HISTORY

Texas Beauty College was founded by Beauty First Join Corporation in 2004 at its previous location at 3534 Denton Highway Haltom City TX 76117. The school has been approved by the (TDLR) Texas Department of Licensing and Regulation to offer programs in Cosmetology, Facial, Manicure and Instructor. All program offerings have remained the same since the school’s founding. The National Accrediting Commission of Career Arts & Sciences, Inc. (NACCAS) accredits our school. The address is: 3015 Colvin St., Alexandria, VA 22314. Tel: (703) 600-7600. Approved courses are:

COSMETOLOGY - 1500 CLOCK HRSFACIAL - 750 CLOCK HRS MANICURE - 600 CLOCK HRS INSTRUCTOR - 750 OR 500 CLOCK HRS

Instruction is in residence with facilities occupancy level accommodating 100 students at any one time. Prospective enrollees are encouraged to visit the physical facilities of the school and to discuss personal, educational and occupational plans with school personnel prior to enrolling or signing enrollment agreements. This school currently do not have any available sponsored programs, government or otherwise, to provide grants or to pay for portions of tuition and fees.

FOR HANDICAPPED STUDENTSAccess for handicapped students to the institution’s facilities is available at the college on the first floor only. This institution does not offer special facilities or programs for the handicapped.SUDENTS WITH DISABILITIES ( Section 504 Regulations ).Accommodations will be made on a case by case basis by the school for students with disabilities. It is however the responsibility of the person with disabilities to inform the admissions department in writing of extent of the disability at the time of enrollment. The student will need to provide the following documentation so that the school can decide what would be appropriate accommodations.

The school will need to be informed at least (4) weeks in advance of the date needed. SEE CURRICULUMS STARTING ON PAGE 20. The freshman class teaches you from the very beginning and introduces the basics for those areas that you will need to know to pass Texas State Board examinations. From this initial introduction, you will learn all fundamentals that are the basics for your future and career. The hours spent in the freshman class are as follows: Cosmetology 150 hrs. Facial 75 hrs. Manicure 60 hrs. Texas Beauty College considers the freshman classes to be the foundation for your future.TEXTBOOKS, EQUIPMENT & SUPPLIESTextbooks will be issued at the beginning of the freshman class. All needed supplies and equipment will be maintained in the freshman classroom. On the first day of class, each student will be issued a complete kit of equipment with carrying case. The kit contains the equipment necessary for satisfactory completion of the course. Students are expected to maintain the kit by replacing lost or broken articles. The college is not responsible for a student’s equipment, either lost or stolen. ADMISSION REQUIREMENTS TEXAS BEAUTY COLLEGE admits as regularly enrolled students only persons who:

1. Have a high school diploma or high school transcript showing a graduation date.

2. Have a recognized equivalent of a high school diploma such as a home-schooled certificate by the state where the student resided during home school or a General Equivalency Diploma (GED). In the event of a FOREIGN DIPLOMA, the prospective student must submit the document to a qualified outside evaluation service for review and translation (if non-English) to determine whether or not the diploma represents the equivalent of a US High School diploma.

3. Are not currently enrolled at a primary or secondary institution.4. Have a correct social security number.5. Are at least 17 years of age.6. We will also admit those students on the basis of his or her ability to benefit from

training but do not have a high school diploma or GED. This option is ONLY for those students who not anticipate participating in Title IV funding. These prospective students must be beyond the who are at least 17 years of age of compulsory education and passes a nationally recognized test prior to admission.

Instructor Course Students with the following criteria will be admitted to the instructor course: A copy of high school diploma or GED; a copy of cosmetology license & proof of 1 year of experience if enrolling in the 500-hour course.

TEXAS BEAUTY COLLEGE does not recruit students who are already or who have admitted to another school offering a similar program of study.Conviction for possession or sale of illegal drugs –A federal or state drug conviction can disqualify a student for FSA funds. The studentSelf-certifies on the FAFSA that he or she may be eligible for aid TEXAS BEAUTY COLLEGE is not required to confirm this unless there is evidence of conflicting information.Admissions/Eligibility for Federal Aid RequirementsA conviction that was reversed, set aside or removed from the student’s record does notRender a student ineligible for aid, nor does a conviction that was received when the student was a juvenile, unless he or she was tried as an adult. If the student was convicted of both possessing and selling illegal drugs, and the periodsOf ineligibility are different, the student will be ineligible for the longer period. Admissions/Eligibility for Federal Aid Requirements:An applicant is not considered to be incarcerated if he or she is in a halfway house or home detention or is sentenced to serve only weekends. Incarcerated applicants may be admitted to TEXAS BEAUTY COLLEGE if the school director can potentially admit the applicant who has been convicted of a felony, but is not currently incarcerated pending a review.

Selective Services Registration:To be eligible to receive Title IV, HEA program funds, a male student who is subject toRegistration with the Selective Services must register with Selective Service (a male Student does not have to register with the Selective Service if the student is below the age of 18 or was born before January 1, 1960).Citizenship and residency requirements:Except as provided in paragraphs (b) and (c) of section 668 of Title 34-Education,To be eligible to receive Title IV, HEA program assistance, a student must:◊ be a citizen or national of the United States or◊ Provide evidence from the US Immigration and Naturalization Service that he or she

Is a permanent resident of the US or◊ be in the US for other than a temporary purpose with the intention of becoming a

Citizen or permanent resident or◊ be a citizen of the Federated States or Micronesia, Republic of the Marshall Islands,

Or the Republic of Palau. (These students are eligible under FWS, FSEOG, and PellPrograms.)

These students must be enrolled as regular students in an eligible program in order to Participate in Title IV.

TRANSFER CREDIT EVALUATION Appropriate credit may be granted for prior training received upon review and verification by college officials of its validity. Students must submit an official transcript of previous work done which reflects a passing grade in subjects that are common to those in the program in which students is enrolling. If a student wishes to transfer out of Texas Beauty College, a student must be paid in full and make up any missing assignments up to that point. There is also $5.00 transfer fee (for paperwork). RE-ENTRY POLICYAll students who withdraw may re-enter into the program without the loss of credit of State Board hours provided it is within 3 years from the date of their withdrawal and the student is in good standing with the college. There is a $25.00 re-entry fee.

