ORDINANCE NO. 071.05
BUILDING CODE OF TIIE CITY OF MASBATE.
BE IT ORDAINED, by the Sanggunian Panlungsod ng Masbate, in session duly assembled:
Article IGENERAL PROVISIONS
SECTION 1. Title
1.1 Chapter I Section 102 up to Section 106 inclusive of the National Building Code (NBC) is adapted
verbatim in this Building Ordinance and shall have mandatory force and effect as if fully embodiedhereunder. Amplification in any of its original provisions, objectively to cope-up with the latestadvancements in science and technology shall apply'
l.Z This Ordinance shall be known as the "Building Ordinance of Masbate City" and shall hereinafterbe referred to as the "Ordinance".
SECTION 2. Declaration of PolicY
It is hereby declared the policy of the City in partnership with Barangay government units, nationalgovernment line agencies and the private sector to safeguard life, health, property, and publicwelfare, consistent with the principles of sound envirorunental management and control; and to thisend, make it the purpose of this ordinance to provide for all buildings and structures, a frameworkof minimum standards and requirements to regulate and control their location, site, desigrr, qualityof materials, construction, use, occupancy, and maintenance.
SECTION 3. Scope and ApPlication.
3.1 The scope of this Ordinance shall cover the following disciplines: architectural, civil/structural,electrical, mechanical, sanitary, plumbing, electronics and interior design. This shall also to thedesign, location, siting, construction, alteration, rcpair, conversion, use, occupancy, maintenance,moving, demolition of, and addition to public and private buildings and structures, excepttraditional indigenous family dwellings, and those covered by Batas Parnbansa Bilang 220otherwise known as the 'Economic and Socialized Housing Projects'.
3.2 Existing buildings or structures without appropriate building permits/certificates of occupancy maybe legalized and issued the necessary permits and certificates, provided, they are made to conformto the existing rules and regulations. However, they shall be subject to the imposition of penalties,surcharges, fines and other appropriate measures.
3.3 This Ordinance is based on the exiting laws, rules, and regulations.

SECTION 4. General Building Requirements
4.1 Building and other structure as well as all accessory facilities shall be aesthetically, functionally and
structurally designed to completely and efficiently serve its purpose while protecting life, health,
property and general public welfare and concomitant resource of civic pride and aspirations.
4.2 Building and other structures intended to be used for the manufacture and/or production of any kindof article or product shall comply with adequate environmental safeguards as provided by allgovemment agencies concern.
.3 Buildings and structures together with all parts thereof as well as their adjunct facilities, utilitiesand equipment therein sha11 be maintained in good repair, safe, sanitary, and good workingcondition as originally approved for occupancy.
ON 5. General Site Requirements
5.1 The land or site upon which the building or structure or any adjunct or ancillary facility thereto
shall be the concem of the building official. He shall verify, survey, and ascertain safe design
determinations such as geodetical and geophysical characteristics, the potential chronological orperiodic flooding, soil conditions of the site and other potentials hazard such as pollution, landslides, tsunami. Other environmental factor shall also be considered such as: solar angles,
prevailing, typhoon winds and orientation to significant views.5.2 Sitting of the building shall be govemed by NBC-IRR as to allowable area on lots, actual
characteristics of physical boundaries.
SECTION 6. Definition of terms:
GENERAL - A1l definitions of words, term or phrases used in this Ordinance shall be limited to the
meaning hereunder presented:
ACCESSORIA OR ROW HOUSE - A house of not more than two storeys, composed of a row ofdwelling unit entirely separated from one another by parfy wa1l or walls and with an independent entrance
for each dwelling unit.
ACCESSORY BUILDING - A building subordinate to the main building on the same 1ot and used forthe purposes customarily incidental to those of the main building such as servants quarters, garage, pump
house, laundry, etc.
ADDITION - Any new construction that increases the height and/or floor area of existing buildingstructures.
AGENCY OF THE GOVERNMENT - Refers to any of the various units of the govemment including a
department, bureau, office, instrumentality, or a government owned and controlled corporation.
AGRICULTURAL BUILDING - A building designed and constructed to house farm implements, hay,grain, poultry, livestock or other horticultural products. This skucture shall not be place of humanhabitation or a place of employment where agricultural products are processed, treated or packaged; norshall it be used by the public.
AILEY - Any public space or thoroughfare which has been dedicated or deeded to the public or publicuse as passage way with a width of not more than three meters.
ALTERATION - Works in building/ structures involving changes in the materials used, partitioning, andlocation/ size of openings, structural parts, existing utilities and equipment but does not increase thebuilding height and/or floor area.
ALTER OR AITERATION - Any change, addition, or modification in construction of occupancy.
APARTMENT - A room or suite of two or more rooms, designed and intended for, or occupied by onefamily for living, sleeping, and cooking purposes.

APARTMENT HOUSE - Any building or portion thereof, which is designed, built rented, leased, let orto be occupied, or which is occupied as the home or residence of three of more families living
dently or each and doing their own cooking in the building, and shall include flats and apartments.
LICATION - A prescribed application form from the Office of the Building Official (OBO) dulyished and notafized.
/PERMITTEE - Any person, firm partnership, corporation, head of government or privatetution, organization of any character applying for the issuance of permits and certificates.
CADE - Any portion of a building above the first floor projecting over the sidewalk beyond the first-\,.f--.- storey wall used as protection for pedestrians against rain or sun.\- -\\
I '\ ASSEMBLY BUILDING oR HALL - A building or a porrion of a building used for the gathering
CS---.-_ together of fifty or more persons for such purposes as deliberation, workshop, entertainment, amusement,
\__ or awaiting transportation or of a hundred or more persons in drinking and dining establishments.
ATTIC STOREY - Any storey who11y or partly in roof, so designed, arranged, or built as to be used forbusiness, storage, or habitation.
AWNING - A movable shelter supported entirely from exterior wall of a building and of a type whichcan be retracted, folded, or collapsed against the face of a supporting building,
BACKING - The surface or assembly to which the veneer is attached.
BAICONY - A portion of the seating space of an assembly room, the lowest part of which is raised 1 .20meters or more above the level of the main floor.
BALCONY EXTERIOR EXIT - A landing or porch projecting from the wall of a building, and whichserves as a required means of egress. The long size shall be a least fifty percent open, and the open areaabove the guardrail shal1 be so distributed as to prevent the accumulation of smoke or toxic gases.
BARBECUE - A stationary open hearth orbrazier, either fuel-fired or electric, used for food preparation.
BASEMENT * A portion of a building between floor and ceiling which is partly below and partly abovegrade but so located that the vertical distance from grade to the floor is less than the vertical distance fromgrade to ceiling.
BASEMENT OR CELLAR - The portion of a building usuaily below level or grade cellar when usedexclusively for storage as wine cellar floor [and ceiling which is wholly or partly below grade, and solocated that the vertical distance from grade to the level is equal] measured to one floor height.
BAY OR PANEL - One of the intervals or spaces into which the building front is divided by columns,buttresses or division walls.
BOARDING HOUSE - A house with five or more sleeping rooms where boarders are provided withlodging, and meals for a fixed sum paid by the month, or week, in accordance with previous arrangement.
BOILER ROOM - Any room containing a stream or hot water boiler.
BUILDABLE AREA - The remaining space in a lot after dedurcting the required minimum open spaces.
BUILDING - Any structure built for the support, shelter or enclosure of persons, animals, chattels, orproperty of any kind.
BUILDING FOOTPRINT - The surface pattern bounded by the building's peripheral exterior walls onthe ground slmonymous to buildable area.

