functionaries of Delhi Administration, NDMC with MCD’s, are not performing their

official duties and whole Universe going to celebrate International Day for Non Violence,

on the eve of Gandhi jayanti, whereas unlawful slaughter houses are functioning, animals

are abused and man animal conflict increasing day by day.

Respectfully showth:

1. Complainant is a non-official Member of the State Committee for Slaughter Houses

(Govt. of Haryana) and this Committee fully Authorized, to get information from

the District Committee for Slaughter House, headed by the Deputy Commissioner,

conduct Inspection and to crack down the unlawful slaughter houses, with the help

of local Enforcement Agencies, where 10 or more animals and birds are being

slaughtered.

O R D E R dated 23-8-2012 in CWP No. 309 of 2003, passed by the Hon’ble

Supreme Court of India:

These writ petitions have been preferred in public interest seeking various

directions to the State Governments as well as to the Union of India, Ministry of

Environment and Forest, Animal Welfare Board of India and other statutory

authorities to effectively implement the provisions of the Prevention of Cruelty to

Animals (Establishment and Registration of Societies for Prevention of Cruelty to

Animals) Rules, 2000 and also the provisions of Environment Protection Act, 1986,

Schedule I, Entry 50 and also Solid Wastes (Management and Handling) Rules,

2000 etc. Further, direction is also sought to ensure that the animals meant for

slaughter are not transported in violation of Transport of Animals Rule, 1978 and

the Prevention of Cruelty to Animals (Transport on Foot) Rules, 2000. Further,

prayers have also been made to ensure that the recognized slaughter houses are in

conformity with the provisions of the Prevention of Cruelty to Animals (Slaughter

House) Rules, 2000 and also for other consequential reliefs. A detailed affidavit has

been filed by the Central Pollution Control Board (for short CPCB) as early as in

October, 2003 wherein they have categorically stated as follows:

The CPCB is of the view that the slaughter houses generate substantial quantities of

effluents and solid wastes. These slaughter houses causes’ nuisance by way of foul

smell due to improper handling. It is, therefore, necessary that these units should

install pollution control devices so that they can comply with the prescribed

standards. Further, it was stated that the existing slaughter houses need to

modernize their operations with greater emphasis of utilization of waste to reduce

environmental problems and to maintain hygienic conditions. It is also pointed out

that most of the slaughter houses in the country are very old and operate without

basic amenities such as proper flooring, water supply, ventilation etc., and there is

no need to upgrade old slaughter houses on modern lines. Therefore, the CPBC

submitted that all the slaughter houses in the country should comply with the

prescribed standards. The local municipal agencies and concerned police should

ensure that no illegal slaughtering takes place and also the units conform to the

standards set by the State Pollution Control Boards and

Pollution Control Committees. This Court has passed various orders alerting the

State Governments to properly implement the various provisions referred to

hereinbefore but still no effective steps have been taken by various States either to

constitute Committees or to see that the slaughter houses are functioning in

accordance with the rules framed. The matters have again come up for hearing

today. Learned senior counsel appearing for the Ministry of Environment and

Forest (MoEF) brought to our knowledge a decision taken by the MoEF under the

Chairmanship of Secretary, Ministry of Environment and Forest on 26.04.2012. In

the meeting, the CPCB has presented its status of 15 States whereas the Ministry of

Labour gave a status of 20 States and the action plan was also discussed. After

examining the matter in depth by the Committee, they found the necessity of

constituting State Committee for slaughter houses to fulfill the mandatory

requirements under the various legislations dealing with the functioning of the

slaughter houses in the country. The decision of dated 26.04.2012 is extracted

hereunder for easy reference:-

"1. CPCB will write to all States informing about its guidelines for slaughter houses.

[Action: CPCB)

2. CPCB will also initiate action against all slaughter houses which are not meeting

the norms and implement the abattoir rules through SPCB. It was discussed that

SPCB even has powers to close slaughter houses under these rules.

[Action: CPCB)

3. States to be requested to constitute State Committee for Slaughter Houses as

follows:

i) Secretary of the Department of Urban Development of the State-Chairman.

ii) Rep. Department of Health.

iii) Rep. Department of Animal Husbandry.

iv) Rep. Department of Labour.

v) Food Safety Commissioner representing Central Food Safety and Standard

Authority of India.

vi) Rep. State Pollution Control Board.

vii) Rep. State Animal Welfare Board.

viii) Rep. of State Police.

ix) 2 prominent persons nominated by state government.

x) Such other officers and experts as the members may choose to co-opt.

