Our annual Christmas Function will be held on the 3rd of December 2016 from 14h00. This year there will be a lot of surprises. Please read further down in the Newsletter for more information.

Our Trick and Treat function was a big success and we would like to thank all of you that participated in this event. See pictures further down in the Newsletter.

The Community Schemes Ombud Service (CSOS) was approved by the State President and Gazetted on the 7th October 2016. This is now law and will have a Financial bearing on all residents and HOAs as an additional levy in future will be billed. Please read further down in the Newsletter about the CSOS.

The year has sped to an end and our Matric learners are hard at work finishing their Matric qualifications. Good luck to all our other learners with the exams!

A lot has been done this year to maintain the Estate in such a way that the values of properties remain constant. The HOA can safely say that all the Capital Projects, approved at the AGM, have been completed for 2016/17.

In response to a call by the National Department of Water and Sanitation, the City is implementing measures to curb water consumption by 15%.Residents and businesses are also urged to use water sparingly and refrain from any irrigation activities from 6am – 6pm. No filling of swimming pools from the municipal water supply, and no using of hosepipes and sprinklers.

In the Kempton Express dated 6th October 2016 it was mentioned that every household will be limited to 25kl water per month. Once that is exceeded a penalty of 10% will be paid.

Despite the lovely rain that has fallen, the Water restrictions are still in place.

COMMUNITY SCHEMES OMBUD SERVICES (CSOS)

The Sectional Title Schemes Management Act (STSMA) and Community Schemes Ombuds Service Act (CSOSA) have been signed by President Jacob Zuma and was Gazetted on the 7th October 2016.The two new acts introduce very significant changes to scheme management law, as well as bringing the CSOS fully into operation to resolve scheme administration disputes.The current draft regulations include:• Establishing a reserve fund to cover costs of future maintenance and repairs to

common property.• The chief ombud, local municipality, and local registrar of deeds need to have

the domicile registered so that in events of cases being brought against bodies corporate by owners or vice versa, there is one address by which to serve notices.

MAINTENANCE - Main Boulevard

Our main boulevard lawn has changed from this - To this in less than a month! Lots of Fertilizer and TLC...

The benches on the Boulevard have been sanded and newly painted and look as good as new.

Our Estate’s name is beautifully displayed on the wall behind the Bottomgate.

The sandpits at the circle in Weltevreden Crescent have been topped up with new sandpit sand. Sandpits at Adelpracht have also been topped up.

COMMUNICATIONCOMMUNICATION DETAILResidents are requested to please update their current details at the Estate’s office to allow for proper communication. This includes e-mail addresses and cell phone numbers. We frequently experience that people phone in complaining that they do not receive Estate correspondence, just to find out that their e-mail addresses or cell phone numbers have changed without informing the office. If someone is not in your employment anymore,pleasealsoinformtheEstateOffice.

THE PORTALThe portal is an essential tool for you and for the Estate Management in that it will keep contact details up to date quite apart from being a communication tool. The tool is both private and public in that you will be able to continually update your contact details. Moreover, we will be able to communicate generally using the portal rather than e-mail and this letter can be sent out to all the right people not just a select few! Before you throw your arms in the air with the thought of yet more user names and passwords, it is simple to use and a very worthwhile tool..

TENANTS/NEW RESIDENTSYou’re not letting us know who is moving into your house! It’s potentially

dangerous from a security viewpoint and embarrassing when we have no clue

that a new resident is moving in. Very simply, we need a visit to the office and

a copy of the lease and for those of you who haven’t provided either/or, we’d

love to see you.

If you are moving within the Estate, please also let the office know about that

as there are several details that need to be changed when people are moving

around within the Estate.

BOULEVARDWe do notice that children are lingering around the Boulevard long past 21:00, making noise and involved in mischief. We would just like to bring the following Rule under your attention: No children under the age of eighteen (18) are allowed on the Boulevard unaccompanied by an Adult RESIDENT of the Estate after 21H00, furthermore, the said adult resident shall be fully accountable for all minors in his / her care, with any transgressions carried out by the minors being the full responsibility of the accompanying adult.

