1. COMMUNITY SERVICES 1.1 Provision of Pool Plant Service Maintenance To Aquatic and Leisure Centres Moved Cr Perri, Seconded Cr Klisaris

That Council: 1. Awards Contract No 2011041 Part A, for the supply of Pool Plant Service

Maintenance for the Monash Aquatic and Recreation Centre, the Clayton Aquatics and Health Club and the Oakleigh Recreation Centre to Roejen Services Pty Ltd for lump sum amount $10,164 per annum (GST inclusive) for a one year term with an option to extend for a period of three years ($40,656 GST inclusive over four years).

2. Awards Contract No 2011041 Part B, Pool Plant Reactive Repairs for the

Monash Aquatic and Recreation Centre, the Clayton Aquatics and Health Club and the Oakleigh Recreation Centre to Roejen Services Pty Ltd and Mechanical Plumbing Services Pty Ltd for the schedule of rates submitted with their tender for a one year period with an option to extend for a period of three years (Estimated Contract Value is $90,000 per annum or $360,000 over four years inclusive of GST).

3. Authorises the Chief Executive Officer, at his discretion, to approve the

extension options of the contract subject to the Contractor’s performance for the preceding period of the contract being satisfactory.

4. Authorises the Chief Executive Officer to sign and seal the appropriate

contract documentation.

1.2 Brine Street Child Care Centre Fees

NOTE: Cr Klisaris disclosed an indirect conflict of interest as he operates a child care centre in the municipality. He left the Chamber at 7.40 pm, prior to Council considering this matter and returned at 7.43 pm, after the matter had been voted on.

That Council approves an increase in fees for Brine Street Child Care Centre from 1 January 2012 to $87.00 (daily) and $408 (weekly)

In response to questions from Cr Dimopoulos, the Director Community Services advised that child care subsidies would be increasing and benchmarking against other child care centres in the area showed that the level of Brine Street’s fees would be just below average

The Council having caused notice of planning application No.TPA/39393 to be given under Section 52 of the Planning and Environment Act 1987 and having considered all the matters required under Section 60 of the Planning and Environment Act 1987 decides to grant a planning permit under the provisions of the Monash Planning Scheme in respect of the land known and described as 6 Kernot Avenue Mulgrave, for buildings and works for the development of a multi-sport complex/gymnasium to be used as part of the existing education centre for a range of school related activities with associated basement car parking and landscaping, generally in accordance with the plans submitted with the application dated 23 May 2011 subject to the following conditions, including the specified standard conditions set out in the Council’s “Town Planning Standard Conditions” adopted by the Council 16 September 2003 : 1. Before the development starts, three copies of amended plans drawn to scale

and dimensioned, must be submitted to and approved by the Responsible Authority. When approved the plans will be endorsed and will then form part of the permit.

The plans must be generally in accordance with the plans submitted with the application, but modified to show: a) The location of electrical, gas and water metres, and any other required

services or amenities not currently located on the plans to be shown not within the front landscaped setback area.

b) The reinstatement of all unused crossovers to grass, footpath and kerb and channel.

c) A notation on each plan stating “the construction and use of the building must be in accordance with the Acoustic Report from Renzo Tonin and Associates dated 16 August 2011”.

d) The ramp grade to be designed in accordance with Section 2.5.3 of the Australian Standard for Off Street Car Parking (AS/NZS 2890.1) in relation to the following: - • Maximum grade of 1 in 4. • Provision of 2.0 metre grade transitions between the main grade

lines when the change in grade exceeds 12.5% • Grade changes to be designed and checked in accordance with

Appendix C to ensure vehicles will not scrape or bottom out. e) Clear sight lines at the property line to ensure adequate visibility between

vehicles leaving the driveways and pedestrians on the road frontage, including the provision of corner splays to each driveway or an area at least 2.0 metres long by 2.5 metres deep (within the property) by less than 1.2 metres in height measured from the edge of the exit land for the crossings.

f) The western vehicle crossing reduced in size to 5.5 metres in width, and labelled ‘vehicle traffic only’.

g) Ambulance parking area to be located within the two existing car spaces to the west of the entry forecourt.

h) A new pedestrian crossover to be labelled ‘pedestrian traffic only’ to be located a minimum of 1.0 metre to the east of the west drain, with corresponding crossover to the north side of Kernot Avenue, with designated pedestrian crossing between the two to be constructed at grade (no raised pedestrian crossing).

i) Redesign of the hard paving, fencing and landscape planter areas to the entry forecourt and front setback area to prevent the mixing of pedestrian and vehicle traffic.

j) A notation stating “the design of the car parking will follow the Australian Standard for Off Street Car Parking (AS/NZS 2890.1) with regard to: - • Where the side boundary of a spaces is a wall or a fence, or if there

are obstructions such as columns which restrict door openings, an additional 300mm in width for the space.

