The State shall institute affirmative action mechanisms so that women can participate meaningfully in the formulation, implementation, and evaluation of policies, plans, and programs for national, regional, and local development; WHEREAS, the Department of the Interior and Local Government (DILG) circularizes MC No. 2006-125 to encourage Local Government Units (LGUs) to organize/reorganize the Local Council of Women (LCWs) as Women Non-Government Organization (NGO) pursuant to RA No. 9710, entitled, "An Act Providing for the Magna Carta of Women (MCW)" to strengthen the women's engagement and participation in all strata of local development in their respective Local Government Units (LGUs); Ordinance No. 06, series of 2017 Tit Page 17www.spgensantos.ph 083.552.9692

• • WHEREAS, the city shall assure the promotion of women empowerment to

enable the local women including the women of indigenous cultural communities become active agents and participants of development, and not just mere beneficiaries; further enabling them to make independent decisions based on their own views and perspectives; and, furthermore allowing them to fully and equally make use of available information, technology, goods, and services as provided in the Gender and Development Code of General Santos City;

WHEREAS, the establishment of the General Santos City Council of Women can improve political and socio-economic status of women as they become more involved in decision-making and policy development at all levels of governance;

NOW THEREFORE, on the motion of City Councilor Lourdes F. Casabuena, duly seconded by City Councilors Alberto D. Pacquiao, Jose Orlando R. Acharon and Brix T. Tan, be it;

RESOLVED, as it is hereby resolved to enact this Ordinance:

AN ORDINANCE CREATING THE GENERAL SANTOS CITY COUNCIL OF WOMEN, DEFINING ITS ROLE, FUNCTION AND COMPOSITION, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES

Be it ordained by the Sangguniang Panlungsod of General Santos City that:

SECTION 1. SHORT TITLE.- This Ordinance shall be known as the General Santos City Council of Women (GSCCW) Ordinance.

SECTION 2. POLICY.- The State recognizes the role of women in nation building as provided for under R.A. 7192 or the Women in Nation Building Act and shall ensure the fundamental equality before the law of women and men. The State shall provide women rights and opportunities equal to that of men.

SECTION 3. DEFINITION OF TERMS AND ACRONYMS AS USED IN THE ORDINANCE.-

a. GAD — Gender and Development

b. Gender Mainstreaming — refers to the strategy for making women as well as men's concerns and experiences an integral dimension of the design, implementation, monitoring, and evaluation of policies, programs and projects in all social, political, civil, and economic spheres so that women and men benefit equally. It is the process of assessing the implications for women and men of any planned action, including legislation, policies or programs in all areas and at all levels;

d. LGU- Local Government Unit

e. PFLCW- Philippine Federation of the Local Council of Women

f. Women's Empowerment — is a goal of and an essential process for women's advancement. It is the process and condition by which women mobilize to understand, identify and overcome gender discrimination so as to achieve equality in welfare and equal access to resources. In this context, women become agents of development and not just beneficiaries enabling them to make decisions based on their own views and perspectives.

g. PCW — Philippine Commission for Women

SECTION 4. COVERAGE.- The council shall cover all accredited organizations and institutions working for women and for the promotion and protection of the rights of women in the 26 barangays of General Santos City.

SECTION 5. MEMBERSHIP GROUPS.- The council shall be composed of women representatives from different organizations of women groups but not limited to the following sectors:

a) Health b) Education & Academe c) Environment d) Legal e) Crisis intervention f) Arts and Culture g) Media h) Labor and Transport i) Business and Industry j) Persons with different abilities k) Urban Poor I) Elderly m) Youth n) Agriculture

When there is a federation belonging to a particular class, the membership of the federation shall prevail over base organizations, provided, however, that at least fifty (50%) percent of the base organizations are members of the federation. In either case, the federation shall be entitled to three representatives. The respective members of the Council shall decide to which class his/her office/organization shall belong provided that the programs/functions of his/her organizations/office are directly relevant to the concern of the chosen class. However, when an organization has programs affecting one or more classes, such organization shall be entitled membership in each class.

SECTION 6. PROCESS OF SELECTION.- The Secretariat is hereby tasked to convene the assembly of all accredited women organizations in the City of General Santos where representatives of the aggrupation will be selected.

• • SECTION 7. OFFICERS OF THE COUNCIL.- The council members shall elect from

among themselves the following officers: Chairperson, Vice Chairperson, Secretary, Treasurer, Auditor and Public Information Officer.