SATISFACTORY ACADEMIC PROGRESS (SAP) POLICY Satisfactory progress in attendance and academic work is a requirement for all students enrolled in a NACCAS-approved program, either full-time or part-time. Federal regulations require all schools participating in state and federal financial aid programs to monitor SAP. These standards are applicable to all students attending the school and is provided prior to enrollment. SAP STANDARDS: This institution requires its students to maintain Satisfactory Academic Progress (SAP) as established by this institution, in order to continue to matriculate at the school and to continue to be eligible to participate in the federal government's Title IV financial aid programs. These standards apply to all students, regardless of the source of the student's funding, and to all students, regardless of their status (full-time or part-time). All students must comply with the following standards:1. All students must maintain a cumulative academic average of “C” (70% or better on all tests, work projects (operations) and other required course work. The system detailed below is the system utilized in the school. 100% - 90% = A = 4.0…Superior Performance, 89% - 80% = B = 3.0…Above Average, 79% - 70% = C = 2.0…Satisfactory, 69% - 60% = D = 1.0…Unsatisfactory, 59% - 50% = F = 0.0…Fail 2. All students must maintain a cumulative average attendance level of at least two-thirds (2/3) of the scheduled hours indicated on their enrollment contract. For example, a student scheduled to complete 30 hours per week would have to maintain an average weekly attendance of at least 20 hours per week (2/3 x 30 = 20). (67%). Regardless of the average level of attendance, students who have more than 10 days of consecutive absence will be dismissed. This standard shall apply to all students except those on an approved Leave-of-Absence (see LOA policy). Students who expect to be absent 10 or more days are encouraged to request a Leave-of-Absence. In addition to attendance standards relating to Satisfactory Academic Progress (SAP), students are also required to adhere to certain other general institutional policies relating to attendance and tardiness. 3. MAXIMUM TIME FRAME: All students must complete the program within one and one-half (1½) times the normal length of time required to complete the program as defined in the enrollment agreement. This time frame will be measured in terms of clock hours attempted. A student who exceeds the maximum time frame will be terminated. Quantitative Requirement:All students must complete their educational program in no longer than 150% of the published length of the program. A leave of absence will extend the student’s contract period, and maximum time frame, by the same number of days in the leave of absence.All clock hours at the Academy and transfer hours must be counted toward the 150% eligibility whether a student received Title IV federal student aid or not in order to graduate within the maximum time frame.Students must also meet the attendance requirements as outlined in this catalog.Academic Year Definition:Texas Beauty College’s academic year is 900 hours and 26 weeks for Title IV purposes. For Title IV payments the student must meet both clock hours and weeks of instruction as well as complying with all standards for Satisfactory Academic Progress before they can receive further Title IV payments. 4. EVALUATION PERIODS: Student compliance with the policy for Satisfactory Academic Progress is divided into evaluation periods and is assessed at each of the following times:Example: For the 1500 clock hour Cosmetology course, a student will be evaluated at 450, 900, 1200 and 1500 ACTUAL hours clock hours. Example: For the 600 clock hour Manicure course, a student will be evaluated at 300 and 600 ACTUAL clock hours.

Example: For the 750 clock hour Facial and Instructor courses a student will be evaluated at 375 and 750 ACTUAL clock hours. For the 500-hour Instructor course the evaluation will occur at 250 and 500 ACTUAL clock hours. Only students who meet the minimum requirements for attendance and academic performance are considered to be making satisfactory progress until the next scheduled evaluation. Students will be notified of any evaluation that impacts eligibility for financial aid, if applicable. Students will be provided with written evaluations at the evaluation periods noted above.

5. WARNING & PROBATION: WARNING: Students who fail to meet minimum requirements for attendance or academic progress are placed on warning and considered to be making satisfactory academic progress during the warning period. The student will be advised in writing on the actions required to attain satisfactory academic progress by the next evaluation. If at the end of the warning period, the student has still not met both the attendance and academic requirements, he/she may be placed on probation (SEE REQUIREMENTS BELOW) and, if applicable, students may be deemed ineligible to receive Title IV funds.PROBATION: Students who fail to meet minimum requirements for attendance or academic progress after the warning period will be placed on probation and considered to be making satisfactory academic progress during the first probationary period, if the student appeals the decision and prevails upon appeal. Additionally, only students who have the ability to meet the Satisfactory Academic Progress Policy standards by the end of the evaluation period may be placed on probation. Students placed on an academic plan must be able to meet requirements set forth in the academic plan by the end of the next evaluation period. Students who are progressing according to their specific academic plan will be considered making Satisfactory Academic Progress. The student will be advised in writing of the actions required to attain satisfactory academic progress by the next evaluation. If at the end of the probationary period, the student has still not met both the attendance and academic requirements required for satisfactory academic progress or by the academic plan, he/she will be determined as NOT making satisfactory academic progress and, if applicable, students will not be deemed eligible to receive Title IV funds. Probationary students who meet standards for SAP by the conclusion of the probationary period will be removed from academic probation. In the event a student is terminated due to not making Satisfactory Academic Progress, all policies regarding the institution’s refund policy will apply.

Students who do not achieve the minimum standards are no longer eligible for Title IV, HEA program funds, if applicable, unless on warning or prevailed upon appeal that has resulted in probation.

6. Re-establishment of Satisfactory Academic Progress Students may re-establish satisfactory academic progress and Title IV aid, as applicable, by meeting minimum attendance and academic requirements by the end of the probationary period.7. Appeal: If a student is determined to not be making satisfactory academic progress, the student may appeal the determination within ten calendar days. Reasons for which students may appeal a negative progress determination include death of a relative, an injury or illness of the student, or any other allowable special or mitigating circumstance. The student must submit a written appeal to the school on the designated form with supporting documentation of the reasons why the determination should be reversed. This information should include what has changed about the student’s situation that will allow them to achieve Satisfactory Academic Progress by the next evaluation point. The appeal and decision documents will be