4. Functions of the State Committee for Slaughter Houses so constituted may be as

following:

i) to identify and prepare a list of all the Slaughter Houses (S.H.s) located within the

local self Govt. (Municipal Corporations, Panchayats etc.)

ii) to call for reports from the District Magistrate or the Dy. Commissioner and

District Food Safety Inspector as the case may be on the condition/functioning of the

S.H.s and also on the compliance of the relevant applicable laws.

iii) to recommend modernization of old slaughter houses (S.H.s) and to relocate

S.H.s which are located within or in close proximity of a residential area.

iv) to recommend appropriate measures for dealing with solid waste, water/air

pollution and for preventing cruelty to the animals meant for slaughter.

v) to carry out surprise & random inspections of S.H.s regularly and to issue

directions for compliance of the recommendations that may be made by it.

vi) to send bi-annual reports on the state S.H.s to the Central Committee and to

refer issues that may require Central Committee recommendations or Central Govt.

assistance.

vii) to accord final approval for licensing of S.H.S to Local Self Govt.

viii) to identify on an ongoing basis, the unlicensed slaughter houses in the region,

and other unlicensed, unlawful establishments where animals are being slaughtered,

on howsoever a small scale, and take the help of the District Magistrate and other

law enforcement agencies to crack down on the same.

viii) To check for child labour.

Learned counsel appearing for the petitioners also pointed out the necessity of

including the Secretary, Local Self Government as well as the Secretary, Panchayat

Raj also as Committee Members for effective implementation of the various

legislations. Further, it was also pointed out that even though the decision was taken

by the MoEF on 26.04.2012 the same was forwarded to various State Governments

only on 2.7.2012 and so far no effective steps have been taken by the State

Governments to constitute the Committee and to take further follow up action. The

functions to be discharged by such Committees have also been dealt with in the

meeting held on 26.04.2012 for proper implementation. The early constitution of the

committees is, therefore, highly necessary for proper and speedy implementation of

the rules under the various enactments. In such circumstances, we are inclined to

give direction to all the State Governments and the Union Territories to constitute

the State Committees for slaughters houses, as decided in the meeting held on

26.04.2012, including the Secretary, Local Self Government as well as Secretary,

Panchayat Raj as Members of the Committee over and above the Members already

mentioned. Since the matter is pending in this Court for a number of years, we are

inclined to give directions to the State Governments and the Union Territories to

constitute the Committees within a period of one month and report compliance.

Further, we also direct CPCB to write to all the State Governments informing about

the guidelines for slaughter houses as well as to initiate action against all slaughter

houses which are not meeting the norms and implement the abattoir rules through

State Pollution Control Board (SPCB). The CPCB will initiate steps within a period

of two weeks from today. The CPCB is also directed to submit its report within a

period of one month.

2. Central Government Act: Section 133 in The Code Of Criminal Procedure, 1973;

133. Conditional order for removal of nuisance -

(1) Whenever a District Magistrate or a Sub- divisional Magistrate or any other

Executive Magistrate specially empowered in this of behalf by the State

Government, on receiving the report of a police officer or other information and on

taking such evidence (if any) as he thinks fit, considers-

(a) that any unlawful obstruction or nuisance should be removed from any public

place or from any way, river or channel which is or may be lawfully used by the

public; or

(b) that the conduct of any trade or occupation, or the keeping of any goods or

merchandise, is injurious to the health or physical comfort of the community, and

that in consequence such trade or occupation should be prohibited or regulated or

such goods or merchandise should be removed or the keeping thereof regulated; or

(c) that the construction of any building, or, the disposal of any substance, as is

likely to occasion configuration or explosion, should be prevented or stopped; or

(d) that any building, tent or structure, or any tree is in such a condition that it is

likely to fall and thereby cause injury to persons living or carrying on business in

the neighborhood or passing by, and that in consequence the removal, repair or

support of such building, tent or structure, or the removal or support of such tree, is

necessary; or

(e) that any tank, well or excavation adjacent to any such way or public place should

be fenced in such manner as to prevent danger arising to the public; or

(f) that any dangerous animal should be destroyed, confined or otherwise disposed

of, such Magistrate may make a conditional order requiring the person causing such

obstruction or nuisance, or carrying on such trade or occupation, or keeping any

such goods or merchandise, or owning, possessing or controlling such building, tent,

structure, substance, tank, well or excavation, or owning or possessing such animal

or tree, within a time to be fixed in the order-

(i) to remove such obstruction or nuisance; or

(ii) to desist from carrying on, or to remove or regulate in such manner as may be

directed, such trade or occupation, or to remove such goods or merchandise, or to

regulate the keeping thereof in such manner as may be directed; or

(iii) to prevent or stop the construction of such building, or to alter the disposal of

such substance; or

(iv) to remove, repair or support such building, tent or structure, or to remove or

support such trees; or

(v) to fence such tank, well or excavation; or

(vi) to destroy, confine or dispose of such dangerous animal in the manner provided

in the said order; or, if he objects so to do, to appear before himself or some other

Executive Magistrate subordinate to him at a time and place to be fixed by the

Order, and show cause, in the manner hereinafter provided, why the order should

not be made absolute.

(2) No order duly made by a Magistrate under this section shall be called in question

in any Civil Court. Explanation- a “public place “includes also property belonging

to the State, camping grounds and grounds left unoccupied for sanitary or

recreative purposes.

3. In your jurisdiction, neither have legal slaughter house, functional Infirmaries and

effective Society for Prevention of Cruelty to Animals – SPCA.