SECTION 8. MEETINGS OF THE COUNCIL.- The council shall meet at least once a month. Special meetings maybe called upon the approval of the board or upon request of at least twenty percent (20%) of the council members;

SECTION 9. TERMS OF OFFICE OF THE COUNCIL OFFICERS.- The officers of the council shall have a term of two (2) years;

a) Term of Office. — The term of office shall be co-terminus with the term of the Local Chief Executive

b) Honoraria. — Officers of the council are entitled to receive an honorarium based on the Commission on Audit rules and regulations.

In case of vacancy, the position shall have to be filled-up within one month of such vacancy from among the officers of the council;

SECTION 10. ROLE AND FUNCTION OF THE GENERAL SANTOS CITY COUNCIL OF WOMEN.- As a vehicle in mainstreaming GAD in pursuit of women empowerment, gender equality, social justice, lasting peace, fulfillment and protection of human rights, and sustainable development, the Local Council of Women shall:

A. Implement international and national instruments such as Convention on the Elimination of all Forms of Discrimination Against Women (CEDAW); Beijing Platform for Action (BPFA); the Philippine Plan for Gender Responsive Development (PPGD); and the Framework Plan For Women among their networks;

B. Mainstream gender and development in the LGU, and the passage of local legislation addressing gender issues and women's concerns;

C. Participate in local governance by pushing for passage of the bill on Sectoral Representation to the Local Sanggunian and ensuring representation of women in local special bodies, among others;

D. Support the implementation of the Framework Plan for Women by collaborating with government agencies and/or GAD Focal Points for the implementation of GAD-related programs, projects and activities (PPAs) and developing and implementing projects that address gender issues and women's concern;

E. Undertake activities and projects such as livelihood, micro-enterprise, social services and training and skills development, within the framework of GAD particularly the Framework Plan For Women, independently or in partnership with existing Local Councils and other government agencies;

F. Establish linkage with business sector, Government Organizations (GO) and Non - Government Organizations (NGO) institutions to enable women's access to resources, information and technology, in order to pursue its projects more effectively;

• • G. Monitor the implementation and impact of local policies and programs on

women and provide the local machineries on women, the Local Chief Executive, and other relevant agencies with copies of the findings, and ensure corresponding action;

H. Establish linkage with the PCW in the pursuit of gender and development mainstreaming and women empowerment at the local level;

I. Build the entrepreneurial capability of marginalized women locally, nationally and internationally;

J. Coordinate and consolidate efforts of the barangay federation of women concerning women agenda;

K. Work for the integration of the PFLCW, Inc. advocacy agenda and other relevant concerns in the development plans and programs;

L. Conduct meetings as the need arises;

M. Coordinate, collaborate, recommend and provide the necessary support to PCW and PFLCW, Inc. in the implementation of its programs;

N. Undertake any other projects or activities and functions pertinent to the promotions of women's concern; and

0. Set women's agenda for General Santos City.

SECTION 11. THE GSCCW Secretariat.— The City Population Management Office shall act as secretariat of the General Santos City Council of Women. As main administrative support, it shall:

a. Organize and make necessary arrangements for GSCCW meetings;

b. Attend and document GSCCW and its meetings, conferences and proceedings as secretary;

c. Prepare the minutes of the meeting, draft resolutions, recommendations, communications and reports;

d. Serve and follow-up resolutions, recommendations and communications of the council to the concerned individuals, offices, agencies and other entities and report the result to the council during meetings;

e. Monitor GSCCW activities and milestones for proper reporting to relevant agencies, when required;

f. Be the central channel of communication for the GSCCW and be the central depository of all GSCCW related information and continually update itself with the most current laws, circulars and events, and downstream the same to all relevant officers, employees and parties requiring information;

g. Provide other assistance as may be required by the council.

• • SECTION 12. APPROPRIATION.- Funds shall be taken from appropriations from

the Gender and Development Fund coursed through the office of City Population Management Office, for the creation, operation and maintenance of the Council for each calendar year.

SECTION 13. REPEALING CLAUSE.— All resolutions, ordinances, memoranda and other issuances inconsistent with this ordinance are hereby repealed or modified accordingly.

SECTION 14. SEPARABILITY CLAUSE.- If, for any reason or reasons, any part or provision of this Ordinance is declared unconstitutional or invalid, other parts or provisions hereof not affected thereby shall continue to be in full force and effect.

SECTION 15. EFFECTIVITY CLAUSE.— This ordinance shall take effect fifteen days after its publication in a local newspaper of general circulation within the City of General Santos.