retained in the student file. If the student prevails upon appeal, the satisfactory progress determination will be reversed and federal financial aid will be reinstated, if applicable.8. Leave of Absence/Re-Entry All students, who have withdrawn or taken a leave of absence and choose to re-enter into a course, will be placed under the same satisfactory or unsatisfactory progress status prevailing at the time of the prior withdrawal or leave. The leave will extend the student’s contract end date and maximum time frame by the same number of days in the leave. Any student who withdraws and re-enters for any reason will return in the same status at which he or she left.9. Course Incompletes, Repetitions and Non-Credit Remedial Courses:Course incompletes, repetitions and non-credit remedial courses do not apply to this institution’s form of instruction. All hours attended are considered attempted. It is not possible for students to withdraw from individual subjects. Students withdrawing from school will receive credit for all work successfully completed up to the point of withdrawal.10. Transfer Hours: Transfer hours from another institution that are accepted toward the student’s educational program are counted as both attempted and completed hours for the purpose of determining when the allowable maximum time frame has been exhausted. SAP evaluations are based on actual contracted hours at the institution.ATTENDANCE STATUS Full time students are required to be enrolled to attend a minimum of 24 hours per week. Half time enrollment requires a minimum of 12 hours per week. Part-time enrollment is defined as more than 12 but less than 24 hours per week. Less than 12 hours per week is less than half time.CONDUCT POLICY Students are expected to conduct themselves in a manner appropriate to a professional work environment. Violations of any following items may result in suspension or termination.

A. Abusing any illegal drugs or alcohol.B. Cheating on school examination or time card.C. Destroying or damaging school property.D. Disrespect toward any school’s staff members or instructors.

DISCLOSURE OF EDUCATION RECORDS Students and parents of dependent minor students have the right to inspect, review, and challenge information contained in their educational records. The parents of tax dependent students are only allowed to access to the proof that their children are attending school for tax purposes, not the remainder of the student’s records. Once the student reaches the age of 18, they became a legal adult and must give a written consent for their records to be released, even to their parents. However, a staff member must be present. Educational records are defined as files, materials, and documents, which contain information directly, related to the students and are securely maintained by the school. The school will maintain students’ files from the effective date of the most recent grant or renewal or removal of accreditation and in accordance with state and federal law. Students are not entitled to inspect the financial records of their parents. Before publishing the directory information the school will give the students and the guardians of dependent minor students the chance to deny the authority to publish the directory information. Written consent is required before educational records may be disclosed to third parties with the exception of Accrediting Commissions or Governmental Agencies as authorized by law.

VACCINNATION POLICY

Texas Beauty College does not require a student to give proof of any vaccination, however the school recommends that a student contact their primary care physician for any vaccination that may be required as part of a wellness checkup

HEALTH AND PHYSICAL CONSIDERATIONS Generally, the professional in the beauty field must be in good physical health for he/she will be working in direct contact with patrons. In most aspects of the beauty culture field there is a great deal of standing, walking, pushing, bending and stretching, and sometimes for long periods of time. A person must consider his/her physical limitations in terms of making a career choice that involves extensive training. We promote the acceptance of students with physical limitations or disabilities if these students believe they can fulfill training demands. GRADING SYSTEM Students are evaluated on a regular basis on theory, practical and clinical work. The evaluations are measured on a standard percentile basis and the percentage equated to a letter grade. Evaluation forms are issued to the students at designated evaluation periods. This evaluation form reflects the overall Attendance and Academic progress of the student. Students must maintain a “C” (70%) average to maintain satisfactory academic status. The system detailed below is the system utilized in the school.

100% - 90% = A = 4.0…Superior Performance 89% - 80% = B = 3.0…Above Average 79% - 70% = C = 2.0…Satisfactory 69% - 60% = D = 1.0…Unsatisfactory 59% - 50% = F = 0.0…FailMAKE-UP POLICY All assignments, tests and homework may be made up. Any deviation from the policy must be in writing from the office and signed by member of administrative staff.GRADUATION REQUIREMENTS Students must meet the following requirements in order to be issued a diploma certifying their graduation.

1) Successful completion of all tests with a passing grade.2) Complete the hour requirement established by the TDLR3) Satisfy all debts owed or establish a payment plan.

CLASS SCHEDULE

CLASSES WILL BEGIN AS FOLLOWS: Cosmetology, Facial, Manicure and Instructor (500 and 750 hours): every Tuesday of the month. STUDENT CLOCK HOUR POLICYOur school is using electronic time clock system and daily sign in sheet to keep track of student hours of attendance.  On the first day of the class, each student will be learn by school officer to clock IN and OUT on the electronic time clock at the start and the end of each day as well as on lunch period.  The time that the student clock IN and OUT on the electronic time clock will automatically transfer into the school office's main computer and the number of hours of attendance will accumulate daily. Daily sign in sheet will use as a back up data in case the electronic time clock failed.   NOTE:  Make sure that you clock IN and OUT at the start and the end of each day.  Besides to clock IN and OUT on the electronic time clock in order to earn credit hours, students are also required to fill out a daily operation sheet, this sheet will reflect student's daily applied efforts and all of the operations filled out on this sheet must be initialized by both the student and instructor in order to receive credits. One clock hour is equal to 60 minutes of instruction.TIME CLOCK CREDIT

The following is a guideline for the instructor to issue credits.

1. Each Theory must be initialed in the proper category. If that category is complete, the instructor may issue credit in a comparative category.

2. The portion of the time card reflecting hours are in the Theory hours earned and any classed the instructor has demonstrated.

3. The portion of the time card concerning operations is to be applied efforts of the students as they manually perform practical subject.

4. Some practical operations may take longer to perform according to the student. Note the following time frame the State Board gives for each operation.

Shampoo/set = 1 ½ hoursScalp Treatment = ½ to 1 hourPermanent Wave = 2 to 2 ½ hoursFacial = 1 ½ to 2 hoursManicure = ½ hourHair cut = ½ to 1 hour

Using the above, the Board would understandably not consider a student capable of performing more than three permanent waves per day.NOTICE OF STUDENT RIGHTS1. You may cancel your contract for school, without any penalty or obligation on the fifth business day following your first class session as described in the Notice of Cancellation form that will be given to you at the first class you go to. However, students who cancel their enrollment after starting classes will be responsible for the non-refundable registration fee, the cost of any kits, books, lab coat, or other supplies issued. Read the Notice of Cancellation form for and explanation of your cancellation rights and responsibilities. If you have lost your Notice of Cancellation form, ask the school for a sample copy.2. After the end of the cancellation period, you also have the right to stop school at any time, and receive a refund for the part of the course not taken. Your refund rights are described in the contract. If you have lost your contract, ask the school for description of the refund policy.

