The Presidential elections are over and changes are coming for OSHA programs, regulatory activity and enforcement. In addition, the next Congress will consider everything from budget issues to OSHA and MSHA reform and regulatory policy. This session will review the ongoing initiatives and offer a forecast for the things to come in 2017.

Adele L. Abrams is an attorney and Certified Mine Safety Professional who is president of the Law Office of Adele L. Abrams P.C., with offices in Beltsville, MD, Denver, CO, and Charleston, WV. The firm represents employers in OSHA and MSHA litigation nationwide. Adele also provides consultation, safety audits and training services to regulated companies. She is an adjunct faculty member at the Catholic University of America.

Adele is a member of the Maryland, DC and PA Bars; the U.S. District Courts of Maryland, DC, and TN; the U.S. Court of Appeals, DC Circuit 3rd Circuit, and 4th Circuit; and the United Sates Supreme Court. She is a graduate of the George Washington University’s National Law Center, and earned her B.S. in Journalism from the University of Maryland, College Park.

Increased criminal prosecutions by OSHA and MSHA, tort liability for negligent training and supervision, and appropriate responses to subpoenas … these are just a few of the legal liability challenges that safety and health professionals and supervisors face in their daily activities. Often liability flows to them, both civil and criminal, because their “fingerprints” are on key documents and their knowledge is also imputed to their employer, holding them to a higher standard of compliance under the General Duty Clause. Professional certifications can also be threatened in certain circumstances. This session will address the legal issues and offer proactive strategies to limit liability exposure.

Driver Engagement in Safe Driving Behavior IntermediateSteve Dixon, Fleet Safety Specialist – Border States

This session will cover unsafe driver behaviors, causes of unsafe behaviors and correcting those behaviors. It will focus on barriers employers face with driver shortages, difficulties in supervising and coaching techniques to assist drivers in improving driver skills.

Steve has been employed with Border States Electric for ten years focusing on employee and driver safety. He is qualified to teach OSHA 10 and 30-hour general industry training. In addition, he is qualified through the National Safety Council to instruct Defensive Driving and Professional Truck Driver Defensive Driving courses. Steve likes to hike, fish and camp in his spare time.

National Electrical Code Update: 2017 BasicBen Doyle, Instructor – M State

This presentation will cover major changes to the 2017 National Electrical Code

Ben Doyle is an M State instructor, teaching classes for the Industrial Maintenance program in Wadena, as well as instructing industrial maintenance and safety classes for M State Custom Training Services.

Ben has an AAS in Agriculture Resources Technology, an AAT in Electrical Construction, and an AA in Liberal Arts and is an authorized OSHA Outreach trainer for General Industries and Construction.

Ben has been a Journeyman Electrician since 2004 in WA and now in MN working in a variety of industries including commercial, residential, industrial, and agriculture. Ben started his career in teaching in 1996 as an instructor for Intel University while working at Intel in DuPont, WA. Since that time he has taught many different ages and subjects from vehicle training in the WA Air National Guard to multiple subjects for youth in 4H as the Wadena County Wildlife Instructor.

This session will include how to establish and maintain a good quality safety committee in your organization and how they can efficiently operate in your particular work environment.

Jay Skarphol is a former Senior Environmental Health and Safety Specialist with a wide range of experience in general industry, construction, and oil and gas safety. In his former positions responsibilities included: safety management system reviews including; incident investigations; safety training; and on-site inspections, audits, and evaluations. Jay also has a background in HAZWOPER, Level 5 Hazardous Materials Incident Command and was a TapRooT Advanced Investigations Team Leader. In retirement, Jay is continuing his passion for safety as a contracted safety trainer for the North Dakota Safety Council.

Additionally, she is responsible for policy, procedure and compliance for the university records management program.

This session will cover the four main causes of construction fatalities in the United States each year. These are: falls, electrocution, struck by and caught in between. This class will highlight the causes of these tragedies and offer practical solutions so we send our workers home every day in the safest and best possible condition.

Jack Kolberg recently retired from Northern Improvement Company after 27 years of service. Jack was a Vice President and Safety Manager with NIC and developed programs and a culture that helped guide NIC to three National AGC of America awards naming NIC as the “Safest” Highway Contractor in the Nation. NIC was also named one of the Safest Companies in America by EHS (Environmental Health & Safety) Today magazine. Jack was also named “Outstanding Safety Professional of the Year” by the NDSC. Jack now works with the AGC of ND in partnership with Workforce Safety & Insurance providing valuable training to the construction industry throughout ND. Jack’s goal is to see each and every construction worker (industrial athletes) go home to their loved ones at the end of each day in better shape than they arrived.

