Tender Notice No. NICSI/HIRING TAXI/2015/20 NICSI invites bids from eligible bidders which are valid for a minimum period of 90 days
from the date of opening or NICSI/NICSI Projects/NIC for Empanelment of
Agency for Providing Taxi Service on Hire Basis.
Scope of Work Contractor shall provide Taxies (AC/Non-AC) with yellow number plates and not older
than 01.01.2013 models of the following categories:-
a. ECONOMY CARS
i.e. Tata Indica, Indica Vista, Ambassador, Maruti Suzuki Zen,
Ritz, WagonR, , Etios Liva, Santro, EECO etc. or equivalent
model
b. (i) MEDIUM CARS
i.e. Ford Ikon, Fiesta, Indigo D’zire, Tata Manza, Accent/ Xcent,
Honda City etc. or equivalent model
(ii) MEDIUM LUXURY CARS
i.e SX4, HONDA CITY etc. or equivalent model
c. LUXURY CARS i.e. Honda Accord, Toyota Corolla, Lancer, Cruze etc or
equivalent model.
d. SPACIOUS CARS i.e. Scorpio, Innova, Tavera, Sumo Grant, M. Xylo, Ertiga etc. or
equivalent model
e. SUPER LUXURY CARS
i.e. Mercedez, Camery, etc. or equivalent model) as per NICSI
requirement.
The cars shall be provided at our office premises or at any other place intimated to
the Contractor for travel within & outside NCR area as and when required.
The agency shall press into service only good quality taxies with good interior,
noiseless drive and in perfect running condition as per NICSI requirement. The car
shall always be provided with decent upholstery, clean seat covers, and other basic
fittings / accessories for maximum comfort of passengers.

The contractor shall provide well-behaved drivers in proper uniform with valid
driving license. The drivers provided must have at least two year’s experience of
driving commercial vehicles. The driver should also have some knowledge of car
mechanism so that he could attend to minor repairs and should be well conversant
with roads and routes in Delhi, Gurgaon and other NCR areas. The reporting time,
place, address etc. is to be strictly followed by the Drivers. This shall be ensured by
the Contractor.
The vehicles should comply strictly with the provisions of pollution control in line
with the decisions of Courts of India from time to time and should also comply
with statutory regulations issued by State Transport Authorities/Central Govt. etc.
Consequences of failure to comply with any of the rules and regulations of the
concerned authorities shall be the sole responsibility of the Agency.

1. INTRODUCTION
National Informatics Centre Services Incorporated (NICSI), set up in 1995 as a Section 25 company, is a corporate extension of National Informatics Centre (NIC), Department of Information Technology, Government of India. This tender is for the empanelment of agencies for Hiring of Private Taxi Service for various projects of NICSI. The empanelment shall be for an initial period of two
years, which can be extended by six month. To meet the demand of cars for NICSI/NICSI Projects/NIC, more than one Delhi NCR based agencies/contractor will be empanelled.
1.1 General Terms
Parties :- The parties to the Contract are the contractor (the tenderer to whom the
work has been awarded) through NICSI.
Addresses :- For all purposes of the contract including arbitration there under, the address of the contractor mentioned in the tender shall be final unless the contractor notifies a change of address by a separate letter sent by registered post with acknowledgement due to the NICSI. The contractor shall be solely responsible for the consequences of any omission or error to notify change of address in the aforesaid manner.
Earnest Money :- Earnest Money of Rs.2,00,000/- (Rupees Two Lakhs Only) in the form of Bank Guarantee/demand draft of any nationalized bank must be deposited by bidders along with their duly filled up tenders documents.
Agencies/Contractor: - Organization or individual that contracts with another organization or individual (the owner) for providing the facility/services under terms specified.
2. TERMS & CONDITIONS AND INSTRUCTION TO BIDDERS 2.1 Instructions
Bidders are advised to study the bid document carefully. Submission of the bid
shall be deemed to have been done after careful study and examination of all
instructions, eligibility, forms, terms and requirement specifications in the
tender document with full understanding of its implications. Bids not
complying with all the given clauses in this tender document are liable to be
rejected. Failure to furnish all information required in the tender Document or
submission of a bid not substantially responsive to the tender document in
every respect will be at the bidder’s risk and may result in the rejection of the
bid. The total annual estimated cost of hiring will be about Rs. 2.00 Cr. This is