DING OFFICIAL (BO) - The City Engineer shall also serve as the Local Building Official pursuant
Section 477, Article 7 of Republic Act 7760 or the Local Government Code.
BUILDING PERMIT - A document issued by the Building Official (BO) to an owner/applicant to
proceed with the construction, installation, addition, alteration, renovation, conversion, repair, moving,
demolition or other work activity of a specific project/building/structure or portion thereof after the
accompanying principal plans, specification and other pertinent documents with the duly notarized
application are found satisfactory and substantially confirming with the National Building Code of the
Philippines and its Implementing Rules and Regulations.
BUILDING WIDTH - Its shorter linear dimensions usually measured in the direction of the floor, beams
or joints.
CANOPY - A suspended covering over a window opening or entrance door.
CARPORT - An open shelter.
CASING - A wood, metal or plastic covering or trim around the door or window frame.
CELLAR - The portion of a building between floor and ceiling which is wholly or partly below grade
and so located that the vertical distance from grade to the floor below is equal to or greater than the
vertical distance from grade to ceiling.
CELLULOSE ACETATE BASE - Safety photographic and X-Ray film identified by the marking on the
edge of the film, which shows plainly before and after developing.
CHIMNEY CLASSIFICATIONS :
(a) RESIDENTIAL APPLIANCE TYPE - A factory built or masoffy chimney suitable foe
removing products of combustion from residential type appliance producing combustion gases
not in excess 538 C measured at the appliance flue outlet.
(b) LOW-HEAT APPLIANCE TYPE - A factory-built masonry or metal chimney suitable forremoving products of combustion from fuel-burning low-heat appliances producing combustiongases not in excess of 538 C under normal operating conditrons but capable of producing
combustible gases of 760 C measured at the appliance flue outlet.
(c) MEDruM-HEAT APPLIANCE TYPE - A factory built masonry or mental chimney suitable forremoving the product of combustion from the fuel-burning medium-heat appliances producingcombustion gases not in excess of 1093 C measured at the appliance flue outlet.
CHIMNEY CONNECTOR - The pipe which connects a flue- burning appliance to a chimney
CHIMNEY LINER - The lining materials of fire clay or other approved materials.
CHIMNEY, MASONRY - The chimney of solid masonry units bricks, stones, listed hollow unit masonryunits, or reinforce concrete.
CHIMNEY METAL - A flue made of metal for smoke or gases from fire.
CONCRETE BLOCKS - A hollow or solid concrete masonry unit made of cement and suitableaggregates such as sand, gravel, crushed stone, bituminous or anthracite cinders, burned clay, pumice,volcanic scoria, air cooled or expanded blast furnace slag.

TRUCTION - A11 on-site work done in the site preparation, excavation, foundation, assembly ofand installation of utilities, machineries and equipment of building/structure.
ERSION - A chance in the use or occupancy of building/structures or any portion/s thereof, whichdifferent requirements.
COPING - The material or unit used to form a cap of finish on top of a wall, pier, or pilaster.
CORROSSION-RESISTANT MATERIALS - Materials that arc inherently rust-resistant or materials to
which an approved rust-resistive coating has been applied either before or after forming or fabrication.
COURSE - A continuous horizontal layer of masonry units.
COURT - An occupied space between building lines other than a yard: free, open and unobstructed by
appendages from the ground upward.
DEMOLITION - The systematic dismantling or destruction of a building/structure, in whole or in part.
DISPERSAL AREA (SAFE) - An area which will accommodate a number of person equal to the total
capacity of the stand and building it serves, in such manner that no person within the area need be closer
than 15.00 meters from the stand or building. Dispersal areas shal1 be based upon an area of not less than
0.28 square meter per person.
DWELLING - Any building or any portion thereof which is not an " apartment house", "lodginghouse", or a "hotel" as defined in this Code which contains one or two "dwelling units" or "guest rooms",
used, intended or designed to be built, used, rented, leased, let or hired out to be occupied or which are
occupied for living purposes.
DWELLING, INDIGENOUS FAMILY- A dwelling intended for the used and occupancy by the familyand owner only. It is one constructed by native materials such as bamboo, nipa, logs, or lumber the totalcoast ofwhich does not exceed Fifteen Thousand Pesos.
DWELLING, MULTIPLE - A building used as a home or residence by three or more families livingindependently from one another each occupying one or more rooms as single house keeping unit.
DWELLING, ONE FAMILY - A detached building designated for, or occupied exclusively by one
family.
DWELLING UNIT- One or more habitable rooms which are occupied or which are intended ordesignated to be occupied by one family with facilities for living, sleeping, cooking and eating.
EAVES - Edge of roofing overhanging from the exterior wall.
EXIT - A continuous and unobskucted means of egress to a public way, and shall include interveningdoors, doorways, corridors, exterior exit balconies, ramps, stairways, smoke proof enclosures, (horizontalexits, exit passageways) exit courts, and yards. An exit be deemed to be that point which opens directlyinto a safe dispersal area ot public way. All measurements are to be made to that point when determiningthe permissible distance of travel.
EXIT, FIRE - A fcontinuous and] doorway, unobstructed means of emergency egress to a public way,and includes intervening doors, doorways, corridors, exterior exit balconies, ramps, stairways, smokeproof enclosures, [horizontal exits, exit passageways] exit courts, and yards. An exit be deemed to be thatpoint which opens directly into a safe dispersal area or public way. A11 measurements are to be made tothat point when determining the permissible distance of travel.

COURTS - A yard or court providing egress to a pubLc way for one or more required exits.
f HORZONTAL - A means of passage from one building into another building occupied by thetenant through a separation wall having a minimum fire resistance of one-hour.
EXIT PASSAGEWAY - An enclosed means of egress connecting a required exit or exit court with apublic way.
FACING - Any masonry, forming an integral pfart of a wall used as a finished surface.
FAQADE - Front of or exterior appeararrce of the building.
FILM LABORATORY - A room where processing ofperformed.

FIRE SEPARATION (WALL) - Horizontal or vertical separator of rated fire-resistive materials toprotect floor or wall respectively and to isolate fre hazardous areas from non-fire hazardous areas.
FIRE RETARDANT TREATED WOOD - Lumber or plywood impregnated with chemicals and whentested in accordance with accepted fire standards for a period of 30 minutes shall have a flame-spread ofnot over 25 and show no evidence of progressive combustion. The fire-retardant properties shall not beconsidered permanent when exposed to the weather.
FIRE WALL - An exterior wall abutting the party or properly line purposely to enclose such part of thebuilding from fire; usually of fire- resistive rating depending upon its occupancy within or the degree ofhazardousness that requires protection.
FIRST STOREY- The storey the floor of which is at or above the level of the sidewalk or adjoiningground, the remaining storeys being numbered in regular succession upward.
FLOOR AREA- The area included within the surrounding exterior walls of a building or portion thereof,exclusive of vent shafts and courts. The floor area of a building or portion thereof, not provided withsurrounding exterior walls, shall be the usable area under the horizontal projection of the roof or floorabove.
FOOTING- That portion of the foundation of a structure which spreads and transmits loads directly to thesoil or the pile.
FOTINDATION- A11 the portions of the building or structure below the footing, the earth upon which thestructure rest.
GARAGE- A building or portion thereof in which a motor vehicle containing gasoline, distillate, or othervolatile, flammable liquid in its tank, is stored, repaired, or kept.
GARAGE COMMERCIAL- A garage where automobiles and other motor are house, cared for, equipped,repaired or kept for remuneration, hire, or sa1e.