4. The Prevention of Cruelty to Animals Act, 1960 read with the rules made out as per

section 38 of the said legislation, being ignored by the respondents;

A. Establishment of SPCA Rules, 2001.

B. Slaughter House Rules, 2001.

C. Cattle Transport Rules, 1978 amended in 2001.

D. The Animal Birth Control (Dogs) Rules, 2001.

E. The Prevention of Cruelty to Animals (Registration of Cattle Premises) Rules, 1978.

F. The Prevention of Cruelty to Drought and Pack Animals Rules, 1965 amended 1968.

G. The Prevention of Cruelty to Animals (Transport of Animals on Foot) Rules, 2001.

H. The Performing Animals (Registration) Rules, 2001.

5. Delhi Motor Vehicle Rules. It would also be pertinent to mention here that the Govt. of

India, Ministry of Road Transport and Highways amended its Motor Vehicle Act and

animals and birds can be shifted as per their shape and size, in ISI specified vehicles.

6. FSSAI and APEDA also issued guidelines about functioning of slaughter houses and

shifting of animals and birds.

PRAYERS:

1. Issue directions, to identify the unlawful meat shops cum slaughter houses, in rural

and urban areas of the District and then crack down the same, as per orders passed

by the Hon’ble Supreme Court of India, as per time frame policy.

2. Issue directions, for strict compliance of all legislation’s concerned about animal

welfare, during their shifting in non ISI specified goods transport vehicles.

3. Issue directions, for proper functioning of Infirmaries and SPCA’s.

4. Issue directions, to issue licenses, to all eligible persons, applied to trade meat, as per

set procedures, rules and regulations enforced, meat shops / slaughter house may be

shut down on the eve of International Day for Non-Violence.

5. Issue directions, to upgrade existing Slaughter House and make it functional, as per

set procedure, rules and regulations enforced.

6. Issue directions, to look after the census of animals, for further protection and

prohibition of the slaughter, keeping in view the census of animals, productive

animals and birds should not offered to slaughter, pre-mortem and post-mortem be

mandatory before slaughtering, ban the supply of unhygienic meat for human

consumption, Introduce strong legislation’s for animals welfare.

7. Issue directions, to identify Child labour, rescue them for further rehabilitation.

8. Issue directions, to develop the mechanism of demand and supply of meat and

chicken, within the jurisdiction of each District’s, because concerned Authorities

should know the actual demand of meat consumption in the area. It would also be

pertinent to mention here that Gazipur slaughter house, have three shifts, two for

local consumption, without knowing demand and third for export for personnel

gain and profit, whereas animals and birds are being brought in very cruel manner,

without verifying pre transport permit, as required under section 96 of the Cattle

Transport Rules, 1978 amended in 2001 and 2009.

9. Agreement and allotment of all unlawful and illegal slaughter houses cum meat

shops needs to be cancelled at once, Government property and shop premises be get

vacated, in case of Government bodies.

10. All encroachments with unlawful slaughter houses / meat shops needs to be crack

down without any further delay, appointing Duty Magistrates.

11. Intensive National Cleanliness Campaign be given top priority with International

Day for Non-Violence, mobilizing NGO, NSS, Eco / Rotary clubs and Nehru Yuva

Kendra’s etc, including Panchyati Raaj with Local Bodies Institutions.

12. Poultry birds does not have any rules and regulations for their slaughtering, as it

cannot covered under the definition of cattle, whereas animals and birds can’t

treated as goods being living creatures, who have feelings and they can travel as per

their shape and size instead by weight, bye laws be prepared for poultry birds,

whereas in Delhi, poultry birds are treated as agriculture product, which is totally

wrong and objectionable, living creature, can’t be treated as agriculture product.

13. Training workshops on animal rights and their welfare be arranged regularly, as

per decision of the State Committee for Slaughter houses, for Civil / Police and

Judicial Officers.

14. Article 51 A (g) of Indian Constitution also needs immediate attention; to protect

and improve the natural environment including forests, lakes, rivers and wild life,

and to have compassion for living creatures.

15. Animal birth Control for stray dogs also be implemented along with the rescue of

stray cattle’s from the road and streets, as public nuisance and similar action

required for monkeys as well for further rehabilitation in their natural habitat,

after identification of family adopting scientific methods of capturing.

16. All unlawful dairies also need attention and dislocation from present place to

outside the locality, as per rules and regulations framed by the Government.

17. Ban the presence of Elephant being wild animal, under your jurisdiction.

18. Performances of monkeys are prohibited by the Government, abused dancing

monkey needs immediate rescue for further rehabilitation.

19. Camels are being badly abused by the Circuses, hence permission for performance

with camels may not be granted; introduce camel transportation rules and

regulations.

20. Kite flying is an offense because, as per section 94 of the Delhi Police Act, 1978,

which states that “no person shall fly a kite or any other thing so as to cause danger,

injury or alarm to person, animals or property”, whereas Chinese manza is also

dangerous and threat to public life, even not safe for kite players, being good

conductor of electricity, hence its import be banned.

21. Progress and achievements needs to be reviewed at the level of monthly meetings of

the District Administration all around in Delhi, sub division level as well.

