Dear Contract Policy and Compliance Professional:

We would like to invite you to an educational opportunity not only of historical proportion but also one that will have a great impact on the work that we do. The American Contract Compliance Association (ACCA) will conduct its annual National Training Institute (NTI) August 14th-19th, 2012 in Philadelphia, PA. The NTI will be hosted by ACCA's northeast regional chapter, the North Central Contract Compliance Association (NCCCA).

Featured this year will be a televised Legislative/Policy Forum in memory of Dr. Arthur A. Fletcher and U.S. Rep. Parren J. Mitchell on Thursday, August 16th. The forum, which will be moderated by ACCA co-founder Kerry L. Kirkland, is designed to rekindle the spirit, passion, energy and commitment of these two champions for economic empowerment and to initiate a serious contract compliance and M/WBE policy discussion.

Panel members, with U.S. Rep. Chaka Fattah, Philadelphia, PA delivering the 'Set the Tone' address, will be asked to identify and closely examine action strategies designed to strengthen these programs. Forum topics will include: a historical and updated review of critical court decisions (Croson, Adarand and Western States, etc.) and their impact on M/WBE Programs on a national, state and local level; a national contract compliance strategy for leveling the playing field of business opportunity; a legislative strategy for M/WBE inclusion on future federal bailout packages; best practices, size standards; net worth requirements; prompt payment policy/enforcement; solicitation requirements; non-discrimination statutes and M/WBE certification. Panel members include some of the top contract compliance and minority business experts in the nation: Anthony Robinson, Esq., president, MBELDEF; Sarah Von Der Lippe, Esq., constitutional law expert; Dr. Thomas 'Danny' Boston, economic professor, Georgia Tech; Franklin Lee, Esq., Tydings and Rosenberg; Harry Alford, president, National Black Chamber of Commerce; Stephen Denlinger, Latin American Management Association (LAMA) and Zenita Wickham Hurley, Esq., director MDOT's Office of Minority Business Enterprise.

Keynote and Luncheon Speakers

Senator Vincent J. Hughes has been member of the Pennsylvania Senate representing the 7th Senatorial District since November 1994. Prior to joining the Senate, Senator Hughes served as a member of the Pennsylvania House of Representatives from 1987 to 1994. While a member of the Pennsylvania House, Senator Hughes chaired the Pennsylvania Legislative Black Caucus from 1991 to 1994. In November 2010, Senator Hughes was elected Democratic Chairman of the Senate Appropriations Committee. Prior to attaining his present leadership position, Senator Hughes served as Chairman of the Senate Democratic Caucus, the third highest ranking position, from 2008 to 2010.Over the years, Senator Hughes has worked on numerous issues, from political empowerment to creating jobs, expanding health insurance to the uninsured and rebuilding of neighborhoods. Senator Hughes, the dean of the Senate Philadelphia delegation, has been a champion on issues that impact directly on PA’s working communities. He helped spearhead efforts to raise the minimum wage and continues to fight to establish a statewide jobs program. Senator Vincent Hughes is supported by his loving wife, actress, entertainer and activist Sheryl Lee Ralph, and their blended family of four children.

Councilman Curtis Jones, Jr. serves as the council representative of the 4th District in Philadelphia, PA. Councilman Jones was appointed as chairman for the Transportation & Public Utilities Committee in City Council, and vice chairman for the Committee on Parks, Recreation & Cultural Affairs. A noted expert on community-based economic development, Councilman Jones has served in various public and private sector positions for more than two decades. Councilman Jones has served on numerous boards and executive committees including the Pennsylvania Convention Center Authority’s Minority Advisory Committee, Genesis II Board of Directors, and the Philadelphia Convention and Visitors Bureau Minority Advisory Council. Councilman Jones has also served as co-chair of the Philadelphia MED Week Committee. Councilman Jones has lectured extensively on economics and community development. Councilman Jones has appeared on various television and radio programs and previously hosted “Handling Your Business,” a weekly television and radio show which aired throughout the region.

Featuring a Historical Policy/Legislative ForumPanel Moderator:Kerry L. Kirkland is the President/CEO of Kirkland Consulting, a management and training consulting firm that specializes in contract compliance/minority business enterprise policy and program development. The company offers turnkey programmatic implementation and a suite of training modules including diversity, sexual harassment and professional and personal development. He is the co-founder of the American Contract Compliance Association, the largest contract compliance training organization in the world. Mr. Kirkland formerly served as the Mid Atlantic Regional administrator, United States Small Business

Association (SBA); vice president, National Black Chamber of Commerce; and executive director, Pennsylvania Democratic Party. Mr. Kirkland served with a four-member delegation from the United States to South Africa that facilitated equity management workshops and provided technical assistance to the new government of Nelson Mandela. He led a historic trade mission to South Africa where he assisted African-American owned businesses establish trade opportunities.