only estimation. The actual amount shall depend upon actual use of hired
vehicles on requirement basis.
2.2 Details of requirements
NICSI is desirous of hiring taxies of different ‘make’ from time to time under the following broad categories. Categories under which taxies may be required:
2.2.1 Category ‘1’: Hiring of DEDICATED Taxies for requirement within DELHI & NCR on monthly basis
Under this category, certain number of DEDICATED taxies would be hired with chauffeurs on monthly basis. The entire maintenance and running cost (like repairs, fuel cost, etc.) will be borne by the Taxi operator, and he would be paid on kilometer basis, subject to minimum of 2000 km per month. The meter reading for payment will start and end from the place where the taxi has been asked to report for duty and returned from duty respectively. However the To and fro dead mileage up to a maximum of only 10 Km per day will be allowed. Usually the services of the vehicle would be required on Monday to Saturday, but it may be required on all the seven days in a week and also on national holidays. Such vehicles, along with chauffeurs would remain at the disposal of NICSI for use on any working day with a provision for at-least one weekly off (normally Sunday will be weekly off). However, the chauffeurs would be required to do the duty for the entire day, which may range from 10 to 12 hours, and NICSI will not be obliged to pay any additional payment on account of such duty hours. Approximate number of taxies likely to be required under this category is 10 to 20. However, NICSI would be free to reduce / increase this number from month to month basis keeping in view its actual need.
2.2.2. Category ‘2’: Hiring of Taxi for requirement within DELHI &
NCR for FULL DAY/HALF DAY on regular basis
Under this category, certain number of taxies would be hired, with chauffeurs, on daily basis, normally for working days, for FULL DAY / HALF DAY for the regular needs of NICSI. The detention period of taxies hired under this category would range for a minimum 5 hours to maximum 12 hours. Payments would be made on per km. basis. Minimum kilometer to be charged under this category would be 80 km. per day. The meter reading for payment will start and end from the place where the taxi has been asked to report for duty and returned from duty respectively. . However the To and fro dead mileage up to a maximum of only 10 Km per day will be allowed.

2.2.3. Category ‘3’: Hiring of Taxi for requirement outside DLHI & NCR
Under this category, taxies would be hired for travel to places ‘OUTSIDE Delhi & NCR’. This may involve stay outside Delhi & NCR ranging from 1 to 7 days. The minimum period for taxi hired under this category may range from 12 hrs. to 14 hrs. and payments would be made on per km. basis. Minimum km. to be charged under this category (average for the entire trip) would be 200 km. per day. Any extra detention beyond 5 hrs (on the last day of the trip) would be treated as a day. The meter reading for payment will start and end from the place where the taxi has been asked to report for duty and returned from duty respectively. . However the To and fro dead mileage up to a maximum of only 10 Km per day will be allowed.
2.3 Eligibility Criteria
a. The bidder should be a well established taxi agency / firm having a fleet of latest models of taxi/cars (at least 20 cars of registration 2013 or of later years) in the bidder’s own name without any legal encumbrances as per details in Annexure – A.
b. The bidder should have experience of at least five years for providing such
services, out of which the bidder should have experience of at least 2 years for providing the service in Govt. /PSU department.
c. The bidder shouldn’t have been blacklisted by any central/state government
agency in the past three years. (Attach self certificate) d. The bidder should have at least four offices/tie-ups preferably in different
regions like North, East, West & South in NCR with a functional landline telephone for round the clock booking of the requirements.
e. The bidder should be registered with the service tax department and
carrying a valid Service Tax registration number. f. The bidder must be carrying a PAN number in the name of agency/firm. g. The bidder must submit attested copies of Articles of Association (in case of
registered firm), Bye laws and certificates for registration (in case of registered co-operative Societies), Partnership deed (in case of partnership firm), and attorney in case of sole proprietor.
h. The agencies to which the bidder is providing taxi services should have the
annual turnover of above Rs. 2 Crores.