• The location of columns to satisfy the requirements of the design

envelope around a parked vehicle as per Figure 5.2 of the standard. 2. The development as shown on the endorsed plans must not be altered without

the written consent of the Responsible Authority. 3. The use of the building hereby permitted may only occur during the following

times: - • General School Use: - 9am to 3.30pm Monday to Friday. • After School Sports Training: - 5pm to 10pm Monday to Friday and 9am

to 6pm Saturday • Non-school sports or events: - not permitted at any time.

unless the Responsible Authority gives consent in writing.

4. The construction and fit out of the building hereby permitted must include the

specific materials, design features and equipment specified in the Acoustic report from Renzo Tonin and Associates dated 16 August 2011.

5. The use of the building hereby permitted must accord with: -

• The Acoustic report from Renzo Tonin and Associates dated 16 August 2011

• Noise Standard – State Environmental Protection Policy No.N-1 (SEPP N-1)

• Noise Standard – State Environmental Protection Policy No.N-2 (SEPP N-2)

6. Before the development permitted is completed, areas set aside for parked

vehicles and access lanes as shown on the endorsed plans must be: a) constructed to the satisfaction of the Responsible Authority; b) properly formed to such levels that they can be used in accordance with

the plans; c) surfaced with an all-weather sealcoat to the satisfaction of the

Responsible Authority; d) drained, maintained and not used for any other purpose to the

satisfaction of the Responsible Authority; e) line-marked to indicate each car space and all access lanes to the

satisfaction of the Responsible Authority.

Parking areas and access lanes must be kept available for these purposes at all times

7. Before occupation all buildings and works specified in this permit must be

completed to the satisfaction of the Responsible Authority. The Responsible Authority must be advised in writing when all construction and works are completed to enable the site to be inspected.

8. No bin or receptacle or any form of rubbish or refuse shall be allowed to remain in view of the public and no odour shall be emitted from any receptacle so as to cause offence to persons outside the land.

9. No equipment, services, architectural features or structures of any kind,

including telecommunication facilities, other than those shown on the endorsed plans shall be permitted above the roof level of the building unless otherwise agreed to in writing by the Responsible Authority.

10. A landscape plan prepared by a Landscape Architect or a suitably qualified or

experienced landscape designer, drawn to scale and dimensioned must be submitted to and approved by the Responsible Authority prior to the commencement of any works. The plan must show the proposed landscape treatment of the site including:-

• the location of all existing trees and other vegetation to be retained on site

• provision of canopy trees with spreading crowns located throughout the site including the major open space areas of the development

• planting to soften the appearance of hard surface areas such as driveways and other paved areas

• a schedule of all proposed trees, shrubs and ground cover, which will include the size of all plants (at planting and at maturity), their location, botanical names and the location of all areas to be covered by grass, lawn, mulch or other surface material

• the location and details of all fencing

• the extent of any cut, fill, embankments or retaining walls associated with the landscape treatment of the site

• details of all proposed hard surface materials including pathways, patio or decked areas

When approved the plan will be endorsed and will then form part of the permit.

11. Before the occupation of the buildings allowed by this permit, landscaping

works as shown on the endorsed plans must be completed to the satisfaction of the Responsible Authority and then maintained to the satisfaction of the Responsible Authority.

12. Before the development starts, a construction management plan must be

prepared and submitted to the Responsible Authority for approval. The plan must be to the satisfaction of the Responsible Authority. Once approved, the plan must be implemented to the satisfaction of the Responsible Authority. The plan must address the following issues: a) measures to control noise, dust and water runoff; b) prevention of silt or other pollutants from entering into the Council’s

underground drainage system or road network; c) the location of where building materials are to be kept during

construction; d) site security; e) maintenance of safe movements of vehicles to and from the site during the

construction phase; f) maintenance of safe and practical pedestrian movements g) parking of vehicles associated with construction activities; h) wash down areas for trucks and vehicles associated with construction

activities; i) cleaning and maintaining surrounding road surfaces; j) a requirement that construction works must only be carried out during the

following hours: • Monday to Friday (inclusive) - 7.00am to 6.00pm; • Saturday - 9am to 1pm; • Saturday - 1pm to 5pm (Only activities associated with the erection

of the building. This does not include excavation or the use of heavy machinery).

13. Before the development starts, a site layout plan drawn to scale and

dimensioned must be approved by the Responsible Authority.

The plans must show a drainage scheme providing for the collection of stormwater within the site and for the conveying of the stormwater to the nominated point of discharge.

The nominated point of discharge is the north-east corner of the property where the entire site’s stormwater must be collected and free drained via a pipe to the Council pit in the nature strip to be constructed to Council Standards. (A new pit is to be constructed if a pit does not exist or is not a standard Council pit).