Opening Speaker: Pending Confirmation U.S. Rep. Chaka Fattah is a senior member of the House Appropriations Committee. This committee is responsible for setting spending priorities of over $1 trillion in annual discretionary funds. Rep. Fattah is ranking member on the subcommittee on Commerce, Justice, Science and related agencies, which oversees more than $50 billion in discretionary spending. Rep. Fattah also sits on the Energy and Water Development subcommittee. He is chair of the Congressional Urban Caucus, a bipartisan group of 57 members representing America’s metropolitan centers. These members work collaboratively with other stakeholders to address

the unique challenges facing America’s urban communities. Rep. Fattah is completing his 16th year in the U.S. House of Representatives. Before his election to Congress Rep. Fattah served six years in the Pennsylvania House of Representatives, followed by six years as a state senator. Rep. Fattah earned a master’s degree in governmental administration from the University of Pennsylvania, Fels Center of Government.

Panel Members:Harry Alford is the National Black Chamber of Commerce (NBCC) president, CEO and co-founder and, in less than a decade, has established himself as perhaps the nation’s preeminent champion of African-American business empowerment. From a visionary concept of what Blacks need to do to fully seize their place in the economic mainstream, Mr. Alford has built a global organization that has earned a place at the table in the White House and at the top levels of corporate America. Mr. Alford has been responsible for opening doors that have led to billions of dollars in new business for Black-owned businesses throughout the nation. In

the public sector, Mr. Alford was the minority business development point person in Indiana Gov. Evan Bayh’s administration. In less than two years, minority business participation at the state level increased by more than 500 percent. Mr. Alford writes weekly business columns for the National Newspaper Publishers Association’s members across the country and consults and speaks on this matter to groups and agencies throughout the nation. Mr. Alford is regularly called upon by Congress to testify on various legislative initiatives related to small business development, e-commerce, health care, social security reform, tax reform and global trade issues.

Panel Members Continued: Dr. Thomas “Danny” Boston is a professor of economics in the School of Economics at Georgia Tech. He is also CEO of EuQuant, an economic consulting and research company. A native of Jacksonville, Florida, he received his Bachelor of Science degree from West Virginia State University and his master’s and Ph.D. degrees in economics from Cornell University. Graduating as a commissioned officer from WVSU, he attained the rank of captain in the U.S. Army and was awarded the Purple Heart. He is a consultant to the Congressional Black Caucus Foundation and assists U.S. Congresspersons and committees that have oversight

over the nation’s minority and small business programs. Dr. Boston’s research, entitled “Increasing the Capacity of the Nation’s Small Disadvantaged Businesses,” was commissioned by the Congressional Black Caucus Foundation, and it contributed to the development of new regulatory guidelines for the U.S. Department of Transportation’s Disadvantaged Business Enterprise Program. He is a member of the Small and Midsize Business Advisory Council of the Atlanta Federal Reserve Bank, and the Black Enterprise Magazine Board of Economists.

Stephen Denlinger has worked as a procurement advocate for the small business, minority business, and Hispanic business communities for the past 35 years. He has been president of the Latin American Management Association (LAMA), procurement advocate to the United States Hispanic Chamber of Commerce (USHCC), and president of the National Association of Small Business Federal Contractors (NASBFC), where he works part-time so he can continue his work with LAMA and USHCC. NASBFC is the national advocate for all small businesses, not just minority businesses. NASBFC focuses on retaining federal contracts that have been

small business set-asides in the past, and on full implementation of the Rule-of-Two, which requires contracting officers to set aside for small business any requirement wherein two or more small businesses are available to compete for the requirement. Mr. Denlinger works to improve the Small Business Administration’s 8(a) program and various socio-economic procurement programs, and to safeguard and improve federal small business set-aside programs.

Zenita Wickham Hurley is director of the Maryland Office of Minority Business Enterprise. Under Ms. Hurley’s direction, the Office of MBE has made many strides toward improving service to the MBE community and has implemented a host of innovative changes designed to improve services extended to MBEs and DBEs. Ms. Hurley is a graduate of the New York University School of Law and graduated magna cum laude from the University of Maryland at College Park with a Bachelor of Arts Degree in Government and Politics and Afro-American Studies. While an undergraduate, Ms. Hurley wrote her thesis entitled “In Defense of Maryland’s Affirmative

Action Program: Examining How a Small Elite Dominated Contracts Awarded by the State Roads Commission in the Baltimore Metropolitan District, 1955-1970.” Ms. Hurley served as an assistant Attorney General assigned to the Maryland Department of Transportation where she provided legal advice to the Office of MBE on issues concerning the MBE and DBE programs, contract monitoring, and compliance with federal and constitutional standards for affirmative action in public contracting. Ms. Hurley was an attorney in the Child Advocacy Unit of the Legal Aid Bureau in Baltimore. She was also an associate with the law firm of Steptoe and Johnson LLP in Washington, D.C.