This interactive session will focus on how healthcare providers can and should provide the most beneficial assistance for HR, Safety Directors and employers with consistent communication while dealing with injury prevention, work injuries and RTW programs. We will share various statistics and perform a few onsite exercises while emphasizing the importance of utilizing rehabilitation programs to assist with injury prevention and proper recovery from injuries. We will also discuss common injuries along with many incorrect habits which frequently occur. Finally, we will cover many important topics which are necessary and beneficial for decision makers to discuss with the healthcare providers who assist them.

Dr. Brad Feldner graduated from Palmer College of Chiropractic in 1993 and he has been teaching, speaking and consulting on rehabilitation and occupational health around the nation since 1997 in 39 different states. He has spoken to thousands of clinicians, third party payers, law firms, HR and Safety Directors on the importance of providing consistent communication,

injury prevention and active care programs with a multidisciplinary approach. In June of 2009, he opened PURE Chiropractic and Rehab in Fargo, ND, and he has lived in Fargo since 1995 with his wife Laura and their twins.

Cultural Diversity in the Workplace Basic - IntermediateTammy Schatz, Program Manager – Moorhead Adult Basic Education

A snapshot of the Islamic faith, various cultures in the region, and some of the conundrums that can arise with a diverse workforce. This session will provide tips and resources to the employer as cultural barriers are addressed.

Tammy Schatz has worked with Moorhead Adult Basic Education for 20 years serving New Americans as they acquire the English language and transition to employment or post-secondary education. She works closely with employers and community agencies to address the challenges they and the students face through this process.

Proactive vs. Reactive Reporting – What You Can Do Before It Becomes an Investigation All LevelsBecky Herrold, PHR, SHRM-CP, Safety Manager – McNeilus Steel

The term “reactive” can be defined as “being responsive to something.” A person who is reactive usually responds to an incident, but does not act on himself. The term “proactive” refers to “being prepared even before an incident takes place.” A proactive person takes the initiative and is prepared. The presentation will share examples of “proactive” vs. “reactive” safety reporting along with what you can do with the reports to ensure follow-through of corrective and/or preventive action along with reducing overall safety related costs.

Becky has worked in the Human Resources/Safety field for over 16 years. She started her tenure ship at Swanson Health Products working in multiple roles including payroll, benefits, HR administration, and Safety for nearly 10 years and during that time obtained her PHR certification. She then moved on to TEAM Industries in Audubon, MN and took on the role of Safety Coordinator. During that time, she obtained her OSHA 30-hour certification along with providing and promoting behavioral safety techniques to employees. She is currently the Safety Manager at McNeilus Steel, Inc in Fargo. With the promotion of proactive safety reporting and implementation of a few safety management systems, Becky has saved McNeilus Steel over $100,000 in potential claims and reserves along with reducing the incidence rate by over ½ in past 2 years.

Joshua Lynn from the ND Office of DOL-OSHA and Vikki Sanders representing MN OSHA perspective on OSHA issues as part of a Panel Discussion.

Joshua Lynn is a Compliance Officer with the Occupational Safety & Health Administration. He is originally from Oklahoma, but has been living and working in North Dakota for the past three years. Prior to relocating to North Dakota, Joshua worked as a Safety Engineer with Lockheed Martin in Fort Worth, Texas. He holds Bachelor of Science and Master of Science degrees in Occupational Safety from Southeastern Oklahoma State University in Durant, Oklahoma.

Vikki Sanders is a Safety Consultant Principal for the MN OSHA Consultation Unit. She has trained, investigated and consulted on the issues of safety and workplace violence for 27 years. She has worked 7 years as an OSHA investigator and 20 years as a consultant specializing in general industry safety. Vikki has taught over 650 businesses and 45,000 employees on safety topics to a variety of industrial settings including but not limited to long term care, hospitals, healthcare, education, manufacturing and business.

During this session, attendees will learn what is considered a recordable injury. The session will review resources you can use to assist you in determining whether an injury is recordable or not. In addition, Tim will illustrate the proper way of counting lost and restricted days. Finally, Tim will share how this information can be used in addition to being in compliance with OSHA.

Tim Peterson is the VP of Operations of OECS, Inc. Tim manages Field operations in Minnesota, South and North Dakota. Mr. Peterson has extensive experience in regulatory issues in construction and general industry. He has a degree in Organizational Management and Communication and is completing a Master’s Degree in Industrial Safety and Hygiene with a BS degree in Manufacturing Management. Tim is a certified instructor for OSHA 500 both the 10 and 30 hours’ outreach training programs as well as a Mine Safety and Health Instructor (MSHA) and has his CHST (Construction Health and Safety Technician) certification through the American Society of Safety Engineers (ASSE). Mr. Peterson is a seasoned First Aid/CPR instructor having trained and certified hundreds of students. Tim is a key Senior strategic management member of OECS, Inc.

