record a search. Searches may also be madeagainst other insurers’ databases. If fraud issuspected, information will be shared withthose insurers. Other users of the fraudprevention agencies may use this informationin their own decision making processes.

Wemay also conduct credit reference checks incertain circumstances. You can find furtherdetails in Our full Privacy Policy explaining howthe information held by fraud preventionagencies may be used or in which circumstancesWe conduct credit reference checks and howthese checks might affect Your credit rating.

Automated DecisionsWemay use automated tools with decisionmaking to assess Your application for insuranceand for claims handling processes, such as pricerating tools, flood, theft and subsidence areachecks and credit checks.

These automated decisions will produce a resulton whether We are able to offer insurance, theappropriate price for Your Policy or whetherWe can accept Your claim. If You object to anautomated decision, Wemay not be able tooffer You an insurance quotation or renewal.

Complaints ProcedureIt is always Our intention to provide a first classstandard of service. However We do appreciatethat occasionally things go wrong. In somecases the broker who arranged Your insurancewill be able to resolve any concerns, particularlyif Your complaint relates to the way the Policywas sold and You should contact them directly.

How to Cancel your PolicyIf You do not want to accept the Policy Youhave the right to cancel it within 14 days fromthe date of purchase of Your Policy or the dayyou receive Your Policy documentation,whichever is later. To do this Youmust returnthe Policy documentation to Your broker whengiving Your instruction to cancel.

If cover has not yet started a full refund will begiven. If cover has started We will refund thepremium for the exact number of days left onthe policy, less an additional charge of £25 plusthe prevailing rate of Insurance Premium Tax asstated on Your Policy Schedule. No refund willbe given if a claim has been submitted or therehave been any incidents likely to give rise to aclaim during the current period of insurance.We will also do this if You want to cancel thePolicy within 14 days after the renewal date.

Youmay cancel the Policy at any other time bycontacting Your broker.

If You cancel Your Policy after 14 days and aclaim has been submitted or there have beenany incidents likely to give rise to a claim duringthe current period of insurance, We will notrefund any part of the premium. If You have aLoan Agreement with Us, all outstandingmonies must be paid to Us as described in YourLoan Agreement.

If no claims have been submitted and therehave been no incidents that are likely to giverise to a claim during the current period ofinsurance, We will refund the premium for theexact number of days left on the Policy less anadditional charge of £25 plus the prevailingrate of Insurance Premium Tax as stated onYour Policy Schedule.

For Our rights to cancel Your Policy please referto Conditions applicable to all SectionsCondition 8 of this Policy Booklet.

Choice of LawThe parties to an insurance contract are free tochoose the law that will apply. Unless We agreein writing with You otherwise, this insuranceshall be subject to the law applying in that partof the United Kingdom, Channel Islands or Isleof Man where You have Your principal place ofbusiness. If there is any dispute, the law ofEngland and Wales shall apply.

Employers’ Liability Tracing OfficeCertain information relating to Your insurancePolicy including, without limitation, the Policynumber(s), employers’ names and addresses(including subsidiaries and any relevantchanges of name), coverage dates, employer’sreference numbers provided by Her Majesty’sRevenue and Customs and Companies HouseReference Numbers (if relevant), will beprovided to the Employers’ Liability TracingOffice, (the “ELTO”) and added to an electronicdatabase, (the “Database”).

This information will be made available in aspecified and readily accessible form asrequired by the [Employers’ Liability Insurance:Disclosure By Insurers Instrument 2010]. Thisinformation will be subject to regular periodicupdating and certification and will be auditedon an annual basis.

The Database will assist individual consumerclaimants who have suffered an employmentrelated injury or disease arising out of theircourse of employment in the UK for employerscarrying on, or who carried on, business in theUK and who are covered by the employers’liability insurance of their employers, (the“Claimants”):

• to identify which insurer (or insurers) was(or were) providing employers’ liabilitycover during the relevant periods ofemployment; and

• to identify the relevant employers’ liabilityinsurance policies.

The Database will be managed by the ELTO.

The Database and the data stored on it may beaccessed and used by the Claimants, theirappointed representatives, insurers withpotential liability for UK commercial linesemployers’ liability insurance cover and anyother persons or entities permitted by law.

By entering into this insurance policy You willbe deemed to specifically consent to the use ofYour insurance policy data in this way and forthese purposes.

Introduction

Each Section of this Policy, the Schedule andany endorsements, together with thisIntroduction, Customer Information and theDefinitions, Conditions applicable to allSections and Exceptions applicable to allSections shall be read as one document.

Any word or expression given a specificmeaning in:

1. the Schedule, and Policy endorsements, orthis Introduction, the CustomerInformation and the Definitions, Conditionsand Exceptions shall have the samemeaning throughout the Policy unless Westate otherwise

2. an individual Section or any Sectionendorsements shall only have the samemeaning throughout such Section orendorsement unless We state otherwise.

Any such word or expression given a specificmeaning shall be highlighted with a leadingcapital letter and in bold text within the Policywording.

In return for You having paid or agreed to paythe premium for the Period of Insurance, Wewill indemnify You, subject to the termscontained in or endorsed on the Policy, inrespect of loss Damage or liability or pay otherbenefits which fall within the operative Sectionsof this Policy, provided that the loss, Damageor injury which gives rise to the claim occurs (orin the case of the Employer's Liability Section iscaused) during the Period of Insurance and inconnection with the Business.

The Schedule shows the Sections of the Policythat are operative.

IMPORTANT

This Policy is a legal contract.

You have a duty to make a fair presentation ofthe risk which is covered by this Policy.Therefore You should ensure that anyinformation You have provided to Us and thecontent of any application form, declarationand / or Statement of Fact is accurate andcomplete. Where You have provided Us withinformation which relates to matters of Yourexpectation or belief, it does not matter if suchinformation turns out to be inaccurate providedthat You acted in good faith when Youprovided Us with such information. If You donot comply with Your duty to make a fairpresentation of the risk, Your Policymay notbe valid or the Policymay not cover You fully orat all.

Youmust also tell Us about any facts orchanges which affect Your insurance and whichhave occurred either since the Policy started orsince the last renewal date.

If You are not sure whether certain facts arerelevant please ask Your insurance broker. IfYou do not tell Us about relevant changes,Your Policymay not be valid or the Policymaynot cover You fully or at all.

You should keep a written record (includingcopies of letters) of any information You giveUs or Your insurance broker.

Conditions applicableto all Sections

Condition 1 – ReasonablePrecautionsThe Insuredmust take or cause to be taken allreasonable precautions to prevent or minimiseInjury or Damage

Condition 2 - Alteration in RiskYou or Your broker must tell Us immediately ifduring the Period of Insurance there is anyalteration in risk or to the facts which Youdisclosed when You took out this Policy, whichmaterially affects the risk of injury, loss,Damage or liability which would fall within thePolicy cover. This includes but is not limited toalterations to the Business or the Premises.

