Pursuant to the Debt Collection Act of 1982 (Public Law 97-365) arid regulations of the U.S. Department ofLabor (29 CFR Part 20), the Occupational Safety and Health Administration is required to assess interest,delinquent charges. and administrative costs for the collection of delinquent penalty debts for violations of theOccupational Safety and Health Act.

Interest: Interest charges will be assessed at an aimtial rate detennined by the Secretary of the Treasury on allpenalty debt amounts not paid within one month (30 calendar days) of the date on which the debt amountbecomes due and payable (penalty due date). The current interest rate is one percent (1%). Interest will accruefrom the date on which the penalty amounts (as proposed or adjusted) become a final order of the OccupationalSafety and Health Review Commission (that is, 15 working days from your receipt of the Citation andNotification of Penalty), unless you file a notice of contesL Interest charges will be waived if the fill amountowed is paid within 30 calendar days of the final order.

Delinquent Charges: A debt is considered delinquent if it has not been paid within one month (30 calendardays) of the penalty due date or if a satisfactory payment arrangement has not been made. If the debt remainsdelinquent for more than 90 calendar days, a delinquent charge of six percent (6%) per annum will be assessedaccruing from the dale that the debt became delinquent.

Administrative Costs: Agencies of the Department of Labor are required to assess additional charges for therecovery of delinquent debts. RE: OSHA Inspection No. 1475615

Dear Employer:

An inspection and evaluation of your workplace at 250 Continental Drive, Salem, OH. 44460 onMay 18, 2020 disclosed the following workplace conditions which raise concerns about thepotential for employee illness(es) related to exposure to SARS-CoV-2 (severe acute respiratorysyndrome coronavirus 2), which is the virus causing coronavirus disease 2019 (COVID-19).

1. Employees required to wear N95 respirators i’hile working in a resident carefacility have not been fit tested. Care may be provided to residents who are sickwith COVJD-J9.

2, Employees that wear !V’95 respirators are instructed to utilize N95 respirators forseven days, which could expose them to COVJD-]9 due to a decreased pi-otectioncaused by loss of respirator functionality.

In the course of its investigation, OSHA became aware that employees continued to use N-OSfiltering facepiece respirators for up to seven (7) days or until soiled or damaged. This practicewas also memorialized in an April 15, 2020, memo to the employees which read, in part“Employees were educated on proper/it ofN-95 masks and to near until soiled or damaged. 4surgical mask is issued daily to be uvrn over the top ofN-95”. The practice of an extremely longreuse of this type of respirator carries a significant risk of contact transmission of SARS-CoV-2transmission from touching the surface of the contaminated respirator. Repeated handling of therespirator may also lead to deterioration of straps or fabric, leading to a reduced facial seal andconsequently diminished protective factor. As such, both OSHA in its 20 CFR 1910.134regulation and most manufacturer guidance require inspection of the respirator before each use, toexamine the respirator parts for signs of damage, in order to ensure the continued effectiveness ofthe respirator.

In addition, please be advised that the practice of covering N-95 respirators with a surgical maskmay interfere with the National Institute of Occupational Safety and Health (NIOSH) certificationof that particular type of respirator, particularly in the inhalation and exhalation resistance tests.Please refer to the respirator manufacturer’s guidance for specific User Instructions. Additionalinformation on these tests is found on the NIOSH website at:https://www. cdc. gov/niosh/npptl/stps/apresp.html

“Recommended Guidance for Extended Use and Limited Reuse of N95 Filtering FacepieceRespirators in Healthcare Settings the CDC states “To reduce the chances of decreasedprotection caused hi’ a loss of respirator functionality, respiratory protection program managet-sshould consult with the respirator manufacturer regarding the tnaxinum number of donnings oruses they recommend for the N95 respirator model(s,) used in that facility, If no manufacturerguidance is available, preliminary data suggests limiting the number of reuses to no more thanfive uses per device to ensure an adequate safety margin.”

