Section 10A (1) of the Local Government Act 1993 (the 'Act') provides as follows:

A council or a committee of the council of which all the members are councillors, may close to the public so much of its meeting as comprises:

(a)the discussion of any of the matters listed in subclause (2), or

(b) the receipt or discussion of any of the information so listed.

In accordance with the Act and the Local Government (General) Regulation 2005, in the opinion of the General Manager, the business contained in the Confidential Reports listed in this Agenda is of a kind as referred to in Section 10A (2) of the Act and should be dealt with in a part of the meeting closed to the public.

On balance, the public interest in protecting confidential information outweighs the public interest in ensuring accountability through open meetings.

RECOMMENDATION:

That the minutes of the Ordinary Meeting of Murray River Council held on 16 January 2018 be confirmed as a true and correct record.

BACKGROUND:

Murray River Council held its Ordinary Meeting of Council on 16 January 2018, commencing at 1:00pm in the Multi-Function Room, Mathoura Visitor & Business Centre, 23 Moama Street (Cobb Highway), Mathoura.

A copy of the draft minutes are attached for ratification by the Council at this meeting.

RECOMMENDATION:

RECOMMENDED that Council rescind the decision of the Council per General Manager’s Report, Clause 4, of 16 January 2018, Ordinary Meeting of Murray River Council, where the following motion was lost:

MOTION (Crs Weyrich/Gorey) that in accordance with Part 7 of Chapter 12 of the Local Government Act 1993 (Act), the Murray River Council (Council) resolves:

1. That the Council inform the Minister for Local Government (Minister) of the Council’s endorsement of the Minister recommending to the Governor the establishment of a Joint Organisation (JO) in accordance with this resolution;

2. To approve the inclusion of the Council’s area in the JO’s area;3. That the JO be established to cover the Council’s area and any one or more of the following

council areas: Albury City, Federation, Berrigan Shire, Edward River, Balranald Shire, Wentworth Shire, Narrandera Shire, Leeton Shire, Griffith City, Murrumbidgee, Carathool Shire and Hay Shire; and

4. That on the expiry of a period of 28 days from the making of this resolution, the General Manager provide the Minister:

(a) with a copy of this resolution, including the date on which Council made this resolution, and

(b) inform the Minister that this resolution has not been rescinded,

for the purpose of the Minister issuing a certificate under section 400P of the Act.

RECOMMENDATION:

RECOMMENDED that Council rescind motion number 130314 as adopted at the Ordinary Meeting of former Wakool Shire Council now Murray River Council of of 19 March 2014 per Replacement of Murray River Bridge at Murray Downs/Swan Hill), as follows:

RESOLVED (Crs Jackson/Lockhart):

i. That the Officer’s report be received and noted.

ii. That Council confirms its position in relation to the approved option 9a as its preferred solution for the Murray River Bridge Crossing at Swan Hill Murray Downs.

FURTHER RECOMMENDED that Murray River Council writes to VicRoads and requests that they investigate the “John Forrest” bridge proposal as a potential option for the replacement of the Murray River Bridge Crossing at Swan Hill/Murray Downs.

BACKGROUND:

Councillors NH Gorey, AM Mathers and A Crowe move to rescind motion number 130314 of 19 MARCH 2014 (Replacement of Murray River Bridge at Murray Downs/Swan Hill), ORDINARY MEETING of former WAKOOL SHIRE COUNCIL now MURRAY RIVER COUNCIL, which reads:

RESOLVED (Crs Jackson/Lockhart):

i. That the Officer’s report be received and noted.

ii. That Council confirms its position in relation to the approved option 9a as its preferred solution for the Murray River Bridge Crossing at Swan Hill Murray Downs.

CLAUSE 1. Murray River Council Draft Councillor Expenses and Facilities Policy

RECOMMENDATIONaaaa

1. That Council adopt the Draft Murray River Council Councillor Expenses and Facilities Policy (POL103) and that same be placed on public exhibition for a period of 28 days to allow for public comments/submissions.

2. That all comments/submissions received to the Draft Murray River Council Councillor Expenses and Facilities Policy (POL103) be considered, and subsequently adopted, at the next scheduled meeting of the Council following the close of the public exhibition period.

aaaaBACKGROUND

Under Section 252 of the Local Government Act 1993 (the ‘Act’), within the first 12 months of each term of a council, the council must adopt a policy concerning the payment of expenses incurred or to be incurred by, and the provision of facilities to, the mayor, the deputy mayor (if there is one) and the other councillors in relation to discharging the functions of civic office.