When You tell Us about an alteration in risk,Wemay apply additional terms and conditionsto this Policy (including but not limited topremium) or, if the risk is unacceptable to Us,Wemay cancel the Policy in accordance withConditions applicable to all Sections –Condition 8 (Our Rights to Cancel the Policy).

If as a result of an alteration You are due arefund of premium, amounts under £10 (plusthe prevailing rate of Insurance Premium Tax)as stated on Your Policy Schedule will not berefunded, to cover administration costs.

If You fail to tell Us about an alteration in risk,Wemay:

(a) terminate the Policy back to the datewhen the alteration occurred, if We wouldhave cancelled the Policy had You told Usof the alteration in risk;

(b) proportionately reduce the amountpayable in respect of a claim; and/or

(c) treat the Policy as if it contained suchdifferent terms (other than relating to thepremium) that We would have applied tothe Policy had You told Us of thealteration in risk.

Any reduction in claims payments orapplication of different terms will take effectfrom the date on which the alteration in riskoccurred.

Where We elect to proportionately reduce theamount payable in respect of a claim, We willpay a percentage of the claim, the percentagebeing calculated by comparing the premiumwhich You actually paid with the premiumwhich We would have charged had You told usabout the alteration in risk. For example, if thepremium which You actually paid is 70% of thepremium We would have charged, We will onlypay 70% of any claim.

Condition 3 - Change of Risk orInterestThis Policy shall be avoided if:

(a) Your interest ceases other than by death

(b) the Business be wound up or carried on bya liquidator or receiver or permanentlydiscontinued at any time after thecommencement of this insurance unlessWe have accepted the change.

Nothing contained in this Policy shall give anyright against Us to any person other than Youexcept to a transferee approved by Us.

Condition 4 – Claims Procedure andRequirementsIt is a condition precedent to Our liability thatin the event of circumstances giving rise to orlikely to give rise to a claim the Insured shall

(a) report it to the Company immediately andfurnish in writing full details of Injury orDamage as soon as possible but at thelatest within seven days if caused by riotcivil commotion or malicious persons

(b) report it to the Police immediately in theevent of Damage by malicious personstheft or accidental loss

(c) at his own expense give all evidenceinformation and assistance as required

(d) send every writ or other document to theCompany immediately and notacknowledge it nor admit liability norpromise payment to other parties withoutthe Company’s written consent

(e) permit the Company at their owndiscretion and expense to take over andconduct the defence or settlement of anyclaim and to take all necessary steps forenforcing any rights against any otherparty in the name of the Insured before orafter meeting the Insured’s claim

Condition 5 – Fraudulent ClaimsFor the purposes of this Condition the definitionof ‘You / Your’ will also include any person whois entitled to benefit from the Policy to theextent that a claim is made by or on theirbehalf.

If You or anyone acting on Your behalf makesa claim which is in any way fraudulent We:

(a) will not pay the claim;

(b) may recover from You any sums alreadypaid by Us in respect of the claim; and

(c) may notify You that We are treating thisPolicy as having terminated with effectfrom the time of the fraudulent act.

If We do treat this Policy as having terminated,You will have no cover under this Policy fromthe date of termination and will not be entitledto any refund of premium.

Where a fraudulent claim is made by or onbehalf of a person who is not the Insured, thiscondition applies only to that person's claimand references to 'this Policy' should be readas if they were references to the cover for thatperson alone and not to the Policy as a whole.

Fraudulent claims include but are not limited to:

(a) making a claim which is fraudulent,fictitious or known to be false

(b) intentionally exaggerating or inflating aclaim

(c) supporting a claim with false or forgeddocuments, information or statements

(d) wilfully causing loss, Damage or injury

Condition 6 – Company’s Rights(a) the Companymay enter any Premises

where Damage has occurred and takepossession of or require to be delivered tothem any property insured and deal with itin any reasonable manner

(b) the Company are entitled to take over andconduct the defence or settlement of anyclaim at their discretion

(c) under Section 1D – Legal Liabilities theCompanymay at any time pay the Limit ofLiability (after the deduction of any sum orsums already paid) or any less amount forwhich such claim or claims can be settledand shall then relinquish the conduct andcontrol of and be under no further liabilityin respect thereof except for the paymentof costs and expenses incurred prior to thedate of such payment

Condition 7 – Other InsurancesIf the Damage or liability which is the subjectof a claim under this Policy is covered by anyother insurance the Company will not paymore than their rateable proportion

This Condition does not apply to Section 1C –Personal Accident – Assault

Condition 8 – Our Rights to Cancelthe PolicyWe or any agent appointed by Us and actingwith Our authority have the right to cancelYour Policy, where there is a valid reason fordoing so. We will give You fourteen days noticeof cancellation in writing, by recorded delivery,to the latest address We have for You and willset out Our reason for cancellation in Ourletter.

Valid reasons may include but are not limitedto:

1. not

(a) paying a premium when it is due

(b) co-operating with Us, or sending Usinformation or documentation thatmaterially affects Our ability to processthe Policy or Our ability to defend Ourinterests

(c) exercising Your duty of care as requiredunder the "Reasonable Precautions"Condition in the Conditions applicableto all Sections of this Policy Booklet.

and failing to put this right when We askYou to by sending You seven days writtennotice to Your latest address.

2. use of threatening or abusive behaviour orlanguage, or intimidation or bullying of Ourstaff or suppliers.

If We cancel Your Policy, We will refund thepremium for the exact number of days left on

the Policy less an additional charge of £25 plusthe prevailing rate of Insurance Premium Tax asstated on Your Policy Schedule.

If a claim has been submitted or there havebeen any incidents likely to give rise to a claimduring the current period of insurance, We willnot refund any part of the premium.

If You have a Loan Agreement with Us to payfor Your insurance, outstanding monies may beowed when Your Policy is cancelled. They mustbe paid to Us as described in Your LoanAgreement.

For Your rights to cancel the policy please referto Customer Information “How to Cancel YourPolicy” section of this Policy Booklet.

