REQUEST FOR PROPOSALS
Objective
The Ohio Legislative Service Commission (LSC) is a nonpartisan agency that
provides drafting, fiscal, research, training, and other services to the Ohio General
Assembly. LSC is required by Section 5 of Sub. S.B. 332 of the 131st General Assembly
to contract with a nonprofit organization to convene and lead a stakeholder group
concerned with matters regarding the social determinants of health for infants and
women of child-bearing age. The nonprofit organization must prepare a report
containing the stakeholder group's findings and policy recommendations not later than
December 1, 2017. To comply with this statute, LSC is requesting proposals from
nonprofit organizations capable of achieving these tasks.
Background
Commission on Infant Mortality
In 2016, the General Assembly enacted Sub. S.B. 332 of the 131st General
Assembly. This act largely provides for the implementation of recommendations made
by the Ohio Commission on Infant Mortality in a report the Commission issued in
March 2016. (The report is available at this website:
http://cim.legislature.ohio.gov/documents – see "March 2016 Final Report.") The
Commission, created by Am. Sub. S.B. 276 of the 130th General Assembly, has
16 members specified in Revised Code (R.C.) 3701.68(C). When the Commission met in
2016 and early 2017, it also designated other individuals to participate in Commission
meetings depending on the topic of a particular meeting.
In addition to issuing a report in March 2016, the Commission compiled an
inventory of services provided or administered by the State of Ohio that are available to
address the State's infant mortality rate.

Social determinants of health
According to the Office of Disease Prevention and Health Promotion in the
U.S. Department of Health and Human Services, social determinants of health are
conditions in the environments in which people are born, live, learn, work, play,
worship, and age that affect a wide range of health, functioning, and quality-of-life
outcomes and risks. Social, economic, and physical conditions in these various
environments and settings (e.g., school, house of worship, workplace, and
neighborhood) have been referred to as "place." In addition to the more material
attributes of "place," the patterns of social engagement and sense of security and well-
being are also affected by where people live. Resources that enhance quality of life can
have a significant influence on population health outcomes. Examples of these
resources include safe and affordable housing, access to education, public safety,
availability of healthy foods, local emergency and health services, and environments
free of life-threatening toxins.1 More information on social determinants of health is

Scope of work
Summary
LSC is seeking a nonprofit organization to convene and lead a stakeholder group
concerned with matters regarding the social determinants of health for infants and
women of child-bearing age. The nonprofit organization is responsible for determining
the stakeholder group's membership and who should be invited to participate in the
group's discussions. However, the group's membership must include a representative
from a metropolitan housing authority that operates at least 1,000 units in Ohio. The
group's membership also should include individuals who represent the five key areas
of social determinants of health identified by the U.S. Department of Health and
Human Services' Healthy People 2020 initiative: economic stability, education, social
and community context, health and health care, and neighborhood and built
environment.

The stakeholder group must do all of the following, as required by Section 5 of
Sub. S.B. 332 of the 131st General Assembly:
(1) Review policies and programs in Ohio that impact the social determinants of
health for infants and women of child-bearing age, particularly programs
intended to improve educational attainment, public transportation options,
housing, and access to employment;
(2) Identify opportunities to improve the programs and policies described
above;
(3) Study the impact of using a state-funded rental assistance program targeted
at infant mortality reduction; and
(4) Evaluate best practices other states have implemented to improve the social
determinants of health for infants and women of child-bearing age.
Not later than December 1, 2017, the nonprofit organization must submit a report
to LSC that summarizes the stakeholder group's findings and makes policy
recommendations based on the findings. The report also must be submitted by that date
to the Governor, President of the Ohio Senate, Minority Leader of the Ohio Senate,
Speaker of the Ohio House of Representatives, and Minority Leader of the Ohio House
of Representatives.
Specific deliverables and funding
The deliverables and installment payment associated with each deliverable shall

Proposal submissions
Through this Request for Proposals (RFP), LSC seeks to contract with a nonprofit
organization capable of achieving the deliverables specified above. To this end, a
proposal must include all of the following:
A cover page as specified in Appendix A.
An overview of the organization, including its purpose or mission,
management structure, affiliations with other entities, and funding sources.
A résumé or curriculum vitae and contact information (including office
address, telephone number, and email address) for the proposed project
leader and all other staff of the organization who will work on the project.
A description of relevant skills and previous experience of the proposed
project staff, including details regarding their experience with:
o Data extraction, compilation, and analysis;
o Analysis of health disparities and health equity;
o Studying and providing policy suggestions regarding population
health management and social determinants of health; and
o Convening, leading, and communicating effectively with stakeholder
groups.
A proposed work plan that describes how the organization intends to
complete the work outlined under "Scope of work," above. Specifically, for
each deliverable, the work plan must identify:
o The human and other resources the organization intends to use (both
from within and outside of the organization);
o Locations where meetings and work are to occur;
o The research to be completed and the organization's research design,
including data and other information the organization intends to
collect and analyze; and
o A timetable for completing the deliverable.
If the organization intends to collect or use individually identifiable data or
information or data about small groups of individuals, the state and federal
regulatory requirements that may apply to the collection and use of that data

