Russo 23 24 COMMITTEE REPORTS 25 COUNCILMAN MCDONOUGH read, The Local Government and Community Services Committee met 26 on Monday, January 23, 2017 at 7:00 pm with two items on the agenda; Ordinance 17-01 allows for the 27 sale of beer and wine coolers at Summerfest. This legislation has been done annually for the past four 28 years, and for the sale of alcoholic beverages in Bohlken Park for the event weekend only. After a short 29 discussion, it was placed on second and subsequent third by a 7-0 vote. The issue of Dogs in City Parks 30 was discussed with Law Director McGinty, who was in attendance. Council discussed the provisions for 31 allowing dogs in city parks and asked that Director McGinty make some amendments to the draft 32 legislation in preparation for reviewing again before placing on first reading. A motion for the issue to 33 remain in committee passed by a 7-0 vote. UH will offer proper car seat installation beginning today at no cost to all parents, 72 grandparents, and expecting parents. This program is in cooperation with our FP fire department and I 73 would like to thank Chief Raffin for organizing this great safety program; Cleveland MetroParks will be 74 continuing their deer management program to reduce deer population. A deer herd reduction is planned 75 for the reservation bordering our community. All residents who own property adjacent to the MetroParks 76 propetiy will be sent a letter informing them of the program; Gemini Center January Report- 77 Memberships: Since January 1st, the Gemini Center has sold 662 memberships. This is an increase from 78 the 632 sold at this time last year. Revenue has also increase to $62,451 in 2017, up from $59,682 at this 79 time last year. Visits to Center (VTC):From January 1st through 31st , the Gemini Center saw 26,745 80 visits to the center. This is an increase from the 25,904 from the same time frame in 2016. This is an 81 increase of 841 visits in one month, or an average of 28 visits er day. This is incredibly remarkable, 82 considering historically speaking, recreation facilities tend to decrease membership retention by about 83 3% per year after the first 5 years of the facility opening. This is additionally remarkable, in that this was 84 done in spite of a membership rate increase for 2017; Swim Lessons:Director Owens also reports by 85 using social media, new letters, and happy participants that our Aquatics Program Swim Lesson 86 enrollment for the Gemini Swim Academy has increased to 138 students in 2017. This is an increase 87 from 120 in 2016; New Non-traditional Programs:Pour N Paint held its first class on January 27th and 88 had 20 students. We received excellent reports on how fun this program is; Chef in Training had 16 89 participants for the January 27th class, and the February 24th class already has 15. Fit in Fairview, which 90 kicks off today has 90 participants; Group Fitness:New classes include Athletes in Training, Kettlebell 91 Express, Kickboxing, Muscle Madness, Piyo, and Aqua Zumba. The Director and his team will be 92 keeping our school age children busy on their day off next week as the Gemini will also be hosting a 3 on 93 3 basketball shoot out on Presidents Day for ages 6 through 13; This Thursday the Senior Center is 94 hosting a "Valentine Party", stop in see all the excitement. The center also begins its tax assistant 95 program for seniors in cooperation with AARP. It will be every Tuesday until 4/15. If you know of a 96 senior who needs assistants with their taxes, please have them call the senior center as appointments are 97 required. Next Thursday, Director Leininger and I have been invited to attend County Executive Budish 98 and Chief Economic Development Officer Ted Carter's countywide economic development briefing. 99