Condition 9 – SecurityIt is a condition precedent to liability under thisPolicy in respect of loss destruction or Damageby theft or attempted theft that

1. all external doors to Your Premises and anyinternal doors leading to other premises notoccupied by Youmust be fitted with andsecured out of business hours by

• a 5 lever mortice deadlock and boxstriking plate conforming to BS3621

• a 5 (or more) lever close shackle padlockand locking bar

• in the case of aluminium or UPVC doorsan integral cylinder operated swingboltmortice lock

• in the case of double leaf doors the firstclosing leaf must be fitted with keyoperated locks or bolts top and bottom inaddition to an appropriate lockingmechanism as above

• in the case of outward opening doorshinge bolts must be fitted in addition toan appropriate locking mechanism asabove

• an alternative form of lock or lockingsystem which provides a level and qualityof security at least equal to thosespecified above

2. all accessible windows fanlights andskylights must be fitted with and secured outof Business hours by

• key operated window locks or beprotected by solid steel bars of not lessthan 3/4 inch diameter not more than5 inches apart and securely grouted intothe brickwork or masonry surrounding thewindow

• in the case of louvred windows the louvresmust be permanently fixed in place

Condition 10 – UnoccupancyIt is a condition precedent to liability under thisPolicy that within 14 days of the Premises orany part thereof becoming Vacant orUnoccupied or not having been actively usedfor Business purposes the Company is notifiedand

1. all services are turned off at the mains andthe water and heating systems drained

2. the Premises are to be adequately securedagainst unauthorised entry

3. at least weekly inspections are to be madeof the Premises by the Insured or anauthorised representative working on theInsured’s behalf

4. any accumulations of combustible materialssuch as junk mail and newspapers are to beremoved during each inspection of thePremises

Condition 11 – Fair Presentation ofthe RiskYoumust make a fair presentation of the riskwhen You first take out this Policy and alsowhenever You renew it or ask Us to changeYour cover.

If You fail to make a fair presentation of the riskincluding failing to disclose or misrepresentinga material fact, or disclosing material facts toUs in a way which is not clear and accessible:.

Wemay avoid this Policy and refuse all claimswhere:

(a) such failure was deliberate or reckless; or

(b We would not have entered into this Policyon any terms had Youmade a fairpresentation of the risk.

Should We avoid this Policy We:

(a) Shall treat the Policy as if it had notexisted from the start date, the renewaldate, or the date when You asked Us tochange Your cover, depending on whenthe failure to make a fair presentation ofthe risk occurred

(b) shall return the premium paid for theperiod for which the Policy is treated as nothaving existed unless the failure to make afair presentation of the risk was deliberateor reckless

(c) may deduct from any return of premiumdue to You any monies already paid inrespect of claims falling within the periodfor which the Policy is treated as nothaving existed or require You to repay suchclaims.

Provided that any failure to make a fairpresentation of the risk is not deliberate orreckless, if We would have entered into orrenewed this Policy, or agreed to makechanges to Your cover on different terms hadYoumade a fair presentation of the risk, Wemay:

(a) proportionately reduce the amountpayable in respect of a claim; and/or

(b) treat the Policy as if it contained suchdifferent terms (other than relating to thepremium) that We would have applied tothe Policy had Youmade a fairpresentation of the risk.

Any reduction in claims payments orapplication of different terms will take effectfrom the date on which the Policy started, wasrenewed or when changes were made to Yourcover, depending on when You failed to make afair presentation of the risk.

Where We elect to proportionately reduce theamount payable in respect of a claim, We willpay a percentage of the claim, the percentagebeing calculated by comparing the premiumwhich You actually paid with the premiumwhich We would have charged had Youmadea fair presentation of the risk. For example, ifthe premium which You actually paid is 70% ofthe premium We would have charged, We willonly pay 70% of any claim.

Where this Policy provides benefits toindividuals who would, if they had taken outsimilar insurance in their own name, have doneso for purposes wholly or mainly unconnectedwith their trade, business or profession, We willnot rely on this condition if the failure to makea fair presentation of the risk concerns onlyfacts or information which relate to thatparticular individual, unless the individual (or

You on their behalf) makes a carelessmisrepresentation, in which case Wemay relyon this condition as against that particularindividual as if a separate insurance contracthad been issued to them leaving the remainderof the Policy unaffected.

Condition 12 - Terms Not Relevantto Actual LossIf payment of a claim is conditional uponcompliance with any term of this Policy We willnot pay for any claim where the term has notbeen complied with except where the termconcerned:

(a) is operative only in connection withparticular premises or locations;

(b) is operative only at particular times; or

(c) is intended to reduce the risk of particulartypes of injury, loss, Damage or liability

where We will pay for claims in respect of whichYou can prove that non-compliance with theterm could not have increased the risk of theinjury, loss, Damage or liability which occurred.

Exception 1 – ExcessPlease see Policy Schedule

Exception 2 – RadioactiveContaminationDamage to any property or any loss orexpense resulting or arising therefrom or anyindirect loss or any legal liability directly orindirectly caused by or contributed to by orarising from

(a) ionising radiations or contamination byradioactivity from any nuclear fuel or fromany nuclear wastes from the combustion ofnuclear fuel

(b) the radioactive toxic explosive or otherhazardous properties of any explosivenuclear assembly or nuclear componentthereof

but in respect of Injury to Employees underSection 1D – Legal Liabilities this Exceptionshall apply only when the Insured under acontract has either undertaken to indemnify orto assume the liability of another party inrespect of such Injury

Exception 3 – Northern Ireland andTerrorismLiability loss or Damage caused directly orindirectly by an act of terrorism as defined inthe UK Terrorism Act 2000 is excluded exceptwhere We need to provide the minimuminsurance required by Employers’ Liabilitylegislation

Exception 4 – Sonic BoomDamage directly occasioned by pressure wavescaused by aircraft or other aerial devicestravelling at sonic or supersonic speeds

Exception 5 – War RisksAny consequence of war invasion act of foreignenemy hostilities (whether war be declared ornot) civil war rebellion revolution insurrection ormilitary or usurped power

Exception 6 – ConfiscationConfiscation nationalisation or requisition byorder of any government public municipal localor customs authority

Exception 7 – Electronic DateRecognitionDamage to any property or any loss orexpense resulting or arising therefrom or anyindirect loss or any legal liability other than inrespect of Injury to an Employee or FinancialLoss directly or indirectly caused by orcontributed to by or consisting of or resultingfrom the failure of any computer dataprocessing equipment media or systemmicrochip integrated circuit or similar device orany computer software or other equipment orsystem for processing storing or retrieving datawhether the property of the Insured or not andwhether occurring before during or after theYear 2000

(iii) to capture save retain or correctly toprocess any data as a result of theoperation of any command which hasbeen programmed into any computersoftware being a command which causesthe loss of data or the inability to capturesave retain or correctly to process such dataon or after any date

but this shall not exclude Damage to anyproperty or any loss or expense resulting orarising therefrom or any indirect loss orFinancial Loss not otherwise excluded whichitself results from

1. fire lightning explosion earthquake

2. riot civil commotion strikers labour orpolitical disturbance malicious persons orvandals

3. storm or Flood but excluding

(a) Damage resulting from frostsubsidence ground heave landslip orchanges in the water table level

