3.Under Section 421 of the Code ofCriminal Procedure, 1973, it is thediscretion of the Court passing asentence of fine to issue a warrantfor the levy of the amount by distressand sale of movable property belongingto the offender, although the sentenceprovides for his imprisonment indefault. If the fine is imposed by aCourt of Sessions, the judge should,in the absence of any specialdirection to the contrary in the lawunder which the fine is imposed,direct the warrant to the chiefJudicial Magistrate of the District.If the whole or a portion of the finehas been awarded in compensation orreward, this fact should becommunicated, along with the warrant.The Chief Judicial Magistrate to whomthe warrant is addressed will, onreceipt, cause the particulars to beentered in the proper page of theGeneral Fine Register, and the FineMoharrir will then be responsible thatthe proper steps are taken for therealization of the fine. 5.At the close of each month astatement, for the whole District ofall the fines imposed by Courts, whichwere realized, and credited toGovernment during the month, should beprepared and submitted to theAccountant General and if no fineswere so realized, a certificate thatno realizations were effected, shouldbe submitted. The statement for theSessions Court will be prepared byDistrict Moharrir of fines and signedby the Magistrate of the District. Theofficer who signs the statement willbe responsible for its accuracy. Nazarrat Office11. Civil Nazir 1.The Civil Nazir is to be regarded as

the ministerial head of the process-serving establishment under thecontrol of the Senior SubordinateJudge (or the Administrative Sub-Judgein districts where an AdministrativeSub-Judge has been appointed). Hismain duty is to maintain theefficiency of the process-servingestablishment and for this purpose hewill submit reports and makesuggestions from time to time to theSenior Sub-Judge or the AdministrativeSub-Judge as the case may be. 2.The Civil Nazir will be expected tokeep up the Civil Deposits andRepayments Accounts and to manage theexecution of decree business. It isleft to Senior Subordinate Judges toissue detailed instructions as to theduties which are to be performed bythe Civil Nazir. The Civil Nazirshould devote his time to thedistribution of business amongstprocess-servers, the transmission ofprocesses to agencies located attehsils for service, the management ofthe accounts and correspondenceregarding the payment of diet money towitnesses, and other similar mattersconnected with the carrying out of thesystem of serving processes throughagencies located at outlying tehsils.(page no.434 Chapter 6-A of PunjabHigh Court Rules and orders Vol. 4)

3.Every Civil Nazir shall be providedwith a strong box for the custody ofall light property such as jewels,bullion, etc.,up to the value of onethousand rupees. This strong box maybe placed in the outer room of theTreasury, if it is open, as providedin Chapter 3 of the Punjab FinancialRules and if it is closed, theofficer-in-charge should arrange forits safe custody in the Civil Nazir'smalkhana, subject to the provision ofrule 8. 4.Columns 1 to 5 of the MiscellaneousRegister F shall be filed up by theCivil Nazir on receipt of theproperty. The number given to thedeposit in column no.1 shall be notedby the Nazir on the record of theproceedings ordering the property tobe made over to him. 5.All civil forms will be stocked by theCivil Nazir whose duty it will be tosupply them to Subordinate Judges andExtra Assistant Commissioners whenrequired. (page no.619 Chapter 25-Bof Punjab High Court Rules and ordersVol. 4)

Record Room13. Record Keeper 1.On receipt of the case in the Record

He will then, ifthe record is complete, sign thecertificate to that effect at the footof the index, and enter the case inits appropriate register; if anypapers or court fee stamps are missinghe will at once bring the deficiencyto notice. The papershall then be sent to the nearestpaper-making jail after ascertainingfrom the jail concerned whether itdoes require the waste paper. Thepaper should be sold in the openmarket if he reply of the jail is inthe negative, the sale proceedingsbeing credited to the head “ XXI-Administration of Justice –Miscellaneous Fees and fines –Judicial Record Room Receipts.” (pageno.514 Chapter 16-E of Punjab HighCourt Rules and orders Vol. 4)

8.2-A,-Documents of a secret orconfidential nature should not be soldbut destroyed by being burnt underproper supervision. (page no.514Chapter 16-E of Punjab High CourtRules and orders Vol. 4)