Panel Members Continued: Franklin M. Lee is one of the country’s leading authorities on socio-economic policies that promote the mainstream utilization of small, minority-, and woman-owned businesses in government contracting. Mr. Lee has served in numerous capacities to promote the advancement of MBEs. Recently, he was invited to participate in a MBE Roundtable of business leaders, academia, and government officials convened by Maryland Congressman Elijah Cummings to develop policy recommendations and strategies for reforming Maryland’s MBE Program to facilitate the growth and expansion of MBEs into the mainstream of Maryland’s economy. Also, Maryland

Governor Martin O’Malley has appointed Mr. Lee to serve as a member of the Maryland Task Force on Minority Business Enterprise and Equity Investment Capital. He has also served on the “Bridging the Gap” Advisory Panel of the Greater Baltimore Committee, which awarded him the “Bridging the Gap President’s Award” in 2008 for his dedication to promoting the advancement of minority-owned business in central Maryland. He was the only attorney selected to serve on Maryland Governor Robert L. Ehrlich Jr.’s Task Force on MBE Reform in 2003. In May 2006, at the conclusion of the Task Force’s work, Governor Ehrlich signed into law groundbreaking MBE legislation crafted largely by Mr. Lee.

Anthony Robinson, Esq. is a civil rights attorney and president of the Washington, D.C. based Minority Business Enterprise Legal Defense and Education Fund (MBELDEF). Mr. Robinson has been a small business crusader, a national advocate and legal representative for minority entrepreneurs. Throughout his career, he has championed cases designed to terminate discrimination in the marketplace and prevent large companies from ignoring the set-aside rights of minority firms. The MBELDEF is a national, nonprofit, public interest law firm founded in 1980 by former U.S. Rep. Parren J.Mitchell. The cases MBELDEF pursues are intended to

achieve equity and fairness for minority businesses in the U.S. marketplace. In 1984, Mr. Robinson his private practice to become the first full-time president and chief executive officer of MBELDEF. His work and dedication to this unique agency has earned him a Parren Mitchell Vanguard for Justice Award. After earning his Bachelor of Science from Morgan State, Mr. Robinson earned a law degree from Washington College of Law at American University. He was legal counsel for the United States Equal Employment Opportunity Commission from 1972 to 1975 and an attorney for Singleton, Dashiell and Robinson, a law firm he co-founded.

Sarah von der Lippe Esq. is a founding member and senior fellow of the Jamestown Project. Ms. von der Lippe is the founder of a sole proprietor law practice targeted to providing legal representation and consulting in the fields of civil rights and affirmative action. Ms. von der Lippe’s clients have included the U.S. Department of Transportation, the Federal Aviation Administration, the Leadership Conference on Civil Rights, and the Urban Institute. Ms. von der Lippe was also the Director of Justice Policy for the John Kerry for President Campaign. Ms. von der Lippe has also addressed poverty issues for Senator Edward M. Kennedy as staff to

the U.S. Senate Committee on Labor and Human Resources. In addition, Ms. von der Lippe has worked for the Rockefeller Foundation, the NAACP Legal Defense and Educational Fund, and Kids Project. Ms. von der Lippe has a Bachelor of Arts from Stanford University, and a law degree from Harvard University.

Level 1EO-1: Equal Opportunity Laws & Regulations (1.5 Hrs)Croson and Adarand- Explanation of these cases how they impact contract compliance. Course is design to explain these premier equal rights cases and the direct impact that have on contract compliance programs; the pros and cons of the decisions; and whether they help or hinder equal opportunity programs. In addition, Equal Opportunity laws such as Title VI and Title VII are examined.

SBD-1: Supplier Diversity and Contract Compliance (1.5 Hrs) A discussion on Supplier diversity as the proactive business process of sourcing products and services from previously under-used suppliers and traditional Contract Compliance programs; the differences between the two and determining which program is most useful for your organization. Best practices and getting the most out of both programs will also be discussed.

CO-1: Examining M/WBE/DBE/HUB Program (1.5 Hrs) This course will provide an overview of M/W/DBE/HUB programs, obstacles and challenges. Best practices will be presented regarding the administration and implementation of programs, goal setting, monitoring and reporting compliance. This session will include a discussion of certification.