(b) property in the open

(c) Damage to fences gates and posts

4. bursting overflowing or leakage of watertanks apparatus or pipes or the escape ofoil from any fixed domestic heatinginstallation excluding Damage occurringwhilst the Premises are empty or disused

5. accidental discharge or leakage from anyautomatic sprinkler installation providedsuch discharge or leakage is not caused byfreezing or when the Premises are emptyor disused

6. falling trees or parts of trees but excludingDamage caused by the felling or loppingof trees or by tree roots

7. impact by any animal vehicle aircraft orany aerial device or articles dropped orfalling therefrom

8. leakage of beer or other beverages fromstorage containers and connectedapparatus

9. theft or attempted theft

(a) involving entry to or exit from thePremises by forcible and violent means

(b) as a result of actual or threatenedviolence or assault to the Insured anypartner director or Employee of theInsured or any person lawfully on thePremises

Exception 8 – Electronic Data1. Electronic Data Exclusion

This Policy does not insure loss Damagedestruction distortion erasure corruption oralteration of ELECTRONIC DATA from anycause whatsoever (including but not limited toCOMPUTER VIRUS) or loss of use reduction infunctionality cost expense of whatsoevernature resulting therefrom regardless of anyother cause or event contributing concurrentlyor in any other sequence to the loss

ELECTRONIC DATA means facts concepts andinformation converted to a form useable forcommunications interpretation or processingby electronic and electromechanical dataprocessing or electronically controlledequipment and includes programmes softwareand other coded instructions for the processingand manipulation of data or the direction andmanipulation of such equipment

COMPUTER VIRUS means a set of corruptingharmful or otherwise unauthorised instructionsor code including a set of maliciouslyintroduced unauthorised instructions or codeprogrammatic or otherwise that propagatethemselves through a computer system ornetwork of whatsoever nature COMPUTERVIRUS includes but is not limited to ’TrojanHorses’ ’worms’ and ’time or logic bombs’

2. Electronic Data Processing Media Valuation

Should electronic data processing mediainsured by this Policy suffer physical loss orDamage insured by this Policy then the basisof valuation shall be the cost of the blankmedia plus the costs of copying ELECTRONICDATA from back-up or from originals of aprevious generation these costs will not includeresearch and engineering nor any costs ofrecreating gathering or assembling suchELECTRONIC DATA

If the media is not repaired replaced orrestored the basis of valuation shall be the costof the blank media however this Policy doesnot insure any amount pertaining to the valueof such ELECTRONIC DATA to the Insured orany other party even if such ELECTRONIC DATAcannot be recreated gathered or assembled

Exception 9 – ProfessionalIndemnityThe Company shall not be liable in respect ofany Injury or Damage to property caused byor in connection with the exercising by theInsured or any director partner or Employee ofthe Insured of any professional skill duty oradvice whether fees are charged or not

Fixed Glass

Damage to fixed glass (including its frameworklettering or any intruder alarm foil attached toit) at the Premises including the cost ofnecessary boarding up pending replacement

Replacement of Locks

Costs incurred as a result of the necessaryreplacement of locks at the Premises followingtheft of keys from the Premises or from thehome of any director partner or Employeeauthorised by the Insured to hold such keysprovided that the Company’s liability shall notinclude the cost of replacing the locks of anysafe or strongroom if the keys to such locks areleft on the Premises while closed for Businessor exceed £1,000 any one occurrence

Electronic Equipment Temporary Removal

Electronic Equipment temporarily removedfrom the Premises where required within theTerritorial Limits provided that theCompany’s liability shall not exceed £1,500 inrespect of any one occurrence

Exhibition Cover

Damage to Contents whilst at any exhibitionwithin the Territorial Limits provided that theCompany’s liability shall not exceed £2,000 inrespect of any one occurrence

Additional Property CoveredThis Section extends to cover Damage to thefollowing property if it is owned by the Insuredor the Insured is legally responsible for it

1. Stock

Stock and materials in trade prescriptiondrugs medicines medical supplies medicalbags including contents and goods in trustthe property of the Insured or for whichthe Insured is responsible excludingMoney securities coins stamps jewelleryprecious metals or stone or explosivesprovided that the Company’s Liability shallnot exceed £1,000 in any one Period ofInsurance

2. Deterioration of Stock

We will indemnify You in respect ofDamage by deterioration or contaminationto drugs and vaccines belonging to You orfor which You are responsible whilstcontained in any refrigeration unit causedby

1. a rise or fall in temperature as a resultof

(a) breakdown of or Damage to therefrigeration unit

(b) non-operation of any thermostaticor automatic controlling devicespertaining to the refrigeration unit

(c) accidental failure of the publicsupply of electricity not occasionedby the deliberate act of the supplyauthority

2. action of refrigerant fumes escapingfrom the refrigeration unit providedthat the Company’s Liability shall notexceed £1,000 in any one Period of Insurance

3. Radio and Television Masts

Radio and television receiving aerialssatellite aerials their fittings or masts at thePremises

4. Theft Damage to the Buildings

The Premises if Damage is caused by theftor attempted theft involving entry to or exitfrom the Premises by forcible and violentmeans

5. Underground Pipes and Cables

Underground water gas electricity sewagedrainage or telephone pipes wires or cablesextending from the Premises to the publicmain

6. Sanitary Fittings

Fixed sanitary ware and fittings at thePremises

7. Metered Water or Heating Oil

The insurance by this Section extends toinclude additional meter water or heatingoil charges incurred by the Insured as aresult of insured Damage provided that theCompany’s liability shall not exceed£2,500 in any one Period of Insurance

The amount payable shall be ascertainedby comparing the charge made by theWater Suppliers on their account for theperiod during which the Damage occurredwith the normal charge in the same periodin a previous year adjusted for any otherrelevant factors affecting the Insured’sconsumption of water during such period

Limits of LiabilityThe Company’s liability during any one Periodof Insurance shall not exceed in respect of

1. any Property specified in the Schedule theSum Insured set against it

2. all Damage the total of the Sums Insuredspecified in the Schedule

3. personal effects or tools belonging to theInsured or any director partner client orEmployee of the Insured £500 any oneperson

Provided the Company’s liability under anyItem specified in the Schedule shall not exceed10% of the Sum Insured on such item inrespect of

(a) Damage sustained elsewhere than at thePremises

Index Linking

The Sums Insured in the Schedule will beadjusted at monthly intervals in accordancewith the percentage change in the ProducerPrice Index published by the Office of NationalStatistics (or an alternative index selected bythe Company)

1. any adjustment made to the Sum Insuredwill be based on the latest figures availableto the Company

2. at each renewal the premium will becalculated on the adjusted Sum Insuredthen in force