Fleet Maintenance Compliance BasicDuane Amundson, MN DOT

Explain when and what rules apply to your company and also what the requirements are for drivers and equipment so companies can be in compliance when managing both. We will cover both the company’s responsibilities and what is expected of the drivers.

Duane has worked in the trucking industry for almost 20 years prior to starting with the State Patrol. He has been with the MN State Patrol for over 20 years a training officer for 7 of those years and during that time he has also been a contract trainer for FMCSA thru the NTC for 14 years. Duane has 11 years of experience doing audits for new companies and explaining the requirements to them.

OSHA Defensible Excavation & Trenching Practices All LevelsMatt Weis, Client Safety Coordinator – Dawson Insurance

While the excavation and trenching is a main subject of this session, the principals and practices discussed can be extended to many other hazard areas. In addition to covering the key safety

requirements involved in excavation and trenching, Matt will share some of the common challenges he finds on jobsites where production goals “seem to be” at odds with compliance requirements. While it will be no surprise that following the regulations is the key to avoiding OSHA citations, it is also no surprise that knowledge of the regulations does not ensure compliance with the regulations. Matt will share tools that assist in the effort of keeping clear standards top of mind until they become standard practice.

Matt has been a Client Safety Coordinator with Dawson Insurance since 2010. In his role with Dawson, he’s a resource to commercial lines customers in all matters risk management and regulatory compliance. Prior to joining Dawson, he served area business leaders as a training and development consultant specializing in areas of team dynamics and change management. Matt currently sits on the board of Northern Region Association of Safety Professionals, and is an active member on the Associated General Contractors of North Dakota safety committee.

Fit for Duty: Injury Prevention and Management details the program utilized at Sanford Health Occupational Medicine for both employment and work injury management. Post-offer testing, ergonomic assessment, and education/training assist in selecting the right employee for the job. Timely, competent, and coordinated care for workplace injuries returns the worker to their specific job tasks as soon and as safely as possible. This system results in a streamlined hiring process, improved worker morale, reduced workplace injuries, decreased lost time/restricted days, and diminished legal action

Chantel Frappier is a physical therapist who specializes in injury prevention/management in the workforce at Sanford Health Occupational Medicine in Fargo, North Dakota. She holds a Doctor of Physical Therapy degree from the University of North Dakota and is a certified provider for DSI Work Solutions, Inc., a system that includes job function matching, testing, and functional capacity assessment.

Mike Lockheart, MD, MPH, FACOEM, is Medical Director of Sanford Health Occupational Medicine Clinic Fargo. As medical director he oversees the medical care, policies, and procedures of the clinic; treats work related injuries and illnesses; and evaluates employees’ capacity for work.

Dr. Lockheart completed his medical and public health degrees at the University of Minnesota Twin Cities, internship in family medicine at North Memorial Medical Center Minneapolis, and

Have you ever wanted the opportunity to practice doing an Accident Investigation, but without an actual accident occurring? Well here’s your chance. Randy and Ben will coordinate walking participants through a Mock Accident Investigation. An employee has just fallen from some scaffolding. What do you do next? How do you coordinate all of the efforts? Who do you involve? This workshop will give participants that opportunity to go through a real life investigation (but without any actual injuries) along with learning some key tips to consider during an actual incident investigation.

Randy Niles began his 2-year term as NRASP President on January 1, 2015. He had been a director on the NRASP Board of Directors for four years prior to becoming President. Randy has been a safety consultant for OECS of the Dakotas, Inc. for four years. His office is located in West Fargo. He has served as safety director for companies in Arizona and North Dakota prior to joining OECS of the Dakotas, Inc. He attended Bismarck State College and Arizona State University where he studied Psychology and Marketing. He is also a member of the Continuum Toastmasters in Fargo. Randy lives in West Fargo with his wife, Kelly. They have three children, Mary Jo, Brandon and Grace. He also has a Great Dane named Oakley. In his spare time, Randy enjoys his role as husband, dad and President of the Pittsburgh Steelers Fan Club! To offset the pure excitement of living the safety world during the week, he relaxes by serving as a wedding DJ for Harmon Entertainment on the weekends!

