Pre-application for Open Water Mooring and Anchoring Area
In 2002, the Washington State Department of Natural Resources (DNR) established a new rule to allowresidential uses on state-owned aquatic lands. In order to allow for residential use of vessels outsideshore-based marinas in Eagle Harbor, the City is required under this DNR ruling to identify an open watermoorage & anchoring area (OWMAA) and lease it from the DNR. The DNR rule also sets standards thatthe City must follow for the establishment, management and occupation of an OWMAA.
The City is currently negotiating with the DNR to lease an OWMAA. The City is considering a number ofmooring system options for residential use vessels in the OWMAA, including single-point, double point,linear moorage, and pilings.
The City is asking people to indicate their interest in residential use of an OWMAA by completing this pre-application. Completing the pre-application DOES NOT commit a vessel owner to apply for moorage inthe OWMAA, nor will it guarantee the right to secure a moorage in the OWMAA. The City will usesubmitted pre-applications to determine the interest of existing residents in residing in the OWMAA and
the type of moorings residents are interested in.
Those considering applying for a mooring in the OWMAA are asked to submit this pre-application to the
City Clerk by mail to 280 Madison Ave. N., Bainbridge Island, WA 98110 or by hand delivery to theInformation Desk at City Hall between 8 am and 4 pm Monday - Friday.
The deadline to submit the pre-application is September 3, 2010.
The City will then use the pre-application information to begin developing OWMAA designs andinfrastructure cost estimates. If an OWMAA is established incorporating residential use, individuals whohave expressed their interest through a pre-application will be notified of the opportunity to submit a
formal application to establish a City Moorage Agreement.
Residents of the OWMAA would benefit from having a legal mooring not subject to Washington Statetrespass statutes, as well as having access to City park restrooms and showers, upland trash receptaclesand the city dock pump-out.
To qualify for a moorage in the OWMAA, applicants will be required to:
Comply with all federal, state and local laws pertaining to vessel registration, waste dischargeregulations, noise and nuisance regulations and other existing or future laws governing the waters of
Eagle Harbor.
Fulfill all requirements of the City Moorage Agreement, which will specify the rules pertaining to marinatenancy. These will include regulations having to do with waste water handling, permitted activities,upland parking of vehicles, required safety equipment, moorage fees, dinghy dockage, etc.
Agree to move their vessel to a mooring location specified by the City, and take responsibility forremoving 1) all old moorings, anchors and ground tackle from their previous moorage, and 2) any floats
or rafts tied to their main vessel.

The following table reflects the expected lease rate cost for a 30 foot or 40 foot vessel in the proposedOWMAA based on the specific mooring method used. These lease rate costs were provided to the City ofBainbridge Island by the Department of Natural Resources and only apply to the cost of leasing the
space. Actual lease rates will be determined based on the length and beam of your vessel, and may beslightly higher due to nominal additional costs for services such as waste management andadministration. If rafting of vessels is approved as part of the OWMAA plan, there will be an additionalcost to a resident who chooses to raft, which would be determined by the additional area encumbered by
the rafted vessel.