CONDUCT ON BOULEVARD

“Behaviour in the common area (with the focus on the boulevard) of the Estate that contribute to a hostile, humiliating or intimidating environment, including the use of abusive language should not be practiced or tolerated.

Any resident (also representing his/her family/friends) who believes he/she was subjected to such unacceptable behaviour, should first attempt to resolve the issue with the affected party. The affected resident may also request assistance from the GEBHOA by reporting all relevant details of the incident as soon as possible to the Reaction Officer (RO) and/or/Estate Manager. Also if any unacceptable behaviour was witnessed, it can be reported by Keystone (as seen on the cameras) or the RO.

The Estate Manager will provide support by reviewing all the reports and other evidence with urgency. The Estate Manager will not get involved in any personal dispute between two parties. Feedback to be given to the affected member.”

A Newsflash has been sent out in regards to incidents of bullying on the Boulevard. The following approach has been adopted by the Board of Directors in this regard.

GOOD NEIGHBOURLINESS

If a neighbour has a birthday party or is celebrating the festive season, then their behavior would be considered reasonable. However, if the behavior of a neighbour has become disruptive or abnormal to the extent that it affects your ability to enjoy your property, then the law supports your concern.

My neighbour’s noise is a nuisanceSo it’s the third night this week you can’t sleep be-cause your new neighbour seems to enjoy playing loud rock music with his band late at night. Normally you wouldn’t mind. However, being kept up till 2am every morning is affecting your productivity at work. You talk with your neighbour, but he doesn’t seem to see a problem. What now?

What does the law say about loudneighbours?There are Noise Control Regulations under the Environment Conservation Act (Act 73 1989). These regulations clearly state that no person (including your neighbour) is allowed to:Operate or play a radio, television, drum, musical instrument, sound amplifier, loud speaker system or similar device that produces, reproduces or amplifies sound, or allow it to be operated or played so as to cause a noise nuisance.

The regulations also give local authorities (i.e. your municipality) the ability to enter premises without prior notice, on condition it’s at a reasonable time of the day. This would be to inspect the premises and take any action if necessary.17

However, before you run off to sue your neighbour it must first be considered whether or not the noise they are producing is reasonable or unreasonable. If you live in a congested city, for instance, noise pollution is common, but a residential area is expected to be quieter.

Whatmakesyourneighbouranuisance?There are several factors that determine if a neighbour is a “nuisance”. Some of them include:1. Excessive loud noise.2. Bad odors.3. Constant movement of inhabitants.4. Smoke, gas or fumes.

However, as mentioned earlier, it’s important to recognize the circumstance of the noise or disruption. Living in a residential area with rowdy neighbours hosting consistently late parties could be considered a nuisance. When judging the actions of your neighbour you should consider the following:1. Whether it is temporary or over a long period.2. Where the property is situated.

If it’s the festive season, then a lot of festive music and many guests is considered normal. In circumstances such as that it may just be better for you to let it go and wait for the festive season to pass. Being overly sensitive and irritable is not a reason to sue someone.

What can you do?The first step of any neighbourly dispute should be to approach your neighbour and ask them to stop what’s causing the nuisance, such as telling them to turn down the music. Matters that can’t be resolved peacefully can be brought to a court and an interdict can be obtained against the neighbour. Legal advice is always beneficial when pursuing legal action so as to determine whether your complaint is valid or whether you’re just too sensitive.An interdict is a court order that will command the neighbour to stop doing whatever is the cause of the nuisance. The nuisance causing neighbour can also be sued for any damages caused from the nuisance, such as broken property or health problems. Reference:Anderson, AM. Dodd, A. 2.4 Use of the Boulevard by Residents2.4.2 Shall the transgressors NOT identify themselves as residents, or as visitors of residents, they shall be requested to leave the Estate immediately and may be charged with trespassing through the involvement of the South African Police Service (SAPS).

2.4.6 The playing of games or sports with hard cricket or golf balls, which may cause injury or damage to adjoining properties, shall not be permitted on the Boulevard. Such, balls shall be confiscated.

ThisisacauseforconcernasthisruleisnotadheredtobychildrenintheEstate.Incidentswherehardballsarebeingused,arestillexisting.

