1.0 INTRODUCTION

AECOM Technical Services of North Carolina, Inc. (includes legacy URS and herein referred toas AECOM) has prepared this Risk Management Plan (RMP) to address dry-cleaning solventcontamination associated with the former Highlander Center Laundry site (DSCA IDDC800006) on behalf of the North Carolina Department of Environmental Quality (NCDEQ)Dry-Cleaning Solvent Cleanup Act (DSCA) Program. The former Highlander Center Laundryfacility was located at 2000 Statesville Boulevard, Rowan County, Salisbury, North Carolina asshown on the attached Figure 1. This address no longer exists as it is in the area of theinterchange at US 70 (Statesville Boulevard) and US 601 (Jake Alexander Boulevard)constructed in 1991. The dates of operation for the former Highlander Center Laundry dry-cleaning facility are not known. The former dry-cleaning property currently exists as an Exxon-branded gasoline filling station and Rushco Food Store convenience store located at 1930Statesville Boulevard.

The Highlander Center Laundry site (herein referred to as the “site”) includes the source property(where the dry-cleaning facility source was located) and four off-source properties wherecontamination from the former facility has migrated in groundwater. The site properties are asfollows:

1. Source property – Rusher Oil Co. Inc., 1930 Statesville Boulevard, PIN 327 027,which encompasses the former Highlander Center Laundry dry-cleaning facility and aportion of the existing convenience store building, canopy-covered dispenser islands,and paved surface level drive aisles and parking areas for the Exxon/Rushco FoodStore #11;

2. Off-source property – Rusher Oil Co. Inc., 2004 Statesville Boulevard, PIN 327118, which encompasses a portion of the existing convenience store building, canopy-covered dispenser islands, and paved surface level drive aisles and parking areas forthe Exxon/Rushco Food Store #11;

3. Off-source property – S Cashion, LLC, 2010 Statesville Boulevard, PIN 331 129,which encompasses a portion of the property improved with a car wash, canopy-covered dispenser islands, and paved surface level drive aisles and parking areas forthe BP/Country Cupboard convenience store and filling station;

4. Off-source property – Hotel Group of Salisbury Inc., West Jake AlexanderBoulevard, PIN 331 135, which encompasses the McDonald’s restaurant and pavedsurface level drive aisles and parking areas; and

5. Off-source property – Rowan County, 1951 Statesville Boulevard, PIN 331 143,which encompasses the former Salisbury Mall Cinemas movie theater and pavedsurface level drive aisles and parking areas.

This RMP is intended to comply with the requirements of the DSCA (N.C.G.S. 143-215.104A etseqs) and promulgated rules and follows the outline provided in the DSCA Program’s risk-basedcorrective action (RBCA) guidance.

2.0 OBJECTIVES OF RISK MANAGEMENT PLAN

AECOM has completed assessment activities at the site which identified the following:· The presence of tetrachloroethylene (PCE), benzene, methyl tert-butyl ether (MTBE),

and methylene chloride in groundwater beneath the source property at concentrationsexceeding the Title 15A NCAC 2L .0202 Groundwater Standards (2L Standards);

· The presence of PCE on four off-source properties at concentrations exceeding the 2LStandards;

· The presence of PCE in soil beneath the source property at concentrations above theDivision of Waste Management (DWM) health based and/or protection of groundwaterPreliminary Soil Remediation Goals (PSRGs); and,

· The presence of PCE in soil gas beneath the source property and two off-sourceproperties at concentrations above the DWM residential Soil Gas Screening Levels.

AECOM completed a risk assessment for the site in accordance with the DSCA Program’s riskassessment procedures in January 2016. The results of the risk assessment indicated that thereare risks that exceed applicable target levels on the source property. These risks will be managedusing site-specific land-use conditions that have been selected as part of the risk assessmentevaluation and which require a RMP. Thus, the objective of the RMP is to ensure that those site-specific land-use conditions remain valid in the future.

3.0 SUMMARY OF RISK ASSESSMENT REPORT

AECOM performed a risk assessment to address the applicable exposure pathways based on theidentified impacts summarized in Section 2.0. Comprehensive results of the risk assessment,which are summarized herein, are documented in the Risk Assessment Report, dated December16, 2015.

The site is currently zoned as commercial; however, to be protective of unknown future zoningand mixed-use development in the future, both residential and commercial scenarios wereconsidered as part of the risk assessment.

The risk assessment process consisted of evaluating exposure pathways for the exposure unitsshown on Figure 2. A summary of the groundwater quality data used in the risk assessment isincluded on Figure 3. A summary of the soil quality data used in the risk assessment is includedon Figures 4 and 5. A summary of the vapor quality data used in the risk assessment is includedon Figure 6. The exposure model evaluation indicated the following exposure pathways for eachExposure Unit:

Exposure Unit #1

Exposure Unit #1 encompasses the source property where the former Highlander Center Laundrydry-cleaning facility was located and the adjacent Rusher Oil Co, Inc. off-source property. Asdocumented in the Risk Assessment Report, dated December 16, 2015, petroleum constituentsidentified in Exposure Unit #1 were not included as part of groundwater, soil, soil gas, indoor airor outdoor vapor emission pathways as these impacts are associated with the active NCDEQUnderground Storage Tank (UST) incident #3519 and falls under the jurisdiction of the USTprogram and not DSCA.

· Indoor Inhalation of Vapor Emissions – For the indoor inhalation of vapor emissionsexposure pathway, soil gas data were used to evaluate current risk and future risk. Themaximum soil gas contaminant concentrations detected within Exposure Unit #1 wereconservatively used for the RCs. Indoor inhalation risk was evaluated using the DSCArisk assessment toolkit and applicable calculators for current conditions (commercial),and future conditions (residential and commercial). The indoor air exposure pathwaypassed the risk evaluation for current commercial land-use conditions as well as futureresidential land-use conditions. No land-use controls in Exposure Unit #1 are necessaryto address the Indoor Inhalation of Vapor Emissions exposure pathway.

· Surface Soil Combined – For the surface soil combined pathway, soil quality data wereused to evaluate current and future risk. The maximum soil contaminant concentrationsdetected within Exposure Unit #1 were conservatively used for the RCs. Surface soilcombined risk was evaluated using the DSCA risk assessment toolkit and applicablecalculators for current conditions (commercial), future conditions (residential andcommercial), and construction worker. Surface soil combined pathway risk levels did not

exceed calculated allowable risk for current commercial land-use conditions or futureresidential, commercial or construction user land-use conditions. No land-use controls inExposure Unit #1 are necessary to address the Surface Soil Combined exposure pathway.