22. Proper coordination amongst all field functionaries also needs to be improved and

need to regulate pet shops and dogs with aquarium fish breeding, whereas Law

Commission of India endorsed vide their report No. 261.

23. Control misuse of oxytocin injections for lactation, unlawful production / trading /

possession along with similar action on polythene as well.

24. Man animal conflict increases day by day, stray cattle, dogs and monkeys creating

public nuisance all around, whereas National Rabies scheme introduced, proper

functioning of SPCA at each District head quarter, likewise MoU was signed

between CZA, WII with University of California, Davis for research on various

aspect related to rhesus macaque.

25. Recharging of ground water also needs immediate attention, whereas concerned

officials are not taking seriously.

26. The cow is a symbol of the Earth, the nourisher, the ever-giving, undemanding

provider. The cow represents life and the sustenance of life. Just as a liberated soul

gives freely of his spiritual knowledge, so too does this gentle and generous animal

who takes nothing more than water, grass and grain, and gives unstintingly all

through her life. The cow is vital to life and sustenance. She is a symbol of grace and

abundance, and embodies the virtues of gentle selflessness. The cow is a uniquely

Indian symbol, revered and protected down the ages by Hindu and Mughal rulers

alike. She became a point of honour during India’s freedom struggle and her

protection was unanimously included in the Indian Constitution by our Founding

Fathers, the Haryana 'Gauvansh Sanrakshan and Gausamvardhan' Bill, passed by

the Haryana Legislative Assembly but not yet implemented like Camel protection

bill of Rajasthan, like wise Cow progeny may kindly be declare as state animal of

Delhi.

27. Replace toothless Prevention of Cruelty to Animals Act, 1960 with the draft of

Animal Welfare Act, under consideration with the Govt. of India, being animal as

state subject.

28. Environment Ministry bans multidose vial of Diclofenac to save vultures:

Keeping in view the severity of the situation and the need to conserve and protect

vultures from extinction, the Ministry of Environment, Forest and Climate Change

has requested the Ministry of Health and Family Welfare to restrict the pack of

Diclofenac for human use in single dose only. Earlier, the Ministry of Environment,

Forest and Climate Change, in consultation with the Ministry of Health and Family

Welfare, published a Gazette notification no G.S.R 558 (E) dated 17th July, 2015,

regarding the restriction on packaging of multi-dose vial of Diclofenac to single dose

for human use. Even after banning the use of Diclofenac for veterinary use, the

multi-dose vials available in the market for human use were widely misused for

veterinary purpose. This, in turn, has a severe impact on the population of vultures.

The commonly-used anti-inflammatory drug for cattle is considered the chief cause

for the steep decline in the number of vultures in recent years. The drug is harmless

to the cattle it is administered to, but is fatal for the vultures, who routinely feed on

the carcass of dead cattle. Studies have shown that the drug causes kidney and liver

failure in vultures.

Earlier, in 2006, the Government of India had imposed a ban on the use of

Diclofenac for treating cattle.

29. In a bid to control illegal slaughter of animals on Eid ul-Zuha or Bakrid, the

environment ministry has asked all state governments to ensure that no illegal

killing of animals, including cows, takes place, and that animals are not subjected to

cruelty during transportation. “It is a fact that large numbers of animals are

slaughtered during Bakrid festival. Kindly note that as per Rule 3 of the Prevention

of Cruelty to Animals Rules, 2001, no person shall slaughter any animal within a

municipal area except in a slaughter house recognized or licensed by the authority

concerned,” read a letter sent by the Animal Welfare Board of India (AWBI) to all

states ahead of Bakrid, which was celebrated on 25 September. The letter dated 17

August has been sent to chief secretaries, directors general of police and the animal

husbandry departments of states. “no animal which is pregnant, has an offspring

less than three months old or is under three months of age and has not been certified

by a veterinary doctor to be in a fit condition to be slaughtered shall be

slaughtered,” the letter said. Bakrid is one of the major festivals of Muslims, during

which animals are sacrificed. AWBI, which is under the environment ministry’s

control, also asked states to ensure that animals are not subjected to any cruelty

during transportation. “It is reported that during the transportation of animals, the

owners of the animals do not follow the animal welfare laws and Transport of

Animal Rules, which prescribe the number of animals which can be transported in a

vehicle, resulting in cruelty to animals. It is noticed that the animals suffer and are

subjected to various cruelties and some of the animals even die during

transportation,” the letter said. The AWBI directive clarified that “camels cannot

be slaughtered”. “Camels cannot be slaughtered for food at all. Also wherever the

cow slaughter prohibition act is in force, slaughtering of cows should not be allowed

at all,” the letter said. The animal welfare board, a statutory advisory body on

animal welfare laws, urged states to strictly enforce animal welfare legislation.

Quoting several Supreme Court judgments relating to animal welfare, AWBI asked

states to “direct all the authorities concerned to take all precautionary measures to

strictly implement the animal welfare laws to stop illegal killing of animals and to

take stringent action against the offenders” It asked states to inform it of action

taken on the directive, hence it is prayed that what action you have taken, to comply

with the said instructions.

