MINUTES OF THE BOARD OF COUNTY ROAD COMMISSIONERS

January 28, 2019
1. At a Regular Meeting of the Board of County Road Commissioners at their offices located at
840 S. Telegraph Road, Monroe, Michigan on Monday, January 28, 2018 the meeting was
called to order by Chairman Iacoangeli at 5:33p.m.
2. Roll Call by Deputy Clerk as follows:

3. Commissioner Iacoangeli led the Pledge of Allegiance.

5. Commissioner Minton moved, seconded by Commissioner Thayer to approve the January 28,
2019 regular meeting agenda as presented.

Restrictions(“frost laws”) for Monroe County roads for 2019 when deemed appropriate,
in accordance with Act 300 of 1949 (Michigan Vehicle Code).
7) Award the contract for Oakville Waltz Road Right-of-Way Clearing to low bidder, T&J
Excavating and Tree Clearing, LLC, in the amount of $64,040.00, and authorize the
Managing Director to sign all documents on behalf of the Board.
8) Approve the Resolution to request reimbursement of $10,000 from the Michigan
Department of Transportation for the sum paid for a Licensed Professional Engineer
employed by the Monroe County Road Commission.
9) Award the bid for the 2019 and 2020 Street Sweeping Services to all responding
vendors.

10) Award the 2019 Spring Pavement Marking Program contract to P.K. Contracting in the
amount of $24,900 and authorize the Managing Director to sign all documents on
behalf of the Board.
Commissioner Stewart moved, seconded by Commissioner Minton to approve the January 28,
2019 Consent Agenda as amended, removing item #4 for further discussion.
Vote: Ayes: 5 Nays: 0 Excused: 0 Motion carried.
Item removed for further discussion:
4) Approve the extension of the contract with Bartolo Surveying for the 2019 Miscellaneous
County Roadway and Bridge Projects, and authorize the Managing Director to sign on behalf
of the Board.
Commissioner Stewart asked for a little back on Bartolo, like how long had the Road
Commission been using them. Mr. Pierce explained the Road Commission has been using
them for a couple years. The Road Commission lost our bridge engineering a few years ago,
and Bartolo has done a good job assisting the engineering division with that work. This is an
extension of the current contract.
Commissioner Stewart moved, seconded by Commissioner Minton to approve extension of
the contract with Bartolo Surveying for the 2019 Miscellaneous County Roadway and Bridge
Projects, and authorize the Managing Director to sign on behalf of the Board. Vote: Ayes: 5
Nays: 0 Excused: 0 Motion carried.

10. Report of Officers –
Randy Pierce (Managing Director) – Mr. Pierce praised the maintenance crews for the
good job done on snow removal over the weekend. Sunday’s snow was unexpected,
but there was good attendance when crews were called in. He also indicated the NE
salt facility is making a difference on response time.
Commissioner Stewart inquired about the letter they were given from MDOT
regarding the emergency procedure for Fermi. Mr. Pierce explained that the MCRC
has worked in conjunction with EMD on Fermi disasters/events, and our staff has
been trained on the procedures. In talking with Mr. Sweeney, it was determined that
the MCRC should continue to provide coverage for any type of Fermi evacuation
situation to maintain the routes and control traffic using specific roads. This is in the
best interest of Monroe County since we know our roads and where to redirect traffic.
Once the trunkline contract has been terminated, a contract will need to be put in
place.
David M. Leach (Superintendent of Maintenance) – Mr. Leach echoed the comments
made by Mr. Pierce that the crews did a good job over the weekend. The last two
weekends has hit us with some good size snow fall and ice but the crews did a good
job.
Commissioner Iacoangeli indicated he has received several emails complimenting the
crews. Mr. Leach said the weather dumped a good amount of snow, and we had a
quick turnaround to get it cleaned up before the deep freeze hit. He stated the crews
will continue to work 24 hours a day until clean.