· Dermal Contact with Groundwater - Impacted groundwater is not present within 10feet of ground surface. Therefore, dermal contact is considered an incomplete exposurepathway for current (commercial), future (residential and non-residential) andconstruction worker conditions.

Since groundwater contaminant concentrations above the 2L Standards are present withinExposure Unit #1, land-use controls should be implemented preventing the installation of watersupply wells within Exposure Unit #1.

Exposure Unit #2

Exposure Unit #2 encompasses a portion of the off-source S. Cashion LLC property. Petroleumconstituents were not included as part of groundwater pathways evaluated for this exposure unitsince these impacts are associated with the active UST incident #3519 and falls under thejurisdiction of the NCDEQ UST program and not DSCA.

· Indoor Inhalation of Vapor Emissions – For the indoor inhalation of vapor emissionsexposure pathway, soil gas data were used to evaluate current risk and future risk. Themaximum soil gas contaminant concentrations detected within Exposure Unit #2 wereconservatively used for the RCs. Indoor inhalation risk was evaluated using the DSCArisk assessment toolkit and applicable calculators for current conditions (commercial),and future conditions (residential and commercial). The indoor air exposure pathwaypassed the risk evaluation for current commercial land-use conditions but did not pass forfuture residential land-use conditions. The future indoor air inhalation exposure pathwaycan be addressed through the imposition of commercial land-use controls on the site.

· Surface Soil Combined – Impacted surface soil is not present within Exposure Unit #2.Therefore, the surface soil combined pathway is considered an incomplete pathway forcurrent (commercial), future (residential and non-residential) and construction workerconditions.

· Dermal Contact with Groundwater - Impacted groundwater is not present within 10feet of ground surface in Exposure Unit #2. Therefore, dermal contact is considered anincomplete exposure pathway for current (commercial), future (residential and non-residential) and construction worker conditions.

Additionally, a commercial land-use control isrecommended to address unacceptable risk levels for indoor inhalation for future residential use.

Exposure Unit #3

Exposure Unit #3 encompasses portions of the off-source Hotel Group of Salisbury Inc. andRowan County properties. Petroleum constituents were not included as part of groundwaterpathways evaluated for this exposure unit since these impacts are associated with the active USTincident #3519 and falls under the jurisdiction of the NCDEQ UST program and not DSCA.

· Indoor Inhalation of Vapor Emissions – For the indoor inhalation of vapor emissionsexposure pathway, soil gas data were used to evaluate current risk and future risk. Themaximum soil gas contaminant concentrations detected within Exposure Unit #3 wereconservatively used for the RCs. Indoor inhalation risk was evaluated using the DSCArisk assessment toolkit and applicable calculators for current conditions (commercial),and future conditions (residential and commercial). Point of Exposure Modeling

Site-specific Domenico groundwater modeling results indicate an exceedance of the SSTL forPCE in source soil and groundwater as modeled to be protective of the closest point of exposure(POE) which was selected to be the first property (Quick Cash Pawn at 2045 StatesvilleBoulevard) on which impacts have not been observed and is located approximately 520 feetsouthwest from what is considered to be the soil and groundwater source area as indicated onFigure 2. Site-specific Domenico groundwater modeling results also indicated an exceedance ofthe SSTLs for PCE in source soil and groundwater as modeled to be protective of the unnamedtributary to Draft Branch Creek located approximately 1,750 feet southwest from the soil andgroundwater source area as indicated on Figure 1.

Evaluation of site groundwater quality indicates that the plume has not migrated as far as themodeling projects. The Domenico groundwater model utilized as part of this evaluation does notaccount for physical and/or biological mediated contaminant degradation that may be occurringnaturally in the subsurface as the contaminant(s) migrate between the source area and the pointof exposure(s). At this site, the significant presence of petroleum hydrocarbons in groundwaterserves as a carbon substrate further promoting biodegradation of the chlorinated constituents.This is apparent based on the presence of chlorinated solvent daughter products in most of thewells at the site, and non-detection of chlorinated solvent contaminant concentrations observedin downgradient wells MW-4, MW-5, and MW-5(CC).

In addition to contaminant degradation, the rate of infiltration is a significant variable in theleaching of contaminants from contaminated soil to groundwater. Specifically, the concentrationof dissolved phase contaminants in the groundwater beneath the site is proportional to the degreeof partitioning of contaminants from affected source soils to groundwater. As the rate ofinfiltration is a significant variable in the leaching of contaminants from contaminated soil togroundwater, it is reasonable to assume that plume expansion will occur if infiltration ratesincrease in the area of source soil contamination. In general, increased contaminant partitioningfrom soil to groundwater may result in a greater groundwater contaminant mass and ultimately alarger contaminant plume. It is recommended that land-use controls be utilized to maintaininfiltration conditions in areas where structures and/or paved surfaces may limit presentinfiltration rates. In respect to the site, the limited area of impacted soils exceeding the calculatedSSTLs as depicted in Figure 5 are located beneath the existing pavement of the current siteimprovements. As such, infiltration land-use controls are recommended for impacted soilsassociated with this site as depicted in Figure 5.

4.0 REMEDIAL ACTION PLAN

4.1 Assessment Activities and Interim Actions

NCDEQ provided URS with a copy of a Semiannual Sampling Report, dated June 25, 2008 forUST Incident Number 3519 at the Former Country Cupboard/Sunoco, Inc. facility located at2010 Statesville Boulevard (US 70), Salisbury, North Carolina. Ongoing assessment activitiescompleted at this property identified the presence of PCE at a concentration exceeding the 2LStandard in one of the groundwater monitoring wells (MW-13) at the property. The source of thePCE impact was not determined as part of the assessment activities completed at the 2010Statesville Boulevard property.

In addition, NCDEQ provided URS information that indicated the footprint of a historic dry-cleaning facility, Highlander Center Laundry (2000 Statesville Boulevard), currently residingwithin and/or beneath the right-of-way (ROW) for West Jake Alexander Boulevard (US 601).The former dry-cleaning facility was identified as a potential source for the solventcontamination identified on the 2010 Statesville Boulevard property.