As reported to the Ordinary Meeting of the Council of 26 September 2017, the Murray River Council Councillor Expenses and Facilities Policy (the ‘Policy’) (POL103) was adopted at the Ordinary Meeting of Council held on Tuesday 8 August 2017.

The Policy was prepared to be consistent with the Act and Local Government (General) Regulation 2005 (the ‘Regulation’) and the Office of Local Government’s Guidelines for the payment of expenses and provision of facilities to mayors and councillors in NSW.  The Policy sets out the maximum amounts Council will pay for specific expenses and facilities. Expenses not explicitly addressed in this Policy will not be paid or reimbursed.

Council will recall that at the Ordinary Meeting of Council of 26 September 2017, it resolved as follows:

RESOLVED (Crs Weyrich/Mathers):

1. That the Council note the current Murray River Council Councillor Expenses and Facilities Policy, but reserve debate on the Policy until a later date.

2. That Councillors identify any areas in the Murray River Council Councillor Expenses and Facilities Policy for amendment, if required, to be considered as a draft Policy prior to formal adoption by the Council.

Furthermore, after receiving Councillor input to the Policy, the Draft Policy was again considered by the Council at its Ordinary Meeting of 28 November 2017, whereby the Council resolved as follows:

RESOLVED (Crs Weyrich/Campbell) that the Council defer adoption of the Draft Murray River Council Councillor Expenses and Facilities Policy pending further Councillor input on the Policy.

DISCUSSION

Council is required to adopt a Councillor Expenses and Facilities Policy. The policy enables the reasonable and appropriate reimbursement of expenses and provision of facilities to councillors to help them undertake their civic duties. It ensures accountability and transparency, and seeks to align councillor expenses and facilities with community expectations. Councillors must not obtain private or political benefit from any expense or facility provided under the policy.

After the resolution of the Council at its Ordinary Meeting of 28 November 2017, whereby the adoption

of the Draft Murray River Council Councillor Expenses and Facilities Policy was deferred pending further input by Councillors on the Policy, such input was received from Councillors and incorporated, where possible, into the proposed Draft Policy.

A copy of the proposed Draft Policy, with alterations shown in red, is attached.

RECOMMENDATION

That Council supports the Echuca Moama Apex Club in holding the 2018 Apex Gift on 23 March 2018 at the Moama Recreation Reserve, with a financial contribution of $1,000 and also waives the booking fee for use of the Moama Recreation Reserve, being $250 (including GST) as per Council's 2017/2018 Fees and Charges, based on the attached request.

BACKGROUND

The Echuca Moama Apex Club is planning a ‘Stawell Gift’ style event for the local football and netball clubs, and the triathlon club, to be held in Moama on 23 March 2018. Prizes will be provided to the winning clubs and competitors.The event aims to generate exposure for the Apex Club, while promoting inclusion and equality, sportsmanship and health and fitness. It is expected this will become an annual event.

That Council sponsors the 2018 Swan Hill Country Music 'Walk Up' event to be held 11-14 October at the Tooleybuc Sporting Club, with a financial contribution of $500 based on the attached request.

BACKGROUND

The 2017 Swan Hill Country Music 'Walk Up' event was held at the Nyah Football Netball Club. While the event was successful, due to poor acoustics, it will be moved to the Tooleybuc Sporting Club in 2018.

The event is expected to attract around 200 people and will include a bus tour to Andrew Peace winery in Piangil.

That Council supports the 2018 Flavours of Echuca Moama festival to be held 19-20 May in Moama, with a financial contribution sponsorship of $2,000 based on the attached letter of request.

BACKGROUND

Flavours of Echuca Moama is a food and wine festival celebrating and showcasing the region’s small producers, local businesses, paddle steamers and local cuisine.

Now in its fourth year, the festival has built a solid reputation and is attended by locals and visitors who enjoy tasting and learning about the very best locally produced food and wine as well as all of those special extras that make Echuca Moama the reputable destination it is today.

The festival will be held 19-20 May 2018 and offers food and wine experiences at Junction Moama, cruising the Murray River onboard paddle steamers and at Morrison’s Winery and Restaurant.

The event is expected to attract over 800 people in 2018. The event is widely promoted and event sponsors receive extensive recognition for their support.

