This program provides a review of the current state of the fiduciary duty of all licensed architects to their clients based in both statutory language and substantive law. The coming of the fiduciary duty is both a great opportunity and the source of great anxiety for licensed design professionals, but a full understanding will help to set the stage for a properly calibrated response in both the underlying processes of architectural practice as well as provide an appropriate bases for risk management going forward. The fiduciary duty is not based either in contract or tort and thus poses special problems in legal procedures and risk management options. At the same time, those firms ready to embrace this coming fiduciary duty regime will obtain significant advantages in the marketplace for fees and trust from owners. AIA HSW - 1.0 CES Learning Unit The fiduciary duty has important implications for design firms and individual practices regarding the interactions among the core HSW obligations and the primary fiduciary duty to the client. This is especially the case in the six states that require a fiduciary duty as part of the enabling legislation for architec-tural licensure. Learning Objectives:

• The program will provide a basic understanding of the scope of the fiduciary duty in the context of design professionals.

• Become familiar with the statutory language used as the basis of the

fiduciary duty in six-states in the US.

• Become aware of the risk management options needed to deal with the fiduciary duty and some of the implications dealing with limitations of liability constraints, the important role of specifications, required firm pro-cess changes to fulfill fiduciary duties, and the proper basis for green design activity.

• Understand the ethical aspects of design professional practice based on

the fiduciary duty.

November 2019 Page 3 Madspec

In 2010 I surveyed a collection of trade magazines that all of us can receive free of charge. I cited these as an easy way to stay current with design and construction news and technical information on con-struction materials and products. Since then, several of those maga-zines stopped publication, a couple of others have returned, and there are now several websites with technical information you should know about. Stay-ing current with the latest developments in materials and construction technology is a never endingprocess. Finding the time for this in our busy professional lives is one concern but, even more difficult, isfinding easily accessible, authoritative sources of information. It’s also nice when the information is low cost or free. Certainly, The Construction Specifier has to be considered the prem-ier periodical for up-to-date information on a wide variety of con-struction materials, products, and building systems. In addition to The Construction Specifier, there are several other magazines that provide useful information on specific materials or building trades. The ones I’ve described below are free to architects and I encourage you to sign up to receive them. But, before I get to those I’d like to mention a few websites, each of which provides a wealth of authori-tative, current, and useful information. Both of the architecture-engineering firms Simpson Gumpertz Heger, www.sgh.com, and Wiss Janney Elstner, www.wje.com, have dozens of authoritative technical articles available on their websites. In the “Knowledge Sharing” tab on the SGH website, and on the WJE website under the “Knowledge” heading, you’ll find research papers and articles describing their projects. Topics range from materials science, to building enclosure and waterproofing issues, to historic restoration projects, to fire protection, and structural engineering design. The architecture and consulting firm, Building Sciences Corp. has a website, www.buildingscience.com, containing literally hundreds of articles and research papers focusing on building sciences and pro-jects where the causes of moisture intrusion had to be determined and then the resulting damage repaired. The website of the consulting firm, RDH Building Sciences, www.rdh.com, has papers on many building envelope and energy conservation issues. These can be found under the heading, “Technical Library” on their homepage. In addition to The Construction Specifier magazine, CSI also hosts, “CSI Connect”, where members can ask questions and participate in lively discussions on specifications and construction contract admin-istration issues. You can sign up in the Communities section of the CSI website, www.csiresources.org.