URS conducted initial assessment activities in November 2010 on the Rusher Oil Co., Inc.property at 1930 Statesville Boulevard. URS installed two shallow Type II groundwatermonitoring wells (MW-1 and MW-2) and collected groundwater samples from on-sitegroundwater monitoring wells MW-1 and MW-2, as well as off-site groundwater monitoringwell MW-13. Laboratory analysis of the groundwater samples identified PCE in all threegroundwater samples at concentrations above the 2L standard. In addition, URS collected twosoil samples during the installation of groundwater monitoring well MW-1. Laboratory analysisof the soil samples identified PCE in shallow (2-3 feet below ground surface [bgs]) on-site soil ata concentration above NCDEQ soil remediation goals. Pertinent soil and groundwater analyticalresults for solvent contamination are shown on Figures 3, 4 and 5. Results of the November2010 investigation activities were submitted to the DSCA program in a letter report datedJanuary 17, 2011.

Subsequently, Rusher Oil Co., Inc. submitted a petition in May 2011 to request admittance of thesite into the DSCA Program. The site was certified into the program on May 24, 2011.

URS initiated prioritization assessment (PA) activities at the site in December 2011, after the sitewas accepted into the DSCA Program. PA activities included: (1) installation of five additional

shallow Type II groundwater monitoring wells (MW-3 through MW-7); (2) installation of twodeep Type III groundwater monitoring wells (DMW-1 and DMW-2); (3) collection of twoshelby tube samples from the groundwater monitoring well MW-7 location; (4) rising head slugtests on monitoring wells MW-1, MW-4 and MW-7; (5) the collection of twelve groundwatersamples from on-site and off-site monitoring wells MW-1 through MW-7, DMW-1, DMW-2,MW-13, VMW-7 and VMW-11; (6) a receptor survey of a 0.5 mile radius around the site; and(7) collection of groundwater samples from nearby water supply wells (WSWs) at 2102Woodleaf Road and 1804 Statesville Boulevard. Pertinent soil and groundwater analytical resultsfor solvent contamination are shown on Figures 3, 4 and 5. Results of the December 2011 PAactivities were submitted to the DSCA Program in a report dated April 4, 2012.

In concurrence with the PA activities performed in December 2011, URS also collected a soilgas sample SG-1 near the foundation of the on-site Rushco Food Store building. Results of thesoil gas sampling indicated acceptable risk levels for non-residential land use. URS submitted thesoil gas assessment data to the DSCA program in a letter report, dated April 4, 2012. Pertinentsoil gas analytical results for solvent contamination are shown on Figure 6.

Upon completion of the PA activities, URS initiated a groundwater monitoring program at thesite to demonstrate plume stability, as well as conducting additional soil gas sampling activitieson the adjacent Hotel Group of Salisbury, Inc. property at 1957 West Jake Alexander Boulevard.Groundwater monitoring events were performed between November 2012 and May 2013. Inaddition to sampling the twelve groundwater monitoring wells previously identified,groundwater sampling was performed in November 2012 and February 2013 at an off-sitemonitoring well located between the western leading edge of the chlorinated solvent contaminantplume and the Country Cupboard convenience store building. This monitoring well has beenidentified as MW-5 (CC). The additional soil gas assessment activities included the collection oftwo soil gas samples (SG-2 and SG-3) from near the foundation of the existing building in April2013.

Based on the results of the groundwater monitoring and soil gas assessment activities, URSconcluded that:

· Groundwater flow direction has consistently been to the southwest and chlorinatedsolvent impacts appear to be limited to on-site monitoring wells MW-1 and MW-2, andoff-site monitoring well MW-13.

· Evaluation of groundwater contaminant concentrations detected as of February 2013indicated either decreasing or stable trends, but an increase was seen in the subsequent

May 2013 sampling event at monitoring well MW-1. Groundwater analytical results fromthe samples collected from groundwater monitoring well MW-5(CC) indicate thatadditional vapor intrusion assessment at the Country Cupboard convenience storebuilding was not warranted. In addition, further horizontal and vertical assessment of thecontaminant plume did not appear to be warranted. URS submitted the groundwatermonitoring data to the DSCA program in a report dated June 18, 2013. Pertinentgroundwater analytical results for solvent contamination are shown on Figure 3.

· Soil gas analytical results from the samples collected from beneath the Hotel Group ofSalisbury, Inc. property did not warrant further vapor intrusion assessment activities.URS submitted the additional soil gas assessment data to the DSCA program in a letterreport, dated May 13, 2013. Pertinent soil gas analytical results for solvent contaminationare shown on Figure 6.

Additional groundwater monitoring activities were completed between September 2013 andNovember 2013 which included sampling thirteen groundwater monitoring wells (MW-1through MW-7, DMW-1, DMW-2, VMW-7, VMW-11 and MW-5(CC)) and four WSWs locatedat 2102 Woodleaf Road, 2036 Woodleaf Road, 2035 Woodleaf Road and 2034 Woodleaf Road.In February 2014, URS oversaw the abandonment of one inactive WSW at 2029 Woodleaf Road.The results of the additional groundwater monitoring activities indicated that the PCEconcentration in monitoring well MW-1 was lower than detected in May 2013. Analytical resultsfor the samples collected from the nearby off-site WSWs did not identify any dry-cleaningrelated contaminants of concern (COCs).

Since the groundwater quality data generated as part of the groundwater monitoring activities forthe site have empirically demonstrated plume stability and no impacts to potential off-sitereceptors (i.e. private WSWs) were identified, further horizontal and/or vertical assessment ofthe contaminant plume was not warranted. Based on the findings of the groundwater monitoringdata generated to date, the site was considered a viable candidate for closure pending thecompletion of a risk assessment pursuant to DSCA Program's RBCA Guidance, June 2012. URSsubmitted the additional groundwater monitoring data and the 2029 WSW abandonment recordto the DSCA in a report dated February 25, 2014. Pertinent groundwater analytical results forsolvent contamination are shown on Figure 3.

In April 2014, URS completed the Level 1 Ecological Risk Assessment checklists whichconcluded that no ecological receptors within 0.5 mile of the site are likely to be impacted.

Results of the ecological risk assessment activities were submitted to DSCA in a letter reportdated April 7, 2014.

In accordance with the RBCA Guidance, a risk assessment was initiated at the site in March2014. During completion of risk assessment activities, additional soil gas data was needed in theevaluation of Exposure Unit #2. Therefore, in February 2015, URS returned to the site andcollected one in-well soil gas sample (IWSG-MW-13-1) from monitoring well MW-13. Per theDSCA Risk Calculators, soil gas concentrations had acceptable cumulative carcinogenic risk fornon-residential use but unacceptable cumulative carcinogenic risk for residential use. Thesefindings were submitted in a letter report dated March 11, 2015.