SCHOOL RULES AND REGULATIONS 1. School hours are Tuesday – Friday 9:00 a.m. until 8:00 p.m. Saturday from 9:00 am-5:00

pm2. Used Electronic Time Clock and sign in sheet available to sign in daily to keep track of

attendance. It is mandatory to sign in and out for lunch. Students must clock their time and sign out when leaving the building. Student fails to do so students will get their hour deducted by the instructor.

3. No student may clock their time in or out for another student. This rule is strictly enforced all time.

4. Students will take lunch between 12:00 noon and 12:30 p.m. Students should report to an instructor if they have not had lunch by 1:30 p.m. Lunch is 30 minutes. Lunch period is each student’s responsibility, and must be staggered.

5. In case of illness or emergency on any day, the student must call in to the school to report his/her absence before 10:10 a.m. that morning.

6. Texas Beauty College does not set a dress code for its students. Any way all students have to appearance in a professional look, and because of they are training to be a professional.

7. Smoking is only allowed in designated areas “OUTSIDE” of the building. 8. No visitors are permitted in the classroom or student lounge area unless approved by the

supervisor. 9. College business phones may not be used for personal calls. 10. No cell phones are allowed during any classes or on clinic floor. If your cell phone is on,

you have to leave the class immediately and you not allowed coming back until the class is over. If you have been asked to leave the class 3 times in a month, you will be placed on probation.

11. Rigid adherence to the rules of sanitation and disinfections and personal hygiene is required at all times.

12. Students must keep their workstations, in class or on the floor, cleaned and sanitized at all times.

13. Each student daily must complete a minimum of ½ hour of sanitation. All kits must be in a sanitized condition at the end of each day.

14. All students serving the public must be courteous and pleasant. If difficulty arises, please call an instructor. Students must take patrons when assigned to them. Students who refuse to take a patron when assigned have to clock out for that day.

15. No student may leave a patron while doing a service, except in an emergency and is excused by an instructor.

16. Students are not allowed to give services or materials other than what is called for on the service ticket. Students violating this rule will be disciplined accordingly.

17. Students will pay in advance for supplies on personal services such as permanents, tints, bleaches, etc. Freshman students are not allowed to work on senior students and vise versa at any time. Personal services will be allowed on Tuesday through Thursday after 8 pm (only if all of the requirements for the day are met, and students must have the instructor permission as well.)

18. Students are responsible to return the college materials or equipment loaned to them. Students must not borrow equipment from each other. Each student is solely responsible for his/her personal belongings and materials.

19. Students have the privilege at all times to consult with the management on personal problems. The college positively reserves the right to suspend or expel a student who gossips, uses vulgar language or causes discord.

20. The college will not tolerate the use of alcohol or drugs at any time. No student will be admitted to class who is apparently under the influence of alcohol or drug

21 Students must keep a record of hours and services each day as required on the student daily record of applied effort. Credit will be given for applied effort only. An instructor must check all works or credit will not be given. Records must be neat and clear.

22 Student must maintain an average of 70% or above in theory and in all practical subjects. Probationary status will result in case of failure to do so

23.Only products furnished by the college may be used unless otherwise approved by the supervisor.

24. Students must comply with all instructions given by personnel relative to school activities. No insubordination will be tolerated.

25. Students must comply with college policy and state rules and regulations.

26. Notify office immediately of any address or telephone change.

27. A student who is late need to let school know in advance.

28. Absence of more days than state allowed without notification shall result in a

telephone call from the school to determine the cause of absence. Any student who is continuous absent more than ten days without signing a Leave-Of-Absence will be terminated.

These rules are designed to form excellent work habits and attendance, and to aid in completing your course as soon as possible so that you may become employed as a cosmetologist, manicurist or esthetician. Violation of school rules may result in suspension or termination.

METHOD OF PAYMENT: TUITION POLICIES AND FEES ALL TUITION AND FEES ARE PAYABLE IN ADVANCE unless other arrangements have been made prior to commencement of classes. Payment schedules (weekly, monthly, and quarterly) are available. This institution charges no interest when the course is paid in full prior to completion of the course. Payment options include: cash, check, credit card, money order or Title IV, if the student is eligible for Title IV. The contract will specify payment options.REFUND POLICY 2 Section 1602.457 Cancellations and Settlement Policy. The school has a fair and equitable refund policy and currently uses the Texas Department of Licensing and Regulation refund policy. The kit costs are non-refundable for items the student has received. The holder of a private beauty school license shall maintain a cancellation and settlement policy that provides a full refund of money paid by a student if the student:

1. Cancels the enrollment agreement or contract not later than midnight of the third day after the date the agreement or contract is signed by student, excluding Saturdays, Sunday, and legal Holiday; or

2. Entered into the enrollment agreement or contract because of a misrepresentation made:a) In the advertising or promotional materials of the school; orb) By an owner or representative of the school

Section 1602.458. Refund Policy (a) The holder of a private beauty culture school license shall maintain a refund policy to provide for the refund of any unused part of tuition, fees, and other charges paid by a student who, at the expiration of the cancellation period established under Section 1602.457:

1. fails to enter the course of training;2. Withdraws from the course of training; or3. Is terminated from the course of training before completion of the course.

(b) The refund policy must provide that:1. the refund is based on the period of the student's enrollment, computed on the basis of course time

expressed in scheduled hours, as specified by an enrollment agreement, contract, or other document acceptable to the department;

2. The effective date of the termination for refund purposes is the earliest of:A. The last date of attendance, if the student is terminated by the school;B. The date the license holder receives the student's written notice of withdrawal; orC. 10 school days after the last date of attendance; and

3. The school may retain not more than $100 if:A. Tuition is collected before the course of training begins; andB. The student fails to withdraw from the course of training before the cancellation period

expires.

Section 1602.459. Withdrawal or Termination of Student(a) If a student begins a course of training at a private beauty culture school that is scheduled to run not

more than 12 months and, during the last 50 percent of the course, withdraws from the course or is terminated by the school, the school:

1) May retain 100 percent of the tuition and fees paid by the student; and2) Is not obligated to refund any additional outstanding tuition.