OpEN pARKING- A structure of one or more tiers in height which is at least 50o% open on
sides is used exclusively for the parking or storage of passenger motor vehicles having a
of not more than nine persons per vehicle. Open parking garages are further classified as either
ilp-u""".. or mechanical-access, open parking garages are those employing a series of continuously
rising floors permitting the movement of vehicles under their own power from and to the street level

GARAGE PRTVATE- A building or a portion of a building in which only motor vehicles used by the
tenants of the building or buildings on the premises are stored or kept.
GRADE (ADJACENT GROLTND ELEVATION)- The lowest point of the elevation of the finished of the
ground the exterior wall of a building and a point 1.50 meters distant from said waIl, or the lowest point
of elevation of the finished surface of the ground between the exterior wall of a building and a property
line if it is less than 1 .50 meters distant from said wall. In case walls are parallel to and within 1.50 meters
of a public sidewalk, alley, or other public way, the grade shall be the elevation of the sidewalk, alley, or
public way.
ICC- Any container approved by International Commerce Commission for transporting any liquid,
gaseous or solid material of a flammable , toxic or other hazardous nature.
IMpLEMENTING RULES AND REGULATION (IR'R) - The rules and regulations promulgated and
issued by the Secretary to implement the Code on the design, location, srting, construction alteration,
repair, conversion, use, occupancy, maintenance, moving, demolition of, and addition to public and
private buildings/structures.
MOVING - The transfer of building/structures or portion/s thereof from original location or position to
another, either within the same lot or to a different one.
NATIONAL GOVERNMENT- Refers to the entire machinery of the central government as distinguished
from the different forms of local government.
OFFICE OF THE BUILDING OFFICIAL (OBO)- The office authorized to handle the processing and
issuance of the building permit and other anclllary or accessory permits/certrficates pertaining to building
/structures owed by the government or private entities. Pursuant to Section 47, Article 7 of the Local
Govemment Code, the City Engineer shall also act as the local building official.
PERMIT- The principal building permit and all the ancillary or accessory permits pertaining to
buildings/structures and appurtenance, such as architectural, civil/structural, mechanical, sanitary,
plumbing, electronics and interior design.
PHOTOGRAPHIC FILM - Any filmed used in photography or motion picture.
REPAIR- Remedial work done on any damaged or deteriorated portion/s of building/structure to restore
to its original condition.
RENOVATION - Any physical change made on buildings/ structures to increase the value, quality, and
or to improve the aesthetic.
SELF-CLOSING FIRE ASSEMBLE - A fire assembly which may remain in an open position and whichwill close automatically if subjected to either of the following: 1. An increase in temperature, 2 .products
of combustion other that heat.
SHUTTER - An assembly made of incombustible material installed on openings and exhaust ducts to
prevent the spread offire.
X- RAY FILM - Film used in x- ray machines.

Article IIADMINISTRATION AI{D ENFORCEMENT
Administration Supervision of Local Chief Executives over the Local Builcling OJJicials.
The City Mayor, berng the appointing authonty with respect to the building officral, shal1 exerciseadministrative supervision over the Local Building Officia1.The Local Chief Executive sha11 see to it that the Local Building Official is performing their dutiesand responsibilities as provided for in the National Building Code.ln instances wherein appeals liom the decisions and orders of the Local Building Official arelodged before their office, they sha11 transmit the same to the Ofllce of the Secretary of DPWH andadvise the appellant in wrrting of such action.

SECTION 2. Duties of a Building Officials.
In his respective territorial jurisdiction, the buildrng OiTicial shall be primanly responsible for theenforcement of the provisions of thrs code as well as of thc implementing rules and regulations issuecltherefor. He is the official charged with the duties of issurng building permits.
In the perforrnance of his duties, a Building Official nray enter any building or its premises at allreasonable times to inspect and deterrnine compliance wrth the requirements of this code, and theterms and conditions provided for in the building permit as issued.
Whenanyburlding work is found to be contrary to lhe provisions of this Code, the BuildrngOfficial may order the work stopped and prescribe the ternis and/or conditions when the work will beallowed to resume. Likewise, the Building Oflicial is aul'rorized to order the discontinuance of theoccupancy or use ofany building or structure or portion tht:reoffound to be occupied or used contraryto the provisions of this Code.
SECTION 3. Fees.
Fees are subject to the provisions of Article lB, section 62 to Article 26, section B9 of AmendedMunicipal Tax Code Ordinance No. 01 - 98 of the City of Masbate and Rule III of PD 1096 or theNational Building Code, whichever is higher in rate.
SECTION 4. Application to Existing Buildings and Other Structures.
4.1 General: Existing Building other structures subject to arlditions, alterations, repairs or renovationshall comply with all requirements of thrs ordrnanc],' as to regulatory measures in type ofoccupancies and/or type of construction, fire safety, reqi.rired number of exits and safety measuresin construction assemblies, and such sha1l be properly done in a manner as to preserve its structuralintegrity, stabilrty, soundness, aside lrom the architeciural character and legacy of building ofhistoric significance.
4.2 Historic building subject to alteration, repairs, reno,,,'ations, additions, upgrading necessaryfor the pteservation, restoration, rehabilitation or continued use or need not conform to alirequirements of the code. However, such shall be subjeeit to regulation of the government agenciesconcemed like the National Historical Institute (NHI) or National Museum, The DPWH fthru therecommendation for approval of the Architectural Code (iommittee]
4.3 Existing building and other structures shal1 be maintained in safe and sanitary conciitron. A11devices, appliances, equipment and safety provisions ano ambiance therefbre sha1l be ir-r appropriateand proper working/operating conditions.
4.4 Tests: when sufficieni evidences of non-compliance with any provisions of the code is found dulngconstruction, final inspection or upon penodic inspectir n, may order a thorough investigation ortest and rectification thereof at the expense of the owner ;rnd subject to applicabli penal proviso.

#il Administrativesanctions.
The Ordinance provide the following administrative sanction to insure observance and compliance
ith all its provisions:
5. 1 . 1 Non-issuance, suspension or revocation of permits5. 1 .2 Non-issuance, suspension or revocation of certificates of occupancy.
5. 1 .3 Issuance of Work Stoppage Order or Notice.5.1.4 Issuance of Order for Discontinuance of Use or Occupancy of Buildings/Structures or parts
thereof.Abatement andl or demolition of dangerous/ruinous buildings/structures.
5.1.5 Imposition of administrative fines, surcharges and penalties.
5.2 Grounds for the Non-issuance, Suspension, Revocation of permits:
The BO may order or direct the non-issuance, suspension or revocation of a permit based on any or all the
following grounds:
5.2.1 Non-compliance with the plans and specifications submitted during the application forbuilding permit with the prescribed standard requirements promulgated in accordance withthe provision of the Code.
5.2.2 Non-compliance with the terms and conditions of permits.5.2.3 Failure to commence the work within a period of one year from the date of issuance of
permit.5.2.4 Abandonment of the work so atthorized in the permit at anfiime after it has been
commenced for a period of one hundred twenty (120) calendar days or more.
5.2.5 Unauthorized change, modification or alteration in the submitted plans and specification
and/or in the type of conskuction.
Failure to engage the service of a duly licensed architect or civil engineer to undertake
the full time inspection and supervision of the construction work andlor failure of the licensed
architect or civil engineer hired to keep at all times at the jobsite a logbook of the progress ofconstruction.
Failure to submit the original design plans stamped by the BO and/or the as-built plan
prior to renovation, alteration, conversion andlor any change affecting the structural stability,architectural presentability and type ofconstruction ofa building/structure.
5.3 Grounds for Non-issuance or Revocation of Certificate of Occupancy/Use:
The BO may direct the non-issuance or revocation of a Cerlificate of Occupancy based on any or all ofthe following grounds:
5.3.1 Non-compliance with the terms and conditions of the permits.5.3.2 Incorrect or inaccurate data or information supplied and incomplete requirements in the
application for a Certificate of Occupancy/Use.
Failure of the owner/applicant to submit the logbook, duly notaized Certification ofCompletion, as-built plans and specifications, and building inspection sheets, duly signed
and sealed, to the BO upon completion of the conshuction.
5.4 Issuance of Work Stoppage Order or Notice:
The BO shall conduct periodic inspection of building/structures and their premises within his area ofjurisdiction. He may direct or order the work stopped by notice in writing served to the owner/proprietoron any responsible person engaged in the doing or causing such work based on any or all of the followinggrounds:

Issuance of Order for Discontinuance of Used or Occupancy:
The BO shall conduct annual inspection of buildings/structures and therr premises withln his area ofjurisdiction. He may direct or order the discontinuance of use or occupancy of buildings/strr-rcturcs
or part thereof based on any or all of the following grounds:
5.5.1 Dangerous or Ruinous Building/Structure specified in Sectron 5.7 of this ordinance.
5.5.2 Use or Occupancy of a buildrng/structure without a Certificate ofOccupancy/Use/Operation even if constructe d under a vaird building permit.
5.5.3 Change in the exrsting use or occupancy classification of a building/structure or portion
thereof without the corresponding Certificate of Change of Occupancy.
5.5.4 Errors found in the appHcation for Certificate of Occupancy, As-built P1an, Notarized
Certificate of Completron and Logbook.5.5.6 Maintainrng hazardous, dangerous and excessive occupancy loadrng beyond the desrgned
capacity of the building/structure or portion thereof.
Non-confonning Use or Occupancy:
5.6.1 The use or occupancy of any building/structure legally authorized under RA 6541 prior tothe adoption of the PD 1096-NBC and its IRR maybe continued although such use or
occupancy does not conform to the approved city zoning or land use ordinance.5.6.2 However, no such nonconforming use or occupancy sha1l be enlarged, increased or
extended to occupy a greater area of land than that already occupied by such
buildrng/structure. Neither shall such non-confonning use or occupancy be moved in wholeor in part, to any other portion of the lot or parcel of land where such non-conforming use
or occupancy exists.5.6.3 A building/structure whose non-conforming use or occupancy has ceased for more than one
(1) year, or has been changed to a use pennitted in the City in which it is located, sha11 notbe revived as a non-confoming use.
5.6.4 A non-conforrring building/structure, or a groupofnon-confbrmingbuildrngs/structuresrelated to one (1) use and under one (1) ownershrp, which have been damaged or destroyedby typhoons, fires, earthquake, or other calamitie s, may be reconstructed and used as befbreprovided that such reconstruction is done within twelve (12) months liom the date of sr-Lch
damage, and provided, further, that cost of tht- reconstruction is not more than twentypercent (20%) of the original construction cost of the buildings or structures. Cost ofreconstruction and the origrnal construction should be in accordance with table I. of thisordinance.
Abatement/Demolition of Dangerous/Ruinous Buildings/Structures :
When any burlding/structure is found or declared to be dangerous or ruinous, the BO sha11 order rtsrepair, vacation or demolition depending upon the degree of danger of 1ife, health, and the saleand/or well berng of the general pubiic and its occupants. Whenever any building/structure or portion thereof has been damaged by fire,earthquake, wind, flood, or by any other cause to such and extent that the structuralstrength or stability thereof is materially less than it was before the catastrophe and is less
than the minimum requirements of the NSCP for new building of similar structure,purpose or location.
Whenever any portion or member or appurtenances thereof is likely to fall, or tobecome detached or dislodged or to collapse and thereby injure persons or damageproperty.
Whenever any portion of a building/structure or any member, appurtenance orornamentation on the exterior thereof is not of sufficient strength or stability, or is notanchored, attached or fastened in place so as to be capable of resisting a wind pressure ofone-half of that specified in the NSCP for such type of buildings.
Wherever any portion thereof has been wrecked, warped, buckled or settled tosuch an extent that the walls or other skuctural portions have materially less resistance towind or earthquake than is required in the case of similar new construction.
Whenever the building/structure or any portion thereof, because of: (1)dilapidation, deterioration or decay; (2) faulty construction; (3) the removal, movementor instability of any portion of the ground necessary for the purpose of supporting such
building; ( ) the deterioration, decay or inadequacy of its foundation; or (5) any othercause, is likely to partially or totally co1lapse.
Whenever the exterior wal1s or other vertical structural member lean or buckle tosuch an extent that a plumb line passing through the center of gravity does not fall insidethe middle one-third of the base.
Whenever the building/structure, exclusive of the foundation, shows thirfy threepercent (33%) or more damage or deterioration of its supporting member or members, orfifty percent (50%) damage or deterioration of its non-supporting members, enclosing oroutside walls or covering.
Whenever the building/shucture has been so damaged by fire, wind earlhquakeorflood,orhasbecomeso dilapidated or deteriorated as to become: (1) an attractivenuisance to public; (2) aharbor for vagrants, criminals or immoral persons; or (3) a resortfor purposes of committing unlawful or immoral acts.
Whenever the building/structure which, whether or not erected in accordance
with all applicable laws or ordinances, has in any non-supporting part, member orportion, less than fifty percent (50%) or in any supporting part, member or portion less
than sixty six percent (66%) of the: (1) strength; (2) fire-resisting qualities orcharacteristics; (3) weather-resisting qualities or characteristics required by law in thecase of a newly constructed building of like area, height and occupancy in the samelocation.
Whenever any portion of a building/structure remains on the site after itsdemolition or whenever any building/structure or portion thereof is abandoned for a
period in excess of twelve ( 1 2) months so as to make it a nuisance or hazard to the public.
Fire Hazards
5.7 .2.1 Any building/structure or portion thereof device, apparatus, equipment material,or vegetation which may cause fire or explosion, or provide a ready fuel oraugment the speed and intensity of fire or explosion arising from any cause.
5.7.2.2 All buildings/structures or portions thereof not provided with the required fire-resistive or fire-protective conshuction or fire-extinguishing system orequipment.
5.7 .2.3 Whenever any door, aisle, passageway, stairway, or other means of exit is not ofsufficient width or size, or is not so arranged as to provide safe and adequatemeans of exit in case and panic.
5.7.2.4 Whenever any building/structure, because of obsolescence, dilapidated condition,deterioration, damaged, inadequate exits, lack of sufficient fire-resistiveconstruction, hazardous eleckic wiring, gas connections or heating apparatus, orother cause, is determined by the BO to be a fire hazard.

or sites-considered to be extremely dangerous and in environmentally critical
areas.
5.7.8 Illegal Conshuction
5.7.8.1 A building/structure shall be deemed to be an illegal construction when it is
constructed, existing or is maintained in violation of any specific requirement or
prohibition applicable to such building/structure as provided in the Code.
5.7.9 Abatement ofDangerous,/Ruinous Buildings
pursuant to Section 215 of the Code, when a building/structure is found or declared by
the BO to be a nuisance, is dangerous or ruinous, he shall order its repair, vacation or
demolition depending upon the d.gr.. of danger to life, health, safety and/or well being
ofthe general public and its occupants.

,7 .IO Procedure for Abatement/demolition of Buildings/structures
5.7.10.1 There must be a finding or declaration by the BO that the building/structure is a
nuisance, ruinous or dangerous.
5.7 .10.2 Written notice or advice shall be served upon the owner and occupanVs of such
finding or declaration giving him at least fifteen (15) days within which to
vacate or cause to be vacated, repaired, renovated, demolished and removed as
the case may be, the nuisance, ruinous or dangerous building/structure or any
part or portion thereof.,5.1.10.3 Within the fifteen (15) day period, the owner may, if he so desires, appeal to the
I.ocal Chief F,xecutive the finding or declaration of the BO and ask that a re-
. inspection or re-investigation of the building/structure be made.
.rS.l.tO.+tf itre appeal is meritorious, the Laggl Chief Executive may designate a
competent representative/s other than the BO tb riiidertake the re-inspection or
re-investigation of the building/structure. The representative/s so designated
shall make or complete his/their report/s within the period of thirty (30) days
from the date of termination of re-inspection or re-investigation.
"'' 5 .7 .1,0.5 If after re-inspection, the finding is the same as the original one, the Irocal Chief
Executive through the BO shall notify the owner, giving him not more than
fifteen (15) days from receipt of notice with affirmed finding to vacate or cause
to be vacated and make necessary repair, renovation, demolition and removal ofthe subject building/structure or part thereof, as the case may be'
If the BO has determined that the building/structure must be repaired or
renovated, the Order to be issued shall require that all necessary permits therefore
be secured and the work be commenced physically within such reasonable time
as may be determined bY the BO.
If the BO has determined that the building/structure must be demolished,
the Order shall require that building. /structure be vacate within fifteen(15) days from the date of receipt of the Order: that all required permits be
secured therefore within the dame fifteen (15) days from the date of the Order,
and that the demolition be completed within such reasonable time as may be
determined by the BO.
{ i.l.to.AThe decision of the -tCE on the appeal shal1 be final.5.7 .10.7 Upon failure of the owner to comply with the Order of the BO or of theLCE, in
case of appeal, to repair, renovate, demolish and remove the building/structure
or any part thereof after fifteen (15) days from the date of receipt of the Order,
the BO shall cause the building or structure to be repaired, renovated,
demolished and removed, parlly or wholly, as the case may be, with all expenses
therefore chargeable to the owner.5.7.10.8 The building/structure as repaired or in case of demolrtion, the building
materials gathered after the demolition thereof shall be held by the OBO untilfull reimbursement of the cost of repair, renovation, demolition and removal is
made by the owner which, in no case, shall extend beyond thirty (30) days fromthe date of completion of the repair, renovation, demolition and removal. Aftersuch period, said building materials of the building thus repaired, renovated or
removed shall be sold at public auction to satisfy the claim of the OBO. Anyamount in excess of the claim of the government realized from the safe of the
building and/or building materials shall be delivered to the owner.
5.7.I0.9 The procedures, actions and remedies herein are without prejudice to furtheraction that may be taken by the BO against the owner/occupants of the
building/structure found or declared to be nuisance/s, dangerous, and/or ruinousunder the provisions of Articles 482 and 694 to 707 of the Civil Code of the
Philippines.