30. IPC 268: Public nuisance.—A person is guilty of a public nuisance who does any act

or is guilty of an illegal omission which causes any common injury, danger or

annoyance to the public or to the people in general who dwell or occupy property in

the vicinity, or which must necessarily cause injury, obstruction, danger or

annoyance to persons who may have occasion to use any public right. A common

nuisance is not excused on the ground that it causes some convenience or advantage.

Bearing in mind that non-violence, tolerance, full respect

for all human rights and fundamental freedoms for all,

democracy, development, mutual understanding and respect

for diversity are interlinked and mutually reinforcing,

Reaffirming the universal relevance of the principle of

non-violence, and desiring to secure a culture of peace,

tolerance, understanding and non-violence,

1. Decides, with effect from the sixty-second session of

the General Assembly and guided by the Charter of the

United Nations, to observe the International Day of Non-

Violence on 2 October each year, with the International Day

being brought to the attention of all people for its celebration

and observance on this date;

2. Invites all Member States, organizations of the United

Nations system, regional and non-governmental organizations

and individuals to commemorate the International Day of

Non-Violence in an appropriate manner and to disseminate

the message of non-violence, including through education and

public awareness;

3. Requests the Secretary-General to recommend ways

and means by which the United Nations system and the

United Nations Secretariat could, within existing resources,

assist Member States, upon request, in organizing activities to

commemorate the International Day of Non-Violence;

4. Also requests the Secretary-General to take necessary

measures, within existing resources, for the observance by the

United Nations of the International Day of Non-Violence;

5. Further requests the Secretary-General to keep the

General Assembly informed at its sixty-third session of the

implementation of the present resolution, within the United

Nations system, as regards the observance of the International

The Delhi Agricultural Cattle Preservation Act, 1994:

Section 2: Definitions, (a) ‘Agricultural Cattle’ means an animal specified in the Schedule;

Section 4: Prohibition on slaughter of Agricultural Cattle.

Note: This section makes it illegal to slaughter agricultural cattle; Notwithstanding anything

contained in any other law for the time being force or in any usage or custom to the contrary, no

person shall slaughter or cause to be slaughtered or offer or cause to be offered for slaughter any

agricultural cattle, section 5: Prohibition on transport or export of agricultural cattle for

slaughter:

Note: This section prohibits the transport or export of agricultural cattle for slaughter. Sub

section (3) states that a person can only export an agricultural animal after getting a permit from

the concerned veterinary officer.

(1) No person shall transport or offer for transport or cause to be transported agricultural cattle

from any place within Delhi to any place outside Delhi, for the purpose of its slaughter in

contravention of the provisions of this Act or with the knowledge that it will be or is likely to be,

so slaughtered.

(2) No person shall export or cause to be exported any agricultural cattle for the purpose of

slaughter either directly or through his agent or servant or any other person acting on his behalf

in contravention of the provision of this Act or with the knowledge that it will be or is likely to

be slaughtered.

(3) Any person desiring to export any agricultural cattle shall apply for a permit to concerned

Veterinary Officer stating the reasons for which they are to be exported and the number of

agricultural cattle with age and sex and also the name of the State/Union Territory to which they

are proposed to be exported and shall further file a declaration to the effect that the agricultural

cattle for which the permit for export is required, shall not be slaughtered.

Section 7:

Prohibition on sale, purchase, disposal in any other manner of agricultural cattle:

Note: This section makes it illegal to buy, sell or dispose of any agricultural cattle if the person

has any reason to believe that such transaction would lead to the agricultural cattle being

slaughtered.

No person shall purchase, sell or otherwise dispose of or offer to purchase, sell or otherwise

dispose of any agricultural cattle for slaughter of knowing or having reason to believe that such

agricultural cattle shall be slaughtered.

Section 8: Prohibition on possession of flesh of Agricultural Cattle:

Note: This section makes it illegal for a person to possess the flesh of any agricultural cattle

which has been illegally slaughtered against the sections of this Act.

Notwithstanding anything contained in any other law for the time being in force no person shall

have in his possession flesh of any agricultural slaughtered in contravention of the provisions of

this Act. Section 9: Prohibition on possession of flesh of Agricultural Cattle slaughtered outside

Delhi. Note: This section makes it illegal for a person to possess the flesh of any agricultural

cattle which was slaughtered outside Delhi, No person shall have in his possession flesh of any

agricultural cattle slaughtered outside Delhi.

Naresh Kadyan, C-38, Rose Apartment, sector-14, Prashant Vihar, Rohini, Delhi - 110085

was born on 10th October, 1961 in village Siwana, now in Jhajjar District of Haryana, he is

a Master Trainer of the Animal Welfare Board of India, had been Nodal Inspecting

Authority for Haryana and adjoining areas of Rajasthan of the Animal Welfare Division

(Govt. of India), Nominee of the CPCSEA, Masters in Journalism and Mass

Communication along with Post Graduate Diploma in J&MC, Diploma in Footwear

Technology along with Advance course with ‘Distinction’ as well, elected as Member of the

Clothing and Footwear Institute, London on November 8th, 1988. He had been a reporter

for the ‘Jagiriti’, a journal of the Khadi and Village Industries Commission – KVIC.