(b) If a student begins a course of training at a private beauty culture school that is scheduled to run not more than 12 months and, before the last 50 percent of the course, withdraws from the course or is terminated by the school, the school shall refund:

1) 90 percent of any outstanding tuition for a withdrawal or termination that occurs during the first week or first one-tenth of the course, whichever period is shorter;

2) 80 percent of any outstanding tuition for a withdrawal or termination that occurs after the first week or first one-tenth of the course, whichever period is shorter, but within the first three weeks of the course;

3) 75 percent of any outstanding tuition for a withdrawal or termination that occurs after the first three weeks of the course but not later than the completion of the first 25 percent of the course; and

4) 50 percent of any outstanding tuition for a withdrawal or termination that occurs not later than the completion of the first 50 percent of the course.

2 The policy applies to all terminations for any reason, by either party, including student decision, course or program cancellation or school closure.

(c) A refund owed under this section must be paid not later than the 30th day after the date the student becomes eligible for the refund.

Section 1602.460. Interest on Refunda) If tuition is not refunded within the period required by Section 1602.459, the school shall pay interest

on the amount of the refund for the period beginning the first day after the date the refund period expires and ending the day proceeding the date the refund is made.

b) If tuition is refunded to a lending institution, the interest shall be paid to that institution and applied against the student's loan.

c) The commissioner of education shall annually set the interest rate at a rate sufficient to deter a school from retaining money paid by a student.

d) The department may exempt a school from the payment of interest if the school makes a good faith effort to refund the tuition but is unable to locate the student. The school shall provide to the department on request documentation of the effort to locate the student.

Section 1602.461. Reentry of Student after Withdrawal or Termination

If a student voluntarily withdraws or is terminated after completing 50 percent of the course at a private beauty culture school, the school shall allow the student to reenter at any time during the 48-month period following the date of withdrawal or termination.

Section 1602.462. Effect of Student Withdrawala) A private beauty culture school shall record a grade of incomplete for a student who withdraws but is

not entitled to a refund under Section 1602.459(a) if the student:1) Requests the grade at the time the student withdraws; and2) Withdraws for an appropriate reason unrelated to the student's academic status.

b) A student who receives a grade of incomplete may reenroll in the program during the 48-month period following the date the student withdraws and complete the subjects without payment of additional tuition.

Section 1602.463. Effect of School Closurea. If a private beauty culture school closes, the department shall attempt to arrange for students enrolled

in the closed school to attend another private beauty culture school.b. If a student from a closed school is placed in a private beauty culture school, the expense incurred by

the school in providing training directly related to educating the student, including the applicable tuition for the period for which the student paid tuition, shall be paid from the private beauty culture school tuition protection account.

c. If a student from a closed school cannot be placed in another school, the student's tuition and fees shall be refunded as provided by Section 1602.458. If a student from a closed school does not accept a place that is available and reasonable in another school, the student's tuition and fees shall be refunded under the refund policy maintained by the closed school under Section 1602.459. A refund under this subsection shall be paid from the private beauty culture school tuition protection account. The amount of the refund may not exceed $35,000.

d. If another school assumes responsibility for the closed school's students and there are no significant changes in the quality of the training, the student from the closed school is not entitled to a refund under Subsection (c).

STUDENT SERVICES POLICY AND PROCEDUREThe system of delivering student services at TEXAS BEAUTY COLLEGE supports and enhances the school’s training programs by encouraging students’ attendance and promoting students’ success. We employ a method of delivering student services that requires all staff members to be part of the student services delivery system. The purpose of our student services is to assist students in maintaining satisfactory progress and in making informed decisions concerning training and employment. We also provide advising and assistance to students in an attempt to address their needs outside the classroom as well as inside.ADVISING: because the same instructor throughout their program teaches students, that instructor delivers most student services. Instructors are responsible for monitoring student’s attendance as well as student satisfactory progress. Consequently, when student advising is required, it is the instructor who ascertains the need for such advising and renders it to the students. The instructor documents student advising at the time it is conducted and placed in the student’s academic file. Students who are having academic problems are assisted by the instructors through extra tutoring or additional time spent with the instructor to go over any work missed. ATTENDANCE: Student attendance is documented through the use of an Electronic clock time tracking system. Students are required to clock their time in and out of the terminal. Students hours will be maintained on computer in the school office, at the same time student are required to sign in and out of a sign in sheet in order to track their presence in school. Each month school will generate a report of student hours and post in school. CAREER ADVISING AND PERSONAL ATTENTION: Students are advised individually, as often as necessary to review the student’s satisfactory progress. Successful salon owners and stylists are scheduled into the school regularly to give demonstration and discuss career goals, etc. with the students. This activity supplements the daily advising carried out by the instructors and supervisor. Students may request additional advising sessions at any time.LEAVE OF ABSENCE: In the event a student finds it necessary to be absent from for an extended period of time, the student may request an official leave of absence (L.O.A.)

1. An authorized leave of absence (LOA) is a temporary interruption in a student’s program of study. LOA refers to the specific time period during a program when a student is not in attendance. An LOA is not required if a student is not in attendance only for an institutionally scheduled break. However, a scheduled break may occur during an LOA.

2. All requests for leaves of absence be submitted in advance in writing, include the reason for the student’s request, and include the student’s signature.

3. An LOA must meet certain conditions to be counted as a temporary interruption in a student’s education instead of being counted as a withdrawal requiring an institution to perform a refund calculation.

4. A student must apply in advance for an LOA unless unforeseen circumstances prevent the student from doing so. For example, if a student were injured in a car accident and needed a few weeks to recover before returning to institution, the student would not have been able to request the LOA in advance. An institution may grant an LOA to a student who did not provide the request prior to the LOA due to unforeseen circumstances if the institution documents the reason for its decision and collects the request from the student at a later date. In this example, the beginning date of the approved LOA would be determined by the institution to be the first date the student was unable to attend the institution because of the accident.

5. The student must follow the institution’s policy in requesting the LOA;6. There must be a reasonable expectation that the student will return from the LOA;7. Approval of the student’s request for an LOA is in accordance with the institution’s

policy;8. The institution will not assess the student any additional institutional charges as a

result of the LOA;9. The LOA together with any additional leaves of absence must not exceed a total of 180

days in any 12-month period;10. A student granted an LOA that meets these criteria is not considered to have

withdrawn, and no refund calculation is required at that time;11. The institution must extend the student’s maximum time frame and the contract period

by the same number of days taken in the LOA. Changes to the contract period on the enrollment agreement must be initialed by all parties or an addendum must be signed and dated by all parties;

12. In the event the student does not return from the LOA, the withdrawal date for the purpose of calculating a refund is always student’s last day of attendance.