i. The bidder should submit Income Tax Return certificate for the last 3 Financial years, i.e. 2014-15, 2013-14, 2012-13. (Certified copy of IT Return is required)
j. The bidder must be providing taxi services to atleast 5 different agencies at present and submit the work order copy along with documents.
k. The bidder must attach a copy of registration certificate from EPFO and ESIC for the driver employed.
The bidders shall submit documents in support of the above eligibility criteria failing which their bids shall not be considered.
2.4 Earnest Money Deposit (EMD)
The bidder should deposit Earnest Money Deposit (EMD) of Rs. 5,00,000/- (Five
Lakhs only) refundable and tender fee of Rs. 500/- (Five Hundred only) non-refundable in the form of separate Demand Draft payable to National informatics
Centre Services Inc., New Delhi. The bid without EMD and tender fee shall be rejected and no correspondence will be entertained on this subject. Firms/suppliers, who are registered for relevant domain/ services with NSIC under Single Point Registration Scheme, shall be considered for exemption from furnishing the tender fees and EMD by the Competent Authority. In such cases, an attested copy of the VALID Registration Certificate from NSIC must be furnished at the time of submission of the bids. Mere registration as a SSI Unit does not qualify the Firm for exemption from furnishing the EMD. In the absence of a valid certificate from the NSIC or proper Bank Draft of EMD amount, such tenders shall be rejected straightway. No request for transfer of any previous deposit of earnest money or security deposit or payment of any previous bill in respect of any previous work will be entertained.
2.5 Bid submission
a. Bids are to be submitted as per the Annexure-C: Bid Submission.
1. Tender bid must contain the name, office and addresses including telephone
number(s) of the person(s) who are authorized to submit the bid with their
signatures.
2. NICSI will NOT be responsible for any delay on the part of the vendor in
obtaining the terms and conditions of the tender notice or submission of the tender
bids.

3. Any alteration / overwriting / cutting in the bid should be duly countersigned
else it will be rejected. Conditional tenders shall NOT be accepted on any ground
and shall be rejected straightway.
4. No deviation from the tender specifications & terms and conditions will be
accepted.
b. The offer submitted by telex/Fax/ Email or ant manner other than specified above shall not be considered. No correspondence will be entertained on this manner.
c. Signing of Bid: Individual signing the bid or other documents connected with contract must specify whether he signs as :
1. A “sole proprietor” of the concern or constituted attorney of such sole
proprietor.
2. A partner of the firm, if it be a partnership firm, in which case he must
have authority to execute contracts on behalf of the firm and to refer to
arbitration disputes concerning the business of the partnership either by
virtue of the partnership agreement or by a power of attorney duly executed
by the partners of the firm.
3. Director or principal office duly authorized by the Board or Directors of the
Company, if it is a Company
4. In case of partnership firms, a copy of the partnership agreement, or general
power of attorney duly attested by a Notary Public, should be furnished on
stamped paper duly sworn of affirmed by all the partners admitting execution
of the partnership agreement or the general power of attorney. The attested
copy of the certificate of registration of firm should also be enclosed along
with the eligibility bid.
5. In the case of partnership firms, where no authority to refer disputes
concerning the business of partnership firm has been conferred on any parties
the tender and all other related documents must be signed by all partners of
the firm.
6. A person signing the bid form or any documents forming part of the bid on
behalf of another person should have an authority to bid such other person
and if, on enquiry it appears that the persons so signing had no authority to do
so, NICSI may, without prejudice cancel the contract and hold the signatory
liable for all costs, consequences and damages under the civil and criminal
remedies available.