Upon further review of soil quality data generated to date at the site, soil contaminantconcentrations of PCE detected in soil sample MW-1 (2-3) exceeded the calculated SSTL to beprotective of groundwater impacts migrating from the site. The location of soil sample MW-1 (2-3) is indicated on the attached Figures 4 and 5. Subsequently, additional soil quality data wasnecessary to accurately define the extent of soil impacts around soil sample MW-1 (2-3)exceeding the SSTLs.

In November 2015, URS returned to the site and collected samples from eight soil boringlocations (SB-1 through SB-8) from around monitoring well MW-1. Based on the findings of theadditional soil sampling activities, the area of soil impacts exceeding SSTLs appeared to bedefined and further assessment of the PCE impacted soil at the site did not appear to bewarranted. URS submitted the additional soil assessment data to the DSCA program in aletterreport, dated December 23, 2015. Pertinent soil analytical results for solvent contamination areshown on Figures 4 and 5.

When it was determined that soil, groundwater, and vapor assessment activities for the site werecomplete, URS submitted a risk assessment dated December 16, 2015 to the DSCA Program,which was approved on January 13, 2016. As discussed in detail in Section 3.0, the riskassessment concluded that risks associated with the contamination could be managed throughimplementation of site-specific land-use controls as detailed in this RMP. Therefore, the riskassessment recommended risk-based closure for the site. The purpose of this RMP is to ensurethat the assumptions made in the risk assessment remain valid in the future.NCDEQ provided URS with a copy of a Semiannual Sampling Report, dated June 25, 2008 forUST Incident Number 3519 at the Former Country Cupboard/Sunoco, Inc. facility located at2010 Statesville Boulevard (US 70), Salisbury, North Carolina. Ongoing assessment activities

completed at this property identified the presence of PCE at a concentration exceeding the 2LStandard in one of the groundwater monitoring wells (MW-13) at the property. The source of thePCE impact was not determined as part of the assessment activities completed at the 2010Statesville Boulevard property.

In addition, NCDEQ provided URS information that indicated the footprint of a historic dry-cleaning facility, Highlander Center Laundry (2000 Statesville Boulevard), currently residingwithin and/or beneath the right-of-way (ROW) for West Jake Alexander Boulevard (US 601).The former dry-cleaning facility was identified as a potential source for the solventcontamination identified on the 2010 Statesville Boulevard property.

URS conducted initial assessment activities in November 2010 on the Rusher Oil Co., Inc.property at 1930 Statesville Boulevard. URS installed two shallow Type II groundwatermonitoring wells (MW-1 and MW-2) and collected groundwater samples from on-sitegroundwater monitoring wells MW-1 and MW-2, as well as off-site groundwater monitoringwell MW-13. Laboratory analysis of the groundwater samples identified PCE in all threegroundwater samples at concentrations above the 2L standard. In addition, URS collected twosoil samples during the installation of groundwater monitoring well MW-1. Laboratory analysisof the soil samples identified PCE in shallow (2-3 feet below ground surface [bgs]) on-site soil ata concentration above NCDEQ soil remediation goals. Pertinent soil and groundwater analyticalresults for solvent contamination are shown on Figures 3, 4 and 5. Results of the November2010 investigation activities were submitted to the DSCA program in a letter report datedJanuary 17, 2011.

Subsequently, Rusher Oil Co., Inc. submitted a petition in May 2011 to request admittance of thesite into the DSCA Program. The site was certified into the program on May 24, 2011.

URS initiated prioritization assessment (PA) activities at the site in December 2011, after the sitewas accepted into the DSCA Program. PA activities included: (1) installation of five additionalshallow Type II groundwater monitoring wells (MW-3 through MW-7); (2) installation of twodeep Type III groundwater monitoring wells (DMW-1 and DMW-2); (3) collection of twoshelby tube samples from the groundwater monitoring well MW-7 location; (4) rising head slugtests on monitoring wells MW-1, MW-4 and MW-7; (5) the collection of twelve groundwatersamples from on-site and off-site monitoring wells MW-1 through MW-7, DMW-1, DMW-2,MW-13, VMW-7 and VMW-11; (6) a receptor survey of a 0.5 mile radius around the site; and(7) collection of groundwater samples from nearby water supply wells (WSWs) at 2102

4.2 Remedial Action

According to the DSCA Program’s RBCA guidance, no remedial action is necessary if thefollowing four site conditions are met:

i. the dissolved plume is stable or decreasing;ii. the maximum concentration within the exposure domain for every complete exposure

pathway of any COC is less than ten times the RC of that COC;iii. adequate assurance is provided that the land-use assumptions used in the DSCA

program’s RBCA process are not violated for current or future conditions; and,iv. there are no ecological concerns at the site.

The site’s compliance with the four above referenced conditions confirms that the contaminantconcentrations are not likely to pose an unacceptable risk either at present or in the future andremedial action at the site is not required. Each of these conditions and their applicability to thesubject site are summarized in the following sections.

4.2.1 Condition 1 – The dissolved plume is stable or decreasing

A total of five groundwater monitoring events have been conducted using existing monitoringwells at the site in November 2012, February 2013, May 2013, September 2013 and November2013. URS focused on PCE as the COC for evaluation of plume stability.

URS prepared a concentration versus time graphs for sampling events conducted at the site,which are included in Appendix A. As shown on the trend plots, PCE concentrations have beengenerally stable or decreasing during the sampling events completed from November 2012through November 2013. Based on this data, URS concludes that the size of the plume is stableand concentrations in the source area are likely to remain generally stable.

Documentation of the plume stability evaluation, including a figure showing monitoring welllocations, a table showing historical groundwater analytical data and concentration versus timegraphs are included in Appendix A.

4.2.2 Condition 2 –The maximum concentration within the exposure domain for every completeexposure pathway of any COC is less than ten times the RC of that COC

Representative concentrations were not calculated as part of the risk assessment for this site.Instead, a more conservative approach was utilized by using the maximum concentration foreach COC within each exposure domain. Hence, this condition has been met for each COC andexposure pathway for the site.

4.2.3 Condition 3 – Adequate assurance is provided that the land-use assumptions used in theDSCA program’s RBCA process are not violated for current or future conditions.

The risk assessment completed for the source property was based on current land-use conditionsbeing commercial. However, using the most conservative approach, future conditions at the site

were considered to be residential. As discussed in Section 6.0, land-use controls will beimplemented for the site to ensure that these assumptions remain valid.