The QBR statement must show, by reference to the estimated income and expenditure that is set out in the operational plan adopted by council for the relevant year, a revised estimate of income and expenditure for that year. 

Legislative requirements, together with the implementation of a formal reporting mechanism, will ensure that councils have a robust and transparent budget reporting framework.

DISCUSSION

Attached is a summary of the fund movements through the year as well as an analysis against the key performance indicators of the budget result, operating result and the operating result before capital. These indicators in an ideal financial scenario would be positive.

This summary includes a statement by the RAO on whether the financial position is satisfactory as compared to the original budget.

That Council continue to require the repayment of the interest free loan from the Local Health Medical Trust, in accordance with the existing repayment schedule.

BACKGROUND

Council received a letter dated 24 January 2018 from the Local Health Medical Trust (LHMT), a not-for-profit entity, who is the Trustee for the Barham and District Medical Centre, requesting an extension of the repayment program for the interest-free loan from Council. Refer to letter attached (confidential). The loan currently has a final payout in 2022 and is being requested to be paid out in 2027. 

Based on the current loan agreement with Council, the principal outstanding is $176,000.

Council received a request from LHMT, which was considered at the Ordinary Meeting of Council of 28 November 2017. The request was for an additional interest free loan for the dental surgery in Barham. The dental surgery received funding under Council's Stronger Communities Fund, but Council declined the request for the additional interest free loan.

DISCUSSION

Section 356 of the Local Government Act 1993 (the 'Act') provides information on financial assistance that can be provided by council.

356 Can a council financially assist others?

(1) A council may, in accordance with a resolution of the council, contribute money or otherwise grant financial assistance to persons for the purpose of exercising its functions.

(2) A proposed recipient who acts for private gain is not ineligible to be granted financial assistance but must not receive any benefit under this section until at least 28 days' public notice of the council's proposal to pass the necessary resolution has been given.

(3) However, public notice is not required if:

(a) the financial assistance is part of a specific program, and

(b) the program's details have been included in the council's draft operational plan for the year in which the financial assistance is proposed to be given, and

(c) the program's proposed budget for that year does not exceed 5 per cent of the council's proposed income from the ordinary rates levied for that year, and

(d) the program applies uniformly to all persons within the council's area or to a significant group of persons within the area.

(4) Public notice is also not required if the financial assistance is part of a program of graffiti removal work.

The proposal from LHMT is from a not-for-profit entity in relation to an existing loan. The extension request for the loan may be tied to the operation of the dental clinic which may involve operating a private gain business. The program would not apply uniformly across the Council area. So if Council

supported the proposal, then the advertising requirements of S356 of the Act would apply.

STRATEGIC IMPLICATIONS

Council is currently dealing with these requests as they occur. Council is balancing its financial stewardship role of different funding arrangements for different groups. A consistent approach would be of assistance into the future.

BUDGETARY IMPLICATIONS

The impact would mean that the repayment of funds would be spread over a longer period and have a minor impact on cash flow.

POLICY IMPLICATIONS

The development a Murray River Council Community Grants Policy was highlighted in November 2017. In addition, a Murray River Council Loans Policy to allow organisations to obtain finance from the Council under particular circumstances would be of benefit to deal with these types of requests.

That Council provide a 50% rate relief on the sewerage rates and annual charges for the property at 2/15 Mellool St, Barham, in accordance with the Murray River Council Greater Wakool Ward policy on “Donations, Rates and Charges Assistance Program”.

BACKGROUND

Council received a letter dated 28 January 2018 from the Local Health Medical Trust (LHMT), a not-for-profit entity, who is the Trustee for the Barham and District Medical Centre, requesting a waiver of rates on the property at 2/15 Mellool St, Barham. 

This property is to be set up as a dental surgery. The Council provides assistance to LHMT for other properties it owns through its Donations, Rates and Charges Assistance Policy.

DISCUSSION

Section 555 and 556 of the Local Government Act 1993 (the 'Act') provides information on properties that can be exempt from all rates or exempt from all rates other than water and sewerage. These relate to entities like religious bodies, crown land, public libraries, public cemeteries, public reserves and public benevolent institutions.

The LMHT does not meet these criteria.

Section 356 of the Act provides information on financial assistance that can be provided by council.

CLAUSE 5. Moama Anglican Grammar School

(b) Moama Anglican Grammar School being responsible for the costs associated with the mortgage discharge.