Naresh Kadyan have successfully organized many camps on blood donation, eye donation,

plantation, awareness about social evils like dowry, honour killings, illiteracy, infants

marriage, killing of female child etc. , he has been elected three time state President of the

Haryana Khadi Board Employees Union and founder Secretary General, National Khadi

and Village Industries Board Employees Federation (An apex body of all state’s KVIB

Employees Unions). He has arranged blood donation camp on January 30th, 1996 with the

Haryana Khadi and Village Industries Board at Manimajra, Chandigarh and then on

October 2nd, 1996 with District Administration, Delhi followed by another on October 2nd,

1997.

Naresh Kadyan is a first complainant under the Right to Information Act, 2005 as he has

moved complaint on 19-10-2005, asking about 370 in J&K and compiled a book on animal

related laws in Hindi, like wise he prepared a book on animal slaughtering. Naresh Kadyan

has been Duty Magistrate during prohibition policy in Haryana.

Animals are being abused during transportation, 29 oxen and 59 Rajasthani calves rescued

and then moved campaign to ban animal transportation in goods transport vehicles,

maximum FIR's were lodged against offenders and animals were rescued, then Ministry of

Social Justice and Empowerment (Govt. of India) made a documentary on live raids in

midnight at Bahadurgarh. Naresh Kadyan compiled a book in Hindi on the animal related

laws in India. The National Dairy Research Institute, Karnal injecting Oxytocin injections

for lactation on the Buffaloes but Naresh Kadyan lodged FIR against animal abuse because

it was a crime as per section 12 of the PCA Act, 1960 then he moved public interest

litigation before High Court at Chandigarh. A special cattle train was caught by Naresh

Kadyan on 10th December, 2000 for the violation of the animal related legislation's,

banned oxytocin was recovered which were injected in 5 boogies 65 cows for lactation and

these all accused were punished by the concerned court at Delhi, similar special cattle train

of 40 boogies was also stopped for the violation of animal related laws, FIR was lodged with

the GRP, Gaziabad on 28th December, 2000 and the Allahabad High court upheld the

objections raised by Naresh Kadyan, animals were rescued, handed over to the local

animal shelters. Border Security Force - BSF also shifting camels in a cruel manner from

Rajasthan to Delhi for Republic parade but this animal abuse was exposed by Naresh

Kadyan, in Jammu and Kashmir horses were abused at Katra then Naresh Kadyan moved

first complaint on 19th October, 2005 under Right to Information Act, 2005 raising this

issue because due to special status state as per the Constitution of India, Indian animal

related laws are not enforced over there. Sheep's and Goats are being abused under Indian

Army supply cover but Naresh Kadyan exposed this crime against animals as well. The

Govt. of India made out rules for slaughter houses in 2001 and these rules were

implemented by Naresh Kadyan lodging FIR against illegal slaughter houses in Ballabgarh

(Delhi). Conchs and corals are also banned in India; Naresh Kadyan found these articles in

Kurukshetra, Mathura, Haridwar and legal actions have been initiated.

He has contributed a lot and a man behind rehabilitation of the performing animals like

lion, bear, panther, monkey and bear, due to his efforts all dancing bears are now out from

the Indian roads and streets because he introduced a scheme for rehabilitation of

kalandher along with their performing animals like monkey and bear, later this scheme

was successfully implemented by the Wildlife SOS and Wildlife Trust of India, more than

600 dancing bears rescued and no one left to perform in captivity. He has rescued many

dancing bears from the Kalanders, lodged FIR with the Police Station, Sonipat, Salhawas,

Delhi, Delhi (Haryana) and Shalimar Bagh in Delhi. He played a key role to rescue 29

performing lions and a bear from the Russian Komal circus from Delhi in Haryana, Asiad

circus from Dehradun, Amar circus from Karnal, laxmi female sick elephant was also

rescued from Dhand in Kaithal and same was shifted to Delhi Zoo, which was died later,

Apollo circus at Meerut, and Western circus at Delhi. He has contributed with the ZEE

News to rescue African lion Narsinhma from a farm house of Muzaffar Nagar, this lion

belongs to Asian circus and Naresh Kadyan lodged a complaint against this circus while

stationed at Delhi, owner ran away along with two lions and cub from Delhi, both lions

were died at farm house and cub Narsinhma became adult, same was rescued and

rehabilitated in rescue center at Nahar Garh, Jaipur after lodging FIR against offenders

with Dalanwala Police station.