7. The bidder should sign and affix his/his firm’s stamp at each page of the bid
and all its Annexure.
d. At any time prior to the last date for receipt of bids, NICSI, may, for any reason,
whether at its own initiative or in response to a clarification requested by a prospective bidder or as per the decisions taken in the pre-bid meeting, modify the Tender Document by an amendment. The amendment will be notified on NICSI website http://nicsi.nic.in & https://eproc-nicsi.nic.in/nicgep/app will be binding on the prospective bidders. In order to afford prospective bidders reasonable time in which to take the amendment into account in preparing their bids, NICSI may, at its discretion, extend the last date for the receipt of Bids. No bid may be modified subsequent to the last date for receipt of bids. No bid may be withdrawn in the interval between the last date for receipt of bids and the expiry of the bid validity period specified by the Bidder in the Bid. Withdrawal of a bid during this interval shall result in forfeiture of Bidder’s EMD.
e. The Bidder shall bear all costs associated with the preparation and submission of its bid. NICSI will, in no case, be responsible or liable for those costs, regardless of the outcome of the tendering process.
f. The vendor has to quote rates for all the categories 1, 2 & 3 as mentioned in ANNEXURE-B of the Financial Bid.
2.6 Last date for receipt of bids
a. The bid complete in all respects and as per the format prescribed in this tender
document must reach the DM (Tender) , National Informatics Centre Services
Inc., New Delhi – 110066, complete in all respect latest by as per schedule
mentioned in Annexure-D : Time Schedule No tender will be accepted beyond
above mentioned date & time.
b. The tender bids will be opened in the presence of representatives of Bidders on
as per schedule mentioned in Annexure-D: Time Schedule at NICSI, New
Delhi.
c. Bids must be received by NICSI at the address specified above not later than the
date and time given as per schedule mentioned in Annexure-D: Time Schedule.
In the event of the specified date for the receipt of Bids being declared a holiday
for the NICSI, the Bids will be received up-to the appointed time on the next
working day. Any bid received by NICSI after the last date and time for receipt
of bids prescribed by NICSI, pursuant to above Clause, will be declared late and
will not be accepted and returned unopened to the bidder.

All the Bids must be valid for a period of 90 days from the date of tender
opening for placing the initial order. However, the prices should be valid for
the period of initial empanelment of two years and extended six months (if
tender will be extended for 6 months after 2 years).
2.8 Evaluation and Comparison of Bids
a. EN-01 & Packet-I (EMD & Tender Fees) will be opened first on the
specified date and time as per schedule mentioned in Annexure-D: Time
Schedule in the presence of bidder’s representatives (one from each bidder).
EN-02 and Packet-II of only those bidders whose EMD and tender fee are in
order shall be opened in the same session. Bids not accompanying with the
prescribed EMD and tender fee shall be returned to their representatives or
posted back to them.
b. The contents of EN-02 & Packet-II (Bidder’s Eligibility) shall be passed on to
a duly constituted Technical Evaluation Committee (TEC) for evaluation.
The TEC would scrutinize the bids with respect to the eligibility conditions
specified in the tender document, may call for additional information from
the bidders or may visit the bidders’ offices for verification. Additional
information if called for must be submitted in the time period given by the
TEC failing which the bid shall be rejected.
c. Packet-III (Financial Bid) shall be opened only for the technically accepted
bidders on a date and time duly notified and in the presence of the bidders’
representatives. The rates quoted by various bidders shall be read out in
this session if so desired by the representatives. The financial bids shall be
evaluated by a duly constituted Financial Evaluation Committee (FEC).
d. LQ1 is the bidder quoting maximum. numbers of least rates in Table 1 &
Table 2 against Column 3,4,5 & 6 in the financial bid. However, LQ1 bidder
has to match the lowest rates for other items in Table-1, Table-2, Table -3
& Table -4 quoted by other responsive bidders. For such matching, zero
rates or incredibly low rates quoted by other bidders wouldn’t be
considered. EMD of bidders quoting zero or incredibly low rates would be
forfeited. If LQ1 refuses to match the lowest rates of other items in Table-1,
Table-2, Table-3 & Table-4, its EMD would be forfeited and tender scrapped.
e. NICSI shall have a panel of 2 (Two) bidders. For this LQ2 (bidder offering
the second max. no. of lowest (L1) quote in Table 1 & 2 against Column 3,
4,5 & 6 will be asked to match the rates of LQ1. If agreed, LQ2 bidder will
also be placed on the panel along with LQ1. If LQ2 does not agree,