BACKGROUND

Council provided a loan to the Moama Anglican Grammar School (MAGS) to fund the land purchase for the school site on the Moama Recreation Reserve.

The loan has been paid in accordance with the loan repayment schedule. The loan is backed by a mortgage.

DISCUSSION

The repayment of the loan will involve the calculation of interest to the day of settlement and the discharge of the mortgage.

The early loan payout will involve an immediate capital injection to Council of $215K.

DISCUSSION

Regional Roads

The reseal program is 84% complete. Council is currently waiting for Roads and Maritime Services' approval to go ahead with the construction of a section of the Deniliquin - Barham Road. Sealing work will be undertaken after construction of this road.

Rural Roads

The rural roads program is 25% complete. The program includes the flood restoration works and bridge replacement/restoration.  Tenders have been issued for the flood restoration works and bridge replacement/restoration (Fountains Road/Merryn Creek and Colenso Park Road/Barbers Creek). Subject to Council approval these works should commence in March. The contract for Nimmie Caira bridges has been awarded and off-site works have commenced.

Reconstruction of Centre Road commenced with widening of the section from the railway crossing to Ham Road currently underway.

Construction started on East Barham Road. Sub-grade stabilisation works are currently underway on Bunnaloo Road and Pericoota Road. Rural drainage works are also underway.

Urban Infrastructure

The urban roads program is 27% complete. Urban reseal work will commence later in March when it is cooler to eliminate bleeding and allow bitumen time to settle.

Drainage works have been completed on Hollara Drive with road works to commence in March. Kerbing works are completed on Niemur Street, Barham with the repair of the road surface to commence in late February. Kerb and gutter works commenced on Blair Street and Simms Street, Moama.

The urban drainage program is 24% complete. Works on the stormwater drainage pump station and rising mains in Greater Wakool Ward will commence soon.

Parks, Gardens and Recreation Reserves

The playground equipment at Riverside Park, Barham has been replaced and quotes for the shading structure(s) are currently being assessed.

Buildings and Other Structures

Council is currently seeking tenders for building works at the Picnic Point caravan park.

Echuca and Moama are undergoing continual and significant urban growth. Being located on the Murray River and adjacent to the junctions with the Goulburn and Campaspe Rivers, contemporary flooding information is important to enable appropriate and proper land use planning to guide their growth. Significant high river events have recently occurred, principally during the 2010-11 flood event. This flood event caused flooding around and within Echuca - Moama and stress and hardship for some residents.

Murray River Council and Campaspe Shire Council have been allocated funding by their respective State Governments to conduct flood studies to update flood information for the Murray River generally between Barmah and downstream of Torrumbarry and particularly with respect to the urban and growth areas affected by that flooding in both municipalities. As flooding along the Murray River does not respect state boundaries and the modelling will require the terrain and features on both sides of the river to be included, in November 2017 both councils resolved to undertake the studies as a joint project.

The project is to be directed by a Project Control Group comprising a senior officer from each of Murray River and Campaspe Shire Councils, the N.S.W. Office of Environment and Heritage and the Victoria North Central Catchment Management Authority Council. This Group has been established.

A Flood Study Reference Committee (FSRC) is also to be established with representation from the urban and rural communities on both sides of the river, the aboriginal community, the Victoria and NSW State Emergency Services and environment departments, municipal engineers, land use planners, Bureau of Meteorology, Goulburn Murray Water and a councillor from each Council. It is to be overseen by the Project Control Group and have an advisory role providing a forum for discussion of technical, social, economic and ecological issues to ensure all important aspects of the study are given due consideration.

DISCUSSION

The Project Control Group has reviewed the initial Terms of Reference and is recommending some alterations to include representation from the Bureau of Meteorology in the FSRC and to clarify the roles of the Councils, Project Control Group and FSRC. This is intended to ensure it is quite clear that the Councils are the decision makers and the Project Control Group and FSRC are only advisory bodies as originally intended.

Council now needs to appoint its Councillor Representative to the FSRC. Expressions of interest are also being sought for community members on the FSRC comprising 3 urban community representatives and 2 rural community representatives from each side of the Murray River. Expressions of interest from the Moama community will be presented to Council to determine the appointments. Invitations have also been forwarded to the various government agencies seeking their nominations.