They will present information on new and improved resources to support our development work 100 including business attraction and expansion. 101 102 DIRECTOR LEININGER reported on his updates during the West 229th sewer line project and 103 announced that it is now completed. He said that this was a priority project coming out of the year-long 104 study of the basement flooding issues occurring on the west side of town. He apologized there were some 105 resident inconveniences with the construction work times and fumes that got into people’s homes, and 106 said he appreciated their patience. He reported that the repairs to the roof at the city hall entrance has 107 been completed and appear to have been successful. The state income tax credit application for 108 redevelopment of the NASA buildings has been denied. The scoring indicated how competitive the 109 program is, and they are planning on resubmitting in March with hopes of a better outcome. DIRECTOR 110 LEININGER will continue to keep everyone updated on this project. The Center Ridge Planning Study, 111 which was done by the cities of Rocky River and Fairview Park is nearing completion, and finishing 112 comments are now being submitted to the consultant for a final report. This was funded through a TLCI 113 grant from NOACA, putting together recommendations for aesthetic, traffic, pedestrian and general 114 economic development along this corridor. Once a final draft is available it will be shared and discussed 115 as needed. 116 THE CHAIR asked whether the NASA project is contingent on getting the tax credit grants. 117 DIRECTOR LEININGER said that the tax credits are very important to the project, however there are 118 other things that they are still moving forward on behind the scenes, but it is a very important component 119 of the project that, if not awarded, will require taking a look at where they are at and perhaps look at the 120 direction they are headed. It is in a hold pattern until they hear back from the State. 121 122 DIRECTOR CINGLE reported that the Administration is working on two final items to complete the 123 2017 budget, which will be processed in the next week to get to council for the February 20 meeting for 124 first reading. The 2016 audit started about two weeks ago and is anticipated to be completed by the end 125 of May or early June. He will keep council abreast on progress of the audit. 126 127 DIRECTOR MCGINTY congratulated and recognized Finance Director Cingle on receiving the Auditor 128 of State Award with Distinction for excellence in financial reporting and the comprehensive annual 129 financial report for the city in 2015. He said that we are proud of him having had a clean audit, and 130 appreciates everything that he has done over the last year. 131 132 ENGINEER MACKAY reported that plans for the 2017 water line projects continue, and one they are 133 approved by Cleveland Water they will proceed with bidding and construction this year. 134 135 PUBLIC SESSION 136 SCOTT ALLEN - 3380 GLENBAR DRIVE – MR. ALLEN spoke about an issue that has started 137 happened in the last few weeks. He said that the parking on Glenbar has increased significantly due to 138 Savers asking RTA drivers not to park in their lot. The overflow has caused significant increase in traffic 139 and parking on Glenbar, as well as potential safety issues with cars cutting through and others attempting 140 to back out to get on the road. He said that it is also causing residents to park further from their homes 141 and believes these issues will become more prevalent once the weather breaks. He recalls when he first 142 moved on the street that there used to be signs prohibiting certain hours of parking. 143 COUNCILMAN MINEK said that there was limited and no parking on Glenbar when the dealership was 144 there. He asked Director Leininger to contact RTA in regards to a possible Park & Ride program. All 145 their transit centers have one except for Fairview Park. He also has suggested in a meeting with the 146 Manager at Savers to possibly establish a lease with RTA for part of the parking lot. He is unsure at this 147 time how to solve this problem, as other businesses around it are about to begin construction in the area. 148

MAYOR PATTON reported that the Savers building is owned by a private company, who recently is up 149 for sale. She believes that this may be why the parking lot changes have occurred, so that it can be seen 150 by potential buyers. Savers has a ten year lease, but the ownership for the building is up for sale. The 151 transit center was not built for a parking lot, but as a transit center for drop-offs and transfers from one 152 bus to another without any accommodations. The owner of the Savers building, as a private owner, is 153 allowed to do whatever they want to do in regard to the lot. She suggested to those who have been in 154 contact with her about the issue to contact the present owner to see if they can come to some type of 155 conclusion. She also gave the number to contact at RTA to make sure that their complaints are known. 156 She thanked Mr. Allen for bringing this to the city’s attention tonight. 157 158 CHUCK SOTU – 20867 Fairpark Drive – MR. SOTU asked about the Brookpark/NASA development 159 and if the project will be jeopardized if they not get the state money. 160 DIRECTOR LEININGER responded that he is not sure if the project will be jeopardized, but it will 161 change it and they do not want to go down that road until they hear back again from the state. The credits 162 amount to several million dollars, so it is a significant revenue stream that will have to visit the question 163 of what does the project become, or do they continue as it is. He said that the credits are on a recurring 164 cycle, so they will reapply. He said that they have received both income tax credit and the blessing of city 165 council to move forward, which is already significant public investment in the project. This is more 166 incentive to bring some of the pieces of the project together. 167 MR. SOTU asked if this project will affect the airport in any way with building height and compliance. 168 MAYOR PATTON said that the buildings are not changing they will remain the same height. 169 170 MR. JESSE SANDERS – Branch Manager, Fairview Branch Library – MR. SANDERS introduced 171 himself and said that he has been working as the new Branch Manager position for the last 7 months. HE 172 said he looks forward to coming back to visit. 173 174 MISCELLANEOUS BUSINESS AND COMMENTS BY MEMBERS OF COUNCIL 175 COUNCILMAN MCDONOUGH announced two events happening this Wednesday at 7:00pm; St. 176 Angela Merici Social Room will be Hosting a presentation by the Cuyahoga County Prosecutor’s Office 177 entitled, “The Dark Side of the Internet”, which will give parents and caregivers the latest knowledge of 178 social media apps that are used by predators to target kids, how to identify and prevent sexting and how 179 to be a better monitor while your children are online. Registration is available by contacting the County’s 180 Crimes Against Children Task Force. The second event will be held at St. Edward’s High School and 181 will be a talk by former Boston College Basketball and NBA player Chris Herren, who will be speaking 182 about his personal story of drug addiction and recovery. This will take place at the Holy Family Chapel. 183 COUNCILMAN MCDONOUGH congratulated Fairview Park Superintendent Wagner for receiving the 184 Administrator of the Year Award from the Ohio Music Educators Association. He welcomed the two 185 firefighters sworn in tonight and thanked Chet Sadonick for all his service over the years. 186 187 COUNCILMAN MINEK congratulated Chet Sadonick and Director Cingle on their recognitions tonight. 188 He asked Director Leininger for the final draft of the Center Ridge Planning Study. 189 190 COUNCILMAN WOJNAR congratulated Chet Sadonick on his years of service and the two firemen 191 sworn in today. 192 193 COUNCILMAN RUSSO thanked Chet Sadonick on his years of service and congratulated the two 194 firemen sworn in today. 195 196 THE CHAIR assigned the issue of Energy Audit Review to the Environment, Public Works, Planning, 197 Zoning and Development Committee. 198

