Victims of Securities fraud receive $46,000 in restitution from Secretary of State’s OfficeMade possible by the Secretary of State’s Securities Restitution Fund

INDIANAPOLIS (December 14, 2015) – Today, Secretary Lawson announced that $46,000 has recently been returned to four victims of two separate Ponzi schemes by way of the Secretary of State’s Securities Restitution Fund.

Three victims of money manager Keenan Hauke’s Ponzi scheme have received restitution awards from the Indiana Secretary of State’s office totaling $31,000. These awards are in addition to the $2.1 million in restitution recovered through asset freezes, the marshaling of other financial accounts and clawback litigation. Hauke was sentenced to 10 years in prison in December 2011 for securities fraud. Although Hauke is behind bars, the effort to try to return significant portions of investor losses, totaling over $9 million, has continued. Keenan Hauke was a prominent money manager from Fishers who managed Samex Capital Partners LLC.

A victim of John Marcum, a Hamilton County man sentenced to five and a half years in prison on federal charges for his role in $6 million Ponzi scheme, was awarded $15,000 in restitution. Marcum’s 16 victims are expected to receive a total of $3.9 Million in total restitution. Marcum used his company, Guaranty Reserves Trust LLC, to solicit unsuspecting investors. Unlike Hauke, Marcum was virtually penniless at the time of his arrest, having deceitfully spent millions of investor dollars to finance his extravagant lifestyle. “Many scam artists quickly spend their ill-gotten gains, leaving very little which can be returned to victims,” stated Secretary Lawson. “The Marcum case demonstrates the continued importance of the Secretary of State’s Restitution Fund, through which victims can generally recoup at least some portion of their losses.”

Since the Securities Restitution Fund was established in 2010, it has helped victims recover nearly $400,000 in restitution payments.