Matthew Snell (County Highway Engineer) – Mr. Snell provided an updated on the
Bedford Township round-a-bout project. The engineering division reviewed the plans
submitted by Mannik & Smith, and the MCRC sent back some suggestions on the
alignment footprint. The MCRC hasn’t received any revised costs estimates as of
today. He will keep the Board updated.
Dori Hawkins-Freelain (Director of Finance) – Ms. Hawkins-Freelain has nothing
additional to report.
Philip Costello (General Counsel) – Mr. Costello explained he continues to follow up
on the Scofield Road abandonment and Ida West Road property sale.
Commissioner Minton mentioned Mr. Pierce presented the 5-year plan to the County
Board of Commissioners and explained that the MCRC sent notice to the State to
terminate the trunkline contract. He asked how the County perceived the notice of
termination.
Mr. Pierce explained he didn’t want the County Board to be caught off guard since
MDOT had posted the RFLOI on their website. The County seemed pleased with the
5-year plan. Mr. Pierce also talked about the placement of the NE salt facility to
access I-75/I-275 and the northern portion of the county that provides a quicker
during snow events. He explained that the MCRC provided the one year notice of
termination along with several options to transition from the Road Commission to the
state. A few of the County Commissioners voiced a concern about citizens getting
to work if the state fails to plow the highways, but overall the County Board
supported the decision.
Mr. Pierce also stated that Monroe News reporter Dean Cousino was in attendance
and talked with him after the meeting about the MDOT contract termination. He
explained that the MCRC isn’t trying to take on MDOT like David and Goliath, but
only wants to be a better Road Commission for the citizens of Monroe County. In
order to do the best job on the state highways, the Road Commission would need to
hire 15 more drivers which isn’t possible with the current funding. Mr. Pierce stated
it would not be his recommendation to maintain the state contract and hire 15
additional employees due to the high cost associated with legacy costs.
Mr. Pierce added that Washtenaw, Macomb and Oakland Counties are all in
negotiations with MDOT, and they all see problems with the current funding
mechanism. For Monroe County, it isn’t just about the money, but about being a
better organization for our county residents. He gave an example of the Sunday
snow event where the Road Commission had 15 trucks on the highways and only a
few trucks available for the primary and local roads. He also reminded the Board
that the MCRC has provided three options and have heard nothing back from MDOT.
Mr. Pierce also spoke with Denise Donahue from CRA of Michigan and explained that
the MCRC Board made this decision. The Board gave Mr. Pierce the authority to
negotiate with MDOT on a transition period, but MDOT has come back with no
options to date.

Commissioner Thayer asked what impact it would have on the Road Commission if
MDOT stores their trucks on our property. Mr. Pierce indicated one option was to
lease a facility from the Road Commission and we would also work on their trucks
and the Road Commission would bill them, and they could also purchase fuel from
the MCRC. This option would provide MDOT with minimal investment and help with
a smooth transition.
During a recent meeting, MDOT indicated they are going out to privatize. Mr.
Sweeney indicated the new MDOT director would like to privatize four counties using
one contractor. When asked where MDOT would situate one garage to service four
counties, but they had no plans at this time.
Commissioner Thayer asked if the Road Commission had enough people to work on
trucks if MDOT stored them here. Mr. Pierce explained they could be worked into the
rotation of our trucks with no problem during the year transition.
Commissioner Minton indicated last year the State had extra monies to be allocated
to road commissions. Where is that money? Ms. Hawkins-Freelain explained that
MDOT is now claiming they miscalculated on their estimates, but no final word yet.
They are doing through an adjustment period for the over estimations.
11. Public Comment -
Bob Queen, Exeter Township Supervisor, welcomed new Commissioner Jack Thayer. Mr.
Queen indicated that the Road Commission might want to reach out to the individual
townships to see how the termination of the state contract might the county. He felt the
townships should be contacted either through a letter asking for their input or maybe hold a
meeting to get their comments. He felt getting rid of the state contract would benefit the
rural townships for sure. He also voiced a concern about the safety of the school buses and
kids, which for him is a priority over the MDOT system. He felt it might be important to
know how the rest of the townships, and maybe the schools, would view this termination as
a group.
12. Commissioners' Comments -
Commissioner Thayer indicated he signed up for the New Commissioner Seminar through
CRA for February 25th
in Mt. Pleasant, so he might not make it back for the evening meeting
as the training doesn’t end until 4pm.
Commissioner Thayer also indicated he has been trying to get in touch to set up a meeting
with Senator Zorn to discuss the out of date ACT 51 funding. He would like to see a
coalition of counties get together to try to amend ACT 51. ACT 51 cannot be changed
because it is constitutional issue, but it is possible to amend it. He also mentioned several
senate bills that might affect additional funding for roads, like vehicle registration and gas
tax on fuel purchased locally.
Commissioner Stewart indicated Monroe County townships have meetings, and it might be
an idea to send a representative to these meetings.
Bob Queen stated not many townships attend these meetings any more. The last meeting
only had three attend.