There has been extensive consultation between officers of Murray River, Campaspe Shire and Gannawarra Shire councils, NCCMA, DELWP and NSWDEH commencing with a joint meeting in May 2017 involving all of the organisations responsible for flood investigations along the Murray from Echuca / Moama to Swan Hill including the municipalities and State authorities from NSW and Victoria to ascertain what studies are being planned or needed with a view to coordinating the investigations and achieving some efficiencies. The key meeting outcome was general agreement to combine the planned Echuca, Torrumbarry and Moama flood studies as far as practical into a single project. Ongoing consultation between Murray River Council, Campaspe Shire Council, NSWOEH, DELWP and the NCCMA has continued with formation of the Project Control Group.

Council stands to benefit immensely from the cross-border collaboration for delivery of the Echuca Moama Torrumbarry Flood Study Project. The outcome will likely be a more extensive flood study and comprehensive floodplain risk management plan.

CONCLUSION

It is considered appropriate to amend the Terms of Reference for the Project Control Group and Flood Study Reference Committee to further clarify their roles and to appoint Murray River Council’s Councillor representative to the Flood Study Reference Committee so that it may be established in a timely manner.

Council received an application to close a section of unnamed public road through Lot 48, DP 75626, off Millewa Road, Bullatale as shown in Appendix A. The applicants own the land on both sides of the unnamed public road. The unnamed section of the road is currently used to crop wheat and canola. To ensure efficient farming practices the applicants wish to close the unnamed road section and purchase the 7ha (approximately) section of closed road.

DISCUSSION

The road has not been maintained by Council as a public road, is superfluous to Council’s needs and is not used by the adjoining landowners as a primary access to their properties. The road, if closed, would vest in the Crown and the subsequent sale would be the responsibility of the Crown. Prior to lodging the application to the Department of Industry - Lands for consideration Council approval for the closure is required. The Department of Industry – Lands will then advertise the proposal in accordance with Section 35 of the Roads Act 1993.

BACKGROUND

At Murray River Council’s Ordinary Meeting held on Tuesday 19 July 2016, Council resolved that the subject ‘Planning Proposal’ be submitted to the NSW Department of Planning and Environment (DPE) with a request for Gateway Determination to amend the Murray Local Environmental Plan 2011 (Murray LEP 2011). The subject planning proposal seeks to rezone Lot 11 DP 701453, Twenty Four Lane, MOAMA NSW 2731 from RU1 Primary Production to R1 General Residential, and reduce the minimum lot size provisions affecting the land from 120 hectares to 750m2. Council submitted the Planning Proposal to DPE on 8 September 2016 requesting a Gateway Determination be made. A Gateway Determination was subsequently received by Council dated 14 October 2016, attached as Appendix Gateway Determination.

DISCUSSION

Condition 1 of the Gateway Determination currently reads:

1. Council is to review the draft Murray Shire Strategic Land Use Plan including the preferred staging of residential land releases around Moama. Demand and supply data must be updated to accurately reflect development activity. The revised draft Murray Strategic Land Use Plan is to be endorsed by the Department prior to community consultation.Council is to amend the planning proposal to reflect the outcomes of this work and seek approval from the Department prior to undertaking community consultation.

Council has since engaged an external consultant to develop a new Council wide Strategic Land Use Plan. Given the amount of work required to complete this project, it is likely that this project will take up to 24 months, which will delay the processing of the current planning proposal.

Regarding this condition, Council subsequently received additional correspondence from NSW DPE dated 16 October 2017, attached as Appendix Correspondence. This correspondence outlined a

The alternative approach is to limit the work to updating the demand and supply detail and land release sequencing, which will ensure the planning proposal can proceed whilst still ensuring all relevant planning matters are addressed.  This would result in an amended condition 1, to read:

1. Council is to update its demand and supply detail and land release sequencing data. This work should include up to date housing supply and demand figures, from development application/construction certificate numbers and include both land zoned for development and land subject to existing planning proposals. The work is to also include the preferred staging of residential land releases around Moama. Council is to amend the planning proposal to reflect the outcomes of this work and seek approval from the Department prior to undertaking community consultation.

It is noted Council has engaged a consultant to complete this project, and is due to receive this information in the near future.

STRATEGIC IMPLICATIONS

An updated Condition 1 of the Gateway Determination will allow the planning proposal to proceed, whilst still ensuring all relevant planning matters are taken into consideration.