Protection after Loss

The Sums Insured in the Schedule on anyBusiness Equipment Item which sustainsDamage by a cause covered by this Section willcontinue to be index-linked following suchDamage while the property is being reinstatedprovided that the Insured takes all reasonablesteps to ensure that the reinstatement is carriedout without undue delay

Claims SettlementFollowing Damage the Company will pay thecost of reinstating the Property equal to itscondition when new provided that

1. this is carried out without delay and in themost economical manner

2. when any Property is partially damaged theCompany’s liability shall not exceed thereinstatement cost that would have beenincurred had it been wholly destroyed

3. no payment will be made untilreinstatement has been carried out

4. if the damaged Property is not reinstated aloss will be settled after allowance fordepreciation

5. in respect of Business Files theCompany’s liability shall be limited to costsand expenses incurred in reproducing orrecompiling them but shall not include thevalue to the Insured of the informationthat they contain

Underinsurance

If at the time of Damage the total of the SumsInsured on Business Equipment specified inthe Schedule is less than 85% of the totalreinstatement cost of such Property theCompany shall bear only that proportion ofany Damage to Business Equipment whichthe total of the Sums Insured on BusinessEquipment bear to the total reinstatementcost of such Property

Automatic Reinstatement of Sum Insured

In the event of a loss the Sum Insured will beautomatically reinstated by the amount of theloss provided that

1. the Insured pays the appropriateadditional premium for such reinstatementof Sum Insured

2. the Insured implements without delay anyamendments to the protections of thePremises that the Companymay require

3. in respect of Damage by theft orattempted theft the automaticreinstatement of Sums Insured shall apply on the first occasion only in onePeriod of Insurance

(a) faulty or defective design material orworkmanship inherent vice latentdefect gradual deterioration wear andtear or frost

(b) corrosion rust dampness dryness wet ordry rot shrinkage evaporation loss ofweight contamination change intemperature colour flavour texture orfinish vermin insects marring orscratching

(c) subsidence ground heave or landslip orthe normal settlement or bedding downof new structures

(d) collapse or cracking of buildings

6. to Property caused by

(a) its own mechanical or electricalbreakdown or derangement

(b) use contrary to the manufacturers’instructions

(c) its undergoing any process

7. to Business Files resulting from erasure ordistortion of information on computersystems or other records

(a) whilst mounted in or on any machine ordata processing apparatus unlesscaused by Damage to the machine orapparatus or by malicious persons

(b) due to the defects in such records ordeliberate falsification

(c) due to the presence of a magnetic fluxor the deliberate act of the publicsupply undertaking in restricting orwithholding electricity supply

8. arising from theft or attempted theft(other than as a result of actual orthreatened violence or assault to theInsured or any partner director orEmployee of the Insured or any personlawfully on the Premises) not involvingentry to or exit from the Premises byforcible and violent means

9. to Electronic Equipment whilsttemporarily left in unattended and/orunlocked motor vehicles

10. (a) to Fixed Glass or Sanitary Fittingsalready damaged at thecommencement of cover

(b) caused by scratching or chipping ofFixed Glass unless it extends throughthe complete fabric of the glass

(c) to Fixed Glass or Sanitary Fittings inany portion of the Premises which isVacant or Unoccupied

11. to Deterioration of Stock

(a) caused by any wilful act or wilfulneglect by the Insured or any directorpartner or Employee of the Insured

(b) if the refrigeration unit is more than 5years old at the start of the Period ofInsurance it must be maintainedregularly by a suitably qualifiedindependent electrical engineer

Policy Cover Section 1C – Personal Accident– Assault

DefinitionsInsured Person(a) the Insured or any director partner or

Employee of the Insured or

(b) any person to whom the Insured hasentrusted Money other than an Employeeof a professional security company ororganisation

CoverIf an Insured Person suffers accidental bodilyinjury as described below as a direct result ofrobbery or attempted robbery in the course ofthe Business the Company will pay therelevant sum specified below

If the Company is liable to indemnify morethan one party the total amount of indemnityto all such parties including the Insured shallnot exceed the Limits of Liability

Additional Cover1. Loading and Unloading

Notwithstanding Exception 3 of thisSection and provided the Insured is notmore specifically insured under any otherpolicy the Company will indemnify theInsured in the terms of this Section inrespect of Injury or Damage arising duringthe act of loading or unloading a motorvehicle or the bringing to or taking away ofa load from such vehicle

2. Cross Liabilities

If the Insured comprises more than oneparty (which term in the case of apartnership includes each individualpartner) the Company will indemnify eachin the terms of this Section against liabilityincurred to the other as if such other wasnot included as an Insured

3. Motor Contingency LiabilityNotwithstanding Exception 3 of thisSection the Company will indemnify theInsured and no other person in the termsof this Section in respect of the use of anymotor vehicle not the property of orprovided by the Insured and being used inthe course of the Business

The Companywill not be liable in respect of

(a) Damage to such vehicle

(b) Injury or Damage arising while suchvehicle is being driven by the Insured

Provided that the Company shall not beliable under this extension if the Insured isentitled to indemnity under any otherinsurance

4. Health and Safety at Work Act 1974The Company will at the request of theInsured indemnify any director orEmployee of the Insured against legal costsand expenses incurred in the defence of anycriminal proceedings brought for the breachof the Health and Safety at Work Act 1974 or the Health and Safety at Work(Northern Ireland) Order 1978 committedor alleged to have been committed duringthe Period of Insurance including legal costsand expenses incurred with the consent ofthe Company in an appeal againstconviction arising from such proceedings

Provided that the Company shall not beliable for the payment of fines or penalties

5. Defective Premises Act 1972

The Company will indemnify the Insuredin the terms of this Section against legalliability incurred by the Insured underSection 3 of the Defective Premises Act1972 or Section 5 of the DefectivePremises Act (Northern Ireland) Order1975 in respect of Injury or Damageoccurring within a period of seven yearsfrom the expiry or cancellation of thisPolicy

Provided that the Company shall not beliable under this extension if the Insured isentitled to indemnity under any otherinsurance

6. Consumer Protection Act 1987

When cover is operative for Injury orDamage caused by Products theCompany will indemnify the Insured andat the request of the Insured anyEmployee or director of the Insuredagainst legal costs and expenses incurredwith the Company’s written consent in thedefence of any criminal proceedingsbrought for a breach of Part II of theConsumer Protection Act 1987 committedor alleged to have been committed duringthe Period of Insurance including costs ofprosecution awarded against the Insuredand legal costs and expense incurred withthe consent of the Company in an appealagainst conviction arising from suchproceedings

Provided that the Company shall not beliable for payment of fines or penalties

7. Damage to Leased or Rented Premises

In Public Liability Cover paragraph 1(b) theexpression “custody or control” shall notapply to any building (including its fixturesand fittings and contents) provided that inrespect of any building which is leasedhired or rented to the Insured theCompany shall not be liable in respect of

