    ITEM NO: 10.1 SYNOPSIS: A Development Application for Lot 2564 (27) Pett Street and Lot 4971 (30) Styles Street Alawa, Town of Nightcliff (Attachment A) has been referred to Council for comment pursuant to Section 48 of the Planning Act. The following report addresses relevant Council issues and recommends that Council endorse comments provided to the Development Consent Authority by staff. GENERAL: Applicant: Mr Paul James Zone: CP (Community Purpose) Area: 6.7ha Proposal Consolidation of lot number 2564 (currently Alawa Primary School) and lot 4971 (currently Alawa Preschool), into one lot and then subdivide the remnant parcel into two lots. The proposed subdivision will allow for the relocation of the Nemarluk School. Site and Surrounds The subject site is identified as lot numbers 2564 and 4971 Town of Nightcliff, commonly referred to as 27 Pett Street and 30 Styles Street Alawa. The site is relatively flat and comprises existing buildings, which operate as a primary school (Lot 2564) and a preschool (Lot 4971) and also a sporting oval. The area is zoned CP (Community Purpose) and is predominantly surrounded by land zoned SD (Single Dwelling). There are small areas of land zoned PS (Public Open Space) located at the East and West end of the site. The site has frontages to

    LOTS. Stedcombe Street on the northern boundary, Pett Street on the southern boundary and Styles Road to the western boundary. Proposed Lot 1 will be approximately 4.6ha and proposed Lot 2 will be approximately 2.1ha. Proposed Lot 1 will continue as a primary school and Lot 2 will accommodate the relocated Nemarluk School. Matters to be taken into account (pursuant to Section 51 of the NT Planning Act 1999): Northern Territory Planning Scheme: The proposed development is in the CP (Community Purpose) zone, and requires consent to subdivide. Council Issues: To ensure stormwater from the individual lots is capable of being operated independently, and to the satisfaction of Council, it is recommended that a schematic plan demonstrating that all stormwater to be collected on the site and discharged underground to Council’s stormwater drainage system be provided as requested in the letter to the Consent Authority. The application indicates that access to the proposed Nemarluk School will be primarily off Styles Street, with a secondary access off Stedcombe Street. The appropriateness of these access points will be assessed during the development phase. Disability Discrimination Legislation: Disability Discrimination Act issues are addressed under the Building Act requirements. Council places a statement of support for equal opportunity on all responses. FINANCIAL IMPLICATIONS: Nil.     ITEM NO: 10.2 SYNOPSIS: A Development Application for Lot 8019 (3) Mitaros Place, Town Of Darwin (Attachment A) has been referred to Council for comment pursuant to Section 48 of the Planning Act. The following report addresses relevant Council issues and recommends that Council endorse comments provided to the Development Consent Authority by staff. GENERAL: Applicant: Mr Kevin Dodd Zone: MR (Medium Density Residential) Area: 3210 m2 Proposal: Unit Title subdivision of previously approved residential units to create 30 lots. History: In 2008 the Development Consent Authority issued Development Permit DP08/0265 approving the development of Lot 5602, for the purpose of 48 x 2 and 72 x 3 bedroom multiple dwellings and 42 x 2 bedroom 2 keyed serviced apartments with ancillary café/restaurant. The DCA also issued DP08/0375 approving the subdivision of Lot 5602 to create 5 lots and common property in accordance with the provisions of the Unit Titles Act. Lots 8018 to 8022 were created and the common property component was designated as lot number 8023.