Ben Doyle is an M State instructor, teaching classes for the Industrial Maintenance program in Wadena, as well as instructing industrial maintenance and safety classes for M State Custom Training Services. Ben has an AAS in Agriculture Resources Technology, an AAT in Electrical Construction, and an AA in Liberal Arts and is an authorized OSHA Outreach trainer for General Industries and Construction. Ben has been a Journeyman Electrician since 2004 in WA and now in MN working in a variety of industries including commercial, residential, industrial, and agriculture. Ben started his career in teaching in 1996 as an instructor for Intel University while working at Intel in DuPont, WA. Since that time he has taught many different ages and subjects from vehicle training in the WA Air National Guard to multiple subjects for youth in 4H as the Wadena County Wildlife Instructor.

In this session, Vicki will cover the information that you the employer need to know when it comes to drug and alcohol abuse in the workplace. She will be sharing the signs and symptoms of the more common drugs found in the workplace as well as showing some of the interesting paraphernalia that people may have with them as a result of using drugs. This information along with her real world stories will prove to be both informative and interesting.

Vicki has more than 25 years of experience working employers and their drug and alcohol testing programs for employees. She has presented a variety of educational programs including Reasonable Suspicion Testing- Training for Supervisors, Designated Employer Representatives – What are Your Responsibilities, and How to Recognize Drug Use and Alcohol Misuse in the Workplace. These subjects are areas of concern for employers who have found her presentations thought-provoking and helpful. Vicki is a DATIA Certified drug screen collector, a Designated Employer Representative and Certified breath alcohol technician. She is employed as the Drug Screen Coordinator at Essentia Health Occupational Medicine in West Fargo. Her presentations are appropriate for new supervisors and designated employer representatives (DER) as well a refresher for those have attended sessions in the past.

Research shows that employees who are excelling in all six dimensions are not only happier, but also have lower medical costs – by more than 40 percent – compared with those who are doing well in two areas or less. In today’s increased war for talent and need to manage health care spending, organizations that create leadership and cultural alignment surrounding the six dimensions will hold a competitive advantage.

Katie Nermoe is the Corporate Wellness Director at Sanford Health Plan and is also an employee engagement author. Over her 20-year career, Nermoe has held leadership positions in health care, marketing and local government administration. Nermoe believes organizational health is the number-one driver of organizational wealth. She contends a businesses’

Are Your Employees Prepared for an Active Shooter Scenario? All LevelsJane Pettinger, SPHR, Asst. Professor, Experiential Learning Coordinator – MSUM

Active Shooters are in the news far too often. While all of us imagine it would never happen in our workplace, clearly it is happening in far too many places. In each shooting we read about, both customers and employees are affected. And quite frankly, too many people are dying. What would YOUR employees do in an active shooter situation? Are they prepared to save lives by their actions?

In this session we will cover statistics on the types and numbers of active shooter scenarios. Some are former or current employees; many are seemingly random strangers. But more importantly, we will cover what your organization can and should do to prepare your workers for such a scenario. Our goal in this preparatory aspect will literally be to save lives. We will also discuss follow-up actions that your organization can do to help alleviate the stress and trauma of having been involved in a situation of workplace violence.

Professor Pettinger is certified as a Senior Professional in Human Resources, the highest level of certification through the Human Resources Certification Institute. She is currently working as a Human Resources consultant and educator.

Minnesota State University Moorhead’s Paseka School of Business has capitalized on her Human Resource Management expertise in the classroom for over 25 years. Professor Pettinger is responsible for the successful launch of the Executive Mentorship program in the Paseka School of Business. She also coordinates internships and other Experiential Learning student opportunities. She was a finalist in Spring of 2016 for the University-wide Excellence in Teaching Award.

Some time back, she served in the position of Human Resources Director for the Austin Medical Center, a Mayo Health System affiliate. In this position, she provided leadership for numerous departmental and organizational improvements focusing on legal compliance and employee satisfaction. Prior to that, she served North Dakota State University as a management instructor and the Practicum Coordinator for the College of Business Administration. She received her MBA from NDSU and joined the teaching faculty that same year. While at NDSU, she received numerous awards for excellence in teaching and student interaction.

Professor Pettinger is a member of the Fargo-Moorhead Human Resource Association and was a charter member of the Agassiz Valley Human Resources Association. She has been reappointed for a fourth term as a Civil Service Commissioner for the City of Fargo and serves as the current Chair. She also serves on the Board of Directors for the Fargo-Moorhead Area Youth Symphonies, recently completing her year as President. She has had the honor to serve on selection committees for local municipalities’ national search efforts. She additionally serves her local community and the world community as a member of Lions Clubs International. The Fargo Lions Club has repeatedly recognized Professor Pettinger for outstanding leadership and service.