If the point of discharge cannot be located then notify Council’s Engineering Division immediately.

14. All on-site stormwater is to be collected and from hard surface areas and must

not be allowed to flow uncontrolled into adjoining properties. The onsite drainage system must prevent discharge from each driveway onto the footpath. Such a system may include either: - a) A trench grate (150mm min internal width) located within the property;

and/or b) Shaping the driveway so that water is collected in a grated pit on the

property; and/or c) Another Council approved equivalent.

15. Once the development has started it must be continued and completed to the

satisfaction of the Responsible Authority.

NOTES- 1. Building approval must be obtained prior to the commencement of the above

approved works. 2. Any new drainage work within the road reserve requires the approval of the

City of Monash’s Engineering Division prior to the works commencing. Three copies of the plans (A3-A1 size) for the drainage works must be submitted to and approved by the Engineering Division. The plans are to show sufficient information to determine that the drainage works will meet all drainage conditions of the permit.

3. Engineering permits must be obtained for new or altered vehicle crossings and

for connections to Council pits and these works are to be inspected by Council (telephone 9518 3690).

4. Stormwater discharge is to be detained on-site to the predevelopment level of

peak stormwater discharge. Approval of any detention system is required from Council prior to works commencing.

5. An onsite detention system for storm events up to the 1% AEP event to be

retained for the basement car park. 6. A Licensed Surveyor or Civil Engineer (who is a Registered Building

Practitioner) must certify that the stormwater detention system including all levels, pits, pipes and storage volumes is constructed in accordance with the approved plans. The certifiers registration number must be included on the certificate.

7. A Traffic Management Plan is required prior to the issue of the Vehicle

Crossing Permits. Expiry of permit:

In accordance with section 68 of the Planning and Environment Act 1987, this permit will expire if one of the following circumstances applies: • The development is not started before 2 years from the date of issue. • The development is not completed before 4 years from the date of issue. In accordance with section 69 of the Planning and Environment Act 1987, the responsible authority may extend the periods referred to if a request is made in writing before the permit expires, or within three months afterwards.

Comprising 34 Dwellings Plus 2 Basement Car Parking Levels Comprising 41 Spaces Removal of 2 Crossovers To A Road Zone (Category 1) and Associated Reduction of Car Parking Requirements of Clause 52.06 of The Monash Planning Scheme

Council having caused notice of planning application No. TPA/39538 to be given under Section 52 of the Planning and Environment Act 1987 and having considered all the matters required under Section 60 of the Planning and Environment Act 1987 decides to refuse the application for the planning permit under the provisions of the Monash Planning Scheme in respect of the land known and described as 660-662 Waverley Road, Glen Waverley for the purpose of the development of a 4 storey building comprising 34 dwellings plus 2 basement car parking levels comprising 41 spaces removal of 2 crossovers to a road zone (category 1) and associated reduction of car parking requirements of clause 52.06 of the moansh planning scheme on the following grounds: 1. The proposed development is out of character with the surrounding area, in

particular with regard to excessive mass, bulk and scale. 2. The proposal is an overdevelopment of the site. 3. The proposal does not provide sufficient on-site car parking. 4. The proposal will have an adverse impact on the amenity of nearby properties,

in particular with regard to inappropriate visual impact and over-spill car parking onto the surrounding street network and leisure centre.

5. The proposal does not comply with necessary setback or fire separation

requirements.

6. Unsatisfactory provision for waste collection and pick up. and directs that the Applicant and each objector be given a notice of the Council’s decision to refuse the permit.

5.4 10-12 Prince Street, Clayton – A Three Level Building Comprising Twenty

Dwellings Plus Basement Car Park Moved Cr Perri, Seconded Cr McGill

Council having caused notice of planning application No. TPA/39689 to be given under Section 52 of the Planning and Environment Act 1987 and having considered all the matters required under Section 60 of the Planning and Environment Act 1987 decides to refuse the application for the planning permit under the provisions of the Monash Planning Scheme in respect of the land known and described as 10-12 Prince Street, Clayton for the purpose of developing the land by constructing a three level building comprising twenty dwellings plus basement car park on the following grounds: 1. The proposal does not adequately satisfy the objectives and/or design

standards of Clause 55 of the Monash Planning Scheme having regard to neighbourhood character.

2. The proposal is an overdevelopment of the site having regard to the extent of continuous unbroken building mass visible from Prince Street and adjoining land.

3. The proposed development is out of character with the existing development in the area in particular with regard to mass, bulk and scale.

4. The proposed development is not appropriate for the locality in regards to its adverse impact on the streetscape and general neighbourhood character.

5. The development provides for a poor level of internal amenity. and directs that the Applicant and each objector be given a notice of the Council’s decision to refuse the permit. Cr Perri noted that the proposal would represent an over-development of the site and had caused great concern to local residents.