The MCRC Engineering Department is recommending the reconfiguration of the intersections of Doty Road and Scofield Road, and Raisin Street and Scofield Road in Exeter Township. This is in conjunction with the abandonment and closure of this section of Scofield Road. The Doty Road and Scofield Rd intersection will be changed to a 3-Way Stop. Doty Road and Raisin Street will have stop signs in all directions.
Action Requested
Please make a motion to adopt Traffic Control Order #19-01 and #19-02 to impose the changes listed above.

Welcome to the 2019 Fair Season! Enclosed is your contract for the 2019 Monroe County Fair being held July 28- August 3.
1. Please read your contract very carefully. The rules and regulations are printed on both the front and the back of your contract.
2. Please sign and return the white copy to us. The pink copy is for your records. If you do not return your signed contract by MARCH 15th, your space may be offered to someone else on the waiting list.
3. Please review authorized items for sale and display. Only these items are to be sold or displayed at the 2019 Mom·oe County Fair. Fair Management will verify that the items being sold or displayed are listed on your contract. Any unauthorized items must be removed immediately. Vendors in violation may be asked to leave the fair immediately, and the contract will be voided.
4. · Please check all the attachments and return those that pertain to you with your signed contract.
5. Information regarding setup times, tear-down, vendor passes, parking stickers and vendor packets is included in your contract.