opportunity will be given to LQ3 bidder and so on. If none of the other
bidders agree to match LQ1 rates then LQ1 alone shall be on the panel.
f. Any attempt by any bidder to bring pressure of any kind, may disqualify the
bidder for the present tender and the bidder may be liable to be debarred for
three years from bidding for future NICSI tenders besides forfeiting the
EMD.
g. NICSI reserves the right to accept any bid, and to cancel/abort the Tender
process and reject all bids at any time prior to award of Contract, without
thereby incurring any liability to the affected Bidder or Bidders, of any
obligation to inform the affected Bidder or Bidders of the grounds for
NICSI’s action and without assigning any reasons.
h. The decision of NICSI arrived at as above will be final and no representation
of any kind will be entertained on the above. Any attempt by any bidder to
bring pressure of any kind, may disqualify the bidder for the present tender
and the bidder may be liable to be debarred from bidding for NICSI tenders
in future for a period of at least three years.
i. When deemed necessary, NICSI may seek clarifications on any aspect from
the Bidder However, that would not entitle the Bidder to change or cause
any change in the substance of the tender submitted or price quoted. Also it
will not imply that bidder’s bid has been selected for processing.
j. NICSI may waive any minor informality or non-conformity or irregularity
in a bid, provided such waiver does not prejudice or affect the relative
ranking of any Bidder.
k. The Percentage of the Fuel Component in rates and the Percentage of Driver
Wages component in rates of the L-1 bidder will be the final empanelled
percentage factors. The LQ2 will be asked to match these percentage
component factors along with the lowest rates.
2.9 Award of Contract
a. In the case of the Bidders whose tenders are not considered, the Earnest
Money Deposit will be refunded without any interest after the tender
finalization. In the case of bidders whose tenders are accepted, bidders
should give Security Deposit of Rs. 6,00,000/- (Rupees Six Lakhs only) in
the form of Bank Guarantee (BG) from a scheduled bank, drawn in the name
of National Informatics Centre Services Inc., New Delhi valid for the period

of empanelment/extended empanelment. Earnest Money Deposit will be
refunded without any interest on receipt of Security Deposit from the
bidder. The security deposit of the empanelled bidder(s) shall be forfeited in
case of any default i.e unsatisfactory service or any established reasons of
breach of contract finalized on the basis of this tender. No interest will be
payable for the Security Deposit. The empanelment or any part of it is non-
transferable.
b. The finally short listed bidder LQ1 & LQ2 shall sign an empanelment with
NICSI within one week of such communication from NICSI failing which
their EMD shall be forfeited and tender will be scrapped. The LQ1 bidder
shall also be debarred from quoting for future tenders of NICSI for a period
of five years.
c. NICSI may at any time terminate the Contract by giving written notice to
the Empanelled Bidder(s), without any compensation, if the Bidder becomes
bankrupt or otherwise insolvent, provided that such termination will not
prejudice or affect any right of action or remedy which has accrued or will
accrue thereafter to NICSI.
d. If the Empanelled Bidder(s) are not able to fulfill their obligations as per the
empanelment, NICSI reserves the right to accomplish the work through
another bidder at the cost and risk of the defaulting bidder.
2.10 Payment terms
a. Payments, subject to Tax Deduction at Source (TDS) shall be processed
within one month of the submission of the complete documents.
b. Duly signed bills in triplicate shall be submitted along with the daily log
book/duty slips of Taxi Permit car’s usage signed by the officer who used
the vehicle in prescribed format provided by NICSI.
c. The To and fro dead mileage up to a maximum of only 20 Km per day will
be allowed.
d. State entry taxes, Parking charges & toll tax will also be paid extra on
production of proof.
e. If any of the condition of Km or Hr is met i.e. either Km completed or hour
time completed, the full payment will be made in that category.