JOB PLACEMENT: Texas Beauty College will assist students in locating employment. The college will its best efforts to successfully place the student including posting list job available from prospective employer soliciting the college, and assist in completing resumes for each student before graduation. However Texas Beauty College cannot guarantee employment as an inducement to enter their establishment.

STUDENT RECORDS: Student permanent educational records and necessary financial records containing student’s name, address, telephone number, social security number, date of birth, program of study, start date, completion or withdrawal date, clock hours and grades are maintained securely either on computer or in locked file cabinets for a period of at least six years or the last grant of accreditation.ENGLISH-AS-A SECOND LANGUAGE: Our school does not provide English-as-a-Second Language of instruction. Cosmetologists and other personal appearance workers receive income from a variety of sources. They may receive commissions based on the price of the service or a salary based on number of hours worked. All receive tips, and many receive commissions on products they sell. In addition, some salons pay bonuses to employees who bring in new business.

PHYSICAL DEMANDS OF THE PRACTICING PROFESSIONALGood health and stamina are important, because these workers are on their feet for most of their shift. Because prolonged exposure to some hair and nail chemicals may cause irritation, special care is taken to use protective clothing, such as plastic gloves and aprons.Most full-time barbers, cosmetologists, and other personal appearance workers put in a 40-hour week, but longer hours are common in this occupation. SAFETY REQUIREMENTS OF THE PROFESSIONBy following safety precautions you contribute to the health, welfare, and safety of the community. Always have good hygiene and be professionally dressed. Keep first aid kit on hand, follow safety regulations and keep equipment properly sanitized. The following precautions should always be taken with each client:

Those without an identification badge must sign in at the entrance and identify their purpose of visit, the person to be visited and register their time in and out of the building. The visitor must also wear a visitor’s badge while on campus. All rear access doors leading to the campus are closed and locked during evening hours starting at 5:00pm. When the school closes for the night, the school’s official or supervisor will inspect each floor to see that it is empty and then set the alarms on each floor and then lock down the campus. Other individuals present on institutional property at any time without the express permission of the appropriate institutional official(s) shall be viewed as trespassing and may as such be subject to a fine and/or arrest. In addition, students and employees present on institutional property during periods of non-operation without the express permission of the appropriate institutional official(s) shall also be viewed as trespassing and may also be subject to a fine and/or arrest.

4. Current policies concerning campus law enforcement are as follows:a) Institution’s officials have no powers of arrest other than the Citizens Arrest

Law, and are required in the event of a crime or emergency to call the correct agency or dial (911) for the police and emergency services. The Citizens Arrest Law will be invoked only as a last resort, and after all other possibilities have been explored.

b) Employees shall contact their immediate or nearest ranking supervisor to report any criminal action or emergency to the appropriate agency by calling (911). If possible, in the interim, the security guard(s) and or institutional official shall attempt to non-violently deal with the crime or emergency with the appropriate agency on campus. Individual discretion must be used, as undue risk should not be taken.

c) The institution currently has no procedures for encouraging or facilitating pastoral or professional counseling (mental health or otherwise), other than the student or employee is encouraged to seek such aid.

5. Though this institution does not offer regularly scheduled crime awareness or prevention programs, students are encouraged to exercise proper care in seeing to their own personal safety and the safety of others. The following is a description of policies, rules and programs designed to inform students and employees about the prevention of crimes on campus.

Once the reason for the lack of disclosure is no longer in force, the institution must disclose the information. If there is a request for information that is older than sixty 60 days, that information must be made available within two (2) business days of the request.

6. The institution does not offer regularly scheduled crime awareness or prevention programs other than orientation where all the institution’s policies and regulations are properly disclosed to prospective students.

7. All incidents shall be recorded in the TEXAS BEAUTY COLLEGE daily Incident Log located on campus in the institutional official’s station. The log includes the date, time, location, incident reported, and disposition of incident and the name of the person who took the report. The report must be entered in the log with two (2) business days after it is reported to the school’s official, unless that disclosure is prohibited by law, would endanger the confidentiality of the victim.

8. This institution does not permit the sale, possession or consumption of alcoholic beverages on school property and adheres to and enforces all state underage-drinking laws.

9. The institution does not permit the possession, use or sale of illegal drugs by its employees and students and adheres to and enforces all state and Federal drug laws. The violations of these policies by students or employees may result in expulsion, termination and/or arrest.

10. Information concerning drug and alcohol abuse education program are posted at campus and is distributed annually to students and staff. (Institutions are advised to make available to students and staff members information on an agency that provides counseling and help on drug and alcohol abuse education).

11. Sexual assaults (criminal offences) on campus will be reported immediately to the institution’s official, who will report it to (911) emergency and police units. The person who was victimized will be encouraged to seek counseling at a rape crisis center and to maintain all physical evidence until such a time as that person can be properly transported to a hospital or rape crisis center for proper treatment. This institution has zero tolerance of such assault; the violation of this policy by students or employees may result in expulsion, while investigations are being followed, termination and/or arrest.

When a student regains eligibility during the award year the institute may award Pell and Campus-based aid for the current payment period and direct for the period of enrollment.

Standards for a qualified drug rehabilitation programA qualified drug rehabilitation program must include at least two unannounced drug tests and must satisfy at least one of the following requirements:

Be qualified to receive funds directly or indirectly from a federal, state, or local government program.

Be qualified to receive payment directly or indirectly from a federally or state-licensed insurance company

Be administered or recognized by federal, state or local government agency or court.

Be administered or recognized by a federally or state-licensed hospital, health clinic, or medical doctor.

B. Incarcerated students:A student is considered to be incarcerated if she/ he are serving a criminal sentence in a federal, state, or local penitentiary, prison, jail, reformatory, work farm, or similar correctional institution (whether it is operated by the government or a contractor). A student is not considered to be incarcerated if she/ he are in halfway house or home detention or is sentenced to serve only weekends. Our attendance policy specifies that all classes and practical studies are done at the Institute’s physical location; there for incarcerated students are not eligible for admissions.