    UNIT TITLE SUBDIVISION TO CREATE 30 LOTS. One of the 4 storey buildings approved by DP08/0265 is nearing completion on Lot 8019 and in order to obtain separate titles for the units the approval of the DCA is required. Site and Surrounds The subject lot is zoned MR (medium Density Residential). Development approved under DP08/0265 (30 multiple dwellings in a 4 storey building) is currently nearing completion on the site. Development approved under the same application is also currently under construction on surrounding lots 8018 to 8022 (formerly of Lot 5602). The subject site is accessed from Parap Road via Lot 8023, which has been set aside as common property in favour of the surrounding lots. Approved for the surrounding lots is a mix of multiple dwellings, serviced apartments and a café (subject to a recent application for change of use to an office). Matters to be taken into account (pursuant to Section 51 of the NT Planning Act 1999): Northern Territory Planning Scheme: The proposed development is in the MR (Medium Density Residential) zone, and requires consent to subdivide. Council Issues: The application has been assessed against section 11.1.4 Subdivision for the purpose of Unit Title Scheme of the NT Planning Scheme. In accordance with the Scheme the proposal was found to have appropriately assigned common facilities within common property and divided the 60 car parking bays evenly amongst the 30 residential apartments. The site contains a number of easements and it has been requested on comments to the DCA that any easements required for servicing and infrastructure be supplied free of cost to Council. Disability Discrimination Legislation: Disability Discrimination Act issues are addressed under the Building Act requirements. History The Argus Apartments submitted a sign application to Council in April 2009. The application was for one (1) illuminated roof sign at 6.65m wide x 1.8m high (11.97m2), which faced towards the CBD. As this was the only sign applied for at the time and no issues were identified, a signs permit was issued under delegation. Illuminated Business Roof Signs The two (2) proposed illuminated roof signs are to be the same as the existing sign, which is 6.65m wide x 1.8m high (11.97m2). The proposed new signs will be placed on various facades of the building so as to face in different directions. It is proposed that Sign 1 is to be placed on the North-Eastern side of the building, facing toward Tiger Brennan Drive and Frances Bay. Sign 2 is to be placed on the northern side of the building, facing toward the Stuart Highway. The Argus Apartments are located on the corner of Woods Street and Cardona Court. The premises are bordered by other large unit developments in both Foelsche Street and McMinn Street. These units are located immediately adjacent to the Argus Apartments. Notwithstanding that the Argus Apartment development is higher than the surrounding residential developments; the illumination from the two signs may have a negative impact for residents living on the higher floors of these residential units. The illumination from these signs is also expected to effect residents in the unit developments of Carey Street and the northern facing sign will face directly at the Evolution residential development on McMinn Street. With the Argus Apartment development being higher than the immediate residential developments, both the proposed illuminated signs will also be clearly seen by the residents in Duke Street, Stuart Park. Conclusion The proposed illuminated signs are likely to have a detrimental impact on the residential amenity of surrounding and future residential developments. Going Forward The only negative element of this application is the illumination of the sign, which is expected to affect residents in adjoining residential developments. The proposed signs, as detailed in the application, are made from neon tubing. It is recommended that Council approve one (1) non-illuminated sign which can be placed on the roof of the premises, after the receipt of details showing the location, size and the design of the sign.     ITEM NO: 10.4 SYNOPSIS: A Development Application for Lot 6362 (61) Stuart Highway, Town of Darwin (Attachment A) has been referred to Council for comment pursuant to Section 48 of the Planning Act. The following report addresses relevant Council issues and recommends that Council endorse comments provided to the Development Consent Authority by staff. GENERAL: Applicant: Mr Kevin Dodd Zone: SC (Service Commercial) Area: 1906 m2 Proposal: Unit title subdivision to create 15 lots comprising two separate buildings to be located at the northern and southern ends of the lot. The lot will be divided by an area of principal common property where additional car parking, a loading bay, the refuse area and also the transformer will be located. History: Development Application (PA 2010/0294) for two office buildings and associated parking was refused on 9 April 2010, as it failed to demonstrate that a waste collection truck would be able to access and egress the site in a forward gear. Development Permit (DP10/0427), issued on 24 November 2010 and the subsequent variations, approved the development of the site in two stages. (See attached drawings 10/7923/2B, 3B and 8). Stage 1 of the development will comprise the building at the northern end, the entrance off the Stuart Highway, the common facilities used by both buildings and the car park closest to the Stage 1 building.

All other aspects of DP 10/0427 and its subsequent variations remain unchanged. Site and Surrounds: The subject site is identified as allotment 6362, Town of Darwin, commonly referred to as 61 Stuart Highway, Darwin. The allotment is an elongated rectangular shape of 1906m2 with a street frontage to Stuart Highway of 118m. The northern and southern boundaries are 12m and 24m respectively. The rear boundary is 117m and overall the site is relatively flat. An existing single storey shop on the land, is to be demolished as part of DP10/0427. Current access to the site is from the Stuart Highway. No other significant structures exist on the site. The site is within the SC (Service Commercial) zone, as are most sites within the locality that have Stuart Highway street frontage. The rear and northern boundaries abut land owned by the Northern Territory Government, which is zoned PM (Proposed Main Road). Matters to be taken into account (pursuant to Section 51 of the NT Planning Act 1999): Northern Territory Planning Scheme: The proposed development is in the SC zone and requires consent. The Application was assessed against Section 11.1.4, Subdivision for the Purpose of a Unit Title Scheme, of the Northern Territory Planning Scheme. Clause 11.1.4.2 Subject to sub-clauses 3,4,5

    (a) all car parking provided as a requirement of a development must be available

    at all times for the use of the occupants of the development and their visitors or clients and be included:

    i) in common property; or ii) as part of the area under the title for the individual units

    All parking spaces are to be included in the title to respective units.

    (b) any loading bays provided for: i) common use must be in common property; and ii) the sole use of an individual unit must be in the entitlement of that

    unit The loading bay is to be included in common property.

    (c) any areas set aside for the communal storage and collection of garbage and solid waste must be included in common property;

Council Issues: Council’s previous comments to the Development Consent Authority included issues in relation to waste collection truck access and stormwater management. These issues were subsequently resolved under DP10/0427. Details of how the unit title subdivision will independently deal with stormwater drainage have been requested for this application. Disability Discrimination Legislation: Disability Discrimination Act issues are addressed under the Building Act requirements.