f. A copy of RC of vehicle used and proof of minimum wages paid, as per
wages of skilled labour under minimum wages act, to the driver concerned
have to be attached along with bills.
g. If the vehicle registration is before 2013, then 50% amount will be deducted
from the payment.
h. Vehicle required before 5:00 AM and detained beyond 11:00PM will be paid
night charge as mentioned in each category.
2.11 Reporting of Taxi Permit Cars and Penalties
a. The empanelled bidder(s) have to provide Taxi Permit Cars on telephonic
intimation from the authorized officers of NICSI. The cars can be requisitioned
at any time of the day and night throughout the validity of the empanelment.
The cars should be provided at the desired location within 30 minutes of
telephonic/written intimation. In case the car is not made available at the
appointed time and desired location, NICSI will make alternate arrangement
at the cost and risk of the defaulting bidder and the double charges as actual
expenditure will be deducted from pending bills or by invoking the Security
Deposit or by raising claims.
b. The log book/duty slips shall be countersigned by NICSI Officer using the
vehicle on the same day/ immediately after availing service. It will be the
responsibility of the Driver to get the log book/ duty slip filled up and signed
by the Officer using the car on completion of the journey. Any overwriting,
cutting or erasing of entries on log book/ duty slip will not be admitted until
signed by the NICSI Officer.
c. NICSI stands indemnified of the consequences arising out of any accident or
mishap or violation of traffic rules by the driver while performing NICSI duty.
NICSI also stands indemnified of any responsibilities that fall in the domain of
the empanelled bidder with respect to the hired vehicles, drivers and statutory
requirements with the State Transport authority.
d. While performing the duty, if a vehicle is rendered out of order, the bidder
shall send the replacement within 30 minutes failing which NICSI shall be free
to make alternate arrangement at the cost and risk of defaulting bidder besides
stopping the payment of the service availed by the vehicle that breaks down
on duty.

e. The order for hiring a vehicle will be placed on the bidder. However, the
bidder shall provide the vehicle from its nearest office/tie-up to contain the
dead mileage. The dead mileage will be actual and will not be more than 20
Km for to and fro in any case.
2.12 Force Majeure Clause
If at any time, during the continuance of the empanelment, the performance in
whole or in part by either party of any obligation under the empanelment is
prevented or delayed by reasons of any war, hostility, acts of public enemity, civil
commotion, sabotage, fires, floods, explosions, epidemics quarantine restrictions,
strikes, lockouts or acts of God (hereinafter referred to as "events"), provided notice
of happenings of any such event is duly endorsed by the appropriate
authorities/chamber of commerce in the country of the party giving notice, is given
by party seeking concession to the other as soon as practicable, but within 21 days
from the date of occurrence and termination thereof and satisfies the party
adequately of the measures taken by it, neither party shall, by reason of such event,
be entitled to terminate the empanelment, nor shall either party have any claim for
damages against the other in respect of such nonperformance or delay in
performance, and services under the empanelment shall be resumed as soon as
practicable after such event has come to an end or ceased to exist and the decision
of NICSI as to whether the services have so resumed or not, shall be final and
conclusive, provided further, that if the performance in whole or in part or any
obligation under the empanelment is prevented or delayed by reason of any such
event for a period exceeding 60 days, NICSI may at his option, terminate the
empanelment.
2.13 Arbitration
a. In case of any disputes or differences arising out at any time in connection with
the discharge of services as per the empanelment, NICSI and the empanelled
bidder shall first endeavor to settle such disputes of differences amicably.
b. All disputes or differences, including the claims for damages and compensation
whatsoever, arising between the parties, out of or relating to the construction,
meaning, operation or effect of this agreement or the breach thereof shall be
settled amicably. However, if the parties are not able to resolve them amicably
within a period of 15 (fifteen) days, the same shall be resolved by arbitration in
accordance with the Arbitration and Conciliation Act, 1996. The dispute may be
referred to arbitration by either party only after notice in writing to the other,
clearly mentioning the nature of the dispute/ differences. Such arbitration shall
be conducted by a arbitral tribunal consisting of three arbitrators one arbitrator