CONCLUSION

As a consequence of the above discussion, together with an assessment of the heads of consideration under Section 79C of the EP&A Act, as well as the planning merits of the proposal in this particular location it is felt that on balance the proposed development incorporating the development of a retaining wall, pump pontoon and walkway as a water supply structure and associated earthworks on Lot 1 DP 148355, No. 91 Perricoota Road, Moama, is both appropriate and satisfactory as a result of this assessment.

The proposal is also considered to be consistent with MREP2 in that rehabilitation of an eroding section of the river bank will be achieved, stabilising a section which is otherwise encroaching upon the nearby dwelling located on site.

Having regard to the nature of the development proposal it is considered that the proposed development is consistent with relevant planning provisions including the Murray LEP 2011 and is consequently worthy of support.  Accordingly, Development Application 133/17 is recommended for APPROVAL subject to the imposition of suitable conditions of consent as outlined below.

General Conditions that must be fulfilled

1. The development of a retaining wall, installation of a pontoon and walkway as a water supply structure and associated earthworks on Lot 1 DP 148355, 91 Perricoota Road, Moama NSW 2731 must be carried out in accordance with the attached approved plans dated 28 September 2017 (Sheets 1 – 6 Drawing No. 44482-3B prepared by BM Civil Engineers) and subject to the following conditions.

2. The proponent must ensure and monitor that the development is secured in the approved location. The development must not be relocated without the prior written consent of Council and other government departments or agencies, as may be the case.

3. The proponent must ensure that the development is maintained in a safe and serviceable condition at all times. The use of the development must not detrimentally affect the amenity of the area, including through:

• the transport of materials, goods or commodities to or from the site, and• the appearance of any works or materials, and• any emission of noise, artificial light, vibration, smell, fumes, smoke, vapour, steam, soot, ash,

dust, waste water, waste products, grit or oil.

1. No waste or waste storage facilities are to be placed or stored on the bank or land adjacent to the retaining wall except with the prior written consent of Council and the relevant landowner.

2. No advertising sign that requires the prior approval of Council is to be erected / displayed on the retaining wall unless the advertising sign benefits from a development consent notice issued by Murray River Council.

3. No vessels are permitted to be moored at the site.

4. The walkway and pontoon must be hinged so it is able to rise and fall with the level of the watercourse and be able to be removed in a major flood event.

5. All conditions of consent must be fulfilled to the standard of Council and at the expense of the developer.

Compliance with Government Department conditions of consent

1. The proponent must comply with all conditions and requirements outlined on NSW DOI Water – General Terms of Approval (Dated 4 December 2017), attached to this Development Consent as Appendix 1. It is noted the attached General Terms of Approval issued by NSW DOI Water do not constitute an approval under the Water Management Act 2000.

1. The Applicant must prepare and submit an Erosion and Sediment Control Plan with the application for a Construction Certificate. This plan must be approved by Council prior to the issue of a Construction Certificate. These measures must be in place prior to works commencing. Such measures must be maintained throughout the working period and must not be removed until the works are completed. Operations must be conducted in such a manner as not to cause damage or increase erosion of the adjacent banks.

2. The Applicant must provide Council with a detailed report from an appropriate consulting structural engineer demonstrating that the proposed development can withstand the force of flowing floodwaters, including buoyancy forces.

3. The structures must be designed and certified by a practicing and suitably qualified Structural Engineer.

4. The Applicant must supply Council with details of the specific colours being used to complete the structure. Colours must blend with the riverine environment and must be approved by Council prior to the commencement of works. This condition does not apply to the requirements of NSW RMS for navigational safety.

5. Prior to the issue of a Construction Certificate, the applicant must submit to Council a landscaping plan detailing indigenous species of riparian vegetation to be planted to screen and soften the appearance of the development to the riverine environment. This plan must also assist with stabilising the bank, providing both habitat for wildlife and a trap for silt, nutrients and other substances which may otherwise enter the river and lead to a deterioration of water quality.

6. Prior to the issue of a Construction Certificate, the consent holder must obtain a Controlled Activity Approval (CAA) for any controlled activity (works) on waterfront land under the Water Management Act 2000 from NSW DOI Water. Waterfront land for the purposes of this DA is land and material in or within 40 metres of the top of the bank or shore of the river identified. The Construction Certificate will not be issued over any part of the site requiring a Controlled Activity Approval until a copy of the approval has been provided to Council.