A system has been implemented where the guards are patrolling the Boulevard in the evenings. We do request the assistance of parents in talking to their children about their behaviour on the Boulevard.

DOMESTICS &GARDENERSPlease note – when you employ a domestic or a gardener, and you are unable to accompany the employee for registration, then you must please supply the worker with a confirmation of employment letter, or make a call to the Estate Office, stating the days he/she will be working for you and means of payment for the access card to be issued. Kindly ensure that the worker has the required I.D document / valid Asylum document or valid workpermitintheirpassport.

If a domestic worker or a gardener has an access card already, you can extend it by phoning the office instead of coming in personally.

SECURITYThe Security Personnel are employees of the Estate and therefore have received clear job instructions and protocols with regard to the security of the Estate. Please do not obstruct, interfere or prevent any of the security staff whilst they are doing their duties. Verbal abuse of security staff is viewed asunacceptable behavior and regarded as serious.

We request residents to abide by this rule to the benefit of everyone who stays in the complex.

PETSThe Estate has no proper facilities to keep stray pets for an unlimited time, and it is NOT the duty of Security to chase pets, find owners etc. as the primary responsibility of Security is access control and the safe keeping of residents.

We would like to remind all residents that pets should have collars with tags on, in order to be able to call the owner immediately, once these animals are observed to be running loose.

We would further want to, once again, bring under your attention the following rules in regards to pets:

2.10.4 Pets shall be on a leash and accompanied by the owner when in the streets, on the Boulevard or any other public area at all times.

2.10.7 Every pet shall wear a collar with a

tag indicating the name, telephone number and address of its owner. Stray pets; without identification tags, shall be apprehended and handed to the S.P.C.A. at the cost of the owner should the owner’s identity be established.

2.10.8 The Glen Erasmia Board of Directors reserves the right to prohibit, restrict, or control the keeping of any animal, which they regard as dangerous, or a nuisance in accordance with the MoI Rules of the Glen Erasmia Boulevard Home Owners Association.

RECYCLING

AESTHETICSAnother annual survey has been done on the Aestheticsof the Estate. The emphasis this time was placed on drive ways and gardens.

Youwillbe informedviaa letter ifyourdriveway,gardenorwallsneedsabitofTenderLoving Care (TLC).

A special request to all residents is to pay attention to pavement appearances as weeds are creeping out of all corners.

Residents are reminded that we have acquired a bin for the recycling of glass and don’t forget the paper recycle bin!

The bins are placed at the Top Gate, opposite the Main Gate. We urge residents to only dispose of paper and glass at the recycling bins at Top Gate and NO OTHER WASTE.

We request your co-operation in this regard in order to keep our Top Gate area neat and aesthetically pleasing.

We encourage Residents that observe transgressions to report such to the Estate Office in writing, noting the date, time, particulars of vehicle etc. Should the CCTV system be in a position to determine the validity of the reported transgression, the requisite sanction will be applied.

All Residents are reminded that any visitor using the roads within the Estate are subject to the same rules and sanction as the Resident her/himself – should a visitor be observed transgressing, the Resident to whom the visitor is travelling will be sanctioned.

To reiterate, safety is the primary concern of the Board, and the same should apply to every Resident/road user within the Estate. Whilst the Estate Management is unable to ‘police’ the road network, we will endeavour through the means noted above to manage the situation.

Please note that there are some post boxes overflowing with mail. If you have a postboxintheEstatepleasecollectyourmailandemptyyourboxonaregularbasis-or,ifyoudonotrequireyourpostboxpleaseinformtheoffice.

We still have children tampering with post box locks. We request parents to liaise with your children in this regard. No playing is also allowed on top of the Post Boxes. If you observe that a light is not working or any other faulty matter in regards to maintenance, please call or e-mail the Estate Office.

HEALTH & SAFETYGlen Erasmia Boulevard has the Health and Safety of the Estate at heart and and therefore we are fully compliant to all matters in regards to the Occupational Health and Safety Act. A consultant is assigned to the Estate to guide the Estate through all the stages of the OSH Act and at the end of the term (12 months) the Estate will be fully compliant.