4.2.4 Condition 4 – There are no ecological concerns at the site.

On April 7, 2014, URS submitted a Level 1 Ecological Risk Assessment for the site inaccordance with the DSCA Program’s RBCA guidance. The results of the evaluation indicatethat the release does not pose an unacceptable ecological risk. The completed Level 1 EcologicalRisk Assessment Checklists A and B are attached as Appendix B.

The site’s compliance with the four above referenced conditions confirms that the contaminantconcentrations are not likely to pose an unacceptable risk either at present or in the future. Theplume is expected to naturally attenuate over time and the appropriate remedial action is toimplement appropriate land-use controls on the properties where soil and/or groundwatercontamination is present.

5.0 DATA COLLECTED DURING RMP IMPLEMENTATION

No further sampling or other data collection activities are proposed for the site or adjacentproperties, assuming the assumptions detailed in the Notice of Dry-Cleaning SolventRemediation (NDCSR) remain valid. As such, this section is not applicable.

6.0 LAND-USE CONTROLS

As discussed in detail in Section 3.0, the recommendation for closure in the risk assessment forthe site was based on the following land-use controls:

· The source property shall not be used for child care centers or schools, or for mining orextraction of coal, oil, gas or any mineral or non-mineral substances without prior writtenapproval from NCDEQ;

· The source property and two off-source properties (Rusher Oil Co. Inc. at 2004Statesville Boulevard [PIN 327 118] and S Cashion, LLC at 2010 Statesville Boulevard,[PIN 331 129]) shall be used exclusively for non-residential land use pursuant to 15ANCAC 02S.0102(21) and related amenities (parking, landscape areas and walkways), andall other uses of the source property are prohibited except as approved in writing byNCDEQ;

· Infiltration land use controls are recommended for the limited area of impacted soilsexceeding the calculated SSTLs located beneath the existing pavement of the sourceproperty.

· Groundwater will not be used on the source property and four off-source propertieswithout prior approval of NCDEQ.

Institutional controls will be implemented to ensure that land-use conditions are maintained andmonitored until the land-use controls are no longer required for the site. NDCSRs were preparedfor the source property and four off-source properties to comply with the land-use controlrequirement. The NDCSRs are included in Appendix C. Refer to the NDCSRs for the specificlanguage to be incorporated to address each of the risk assessment assumptions.

A plat showing the locations and types of dry-cleaning solvent impacts on the site is included asan exhibit to each NDCSR. The locations of dry-cleaning solvent impacts are wherecontaminants have been detected above unrestricted use standards.

7.0 LONG-TERM STEWARDSHIP PLAN

The NDCSR for the source property contains a clause which requires the owner of the site tosubmit a notarized “Annual Certification of Land-Use Restrictions” to NCDEQ on an annualbasis certifying that the NDCSR remains recorded with the Register of Deeds and that land-userestrictions (LURs) are being complied with. An example of such a certification is included inAppendix D.

8.0 RMP IMPLEMENTATION SCHEDULE

Since the groundwater plume is stable and confined to the source property and four off-sourceproperties, and possible exposure to the contamination is managed through the NDCSRs, noadditional site remediation activities are required to implement the RMP. A 30-day publiccomment period will be held to allow the community an opportunity to comment on thisproposed strategy. Appendix E includes example documents used to announce the publiccomment period in the local newspaper and to inform local officials, nearby property owners,and interested parties. As such, upon completion of the public comment period and finalapproval of the RMP, the NDCSRs will be filed with the Rowan County Register of Deeds andwill complete the RMP schedule.

9.0 CRITERIA FOR DEMONSTRATING RMP SUCCESS

The RMP will be successfully implemented once the required NDCSRs have been executed andrecorded with the Rowan County Register of Deeds. The NDCSR for each property may, at therequest of the property owner, may be canceled by NCDEQ after the risk to public health and theenvironment associated with the dry-cleaning solvent contamination and any other contaminantsincluded in the dry-cleaning solvent assessment and remediation agreement has been eliminatedas a result of the remediation of the property. If NCDEQ is notified of a change in siteconditions, per the notification requirements set forth in each NDCSR, the RMP will be reviewedto determine if the site conditions have impacted the requirements set forth in the NDCSR and ifchanges are required. Enforcement of the RMP will be maintained through receipt of the“Annual Certification of Land-Use Restrictions” from the property owner as part of the NDCSRrequirements.

10.0 CONTINGENCY PLAN IF RMP FAILS

As discussed above, unless the DSCA Program is notified of a change in land-use conditions atthe subject site, per the notification requirements detailed in this plan, the RMP will remain ineffect until the RMP has met its objectives and is considered a success. Pursuant to N.C.G.S.143-215.104K, if any of the LURs set out in the NDCSR are violated, the owners of theproperties at the time the LURs are violated, the owner’s successors and assigns, and the owner’sagents who direct or contract for alteration of the site in violation of the LURs, shall be heldliable for the remediation of all contaminants to unrestricted use standards.

11.0 CONCLUSIONS AND RECOMMENDATIONS

AECOM has prepared this RMP for the former Highlander Center Laundry site on behalf of theDSCA Program. The results of the risk assessment completed for the site indicate thatcontaminant concentrations do not pose an unacceptable risk. The contaminant plume associatedwith the site appears stable or decreasing. This RMP specifies that the NDCSR requirementsprovide notification that land-use conditions observed during the risk assessment evaluationremain valid in the future. Based on the documentation contained in this report, AECOMrecommends issuance of a “No Further Action” letter.

Level 1 Ecological Risk Assessment Checklist A for Potential Receptors and Habitat

DSCA #80-0006

1. Are there any navigable water bodies or tributaries to a navigable water body on or

within the one-half mile of this site? No. According to the Prioritization Assessment Report (PAR) dated April 4, 2012, a wet weather creek is located approximately 225 feet (ft) north of the site. Based on review of the United States Geological Survey (USGS) topographic map, Salisbury, North Carolina dated 1991, the wet weather creek discharges to Jump and Run Branch located approximately 2,460 ft north of the site. There is also an intermittent drainage feature located approximately 1,750 ft southwest of the site, which discharges to an unnamed tributary of Draft Branch located approximately 4,260 ft southwest of the site. In addition, there is another intermittent drainage feature approximately 1,485 ft southeast of the site, which discharges to Grants Branch located approximately 6,100 ft southeast of the site. Jump and Run Branch, Draft Branch, Grants Creek and their tributaries/drainage features are classified as Class C water bodies; however, none these features are considered navigable. The drainage and surface water features within one-half mile of the site are shown on the attached Figure 1.