MONROE COUNTY FAIR

The undersigned hereby contracts for EX# 82 space at the Monroe County Fair. PERIOD OF OCCUPANCY: Entire Fair period from July 28 through August 3, 2019. THIS SPACE IS TO BE USED FOR THE FOLLOWING PURPOSES: Information booth to inform public about MCRC operations
The contract is made subject to the following important RULES AND REGULATIONS: 1. Payment Terms. One half of the contract balance is due on March 15,2019 with the remainder due by June 15,
2019. Contract is subject to cancellation, and late fees may apply if payments are not received on time. Please contact us for payment arrangements if necessary. There is a $25 fee for all returned checks. No refunds will be granted after June 15, 2019.
2. Should the Vendor fail to observe the terms of this contract, the Fair Management may at its election, declare all rights hereunder at an end and shall not be obligated to refund any sum theretofore paid by the Vendor. In such event the Vendor may be immediately put off the grounds without notice. Should the Vendor fail to use allotted space, no refund will be made on any advance payment.
3. The management shall have a possessory lien on any property of the Vendor to satisfY liabilities of the Vendor to the Monroe County Fair. This lien may be perfected by sale in like manner as constable sales are held.
4. The Vendor as part of the consideration of this contract waives any claim of damages or liability as against the Monroe County Fair, the Fair Manager, Fair Board of Directors, or its agents and employees. The Vendor further agrees to hold the Monroe County Fair, the Fair Manager, Fair Board of Directors, or its agents and employees harmless from loss or liability arising on accmmt ofthe acts or omissions of the Vendor.
5. Liability Insurance- A copy of liability insurance should be sent to our office by July 1, 2019. Liability insurance coverage is required in the amount of $1,000,000 with Monroe County Fair listed as additional insured. The insured entity must be the same name as listed on your contract. The fair must have proof of your insurance before you are allowed to open. Liability insurance may be purchased from the fair insurance carrier.
6. Vendor Passes: Every person going through a gate must have a pass, including the driver of a vehicle. Also, a vehicle pass must be affixed to the upper left hand corner of the windshield of the vehicle. Packets with information, including your gate and vehicle passes, will be ready the week before the fair. You must pick them up at the Fair. Office. Gate passbooks included with contract: ~ (7 individual passes per passbook) Additional passbooks are available for purchase at the fair office. Car passes included with contract: 1A
7. Vendor must provide a list of their free handouts and samples. The Fair has the right to reject any handouts or samples. NO BOTTLED WATER or HELIUM BALLONS may be given away at any booths, inside or outside. Raffles are not to be held on the grounds.
8. No other use than specified may be made of the space, and no other products than those specified may be exhibited, except by consent of the Fair Management.
9. Rights under this contract may not be assigned, sold, transferred, pledged, or otherwise hypothecated. Neither may the Vendor sublicense any portion of the space the use of which is licensed to him.
10. Having a contract awarded for current year does not guarantee contract will be awarded for the following year. 11. Vendor Setup: Thursday, Friday, Saturday the week prior to the fair between 9am-8pm. Outside vendors should
be ready to open by .1 Oam on the first day of the fair (Sunday). MBT Expo Center vendors and South Exhibit Building vendors should be ready to open by 1 pm on the first day of the fair (Sunday). Please notifY the fair office as soon as possible if you are unable to meet the opening deadline.
12. The Vendor shall setup his or her own space and not interfere with neighboring Vendors by blocking the view for the public. The exhibit is subject to the approval of Fair Management. No tents, awnings or similar structures are allowed inside the buildings unless they are part of your product line and are approved on your contract.
13. Vendor Tear-down: a. Outside Vendors: Not before midnight on Saturday, Sunday 7am- 11am. Tents are dismantled at dawn
on Sunday so make sure all merchandise is removed from beneath tents before leaving on Saturday. b. Inside Vendors: 10:00pm- midnight Saturday night (Custer Road entrance only), Sunday 8:00am
noon, Monday 8:00am- noon. 14. Vendor exhibits shall be open to the public and in charge of a competent attendant for the full period of the Fair
during the designated operating hours established by the Fair. Those hours are as follows_unless exception is specifically made in the individual case by Fair Management :
c. Inside Vendors: 1pin- 1 Opm Sunday of fair, 1 Oam -1 Opm balance of fair week. d. Outside Vendors: no later than 11am and until 11pm Sunday- Saturday of fair week.
Vend or space may be cancelled if Vendor fails to occupy their space with the exhibit referred to in this contract by the designated opening time. Any vendor space left unmanned increases the risk of both a safetv and security hazard. Early teardown increases this risk as well, and will not be tolerated. Contracts will not be issued for the following year as a result of either infraction.
15. The Fair Management may at any time enter upon and inspect any portion of the licensed premises. 16. The Vendor must take good care of the licensed premises and at the expiration of the Fair surrender up the same
in as good condition as when taken. A fee of $25 for inside vendors and a minimum of $50 for outside vendors will be charged for any space not left in the same condition as when you entered it.
17. Walks, roadways, entries, passages, and staircases shall not be obstructed or used for any other purposes than ingress and egress. The Fair Management reserves full traffic control. Vehicles will be admitted to the Grounds for the purpose of servicing Exhibits at the hours and under the conditions that the Fair Management will prescribe.