The Discussion Forum on the website www.4specs.com includes conversations on many specification writing issues and construction products. Architects and spec writers have been contributing to these discussions for over 15 years. The American Institute of Architects has 21 Knowledge Communi-ties each addressing a different aspect of architectural practice. These can be found on its website, www.aia.org, under the “Topics” tab on the homepage. These are available to both AIA members and non-members. For example, the construction contract administra-tion community has a list of white papers on a variety of CCA sub-jects. A couple of these were written by our LACSI member, Bill Schmalz, CSI, CCCA, FAIA. The Wood Products Council, Woodworks, website, www.woodworks.org, has a long list of PowerPoint presentations available on its website and these are not limited to wood construc-tion topics. There are several presentations on the science in exterior envelope design, and others on fire protection and building code is-sues related to Type V construction. These PowerPoints are located under the “Education” heading on the homepage in the “Presentation Slides Archive” section. The Whole Building Design Guide, www.wbdg.org, has an extensive list of resources created specifically for work on projects for agencies of the Federal Government. Turning back to FREE magazines, consider the following: Walls & Ceilings. www.wconline.com. Published monthly by bnp Media. Aimed at both designers and builders, it includes articles on plaster, gypsum wallboard, metal stud framing, and EIFS. Articles are frequently included on sound control and fire resistance issues. In recent issues there has been a fascinating series of articles on tradi-tional plaster and historical plastering methods written by Patrick Webb, an adjunct professor at the American College of the Building Arts in Charleston, SC. Door Security and Safety, (formerly Doors and Hardware). [email protected]. Published monthly by the Door and Hardware Institute. The magazine provides a blend of technical and product information on many aspects of openings protection: spe-cialty doors, wood and metal doors and frames, and door hardware. It’s written for hardware consultants and hardware suppliers as well as for architects and specifiers. Contemporary Stone & Tile Design. www.stoneworld.com. Pub-lished quarterly by BNP, this used to be the best designed trade mag-azine in our industry. Even though the layout and design of the mag-azine isn’t what it used to be, it still provides beautiful photographs to present stone and tile projects. An interview with a notable architect is often included to describe the approach used for the selection of stone or tile on the featured project. The inclusion of advertisements for many types of tile and stone and related products makes this magazine an excellent resource for architects, interior designers and specifiers. Building Design & Construction. www.bdcnetwork.com. BD&C relaunched publication in Sept. 2010 with a blend of AEC industry news, some technical information, featured building projects, and

their trademarked, “Industry Giants” list, an annual ranking of design and construction firms based on firm size and reve-nue. Stone World. www.stoneworld.com. Published monthly by BNP, it contains stone industry news for stone suppliers and fabricators. Excellent photos and some drawings are used to illustrate recent projects. Useful for architects, interior de-signers, and specifiers to understand the different types of stone and their applications. Modern Steel Construction. www.modernsteel.com. Pub-lished monthly by the American Institute of Steel Construc-tion, this is an excellent source of information on steel for both structural and architectural applications. Written pri-marily for structural engineers, each month several projects are presented highlighting innovative or unique uses of steel. High Performance Buildings. www.hpbmagazine.org. Pub-lished quarterly by ASHRAE, it focuses on the HVAC aspects of energy efficient building design. Energy concepts are pre-sented in laymen friendly terminology. Each issue uses re-cently completed projects to demonstrate the theme of the issue and includes detailed breakdowns of energy usage and comparison of before and after energy usage, in the case of renovations, and comparisons with various standards such as ASHRAE 90.1, California Title-24 Part 6, in the case of new projects. Lots of interesting HVAC equipment advertising is also included. HPAC Engineering. www.hpac.com. Published monthly by informa. Each issue includes technical articles, and great graphics on heating, piping, air conditioning, and fire protec-tion aimed at building services engineers. Much of the infor-mation is useful for architects and specifiers. Sadly, Architectural Lighting, www.archlighting.com is no longer available in print. In 2018 it shifted to digital-only pub-lication. This is too bad since it was really a great magazine for anyone who wanted to understand architectural lighting or who just enjoyed photos of beautiful lighting projects. Today, some of its previous content is included in ARCHI-TECT magazine. The website continues to be an excellent source of information on lighting fixtures, the lighting indus-try, and lighting projects. In addition to these FREE magazines, there are at least two other architectural magazines available for purchase: ARCHI-TECT magazine and Architectural Record. Both provide coverage of our profession focusing mainly on projects and project design. The few articles of a technical nature in both of these magazines are provided, mostly, in their advertori-als. This provides a huge opportunity for the trade maga-zines to fill the need for technical information. Ed Buch, FCSI, CCS, AIA, LEED AP Los Angeles, Oct. 9, 2019