The amount that has been calculated as expected family contribution to offset the student cost of attendance. NEED

Financial need is the amount left over after subtracting the expected family contribution from your cost attendance. DETERMINING NEED

The U.S. Department of Education approves the Effective Family Contribution formula. This school uses it to compute the ability of the family to contribute to the cost of the student’s training. Each year certain aspects of EFC are adjusted. This accounts for both actual inflation in the previous year and projects inflation for the next analysis year. The yearly Consumer Price Index (CPI) analysis determines inflation rates. Revision in FICA, federal, state, and local taxes reflect changes in the law and recently available IRS data. The Federal Pell Grant uses the Federal Pell Grant Index (PGI) number on the Student Aid Report (SAR) to determine eligibility for the Family Contribution (FC) number obtained. This determines the student’s (or family’s) ability to contribute to the Cost of Attendance (COA). The EFC is subtracted from the COA, and the school awards financial aid to cover as much of the student need as possible. The EFC bases need on information furnished in the Application for Federal Student Aid (AFSA). The FC number produced is for nine months for Dependent students, and twelve months for Independent students. In application, the FC number is pro-rated to the length of the defined Academic Year.TRANSFER STUDENT (FINANCIAL AID TRANSCRIPT REQUIRED):

A student who attended another eligible institution on at least a half-time basis. A financial aid transcript must be obtained even if the student says he/she did not receive financial aid at the other institution. If a financial aid transcript is required no financial aid may be advanced until the financial aid office receives the completed transcript. INTEGRATED VERIFICATION PROCESS

Federal regulations 34 C.F.R. Part 668, Subpart E, dated March 14, 1986, executing legislation 20 U.S.C. 1094 governing the Title IV programs require schools to be sure of certain applicant-reported data. These regulations require schools to develop written policies and procedures for verification. The school is required to make these policies available to all applicants for financial aid, as well as prospective students upon request. Applicants shall complete the appropriate sections of the Verification Worksheet. There are two different worksheets: One for Dependent students and one for Independent students. Applicants must provide the Admissions or Financial Aid Officer the IRS forms 1040, 1040A, or 1040EZ during the admissions and advising process and provide all required documentation no later than two weeks from the enrollment date. If the student makes corrections to Part 2 of the Federal Pell SAR, they must complete and process them within two weeks from the enrollment date, or the date the school receives the SAR, whichever occurs first. If copies of the income tax returns are not available from the applicant, spouse, and/or parent(s) within two weeks from the enrollment date, request the “IRS listing of Tax Account Information” directly from the Internal Revenue Services. The school must allow no more than 60 days for its receipt. APPLICANTS RESPONSIBILITIES To be eligible to receive Title IV funds, we require applicants to provide requested information during the time period(s) specified in these policies. Applicants must certify that the following data items are correct as listed on the original application; or, if not correct, must update the date items, as of the date of verification: . Number of family members in the household. . Number of family members the household now enrolled as at least half-time students in postsecondary educational instructions. . Change in dependency status. Federal Pell Grant applicants whose dependency status changes during the Award Year must file a correction application. This process does not apply if the change occurs due to marriage. Campus-Based applicants whose dependency status changes during the Award Year must have their FC recalculated. This process does not apply if the change occurs due to marriage. The applicant must repay any over award, or any award, discovered during verification, for which he/she was not eligible. CONSEQUENCES OF FAILURE TO PROVIDE DOCUMENTATION WITHIN THE SPECIFIED TIME PERIOD(S)

If the student cannot provide all required documentation, the school cannot complete the verification process within two weeks from the date of enrollment. The school must then advise applicants that they are not eligible for financial aid funds. The school then gives the applicants the following options: . The student may continue training on a cash payment basis. . The student may withdraw, and re-enroll at no additional charge. There will be no loss of credit earned, when the student provides all proof, and verification is complete.

If a Federal Pell Grant applicant has not processed Part 2 of the SAR within two weeks of enrollment, the school must advise them that they are not eligible for financial aid. The school will then provide applicants with the following options: . The student may continue training on a cash payment basis. . The student may withdraw, and re-enroll at no additional charge. The school may not make any interim disbursements. The student must complete verification before disbursement of all Title IV funds. TOLERANCES For the Federal Pell SAR, with an original PGE of zero, the school shall use the Zero PGI Charts to determine whether the applicant must resubmit their SAR because of a change in information. The student must make appropriate corrections on Part 2 of the SAR. A new PGE is computed when required as a result of comments on the SAR, and/or as a result of data item changes. This occurs regardless of the absolute error amount.

The school shall notify the applicant of additional information/documentation needed for verification. This occurs through contact with the Financial Aid Officer, or by mailing to the applicant’s resident address a VERIFICATION FOLLOW-UP form. This form indicates additional items needed. How much you will get will depend not only on your EFC but also on your cost of attendance, whether you’re full-time or part-time student, and whether you attend school for a full academic year or less. You may receive only one Pell Grant in an award year and you may not receive Pell Grant funds from more than one school at a timeHow will I be paid?Your school may credit the Pell Grand funds to your school account, pay you directly (usually by check), or combine these methods. RETURN TO TITLE IV (R2T4)Process Overview & ApplicabilityThe return of Title IV funds requirement is a complex process involving a great deal of interoffice cooperation and coordination. The school director is designated as the contact point for students who wish to withdraw. Inter-Office email or written memoranda may be used to communicate that information to faculty, bookkeeping, and the office of financial aid. The school's director determines the withdrawal date and reports it to other institutional offices and the Department of Education. The Office of Financial Aid calculates the return of Title IV funds using federal formulas, notifies FAS, Genesis in writing to complete recovery of Title IV funds to specific program funds, notifies the student of his or her obligation to repay funds if applicable, tracks the repayment, and refers overpayments to ED. It also offers the student any earned post-withdrawal disbursement and follow procedures and policies pertaining to this indicated in the award notification part of the manual. For students whose status changes from full-time to part-time during the payment period, the award package must be revised based on the revised enrollment status and student must be notified about the changed award amounts and status. FSA Handbook, Vol. 2, Ch. 6 provides details on R2T4 calculations and regulations.