(a) Damage to its contents

(b) the first £100 of each and every claimfor Damage caused other than by fireor explosion

(c) liability arising solely because of acontract

8. Employees and Visitors Effects

In Public Liability Cover Paragraph 1(b) theexpression “custody or control” shall notapply to visitors directors partners andEmployees personal effects includingmotor vehicles and their contents

9. Wrongful Arrest

The Company will indemnify the Insuredunder the Public Liability Cover in respect oflegal liability arising out of wrongful arrestmalicious prosecution detentionimprisonment eviction or invasion of theright of privacy of any person (not being anEmployee) up to a maximum amount of£25,000 in any one Period of Insurance

10. Court attendance costs

If during the Period of Insurance anypartner director or Employee of theInsured is required to attend court as awitness at the request of the Company inconnection with a claim which is the subjectof indemnity under this Policy theCompany will pay compensation to theInsured on the following scale for each daythat attendance is required

(a) any director or partner £250

(b) any Employee £150

Limits of Liability1. Employer’s Liability

Any claim or number of claims arising outof one cause for Injury to Employeesincluding claimants costs and any othercosts and expenses incurred with theCompany’s written consent shall notexceed the limit shown in the Schedule

2. Public Liability

(a) any other claim or number of claimsarising out of one cause includingclaimants costs and expenses shall notexceed the limit shown in the Scheduleprovided that the Company’s liabilityin any one Period of Insurance inrespect of

(i) Injury or Damage arising directlyor indirectly from Pollution orContamination which is deemed

to have occurred during any suchperiod shall not exceed the limitshown in the Schedule

(ii) Injury or Damage happeningduring any such Period and causedby Products shall not exceed thelimit shown in the Schedule

(b) the Company will in addition in respectof any other claim or number of claimsarising out of one cause pay any othercosts and expenses incurred with theirwritten consent

Exceptions that apply toLegal LiabilitiesThe following Exceptions do not apply toliability in respect of Employer’s Liability

The Company will not be liable in respect of

1. any liability for

(a) any amount in respect of liquidateddamages fines or penalties

(b) Injury or Damage caused by Products

which attaches solely because of a contract

2. (a) the cost of rectifying defective work

(b) Damage to or the cost of recallingremoving or repairing or replacingProducts arising from a defect in or anerror in connection with the sale supplyor presentation of such Products

3. Injury or Damage arising out of the use ofor caused by any craft designed to travel inon or through water air or space (otherthan hand propelled craft) or any motorvehicle which is owned by or in thepossession of or being used by or on behalfof the Insured

4. Injury or Damage which results from anydeliberate act or omission of the Insuredhis partners directors or managerialEmployees and which could have beenreasonably expected having regard to thenature and circumstances of such act oromission

This exception shall not apply in respect ofany deliberate act or omission of any otherperson claiming indemnity but only so faras indemnity to such person is concerned

5. Injury or Damage arising out of or inconnection with

(a) the exercise by the Insured his partnersassistants Employees or any personacting for him or on his behalf havingprofessional qualifications ofprofessional skill associated with suchqualifications

(b) the dispensing of medicine

(c) the giving of advice or treatment

6. Injury or Damage caused by Productsincorporated in a craft designed to travelthrough air or space which have been

specifically supplied by the Insured for thatpurpose and are directly connected withthe safety of such craft

7. Injury or Damage which arises directly orindirectly from Pollution orContamination unless such Pollution orContamination is caused by a suddenidentifiable unintended and unexpectedincident which takes place in its entirety ata specific time and place during the Periodof Insurance

For the purposes of this Exception allPollution or Contamination which arisesout of one incident shall be deemed tohave occurred at the time such incidenttakes place

8. loss cost expense liability for Injury loss orDamage directly or indirectly arising outof or resulting from the manufacturemining processing distributions testingremediation removal storage disposal saleuse of or exposure to asbestos or materialsor products containing asbestos whether ornot there is another cause of loss whichmay have contributed concurrently or in any sequence to a loss

In respect of liability for property Damageonly that part of any such loss which isdirectly or indirectly arising out of or resultingfrom the manufacture mining processingdistributions testing remediation removalstorage disposal sale use of or exposure toasbestos is excluded by the foregoing

9. Injury arising in connection with work onoffshore installations or transit thereto ortherefrom

10. Injury arising when any Employee is

(i) carried in or upon a vehicle

(ii) entering or getting on to or alightingfrom a vehicle

in circumstances where any road trafficlegislation requires insurance or security

Right of recoveryThe indemnity granted by this Section isdeemed to be in accordance with theprovisions of any law enacted in Great BritainNorthern Ireland the Isle of Man or theChannel Islands relating to the compulsoryinsurance of liability to Employees

But the Insured shall repay to the Companyall sums paid by the Company which theCompany would not have been liable to paybut for the provisions of such law

DefinitionsRevenueThe Insured’s charges for work done in thecourse of the Business

Outstanding Debit BalancesThe sums outstanding in the Insured’s recordsof the individual amounts owed to the Insuredby clients

CoverIf the Business carried on by the Insured atthe Premises is interrupted or interfered withbecause of Damage to any building or otherproperty used by the Insured at the addressshown in the Schedule by a cause specified inSection 1A – Contents the Company will payfor the loss of Revenue or additional costsreasonably incurred by the Insured during theIndemnity Period in accordance with ClaimsSettlement of this Section

Provided that when the Damage occurs thereis insurance in force covering the Insured’sinterest in the building or other property at thePremises against such Damage under which

(a) payment has been made or liabilityadmitted

or

(b) liability would have been admitted but forthe exclusion in such insurance of lossesbelow a specified amount

Outstanding Debit Balances

If the Insured’s records of Outstanding DebitBalances sustain Damage within theTerritorial Limits by a cause covered underSection 1A – Contents and the Insured inconsequence is unable to fully trace or establishthe Outstanding Debit Balances theCompany will indemnify the Insured inaccordance with Claims Settlement of thisSection to a maximum of £25,000 for any onePeriod of Insurance

Additional CoverThe cover provided by this Section extends toinclude interruption of the Business as a resultof

Prevention of Access

Damage to property in the vicinity of thePremises by a cause covered under Section 1A– Contents which hinders or prevents access tothe Premises

Disease infestation and defective sanitation

The occurrence at the Premises of murdersuicide food or drink poisoning vermin pestsdefective sanitation or any human infectious orcontagious disease (excluding AcquiredImmune Deficiency Syndrome (AIDS) or anyAIDS related condition) an outbreak of whichthe Local or Government Authority hasstipulated shall be notified to them

Public Utilities

Accidental failure of public supplies ofelectricity gas or water at the terminal ends ofthe public supply undertakings feed to thePremises not occasioned by the deliberate actof any supply authority or by the exercise byany such authority of its power to withdraw orrestrict supply