and information, the organization's protocol for addressing compliance with
those requirements, and how the organization de-identifies such data and
information.
If the organization intends to collect or use information on human subjects,
the organization's plan for working with an institutional review board or
similar oversight committee.
A description of the organization's record management process, including
how long the organization would maintain data, information, and records
associated with the project and a plan for disposing of those materials in a
secure manner.
Descriptions and examples of reports or similar projects the organization has
completed in the last five years.
A detailed proposed budget and narrative that includes all costs, including
any travel. (The organization awarded the contract will not be reimbursed for
travel, lodging, or other expenses separately from the installment payments
specified under "Scope of work," "Specific deliverables and funding,"
above.)
Evidence of the organization's nonprofit status with the Ohio Secretary of
State or the secretary of state or corresponding agency of another jurisdiction
if the nonprofit organization is organized in a jurisdiction other than Ohio.
For purposes of this RFP, a "nonprofit organization" includes a public
university in Ohio or another jurisdiction or a research institute or similar
entity under the auspices of such a university.
Disclosure of any interest that the organization (or any person or entity
affiliated with or employed by the organization) may have that could create a
conflict of interest or the appearance of a conflict of interest relevant to this
project. Please include a copy of any policy, procedure, or protocol the
organization has adopted to ensure compliance with any applicable state or
federal ethics laws or regulations.
A description of the organization's policies, procedures, or protocols for
managing, storing, organizing, and retaining documents relating to the
project, as well as for ensuring compliance with the Ohio Public Records Law
(R.C. 149.43) (see "Public record information," below).

Proposals must be received not later than April 7, 2017, at 1:00 p.m., Eastern
Daylight Saving Time. A proposal submitted by U.S. mail must include six copies. A
proposal submitted by email must be in PDF format. LSC will notify each responding
organization of its receipt of the proposal, or if a proposal has been rejected for being
late or incomplete or for any other reason.
A proposal may be withdrawn up until the date and time set for delivery of the
proposals. No organization may submit more than one proposal. No RFPs received by
LSC will be returned.
LSC reserves the right to cancel the RFP at any time before the date and time set
for delivery of proposals.
Scoring criteria and weights
All bids will be reviewed by a subcommittee of LSC staff and its director. LSC
will score proposals that have not been rejected. The scoring criteria and weights to be
applied are as follows:

The perceived ability of the organization to professionally complete each deliverable in this RFP on time, within budget, and in a manner that will produce a high quality report that policymakers will find useful.
Evidence of other similarly sized projects completed within the past five years that demonstrate the organization's expertise in providing the type of deliverables identified in this RFP on time and within budget.

The proposal's completeness and cost-effectiveness. 40 points
Evidence of the organization's experience engaging in social policy research concerning Ohio residents.

Terms and conditions
For purposes of this RFP and any ensuing contractual relationship, LSC reserves
the right to:
(1) Reject any proposal and waive minor irregularities in a proposal
(2) Negotiate the final scope of work with the selected organization;
(3) Request clarification from a responding organization regarding information
submitted as part of a proposal, as well as request additional information
from an organization;
(4) Award the contract to the next most qualified responding organization, if the
selected organization does not execute a contract within 15 days after being
notified of being selected; and
(5) Reject a proposed contract that does not conform to the specifications in this
RFP.
Budget and payment
The maximum amount that LSC has legal authority to make available for this
project is $500,000. As a steward of taxpayer dollars, LSC would prefer to spend less
than this amount. LSC does not have any other funds available for this project and
organizations should not submit a proposal unless they can meet LSC's project budget.
LSC will make payments to the organization in five installments, the exact dollar
amount of each to be determined at the time of the contract. Except for the initial
installment payment made on the contract's effective date, the organization is required
to submit to LSC an invoice summarizing the work completed before the other
installment payments will be made. The selected organization's right to an installment
payment is contingent on the organization's satisfactory performance of each
deliverable associated with the installment payment, as specified under "Scope of
work," "Specific deliverables and funding," above.
Subcontracting
The organization may subcontract any of its obligations under the contract with
LSC's written permission. If an organization proposes to subcontract any part of the
work, the organization's proposal must include a subcontracting plan. The
subcontracting plan must identify all vendors that are proposed as subcontractors for
the project, and must include a description of each subcontractor's role, qualifications to

perform that role, management structure, key staff assignments, and qualifications of
assigned staff.