18. Doors, windows, glass doors, and any lights or skylights that reflect or admit light shall not be covered or obstructed.
19. No person shall mark, paint, drill, dig into, or in any way deface the walls, ceiling, patiitions, floors, wood, stone, iron work, or the lands of the Fair, without first obtaining written permission from the Fair Management. No adhesive's (tape or otherwise) are to be used on the floor or other surfaces inside the buildings including the MBT Expo Center.
20. Nothing shall be done on the premises that shall in any way increase the rate of fire insurance or conflict with fire and sanitaty regulations.
21. Methods of handling electricity, gas, and inflammable or explosive substances shall be at all times subject to the power of the Fair Management to limit, prescribe, and prohibit.
22. The Fair Management shall have the power to prescribe the weight and position of objects which shall be brought upon the premises and shall have the power to prohibit the bringing upon the premises of any objects which by their weight or inherent dangerousness shall constitute a hazard to person or property.
23. Vendors and their employees shall not be permitted to remain on the Grounds after Fair hours unless written authority therefore has been procured from the Fair Management.
24. No stock trucks or trailers are to be parked in CLot with the exception of setup and tear-down times. 25. It is agreed that general illumination of the interior of the building and such electricity as may be needed in the
demonstration of the Vendor's products shall be furnished by the Fair Management without charge to the Vendor; but in all instances of special uses of current as for electric signs, spot lights, protectors, and the lilce, the Vendor shall pay an added charge.
26. Special and additional electrical connections for operation of lamps, motors, signs, etc. must be furnished by the Vendor. A competent electrician will be designated by the Fair Management and will be in attendance upon the Grounds before, during and after Fair time, with which the Vendor may on his own responsibility make atTangements for necessaty expert service.
27. Any Concession Trailer requiring 208/220/240 volt electrical service will be required to have the proper 4 wire connection that meets the National Electrical Code defmition of a 4 wire connection.
28. Any outside advertising for this event must refer to MBT Expo Center as well as the fair if your vendor space is in that building.
29. The Fair Management must approve language, type, and placing of commercial signs and advertising. 30. No Vendor shall make such noise in connection with his place of business or exhibit as to interfere with
neighboring Vendors. 31. No Vendor shall solicit outside of their designated space by any means including, but not limited to, the use of
microphones/bull horns, handing out flyers or other advertising materials, etc. 32. Operation of stokers and furnaces whereby heat is generated in exhibits is prohibited. The Fair Management
further in the interest of safeguarding the rights of all Vendors, reserves the right to regulate, and prohibit if need be, use of excessive lights, fans, cooling devices, motors, suction machines, and the lilce, if the same create any undue interference with the rights of neighboring Vendors.
3 3. The Fair Management reserves the right to prohibit exhibits and merchandising which in the judgment of the Fair Management are below standard, offensive or not in keeping with exhibits and merchandising of high character.
34. The Vendor shall be subject to any regulations made by the Fair Management concerning cleanliness of space, neatness and conduct of attendants, disposal of waste, rubbish, and garbage and used containers, and general attractiveness of the Grounds, Vendor is responsible for the cleanliness and maintenance ofhis space. During Fair week Fair Management will provide for the pick up and disposal of waste, rubbish, and garbage and used containers placed in 3;isles by the Vendor. Under no circumstances will Fair employees enter the Vendor's space for cleaning purposes.
3 5. The Vendor must vacate Grounds and remove his goods, equipment and materials within not more than two days after the conclusion of the Fair; but permission for longer stay where necessaty will be given in specific cases by the Fair Management.
36. The Vendor shall be subject to further and additional regulations made by Fair authority, provided that said further and additional regulations to be later promulgated shall be reasonable necessary or proper to prevent injury or damage to persons or property or to prevent the endangering of health or morals.
INTERPRETATION OF RULES In the event of dispute under these rules between the Fair and Vendors or between Vendors themselves, interpretation and decision shall be made by the Fair Management, whose decision shall be binding. In individual cases for adequate reason the said Fair Management shall have authority to release in his discretion from any of these rules. The Fair Management shall be the sole and final judge of questions arising. Vendor acknowledges they have read and understand the Rules and Regulations of the contract by affixing their signature to this contract.