Limits of LiabilityThe Company’s liability for all loss resultingfrom interruption of the Business arisingduring any one Period of Insurance shall notexceed in respect of

1. each Item specified in the Schedule theSum Insured set against it

2. all Damage the total of the Sums Insuredspecified in the Schedule

Claims SettlementThe Company will pay

1. for an Item in the Schedule on Revenue

(a) in respect of reduction in Revenue –the amount by which the Revenue fallsshort of the expected Revenue duringthe Indemnity Period less any chargesor expenses which are reduced becauseof the interruption

(b) in respect of additional expenditure –that reasonably incurred as a result ofinterruption of or interference with theBusiness carried on at the Premisesbut not exceeding the amount whichwould otherwise have been payableunder (a) above

2. for an item in the Schedule on AdditionalExpenditure the additional costs andexpenditure necessarily and reasonablyincurred as result of interruption of orinterference with the Business carried on atthe Premises because of the Damageduring the Indemnity Period

3. for professional accountants’ chargesreasonably incurred by the Insured forproducing and certifying any particularsrequired by the Company in connectionwith the investigation and verification of aclaim

4. in respect of Outstanding Debit Balancesonly

(a) the amount by which the OutstandingDebit Balances traced or receivedfollowing the Damage shall fall short ofthe Outstanding Debit Balancesbefore the Damage occurred

(b) for additional expenditure incurred withthe previous consent of the Companyin tracing and establishing theOutstanding Debit Balances

Underinsurance

If at the time of Damage the Sum Insured onany Item on Revenue specified in the Scheduleis less than 85% of the Revenue which wouldhave been earned during the period of theMaximum Indemnity Period specified in theSchedule following the Damage the amountpayable under this Section will beproportionately reduced

Automatic Reinstatement of Limits of Liability

In the event of a loss the Sums Insured will beautomatically reinstated by the amount of theloss provided that

1. the Insured pays the appropriate premiumfor such reinstatement

2. in respect of interruption or interferencewith the Business because of Damagecaused by theft or attempted theft theautomatic reinstatement of the SumsInsured shall apply on the first occasiononly in any Period of Insurance

(i) cost incurred in complying withsuch regulations or bye-laws underwhich notice has been served uponthe Insured prior to the happeningof the Damage or in respect ofundamaged parts of the Buildings

(ii) the amount of any rate tax dutydevelopment or other charge orassessment which may becomepayable following compliance withsuch regulations or bye-laws

(d) Emergency Servicesrepairing Damage to the grounds ofthe Premises caused by the EmergencyServices up to a maximum of £1,000 inany one Period of Insurance

Additional CoverContracting Purchasers Interest

The cover provided by this Section in the eventof the Insured contracting to sell the Buildingsis extended to the purchaser who completesthe sale up to and until the date of completionof sale provided that the Buildings are nototherwise insured

Limit of LiabilityThe Company’s liability during any one Periodof Insurance shall not exceed in respect of eachItem specified in the Schedule the Sum Insuredset against it

Index Linking

The Sums Insured in the Schedule will beadjusted at monthly intervals in accordancewith the percentage change in the GeneralBuildings Cost Index published by the BuildingsCost Information Service of the RoyalInstitution of Chartered Surveyors (or analternative index selected by the Company)

Provided that

(a) any adjustment made to the Sum Insuredwill be based on the latest figures availableto the Company

(b) at each renewal the premium will becalculated on the adjusted Sum Insuredthen in force

Protection after loss

The Sum Insured in the Schedule on anyBuildings item which sustains Damage by acause covered by this Section will continue tobe index-linked following such Damage while

the property is being reinstated provided thatthe Insured takes all reasonable steps toensure that the reinstatement is carried outwithout undue delay

Claims Settlement

Following Damage the Company will pay thecost of reinstating the Buildings equal to theircondition when new provided that

1. this is carried out without delay and in themost economical manner

2. when any Building is partially damagedthe Company’s liability shall not exceedthe reinstated cost that would have beenincurred had it been wholly destroyed

3. no payment will be made untilreinstatement has been carried out

4. if the damaged Building is not reinstated aloss will be settled after allowance fordepreciation

Underinsurance

If at the time of Damage the total of the SumsInsured specified in the Schedule is less than85% of the reinstatement cost of theBuildings covered by this Section theCompany shall bear only that proportion of theDamage which the total of the Sums Insuredbear to the total reinstatement cost

Automatic Reinstatement of Sums Insured

In the event of a loss the Sums Insured in thePolicy Schedule will be automatically reinstatedby the amount of the loss provided that

1. the Insured pays the appropriateadditional premium for such reinstatementof Sums Insured

2. the Insured implements without delay anyamendments to the protections of thePremises that the Companymay require

2. to fences or gates caused by storm or flood

(a) theft or attempted theft

(c) corrosion rust dampness dryness wet ordry rot shrinkage collapse crackingevaporation contamination changes intemperature colour or texture or finishvermin insects marring or scratching

(d) subsidence ground heave or landslip orthe normal settlement or bedding downof new structures

DefinitionsComputer Virus or SimilarMechanismA set of corrupting harmful or otherwiseunauthorised instructions or code including aset of maliciously introduced unauthorisedinstructions or code programmatic or otherwisethat propagate themselves through a computersystem or network of whatsoever natureComputer Virus or Similar Mechanismincludes but is not limited to ’Trojan Horses’’worms’ and ’time or logic bombs’

HackingHacking shall mean unauthorised access toany computer or other equipment orcomponent or system or item which processesstores transmits or retrieves data

Property Insured1. Computer Equipment

computer and auxiliary equipment used forelectronic processing communication andstorage of data including

(a) fixed disks interconnecting wiring andtelecommunications systems

(b) temperature and environmental controlequipment power supply voltageregulating and other protective equipmentused exclusively in connection with theComputer Equipment

2. Computer Records

all current and back-up computer records(excluding fixed disks and paper records of anydescription) incorporating stored programsand/or information stored thereon the propertyof the Insured on the Premises or anywherewithin the Territorial Limits

CoverThe Company shall indemnify the Insuredagainst loss or Damage to Property Insuredcaused by the following

1. breakdown or failure of any part of theComputer Equipment or Computer Recordswhilst in ordinary use arising from eithermechanical or electrical defect causing astoppage of normal functions

2. failure or fluctuation of the supply ofelectricity to the Computer Equipment

3. erasure destruction corruption or distortionof software contained or data stored onfixed disks or Computer Records

Additional CoverThis Section also covers

1. Additional Expenditure

The additional expenditure necessarily andreasonably incurred by the Insured to

(a) prevent or minimise the interruption of orinterference with the work normally carriedout by or on the Computer Equipment