Warranties and certifications
By submitting a proposal, the responding organization does all of the following:
(1) Certifies that it is eligible for award of a contract by LSC, pursuant to
R.C. 9.24, 9.76, 125.111(B), 125.25, and 153.02.
(2) Certifies that it possesses all approvals, licenses, or other qualifications
needed to conduct business in Ohio.
(3) Certifies that it has read the RFP, understands it, and agrees to be bound by
its requirements.
(4) Certifies that it has not included any legal terms or conditions for the
contract in its proposal.
(5) Certifies that it has familiarized itself with the ethics statutes governing state
employees and appointees, including those concerning employment of
former government employees, gifts, and lobbying.
(6) Acknowledges that LSC staff may attend stakeholder group meetings, but
will not provide staffing, research, or other resources for the project.

(7) Agrees to all of the following, if the organization is awarded a contract
ensuing from this RFP:
--To negotiate the contract in good faith in a form approved by LSC.
--To not discriminate, by reason of race, color, religion, sex, age, disability,
military status, national origin, or ancestry, against any Ohio citizen in
the employment of any person qualified and available to perform work
under the contract or, if applicable, a subcontract.
--To notify LSC in writing if any employee or contractor of the
organization is an Ohio Public Employees Retirement System (OPERS)
retirant.
--To be subject to Ohio law and the jurisdiction of a court of proper
jurisdiction in Franklin County, Ohio, in the event of a dispute.
--To indemnify and hold LSC and the State of Ohio harmless and immune
from any claim for injury or damages arising from an ensuing contract
that is attributable to the organization's own actions or omissions or
those of its trustees, officers, employees, subcontractors, suppliers,
third-party agents, or joint ventures while acting under the contract.
(Such claims must include any claims made under the Fair Labor
Standards Act, any other federal or state laws on wages, overtime, or
employment matters, or claims involving patents, copyrights, or
trademarks.)
--To bear all costs associated with defending LSC and the State of Ohio
against a claim resulting from the contract.
--To comply with all applicable federal, state, and local laws, rules,
regulations, and ordinances.
--To notify LSC immediately in writing and cease further performance of
work under the contract if the organization is disqualified from doing
business in Ohio at any time during the contractual period.
--To make no news releases pertaining to the award of this solicitation
without LSC's prior approval.

Public record information
LSC is subject to the requirements of the Ohio Public Records Law, R.C. 149.43.
Accordingly, responding organizations must understand that information and other
materials submitted in response to this RFP or in connection with any contract resulting
from this RFP may be subject to disclosure as a public record, except to the extent the
materials are protected from disclosure by applicable state or federal laws.
By submitting a proposal, the organization agrees that if, after a request for
disclosure, litigation is brought attempting to compel production of the materials or to
protect the materials from production, the organization must be solely responsible, at its
sole cost, for any defense, and for establishing the basis for nondisclosure of the
information. If an appropriate tribunal determines that the information must be
disclosed or fails to protect the information from disclosure, LSC will release the
materials and the organization must indemnify and hold LSC harmless and immune
from any and all claims for injury or damages arising out of the litigation including, but
not limited to, attorneys' fees.

Appendix C: Section 5 of S.B. 332 of the 131st General Assembly
Section 5. (A) Not later than thirty days after the effective date of this section, the
Legislative Service Commission shall contract with a nonprofit organization to convene
and lead a stakeholder group concerned with matters regarding the social determinants
of health for infants and women of child-bearing age. The stakeholder group shall do all
of the following:
(1) Review state policies and programs that impact the social determinants of
health for infants and women of child-bearing age, particularly programs intended to
improve educational attainment, public transportation options, housing, and access to
employment;
(2) Identify opportunities to improve the programs and policies described in
division (A)(1) of this section;
(3) Study the impact of using a state-funded rental assistance program targeted
at infant mortality reduction;
(4) Evaluate best practices other states have implemented to improve the social
determinants of health for infants and women of child-bearing age.
(B)(1) The nonprofit organization shall determine the stakeholder group's
membership and who should be invited to participate in the group's discussions.
(2) The stakeholder group shall include a representative from a metropolitan
housing authority that operates at least one thousand units in this state.
(C) Not later than December 1, 2017, the nonprofit organization shall submit a
report to the Governor and General Assembly that summarizes the stakeholder group's
findings and makes policy recommendations based on the findings. The report shall be
submitted to the General Assembly in accordance with section 101.68 of the Revised
Code.
(D) The Legislative Service Commission shall use up to $500,000 to contract with
the nonprofit organization.