CITY OF FAIRVIEW PARK ORDINANCE NO. 17- REQUESTED BY: COUNCIL PRESIDENT KILBANE SPONSORED BY: COUNCIL PRESIDENT KILBANE and COUNCILMAN HINKEL

AN ORDINANCE AMENDING SECTION 505.10 OF THE CODIFIED ORDINANCES OF THE CITY OF FAIRVIEW PARK CHAPTER 505 TITLED “ANIMALS” TO ALLOW DOGS IN PUBLIC PARKS AND ESTABLISHING RULES THEREIN

WHEREAS, it is in the best interest of the City of Fairview Park to amend Section 505.10 of the Codified Ordinances of the City of Fairview Park to provide for the allowance of dogs in city parks and to calculate repeat offenses in total.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FAIRVIEW PARK, COUNTY OF CUYAHOGA, AND STATE OF OHIO:

SECTION 1: That Section 505.10 of Chapter 505 titled “Animals” is hereby repealed and replaced with the following:

505.10 DOGS IN PUBLIC PARKS

(a) No person owning, keeping, or in charge or control of any dog shall permit such dog to go, enter or remain, without a leash upon any public parks within the City, to wit: Bain Park, Bohlken Park, Grannis Park, Nelson Russ Park, Morton Park, and any other City park hereafter established.

(1) Any dog must be on a leash that is extended no farther than six feet and must wear a collar or harness that must be specifically made or manufactured to be the proper size and strength for that particular dog.

(2) Any dog must be under control of a person who possesses discretion and physical strength sufficient to exercise reasonable restraint and control conforming to the animal’s weight, size and strength.

(3) Any person walking a dog on paved paths shall yield way to any and all traffic on the paths without dogs and shall obey any other rules related to traffic on paved paths posted at the park.

(b) Dogs shall be prohibited from the following areas within city parks:

(1) Playground equipment and 30 feet immediately surrounding;

(2) On designated soccer field, baseball field, football field, tennis court, basketball court or other designated athletic areas while in use;

(3) Within 30 feet of splash pad and pavilion area of Morton Park; and

(c) Any person bringing a dog into a park or exercising control of a dog while in a park shall promptly clean up any waste from the dog and place it in the receptacles provided. SECTION 2: It is found and determined that all formal actions of this Council concerning and relating to the adoption of this ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.

SECTION 3: That this ordinance shall take effect and be in force from and after the earliest period allowed by law.

CITY OF FAIRVIEW PARK ORDINANCE NO. 17- ORIGINATED BY: GREG CINGLE, FINANCE DIRECTOR REQUESTED BY: MAYOR EILEEN ANN PATTON SPONSORED BY: COUNCILWOMAN CLEARY AN ORDINANCE APPROPRIATING FUNDS FOR CURRENT EXPENSES AND OTHER EXPENDITURES OF THE CITY OF FAIRVIEW PARK, OHIO FOR THE PERIOD COMMENCING JANUARY 1, 2017 AND ENDING DECEMBER 31, 2017 AND DECLARING AN EMERGENCY WHEREAS, for the ongoing operation of the municipal government, it is necessary to appropriate funds for the fiscal year 2017. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FAIRVIEW PARK, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1. To provide for the current expenses and other expenditures of the City of Fairview Park, Ohio for the period commencing January 1, 2017 and ending December 31, 2017 as attached in Exhibit "A". SECTION 2. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. SECTION 3. That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and welfare and for the further reason that it is necessary for the daily operation of municipal departments in 2017 and provided it receives the affirmative vote of a majority plus one of the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor, otherwise from and after the earliest period allowed by law.