7. The requirements of the NSW DOI Water - General Terms of Approval must be shown on the plans accompanying the Construction Certificate prior to the issue of any Construction Certificate.

Conditions that must be fulfilled prior to the commencement of any works

1. A Construction Certificate must be submitted to, and approved by Council prior to any building works taking place on the subject site. 

2. The Applicant may need to obtain a permit under the Fisheries Management Act 1994 or the Water Management Act 2000 if there is to be any excavation within, or filling of the waterway.

3. Erosion and sedimentation controls must be installed and maintained on site in accordance with the approved plan for the duration of construction works. Such measures must be maintained throughout the working period and not removed until the works are completed. Operations must be conducted in such a manner as not to cause damage or increase erosion of the bank. Erosion and sediment mitigation devices must be erected in a manner consistent with currently accepted Best Management Practice (i.e. Managing Urban Stormwater: Soils and Construction 4th Edition Landcom, 2004) and the NSW Department of Environment and Conservation “Erosion and Sediment Control – A Resource Guide for Local Councils” to prevent the entry of sediment into the waterway prior to any earthworks being undertaken.  These must be maintained in good working order for the whole duration of the works and subsequently until the site has been stabilised and the risk of erosion and sediment movement from the site is minimal.  Exposed soil must be reseeded or turfed.

4. A temporary water closet accommodation must be provided onsite during construction. This facility must be located onsite so as to not create a nuisance to any adjoining properties.

5. The NSW DPI Fisheries District Fisheries Officer at Deniliquin (Telephone: 03 5881 9928, Mobile: 0427 897 145, Email:  [email protected]) must be notified at least 3 days prior to

the commencement of construction (email preferred). 

6. If any ground disturbance is to take place, erosion and sediment mitigation devices must be erected in a manner consistent with currently accepted Best Management Practice (i.e. Managing Urban Stormwater: Soils and Construction 4th Edition Landcom, 2004) to prevent the entry of sediment into the waterway prior to any earthworks being undertaken.  These must be maintained in good working order for the whole duration of the works and subsequently until the site has been stabilised and the risk of erosion and sediment movement from the site is minimal.  Exposed soil must be reseeded or turfed. 

Conditions that must be complied with during works and in perpetuity

1. Machinery must not enter, or work from the waterway unnecessarily. 

2. No snags (tree trunks, root balls, limbs, branches or other woody debris) in the channel or on the bank of the river are to be moved, removed or otherwise interfered with either during the construction phase or at any time subsequently, without the concurrence of NSW Department of Primary Industries - Fisheries. 

3. Native vegetation (including trees such as River Red Gum, Black Box and River Coobah, shrubs, reeds such as Phragmites and grasses) on or adjacent to the river bank must not be cleared, modified or otherwise harmed at any time during the construction or at any time subsequently.  This does not include control of noxious or other recognised weeds. 

4. NSW Department of Primary Industries Fisheries must be notified immediately if any fish kills occur in the vicinity of the works.  In such a case all works must cease until the issue is rectified and approval is given to proceed. 

5. Vehicles must be clean and free of debris prior to leaving the site during construction. Deposited material may be ordered to be removed at the applicant/operator’s expense.

6. The construction site must be maintained in an environmentally sound manner during works. Designated waste containment areas must be provided on site, and maintained so as to prevent any windblown litter escaping from the site.

7. Any damage or deterioration to any portion of the footpath and/or kerb and guttering or other Council property including road reserves, during construction must be reinstated to its original condition at the owner's expense to the satisfaction of Council.

8. During construction the proponent must undertake measures to minimise dust and noise and ensure that the impact on neighbouring properties is minimised.

9. Works must not commence on the site before 7am on weekdays and Saturdays and 8am on Sundays and public holidays. All works must cease by 8pm on any day.

10. There must be no clearing of native vegetation other than that approved by NSW Murray Local Land Services in accordance with the provisions of the Biodiversity Conservation Act 2016.The works associated with the approved development must not disturb the root systems of any native trees present on site.

11. If any Aboriginal object is discovered and/or harmed in, or under the land, while undertaking the proposed development activities, the proponent must:◦ Not further harm the object;◦ Immediately cease all work at the particular location;◦ Secure the area so as to avoid further harm to the Aboriginal object;◦ Notify NSW OEH as soon as practical on 131 555, providing any details of the Aboriginal

object and its location; and◦ Not recommence any work at the particular location unless authorised in writing by NSW

OEH.