Naresh Kadyan, a whistle blower of former captain of Indian cricket team Mansur Ali

Khan Pataudi black buck hunting along with two hares in 2005, he took the carcass for

postmortem cum identification of species to Delhi zoo and he is faces criminal proceedings

for his strong activism. Animal Welfare Board of India - AWBI recognized his work

declaring Star of the month, later he strongly opposed accused bail in the High Court at

Chandigarh and raised the jurisdiction issue and get trial shifted from Jhajjar to Special

Environment court at Delhi. A black buck and Chinkara was illegally captured by the Air

Force Station, Sirsa officials and make unrecognized mini zoo within the Air Force station

premises but Naresh Kadyan moved complaint, both animals were rescued and

rehabilitated at Deer park, Delhi. The Chief Wild Life Warden of Haryana failed to take

legal action then he filed a complaint before Special Environment Court at Kurukshetra,

likewise a black buck was hunted in Udmi village of Panipat, FIR was lodged and when due

to politically pressure Administration moved to cancel the case but Naresh Kadyan moved

complaint in this case as well before the Special Environment Court at Kurukshetra. A

black buck was also found in the captivity of a Chairman, Haryana Tourism Corporation's

residence at Dharuheda but same was also rescued and rehabilitated in Delhi zoo by

Naresh Kadyan, due to this strong activism Naresh Kadyan was harassed by then Haryana

Govt. A black buck was captured by the officials of Wildlife science faculty of Aligarh

Muslim University, same was rescued by the UP Wildlife Department without any legal

action against offenders but Naresh Kadyan lodged FIR No. 491 dated 9th July, 2011

against five officials of the faculty as well. Elephant polo was held at Jaipur in 2006 but

Naresh Kadyan raised the issue and then moved public interest litigation about elephant

abuse, Rajasthan High Court - Jaipur Bench banned the operation of Iron Ankush on the

PIL moved by him. Chimpanzee was abused in the feature film Janseen, Elephants in

Jodha Akbar, horses in Drona and all these issues were raised by Naresh Kadyan.

Mongoose is a protected wild animal but people used its hair paint brushes. Naresh

Kadyan moved a campaign in India for awareness and many legal actions were initiated

like huge mongoose hairs along with paint brushes were recovered from Ambala Cantt,

Delhi, Bhiwani, Delhi, Ballabgarh, Narnaul, Rewari, Bahadurgarh in Haryana,

Jahangirpuri in Delhi and in Hyderabad, where as this project was sponsored by the

Wildlife Trust of India.

Leopards are being killed due to conflict between human beings with the wild animals,

leopards were killed at Jind, Karnal, Delhi, Delhi, one was badly beaten in Delhi another

was illegally captured by a farm house owner in Delhi but all these issues were raised by

Naresh Kadyan. Many online petitions successfully operated to get support of local and

International communities, due to his strong campaigning peacock feathers trade was

proposed to be banned, the Prevention of Cruelty to Animals Act, 1960 and the Wild Life

Protection Act, 1972 draft bills were prepared for replacement of PCA Act, 1960 with the

Animal Welfare Act, 2011 and to amend the WP Act, 1972. Adoption of Zoo animals in

Haryana scheme was introduced by the Chief Wild Life Warden and motivation campaign

was initiated by Naresh Kadyan at his own. Elephants can be openly traded from the

official cattle fairs but Naresh Kadyan raised his voice for amendment in the concerned

legislation. He has recovered 30,000 plastic Indian flag before Independence day in Delhi

then mobile fast to get ban on Elephant polo in Jaipur, same was canceled by the Carlsberg

beer, in past Naresh Kadyan moved PIL against Cartier Elephant polo in 2006 and Iron

Ankush was banned by the Rajasthan High Court (Jaipur Bench). Presently he is

campaigning to get ban on meat export and illegal animal slaughtering in Gazipur

Slaughter house in Delhi by Allana’s, Cancellation of White Tiger inbreeding in Madhya

Pradesh, Where as concerned officials are backing it for profit and tourism promotion.

Campaigning for food, water and treatment for Tripoli Zoo animals in Libya during war,

Campaign against Factory Farming in India, FIR has been lodged with the Madhuban

Police station against Rabbit farm and owners were hold guilty, punished as per legal

provisions by the local court, moved petition before the Chief Election Commissioner of

India for freezing the Elephant symbol of BSP, online petition has been delivered to the

Chief Election Commissioner of India on November 3, 2011. Complaint against Jumbo

Circus has been lodged by Naresh Kadyan to rescue blind hippo, docked tail dogs, feathers

chopped birds, abused horses, camels, cats and elephants. Raised his voice against the

National Dairy Research Institute – NDRI, Central Board of Excise and Customs, Income

Tax Department, Delhi State Rifle Association, Haryana Public Service Commission, State

Government of Himachal Pradesh, Tamil Nadu, Kerala, Karnataka, Haryana Police,

Punjab Police, Gujarat Police, Assam Police, Goa Police, Tamil Nadu Police, Delhi Police,

Manipur Police, Kolkata Police, Karnataka State Police, Bangalore City Police, Rajasthan

Police, Utter Pradesh Police, Madhya Pradesh Police, Indian Ordnance Factories (Ministry

of Defense), Jharkhand High Court, Ranchi building and Mizoram Legislative Assembly,

which insulting the National Emblem of India, where as Haryana Police comes forward to

remove the errors after Naresh Kadyan complaint. HE the Governor of Tripura breach the

agreement and violated the set procedure, guidelines of the Government of India being an