(b) recompile or restore data or software orreplace third party proprietary software indirect consequence of loss or Damage toProperty Insured caused by Cover 1

provided that the liability of the Companydoes not exceed £10,000 in any one Period ofInsurance

2. Incompatibility of Computer Records

The costs of

(a) modification of the Computer Equipment;or

(b) replacement of Computer Records togetherwith reinstatement of programs and/orinformation thereon whichever is the lesseramount to achieve compatibility in theevent that the loss of Computer Equipmenthas resulted in undamaged ComputerRecords being incompatible with thereplacement Computer Equipment

provided that the liability of the Companydoes not exceed £5,000 in any one Period ofInsurance

3. Additional Rental

The additional rental arising out of thereplacement of a lease/hire agreement inrespect of the Property Insured by a newcontract for a similar property consequent uponloss or Damage insured by this Sectionprovided that the liability of the Companydoes not exceed £5,000 in any one Period ofInsurance

Limit of LiabilityItem 1. Computer Equipment

The Company’s liability during any one Periodof Insurance shall not exceed the Sum Insuredset against it in the Schedule

Item 2. Computer Records

The Company’s liability during any one Periodof Insurance shall not exceed £5,000

Index Linking

The Sums Insured in the Schedule in respect ofItem 1 Computer Equipment will be adjusted atmonthly intervals in accordance with thepercentage change in the Producer Price Indexpublished by the Office of National Statistics(or an alternative index selected by theCompany)

1. any adjustment made to the Sum Insuredwill be based on the latest figures availableto the Company

2. at each renewal the premium will becalculated on the adjusted Sum Insuredthen in force

Claims SettlementIn the event of loss Damage or destruction toItem 1 Computer Equipment the basis uponwhich the amount payable hereunder is to becalculated shall be the reinstatement value ofthe property lost destroyed or damaged

For this purpose ’reinstatement’ means

(a) the rebuilding or replacement of propertylost or destroyed which provided theliability of the Company is not increasedmay be carried out

(i) in any manner suitable to therequirement of the Insured

(ii) upon another site

(b) the repair or restoration of propertydamaged in either case to a conditionequivalent to or substantially the same asbut not better or more extensive than itscondition when new

Underinsurance

If at the time of reinstatement the sumrepresenting 85% of the cost which wouldhave been incurred in reinstating the whole ofthe property covered by any item subject to thisClause exceeds its Sum Insured at thecommencement of any destruction or Damagethe liability of the Company shall not exceedthat proportion of the amount of thedestruction or Damage which the said SumInsured shall bear to the sum representing thetotal cost of reinstating the whole of suchproperty at that time

Special Conditions

1. the liability of the Company for the repairor restoration of property damaged in partonly shall not exceed the amount whichwould have been payable had suchproperty been wholly destroyed

2. no payment beyond the amount whichwould have been payable in the absence ofthis Clause shall be made

(a) unless reinstatement commences andproceeds without reasonable delay

(b) until the cost of reinstatement shallhave been actually incurred

(c) if the Property Insured at the time of itsloss destruction or Damage shall beinsured by any other insurance effectedby or on behalf of the Insured which isnot upon the same basis ofreinstatement

3. all the terms and conditions of this Policyshall apply

(a) in respect of any claim payable underthe provisions of this Clause exceptinsofar as they are varied hereby

(b) where claims are payable as if thisClause had not been incorporated

Subrogation Waiver

The Company agrees to waive any rights ofsubrogation against any user of the ComputerEquipment provided that

(a) such user has the authority of the Insuredto use the Computer Equipment

and

(b) such user shall as if they were the Insuredobserve fulfil and be subject to the termsExceptions and Conditions of this Section

Exceptions that apply toComputer BreakdownThe Company will not be liable under thisSection for

1. loss destruction or Damage to the PropertyInsured

(a) occasioned by its own breakdownunless there is in force an ApprovedMaintenance Agreement providing aminimum service of on call remedialand/or corrective maintenance atinclusive costs

(b) for which any manufacturer supplieragent or maintenance undertaking isresponsible under the terms of aguarantee or maintenance agreement

(c) for which the Insured is relieved ofresponsibility under any rental hire orlease agreement

(d) any Damage caused under Section1A – Contents whether insured or not

(e) caused by or consisting of wear andtear deterioration due to atmosphericor climatic conditions but thisException shall not apply tosubsequent loss destruction orDamage which itself results from acause not otherwise excluded

(f) caused by a deliberate act of a supplyundertaking in withholding the supplyof electricity or telecommunicationservices unless for the sole purpose ofsafeguarding life

(g) caused by the inability of the supplyundertaking to maintain the supplysystem due to industrial action by itsemployees

(h) caused by the use oftelecommunications equipment whichis not approved by thetelecommunications authority

(i) caused by it undergoing any processof production packaging treatmenttesting commissioning servicing orrepair

(j) caused by the use of unprovensoftware which has not been finalisedor which has not passed all the testingprocedures or which has not beensuccessfully proven

(k) caused by programming errors ordesign defects in software

2. the first £250 of each and every loss unlessshown differently in the Schedule

3. (a) in respect of Property Insured loss orDamage to Computer Equipment orother equipment or componentsystem or item which processes storestransmits or retrieves data or any partthereof whether tangible or intangible(including without limitationComputer Records any information orprograms or software) directly orindirectly caused by occasioned by orarising from programming or operatorerror Computer Virus or SimilarMechanism or Hacking

(b) in respect of Additional Cover anyloss cost or expense incurred inconsequence directly or indirectly ofprogramming or operator errorComputer Virus or SimilarMechanism or Hacking

In the event of an incident occurring whichmay give rise to a claim under this Policy

1. take all necessary and reasonableprecautions and emergency action toprevent further Injury Loss or Damageoccurring

Utilise the Helpline facility – see page 2 ofYour Policy Booklet

2. notify the Police of any incident involvingloss Theft Malicious Damage or Vandalism

3. notify Us as soon as possible giving fulldetails of the incident

We will

(i) check the Policy cover to ascertain asfar as practical at this stage that a validclaim exists

(ii) appoint a Loss Adjuster at Ourdiscretion

4. send to Us immediately upon receipt anywrit summons or other legal process issuedor commenced against You and do notnegotiate admit or repudiate any claimwithout Our written consent

5. retain all damaged property/salvage forinspection Youmay not however abandonany property or salvage to Us

6. We shall be entitled to

(i) enter any of the buildings where BodilyInjury Loss or Damage has happenedand take and keep possession of theinsured property and deal with thesalvage in a reasonable manner

(ii) negotiate defend or settle in Your nameand on Your behalf any claim madeagainst You as We deem appropriate

(iii) prosecute in Your name for Our ownbenefit any claim against any otherperson in respect of any amount paid orpayable