9.When under the above rules the wholeof the papers of Part A of the recordare destroyed, a note to the effectshall be made at the time ofdestruction, against the entry of thecase in the Goshwara. In the case ofthe record offices of District andSessions Courts where no Goshwaras arekept, the note shall be made againstthe entry of the case in the GeneralRegister. 11.All notes made under the aboveinstructions (i) and (ii) shall beattested by the Record-Keeper. When the copies ofjudgments are returned to him by theoriginal courts, he will add them tothe records, fill in the date ofreceipt and strike those cases off hisrunning list. 12.The rules for the cancellation ofcourt-fee stamps by the Record keeperare contained in a resolution of theCentral Government in the FinancialDepartment, No.1763, dated 24th July,1873, in which it is ordered that theRecord Keeper of every court shall,when a case is decided and the recordconsigned to his custody, punch asecond hole, or, in the case of stampsfalling under clause (c), rule 1 athird hole, in each label, distinctfrom the first and note the date ofdoing so at the same time. Specialattention is requested to the words initalics, as the directions thereincontained in always not compliedwith. The Record Keeper's punchingshould not remove so much of the labelas to render it impossible ordifficult to ascertain its value ornature. From the resolution of theCentral Government, No.3047, dated 5thSeptember, 1883, it will be seen thatthese directions apply only toadhesive label used under the Act, andnot to impressed stamps which need notbe punched a second time. 13.Record Keepers will held personallyresponsible that the stampappertaining to the record under theircharge are complete and they have beenduly cancelled in accordance withthese instructions. Should a record besent into the record room in which thestamps are incomplete or not fullycancelled, the Record Keeper shallreport the circumstances at once tothe Head of the Office and shall deferentering the case in its appropriateregister until orders have been passedin the matter. 14.It is the duty of the Record Keeperto see that the records are made overto the Senior copyist on the day hereceives the application or in themorning of the next working da at thelatest. (page no.530 Chapter 17 ofPunjab High Court Rules and ordersVol. 4)

14. Record RoomClerk/Staff

1.In the case of courts at District headquarters of Districts, a challan induplicate in form given hereinafter,along with the court registers, dulycompleted, will accompany the records.The court registers will beimmediately returned after beingsigned by the Record Room Clerkreceiving the records. One copy of thechallan will be returned later, afterentry of Goshwara number with dateagainst each record and signature infull of the Record Room Clerk. Theother copy of the challan will beretained by Record Room Staff. (pageno.506 Chapter 16-A of Punjab HighCourt Rules and orders Vol. 4)

2.In the case of outlying courts, thechallan will be prepared in triplicateand sent to the District Record roomalong with the records sought to beconsigned. Copying Agency15. Copying agent 1.The senior copyist in each agency

shall be the copying agent and filefetcher and shall be subject to thecontrol of the copying supervisor.(page no.536 Chapter 17 of Punjab HighCourt Rules and orders Vol. 4)

9.Copying agent before any copy isdelivered, shall endorse thereon thedate of delivery and verify thecancellation of the Court Fee Stamps.(page no.534 Chapter 17 of PunjabHigh Court Rules and orders Vol. 4).The copying agent shall maintain aseparate register in form C.D.11 inwhich he shall enter the balance offees recoverable in each case andrefused VPPs and from which he shallprepare the statement required by rule53(2). 10.On receipt of an application thecopying agent shall scrutinize whetherthe copy applied for can be suppliedunder rules ; the application has beenduly stamped with forty paise courtfee stamp and give the correctparticulars for tracing the record;the fee if pre-paid has been correctlyassessed in accordance with the scalelaid down in Schedule A. 12.The copying supervisor shall maintaina register in form D.D.6 for paymentreceived by money order or throughVPP. He shall convert all suchpayments into court fee stamps. Affixthem to the application, and thencancel them by punching out thefigure-head so as to leave the amountdesignated on the stamp un-touched.The part removed by punching shall beburnt or otherwise destroyed. As anadditional precaution the cancellingofficer shall affix his signature andthe date across each label, at thetime of cancellation, in durable ink.Thereafter copying supervisor shallhand over the application to thecopying agent by obtaining his receiptin the register C.D.6. 1.The Judgment Writers, Stenographers orSteno Typists as the case may be,shall prepare as many extra carboncopy of appealable interim order/judgments as are applied for by theparties or their pleader within theprescribed time limit at the time oftranscription of interim order/judgment pronounced by the court.(page no.169 Chapter 11, Part a ofPunjab High Court Rules and ordersVol. 1)

2.The Judgment Writer, Stenographer orthe Steno-typist as the case may be,who prepared the copy, shall makethereon the endorsement 'certified tobe a true copy' and shall sign anddate the endorsement and alsosubscribe his official designationbelow which he shall make theendorsement 'Authorised by Section 76of Indian Evidence Act, 1872' (pageno.550 Chapter 17-A of Punjab HighCourt Rules and orders Vol. 4)

6.After the close of each month, heshall total the income and prepare astatement of monthly income whichshall be sent by him after beingcountersigned by the Presiding Officerof the court by the 15th of succeedingmonth to the Officer incharge of thecopying agency which is required tosupply copies of the records of thatcourt. 2.With the record of each civil case andof each criminal case in which processfees are levied, should be kept aseparate sheet of paper to be termedthe 'Diary of Process Fee' whichshould be devoted to the sole purposeof maintaining a record of processfees. 3.The Goshwara numbers given by theRecord Officer in the challan will beentered in the court registers by theAhlmad. Presiding officer of courtshould on the first working day in themonths of February, May, August andNovember check the Goshwara numbersgiven in the court registers byAhlmads with those entered in thechallan in order to see that entriesare correctly made in the courtregisters and sign the court registersin token of their check.