In the event that skeletal remains are unexpectedly encountered during the activity, work must stop immediately, the area secured to prevent unauthorised access and NSW Police and NSW OEH

1. The proponent must take all necessary precautions and implement measures to prevent pollution of waterways during the proposed works.

2. Clean fill only is to be utilised between the retaining wall and the land. There must be no urban rubble or litter in the fill. All backfill material to fill behind the retaining wall must be sourced from off-site.

3. Geotextile material must be placed between the bank and the retaining wall so that soil is retained behind the wall and not washed out by water. The Geotextile material will allow water movement to occur freely, but soil movement is hindered. 

4. Operations must be conducted in such a way that there is no diversion of the stream from the existing alignment and conducted in such a manner as not to cause damage or increase erosion of the adjacent banks. 

5. Council must be notified of the completion of the works.

Conditions that must be fulfilled prior to the release of the Occupation Certificate or use of the development

1. The Applicant must not allow or permit the structure (or part of the structure, in the case of alteration or additions) to be occupied or used, until:

i. All conditions of this consent have been completed in full; ii. An application for an Occupation Certificate has been completed and returned to the

Principal Certifying Authority; andiii. The Principal Certifying Authority has issued an Occupation Certificate.

2. Landscaping must be completed to the satisfaction of Council in accordance with the approved Landscaping Plan prior to the use of the development.

3. The structures must have restricted access and appropriate signage to prohibit unauthorised use. The signage must be of minimal size to protect the amenity of the riverine environment.

4. The development consent number (DA 133/17) must be displayed at an acceptable location on the site.

5. On completion of the works, the site must be rehabilitated and stabilised.  Surplus construction materials and temporary structures (other than silt fences and other erosion and sediment control devices) installed during the course of the works must be removed. 

6. The applicant must ensure that they have adequate Public Liability Insurance to cover the structures.

Reasons for Conditions

(a) To ensure compliance with the terms of the Environmental Planning and Assessment Act 1979

(b) Having regard to Council's duties of consideration under Section 79C and 80A of the Act

(c) To ensure an appropriate level of provision of amenities and services occurs within the Murray River Council LGA and to occupants of sites

(d) To improve the amenity, safety and environmental quality of the locality

(e) Having regard to environmental quality, the circumstances of the case and the public interest

(f) Having regard to the Murray Development Control Plan 2012

(g) To satisfy the requirements of NSW Roads & Maritime Services.

(g) To ensure that habitats are restored as quickly as possible, public safety is not compromised and aesthetic values are not degraded

(h) To ensure minimal risk of water pollution from oil or petroleum products and to minimise disturbance to the streambed substrate

(i) To protect public interest, the environment and existing amenity of the locality

(j) To minimise health risk to neighbouring residents and workers.

Advice to applicant

The land subject to this consent may have restrictive covenants applying to it. It is the responsibility of the owner and builder to ensure that covenants are adhered to. Council does not enforce or regulate covenants and therefore accepts no responsibility for checking the compliance of building design with such covenants.

Reason: To ensure compliance with the Environmental Planning and Assessment Act 1979.

Individuals owe asset owners a duty of care that must be observed when working in the vicinity of plant or assets on the relevant property via contacting the Dial Before You Dig service in advance of any construction or planning activities.

Reason: To protect underground assets.

The development must be in accordance with the relevant provisions and Regulations of the Biodiversity Conservation Act 2016, the Fisheries Management Act 1994, the National Parks and Wildlife Act 1974, the Protection of the Environment Operations Act 1997, and all other applicable legislation.

Reason: To comply with relevant legislation.

The proponent should be aware that under Section 120 of the Protection of the Environment Operations Act 1997 it is an offence to pollute waters.

Reason: To comply with NSW EPA requirements.

No agent is exempt from the provisions of the Marine Safety Act 1998, or any other relevant legislation, and all agents must comply with any direction given by NSW RMS officers with regard to the prevention of pollution and safe navigation.

Reason: To adhere to NSW RMS advice.

Controlled Activity Approval (CAA) is required for that part of the works located on "waterfront land". Waterfront land is considered to be the channel of the Murray River and land within 40 metres of the top of the bank. Please note that any subsequent application for CAA requires the inclusion of the relevant landholders consent.

Reason: To comply with NSW DOI Water requirements.