Dwellings, Alteration of A Vehicle Accessway To A Road Zone - Category 1, Removal of Vegetation Within A Vegetation Protection Overlay 1 and A 20 Lot Subdivision

Council having caused notice of planning application No. TPA/39504 to be given under Section 52 of the Planning and Environment Act 1987 and having considered all the matters required under Section 60 of the Planning and Environment Act 1987 decides to refuse the application for the planning permit under the provisions of the Monash Planning Scheme in respect of the land known and described as 61-63 High Street Road and 8 Harold Street, Ashwood for the development of 20 dwellings, alteration of a vehicle accessway to a Road Zone- Category 1, removal of vegetation and a 20 lot subdivision on the following grounds: 1. The proposal is not consistent with the Local Planning Policy Framework at

Clauses 22.01 and 22.05 of the Monash Planning Scheme relating to Residential Development and Character and Tree Conservation.

2. The proposed development is out of character with the existing residential

development in the area, in particular having regard to its mass, bulk, height and scale.

3. The proposal is not consistent with the objectives and standards of Clause 55 of

the Monash Planning Scheme, particularly Neighbourhood Character, Internal Amenity, Overlooking, Private Open Space , Vehicle Access, Landscaping, Tree Removal, Energy Efficiency, Walls on Boundaries, Side Setbacks, and Dwelling Entry Standards.

4. The proposed development does not pay due regard to the Garden City and

Tree Conservation Policies within the Monash Planning Scheme. 5. The car parking layout does not provide for satisfactory vehicle movement. 6. Inadequate provision is made for vehicles to exit the site in a forwards

direction.

7. The proposal does not meet the private open space requirements of the Schedule to the Residential 1 Zone of the Monash Planning Scheme.

8. The proposed development as submitted is considered to constitute an

overdevelopment of the site. 9. There is a lack of provision of canopy trees and other plantings throughout site 10. The proposal would result in poor internal amenity for future residents. 11. The proposal would cause a loss of amenity to surrounding land.

and directs that the Applicant and each objector be given a notice of the Council’s decision to refuse the permit.

reconstruction of Hamilton Street, Oakleigh between Edward Street and Railway Avenue for the lump sum of $508,919.40 (GST inclusive).

2. The anticipated project expenditure of $515,654.00 (GST exclusive) for the

reconstruction, design and supervision be noted. 3. The Chief Executive Officer be authorised to sign and seal the contract

documents.

4. The Chief Executive Offer be authorised to approve any contract variations that are contained within the anticipated project expenditure.

That Council notes the Quarterly Website Report and in particular the following features: 1. Visits to the site during the period have increased by 17% over the same period a

year ago; 2. The number of pages accessed during the period has increased by 2% over the same

period a year. Cr Dimopoulos commended the work done on the new Council web site and added that despite his concerns about the weaknesses of Google Translate it has proved to be a beneficial addition to the site.

7. COMMITTEE REPORTS 7.1 Monash Community Grants Program - 2012 Allocations

That Council: 1. Adopts the recommended Monash Community Grants Program allocations

for the 2012 calendar year as per Attachment A to this report totalling $2,297,634 in cash and in kind support.

2. Allocates an additional: (i) $16,362 for Arts Cash Grants (ii) $97,604 of ‘in kind’ support to fund hall hire for arts and community groups. 3. Council considers in its budget development for the 2012/2013 financial year

to adjust the Community Grants Program hall hire budget by: (i) An additional $97,604 in 2012/13 to meet increased community demand; and (ii) An annual increase of 5% from 2012/13 to ensure the program maintains its

value against the annual adjustments in hall hire fees and that it continues to meet increasing community demand into the future.

4. In recognition of the number of growing requests placed on this program and subsequent increasing salary costs for agencies, it is recommended that Council considers a 3% increase to the 2011/12 direct cash budget of $985,890 to the Monash Community Grants Program in the development of the 2012/2013 budget to increase the total program budget to $1,015,500.

Cr Klisaris welcomed the Evaluation Panel’s report, adding that the process of allocating the funding was well managed and reflected the Council’s responsibility to maximise the value of the funding to the community. Cr Dimopoulos noted that the process of the funding allocation allowed the Council to obtain a great amount of information about the community, which leads to better policy making. The funding process also increased the level of engagement with the Council, by community groups. The Mayor noted that the Council’s process allowed for the distribution of funds across the community, to be maximised.

7.2 Community Grant Application – Dimitria Festival

That Council approves $5,000 for the Pan –Macedonian Association of Melbourne and Victoria Inc for the 2012 Dimitria Festival to be held in Oakleigh as part of the 2012 Community Grants allocations.

Cr Drieberg noted that this was a valuable event for the Monash community.

He advised that the Council had been invited to speak to the Joint Committee in support of its submission and this had taken place on 25 October 2011.