2. Are there any water bodies anywhere on or within the one-half mile of the site? Yes.

The above referenced drainage feature and Jump and Run Branch are located approximately 225ft and 2,460 ft north of the site, respectively.

3. Are there any wetland areas such as marshes or swamps on or within one-half mile of the site? Yes. According to the EDR NEPACheck report, the National Wetland Inventory (NWI) identified one (1) wetland feature within one-half mile of the site. Off-site wetland features include:

1. PUBHh - [P] Palustrine, [UB] Unconsolidated Bottom, [H] Permanently Flooded, [h] Diked/Impounded located approximately 1,400 ft south-southeast.

4. Are there any sensitive environmental areas on or within one-half mile of the site? Yes. One (1) wet weather drainage feature, one (1) Class C water body, and one (1) wetland feature referenced above were identified within one-half mile of the site.

5. Are there any areas on or within one-half mile of the site owned or used by local tribes?

None were identified by the Indian Reservation Database. 6. Are there any habitat, foraging area or refuge by rare, threatened, endangered,

candidate and/or proposed species (plants or animals), or any otherwise protected species on or within one-half mile of the site? Potentially. According to the EDR NEPACheck report, the County Endangered Species database identified one (1) endangered species within Rowan County: the Schweinitz’s Sunflower (plant). However, none have specifically been identified at the site, and the U.S. Federal Lands, NC Game Lands, NC Natural Heritage Sites, and NC Natural Areas databases did not identify any endangered and/or threatened species within 1 mile of the site.

In addition, five (5) federal species of concern (FSCs), one (1) candidate for official listing, and one (1) Bald and Golden Eagle Protection Act (BGPA) species were also identified by the U.S. Fish and Wildlife Service (FWS) in Rowan County (http://www.fws.gov/raleigh/species/cntylist/rowan.html). However, none have specifically been identified at or within one-half mile of the site.

7. Are there any breeding, roosting or feeding areas by migratory bird species on or

within one-half mile of the site? One (1) BGPA was identified by the U.S. FWS in Rowan County. However, according to the National Audubon Society, Important Bird Areas (IBAs) web page (http://netapp.audubon.org/iba/state/US-NC), there are no breeding, rousting, or feeding areas by migratory bird species on or within one half mile of the site. In addition, no important bird areas or endangered/threatened bird species have been specifically identified within one-half mile of the site.

8. Are there any ecologically, recreationally or commercially important species on or

within one-half mile of the site? None have been identified. 9. Are there any threatened and/or endangered species (plant or animal) on or within one-

half mile of the site? Potentially. According to the EDR NEPACheck report, the County Endangered Species database identified one (1) endangered species within Rowan County: the Schweinitz’s Sunflower (plant). However, none have specifically been identified at the site, and the U.S. Federal Lands, NC Game Lands, NC Natural Heritage Sites, and NC Natural Areas databases did not identify any endangered and/or threatened species within 1 mile of the site.

Wetlands are defined in 40 CFR §232.2 as “areas inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and that under normal circumstances does support, a prevalence of vegetation typically adapted for life in saturated soil conditions.” The sources to make the determination whether or not wetland areas are present may include, but not limited to, national wetland inventory available at http://nwi.fw.gov, federal or state agency, and USGS topographic maps. Areas that provide unique and often protected habitat for wildlife species. These areas typically used during critical life stages such as breeding, rearing or young and overwintering. Refer to Attachment 1 for examples of sensitive environments. Ecologically important species include populations of species which provide a critical food resource for higher organisms. Ecologically important species include pest an opportunistic species that populate an area if they serve as a food source for other species, but do not include domesticated animals or plants/animals whose existence is maintained by continuous human interventions. Eventually, groundwater likely discharges to an intermittent drainage feature located approximately 1,750 feet (ft) southwest of the site which discharges to an unnamed tributary of Draft Branch located approximately 4,260 ft southwest of the site. Question 1. Could chemicals associated with the site reach ecological receptors through groundwater? Not likely. According to the Prioritization Assessment Report (PAR) dated April 4, 2012, the groundwater impacts have been horizontally and vertically delineated. In addition, review of the Updated Groundwater Monitoring Report (GWMR) dated February 25, 2014, the contaminant plume has migrated off-site to the west-southwest but stable, with fluctuations in contaminant concentrations due to seasonal changes in the groundwater table.

2A. Are chemicals present in surface soils on the site? Yes. 2B. Can chemicals be leached from or be transported by erosion of surface soils on the

site? No. Surface soil impacts were only identified under impervious surfaces at the site. Question 2. Could chemicals associated with the site reach ecological receptors through runoff or erosion? Not likely. Given the current condition of the site, erosion and runoff are not likely concerns since the surface soil impacts were only identified under impervious surfaces.

3A. Are chemicals present in surface soil or on the surface of the ground? Yes. 3B. Are potential ecological receptors on the site? No.

This Notice has been approved by theNorth Carolina Department of Environmental Quality, or its successor in function (hereinafter“DEQ”) under the authority of the Dry-Cleaning Solvent Cleanup Act of 1997, as amended,N.C.G.S. § 143-215.104A et seq. (hereinafter “DSCA”), and is required to be filed in theRegister of Deeds' Office in the county or counties in which the land is located, pursuant toNCGS § 143-215.104M. A Notice will be recorded separately in each chain of title of theContamination Site.

Soil and groundwater at the Property are contaminated with dry-cleaning solventsassociated with dry-cleaning operations at the Former Highlander Center Laundry (DSCA SiteDC800006) previously located at 2000 Statesville Boulevard, Salisbury, North Carolina. Dry-cleaning operations were conducted on the Property from approximately 1962 to 1991.

Pursuant to N.C.G.S. § 143-215.104M, this Notice is being filed in order to reduce oreliminate the danger to public health or the environment posed by the Property. Attached heretoas Exhibit A is a reduction, to 8.5" x 11", of the survey plat component of the Notice required byN.C.G.S. § 143-215.104M. The survey plat has been prepared and certified by a professionalland surveyor and meets the requirements of G.S. 47-30, and contains the following informationrequired by N.C.G.S. § 143-215.104M:

(1) A description of the location and dimensions of the areas of potential environmentalconcern (Area “A”) with respect to permanently surveyed benchmarks; and

Pursuant to NCGS § 143-215.104M, a certified copy of this Notice must be filed within15 days of receipt of DEQ's approval of the Notice or the effective date of the dry-cleaningsolvent remediation agreement, whichever is later. Pursuant to NCGS § 143-215.104M, the copyof the Notice certified by DEQ must be recorded in the grantor index under the names of theowners of the land.