Padma Shri awardees but Naresh Kadyan taken up this matter as well, he has further

raised his voice about the rank of the Indian Police, Para Military Forces, the Food Safety

holy Ganga with the full support of International communities, he is the man behind

getting approved of the pension benefits scheme to the Haryana Khadi and Village

Industries Board employees. Many International community’s recommended Naresh

Kadyan, to be a political voice for animals in the Indian Parliament. He successfully

campaign against lifting ban of beef export from India, conducted raids to recover oxytocin

injections from the general merchants in Rewari. Holy lord Buddha image was fixed on

shoes by the USA based ICON but Naresh Kadyan lodged complaint to ban the website

and Face book page in India. The National Defense Academy – NDA, Army Service Core

violated the state emblem legislation but Naresh Kadyan raised his voice against emblem

insult, raised his voice against Jet Airways for killing of two pugs. Farmers of Baghola

village wheat crops was protected from fire by Naresh Kadyan, Pakistani Hindu families

approached him for shelter and same was provided in the Gaushala run and managed by

Kadyan family. The Govt. of Haryana amended the Haryana Cattle Fairs Act, 1970 with

the Haryana Cattle Fairs (Amendment) Bill, 2013 deleting elephant trading in Haryana on

Naresh Kadyan complaint, likewise matter has been taken up with the Govt. of Punjab to

ban Elephant trading, the PMO, Ministry of Information and Broadcasting, Indian

Embassy, Paris, National Commission for Scheduled Caste, Punjab and Haryana Court

website insulted Indian National Flag, matter was taken up with concerned Authorities by

Naresh Kadyan, costly articles were snatched from the pilgrims of Kedarnath in

Uttrakhand during natural calamity; complaint was lodged with Uttrakhand Police by

Naresh Kadyan.

He has managed many PIL’s and online petitions, as he has spent 30 years active service

for the development of Khadi and Village Industries, mankind, animals, wildlife, nature

and society as well, proceed on voluntary retirement on August 7, 2014 from the Haryana

Khadi and Village Industries Board. The Election Commission of India asked INLD about

births for convicted persons in the party.

elephants, introduction of rules and regulations for betterment of animals.

12. Langur was abused in Escorts, Gupta Exim, Prithla, PGI at Chandigarh and another

company in Orangabad, FIR lodged against all offenders by Naresh Kadyan.

13. Oxytocin injections were operated on Buffaloes for lactation by the NDRI, Karnal, FIR

was lodged and then PIL moved in the High Court, directions were issued on this PIL.

14. Wildlife Trophies declaration matter was taken up as per the policy of Ministry of

Environment and Forest and exposed many illegal trophies.

15. Right to Information Act, 2005 was enforced on October 12, 2005 but first petition

moved on October 19, 2005 by Naresh Kadyan directly to the Hon'ble Speaker of Lok

Sabha but same was forwarded to the Ministry of Environment and Forest and

information was supplied.

16. Legislation for exotic animals and birds like Japanese quail, Emu and Rabbits for

commercial breeding in India.

17. Exposed Cruel camel transportation by the BSF for Republic day parade in Delhi,

online campaigns are going on.

18. Two special cattle trains were stopped, offenders booked within 15 days, 40 boogies

cow's train was stopped on December 10, 2000 with FIR in GRP, Delhi and same action on

December 28, 2000 with FIR in GRP, Gaziabad against another 40 boogies special cattle

train, Naresh Kadyan objections were uphold by the Allahabad bench of High court.

before the Chief Judicial Magistrate, Panipat.

32. Freeze elephant as BSP symbol, being an National Heritage animal of India, moved PIL

in the Delhi High court / Chief Election Commission of India.

33. Registry for animal abusers, Jet Airways responsible for two dogs death during its

flight from Mumbai to Delhi, complaint was lodged with the Mumbai and Delhi Police,

Consumer court fined Jet Airways.

35. During natural calamity earth awake in Gujarat, Naresh Kadyan worked for effected

38. African lion Narsinhma rescued from Mujaffarnagar (UP) and sent to Nahargarh

rescue center at Jaipur by the CZA on FIR lodged by Naresh Kadyan.

39. Animals are being badly abused during their shifting in goods transport vehicles,

Naresh Kadyan managed campaign for amendment in the Motor Vehicle Act.

Sonipat Police against begging with Elephant, female elephant was confiscated, like wise

complaint lodged with Dhand Police station in Kaithal, abused Amar circus female

elephant was shifted to Delhi Zoo.

46. The Director General of Supply and Disposal along with the Government of Punjab

insulted the State Emblem of India but Naresh Kadyan lodged FIR against all of them with

the Police Station Model Town, Rewari, likewise Punjab Khadi Board replace its logo.

47. The Broadcasting Content Complaints Council (BCCC) has issued guidelines to 235 TV

networks not to abuse animals, where as Naresh Kadyan opposing animal abuse in live TV

shows since last five years.

48. An injured bird was rescued from the National Institute of Financial Management

(NIFM), during this rescue Langur was found in captivity to keep away common monkey

from NIFM and the same matter taken up with the management under RTI Act, 2005.

49. Naresh Kadyan nominated as a Member, State Committee for Slaughter Houses,