to be appointed by each Party, and the third arbitrator to be nominated by DG
(NIC). The Arbitration and Conciliation Act 1996 or any statutory modification
thereof shall apply to the arbitration proceedings and the venue for the
arbitration proceedings shall be Delhi and courts at Delhi shall have exclusive
jurisdiction. All the arbitration proceedings shall be carried out in English
language.
c. The arbitrator or arbitrators appointed under this Article shall have the power
to extend the time to make the award with the consent of parties.
d. Pending reference to arbitration, the parties shall make all endeavors to
complete the work in all respects and all disputes, if any will finally be settled in
the arbitration.
e. Upon every or any such references to the arbitration, as provided herein the cost
of and incidental to the reference and Award respectively shall be at the
discretion of the Arbitrator, or the umpire, as the case may be.
f. The award of Arbitrator or Arbitrators, as the case may be, shall be final and
binding on the parties. It is agreed that the empanelled bidder shall not delay
the carrying out of the services by reason of any such matter, question or dispute
being referred to arbitration, but shall proceed with the services with all due
diligence. NICSI and the empanelled bidder hereby also agree that arbitration
under this clause shall be the condition precedent to any right of action under
the empanelment except for as provided for in the Tender.
2.14 Miscellaneous
a. NICSI will not be responsible for any delay on the part of the bidder in obtaining the terms and conditions of the tender notice or submission of the tender bids.
b. In the event the Bidder’s Company or the concerned division of the company is
taken over/bought over by another company, all the obligations under the agreement with NICSI, should be passed on for compliance by the new Company/new Division in the negotiation for their transfer.
c. All terms and conditions governing prices and supply given above, as
applicable to NICSI, will be made equally applicable to NIC. d. NICSI reserves the right to modify and amend any of the above-stipulated
condition/criterion depending upon Project priorities vis-à-vis urgent commitments. NICSI also reserves the right to cancel this tender without assigning any reason therefore.

e. NICSI may at its discretion, extend this date for the receipt of bids by
amending the tender document , in which case all rights and obligations of the client and bidder previously subject to the last date will there after be subject to the last date as extended.
f. Printed conditions mentioned in the tender bids will not be binding on NICSI.
Alterations, if any, in the tender bid should be attested properly by the bidder, failing which the tender will be rejected.
g. Rates should be in Indian Rupees only. Rates should include all charges
applicable for the services being offered. Service tax shall be applicable as per the Government orders from time to time. Parking charges, toll tax and other Govt. Charges will be paid extra on production of proof.
h. During the period of empanelment/extended empanelment, if the rates of fuel
go up by more than 10%, on account of the policies of the Government, NICSI would consider upward revision of the hiring charges to tune such hike in fuel charges affecting the operating costs. NICSI’s decision will be final and binding in this regard. The empanelment of the vendor(s) refusing to accept NICSI’s decision will be cancelled and EMD/Security Deposit will be forfeited.
i. In case of monthly vehicle, Sunday will not be included. j. Each driver must have a mobile and his mobile no. should be informed to
NICSI by the vendor. k. If it is found that any vendor is involved in tampering of meter, then his
empanelment will be cancelled and penalty will be imposed. l. The Taxi Permit cars, of registration 2013 and later, neatly upholstered and
fitted with all necessary accessories for the safe and comfortable journey of officers availing them, will only be accepted for NICSI duty.
m. Only regular, reasonably educated and well behaved drivers in uniform (white
safari suit) with proven efficiency will be deployed for NICSI duty. For long term/monthly hiring, the vehicle and driver will not be changed unless the driver is on leave.
n. The vehicle deployed for NICSI duty shall be preferably CNG driven and
conforming to the standards and norms prescribed by the Transport Department.
o. During the period of empanelment/extended empanelment, if the rates of fuel
changed for more than +/- 10%, on account of the policies of the Government, NICSI would consider revision of the hiring charges to tune such changes in fuel charges affecting the operating costs. NICSI’s decision will be final and

binding in this regard. The empanelment of the vendor(s) refusing to accept NICSI’s decision will be cancelled and EMD/Security Deposit will be forfeited.
p. During the empanelment/extension period, if there are some changes in the government polices/ labour law which has implication in the wages of the drivers. NICSI would consider the revision of the empanelment rates. NICSI’s decision will be final and binding in this regard. The empanelment of the vendor(s) refusing to accept NICSI’s decision will be cancelled and EMD/Security Deposit will be forfeited.
2.15 Applicable Law
a. The agency shall be governed by the laws and procedures established by Govt. of India, within the framework of applicable legislation and enactment made from time to time concerning such commercial dealings/processing.
b. All disputes in this connection shall be settled in Delhi jurisdiction only. c. NICSI reserves the right to cancel this tender or modify the requirement. d. NICSI also reserves the right to modify/relax any of the terms & conditions of
the tender by declaring/ publishing such amendments in a manner that all prospective vendors /parties to be kept informed about it.
e. NICSI in view of projects requirement may reject any tender(s), in which any
prescribed condition(s) is/are found incomplete in any respect and at any processing state.