LAND-USE RESTRICTIONS

NCGS § 143-215.104M requires that the Notice identify any restrictions on the current andfuture use of the Property that are necessary or useful to maintain the level of protectionappropriate for the designated current or future use of the Property and that are designated in thedry-cleaning remediation agreement. The restrictions shall remain in force in perpetuity unlesscanceled by the Secretary of DEQ, or his/her designee, after the hazards have been eliminated,pursuant to NCGS §143-215.104M. Those restrictions are hereby imposed on the Property, andare as follows:

1. Without prior written approval from DEQ, the Property shall not be used for:

a. child care centers or schools; orb. mining or extraction of coal, oil, gas or any mineral or non-mineral substances.

2. The Property shall be used exclusively for non-residential land use pursuant to NorthCarolina Administrative Code (NCAC) 15A NCAC 02S.0102(21) and related amenities(parking, landscape areas and walkways), and all other uses of the Property are prohibitedexcept as approved in writing by DEQ.

3. No activities that encounter, expose, remove or use groundwater (for example,installation of water supply wells, fountains, ponds, lakes or swimming pools that usegroundwater, or construction or excavation activities that encounter or exposegroundwater) may occur on the Property without prior approval of DEQ.

4. No activities that cause or create an increase in infiltration (for example, removal ordemolition of materials such as asphalt, concrete, buildings, or other structures that bytheir use and nature minimize infiltration of rain or water runoff into potentiallycontaminated soil) may occur in “Area A” of the Property, as shown on Exhibit A,without prior approval of DEQ.

5. In January of each year, on or before January 31st, the owner of any portion of theProperty shall submit a notarized Annual Certification of Land-Use Restrictions to DEQcertifying that this Notice remains recorded at the Register of Deeds’ office, and that theland-use restrictions are being complied with.

6. No person conducting environmental assessment or remediation at the Property orinvolved in determining compliance with applicable land-use restrictions, at the directionof, or pursuant to a permit or order issued by DEQ may be denied access to the Propertyfor the purpose of conducting such activities.

7. The owner of any portion of the Property shall cause the instrument of any sale, lease,grant, or other transfer of any interest in the property to include a provision expresslyrequiring the lessee, grantee, or transferee to comply with this Notice. The failure toinclude such a provision shall not affect the validity or applicability of any land-userestriction in this Notice.

EASEMENT (RIGHT OF ENTRY)

The property owner grants and conveys to DEQ, its agents, contractors, and employees,and any person performing pollution remediation activities under the direction of DEQ, access atreasonable times and under reasonable security requirements to the Property to determine andmonitor compliance with the land-use restrictions set forth in this Notice. Such investigationsand actions are necessary by DEQ to ensure that use, occupancy, and activities of and at theProperty are consistent with the land-use restrictions and to ensure that the structural integrityand continued effectiveness of any engineering controls (if appropriate) described in the Noticeare maintained. Whenever possible, at least 48 hours advance notice will be given to the PropertyOwner prior to entry. Advance notice may not always be possible due to conditions such asresponse time to complaints and emergency situations.

REPRESENTATIONS AND WARRANTIES

The Property Owner hereby represents and warrants to the other signatories hereto:

i) that the Property Owner is the sole owner of the Property; or that the Property Owner hasprovided to DEQ the names of all other persons that own an interest in or hold anencumbrance on the Property and have notified such persons of the Property Owner’sintention to enter into this Notice;

ii) that the Property Owner has the power and authority to enter into this Notice, to grant therights and interests herein provided and to carry out all obligations hereunder; and

iii) that this Notice will not materially violate or contravene or constitute a material defaultunder any other agreement, document or instrument to which the Property Owner is aparty or by which the Property Owner may be bound or affected.

ENFORCEMENT

The above land-use restrictions shall be enforceable without regard to lack of privity ofestate or contract, lack of benefit to particular land, or lack of any property interest in particularland. The land-use restrictions shall be enforced by any owner of the Property. The land-userestrictions may also be enforced by DEQ through the remedies provided in NCGS § 143-215.104P or by means of a civil action; by any unit of local government having jurisdiction overany part of the Property; and by any person eligible for liability protection under the DSCA whowill lose liability protection if the restrictions are violated. Any attempt to cancel any or all ofthis Declaration without the approval of the Secretary of DEQ (or its successor in function), orhis/her delegate, shall be subject to enforcement by DEQ to the full extent of the law. Failure byany party required-or authorized to enforce any of the above restrictions shall in no event bedeemed a waiver of the right to do so thereafter as to the same violation or as to one occurringprior or subsequent thereto.

If a land-use restriction set out in this Notice required under NCGS § 143-215.104.M isviolated, the owner of the Property at the time the land-use restriction is violated, the owner’ssuccessors and assigns, and the owner’s agents who direct or contract for alteration of thecontamination site in violation of a land-use restriction shall be liable for remediation of allcontaminants to unrestricted use standards.

FUTURE SALES, LEASES, CONVEYANCES AND TRANSFERS

When any portion of the Property subject to this Notice is sold, leased, conveyed ortransferred, the deed or other instrument of transfer shall contain in the description section, in nosmaller type than that used in the body of the deed or instrument, (1) a statement that theproperty has been contaminated with dry-cleaning solvent and, if appropriate, cleaned up underthe Act and (2) a reference by book and page to the recordation of this Notice.

The Property Owner shall notify DEQ within fourteen (14) calendar days of the effectivedate of any conveyance, grant, gift, or other transfer, whole or in part, of the Property Owner’sinterest in the Property. This notification shall include the name, business address and phonenumber of the transferee and the expected date of transfer.

The Property Owner shall notify DEQ within thirty (30) days following the petitioning orfiling of any document by any person initiating a rezoning of the Property that would change thebase zone of the Property.

This provision shall not apply to leases that do not provide for the right to take actionsthat would violate the prohibitions and restrictions of this Notice.

The Property Owner shall notify DEQ within fourteen (14) calendar days of the effectivedate of any conveyance, grant, gift, or other transfer, whole or in part, of the Property Owner’sinterest in the Property. This notification shall include the name, business address and phonenumber of the transferee and the expected date of transfer.