The date of Texas Beauty College determination that a student withdrew is identified through faculty input, student’s failure to return from an approved leave of absence, student’s verbal or written notification to any office such as Office of Academic Affairs, Office of Financial Aid, etc.

In the event of any unofficial withdrawals, R2T4 refund must be done within 45 days from the date of determination of such withdrawal. The date of determination must occur within two weeks from the last day of attendance.

All enrolled students are notified through Texas Beauty College catalog about the withdrawal process and the student’s rights and responsibilities including how a student reports the intent to withdraw and how the student begins the withdrawal process. Withdrawal Date

The faculty is required to take attendance and notify the school director if a student has stopped attending class without any notice for 3 (three) consecutive scheduled class days. The school director monitors attendance of all enrolled students. He will contact students via email, phone call and letter. If no response is received within 14 days, the school will assume the student has unofficially withdrawn. The school director will determine the withdrawal date, which would be no later than two weeks from the last day of attendance. However, if the student responds, the official withdrawal date will be the date on which student notifies school via any means of communication. Students who have been absent for 30 consecutive days will automatically be terminated. However all refunds due will be paid within 45 days of the student's 14th consecutive day of absence. A student who wishes to withdraw from school for compelling personal reasons should notify the Director in writing stating the reasons for withdrawal and whether or not the student intends to return at a later date to pursue a program of study. For all clock hours programs attendance roster is mandatory. All

documentation for a withdrawn student will be kept in the student’s file in the office of financial aid.

Texas Beauty College grants Leaves of Absence (LOA) as per regulation of Higher Education Reconciliation Act (HERA) 2006. Students who require a leave of absence from the program must do so in writing and be approved by the Director prior to leaving school. If a student does not return from his/her LOA, the student will be dropped the day following the expiration of the leave of absence, and the financial aid office will be notified. This begins the withdrawal process. The office of Financial Aid will complete the R2T4 (Return to Title IV) process as per regulations as described in the manual.Formula CalculationTexas Beauty College is required by federal statute to recalculate federal financial aid eligibility for students who withdraw, drop out, are dismissed, or take a leave of absence prior to completing 60% of a payment period or term. The federal Title IV financial aid programs must be recalculated in these situations. If a student leaves the institution prior to completing 60% of a payment period or term, the financial aid office recalculates eligibility for Title IV funds. Recalculation is based on the percentage of earned aid using the following Federal Return of Title IV funds formula:Percentage of aid earned = the number of scheduled hours in the payment period completed up to the student’s last date of attendance as per the school’s attendance records, divided by the total clock hours in the payment period.If this percentage is greater than 60%, the student earns 100% of the disbursed Title IV funds or aid that could have been disbursed. If this percentage is less than 60%, then the percentage earned is equal to the calculated value. Funds are returned to the appropriate federal program based on the percent of Percentage of aid earned = the number of scheduled hours in the payment period completed unearned aid using the following formula:Aid to be returned = (100% minus the percent earned) multiplied by the amount of aid disbursed toward institutional charges. If a student earned less aid than was disbursed, the institution would be required to return a portion of the funds and the student may be required to return a portion of the funds. All Title IV funds that the institution must return will be made no later than 45 calendar days after the date the school determines that the student withdrew. When Title IV funds are returned, the student may owe a balance to the institution. If a student earned more aid than was disbursed to him/her, the institution must send written notification to the student (or parent for PLUS loan funds) to offer a post-withdrawal disbursement for any amount not credited to the student’s account no later than 30 calendar days after the date that the school determines that the student withdrew. The institution is required to make a post-withdrawal disbursement within 45 days of the student's date of determination that they withdrew for grants and 180 days of the student’s date of determination that they withdrew for loans. The following is a step-by-step process that is followed in all R2T4 calculations on clock hour formulaStep 1: Determine the percentage of aid earned by calculating the percentage of the

scheduled hours that the student completed.Step 2: Determine the amount of earned aid by applying the percentage to the total Title

IV aid that was or could have been disbursed.Step 3: Determine the amount of unearned aid by subtracting earned aid from disbursed

aid or determine the amount of a post-withdrawal disbursement by subtracting disbursed aid from earned aid.

Step 4: If unearned funds must be returned, determine the schools and the student’s shares; or if a post-withdrawal disbursement is due, determine the sources from which it will be funded.

Step 5: If unearned funds must be returned, allocate unearned aid to programs from which student was funded; or if a post-withdrawal disbursement is due, send student applicable notification.

Step 6: Return the institution’s share and any funds repaid by the student or refer the student to ED; or make the post-withdrawal disbursement.

The Department of Education provides return of Title IV funds worksheets in Volume 2, Chapter 6 of the FSA Handbook. It has also developed software that automates the calculation. This software can be downloaded via http://www.sfadownload.ed.gov/ReturnT4Funds.htm. These are used to calculate all R2T4 calculations. A copy of the worksheet in the event of manual calculation and a computer printout in the event of automated calculation is placed in student’s file for records. The office of financial aid performs all R2T4 calculations as it has all Title IV award and institutional charges information, which are required in the calculations. Post-Withdrawal Disbursements

In the event a student is eligible for a post-withdrawal disbursement based on student’s budget, awarded financial aid and Title IV funds and R2T4 calculations, a post-withdrawal disbursement must be made only after the following conditions are met.

1. The Office of Financial Aid in most cases verbally notified student and parents of the availability of post-withdrawal disbursements within one week from the date of R2T4 calculation was performed.

2. Student and parents in most cases verbally notified the Office of Financial Aid within a reasonable time indicating their acceptance of available post-withdrawal disbursement amounts. The reasonable time refers to allowing sufficient time to school to process a post-withdrawal disbursement within the deadlines set by the Department of Education. Student has outstanding institutional charges that are due and wants to pay off those charges by applying his/her post-withdrawal disbursement. Student/Parents completed all necessary paperwork related to such post-withdrawal disbursement within a reasonable time. The Office of Financial Aid must track the notification and authorization to make the disbursement and meet deadlines as prescribed by ED. A school must process Title IV aid within 120 days from the last day of the enrollment period.

3. The post-withdrawal disbursement must be applied to outstanding institutional charges before being paid directly to student. See sections 668.22(a)(4) of HEA 1965 and GEN-04-03 for details on Post-Withdrawal Disbursement regulations.