l. Business Permits
No Business Permit shall be issued by the concerned Local Unit or Department unless a validCertificate of Annual Inspection has been issued.
2. Business Permits
General. Chapter 3, Section 309 inclusive of the National Building Code (NBC) is adaptedverbatim in this ordinance and shall have mandatory force and effect as if fully embodiedhereunder. Amplification in any of its original provisions, objectively to cope-up with the latestadvancements in science and technolory shall apply.
2.2 No person, firm or corporation, including any agency or instrumentality of the government shallerect, construct, alter, repair, ronovate, move, convert or demolish any building or structure orcause the same to be done without first obtaining a building permit from the Office of theBuilding Official. Government agencies and/ or Civic projects exempted from payments of said
'permits, as provided for in PD 1096-NBC shall mandatorily acquire the same from the OBO ofthe LGU for a purpose of record to ascertrain responsibility for the building design andconstruction under the Law.
SECTION 3. Applicationfor Building Permits
3.1 Application for Building Permit shall be signed by the owner/ applicant, design professionals andduly licensed architect or engineer who will undertake full time inspection and supervision of theconstruction/ installation signed and sealed by the corresponding design professionals who shallbe responsible for the comprehensive and correctness of the plans in compliance to the Code andits IRR and to all applicable referral codes and professional regulatory laws.
3.2 Buildingl Sffucture Accessory Permits
3.2.1 Building/ Structure Accessory permits are issued by the BO for accessory parts of theproject with very special functions or use, which are indicated or implied in the plans andspecifications that accompany the building permit application. These must the same

Processing of Building Permit
The processing of the application for a Building Permit by the Building Official (OBO) shall be
purely ministeiial; to preiisely see to it that permit is accomplished to the letter.
Incomplete information or data shall be returned to the Architect or Engineer, until satisfactory
completion of the said documents. The Building Official upon the recommendation of his technical
staff shall do official issuance of the Building Permit.
Validily of Building Permit
pursuant to pD 10g6 the NBC and its IRR, a Building Permit issued under the provisions of the
NBC shall expire and become null and void if the buildingorworkthereinisnotcommencedwithin a period of one year from the date of issuance of such permit, or if the building or work so
authorized is suspended or abandoned at any time after it has been commenced, for a period of 120
days.

{-=--Non-Issuance, Suspension or Revocation of the Building Permit
Pursuant to PD 1096-NBC and its IRR, the Building Official may order or cause the non-issuance,
suspension or revocation of Building Permit for any or all of the following reasons:
7.1.1 Errors found in the Plans, Specifications, and other Construction Documents;
7.1.2 Incorrect or inaccurate data or information supplied;
7.1.3 Non-compliance with the Terms and Conditions of the Permit;
7.1.4 Notice of non-issuance, suspension or revocation of the Building Permit shall always be
made by the Building Official in writing, stating the reasons or grounds therefore.
SECTION 8. On-Site Inspection and Superstision
8.1 The Architect or Engineer for his protection under Civil Code CC Article 1723 shall periodically
inspect the construction operation to see to it that the works are executed in faithful compliance
with all the construction documents for which the Building Permit was issued as stipulated in this
Ordinance and/or PD 1096-NBC, and it's IRR. He shall attest to all final inspection permits as
accepted and accomplished, signed and through his Architect/Engineer in - Charge of the division,
section, or unit, who shall recommend the issuance or non-issuance of the Certificate of Occupancy.
8.2 The above article "8.1" does not necessarily preclude the commissioning by the Owner of an
Architect/Engineer in - Charge for the full time superintendence or administration of construction
nor prevent the design Architect/Engineer to be commissioned as the Project Construction
Administrator or Construction Manager.
SECTION 9. Certificate of Occupancy
g.l Pursuant to Section 309 of the National Building Code (PD 1096), no building or structure shall
be used or occupied and no change in the existing use or occupancy classification ofa building or
structure or portion thereof shal1 be made until the Building Official has issued a Certificate ofOccupancy therefor.
g.Z To secure a certificate of occupancy, the ownerlapplicant shall submit to the Building Official the
following documents:9.2.1 Cerifrcate of Completion together with the logbook and the Building Inspection Sheet duly
Accomplished by the contractor (if the construction is undertaken by contract), signed, and
sealed by the architect or civil engineer in-charge of the construction work. Said architect
or civil engineer may hire the services of one or more project inspector/s to assist in the fulltime inspection and supervision of all aspects by the conskuction. Said project inspector/s
must be qualified professional/s, who is/are duly registered architect/s, master electrician/s,
master plumber/s, etc.
9.2.2 As-built plans and specification jointly signed and sealed by the designing architect or civilengineer and the architect or civil engineer in-charge for the construction, sigred by the
contractor (if the construction is undertaken by conkact), and confirmed by the owner. Said
plans and specification shall reflect faithfully all changes, modification and alterations
made on the original building permit.g.2.3 A Certificate of Occupancy sha1l be issued by the Building Offrcial within thirty (30) days
if after frnal inspection and submittal of a Certificate of Completion referred to in the
preceding section, it is found that the building or structure complies with the provisions ofthe Code.
g.3 The Certificate of Occupancy shall be posted or displayed in a conspicuous place on the premises
and shall not be removed except upon order of the Building o0fficial.g.4 Non -issuance of Occupancy and revocation of Certificates of Occupancy and the procedure for
appeal therefrom shall be governed in so far as applicable, by the provisions ofSection 306 and307
of PD 1096-NBC.

ARTICLE IVTYPES OF CONSTRUCTION
SECTION 1. Types of Construction
1.1 For the purpose of this Ordinance, all buildings proposed for construction shall be classifiedaccording to the following types:
1.1.1 Type I - shall be of wood construction. The structural elements may be any of the materialspermitted by the Code.
1 . 1 .2 Type II - shall be of wood construction with protection fire-resistant materials and one ( 1)
hour fire-resistive throughout, except, those permanent non-bearing partitions may use fire-retardant treated wood within the framing assembly with one (1) hour resistively.
1.1.3 Type III * shall be masonry and wood construction. Structural elements may be any of the
materials permitted by the Code provided that the building shall be one-hour fire-resistivethroughout. Exterior walls sha1l be of incombustible fire-resistive construction.
1.1.4 Type IV - shall be steel, iron, concrete, or masonry construction and walls, ceiling andpermanent partitions shall be of incombustible fire-resistive construction, except, thatpermanent non-bearing partitions of one (1) hour fire-resistive construction may use fire-retardant treated wood within framing assembly.
1.1.5 Type V - shall be four (4) hour fire-resistive throughout and the structural elements sha11 be
steel, iron, concrete, or masonry construction.
2. Fire-Resistive Requirements
Exterior bearing and non-bearing walls of Types II and III Conskuctions shall have one hour fire-resistive rating, while those of Types IV and V shall have four- (4) hour fire-resistive rating.Interior bearing walls, permanent partitions, floors, and roofs of Types II to IV Construction shallhave one (1) hour fire-resistiveratingwhile those of Type V shall have three (3) hour fire-resistiverating for bearing walls, one (1) hour fire-resistive rating for vertical openings, floor and roofs.Structural frames of Type II and III Construction shall have one (1) hour fire-resistive rating, whilethose of Tlpe IV shall have two (2) hour fire-resistive rating and those of Type V shall have three(3) hour fire-resistive rating.Exterior doors and windows shall have one (1) hour fire-resistive rating for all Types ofconstruction.