Based on OSHA regulations and the current CDC guidance, which are listed at the end of thisletter, it is recommended that you take the following steps to materially reduce your employees’exposure to the hazards and conditions listed above:

a) Conduct initial and annual fit testing for those required to wear tight fitting respiratoryprotection as part of a comprehensive respiratory protection program. This is a requirementunder OSHA’s 29 CFR 1910.134 Respiratory Protection standard. During the course ofthe inspection, it was determined that a good faith effort was made to fit test employees butdue to nationwide shortage of fit testing equipment, this was not achieved by the time ofthe OSHA inspection. Continue efforts to acquire this equipment and fit test all affectedemployees at the earliest opportunity.

b) Consider NIOSH-certified elastomeric respirators (e.g., cartridge respirators) for essentialworkers who may have to decontaminate and reuse respirators in the event that there is ashortage of disposable respirators.

c) Follow the employer’s maximum number of uses (or up to five if the manufacturer doesnot provide a recommendation) and recommended inspection procedures.

An inspection and evaluation of your workplace at 2511 Bentley Drive. Salem, 01-1, 44460 onApril 22, 2020 disclosed the following workplace conditions which raise concerns about thepotential for employee illness(es) related to exposure to SARS-CoV-2 (severe acute respiratorysyndrome coronavirus 2), which is the virus causing coronavirus disease 2019 (COVID-19).

1. Employees required to wear N95 respirators while working in a resident carefacility have not been fit tested. Care may be pro vided to residents who are sickwith COVID-J9.

In the course of its investigation, OSHA became aware that employees continued to use N-95filtering facepiece respirators for up to seven (7) days or until soiled or damaged. This practicewas also memorialized in an April 15, 2020, memo to the employees which read, in part:“Employees were educated on proper fit of 1V-95 masks and to wear until soiled or damaged. Asurgical mask is issued daily to be worn over the top ofN-95”. The practice of an extremely longreuse of this type of respirator carries a significant risk of contact transmission of SARS-CoV-2transmission from touching the surface of the contaminated respirator. Repeated handling of therespirator may also lead to deterioration of straps or fabric, leading to a reduced facial seal andconsequently diminished protective factor. As such, both OSHA in its 20 CFR 1910.134regulation and most manufacturer guidance require inspection of the respirator before each use, toexamine the respirator parts for signs of damage, in order to ensure the continued effectiveness ofthe respirator.

In addition, please be advised that the practice of covering N-95 respirators with a surgical maskmay interfere with the National Institute of Occupational Safety and Health (NIOSH) certificationof that particular type of respirator, particularly in the inhalation and exhalation resistance tests.Please refer to the respirator manufacturer’s guidance for specific User Instructions. “Recommended Guidance fbr Extended Use and Limited Reuse of N95 Filtering FacepieceRespirators in Healthcare Settings “. the (‘DC states To reduce the chances of decreasedprotection caused by a loss of respirator functionality, respiratory protection program managersshould consult with the respirator manifacturer regarding the maximum number of donnings oruses they recommend for the N95 respirator model(s) used in that facility. If no manufacturerguidance is available, prcliminary data suggests limiting the number of reuses to no more thanfive uses per device to ensure an adequate safety margin.”

Based on OSHA regulations and the current CDC guidance, which are listed at the end of thisletter, it is recommended that you take the foflowing steps to materially reduce your employees’exposure to the hazards and conditions listed above:

a) Conduct initial and annual fit testing for those required to wear tight fitting respiratoryprotection as part of a comprehensive respiratory protection program. This is a requirementunder OSHA’s 29 CFR 1910.134 Respiratory Protection standard. During the course ofthe inspection, it was determined that a good faith effort was made to fit test employees butdue to nationwide shortage of fit testing equipment, this was not achieved by the time ofthe OSHA inspection. Continue efforts to acquire this equipment and fit test all affectedemployees at the earliest opportunity.

b) Consider NIOSH-certified elastomeric respirators (e.g., cartridge respirators) for essentialworkers who may have to decontaminate and reuse respirators in the event that there is ashortage of disposable respirators.

c) Follow the employer’s maximum number of uses (or up to five if the manufacturer doesnot provide a recommendation) and recommended inspection procedures.