BUSM-1: Business Ethics (2.0 Hrs) Business ethics includes practitioners and contractor/vendor relationships; an overview and discussion of business ethics; workplace behavior; crossing the line and potential consequences. Case studies will guide the discussion.

Level 2EO-2: Section 3 and Today’s Economy (1.5 Hrs) Basic overview of HUD’s Section 3 followed by an in depth look and focus on the intent of the policy, whether the policy is effective, and what obstacles it creates for contractors and practitioners. Participants will gain a thorough knowledge of the Section 3 policy; when and how it should be used; and discuss the effectiveness of the policy in today’s economy, including a discussion on the “Wal-Mart Loophole”.

SBD-2: Prevailing Wage (1.5 Hrs) Workshop attendees will receive an understanding of the Federal Davis-Bacon Act and Related Amendments pertaining to federally funded projects. Prevailing wage regulations are an important element in ensuring that public construction projects do not destabilize the local construction industry in leveraging public works investments for supporting local economies and local governments

CO-2: Understanding Project Labor Agreements (PLAs), Local Hire Programs & Community Benefits Agreement (1.5Hrs) This course provides an overview of Project Labor Agreements, local hire programs, and community Benefits Agreements and their potential impact on projects, employment and wages.

BUSM-2: High Performing Contract & Compliance Management “Enhancing Contract & Compliance Programs with Automated systems and Executive Support” (1.5Hrs) Participants will learn how S/M/DBE programs will benefit their organization; and identify how the Contract Compliance and Certification policies and processes are relevant to their organizations’ successful implementation of economic development strategies. The presenter will describe how effective compliance and reporting may justify program enhancements and generate enterprise value. Moreover, participants will be able to build a business case for their organization to support the acquisition of an automated Contract and Compliance Management system.

Level 3EO-3: CSI-Compliance Systems Investigation: Prevention and enforcement of M/W/DBE Fraud and other Workforce Related Issues ( 2.0 Hrs) The course will focus on how we monitor programs; what is being done to prevent fraud, best practices will be examined to show practitioners what should be done using case examples. Course includes investigation techniques and discusses enforcement policies.

SBD-3: Bonding (2.0 Hrs) This course will begin with an overview of different types of bonds and insurance, who qualifies for bonding with a discussion of the pros and cons of bonding and insurance requirements. Will include a discussion on how bonding may limit small business participation and how to increase access to bonding to capitalize on contracting opportunities.

CO-3: Evaluating Workforce Utilization (2.0 Hrs) This workshop will provide an overview of workforce utilization requirements for contractors and sub-contractors on government projects and will include a discussion of compliance, monitoring and reporting requirements. Best practices will be examined for policy enforcement, union vs. non-union and other workplace and market factors.

BUSM-3: Business Development: Philadelphia International Airport (2.0Hrs) This session provides key concepts and strategies focusing on increased capacity building of small businesses. Bonding support, joint venturing, and prompt pay will be discussed.

Level 4EO-4: Equal Opportunity- Bridge to Leadership (2.0 Hrs) This workshop examines the use of equal opportunity laws in the work place. What practitioners can do to lead the charge in ensuring that equal opportunity laws such as age, gender and racial discrimination as well as sexual harassment are eradicated in the workforce. A discussion on best practices used by agencies supporting and complying with these laws and why some may choose not to and the methods used to get around fully implementing equal opportunity laws.

SBD-4: Phillies: A Story in Capacity Building (3.5 Hrs)A look at the building of the $458 million dollar ballpark built between 2002 and 2004 in south Philadelphia. Course includes the successful efforts to include MBE/WBE participation, supplier diversity and vendors in the ball park and project monitoring by MCA graduates Carlos Jones and Michelle Gumbs of the Urban Affairs Coalition in Philadelphia.

CO-4: Managing DBE Programs in a Design Build Environment (2.0 Hrs)Participants will understand the different project delivery methods such as design build, DBOM, DBOOM, Public Private partnership, OMGC, turnkey, etc. versus the traditional design bid build environment. Participants will gain a greater knowledge of why the DBE program must be administered differently when non-traditional project delivery methods are utilized. They will review key regulations that must be implemented and the associated issues and challenges.

BUSM-4: Federal Initiatives (2.0 Hrs) This panel discussion will include an overview of recent initiatives implemented by various federal agencies including Minority PTAC Pilot, State Trade Export Initiative, State Small Business Credit Initiative, Teaming/Joint Venturing Program and Federal Highway Program updates and new initiatives.

GeneralLEGAL UPDATE on Affirmative Action Programs (2.5 Hrs) Update on legal issues impacting affirmative action programs. Learn about recent cases, legislative changes and trends in federal and state courts related to M/W/DBE program.