Interior lVall and Ceiling Finishes
Or walls and ceilings of any building shall be classified according to their flame-spread
characteristic using g-enerally accepted engineering standards. The smoke density shall not be
great* than that obtarnea from burning of untreated wood under similar conditions when tested in

3.2 Interior walls and ceiling finishei shall mean interior wainscoting, paneling, or other finish applied
structurally of for decoration, acoustical correction, surface insulation or similar purposes'
Requirements for flame-spread surface insulation or similar purposes. Requirements for flame-
spread characteristics of finishes shall not apply to trim of doors and windows or their frames, and
not to materials which are less than one (1) millimeter in thickness cemented to the surface of walls
or ceilings.3.3 Materials required to be flame-spread proofed shall be treated with a flame-retardant having a
flame-spread of fifty (50) or less as determined by the "Tunnel Test".
ARTICLE VF'IRE-RESISTIYE RE QUIREMENTS IN CONSTRUCTION
SECTION l. Fire-Resistive Rating Defined
Fire-Resistive Rating means the degree to which a material can withstand fire as determined by generally
recognized and accepted testing methods.
SECTION 2. Fire-Resistive Time Period Defined
Fire -Resistive Time period Rating is the length of time a material can withstand being bumed which
may be one (1) hour, two (2) hours, three (3) hours, four (4) hours, etc'
SECTION 3. Fire-Resistive Standards
All materials of construction, and assemblies or combinations thereof shall with the herein matrix.

N 4. Fire-Resistive Regulation

4.3 Regardless of the type of construction, draft stops with (1) hour fire-resistively shall be provided intrussed roofs every two hundred (200) sq. m. Attic area.
ARTICLE \TCLASIF'ICATION AND GENERAL REQUIREMENT
OF'ALL BTIILDINGS BY USE OR OCCUPANCY
SECTION 1. Occupancy Classified
1.1 Buildings proposed for construction sha1l be identified according to their use the character of itsoccupancy and shall be classified as follows:
1.1.1 Group A - Residential DwellingsGroup A Occupancies shall be dwellings.
1.1.2 Group B - Residential, Hotels and ApartmentsGroup B Occupancies shal1 be multiple dwelling units including boarding or lodginghouses, hotels, apartment buildings, row houses, convents, monasteries and other similarbuilding each of which accommodates more than 10 persons.
1.1.3 Group C - Educational and RecreationGroup C occupancies sha1l be buildings used for school or day-care purposes, involvingassemblage for instruction, education, or recreation, andnotclassifiedinGroupl orinDivision 7 and2 or Group H Occupancies.
1.1.4 Group D * InstitutionalGroup D Occupancies shall include:
Division 1 - Mental hospitals, mental sanitaria, jails, prisons, teformatories, and buildingswhere personal liberties of inmates are similarly restrained.
Division 2 - Nurseries for full-time care of children under kindergarten age, hospitals,sanitaria, nursing homes with non-ambulatory patients, and similar buildings each
accommodating more than five persons.
Division 3 - Nursing homes for ambulatory patients, homes for children of kindergartenage or over, each accommodating more than five persons: Provided, that Group DOccupancies shall not include buildings used only for private or family groupdwelling purposes.

3.3.3 A,, Three-Houi Fire-Resistive Occupancy Separation " shall be of not less than three-hour
fire-resistive construction. A11 openings in walls forming such separation shall be protected
by a fire assembly having a three-hour fire-resistive rating. The total width of all openings
in any three-hour- fire- resistive occupancy separation wall in any one-storey sha1l not
exceed 25 percent of the length of the wall in that storey and no single opening shall have
anarea greater than 10.00 square meters. A11 openings in floors forming a " Three-Hour
Fire-Resistive Occupancy Separation " shall be protected by vertical enclosures extending
above andbelow suctr openings. The walls of suchvertical enclosures shall be of not less
than two-hour fire-resistive construction, and all openings therein shall be protected by a
fire assembly having a three-hour flre-resistive rating'
3.3.4 A,, Four-Hour Fire-Resistive Occupancy Separation " shall have no openings therein and
shall be of not less than four-hour fire-resistive construction.
Fire Rating for Occupancy Separation
Occupancy Separations shall be provided between groups, sub groupings' or divisions ofoccupancils. The Secretary shal1 promulgate rules and regulations for appropriate occupancy
sepaiations in buildings olmixed o..rpur"y; Provided, that, where any occupancy separation is
required, the minimum shall be a "One-Hour Fire-Resistive Occupancy separation"; and where the
o..rpur"y separation is horizontal, structural members supporting the separation shall be protected
by an equivalent fire-resi stive construction.
Location on ProPertY
General
No building shall be constructed unless it adjoins or has direct access to a public space, yard or
street on at least one of its, sides. For the purpose of this Section, the centerline of an adjoining
street or alley shall be considered an adjacent property line.
Eaves over required windows shall not be less than 750 millimeters from the side and rear property
1ines.
Fire Resistance of Walls
Exterior walls shal1 have fire resistance and opening protection in accordance with the requirements
set forth by the Building Official. Projections beyond the exterior wall shall not exceed beyond a
point one-third the distance from an assumed vertical plane located where the fire-resistive
protection of openings is first required to the location on property whichever is the least restrictive'
Distance shall be measured at right angles from the property line. When openings in exterior walls
are required to be protected due to distance from property line, the sum of the areas of such
openings in any storey shall not exceed 50 percent of the total area of the wall in that storey.

The floor areas hereinabove provided may be increased in certain specific instances and under appropriate
conditions, based on the existence of public space, streets or yards extending along and adjoining two or
more sides of the building or structure subject to the approval c f the Building Official.
SECTION 7. Maximum Height of Buildings
The maximum height and number of storeys of every buildinE, shall be dependent upon the character ofoccupancy and the type of construction as determined by the'Building Official in consonance with the
approved City Zonin[ Ordinance. The height shall be measur;d from the highest adjoining sidewalk or
ground surfaie: Provided, that height measured from the lowest adjoining surface shall not exceed such
maximum height by more than 3.00 meters: Excepts, that towets, spires, and steeples, erected as part of a
building and not used for habitation or storage are limited as to height only by structural design ifcompleiely of incombustible materials, or may extend not to exceed 6.00 meters above the height limits
for each occupancy group if of combustible materials. l
SECTION 8. Minimum Requirements for Group A Dwelling l
8.1 Dwelling Location and Lot Occupancy
The dwelling shall occupy not more than ninety percent of a corner lot and eight percent of an
inside lot, subject to the provisions on Easements of ),ight and View of the Civil Code of the
Philippines, shall be at least 2 meters from the properfi hne.
8.2 Light and Ventilation !
Every dwelling shall be so constructed and arranged as t,t provide adequate light and ventilation as
provided under Article VII, section 5 to section 14 of this' ordinance.
8.3 Sanitation
Every dwelling shall be provided with at least one smitary toilet and adequate washing and
drainage facilities.
8.4 Foundation
Footings shall be of sufficient size and strength to suppr.,rt the load of the dwelling and shall be at
least 150 millimeters above bottom reinforcement and 600 millimeters below the surface of theground.

1. General
Subject to the provisions of Book II of the Civil Code of the Philippines on Property, Ownership,
and its Modification, all buildings hereafter erected, altered, remodeled, relocated or repaired for
human habitation shall be providid with adequate and potable water supply, plumbing installation,
and suitable wastewater treatment or disposal system, storm water dtainage, pest and vermin
control, noise abatement device, and such other measures required for the protection and promotion
of health of persons occupying the premises and others living nearby.

city sewerige system in accordance with the criteria set by the Code of Sanitation of the
fhilippines anOitre department of Environment and Natural Resources {DENR}

ARTICLE IXBUILDING PROJECT OVER PUBLIC STREET
SECTION 1. General
1.1 No part ofany building or structure or any ofits appendage except signs, sha11 project beyond the

SECTION 2. Projection into Alleys or Streets
2.1 Footings and foundation may be permitted to project or encroach into alleys or streets provided thesame shall not obstruct any existing utilities/services such as power, water, sewer, gas,
communication, and drainage lines, etc.2.2 In cases where there is a need to re-route existing utilities/services lines, the concerned owner may
be permitted to project or encroach into alleys or streets provided that the proper government
authorities and the franchise holder be informed of such development of such development or re-routing; provide further, that the costs for the re-routing works will be charged to the concernedowner.
SECTION 3. Projection of Balconies and Appendages Over Streets
3.1 Projection of balconies and appendages are classified as architectural works andbe constructed ofnon-combustible materials of at least three (3) hour fire-resistive rating.
3.2 If the architectural projection is for pedestrian protection, the same shall be constructed of concretematerials. The clearance between the established grade of the street and/or sidewalk the lowestundersurface of any part of the balcony shall be less than three (3.00) m.

SECTION 4. Arcades

ARTICLE XIIELECTRICAL AND MECHANICAL REGULATIONS

2.1 General
consistent provisions of the two- (2) codes: Philippine Electrical Code Part 1
(PEC-2) and Philippine Mechanical Codes shall form part of this Ordinance.
\*\--H'7\ 2.1.7 Arcaded Sidewalk: Arcaded sidewalk is not compatible with the usual open supply line
construction unless back street is available for the distribution system. Proposed arcaded
sidewalk should therefore be reconciled with the development of the power diskibutionsystem in the area.
2.1.2 Safety of Construction Personnel: The building construction shall be responsible innotifying the electric utility if the nearby power lines may pose hazard to his workers. If theworking clearance is not enough, the power lines need to be guarded temporarily.
2.1.3 Falling debris Form High-rise Building Construction: Falling debris from high-rise buildingconskuction can cause contamination of line insulators if not outright circuit trip outresulting to service interruptions. Interceptors to catch that debris must be provided.
2.1.4 Clearances specified: The clearances specified are the minimum allowed for safety and donot consider the effect of electromagnetic freld (EMF) to human being. The effect of EMFis not considered in specifliing clearances to buildings, etc., since science has yet to proveconclusively the adverse effect of EMF to people.
2.1.5 Tree management: Tall and fast growing tress should not be planted beneath poser linesalong streets. The electrical utility firm has the right to trim offending trees before they
cause circuit intemrption.
On Clearances of Support Structures from other Objects
2.2.1 Measurement of Clearances: Clearances are measured surface to surface. When measuring
the clearances, energized metallic hardware connected to the supply line shal1 be
consideredaspartoftheline conductor. Metallic bases of potheads surge arresters and
similar devices on the other hand shall be considered as part of the support structure.
2.2.2 Clearance of Support Structures from other Objects
2.2.2.1 From fire hydrants: not less than nine hundred (900) mm.2.2.2.2 From streets, roads and highways: portion of the structures and attached
equipment not more than four point sixty (4.60) m above the roadway must have
a sufficient distance to avoid contact by passing ordinary vehicle. At the curb, the
distance must not be less than one hundred fifty (150) mm.
On Clearances of Energized Parts
2.3.1 Covered and bared conductors shall be considered for all clearance requirements.2.3.2 Yertical Clearances of Wires, Conductors, Cables and Equipment over Roadways:
2.3.2.1 The vertical clearances herein given refer to the minimum allowable verticalclearances ofthe conductor and will not require further correction to account foradditional sag due to high temperature operation or for long span installation. and shall have at least two (2) separate exits.

Smokestacks whether self-supporting or guyed, shall be of sufficient capacity to handle fuelgases, shall be able to withstand a wind load of one hundred seventy five (175) lcn per

3.6.3 Manufacturers/assemblers of boilers/pressure vessels/pressurized water heaters shall stamp
each vessel on the front head or on any other suitable location with the name of the
manufacturer, serial number, minimum allowable working pressure, heating surface in sq.
m. Thickness of she11 andyear of manufacture.3.6.4 Boilers of more than forty six (46) sq. m. heating surface shall each be provided with two
(2) means of feeding water, one steam driven and one (1) electrically driven, or one (1)
pump and one injector.3.6.5 Two (2) check valves shall be provided between any feed pump and the boiler in addition
to the regular shut-off valve.3.6.6 Where two (2) or more boilers are connected in paral1e1, each steam outlet shall be
provided with a non-return valve and a shut-off valve.3.6.7 In no case shall the maximum pressure of an old/existing boiler be increased to a grealer
pressure than would be allowed for a new boiler of same construction.3.6.8 Each boiler shall have at least one (1) safety valve. For boilers having more than forfy six
(46.00) sq. m. of water heating surface or a generating capacily exceeding nine hundred
(900) kg per hour, two (2) or more safety valves sha11 be required.3.6.9 Eachboiler shall have a stream gauge, with dial range of not less than one and one-half (1-
1/2) times and not more than twice the maximum allowable working pressure. It may be
connected to the steam space or to the steam connection to the water column.
3.6.10 Repairs/ replacements shall comply with the applicable section on New Installation of the
Philippine Mechanical Code.
3.6.1 1 Upon the completion of the installation, the BO shall conduct an inspection and test, after
which a certificate of operation for a period not exceeding one (1) year shall be issued
upon payment of the required inspection fees and compliance with requirements/s after
inspection, if any.
3.6.12 Miniature and steam processing boilers shall be internally inspected with hydrostatic test
annually while power boilers shall be internally inspected with hydrostatic test annuallywhile power boilers sha1l be internally inspected with hydrostatic test every five (5)
years. However, A11 steam boilers shall each be maintained with operation, repair and
maintenance logbook everyday.3.6.13 The BO shall notify the owner in writing of the intended date of the annual inspection at
least fifteen (15) days from the intended date of inspection.3.6.14 The owner or user of a boiler shall prepare the same for inspection and shall provide all
labor and equipment required during said inspection.
Refrigeration and Air Conditioning
3.7.1 The temperature and humidity to be used for comfortable cooling shall be maintained at

Shutters

SECTION 4. Ventilation
4.1 Film laboratories shall be well ventilated by either natural or mechanical means.4.2 Ventilation systems shall be controlled from within and shall have pilot lights to indicate operation.
The ventilation system serving the processing room may be extended tom cover rooms associated
therewith. Ducts shall be constructed entirely of non-combustible materials such as steel, iron,aluminumorotherapprovedmaterials. Only fire retardant lining shall be used on the inside ofducts.
SECTION 5. Film Vaults
5.1 Vaults shall be constructed with walls, floors and roofs of reinforced concrete not less than onehundred fifty (150) mm thick.
5.2 Vaults shall be property ventilated either by natural or mechanical means. If mechanicallyventilated, the system shall be controlled from within.Vaults shal1 be provided with doors made up of three point twenty (3.20) mm thick steel sheets withfifb, (50) mm asbestos fiber insulation in between. Such doors shall easily be opened from inside.

wood under similar conditions when tested in accordance with generally accepted engineering
practices. The product construction shall be no more toxic than the burning of untreated wood

2.2 Fastenings shall be adequate to withstand design loads and internal and external stresses required of

Approved plastics may be used in skylights installed on roofs of type I,II or III constructions and all
buildings in these categories shall be equipped with an approved automatic fire-extinguishing

4.1.1 Approved plastics may be used in any type of construction or occupancy as a fire venting
system.4.1.2 Plastic may be used in approved skylights in Type II one-hour fire-resistive conskuction
which are located three hundred (300) mm or more above lower flange of the ceiling. The
walls of the skylight well shallb e no less fire-resistive than the adjacent ceiling.
4.1.3 Where a fire-resistive ceiling is not required in one -story building, approved plastics may
be used in skylights.
Lrstallation Requirements
4.2.1 Except in A Group Occupancies, no skylight shall be installed within three- (3.00) m of a
properfy line.4.2.2 The edges of dome-type skylights shall be properly flashed.
4.2.3 Plastics skylights shall be separated from each other by at least two point fifty (2.50) m
laterally and three (3.00) m along the slope of the roof.

4.3 Allowable Areas
4.3.1 The area of individual plastic skylights shall not exceed ten- (10.00) sq. m. The total
aggregate area of plastics used in skylights, monitors, and sawtooth glazing shal1 not
exceed twenty percent (20%) of the floor area of the room or occupancy sheltered.
4.4 Curb Requirements
4.4.1 Plastic skylights in roofs having a slope of less than one (1) in three (3) sha1l have one
hundred (100) mm high curb. The curb may be omitted where a wire screen not smaller
than NO. 12 U.S. gauge with a mesh not larger than twenty (25)mm is provided
immediately below the skylight. The screen shall be substantially mounted below the
skylight.
SECTION 5. Light-Transmitting Panels in Monitors and Sawtooth Roofs
5.1 Where a fire-resistive rating is not required for the roof structure, and in all buildings provided withan approved automatic fire-extinguishing system, approved plastics may be used with or without
sash as the light-transmitting medium in monitors and sawtooth; except, that plastics used in
monitors or sawtooth roofs of type II Construction shall be of materials appropriate to be used
according to flame-spread characteristics.5.2 Area Separation
5.2.1 The area of individual plastic panels shall be separated from each other by a section ofincombustible materials or by a section of the roofing materials of the structure not less
than one point fifty (1.50) m in length. The lower edge of the plastic materials shall be at
least one hundred fifty (1.50) mm above the surface of the adjoining roof surface.

8.2.1 Plastic veneer shall not be attached to any exterior wall above the first storey: Provided,that plastic veneer may be attached to exterior walls above the first storey of the buildinglocated outside of highly restrictive Fire Zones; provided further, that the height of veneer
is not in excess often (10.00) m above the adjacent grade ofelevation.8.2.2 Sections of plastic veneer shall not exceed fifteen (i5.00) sq. m in area, except, that in less
restrictive Fire Zones, The area may be increased by fifty percent (50%).
8.2.3 Sections of Plastic veneer shall be separated by a minimum of one point twenty ( 1 .20) mvertically and six hundred (600) mm horizontally.
SECTION 9. Awning and Canopies
9.1 Plastic materials appropriate for use according to flame-spread characteristics may be utilized inawnings and canopies provided such awnings and canopies are constructed in accordance withprovisions governing projections and appendages as specified in the Code.
9.2 Approved plastic may be used in awning where untreated canvas is permitted.9.3 Approve plastics may be used in lieu of plain glass in greenhouses in less restrictive Fire Zones.
ARTICLE XVISHEET METAL PAINT SPRAYS BOOTHS
SECTION 1. General
1.1 Paint spray booths shall be constructed of steel of not less than No. 18 U.S. gauge in thickness and
shall be designed in accordance with this Ordinance.1.2 The area of a paint spray booth shall not exceed one hundred fifty-- (150) sq. m. or ten percent
(10%) of the basic area permitted for the major use of the building according to its Occupancy
Group.The floor shall be constructed of incombustible material. The floor of the spray booth and operation
working area, if combustible, shall be coveredwithnon-combustible, non sparklingmaterial ofsuch character as to facilitate the safe cleaning and removal of removal of residue.Paint spray booths shall be designed to permit the free passage of exhaust air from all parts of the
interior and all interior surfaces shall be smooth and continuous without outstanding edges.

cm, or by a greater distance, or by such partition or wall as the City Fire Marshall may require.
3. Light
3.1 Paint spray booths shall be illuminated through hammered wire or heat-treated glass panels. The
glass panels shall be located in such a manner as to reduce the hazard of ignition caused by paint
spray deposit.3.2 When spray areas are illuminated through glass panels or other transparent materials, only light
units shall be used source of illuminations.3.3 Panels shall be arranged so that normal accumulations of residue on the exposed surface of the
panel will not be raised to a dangerous temperature by radiation or conduction from the source ofillumination.
SECTION 4. Ventilation
4.1 Mechanical ventilation shal1 be provided direct to the exterior of the building. The mechanicalexhaust system shall be designed to move the air through any portion of the paint spray area at therate of not less than thirty- (30.00) linear m per minute.
4.2 The blades of exhaust fans shal1 be constructed of non-ferrous material and shall be mounted insuch a manner as to prevent contract with the exhaust duct.
4.3 The motor shall not be mounted in the spray booth or the duct system and belts shall be enclosed
where they enter booth or duct system.4.4 The discharge point for ducts in a paint spray booth shall be not less than two (2.00) m from the
adjoining combustible construction nor less than eight (8.00) m from adjoining exterior wallopening; except, that the discharge point for exhaust ducts is not regulated in a waterwash spray
booth.
ARTICLE XVIIGLASS AND GLAZING
SECTION 1. General
i.1 This Ordinance shall apply to exterior glass and glazing in all Uses/Occupancies except Groups A,B, and J not over three (3) storeys in height, and to interior and exterior glass and glazing in alloccupancies subject to human impact.
1.2 Standard for glass and gTazing materials shall conform to the provision on glass dimensional
tolerance, breaking skess level, and design safety factors.
1.3 Each light shall bear the manufacturer's label designating the type and thickness of glass.
1.4 Each slight with special performance characteristics such as laminated heat strengthened, fullytampered or insulated, shall bear the manufacturer's identification showing the special
characteristics and thickness by etching or other permanent identification that shall be visible after
the glass is glazed.1.5 Appropriate measures shall be provided to deter persons walking into fixed glass panels where the
floor contiguous thereto on to both sides is approximately the same level.1.6 Glass panels not adjacent to wall openings may be made obvious by horizontal bars at guardrail
height, a four hundred fifty (450) mm opaque bulkhead, distinctive glass such as etched ortranslucent for guardrail height, fixed flower bins or other appropriate construction arrangement.
SECTION 2. Area Limitation
2.1 Exterior glass and glazing shall be capable of safety withstanding the load due to wind pressure forvarious height zones above ground acting inward or outward. The area of individual light shall not
be more than the maximum allowable area of glass according to the wind load multiplied by the
appropriate adjustment factor.

2.1.1 Wired or wireless telecommunications systems, including central office switchingequipment, switching centers, remote switching units, concentrators, wired and wirelessPABX/PB)Vtelephone/ intercommunication system, video conferencing systems,

other wired or wireless electronic equipment for voice, data, text and facsimilecommunications, but excluding installations with not more than three (3) line and/or

ARTICLE XXFINAL PROVISIONS
General
21, Sections 2101 up to Section 2105 of the National Building Code - NBC is adaptedand effect as if fully embodiedobjectively to cope-up the latest
in this ordinance and shall have mandatory force. Amplifications in any of its original provisions,
ts in science and technology shall apply.
SECTION 2. Existing Building and Smtctures
2.1 All existing buildings or structures constructed with valid permits, shall be respected subject tosuch limitations established in this Ordinance.
2.2 However, alteration addition, conversions and/ or repairs to be made in such buildings orskucture shall be subject to the provision of this Ordinance.
2.3 All existing Commercial and Business Structures covered by this ordinance without permit arehereby given a period of five (5) years from the approval of this ordinance to comply herewith.
2.4 Non-compliance with this ordinance within the period herein provided shall cause the non-issuance, suspension or non-renewal, as the case may be, of the offending establishment.
SECTION 3. Separability Clause
3.1 In case any clause, sentence, seotion or provision ofthese ordinance or any portion hereofis heldor declared unconstitutional or invalid by a competent cour! the other sections and provisionshereof which are not alfected thereby shall continue to be in full force and effect.
SECTION4. RepealingClause
4.1 All ordinances, rules or regulations which are in conflict with the provision of this Ordinance arehereby repealed amended and/ or modified and that any rights that are vested upon any personshall remain effective and shall not be impaired.
SECTION 5. Effectively Clause
5.1 This Ordinance shall take effect after its publication once in a newspaper of general circulation inthe locality, and posting for three (3) consecutive weeks at all Barangay Halls in the City, at theCity Engineer's Office, at the City Assessor's Office, and at the City Council Bulletin Board.
The City Council Secretary is hereby tasked to cause such publication and posting as hereinrequired, and to cause the distibution of the ordinance as published to all effectedestablishments.