(hereinafter “DSCA”), and is required to be filed in theRegister of Deeds' Office in the county or counties in which the land is located, pursuant toNCGS § 143-215.104M. A Notice will be recorded separately in each chain of title of theContamination Site.

Groundwater under the Property is contaminated with dry-cleaning solvents associatedwith dry-cleaning operations at the Former Highlander Center Laundry (DSCA Site DC800006)previously located at 2000 Statesville Boulevard, Salisbury, North Carolina. Dry-cleaningoperations were conducted on the Property from approximately 1962 to 1991.

Pursuant to N.C.G.S. § 143-215.104M, this Notice is being filed in order to reduce oreliminate the danger to public health or the environment posed by the Property. Attached heretoas Exhibit A is a reduction, to 8 1/2" x 11", of the survey plat component of the Notice requiredby N.C.G.S. § 143-215.104M. The survey plat has been prepared and certified by a professional

(2) The type, location and quantity of regulated dry-cleaning solvent contamination andother contaminants known to exist on the Property.

Attached hereto as Exhibit B is a legal description of the Property that would besufficient as a description in an instrument of conveyance.

LAND-USE RESTRICTIONS

N.C.G.S. § 143-215.104M requires that the Notice identify any restrictions on the current orfuture use of the Property that are necessary to assure adequate protection of public health andthe environment. The restrictions shall continue in perpetuity and cannot be amended orcanceled unless and until the County Register of Deeds receives and records the writtenconcurrence of DEQ. Those restrictions are hereby imposed on the Property, and are as follows:

1. Without prior written approval from DEQ, the Property shall not be used for:

a. child care centers or schools; orb. mining or extraction of coal, oil, gas or any mineral or non-mineral substances.

2. The Property shall be used exclusively for non-residential land use pursuant to NorthCarolina Administrative Code (NCAC) 15A NCAC 02S.0102(21) and related amenities(parking, landscape areas and walkways), and all other uses of the Property are prohibitedexcept as approved in writing by DEQ.

3. No activities that encounter, expose, remove, or use groundwater (for example,installation of water supply wells, fountains, ponds, lakes or swimming pools that usegroundwater, or construction or excavation activities that encounter or exposegroundwater) may occur on the Property without prior approval by DEQ. No subsurfacestructures for access of personal use, such as basements, may be constructed on theProperty without prior approval by DEQ.

4. In January of each year, on or before January 31st, the owner of any portion of theProperty shall submit a notarized Annual Certification of Land-Use Restrictions to DEQcertifying that this Notice remains recorded at the Register of Deeds’ office, and that theland-use restrictions are being complied with.

5. No person conducting environmental assessment or remediation at the Property, orinvolved in determining compliance with applicable land-use restrictions, at the direction

The owner of the Property which is the subject of this Notice shall cause the instrumentof any sale, lease, grant, or other transfer of any interest in the Property to include aprovision expressly requiring the lessee, grantee, or transferee to comply with this Notice.The failure to include such provision shall not affect the validity or applicability of anyland-use restriction identified in this Notice.

EASEMENT (RIGHT OF ENTRY)

The property owner grants and conveys to DEQ, its agents, contractors, and employees,and any person performing pollution remediation activities under the direction of DEQ, access atreasonable times and under reasonable security requirements to the Property to determine andmonitor compliance with the land-use restrictions set forth in this Notice. Such investigationsand actions are necessary by DEQ to ensure that use, occupancy, and activities of and at theProperty are consistent with the land-use restrictions and to ensure that the structural integrityand continued effectiveness of any engineering controls (if appropriate) described in the Noticeare maintained. Whenever possible, at least 48 hours advance notice will be given to the PropertyOwner prior to entry. Advance notice may not always be possible due to conditions such asresponse time to complaints and emergency situations.

REPRESENTATIONS AND WARRANTIES

The Property Owner hereby represents and warrants to the other signatories hereto:

i) that the Property Owner is the sole owner of the Property; or that the Property Owner hasprovided to DEQ the names of all other persons that own an interest in or hold anencumbrance on the Property and have notified such persons of the Property Owner’sintention to enter into this Notice;

ii) that the Property Owner has the power and authority to enter into this Notice, to grant therights and interests herein provided and to carry out all obligations hereunder; and

USE OF GROUNDWATER PROHIBITED BY STATE AND LOCAL REGULATIONS

Groundwater on this property contains contaminants that exceed unrestricted usestandards. Pursuant to 15A North Carolina Administrative Code 02C .0107(b)(1), “(t)he sourceof water for any water supply well shall not be from a water bearing zone or aquifer that iscontaminated.” Therefore, state law prohibits construction of a water supply well on thisproperty unless it can be demonstrated that the water pumped from the well is notcontaminated. That site has been certified intothe DSCA Program, and a remedial strategy to address the site contamination has beenprepared. A public comment period was held from ___ to ____, during which thecommunity had an opportunity to comment on the proposed remedial strategy. Anycomments received were addressed, and the proposed remedial strategy is now approvedas final.

You are receiving this letter because your property lies within an area where dry-cleaningsolvents have been detected in groundwater. An evaluation of the risks concluded that thecontamination poses no unacceptable risks for the current use of your property. Theapproved remedial strategy provides that a notice will be recorded in the chain of title foryour property indicating that groundwater is contaminated with dry-cleaning solvents andthat regulations in 15A North Carolina Administrative Code 02C.0107(b)(1) prohibitinstallation of a water supply well into an aquifer that is contaminated. If you have anexisting water supply well, it must be maintained in accordance with 15A North CarolinaAdministrative Code 02C.0112 whereby it will not be a source or channel ofcontamination to the water supply or aquifer.

The proposed Notice of Dry Cleaning Solvent Remediation applicable to your property isattached hereto as Attachment A. You have the option of recording the Notice yourself,however, if you elect not to, the DSCA Program will record the Notice in the chain oftitle for your property. Should you elect to record the Notice yourself, we will send you

detailed instructions along with the final documents that will need to be presented at theRowan County Register of Deeds Office for recordation.

If you wish to appeal the decision to file the Notice, you are entitled to a hearing. Yourrequest for a hearing must be in form of a written petition, complying with the requirementsof Chapter 150B of the General Statutes of North Carolina. The petition must be filed withthe Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714.The petition must be received and filed by the Office of Administrative Hearings within sixty(60) days of receipt of this letter.

In addition to filing the original written petition with the Office of Administrative Hearings, acopy of this petition must be served on this office as follows:
