UNIVERSITYATHLETICSCOMMITTEETheDepartmentofAthleticshasadirectrelationshipwiththeUniversityAthleticsCommittee.Comprisedoffaculty,staffandstudents,thecommitteeservesasastandingcommitteetotheNDSUFacultySenate.ThiscommitteealsoservesastheNDSUAthleticsAdvisoryBoardasdescribedintheconstitutionoftheNationalCollegiateAthleticAssociation.TheCommitteemembersareselectedbytherespectivecollege,andincludetheFacultyAthleticRepresentative,SeniorAssociateDirectorofAthletics/SWA,vicepresidentofthestudentbodyandamemberoftheStudent-AthleteAdvisoryCouncil.STUDENT-ATHLETEADVISORYCOUNCIL(SAAC)TheStudent-AthleteAdvisoryCouncilisaveryactivegroup,meetingtwiceamonthduringtheacademicyear.Asyourrepresentatives,theyserveasleadersbylisteningtoyourconcernsandsharingthemwiththeathleticsadministrators.Thecounciliscomprisedoftwomembersfromeachteam.ProjectsincludedevelopmentofStudent-Athletepolicies,extendedrelationshipswithstudent-government,andinvolvementineducationalprogramming.Manypositivevolunteeropportunitiesareinitiatedandimplementedbyallstudent-athletessuchastheblooddrive,holidayvisitstoareahospitalsandcommunityservicestonameafew.

ACADEMICSSuccessintheclassroomisacentralfocusforNDSUstudent-athletes.Thestaff,coachesandadministratorssharethesamecommitmentanddedicationtoacademicexcellence.Yourmaingoalistoearnacollegedegreeasitcreatesalifefilledwithopportunity.Ifyoumaintaingoodstudyhabitsandworkhardinclasses,youwillearnyourdegree.NDSUandtheNCAAhaveestablishedseveralacademicguidelinesandregulations:GuidelinesforAcademicSuccessUnderstandthatearningadegreethroughachallengingacademicexperienceisyourprimarygoal.Meetallacademicresponsibilities,includingtheresponsibilitiesofclassattendanceandthecompletionofallassignmentsinatimelymanner.Strivetobeinvolvedasafull-fledgedmemberoftheUniversitycommunityandmakeastrongefforttoderiveasmuchaspossibleoutofallofthemanyopportunitiespresentedatNDSU.

UtilizetheacademicsupportservicesavailablethroughtheAcademicCollegiateEnhancement(ACE)programandseekacademichelpwhenitisneeded.Understandthatyourpersonalcommitmentisattheheartofyouracademicsuccess.ClassAttendanceTobesuccessfulacademicallyyoumustattendallclasses.Student-athletesarerequiredtoattendalloftheirclassesregardlessoftheinstructor’sattendancepolicy.Athleticsexpectsyoutobeinclasswiththeexceptionofillness,familyemergenciesandofficialteamtravel.MissedClassPolicyAsfoundintheNDSUPolicyManual,SECTION333,CLASSATTENDANCEPOLICYANDPROCEDURE,pleasebefullyawareofyourresponsibilitytoadheringtothemissedclasspolicyasstatedbelow.SOURCE:NDSUFacultySenatePolicy1.GENERALPHILOSOPHYAttendanceinclassesisexpected.Onlythecourseinstructorcanexcuseastudentfromcourseresponsibilities.(Thetermcourseincludesclass,laboratory,fieldtrips,groupexercisesorotheractivities.)Ifclassattendanceisacomponentofthecoursegrade,thecourseinstructormustclearlycommunicatethistotheclassinwritinginthesyllabus.

Thecourseinstructormustclearlyinformstudentsonthefirstdayofclassandinwritinginthesyllabus(1)oftheirpolicyregardingclassabsence(includingifsupportingdocumentationisrequired;and(2)policyformakingupmissedassignments.Itisrecognizedthatsometimesanassignmentisimpossibletomake-up.Thecourseinstructormustexerciseafairandconsistentstandardforresolvingquestionsofmissedassignments,thetype,extent,mannerandtimeframeofthemake-upassignments.Studentsareresponsibleforinformingcourseinstructorsofabsences.Ifabsencesareknown(e.g.,universitysanctionedactivity,suchasstudentgovernment,judging,clubs,athleticcompetition,fineartsperformances),courseinstructorsshallbeinformedwithwrittennotificationasfarinadvanceaspossible(preferablyatwo-weeknotice).Whereadvancenotificationisnotpossible(e.g.,illness,familyemergency),studentsshouldcontacttheircourseinstructorassoonaspossibleabouttheabsence.Veteransandstudentservicememberswithspecialcircumstancesorwhoareactivated,toincludeStateActiveDuty,areencouragedtonotifytheinstructorassoonaspossible,provideActivationOrdersifpossible,andinformtheNDSUOfficeofMilitaryandVeteransServicestofacilitateasmoothexitfromandsuccessfulre-entrytotheUniversity.Whenastudentmissesclassforanyreason,thestudentisresponsibleforcontactingtheinstructortomakearrangementstofollowthecourseinstructor’spolicyinmakingupanymissedassignments,ifpermitted.

ResponsibilitiesoftheStudent-AthleteItisyourresponsibilitytoobtainandunderstandeachinstructor’spolicyregardingattendance.Youcanbedeletedfromtheclassrosterorfailaclassbecauseofalackofattendance,andyourinstructordoesnothavetonotifyyouofthis.Directcommunicationwitheachofyourinstructorsisveryimportant.Ifyouknowthatyouwillmissclasstimebecauseofcompetition,discussitwithyourinstructorsduringthefirstweekofclasssothatyouknowwhereyoustandaheadoftime.Itisyourresponsibilityduringthefirstweekofclasstofindoutthepolicyonmake-upworkineachofyourclasses.Donotwaituntilyouhavealreadymissedatestorassignmenttofindoutyourinstructor’spolicyonmake-upwork.Ifyouareunabletoattendclassbecauseofaconflictwithacompetition,itisyourresponsibilitytoinformtheinstructor.Priortoeachawaycompetition,yourcoachwillprovideyouwithanofficialletterforyoutopersonallypresenttoeachofyourinstructors.Thisletteridentifiesthedateandtimeofdepartureandliststheofficialtravelroster.Pleasebecertainthattheinstructorisawarethatyourabsencefromclassisduetoathleticparticipation.Satisfyallacademicexpectationsoutlinedbytheinstructorforeachclassevenwiththeadditionaltimedemandsrelatedtopractice,competitionandteamtravel.EarnUniversityandNCAAsatisfactoryprogresseachsemestertowardsadegree.Prepareforandattendallscheduledtutoringappointments,advisingandotheracademicrelatedmeetings.

4. Suspension:OccurswhenboththesemesterandcumulativeGPAfallsbelowa2.00iftheprevioussemesterthestudentwasonprobationorcontinuedprobationorwasadmittedtotheinstitutionasaconditionalstudent.Thisisaninterventionbytheinstitutionforfailuretodemonstrateacademicimprovement.Suspensionisissuedfortheimmediatetwogradingperiodsfollowingthesuspendedterm.Suspensiondoesappearontheofficialtranscript.

5. SuspensionAppeal:Ifsuspended,astudentmayappealwithextenuatingdocumentedcircumstances.SuspensionappealsarenotedontheofficialacademicrecordafterthespecifictermasacontinuanceapprovedbyAcademicStandardswiththedateofapproval.StudentsmustmeetorexceedboththetermandcumGPAtocontinue;ifnot,thestudentisre-suspended.

SocialandCommunityResponsibilitiesStudent-athletesshallconductthemselvesasresponsiblemembersoftheuniversityandlocalcommunity.Student-athletesmustabidebythesportspecificteamrulesestablishedbuytheircoach;therules,regulationsandpoliciesoftheuniversityandalllocal,stateandfederallaws.InternetUsage/SocialNetworking/OnlineCommunitiesThepopularityofsocialnetworkingwebsites(e.g.,Facebook,Twitter,YouTube,Instagram,Snapchat)hasgrowntremendously.Thesewebsitescanserveasvaluablecommunicationtoolswhenusedappropriately.Theuseofsocialmedia,however,hasthepotentialtocauseproblemsforboththestudent-athleteandtheuniversityifusedinappropriately.

ImportantSuggestionsandRecommendationsRegardingSocialNetworkingSitesSomestudentsmistakenlybelievesocialnetworkingwebsiteshaveawallofprivacyandassumetheirprofilesareviewedonlybyaclosecircleoffriendsandfellowstudents.Tothecontrary,thecontentonmostofthesesitesisaccessiblebyanyoneinthegeneralpublicunlesssecurityandprivacyfeaturesareused.

Thepublicnatureofthesewebsiteshascreatedpersonalsafetyandpersonalwelfareconcerns.Forexample,student-athleteshavebeenstalkedorsexuallyharassedandassaultedasaresultoftheirFacebookprofiles.Agentsandgamblersalsohavecontactedstudent-athletesthroughsocialnetworkingsites.Fansofopposingteamshavetauntedstudent-athletesbasedoninformationobtainedfromsocialnetworkingsites.

Youalsoshouldbeawarethatpotentialemployersandgraduateschooladmissionofficersnowregularlyscreenapplicantsbyconducting“Google”searchesofanapplicant’snameandbyreviewingtheapplicant’ssocialnetworkingprofiles.Studentsarebeingpassedoverforinterviewsanddeniedadmissiontouniversitiesbasedonthecontentoftheirprofiles.

Youshouldbeverycarefulaboutwhatpersonalinformationyoushareontheinternet.Foryourownsecurity,protectionandwelfareandthatofyourteammatesandfriends,theAthleticsDepartmentstronglyrecommendsandadvisesyouto:• Keepphonenumbers,physicaladdresses,birthdates,currentwhereabouts,travelplansandotherpersonalinformation

strictlyconfidential.Thisinformationshouldnotbecontainedinyourpersonalonlineprofile.

• Limittheaccessofotherstoe-mailaddressesandscreencarefullythosewhomyoumayacceptas“friends”onasocialnetworkingsite.

• Usewhateversecurityandprivacyfeaturesareavailabletorestricttheabilityofothersviewonyoursiteortopostpictures,messagesandothercontentonyoursite.

• Ifanindividualcontactsyouviaasocialnetworkingsiteandthenatureofthecontactmakesyouconcernedforyoursafetyoruncomfortableinanyway,youshouldimmediatelycontactacoach,anAthleticsDepartmentadministratororthepolice.�

RulesRegardingSocialNetworkingSites�Participationinintercollegiateathleticscarrieswithitpersonalaccountability.Asaconditionofbeingastudent-athleteattheNDSU,student-athletesmustabidebythefollowingrulesrelatedtotheuseoftheinternetandsocialnetworkingsites:

Student-athletesmaynotpostonlineanypictures,informationorothercontentthatmightcauseembarrassmenttothemselves,fellowstudent-athletes,teams,coaches,theAthleticsDepartmentortheuniversity(examples:obsceneimagesorlanguage,picturesatpartieswithalcohol,referencestodrugsorsex).

Student-athletesmaynotpostanycontentonlinethatisunsportsmanlike,derogatory,demeaningorthreateningtowardanyotherindividualorentity(examples:derogatorycommentsregardinganotherinstitution;tauntingcommentsaimedatastudent-athlete,coachorteamatanotherinstitution).Nopostsshoulddepictorencourageunacceptableorillegalactivities(examples:hazing,sexualharassment/assault,gambling,discrimination,fighting,vandalism,academicdishonesty,underagedrinking,andillegaldruguse).

Student-athletesmaynotpostanycontentonlinethatwouldconstituteaconferenceorNCAArules(examples:commentingpubliclyaboutaprospectivestudent-athlete,providinginformationrelatedtosportswageringactivities;solicitingimpermissibleextrabenefits).

Student-athletesmaynotpostanyinformationthatissensitiveorpersonalinnatureorisproprietarytotheAthleticDepartmentortheuniversitythatisnotpublicinformation(examples:tentativeorfutureteamschedules,student-athleteinjuriesandeligibilitystatus,travelplans/itinerariesorinformation).

Student-athletesmaynotpostanypictures,audioorvideocontentoranyotherinformationthatisnotthestudent-athlete’spersonalpropertyorwouldviolatecopyrightlaws.Student-athletesmaynotusethelogosortrademarksoftheNDSUorotherentitieswithoutpermission,andstudent-athletesarepersonallyliableforanycopyrightviolationstheymaycommit.

Student-athletesarerequiredtoabidebyalllawsrelatedtotheuseoftheinternet(includingstateandfederalprivacylawssuchasFERPAandHIPAA),andstudent-athletesarepersonallyliableforanyviolationsofthoselaws.Student-athletesalsoarerequiredtofollowtheNDSUStudentCodeofConductandalluniversitycomputerusagerulesandregulations.

Anyinformationpostedcanbeheldagainstyouincriminalchargesand/orasevidenceofviolationsofcampuspolicies.

Student-athletesmustprovidetheircoacheswithaccesstotheirsocialnetworkingsitesifrequested.

Manyinstitutionshaveprohibitedstudent-athletesfromhavingSocialMediaorotherelectronicsocialsites.Severalfactors

playintothisdecisionincludingaccessbythosewhomayintentionallyorunintentionallyjeopardizethewell-beingofa

student-athlete.

Asapartofonlinesocialnetworking,itisimperativethatyouareawarethatthisinformationispublicandcanbeviewedby

anyone,includingmembersofthemedia,thegeneralpublicandBisonfansingeneral.Informationpostedasocialnetwork

siteshasthepotentialtoinfluencethepublicopinionoftheuniversity,theathleticsdepartmentandyouasanathlete.

CompetitorssearchforwaystogainadvantageovertheBison.Anyinformationpostedcanbeheldagainstyouincriminalchargesand/orasevidenceofviolationsofcampuspolicies.

AsadministratorsandcoachesatNDSUwetrustthatyouwillmakegooddecisionsandberesponsibleforyourpersonal

information.

ResponsibleComputerUsageTheNDSUcomputersystemisintendedforacademicuse.Whileyoumayusethesystemforpersonalreasons,youareexpectedtoabidebyallcampuspolicies,stateandfederallaws.

TransferPolicy/PermissiontoContactotherinstitutionsIfastudent-athletewishestospeakwithanotherinstitutionabouttransferringtothatinstitution,thestudent-athletemustrequestpermissiontocontactpriortospeakingwithanycoachatthesecondinstitution.Thestudent-athleteshouldfirstcommunicatetheirrequestwiththeirheadcoach.Thestudent-athletewillthenneedtoprovideawrittenrequesttoamemberofthecompliancestaff.Thecompliancestaffmemberwillverifywiththeheadcoachaboutprovidingpermissiontothestudent-athlete.Thecompliancestaffwillprovidewrittenpermission,viae-mail,totheinstitution(s)thestudent-athleteswishestocontact.Ablanket,permissiontocontactmemowillnotbeprovidedtothestudent-athlete.Permissiontocontactwillonlybeprovidedbythecomplianceoffice.Thestudent-athlete’srequestwillbegrantedordeniedwithinsevenbusinessdaysofreceiptofthewrittenrequest.Ifthecomplianceofficefailstorespondtothewrittenrequestwithinsevenbusinessdays,permissionshallbegrantedbydefaultandwrittenpermissionwillbeprovided.NCAABylaw13.1.1.3.1-HearingOpportunityIftheinstitutiondecidestodenyastudent-athlete'srequesttopermitanyotherinstitutiontocontactthestudent-athleteabouttransferring,theinstitutionshallinformthestudent-athleteinwritingthatheorshe,uponrequest,shallbeprovidedahearingconductedbyaninstitutionalentityorcommitteeoutsidetheathleticsdepartment(e.g.,theofficeofstudentaffairs;officeofthedeanofstudentlife;oracommitteecomposedofthefacultyathleticsrepresentative,student-athletesandnon-athleticsfaculty/staffmembers).Theinstitutionshallconductthehearingandprovidewrittenresultsofthehearingtothestudent-athletewithin15businessdaysofreceiptofthestudent-athleteswrittenrequestforahearing.Thestudent-athleteshallbeprovidedtheopportunitytoactivelyparticipate(e.g.,inperson,viatelephone)inthehearing.Iftheinstitutionfailstoconductthehearingorprovidethewrittenresultstothestudent-athletewithin15businessdays,permissiontocontactthestudent-athleteshallbegrantedbydefaultandtheinstitutionshallprovidewrittenpermissiontothestudent-athlete.

GENERALATHLETICSCHOLARSHIPPOLICIES• Student-athletesonathleticscholarshipareboundbythesamerequirementsforathleticeligibilityasathleteswhoarenot

onscholarship.

• Thetotalamountoffinancialaid(excludingbonafideloansandaidfromfamily)forathletesreceivingathleticgrantsandotheruniversitydesignatedfinancialaid(suchasacademicscholarshipsorgrants)maynotexceedthecostofattendance.However,anathletereceivingaPellGrantmayretainthegrantinadditiontothecostofattendance.AcademichonorawardsthatmeetNCAAcriteriaaresubjecttoconsiderationforretentionbythestudent-athlete.

• Inallcases,thestudent-athlete’sfinancialaidawardmaynotexceedthecostofattendanceatNDSU.

• Anathleticscholarshipisissuedforoneacademicyear.

• Student-athleteswhoareNCAAqualifiersfromhighschoolmayreceiveathleticaidduringtheirfirstyear.

• Ifastudent-athleteisinjuredduringofficialpractice,competitionoruniversitysponsoredtraveltoorfromcompetitionunderintercollegiateathleticsauspices,thatstudent’sathleticgrant,oraportionthereof,maybecontinueduntiltheathletereceiveshis/herbaccalaureatedegreeorthroughtheathlete’sfourthyearofenrollment,whichevercomesfirst.

• Theuniversity’sobligationtoprovidemedicalcareandfinancialaidforaninjuredathleteundertheabovepolicywillterminateimmediatelyifappropriateuniversitymedicalstaffcertifythataninjuredathletehasrecoveredsufficientlytopermitcompetitionandtheathletevoluntarilychoosesnottoparticipateinathletics.

• Anathleticgrantmaybewithdrawnduringtheperiodoftheawardifthestudentathlete:- Rendershimself/herselfineligibleforintercollegiatecompetition.- Voluntarilyquitstheteam.- Losesamateurstatusintheathlete’ssport.- Fraudulentlymisrepresentsanyinformationonanapplication,letterofintentorfinancialaidtender.- EngagesinmisconductthatbringsdisciplinaryorotherlegalactionsincludingconductpriortoenrollmentatNDSU.

• Aninstitutionmaycancelorreducefinancialaidofthestudent-athletewhoisfoundtohaveengagedinmisconductbythe

university’sregularstudentdisciplinaryauthority,evenifthelossinaidrequirementdoesnotapplytothestudentbodyingeneral.

• Acurrentlyenrolledstudent-athletemayhavetheirfinancialaidcancelledorreducedforacivilwrongdoing.

• AccordingtorecentchangesintheInternalRevenueCode,aportionofarecipient’sscholarshipmaybetaxable.Therecipientmayexcludeamountspaidfortuitionandfees.Generally,amountsreceivedforroomandboardbecomethetaxableamount.NDSUisnotrequiredtofurnishtherecipientstatementoftaxableamounts.Thestudentisresponsibleforreportingsuchamountsonhis/herindividualtaxreturns.

AppealsNDSUprovidesthefollowingappealsprocessforstudent-athleteswhowishtoappealadecisionregardingtheirathleticgrant-in-aid,adenialofatransferrequest,oranyothercircumstancethatwarrantsasanction,bytheheadcoachoranathleticadministrator.Toinitiatetheappeal,thestudent-athleteneedstosubmitawrittenrequestthatincludes:

• Thestudent’sname,studentID,yearinschool,andsport;

• Reasonfortheappeal(e.g.,denialoftransferrequest,teamsuspension);• Reasonsforbelievingthatthedecisionwasunfair,includingnamesofinstitutionalstaffmembers(e.g.,coach,athletic

administrator)withwhomthestudent-athletehaddiscussedtheconcern;

• ProvidecopiesofanyrelevantdocumentstotheUniversityStudent-AthleteAppealsCommittee(e.g.,letterregardingdecision,suspension).

Ifthestudentwishes,aprocessadvocatewillassistthestudentwiththepreparationoftheabovematerials.UponrequestbythestudenttheprocessadvocatewillbeassignedbythechairoftheUniversityAthleteAppealsCommitteeandwillberesponsibletocontacttheathlete.Thestudent-athletesubmitsthesematerialstothechairoftheUniversityStudent-AthleteAppealsCommitteewithin15workingdaysafterreceivingnotificationthatthedecisionhasbeenrenderedcontrarytotheexpectationofthestudent-athlete.Afterreceivingthisinformation,thechairofthecommitteenotifiestheappropriatecoachandtheathleticdirectoroftheappeal,providesthemacopyoftheinformation,schedulesahearingandnotifiesallofthepartiestotheappealofthetimeandplace.Thehearingwillusuallybeconductedbyconferencecall,butthestudent-athletemayrequestthehearingbeinperson.Duringthehearing,eachpartypresentsitsargumentstotheUniversityAthleteAppealsCommittee.Followingthehearing,theUniversityStudent-AthleteAppealsCommitteewilltakeoneoftwoactions:

1. Iftheappealscommitteefindsthatthedecisiontoupholdthedecisionregardingfinancialaid,todenythetransferrequestortosustainthedecisionforothercircumstances,isnotaviolationofNCAArules,regulationsorinstitutionalpoliciesandnoextenuatingcircumstancesarepresent,theappealisimmediatelydenied.

2. Iftheappealscommitteefindsthatthedecisiontoupholdthedecisionregardingfinancialaid,todenythetransferrequest

ortosustainthedecisionforothercircumstances,isaviolationofNCAArules,regulationsorinstitutionalpolicies,theappealisimmediatelyapproved.Thestudent-athletewillbeawardedfinancialaidagreeduponbytheappealscommittee,grantedpermissiontotransferorwillbereinstatedasamemberoftheirrespectiveteam.

Ineithercase,thechairoftheappealscommitteenotifiesthestudent-athleteofthedecisioninwritingassoonaspossiblebutnotlaterthanthree(3)weeksafterthehearing.Ifthestudent-athletewishestodiscusstheresultoftheappeal,ameetingwiththechairoradesignatedmemberoftheUniversityStudent-AthleteAppealsCommitteeisarranged.Thecommittee’sdecisionisfinalandthereisnoappealbeyondtheUniversityStudent-AthleteAppealsCommittee.CommitteeTheUniversityStudent-AthleteAppealsCommitteeconsistsoffourfacultyandstaffmembers.Eachmemberisappointedtoathree-yeartermbytheuniversityPresidentandmaybere-appointed.ThePresidentshalldesignatethechair.TheAssociateViceProvostforEnrollmentManagementservesasthechair.ThecurrentFacultyAthleticsRepresentativeisalsoastandingmemberofthecommittee.AMATEURISMStudent-athletesmustbeawareofandresponsibleforamateurismrulesasgovernedbytheNCAA.Astudent-athletewillnotbeeligibleforparticipationinanintercollegiatesportiftheindividual:

• Useshisorherathleticsskills(directlyorindirectly)forpayinanyforminthatsport;

• Acceptsapromiseofpayevenifsuchpayistobereceivedfollowingcompletionofintercollegiateathleticsparticipation(i.e.,giftcertificates,cash,savingsbonds);

• Signsacontractorcommitmentofanykindtoplayprofessionalathletics,regardlessofitslegalenforceabilityoranyconsiderationreceived;

• Receives,directlyorindirectly,asalary,reimbursementofexpensesoranyotherformoffinancialassistancefromaprofessionalsportsorganizationbaseduponathleticskillorparticipation,exceptaspermittedbyNCAArules;

• Competesonanyprofessionalathleticteam,evenifnopayorremunerationforexpensesisreceived.Atthebeginningofeachsportseason,student-athleteswillbegivenanopportunitytoreporttheacceptanceorpromiseofpay.Thereafter,theinstitutionshallfullyassistthestudent-athleteinreinstatingtheireligibility.Itisimperativestudent-athletesreportsigningofanyoutsidecontracttoplayoutsidecompetitionintheirsport.Forexample,athletesmayparticipateinapprovedsummerleagues,includinginternationalleagues,withadvancewrittenpermissionfromthedirectorsofathleticsordesignee.

AGENTSAstudent-athleteshallbeineligibleforparticipationinanintercollegiatesportifhe/shehaseveragreed(orallyorinwriting)tobe

representedbyanagentforthepurposeofmarketinghis/herathleticabilityorreputationinthatsport.Further,anagencycontractnotspecificallylimitedinwritingtoasportorparticularsportsshallbedeemedapplicabletoallsports,andtheindividualshallbeineligibletoparticipateinanysport.Eachstudent-athleteisencouragedtokeepindirectcontactwiththeirheadcoachandthedirectorofathleticsconcerningtheuseofanagent.

EQUIPMENTNDSUathleticequipmentorclothingmaybeusedonlyinpractice,duringworkouts,orincompetitionwhilerepresentingNDSUasamemberofateam.Useduringanyothertypeofcompetitionmayresultinlossofathleticeligibility,amongotherconsequences.Ifissuedathleticequipmentisnotreturned,awardsmaybewithhelduntiltheequipmentisreturnedorpaidfor(i.e.,rings,watches,jacketsetc.)• Theathleteisresponsibleforallequipmentissuedtohim/her.Itishis/herresponsibilitytoreturnallequipment(regardlessof

condition)totheequipmentroomonthedateestablishedbytheequipmentmanager.Allpracticeandcompetitiveequipmentmustbereturnedtotheequipmentroomimmediatelyfollowingthefinalcompetitiveeventoftheseason.Failuretoreturnequipmentcouldhavesevereconsequencessuchaschargesassessedtothestudent-athlete’saccount.

• Ifequipmentisnotreturned,equipmentpersonnelwillnotifytheappropriateathleticadministratorwhowillinformthestudent-athletetheamountduepayabletotheAthleticBusinessOfficeforcollection.

• Ifastudent-athlete,includingthosewhohaveexhaustedtheirathleticeligibility,failstoreturnhis/herathleticequipment,thecostofequipmentdoublesandaholdwillbeplacedontheirofficialuniversitytranscript.

• Anathletecannotelecttopurchasetheirequipmentoruniforminlieuofitsreturn.Theathletewillreimbursethedepartmentdoubleforanymissingequipment.

TICKETPOLICY• TheNCAApermitsamaximumoffourcomplimentaryadmissionsperhomecontesttoaneligiblestudent-athleteinthesport

MEDICALCAREYourphysicalwelfareisveryimportanttousatNorthDakotaStateUniversity.Everystudent-athletewillreceiveexcellentmedicalcare.Themedicalstaffwillcloselymonitorrecuperationandrecoveryafteraninjuryorillnesstoensureyouareatyourpeaklevelofphysicalhealthwhencompeting.Theathletictrainingstaffhopesyourcompetitiveexperienceisenrichingphysically,mentallyandsocially,andisdedicatedtohelpingyouachieveyourgoals.Withathleticparticipationcomestheinherentriskofinjury.We’reheretohelpinthefollowingways:• Reduceriskofinjurythroughphysicalscreening,conditioningprogramsandeducation.• Shouldaninjuryoccur,beavailableforconsultation,referraltotheteamphysician,anddevelopatreatmentandrehabilitation

programthatwillguideyoutofullrecovery.• Actasliaisonbetweenphysician,coach,parentsandathletesoeveryonehasfullunderstandingofthecapabilitiesor

limitationstheinjuryimposes.• Educatetheathletesothathe/sheunderstandshis/herinjury,responsibilitiesandfutureimplicationsforparticipation.

PhysicalExaminationsYouarerequiredtohaveaphysicalexamination.Allreturningstudent-athleteswillbegivenaphysicalwhentheyreturntoschool;transferstudentsandfreshmenmusthavetheirphysicalpriortoanyworkouts,includingsummerconditioning.TreatmentofIllnessandInjuriesAllillnessesorinjuries,includingcutsandabrasions,shouldbereportedimmediatelytotheathletictrainerofyoursport.Forinjuries,thefollowingstepsshouldbetaken:• Afterreportingtheinjurytotheathletictrainer,thestudent-athlete,incaseofanemergency,willbetakentoahospitalfor

evaluation.• Followingevaluation,thestudent-athletemaybereferredtotheathletictrainingroomfortreatment,ortothephysicianfor

additionalevaluation.• Thestudent-athleteisrequiredtoreporttothedesignatedathletictrainingroomfortreatment.• AfterdailyevaluationsoftheinjuryandapprovalbytheNorthDakotaStateUniversityteamphysicianorpersonalmedical

physician,andthereafterverifiedbyNDSU’steamphysician,andathletictrainer,thestudent-athletewillbeallowedtoreturntocompetition.

• Ifappointmentsforasecondopinionaremadeforfurthermedicaltreatmentortesting,itisimperativethestudent-athlete

keepsthatscheduledappointment.Further,withoutpriornotificationbythestudent-athletetotheDirectorofSportsMedicinetoseekasecondopinion,NDSUwillnotberesponsibleforanyrelatedexpenses.

PregnancyPolicy• Femalestudent-athletesareencouragedtonotifythesportsmedicinestaff,coachandteamathletictrainerimmediately

iftheythinktheymaybepregnant.Thestudent-athleteisencouragedtoseekassistancefromtheNDSUSportsMedicineDepartment,theirpersonalhealthcareproviderorotherexpertsinpregnancyandrelatedconditions.

• Thesportmedicinestaffwillcollectivelyworktoassurethestudent-athlete’swell-beingaswellasthestudent-athlete’s

positionasateammemberand/orherathleticscholarship.Womennotonscholarshipwillreceivethesamelevelofcare.• Evenifthestudent-athletechoosestoseekassistancefromtheNDSUSportsMedicineDepartment,thestudent-athleteisstill

stronglyencouragedtoseekoutsideprofessionalmedicalcare.

• Acertifiedathletictrainerwillassistinreferringthestudent-athletewhothinksshemaybepregnanttotheStudent-HealthService,ateamphysician,anobstetrician/gynecologist,ortothestudent-athlete’spersonalphysicianformedicalcare.

• Withapositivepregnancytest,thestudent-athletewillbegiveninformationabouttheavailabilityofprofessionalcounseling.• Intheeventthestudent-athleteelectstocontinuetoparticipateinintercollegiateathleticswhilepregnant,thefollowing

temporarymedicalcondition,similartoanytemporarydisability,whichmayresultinthestudent-athlete’sinabilitytoparticipateinathletics.

• Thestudent-athleteshallbeinformedthatherpositionasateammemberandherathleticscholarship,ifapplicable,isnotinjeopardyforthecurrentacademicyearaslongasthestudent-athletedoesnotvoluntarilywithdrawfromhersport,andthatNDSUseeksaone-yearextensionoftheNCAAfive-yeareligibilityrule.

• Areductionorcancellationofscholarshipisnotpermittedduringthetermoftheawardforthereasonofpregnancy.

• Ifthestudent-athletevoluntarilyterminatesherpositionasamemberoftheteamonapermanentbasis,herathleticscholarshipwillcontinueonlyuntiltheendofthecurrentsemester.

• Renewalandnon-renewalofathleticfinancialaidforapregnantorpostpartumstudent-athletewillbedeterminedbytheheadcoachandtheDirectorofAthletics.NCAAregulationsregardingrenewalandnonrenewalofathleticfinancialaidwillbeapplied.

• Itispossiblethatapregnancywillhaveanimpactonacademicadvancementandeligibility;therefore,itisofvitalimportancethestudent-athleteconsultwithherAcademicAdvisor,theAssociateDirectorofLearningServices/AthleticAcademicsandtheDirectorforComplianceregardingindividualcircumstances.

• Allcostsandexpensesofthepregnancyaretheresponsibilityofthestudent-athleteandwillnotbecoveredbytheDepartmentofAthletics.

Amalestudent-athletewhosepartnerbecomespregnantoftenlooksforsupportfromothersaswell.Althoughmalesdonotexperiencethephysicalchangesassociatedwithpregnancytheyneverthelessmayendureemotionalstress.Ifyouareamaleandneeddirection,support,orguidancepleaseknowthatmanyprofessionalsareavailabletoassistyou.Afirststepwouldbe,foryoutovisitwithyourheadcoach,athletictrainerorathleticdirector.MentalHealthPolicyInstitutionalfinancialaidbasedinanydegreeonathleticsabilitymaynotbereducedorcancelledbecauseofaninjury,illness,orphysicalormentalconditionthatpreventstherecipientfromparticipatinginathletics(exceptaspermittedpursuanttoNCAABylaw15.3.4.3).NDSUAthleticTrainingEquipmentCheckOutPolicy

Ifyou,asastudent-athlete,receiveaninjuryrequiringutilizationofanyequipment(i.e.crutches,braces)theywillbecheckedouttoyouuntilthemedicalstaffindicatesitisnolongermedicallynecessary.Failuretoreturntheitem(s)willresultinthestudent-athlete’spersonalaccountbeingchargedforthevalueofthemodality.Iftheathletehasgraduated,theathlete’stranscriptwillbehelduntilreceiptofpayment.

STUDENT-ATHLETEINSURANCEPOLICYParticipationinintercollegiateathleticscarrieswithitaninherentriskofinjuries.Athletesassumecertainrisksinthatanathletemaysufferinjuriesinconnectionwithintercollegiateactivities.Whensuchinjuriesoccur,NDSUcannotassumeindefiniteresponsibilityforcontinuingmedicalcarethatmightbesubsequentlyrequired.Subjecttothelimitationsstatedhereinafter,however,NDSUdoesacceptcertainobligations.UniversityObligationsWhenastudent-athleteisinjuredduringtheofficialNCAAplayingandpracticeseason,atasanctionedcompetitionoruniversitysponsoredtraveltoorfromcompetitionunderNDSU’sathleticdepartmentauthority,theuniversitywillprovidethefollowingassistancetotheinjuredstudent.Forpurposesofthispolicy,universitysanctionedathleticactivityincludesallpracticesonuniversityorsharedcommunityfacilitiesauthorizedbyacoach,andanyeventstowhichanathletetravelswithuniversitysupportorfinancialassistance.

• Allstudent-athletesmusthaveprimarymedicalinsurancecoverage.NorthDakotaStateUniversityathleticscarriesasupplementalpolicythatrequiresallmedicalchargestobefiledwithaprimaryinsurancecompanypriortoconsiderationofacceptablecharges.Therefore,allexpensesmustbefiledwiththestudent-athlete’sprimaryinsurancefirst.

• AsamemberinstitutionoftheNCAA,catastrophicinjurycoverageisdictatedbythepolicyprovidedbytheNCAA.

• Approvedeligiblemedicalcostsassociatedwiththeinjurymustbesubmittedtothestudent-athlete’spersonalinsurancepolicy.TheuniversitywillcoverdeductiblecostsorremainingbalancesperNDSU’smedicalathleticpolicy.

• NDSUreservesthefirstrighttoobtainmedicalopinionsabouttheinjuryfromtheNDSUmedicalstaffforthenecessityandreasonablenessofanyparticulartreatmentofaninjury.

• Ifthestudent-athleteseeksasecondopinionfromaphysicianotherthananNDSUteamphysician,andthesecondopinionconfirmstheopinionofanNDSUteamphysician,thenNDSUwillonlyprovidefinancialassistanceforchargesassociatedwiththeservicesperformedbyanNDSUteamphysician.

LimitationsTheforegoingissubjecttothefollowinglimitations:

• Anyathletewithapre-existinginjuryorwhohasadiagnosedillnesspriortoparticipationinNDSUathleticsmustnotifyinwritingtotheNDSUmedicalstaffpriortoparticipationinNDSUathletics.Anymedicalcostassociatedwiththepre-existinginjuryorillnessisnottheresponsibilityoftheNDSUathleticdepartment,unless,afterdisclosureandapprovaltoparticipateinathletics,aninjuryorillnessisaggravatedduetosuchparticipation.

• Amedicalphysician,includingtheathlete’spersonalphysicianand/oraNDSUteamphysician,mustcertifythatan

injuredathletehasrecoveredsufficientlytoreasonablypermittheathletetoparticipate.Furthermore,inallcases,NDSUreservestherighttorelyontheopinionofaphysicianofitschoosingshouldtherebeadifferenceofopinion.

• AlltreatmentofinjuriesmustbeauthorizedoradministeredbytheNDSUmedicalstaff.Anyoutsidetreatmentobtained

byaninjuredathletewithoutNDSUauthorizationwillnotbethefinancialresponsibilityoftheNDSUathleticdepartment.

• NorthDakotaStateUniversitywillassumeeligiblemedicalexpensesincurreduptothreemonthspastthecurrentacademic

year,providedtheinjuryoccurredpriortothelastdateoftheacademicyear,asstatedintheNDSUStudent-AthleteHandbookfoundonlineatwww.gobison.com.Thisappliestoastudent-athletewhohasexhaustedeligibilityandislistedonthatyear’sofficialUniversityintercollegiateteamroster.Thisstatementisnotintendedtoautomaticallygrantcoverageofthemedicalcostsastheathleticdepartmentreservestherighttodetermineifthesituationwarrantscoverage.

• Theabovestatement(#4)isnullandvoidifthestudent-athletevoluntarilywithdrawsfromtheteam.• AnyathleteinjuredineventsorcompetitionnotconductedorsanctionedbytheuniversityisnoteligibleforNDSU

AcademicPerformanceAwardsGreen&GoldGalaAcademicAwards:Attheendofeachspringsemesterthosestudent-athleteswhohaveexcelledintheclassroommayqualifyforanaward.Criterionisbasedonstudent-athlete’sGPAand/ornumberoftimesthestudent-athletemadetheDean’slistinthatacademicyear.Green&GoldGalaAthleticsAwards:Variousawardsgiventoselectedstudent-athletesforathleticperformance.InadditiontotheaboveNDSUsponsoredawards,therearenumerousconferenceandnationalacademicawardsthatyoumayqualifyfor.

PUBLICSERVICE/FUNDRAISINGBisonstudent-athletesareprominentandpopularoncampusandinthecommunity.Becauseoftheattentiontheyreceive,manylocalandregionalbusinesseswanttobeaffiliatedwithNDSU’sstudent-athletes.YoumustcheckwiththeDirectorofCompliancebeforeestablishinganyagreementwithanindividualorrepresentativefromanycompanyoroutsideorganization.Inalmostallcases,theNCAAandNDSUwillstrictlyprohibitinvolvement.Ifyouareapproachedbyabusinesstoadvertiseorpromoteacommercialproduct,itisyourresponsibilitytoreportthistoyourheadcoachimmediately.ItisaviolationofNCAAregulationsforanystudent-athletetoendorseanycommercialproduct.Astudent-athleteispermittedattimestoworkforanon-profit,charitableoreducationalorganization(forexample,iftheBigBrother-BigSisterorganizationasksyouspeaktotheirgroup).However,thefollowingmustbemet:

• Permission:Toparticipate,thestudent-athletemustreceivewrittenpermissionfromtheappropriateathleticadministrator.

• Involvement:Thespecificactivityorprojectinwhichthestudent-athleteparticipatesmustnotinvolvecommercialendorsement.

• ClassConflicts:Thestudent-athletemustnotmissanyclassesasaresultoftheactivity.

• PaymentforService:Allmoniesderivedfromtheactivityorprojectmustgodirectlytothememberinstitutionorthecharitableoreducationalagency.Thestudent-athletemayacceptnormalandlegitimateexpenses.

PolicyRegardingExternalFunds:Allrequestsforexternalfundsbyeitherindividualstudent-athletesorteamsmustreceivepriorapprovalfromtheDirectorofAthletics.Student-athleteswhohavejustcompletedtheireligibility,butremainonathleticsscholarship,alsoarerequiredtoinformtheDirectorofComplianceoftheirrequests.

IntroductionBeingamemberofaNorthDakotaStateUniversityathleticteamisaprivilege,notaright,andisonethatbearsresponsibilities.Theobligationsofastudent-athleteextendbeyondtheathleticsarenaandclassroom.AsamemberofanyNorthDakotaStateUniversityathleticteamyouareresponsibleforunderstandingalloftheresponsibilitiesincludedintheStudent-AthleteCodeofConduct.Inaddition,itisthestudent-athlete’sresponsibilitytoknowandunderstandallsanctionsthatmightbeimposedbytheUniversityforviolationsoftheRightsandResponsibilitiesofCommunity:ACodeofStudent

Conduct.Student-athletes,likeotherstudents,aremembersofseveralcommunitiesincludingtheUniversitycommunity,theresidencehallcommunity,andlocal,stateandnationalcommunities.Eachofthesecommunitiesexpectsitsmemberstoexhibitrespectfulandlawfulbehavior.

TheathleticsprogramisahighlyvisiblecomponentoftheUniversity,andassuch,student-athleteshavethepotentialtobecomehighlyvisiblemembersofthepublic.Asaresultofthatreality,andinconjunctionwithyourresponsibilitiesasamemberofboththestudentpopulationandthestudent-athletepopulation,itiscriticalthatyou,thestudent-athlete,remaincognizantatalltimesofyourroleinabidingbytheappropriaterulesoftheUniversity,theNCAA,theSummitLeague,theMissouriValleyFootballConference,theBigXIIConferenceandtheNorthDakotaStateUniversityAthleticDepartment.

AnyallegedviolationoftheStudent-AthleteCodeofConductthatisreportedtotheDirectorofAthleticsortheAthleticDepartmentwillrequireaninvestigationintotheallegedviolation.Ameetingwillbeconvenedassoonaspossible,withtheDirectorofAthletics(ordesignee),involvedparty(ies),coachandsportsupervisorand/oranyotherrelativeparties.Baseduponthismeeting,theDirectorofAthleticsmayimpose,inareasonabletime,sanctions,separatefromorinadditiontoUniversityimposedsanctionsforinfractionsoftheRightsandResponsibilitiesofCommunity:ACodeofStudentConduct.

Thesesanctionsmayinclude,butarenotlimitedto,immediateandindefinitesuspensionfromcompetitionandpractice.TheAthleticDepartmentreservestherighttosuspendanindividual(s)fromcompetitionorpracticeinsituationswheretheallegedviolationisdeemedtobeseriousin nature.

SuchactionsmaybetakenuponnoticetotheAthleticDepartmentofanyallegedviolationoftheRightsandResponsibilitiesofCommunity:ACodeofStudentConductortheStudent-AthleteCodeofConduct.ThismayresultintheAthleticDepartmentimposingsanction(s)whenanoutsideagency(universitydisciplinarybodies,courtoflaw,etc.)hasnottakenanyaction,hasnotmadeafinaldeterminationorafterafinaldetermination.Additionally,becauseofvaryingroles/relationships/responsibilitiesstudentsmayhavewithinandoutsideoftheUniversity,astudentmaybeheldaccountableforprohibitedconductunderotheruniversity,local,stateorfederalpolicies/laws/jurisdictions,whichincludesstudent-athletesundertheStudent-AthleteCodeofConduct.

ActionsunderthiscodeareeducationalasareotheractionstakenunderNDSUpolicies.BecausetheUniversity'sproceduresareeducationalandnotcriminalinnature,suchseparateproceedingsdonotconstitutedoublejeopardy.TheUniversitymayproceedunderthiscodebefore,duringorafterotherNDSUadministrativeprocesses,orlegalproceedings,anddoesnottypicallywaitforacourtfinding.Findingsunderthiscodemaydifferfromjudgmentsincriminalcourts .

UniversityPolicyonParentalNotificationInthecaseofseriousviolationsoffederal,stateorlocallaw,includingalcoholandotherdrugviolations,orwheninstancesofmedical/psychologicalemergencieshavecometotheUniversity'sattention,theUniversitymaynotifyparentsincaseswherewebelievethestudentmightbenefit.

ParentalNotificationPolicyParentsorguardiansofstudentsunder21yearsofagemaybecontactedbyanNDSUathleticsadministratorfollowingalcoholand/orotherdrugrelatedincidents:

• IfastudentisfoundresponsibleforviolatingtheUniversity'salcohol/drugpolicythatresultsinaUniversityreferralforassessmentsorevaluationsforchemicaldependency,and/orwhenUniversitysanctionsofBehavioralProbationorgreaterare assigned.

• Basedonsituationsthatappeartoendangerthehealth,safety,orlifeofotherpersonsorthestudent.

• Ifanindividualisinvolvedinincidentsthatresultedinsignificantpropertydamage.

• Ifadecisionismadethatitisinthebestinterestofaparticularstudenttoinvolveaparentorguardiantohelpaddressothersignificantlifeconcernsrelatedtoillegaluseofalcoholorother drugs.

RulesViolationPolicyNorthDakotaStateUniversityiscommittedtooperatingitsathleticsprogramsinamannerconsistentwiththeletterandthespiritofNCAA,theSummitLeague,theMissouriValleyFootballConference,theBigXIIConference,andUniversityrulesandregulations.Towardthatend,ourcomplianceprogramcombinesthetrainingandeducationofcoaches,staffandstudents;thereviewandmodificationofathleticsdepartmentandUniversityoperatingprocedurestoensurecompliancewiththoserules;andpromptinstitutionalresponsewhenruleviolationsdooccur.

Ourgoalsaretoeducatecoaches,staff,studentsandfansintheirresponsibilitiesundertherules,todevelopoperatingsystemswithintheAthleticDepartmentandtheUniversitythatguidestaffandstudentsintheireffortstoworkwithintherules,andtorespondtoeachruleviolationsothatwecancorrectthesituationthatledtotheproblem.

Weaffirmthatstaffmembersandstudent-athletesoftheNorthDakotaStateUniversityAthleticDepartmenthaveanobligationtoreportanyviolationsorpotentialviolationsofNCAA,theSummitLeague,theMissouriValleyFootballConference,andtheBigXIIConference,rulesofwhichtheyare aware.

RulesofSportsmanshipEachstudent-athleteisexpectedtoexhibitgoodsportsmanshipconductatalltimesasarepresentativeoftheteam,department,universityandcommunity.Thefollowingconstitutespoorsportsmanshipandwillnotbeaccepted:

• Physicalorverbalabusetowardofficials,opponents,spectators,coachesorthemedia.

• Chantsorstatements,whicharediscriminatoryinnature.• Throwingobjectsatorontotheplayingsurfaceoratspectators.• Useofincitingortauntinggesturesdesignedtoelicitnegativereactionsfromopposingplayers,coaches,spectators

orofficials.• Fightingwithopponents.

• Negativepublicstatementsdemeaningateam-member,coach,opponentoranotherinstitution.

Gambling PolicyStudent-athletesareexpectedtoabidebytheNCAArule(Bylaw10.3),whichprohibitsstudent-athletesfrom knowingly:

• Providinginformationtoindividualsinvolvedinorganizedgamblingactivitiesconcerningintercollegiateathleticscompetition;

• Solicitingabetonanyintercollegiateteam;

• Acceptingabetonanyteamrepresentingtheinstitution;

• Solicitingoracceptingabetonanyintercollegiatecompetitionforanyitem(e.g.,cash,shirt,dinner)thathastangiblevalue;or

Followingnotificationofasecondaryoffensecommittedbyanystudent-athlete,theDirectorofAthletics(designee)willconvenetheappropriateparties,includingbutnotlimitedtothestudent-athlete,headcoach,andsportsupervisortoinvestigateanddiscusstheknowncircumstancesrelatedtotheviolation.Ifappropriate,arepresentativeoftheUniversity'sOfficeofStudentAffairsshouldalsobeinvolvedinsuchdiscussionsorusedasaresource.Followingtheinvestigation,theDirectorofAthletics(designee)willimplementandmonitortheappropriatesanctionsasdeterminedforthestudent-athlete(s)whocommittedthesecondaryoffense.Itisimportanttonotethattheathleticadministrationreservestherighttosuspendastudent-athletefromparticipationonanintercollegiateteamwhileanycriminalchargeisbeing investigated.CategoryII:Major Offenses:AmajoroffenseisanyviolationofNorthDakotastatecriminallaw,federallaworlawsofanotherjurisdictionthatisclassifiedasafelony;twoormoresecondaryoffenseswhileastudent-athleteisenrolledatNorthDakotaStateUniversity;or,aviolationoftheNorthDakotaStateUniversityRightsandResponsibilitiesofCommunity:ACodeofStudentConductthatcouldresultinanexpulsionorsuspensionfromthe university.Thesanctionsforamajoroffensearethatthestudent-athleteshallbeimmediatelyprohibitedfromparticipationinpractice,competitionandanyservicesprovidedbytheathleticdepartmentandfromanyathleticrelatedbenefits;and/or,theDirectorofAthleticsmayrevokeormodifyanyathleticrelatedfinancialaidtothestudent-athlete. Followingtheimmediatesuspension,theDirectorofAthletics(designee)willconvenetheappropriateparties,includingbutnotlimitedtothestudent-athlete,headcoach,andsportsupervisortoinvestigateanddiscusstheknowncircumstancesrelatedtotheviolation.Ifappropriate,arepresentativeoftheUniversity'sOfficeofStudentAffairsshouldalsobeinvolvedinalldiscussions.Followingtheinvestigation,theDirectorofAthleticsandtheappropriaterepresentativeoftheUniversity'sOfficeofStudentAffairswilldeterminethelength(definiteorindefinite)ofthe suspension.TheAthleticDepartmentwillfollow/supportanydisciplinarydecisionsasmadebytheOfficeofStudentAffairs.Asmajoroffensesareofthemostseriousnature,itisimperativethattheUniversityandtheathleticscommunityarebothconsideredwhendeterminingtheappropriatesanctions.

STUDENT-ATHLETECODEOFCONDUCTAPPEALSPOLICYAnyStudent-Athletewhoisfoundresponsibleforanyviolationofthestudent-athletecodeofconductwillbegiventheopportunitytoappealthatfindingand/orimposedsanctions.Inordertoformallyappealanysuchdecisions,theaffectedstudent-athletemustfollowtheprescribedappealprocess.Onceastudent-athleteisnotifiedofaviolationorofthesanctiontobeimposedforaviolation,theaffectedstudent-athletewillhave72hoursoncehe/shereceiveswrittennotificationinordertosubmitanappeal.TheappealmustbeinwritingtotheDirectorofAthletics(designee)andmustsetforthindetailthereason(s)fortheappeal.Allsuspensionsareimmediateandcounselingrequirementswillremainineffectduringthisperiodofappeal.Thestudent-athletewillbegrantedahearingoftheappealsboardwithin72hoursoffilingtheappeal.Theappealsboardwillconsistof:theFacultyAthleticRepresentative(FAR)asthechair,onemaleandonefemaleathletefromSAACwithjuniororseniorstatusbutnotinthesamesportastheinvolvedathlete,onememberofthecoachingstaffbutnotinthesamesportoftheinvolvedathlete,andasportsupervisorwithdirectoversightforthesportinwhichtheinvolvedathleteparticipates.TheSeniorAssociateDirectorofAthletics/SWA/Compliancewillserveasexofficiomemberoftheappealsboardandwillberesponsiblefororganizingandmonitoringtheprocess.Pleasenote:Thisprocessisseparatefromthestudentconductactionappealsprocess.PleaserefertotheNDSURightsandResponsibilities:ACodeofStudentConductforinformationregardingthestudentconductprocessthatappliestoallNDSUstudents.AppealDecisionsAppealsmaybedecidedinoneofthefollowingmanners:
