Minutes of the 89th meeting of State Environment Impact Assessment Authority
held on. 28.03.2016 under the Chairmanship Sh. Bharat Bhushan IAS (Retd.),
Chairman, SEIAA held in the meeting room of office of SEIAA Haryana, Sector-2
Panchkula, regarding Environmental Clearance under EIA Notification dated
14.9.2006.
The full Authority is present. The Cases recommended by SEAC for
Environmental Clearance or otherwise as listed in the Agenda item circulated vide letter
No. 223-225 dated 22.03.2016 were discussed. Following decisions were taken:-
Item No.[1]Environmental Clearance for construction of Affordable Group Housing
Colony Project at Village Sohna & Khaika, Sector-4, Distt Gurgaon,
Haryana by M/s GLS Infratech Pvt. Ltd.
This case was lastly considered in the 84th meeting of SEIAA held on 29.10.2015
and the case was referred back to SEAC for reconsideration with the following
observations.
1. The project proponent has proposed to develop green area on 15.66% of the
project area whereas in the conditions it has been mentioned that the project
proponent shall maintain 20% green area. The project proponent on 28.10.2015
submitted revised plan showing 20% green area. The SEAC should examine the
same.
2. The SEAC shall ensure that the solid waste generation calculation and parking
calculation is as per latest prescribed norms and shall also ensure that the project
proponent has furnished details of appropriate technology to be adopted for
treatment of bio-degradable waste. The project proponent shall submit plan
depicting the area ear marked for composting.
3. The project proponent shall submit latest undertaking on non judicial stamp paper
stating that no construction has been raised at site duly signed by the director. The
project proponent shall also submit latest photograph of site.
4. The project proponent shall submit solar path analysis.
The SEAC in its 127th meeting held on 16.02.2016 considered the reply dated
24.11.2015 submitted by the project proponent on the above observations and again
recommended this case for environmental clearance. The recommendation of SEAC was
taken up for consideration in the today’s meeting. The reply submitted by project
proponent and considered by SEAC was found in order.
After detailed deliberation, the Authority decided to agree with the
recommendations of SEAC to accord Environment Clearance to this project by imposing
the following condition in addition to the usual conditions in practice.
[1] The project proponent shall install solar panel for energy conservation.
[2] The project proponent shall provide green area on 20.017% of project area.

[3] The project proponent shall essentially provide two numbers of STPs preferably
equivalent to 50% of total capacity or as per the initial occupancy as the case may
be.
[4] Adequate drinking water and sanitary facilities shall be provided for construction
workers at the site. Provision should be made for mobile toilets. Open defecation
by the laboures is strictly prohibited. The safe disposal of solid wastes/ waste water
generated during the construction phase should be ensured. Efforts shall be made to
provide mobile STP for treatment of waste water during the construction phase.
Item No.[2] Environmental Clearance for proposed project 15 Acres “Cyber Park”
at Village-Fazilpur, Jharsa & Bhadshahpur, Sector-69, Gurgaon,
Haryana by M/s Unitech Limited.
The SEAC has recommended this project for Environmental Clearance subject to
stipulation stated therein. The Project Proponent has proposed the construction of “Cyber
Park” at Village-Fazilpur, Jharsa & Bhadshahpur, Sector-69, Gurgaon, Haryana on a plot
area is 60702.75 sqm (15 Acres). The total built up area shall be 349976.90 sqm. The
proposed project shall comprise of 05 Towers in which 4 Basement + GF + maximum 21
floors. The maximum height of the building shall be 95.05 meters. The total water
requirement shall be 1174 KLD. The fresh water requirement shall be 340 KLD. The
waste water generation shall be 878 KLD, which will be treated in the 3 STPs of 500
KLD, 300 KLD & 200 KLD capacities.
The above recommendation of SEAC was taken up for consideration. Detailed
discussions were held regarding water requirement, quality of water, green belt
development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli
Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation
etc. It was found that the project proponent submitted the assurance of HUDA for supply
of water along with copies of EDC/IDC paid to HUDA for the services for supply of
water, sewerage connection and drainage system, NOC from DC Gurgaon regarding non
applicability of Aravalli Notification and NOC from AAI regarding height clearance. It
was noticed that the project proponent has proposed to use excavated Top soil for use of
landscaping and has proposed to stack the same in the project area covering the same
with Tarpaulin. The project proponent is required to give exact quantum of Top soil to be
excavated and also brief description for its preservation in order to control its erosion. It
was observed that as a mitigation measure under Water Environment due to improper
disposal of construction debris leading to offsite contamination of water reserves; the
project proponent has proposed disposal of construction debris in low lying area. The
project proponent is required to submit the area identified for the same. It was observed
that the project area is at a distance of 9 km from National Highway and is located along
90 meter wide Southern Peripheral Road and the project proponent on the basis of
PCU/hr calculated for NH-8 and Sohna Road has claimed that since carrying capacity of

NH-8 is much higher than proposed traffic volume therefore the traffic movement from
the proposed Cyber Park will not create any traffic congestion. The project proponent is
required to justify the same with authenticated proof.
In view of the above discussions the Authority decided to defer to this case with
the decision that the project proponent may be asked to submit reply to the below
mentioned observation within 15 days.
[1] The project proponent shall submit the details regarding provisions made for
preservation of Top soil in the project area in order to avoid its erosion.
[2] The project proponent shall submit the details regarding disposal method of
construction debris in the low lying area as reported in the EIA/EMP.
[3] The project proponent shall justify the claim that the carrying capacity of NH-8 is
much higher than the proposed traffic volume and traffic movement from the
proposed project will not create any congestion on NH-8 with calculations and
authenticated proof.
Item No.[3] Environmental Clearance for the proposed ‘Stone Along with
Associated Minor Minerals’ at ‘Ramalwas’ over an area of 12.25 Ha.
In Tehsil-Dadri, District-Bhiwani by M/s Kayden Infra Engineering
Pvt. Ltd.
The SEAC has recommended granting Environment Clearance to M/s Kayden
Infra Engineering Pvt. Ltd. for Mining of Minor Mineral for proposed ‘Ramalwas’ Stone
mines Along with Associated Minor Minerals’ at Village- Ramalwas over an area of
12.25 Ha in Tehsil-Dadri, District-Bhiwani by imposing stipulations stated therein.
The recommendation of SEAC was taken up for consideration in the today’s
meeting. It was noticed that the Mines and Geology Department has granted lease for a
period of 10 years subject to the terms and conditions as indicated in Letter of Intent (LOI)
dated 24.07.2015. The lease has been granted for an area of 12.25 Ha having Khasra no.
105/1, Village- Ramalwas. The project proponent on 12.09.2015 submitted online
application along with copy of approved Mining Plan under category B-2. The validity of
Mining Scheme in the Mining plan is for 5 years. It was noticed that The
Mines & Geology, Department has clarified that no other mine lease exists within 500
meter radius of this mine accordingly the SEAC appraised this project as category B-2.
NOC from Forest Department has been obtained.

After detailed deliberations, the Authority decided to agree with the
recommendations of SEAC to accord Environment Clearance to this project by imposing
the following conditions.
A. SPECIFIC CONDITIONS:
[1] This Environment Clearance is granted for Production of Stone along with
Associated Minerals as per below mentioned figures.

[2] The project proponent shall obtain prior CTO under Air Act and Water Act from
HSPCB and effectively implement all the conditions stipulated by the HSPCB.
[3] The project proponent shall carry out mining activity strictly as per the approved
Mining Plan.
[4] The project proponent shall ensure that the mining operations shall not intersect
groundwater table and the mining operation should be restricted at least 3 meter
above the ground water table.

[5] Topsoil shall be stacked temporarily at earmarked sites only and it shall not be
kept unutilized for a period more than three years; it shall be used for land
reclamation and plantation in mined out areas.
[6] The project proponent shall ensure that no natural water course/water body shall
be obstructed due to any mining operations.
[7] The over burden generated shall be stacked at earmarked dump site (s) only and it
shall not be kept active for long period of time. The maximum height of the
already existing waste dumps shall not exceed 5 meter in single terraces and the
slope angle shall not exceed 28o as per norms.
[8] The dumping site selected and proposed shall be used for OB dump at the
designated site within the lease area as per the approved mine plan. In no case the
overburden should be dumped outside the lease area.
[9] The benches height and slope shall be maintained as per approved mining plan.
[10] Waste dump shall be terraced. The height of the dump and its slope shall not
exceed as suggested in the approved mining plan. A retaining wall shall be
constructed at the toe of the dump.
[11] Garland drains shall be constructed to prevent the flow of the water in the dumps.
[12] Check dams shall be constructed in the seasonal rivulets to prevent the flow of
fines to low lying areas during rains.
[13] The total waste generated in the present plan period shall be as envisaged, which
shall be accommodated in old dumpsite in addition to the waste already dumped.
Monitoring and management of rehabilitated areas shall continue until the
vegetation becomes self sustaining. Compliance status shall be submitted to
HSPCB and MOEF Zonal Office, Chandigarh on six monthly bases.
[14] Drills shall either be operated with dust extractors or equipped with water injection
system.
[15] The higher benches of excavated void/mining pit shall be terraced and plantation
done to stabilize the slopes. The slop of higher benches shall be made gentler for
easy accessibility by local people to use the water body. Peripheral fencing shall
be carried out along the excavated area.
[16] Catch drains and siltation ponds of appropriate size shall be constructed for the
working pit, OB dumps and mineral dumps to arrest flow of silt and sediment. The
water so collected shall be utilized for watering the mine area, roads, green belt
development etc. The drains shall be regularly de-silted, particularly after
monsoon and maintained properly.
[17] Garland drains; setting tanks and check dams of appropriate size, gradient and
length shall be constructed both around the mine pit and over burden dumps and
sump capacity shall be designed keeping 50% safety margin over and above peak

sudden rainfall (based on 50 years data) and maximum discharge in the area
adjoining the mine site. Sump capacity shall also provide adequate pits shall be
constructed at the corners of the garland drains and de-silted.
[18] Dimension of the retaining wall at the toe of dumps and OB benches within the
mine to check run-off and siltation shall be based on the rainfall data.
[19] Green belt should be developed as per the proposed plantation as given in the
proposal. Plantation should be carried out in phased manner. The green belt
should be developed in the safety zone around the mining lease by planting the
native species around ML area, OB dumps, backfilled and reclaimed around water
body, road etc. in consultation with the local DFO/Agriculture Department.
[20] Regular water sprinkling shall be carried out in critical areas prone to air pollution
and having high levels of SPM and RPM such as haul road, loading and unloading
point and transfer points. It shall be ensured that the Ambient Air Quality
Parameters conform to the norms prescribed by the CPCB.
[21] The project authority shall implement suitable conservation measures to augment
ground water resources in the area in consultation with the Regional Director,
Central Ground Water Board.
[22] Regular monitoring of ground water level and quality shall be carried out in and
around the mine lease. The monitoring shall be carried out four times in a year-pre
monsoon (April-May), monsoon (August), post monsoon (November); winter
(January) and the data thus collected may be sent regularly to MOEF Regional
Office, Chandigarh and Regional Director CGWB.
[23] Data on ambient air quality and stack emissions shall be submitted to Haryana
Pollution Control Board once in six months carried out by
MOEF/NABL/CPCB/Government approved lab.
[24] Vehicular emissions shall be kept under control and regularly monitored.
Measures shall be taken for maintenance of vehicles used in mining operations and
in transportation of mineral. The vehicles shall be covered with a tarpaulin and
shall not be overloaded. The project proponent shall ensure that the vehicle must
have pollution under control certificate.
[25] Blasting operation shall be carried out only during the daytime. Controlled
blasting shall be practiced. The mitigation measures for control of ground
vibrations and to arrest fly rocks and boulders shall be implemented.
[26] The blasting operation will be carried out as per the norms of Director (Mines &
Safety), Gaziabad. Take all safety measures as per the various mining regulations.
[27] The project proponent shall take all precautionary measures during mining
operations for conservation and protection of endangered fauna, if any, spotted in
the study area. A plan for conservation shall be drawn and approved by the State

Wildlife Department. Necessary allocation of funds for implementation of the
conservation plan shall be made and the funds so allocated shall be included in the
project cost. All the safeguard measures brought out in the wildlife conservation
plan so prepared specific to the project site shall be effectively implemented. A
copy of action plan may be submitted to the HSPCB and MOEF, Regional Office,
Chandigarh within 3 months.
[28] As envisaged, the Project Proponent shall invest at least an amount of Rs. 13.50
lakh as cost for implementing various environmental protection measures
including recurring expenses per year.
[29] A sum of Rs. 20 lakh shall be earmarked by the Project proponent for
investment as CSR on socio economic up-liftment activities of the area
particularly in the area of habitat, health or education, training programme of rural
women & man provide the kit for employment generation. The proposal should
contain provision for monthly medical camps, distributions of medicines and
improvement in educational facilities in the nearby schools. Details of such
activity along with time bound action plan be submitted to HSPCB/SEIAA
Haryana before the start of operation.
[30] Budgetary provision of Rs. 05 lakh per year earmarked for the labours working in
the Mine for all necessary infrastructure facilities such as health facility, sanitation
facility, fuel for cooking, along with safe drinking water, medical camps and
toilets for women, crèche for infants should be made and submitted to HSPCB at
the time of CTO/SEIAA Haryana. The housing facilities should be provided
for mining labours.
[31] A Final Mine Closure Plan along with details of corpus fund shall be submitted to
the SEIAA well within the stipulated period as prescribed in the minor mineral
concession rules 2012.
[32] The water reservoir, which would be created/available during post closure (all
pits), shall be provided with suitable benches and fencing to provide the access to
the water body and safety.
[33] The project proponent shall ensure that the EC letter as well as the status of
compliance of EC conditions and the monitoring data are placed on company’s
website and displayed at the project site.
[34] The project proponent shall ensure that loading in Trucks do not exceed the norms
fixed by the Transport Department as per relevant rules.
[35] The project proponent shall ensure approach roads are widened and strengthened
as per requirements fixed by PWD and district administration before the start of
the work.

[36] The project proponent shall ensure that all measures are taken simultaneously for
safeguard and maintenance of the health of the workers.
[37] The project proponent shall ensure supply of drinking water through RO.
GENERAL CONDITIONS:
[i] Any change in mining technology/scope of working shall not be made without
prior approval of the SEIAA.
[ii] Any change in the calendar plan including excavation, quantum of mineral and
waste shall not be made.
[iii] Periodic monitoring of ambient air quality shall be carried out for PM10, PM2.5,
SO2 and NOx monitoring. Location of the stations (minimum 6) shall be decided
based on the meteorological data, topographical features and environmentally and
ecologically sensitive targets and frequency of monitoring shall be decided in
consultation with the Haryana State Pollution Control Board (HSPCB). Six
monthly reports of the data so collected shall be regularly submitted to the
HSPCB/CPCB including the MOEF, Regional office, Chandigarh.
[iv] Measures shall be taken for control of noise levels below 85 dBA in the work
environment. Workers engaged in operations of HEMM etc. shall be provided
with earplugs/muffs.
[v] Waste water (workshop and waste water from the mine) shall be properly
collected & treated so as to conform to the standards prescribed under GSR 422
(E) dated 19th May 93 and 31st December 1993 (amended to date). Oil and grease
trap shall be installed before discharge.
[vi] Personnel working in dusty areas shall wear protective respiratory devices they
shall also be provided with adequate training and information on safety and health
aspects.
[vii] Occupational health surveillance program of the workers shall be undertaken
periodically to observe any contractions due to exposure to dust and take
corrective measures, if needed.
[viii] The funds earmarked for environmental protection measures shall be kept in
separate account and shall not be diverted for other purpose. Year wise
expenditure shall be reported to the HSPCB and the Regional office of MOEF
located at Chandigarh.
[ix] The project proponent shall also submit six monthly reports on the status of
compliance of the stipulated EC conditions including results of monitored data
(both in hard copies as well as by e-mail) to the northern Regional Office of
MoEF, the respective Office of CPCB, HSPCB and SEIAA Haryana.
[x] The SEIAA, Haryana reserves the right to add new conditions, modify/annual any
of the stipulated conditions and/or to revoke the clearance if implementation of

any of the condition stipulated by SEIAA, Haryana or any other competent
authorities is not satisfactory.
[xi] Failure to comply with any of the conditions mentioned above may result in
withdrawal of this clearance and attract action under the provisions of
Environment (Protection) Act, 1986.
[xii] The above conditions will be enforced, inter alia, under the provision of the Water
(Prevention & Control of Pollution) Act, 1974 the Air (Prevention & Control of
Pollution) Act, 1981, the Environment (Protection) Act, 1986 and the Public
Liability Insurance Act 1991 (all amended till date) and rules made hereunder and
also any other orders passed by the Honb’le Supreme Court of India/High Court of
Haryana and other Court of law relating to the subject matter.
[xiii] The Project proponent should inform the public that the project has been accorded
Environment Clearance by the SEIAA and copies of the clearance letter are
available with the Haryana State Pollution Control Board & SEIAA. This should
be advertised within 7 days from the date of issue of the clearance letter at least in
two local newspapers that are widely circulated in the region and the copy of the
same should be forwarded to SEIAA Haryana. A copy of Environment Clearance
conditions shall also be put on project proponent’s web site for public awareness.
[xiv] All the other statutory clearances such as the approvals for storage of diesel from
the Chief Controller of Explosives, Fire department, Civil Aviation Department,
Forest Conservation Act, 1980 and Wildlife (protection) Act, 1972 etc. shall be
obtained, as may be applicable, by Project proponent from the competent authority
before the start of mining operation.
[xv] That the grant of this EC is issued from the environmental angle only, and does
not absolve the project proponent from the other statutory obligations prescribed
under any other law or any other instrument in force. The sole and complete
responsibility, to comply with the conditions laid down in all other laws for the
time being in force, rests with the industry/unit/project proponent. Any appeal
against this environmental clearance shall lie with the National Green Tribunal, if
preferred, within a period of 30 days as prescribed under section 16 of National
Green Tribunal Act, 2010.
Item No.[4] Environmental Clearance for the proposed “Stone Along with
Associated Minor Minerals’ at ‘Maikalan & Maikhurd’ over an area of
3.65 Ha. In Tehsil Dadri, District-Bhiwani by M/s Hari Har Mining
Company.
The SEAC has recommended granting Environment Clearance to M/s Hari Har
Mining Company for Mining of Minor Mineral for proposed ‘‘Maikalan & Maikhurd’
Stone mines Along with Associated Minor Minerals’ at Village- Maikalan & Maikhurd
over an area of 3.65 Ha. In Tehsil Dadri, District-Bhiwani by imposing stipulations stated
therein.

The recommendation of SEAC was taken up for consideration in the today’s
meeting. It was observed that the mine lease area is less than 5 Ha and as such the
environmental clearance in this case is to be granted by DEIAA/DEAC in view of
amendment to the Notification dated 15.01.2016. It was found that MoEF & CC, GoI vide
letter no. Z-11013/8/2016-IA.II (M) dated 15.03.2016 has clarified that where SEAC has
recommended the cases for environmental clearance such cases are to be processed at the
level of SEIAA for grant of environmental clearance. Accordingly it was decided to take
up the case as recommended by SEAC. It was noticed that the Mines and Geology
Department has granted lease for a period of 10 years subject to the terms and conditions
as indicated in Letter of Intent (LOI) dated 24.07.2015. The lease has been granted for an
area of 3.65 Ha having Khasra no. 315, 230 & 233 village- Maikalan & Maikhurd. The
project proponent on 13.08.2015 submitted online application along with copy of approved
Mining Plan under category B-2. The validity of Mining Scheme in the Mining plan is for
5 years. It was noticed that The Mines & Geology, Department has clarified that no other
mine lease exists within 500 meter radius of this mine accordingly the SEAC appraised
this project as category B-2. NOC from Forest Department has been obtained.

done to stabilize the slopes. The slop of higher benches shall be made gentler for
easy accessibility by local people to use the water body. Peripheral fencing shall

[16] Catch drains and siltation ponds of appropriate size shall be constructed for the
working pit, OB dumps and mineral dumps to arrest flow of silt and sediment. The
water so collected shall be utilized for watering the mine area, roads, green belt
development etc. The drains shall be regularly de-silted, particularly after
monsoon and maintained properly.
[17] Garland drains; setting tanks and check dams of appropriate size, gradient and
length shall be constructed both around the mine pit and over burden dumps and
sump capacity shall be designed keeping 50% safety margin over and above peak
sudden rainfall (based on 50 years data) and maximum discharge in the area
adjoining the mine site. Sump capacity shall also provide adequate pits shall be
constructed at the corners of the garland drains and de-silted.
[18] Dimension of the retaining wall at the toe of dumps and OB benches within the
mine to check run-off and siltation shall be based on the rainfall data.
[19] Green belt should be developed as per the proposed plantation as given in the
proposal. Plantation should be carried out in phased manner. The green belt
should be developed in the safety zone around the mining lease by planting the
native species around ML area, OB dumps, backfilled and reclaimed around water
body, road etc. in consultation with the local DFO/Agriculture Department.
[20] Regular water sprinkling shall be carried out in critical areas prone to air pollution
and having high levels of SPM and RPM such as haul road, loading and unloading

point and transfer points. It shall be ensured that the Ambient Air Quality
Parameters conform to the norms prescribed by the CPCB.
[21] The project authority shall implement suitable conservation measures to augment
ground water resources in the area in consultation with the Regional Director,
Central Ground Water Board.
[22] Regular monitoring of ground water level and quality shall be carried out in and
around the mine lease. The monitoring shall be carried out four times in a year-pre
monsoon (April-May), monsoon (August), post monsoon (November); winter
(January) and the data thus collected may be sent regularly to MOEF Regional
Office, Chandigarh and Regional Director CGWB.
[23] Data on ambient air quality and stack emissions shall be submitted to Haryana
Pollution Control Board once in six months carried out by
MOEF/NABL/CPCB/Government approved lab.
[24] Vehicular emissions shall be kept under control and regularly monitored.
Measures shall be taken for maintenance of vehicles used in mining operations and
in transportation of mineral. The vehicles shall be covered with a tarpaulin and
shall not be overloaded. The project proponent shall ensure that the vehicle must
have pollution under control certificate.
[25] Blasting operation shall be carried out only during the daytime. Controlled
blasting shall be practiced. The mitigation measures for control of ground
vibrations and to arrest fly rocks and boulders shall be implemented.
[26] The blasting operation will be carried out as per the norms of Director (Mines &
Safety), Gaziabad. Take all safety measures as per the various mining regulations.
[27] The project proponent shall take all precautionary measures during mining
operations for conservation and protection of endangered fauna, if any, spotted in
the study area. A plan for conservation shall be drawn and approved by the State
Wildlife Department. Necessary allocation of funds for implementation of the
conservation plan shall be made and the funds so allocated shall be included in the
project cost. All the safeguard measures brought out in the wildlife conservation
plan so prepared specific to the project site shall be effectively implemented. A
copy of action plan may be submitted to the HSPCB and MOEF, Regional Office,
Chandigarh within 3 months.
[28] As envisaged, the Project Proponent shall invest at least an amount of Rs. 11.50
lakh as cost for implementing various environmental protection measures
including recurring expenses per year.
[29] A sum of Rs. 17 lakh shall be earmarked by the Project proponent for
investment as CSR on socio economic up-liftment activities of the area
particularly in the area of habitat, health or education, training programme of rural

women & man provide the kit for employment generation. The proposal should
contain provision for monthly medical camps, distributions of medicines and
improvement in educational facilities in the nearby schools. Details of such
activity along with time bound action plan be submitted to HSPCB/SEIAA
Haryana before the start of operation.
[30] Budgetary provision of Rs. 05 lakh per year earmarked for the labours working in
the Mine for all necessary infrastructure facilities such as health facility, sanitation
facility, fuel for cooking, along with safe drinking water, medical camps and
toilets for women, crèche for infants should be made and submitted to HSPCB at
the time of CTO/SEIAA Haryana. The housing facilities should be provided
for mining labours.
[31] A Final Mine Closure Plan along with details of corpus fund shall be submitted to
the SEIAA well within the stipulated period as prescribed in the minor mineral
concession rules 2012.
[32] The water reservoir, which would be created/available during post closure (all
pits), shall be provided with suitable benches and fencing to provide the access to
the water body and safety.
[33] The project proponent shall ensure that the EC letter as well as the status of
compliance of EC conditions and the monitoring data are placed on company’s
website and displayed at the project site.
[34] The project proponent shall ensure that loading in Trucks do not exceed the norms
fixed by the Transport Department as per relevant rules.
[35] The project proponent shall ensure approach roads are widened and strengthened
as per requirements fixed by PWD and district administration before the start of
the work.
[36] The project proponent shall ensure that all measures are taken simultaneously for
safeguard and maintenance of the health of the workers.
[37] The project proponent shall ensure supply of drinking water through RO.
GENERAL CONDITIONS:
[i] Any change in mining technology/scope of working shall not be made without
prior approval of the SEIAA.
[ii] Any change in the calendar plan including excavation, quantum of mineral and
waste shall not be made.
[iii] Periodic monitoring of ambient air quality shall be carried out for PM10, PM2.5,
SO2 and NOx monitoring. Location of the stations (minimum 6) shall be decided
based on the meteorological data, topographical features and environmentally and
ecologically sensitive targets and frequency of monitoring shall be decided in
consultation with the Haryana State Pollution Control Board (HSPCB). Six

monthly reports of the data so collected shall be regularly submitted to the
HSPCB/CPCB including the MOEF, Regional office, Chandigarh.
[iv] Measures shall be taken for control of noise levels below 85 dBA in the work
environment. Workers engaged in operations of HEMM etc. shall be provided
with earplugs/muffs.
[v] Waste water (workshop and waste water from the mine) shall be properly
collected & treated so as to conform to the standards prescribed under GSR 422
(E) dated 19th May 93 and 31st December 1993 (amended to date). Oil and grease
trap shall be installed before discharge.
[vi] Personnel working in dusty areas shall wear protective respiratory devices they
shall also be provided with adequate training and information on safety and health
aspects.
[vii] Occupational health surveillance program of the workers shall be undertaken
periodically to observe any contractions due to exposure to dust and take
corrective measures, if needed.
[viii] The funds earmarked for environmental protection measures shall be kept in
separate account and shall not be diverted for other purpose. Year wise
expenditure shall be reported to the HSPCB and the Regional office of MOEF
located at Chandigarh.
[ix] The project proponent shall also submit six monthly reports on the status of
compliance of the stipulated EC conditions including results of monitored data
(both in hard copies as well as by e-mail) to the northern Regional Office of
MoEF, the respective Office of CPCB, HSPCB and SEIAA Haryana.
[x] The SEIAA, Haryana reserves the right to add new conditions, modify/annual any
of the stipulated conditions and/or to revoke the clearance if implementation of
any of the condition stipulated by SEIAA, Haryana or any other competent
authorities is not satisfactory.
[xi] Failure to comply with any of the conditions mentioned above may result in
withdrawal of this clearance and attract action under the provisions of
Environment (Protection) Act, 1986.
[xii] The above conditions will be enforced, inter alia, under the provision of the Water
(Prevention & Control of Pollution) Act, 1974 the Air (Prevention & Control of
Pollution) Act, 1981, the Environment (Protection) Act, 1986 and the Public
Liability Insurance Act 1991 (all amended till date) and rules made hereunder and
also any other orders passed by the Honb’le Supreme Court of India/High Court of
Haryana and other Court of law relating to the subject matter.
[xiii] The Project proponent should inform the public that the project has been accorded
Environment Clearance by the SEIAA and copies of the clearance letter are

available with the Haryana State Pollution Control Board & SEIAA. This should
be advertised within 7 days from the date of issue of the clearance letter at least in
two local newspapers that are widely circulated in the region and the copy of the
same should be forwarded to SEIAA Haryana. A copy of Environment Clearance
conditions shall also be put on project proponent’s web site for public awareness.
[xiv] All the other statutory clearances such as the approvals for storage of diesel from
the Chief Controller of Explosives, Fire department, Civil Aviation Department,
Forest Conservation Act, 1980 and Wildlife (protection) Act, 1972 etc. shall be
obtained, as may be applicable, by Project proponent from the competent authority
before the start of mining operation.
[xv] That the grant of this EC is issued from the environmental angle only, and does
not absolve the project proponent from the other statutory obligations prescribed
under any other law or any other instrument in force. The sole and complete
responsibility, to comply with the conditions laid down in all other laws for the
time being in force, rests with the industry/unit/project proponent. Any appeal
against this environmental clearance shall lie with the National Green Tribunal, if
preferred, within a period of 30 days as prescribed under section 16 of National
Green Tribunal Act, 2010.

Tehsil-Narnaul, District-Mahendergarh by imposing stipulations stated therein.
The recommendation of SEAC was taken up for consideration in the today’s
meeting. It was noticed that the Mines and Geology Department has granted lease for a
period of 10 years subject to the terms and conditions as indicated in Letter of Intent (LOI)
dated 02.09.2015. The lease has been granted for an area of 9.55 Ha having Khasra no. 61
min village- Karota. The project proponent on 19.10.2015 submitted online application
along with copy of approved Mining Plan under category B-2. The validity of Mining
Scheme in the Mining plan is for 5 years. It was noticed that The Mines & Geology,
Department has clarified that no other mine lease exists within 500 meter radius of this
mine accordingly the SEAC appraised this project as category B-2. NOC from Forest
Department has been obtained.

shall not be kept active for long period of time. The maximum height of the
already existing waste dumps shall not exceed 5 meter in single terraces and the
slope angle shall not exceed 28o as per norms.
[8] The dumping site selected and proposed shall be used for OB dump at the
designated site within the lease area as per the approved mine plan. In no case the
overburden should be dumped outside the lease area.
[9] The benches height and slope shall be maintained as per approved mining plan.

Yamuna Mining Co. for Mining of Boulder, Gravel and Sand of “Bhood Kalan Block
/YNR B-19” at Village- Bhood Kalan over an area of 12.62 Ha by imposing stipulations
stated therein.

period of 07 years subject to the terms and conditions as indicated in Letter of Intent (LOI)
dated 19.06.2015. The lease has been granted for an area of 12.62 Ha having Village-
Bhood Kalan Block /YNR B-19. The project proponent on 11.09.2015 submitted online
application along with copy of approved Mining Plan under category B-2. The validity of
Mining Scheme in the Mining plan is for 5 years. It was noticed that The

After detailed deliberations, the Authority decided to agree with the
recommendations of SEAC to accord Environment Clearance to this project by imposing
the following conditions.
A. SPECIFIC CONDITIONS:
[1] This Environment Clearance is granted for the proposed production for the five
years @ 2,59,000 TPA. The ultimate depth of Mining will be 9 meter. The
alivation range of mine site is 297-298 armsl. The Corner Coordinates of the
leased area are:

[2] The project proponent shall carry out mining activity strictly as per the approved
Mining Plan.
[3] Environmental Clearance is subject to obtaining clearance, under the Wildlife
(Protection) Act, 1972 from the National Board of Wildlife, as applicable to the
project.
[4] No mining activities will be allowed in forest area, if any, for which the Forest
Clearance is not available.
[5] The Project proponent shall obtain consent to Operate from the State Pollution
control Board, Haryana and effectively implement all the conditions stipulated
therein.
[6] Project Proponent shall appoint an Occupational Health Specialist for Regular and
Periodical medical examination of the workers engaged in the project and records
maintained; also, Occupational health check-ups for workers having some
aliments like BP, diabetes, habitual smokers, etc. shall be undertaken once in six
months and necessary remedial/preventive measures taken accordingly.
Recommendations of National Institute for labour for ensuring good occupational
environment for mine workers would also be adopted.

[7] Project Proponent shall appoint a Monitoring Committee to monitor the
replenishment study, traffic management, levels of production, River Bank erosion
and maintenance of Road etc.
[8] The number of trips of the trucks shall not exceed the estimated quantity of 875
Mt/day @35 Trips/day (25 Mt/Trip). Transport of minerals shall be done either by
dedicated road or it should be ensured that the trucks/dumpers carrying the mineral
should not be allowed to pass thought the villages.
[9] Project Proponent shall ensure that the road may not be damaged due to
transportation of the mineral; and transport of minerals will be as per IRC
Guidelines with respect to complying with traffic congestion and density.
[10] Excavation will be carried out up to a maximum depth of 3 meters from surface of
mineral deposit and not less than one meter from the water level of the River
channel whichever is reached earlier.
[11] The pollution due to transportation load on the environment will be effectively
controlled & water sprinkling will also be done regularly. Vehicles with PUCC
only will be allowed to ply. The mineral transportation shall be carried out through
covered trucks only and the vehicles carrying the mineral shall not be overloaded.
Project should obtain ‘PUC’ certificate for all the vehicles from authorized
pollution testing centre.
[12] Washing of all transport vehicles should be done inside the mining lease.
[13] Permanent pillars has to be constructed to demarcate width of extraction of ROM
leaving 25% of River width from the bank with depth of 1.5m below the ground
and 1.2 m above the ground to observe its stability.
[14] There shall be planning, developing and implementing facility of rainwater
harvesting measures on long term basis in consultation with Regional Director,
Central Groundwater Board and implementation of conservation measures to
augment ground water resources in the area in consultation with Central Ground
Water Board.
[15] The Project Proponent shall also take all precautionary measures during mining
operation for conservation and protection of endangered flora/fauna, if any,
spotted in the study area.
[16] Main haulage road in the mine should be provided with permanent water
sprinklers and other roads should be regularly wetted with water tankers fitted
with sprinklers.
[17] Provision shall be made for the housing of construction labour within the site with
all necessary infrastructure and facilities such as fuel for cooking, mobile toilets,
mobile STP, safe drinking water, medical health care, crèche etc. The housing may

be in the form of temporary structures to be removed after the completion of the
project.
[18] No River sand mining shall be allowed in rainy season.
[19] The project proponent shall submit annual replenishment report certified by an
authorized agency. In case the replenishment is lower than the approved rate of
production, then the mining activity/ production levels shall be decreased/ stopped
accordingly till the replenishment is completed.
[20] In River flood plain mining a buffer of 3 meter to be left from the River bank for
mining.
[21] The project proponent shall ensure that no natural water course/water body shall
be obstructed due to any mining operations.
[22] The dumping site selected and proposed shall be used for OB dump at the
designated site within the lease area as per the approved mine plan. In no case the
overburden should be dumped outside the lease area.
[23] Garland drains shall be constructed to prevent the flow of the water in the dumps.
[24] Green belt should be developed as per the proposed plantation as given in the
proposal. Plantation should be carried out in phased manner. The green belt
should be developed in the safety zone around the mining lease by planting the
native species around lease boundary and haul roads , backfilled and reclaimed
around water body, road etc. in consultation with the local DFO/Agriculture
Department.
[25] Regular water sprinkling shall be carried out in critical areas prone to air pollution
and having high levels of SPM and RPM such as haul road, loading and unloading
point and transfer points. It shall be ensured that the Ambient Air Quality
Parameters conform to the norms prescribed by the CPCB.
[26] Regular monitoring of ground water level and quality shall be carried out in and
around the mine lease. The monitoring shall be carried out four times in a year-pre
monsoon (April-May), monsoon (August), post monsoon (November); winter
(January) and the data thus collected may be sent regularly to MOEF Regional
Office, Chandigarh and Regional Director CGWB.
[27] Data on ambient air quality and stack emissions shall be submitted to Haryana
Pollution Control Board once in six months carried out by
MOEF/NABL/CPCB/Government approved lab.
[28] Vehicular emissions shall be kept under control and regularly monitored.
Measures shall be taken for maintenance of vehicles used in mining operations and
in transportation of mineral. The vehicles shall be covered with a tarpaulin and
shall not be overloaded. The project proponent shall ensure that the vehicle must
have pollution under control certificate.

[29] The project proponent shall take all precautionary measures during mining
operations for conservation and protection of endangered fauna, if any, spotted in
the study area. A plan for conservation shall be drawn and approved by the State
Wildlife Department. Necessary allocation of funds for implementation of the
conservation plan shall be made and the funds so allocated shall be included in the
project cost. All the safeguard measures brought out in the wildlife conservation
plan so prepared specific to the project site shall be effectively implemented. A
copy of action plan may be submitted to the HSPCB and MOEF, Regional Office,
Chandigarh within 3 months.
[30] As envisaged, the Project Proponent shall invest at least an amount of Rs. 9.25
lakh as cost for implementing various environmental protection measures
including recurring expenses per year.
[31] A sum of Rs. 10.25 lakh shall be earmarked by the Project proponent for
investment as CSR on socio economic up-liftment activities of the area
particularly in the area of habitat, health or education, training programme of rural
women & man provide the kit for employment generation. The proposal should
contain provision for monthly medical camps, distributions of medicines and
improvement in educational facilities in the nearby schools. Details of such
activity along with time bound action plan be submitted to HSPCB/SEIAA
Haryana before the start of operation.
[32] Budgetary provision of Rs. 05 lakh per year earmarked for the labours working in
the Mine for all necessary infrastructure facilities such as health facility, sanitation
facility, fuel for cooking, along with safe drinking water, medical camps and
toilets for women, crèche for infants should be made and submitted to HSPCB at
the time of CTE/CTO/SEIAA Haryana. The housing facilities should be provided
for mining labours.
[33] A Final Mine Closure Plan along with details of corpus fund shall be submitted to
the SEIAA well within the stipulated period as prescribed in the minor mineral
concession rules 2012..
[34] The project proponent shall ensure that the EC letter as well as the status of
compliance of EC conditions and the monitoring data are placed on company’s
website and displayed at the project site.
[35] The project proponent shall ensure that loading in Trucks do not exceed the norms
fixed by the Transport Department as per relevant rules.
[36] The project proponent shall ensure approach roads are widened and strengthened
as per requirements fixed by PWD and district administration before the start of
the work.
[37] The project proponent shall ensure supply of drinking water through RO.

GENERAL CONDITIONS:
[i] Concealing factual data or submission of false/fabricated data and failure to
comply with any of the conditions mentioned above may result in withdrawal of
this clearance and attract action under the provisions of the Environment
(Protection) Act, 1986.
[ii] Any change in mining technology/scope of working shall not be made without
prior approval of the SEIAA.
[iii] Any change in the calendar plan including excavation, quantum of mineral and
waste shall not be made.
[iv] Periodic monitoring of ambient air quality shall be carried out for PM10, PM2.5,
SO2 and NOx monitoring. Location of the stations (minimum 6) shall be decided
based on the meteorological data, topographical features and environmentally and
ecologically sensitive targets and frequency of monitoring shall be decided in
consultation with the Haryana State Pollution Control Board (HSPCB). Six
monthly reports of the data so collected shall be regularly submitted to the
HSPCB/CPCB including the MOEF, Regional office, Chandigarh.
[v] Personnel working in dusty areas shall wear protective respiratory devices they
shall also be provided with adequate training and information on safety and health
aspects.
[vi] Occupational health surveillance program of the workers shall be undertaken
periodically to observe any contractions due to exposure to dust and take
corrective measures, if needed.
[vii] The funds earmarked for environmental protection measures shall be kept in
separate account and shall not be diverted for other purpose. Year wise
expenditure shall be reported to the HSPCB and the Regional office of MOEF
located at Chandigarh.
[viii] The project proponent shall also submit six monthly reports on the status of
compliance of the stipulated EC conditions including results of monitored data
(both in hard copies as well as by e-mail) to the northern Regional Office of
MoEF, the respective Office of CPCB, HSPCB and SEIAA Haryana.
[ix] The above conditions will be enforced, inter alia, under the provision of the Water
(Prevention & Control of Pollution) Act, 1974 the Air (Prevention & Control of
Pollution) Act, 1981, the Environment (Protection) Act, 1986 and the Public
Liability Insurance Act 1991 (all amended till date) and rules made hereunder and
also any other orders passed by the Honb’le Supreme Court of India/High Court of
Haryana and other Court of law relating to the subject matter.
[x] The Project proponent should inform the public that the project has been accorded
Environment Clearance by the SEIAA and copies of the clearance letter are

available with the Haryana State Pollution Control Board & SEIAA. This should
be advertised within 7 days from the date of issue of the clearance letter at least in
two local newspapers that are widely circulated in the region and the copy of the
same should be forwarded to SEIAA Haryana. A copy of Environment Clearance
conditions shall also be put on project proponent’s web site for public awareness.
[xi] All the other statutory clearances such as the approvals for storage of diesel from
the Chief Controller of Explosives, Fire department, Civil Aviation Department,
Forest Conservation Act, 1980 and Wildlife (protection) Act, 1972 etc. shall be
obtained, as may be applicable, by Project proponent from the competent authority
before the start of mining operation.
[xii] That the grant of this EC is issued from the environmental angle only, and does
not absolve the project proponent from the other statutory obligations prescribed
under any other law or any other instrument in force. The sole and complete
responsibility, to comply with the conditions laid down in all other laws for the
time being in force, rests with the industry/unit/project proponent. Any appeal
against this environmental clearance shall lie with the National Green Tribunal, if
preferred, within a period of 30 days as prescribed under section 16 of National
Green Tribunal Act, 2010.
Item No.[7] Environmental Clearance for proposed Special Economic Zone at Village
Behrampur, Balola & Bandhwari, Gurgaon by M/s G.P.Realtors Pvt.
Ltd.
The SEAC has recommended this project for Environmental Clearance subject to
stipulation stated therein. The Project Proponent has proposed the construction of Special
Economic Zone at Village Behrampur, Balola & Bandhwari, Gurgaon on a plot area of
38.12 acres (1st phase for EC 12.5835 acre). The total built up area shall be 103807.64
sqm. The proposed Project shall comprise of 3 Basement + GF + 5 Floors. The maximum
height of the building shall be 30.45 meter. The total water requirement shall be 636
KLD. The fresh water requirement shall be 370 KLD. The waste water generation shall
be 296 KLD, which will be treated in the STP of 300 KLD capacity. The total power
requirement shall be 6250 KVA which will be supplied by DHBVN. The Project
Proponent has proposed to develop green belt on 34.48% of project area (23% tree
plantation + 11.48% landscaping). The Project Proponent proposed to construct 12 rain
water harvesting pits. The solid waste generation will be 1.5 ton/day (OWC proposed for
1716 kg/day). The total parking spaces proposed are 1299 ECS.
The above recommendation of SEAC was taken up for consideration. Detailed
discussions were held regarding water requirement, HT line, quality of water, green belt
development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli
Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation
etc. It was found that the project proponent submitted the assurance of HUDA for supply

of water, NOC from DC Gurgaon regarding non applicability of Aravalli Notification and
NOC from AAI regarding height clearance. It was noticed that the project proponent has
not clearly mentioned the capacity of OWC vis-à-vis the generation of bio-degradable
waste, dimensions of the earmarked area and the process involved for the treatment of
bio-degradable waste. It was noticed that for disposal of 32 KLD of waste water from
labour camp the project proponent has proposed to provide soak pit. It was observed that
the project proponent should provide mobile STP/STP for treatment of waste water
generated from the labour camp during construction phase. It was also noticed that the
capacity of STP proposed to be set up in operation phase is inadequate. The project
proponent is required to revise the capacity of STP from proposed 300 KLD.
In view of the above discussions, the Authority decided to agree with the
recommendations of SEAC to accord Environment Clearance to this project by imposing
the following condition in addition to the usual conditions in practice and subject to the
submission of capacity of OWC vis-à-vis the generation of bio-degradable waste,
dimensions of the earmarked area and the process involved for the treatment of bio-
degradable waste; provision of mobile STP/STP for treatment of waste water generation
from the labour camp and adequately revised capacity of STP within 15 days.
[1] The project proponent shall not raise any construction activity in the ROW
reserved/acquired for High Tension Wire passing through the project area and shall
maintain horizontal and vertical ROW as required under Indian Electricity Rules,
1956/DHBVN latest instructions.
[2] The project proponent shall set up STP of 350 KLD capacity in operation phase.
[3] The project proponent shall provide STP/mobile STP for treatment of 32 KLD of
waste water proposed to be generated from the labour camp during construction
phase.
[4] Adequate drinking water and sanitary facilities shall be provided for construction
workers at the site. Provision should be made for mobile toilets. Open defecation
by the laboures is strictly prohibited. The safe disposal of solid wastes/ waste water
generated during the construction phase should be ensured. Efforts shall be made to
provide mobile STP for treatment of waste water during the construction phase.
[5] The project proponent shall submit the following information within 15 days.
(i) Capacity of OWC vis-à-vis the generation of bio-degradable waste,
dimensions of the earmarked area and the process involved for the treatment
of bio-degradable waste.
(ii) Provision of mobile STP/STP for treatment of 32 KLD of waste water
generation from the labour camp during construction phase.
(iii) Revised capacity of STP to be set up during operation phase.

Item No.[8] Environmental Clearance for proposed Group Housing Project
measuring (18.675 + 5.88472 = 24.55972 acres) at Vilalge Dhorka,
Sector-95, Gurgaon, Haryana by Benchmark Infotech Pvt. Ltd.
The SEAC has recommended this project for Environmental Clearance subject to
stipulation stated therein. The Project Proponent has proposed for construction of Group
Housing Project measuring (18.675 + 5.88472 = 24.55972 acres) at Vilalge Dhorka,
Sector-95, Gurgaon, Haryana on a total plot area of 99389.6 sqm (24.55 Acres). The total
built up area shall be 287179.9 sqm. The proposed Project shall comprise of 3 Basements
+ GF + 17 floors. The maximum height of the building shall be 26.5 meter. The total
water requirement shall be 1201 KLD. The fresh water requirement shall be 694 KLD.
The waste water generation shall be 902 KLD, which will be treated in the STP 1100
capacity.
The above recommendation of SEAC was taken up for consideration. Detailed
discussions were held regarding water requirement, quality of water, green belt
development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli
Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation
etc. It was found that the project proponent submitted the assurance of HUDA for supply
of water along with copies of EDC/IDC paid to HUDA for the services for supply of
water, sewerage connection and drainage system, NOC from DC Gurgaon regarding non
applicability of Aravalli Notification and NOC from AAI regarding height clearance. It
was noticed that the project proponent has proposed to use excavated Top soil for use of
landscaping and has proposed to stack the same in the project area covering the same
with Tarpaulin. The project proponent is required to give exact quantum of Top soil to be
excavated and also brief description for its preservation in order to control its erosion. It
was noticed that the project proponent has proposed to reuse construction debris and
demolition debris; the project proponent is required to submit the details of the same. The
project proponent has not discussed the storm water management during construction
phase the project proponent is required to submit the same. It was noticed that the project
proponent has not clearly mentioned the capacity and dimensions of OWC to be installed
for treatment of bio-degradable waste.
In view of the above discussions the Authority decided to defer to this case with
the decision that the project proponent may be asked to submit reply to the below
mentioned observation within 15 days.
[1] The project proponent shall submit details regarding provision made for
preservation of Top Soil in the project area.
[2] The project proponent shall submit details of reuse of construction
debris/demolition debris during construction phase.
[3] The project proponent shall submit capacity and dimensions of OWC proposed to
be installed for treatment of bio-degradable waste.

Item No.[9] Environmental Clearance for construction of commercial colony project
located at Sector-6 & 11 in Revenue Estate of Ratgal, District-
Kurukshetra, Haryana by M/s Divine Vision Infraestate Pvt. Ltd.
The SEAC has recommended initiating legal action against the project proponent
under the Environment (Protection) Act, 1986 as the project proponent has completed the
construction of Commercial Colony project without obtaining prior environmental
clearance. The SEAC has appraised this case in the light of MoEF & CC, GoI OM dated
12.12.2012 and 27.06.2013.
The above recommendation of SEAC was taken up for consideration in the
today’s meeting. It was noticed that Hon’ble NGT has already quashed the operation of
OM of MoEF & CC, GoI OM dated 12.12.2012 and 27.06.2013. The SEIAA vide letter
no. SEIAA/HR/15/634 dated 28.12.2015 has already sought clarification from MoEF &
CC, GoI regarding change in procedure if any in violation cases keeping in view the
quashing of OM dated 12.12.2012 by Hon’ble NGT but no response from the MOEF &
CC, GOI has been received.
In view of the above the Authority decided to keep this case pending till
clarification is received from MoEF & CC, GoI.
Item No.[10] Environmental Clearance for construction of Group Housing Project
at Village Badshahpur, Sector-65, Gurgaon, Haryana by M/s Manglam
Multiplex Pvt. Ltd.
The SEAC in its 128th meeting held on 26-02-2016 has referred this case to the
SEIAA for rejecting the environment clearance application on the grounds that the
project proponent has submitted separate application for the additional licensed area of
3.518 acres (2.081 acres + 1.437 acres of license no. 114 & 122 of 2014) which is in
contagious with the existing project area of 254925.63 sqm (license no. 234 of 2007, 52
of 2009 and 35 of 2010).
The recommendation of SEAC was taken up in the today’s meeting. It was noticed
that the project proponent has submitted fresh application for obtaining environmental
clearance for 3.518 acres of additional license which is in contiguity with the existing
project area of 254925.63 sqm for which the environmental clearance was granted by
SEIAA vides letter no. 1092 dated 28.10.2009 and subsequently the extension of validity
of EC was also granted to the project proponent vide letter no. 61 dated 05.01.2015. The
existing project proposal is under initial stage of construction and the project proponent is
required to submit the application for the additional area of 3.518 acre (license no. 122
and 114 of 2014) in conjunction with the existing project under expansion.
In view of the above the Authority accepted the recommendation of SEAC and
decided to reject the application. It was also decided that the project proponent may be
asked to submit fresh application for additional area of 3.518 acres in conjunction with
the existing project under expansion.

Item No.[11] Environmental Clearance for Revision/Modification of Group Housing
Project (37.512 acres) at Sector-67A, Village Dhumsapur and
Maidawas, District-Gurgaon, Haryana by M/s Precision Realtors Pvt.
Ltd.
The SEAC in its 128th meeting held on 26.02.2016 has recommended this project
for environment clearance. The project proponent for seeking environment clearance for
Revision/Modification of Group Housing Project (37.512 acres) at Sector-67A, Village
Dhumsapur and Maidawas, District-Gurgaon, Haryana with the proposal as given under:

In the today’s meeting the recommendation of SEAC and the project details were
taken up for consideration. It was observed by the Authority that:
[1] The project proponent has not proposed any change in the DG set configuration
whereas water consumption for cooling has been reduced in the revised
submission. The project proponent is required to clarify the same.
[2] The project proponent has proposed to reduce Dwelling units by 5.4% in revision
application whereas the water requirement has been proposed to be reduced by
24.43% .The project proponent is required to clarify the same.
[3] The project proponent in the revised proposal has reduced the water demand for
maintenance/Arboriculture by 60.54%. The project proponent is required to justify
the same.
[4] The project proponent in the revised proposal has reduced the water requirement
by 24.77% . The project proponent is required to justify the same.
[5] The project proponent in the revised proposal has proposed the reduction of waste
water generation by 15% whereas the treated waste water has been shown reduced
by 26%. The project proponent is required to justify the same.
[6] On page 50 of presentation the diameter of recharge pit has been shown as 25
meter against the requirement of 2.5 meter. The project proponent is required to
clarify the same.

[7] The project proponent in the revision application has calculated water requirement
for visitors @ 10% whereas the solid waste generation has been calculated @ 5%.
The project proponent is required to clarify the same.
[8] The project proponent has not submitted the details regarding treatment of bio-
degradable waste. The project proponent is required to submit the details regarding
treatment of bio-degradable waste within the project area and should submit a plan
earmarking space for management of bio-degradable waste.
In view of the above observations the Authority decided to defer to this case with
the decision that the project proponent may be asked to submit reply to the above
observation within 15 days.
Item No.[12] Environmental Clearance for construction of “Affordable Group
Housing” project at Village-Mujeri, Sector-70, Faridabad, Haryana by
M/s Agrasain Spaces.
The SEAC has recommended this project for Environmental Clearance subject to
stipulation stated therein. The Project Proponent has proposed the construction of
“Affordable Group Housing” project at Village-Mujeri, Sector-70, Faridabad, Haryana on
a total plot area of 21650.85 sqm (5.35 acre). The total built up area shall be 49375.498
sqm. The Group Housing project shall have 07 Towers Stilt + 14 Floors & Stilt + 06
Floors. The Group Housing project shall have 720 Dwelling Units, Commercial 1 & 2,
Aaganwadi cum Creche, Community Hall. The maximum height of the building shall be
44.5 meter. The total water requirement shall be 519 KLD. The fresh water requirement
shall be 346 KLD. The waste water generation shall be 427 KLD, which will be treated in
the STP of 515 KLD capacity. The total power requirement shall be 3044 KW which will
be supplied by DHBVN. The Project Proponent has proposed to develop green belt on
4256.79 sqm (21.04%) of project area (13.04 tree plantation + 8% landscaping). The
Project Proponent proposed to construct 05 rain water harvesting pits. The solid waste
generation will be 1688 kg/day. The bio-degradable waste will be treated in the project
area by installation of OWC (organic waste converter). The total parking spaces proposed
are 720 Scooter 390 ECS.
In the today’s meeting the recommendation of SEAC and the project details were
taken up for consideration. Detailed discussions were held regarding HT line, gas pipe
line, water requirement, quality of water, green belt development plan, Ambient Air
Quality, NOC regarding non-involvement of Forest land, recycle and reuse of water,
parking plan, traffic circulation etc. It was noticed that the project proponent has
submitted copy of EDC/IDC paid to HUDA for the services for supply of water,
sewerage connection and drainage system and NOC from DFO regarding Non
involvement of Forest land. It was observed that the project proponent has submitted
calculations and detail of the capacity of OWC vis-à-vis the generation of bio-degradable
waste and the process involved for the treatment of bio-degradable waste.

In view of the above discussions, the Authority decided to agree with the
recommendations of SEAC to accord Environment Clearance to this project by imposing
the following condition in addition to the usual conditions in practice.
[1] The project proponent shall install solar panel for energy conservation.
[2] The project proponent shall provide green area on 21.04% of project area.
[3] The project proponent shall essentially provide two numbers of STPs preferably
equivalent to 50% of total capacity or as per the initial occupancy as the case may
be.
[4] The project proponent shall not raise any construction activity in the ROW
reserved/acquired for High Tension Wire passing through the project area and
shall maintain horizontal and vertical ROW as required under Indian Electricity
Rules, 1956/DHBVN latest instructions.
[5] The project proponent shall not raise any construction in the ROW reserved
for Gas Pipe Line.
[6] Adequate drinking water and sanitary facilities shall be provided for construction
workers at the site. Provision should be made for mobile toilets. Open defecation
by the laboures is strictly prohibited. The safe disposal of solid wastes/ waste water
generated during the construction phase should be ensured. Efforts shall be made to
provide mobile STP for treatment of waste water during the construction phase.
Item No.[13] Environmental Clearance for Regarding Extension of validity period
by 5 years of Environmental Clearance Letter issued for the project
“Uniworld Resorts”-Residential ploted colony with other
infrastructure Amenities at Sector-33 & 48, Gurgaon by M/s Unitech
Residential Resorts Ltd.
The project proposal relates to grant of extension of validity of EC. The project
proponent on 12.06.2013 submitted application seeking extension of validity of EC of the
environmental clearance granted by MoEF & CC, GoI on 03.12.2007 for the project. The
case was lastly taken up by SEIAA in its 77th meeting held on 14.11.2014. The project
proponent vide letter 13.11.2014 informed that the civil construction work of the project
has already been completed as per approved plans and within the validity of EC letters
and requested for withdrawal of the application. The SEIAA decided to refer back this
case to SEAC to inspect the site and to assess the status of construction. The sub-
committee tried to contact the project proponent for doing inspection. The report is
incomplete and not signed by other member.
The case was taken up in the today’s meeting, it was observed that the project
proponent vide letter on. URRL/Uniworld Resorts/EC/2402/2016 dated 24.02.2016 has
intimated that they have obtained Consent to Operate from the HSPCB on 13.02.2016 it
was noticed that the MoEF & CC, GoI has granted EC to the project proponent under
category 8(b) as the project area is more than 50 Ha and as per provision contained in

para 9 of EIA Notification 14.09.2006 the validity period of item 8(b) is limited only to
such activities as may be the responsibility of the applicant as a developer. It was not
clear whether the project proponent has carried out construction of the project as per
approved plans. The Authority decided that a Sub-Committee comprising of Shri
Hitender Singh and Dr. S.N. Mishra, Members SEAC shall visit the site to check whether
the construction raised by the project proponent is in accordance with the approved plans
or not and shall submit the report to the SEIAA. Accordingly the case was deferred.
Item No.[14] Environmental Clearance for Expansion and Modernization of DLF
Commercial Project Corporate Green (IT Office, Retail and
Studio/Service Apartment) at Sector-74A, Gurgaon by M/s DLF
Universal Ltd.
The case was lastly considered in the 87th meeting held on 05.02.2016 wherein the
Authority decided that a Sub-Committee comprising of Shri Hitender Singh and Dr. S.N.
Mishra, Members SEAC shall monitor the compliance of the conditions imposed in the
EC letter and shall submit the report to the SEIAA and the case was deferred.
In the today’s meeting the report dated 14.03.2016 of sub-committee was taken up
for consideration. It was found that the sub-committee in its report has reported that the
project proponent is complying with the conditions imposed in the EC letter. The
Authority decided to accept the recommendation of SEAC and to grant environmental
clearance for Expansion and Modernization of DLF Commercial Project Corporate Green
(IT Office, Retail and Studio/Service Apartment) at Sector-74A, Gurgaon by imposing
standard conditions as recommended by SEAC and subject to the following additional
conditions.
[1] The project proponent shall ensure that no construction activity is undertaken
either on surface or below or above surface of revenue rasta passing through the
project area.
[2] The project proponent shall indicate the width and length of revenue rasta passing
through the project area on sign board and shall display the same at both the ends
of revenue rasta stretch, for awareness of public. Sign board shall also display the
message that this is a public rasta/road and any citizen can use it. There shall not
be any gate with or without guards on revenue rasta further project proponent shall
not encroach revenue rasta and shall not cross internal roads over revenue rasta.
[3] The project proponent shall not raise any construction activity in the ROW
reserved/acquired for High Tension Wire passing through the project area and
shall maintain horizontal and vertical ROW as required under Indian Electricity
Rules, 1956/DHBVN latest instructions.

Item No.[15] Environmental Clearance for Mining of “Brick Earth”
The matter regarding grant of environmental clearance to the project proponents
engaged in mining of “Brick Earth” required for brick-kiln units was taken up in the
today’s meeting. It was informed that in compliance of the Hon’ble Supreme Court
Orders the SEIAA started receiving the applications from Brick-Kiln owners for
environmental clearance of their Mining projects. The SEIAA in October 2012 received
118 applications for environmental clearance. The applications could not be appraised as
there was no set procedure and the requirement of environmental clearance was
challenged in the Hon’ble NGT. Now MoEF&CC, GoI vide amended Notification SO
141 (E) dated 15.01.2016 has prescribed procedure for granting environmental clearance
to the Mining projects having project area less than 5 Ha. As per this amended
Notification the 118 applications pending with SEIAA now require environment
clearance from the DEIAA/DEAC under category B2.
In view of the above it was decided to file all the 118 applications pending with
SEIAA as environmental clearance applications in case of these projects shall now be
processed at the level of DEIAA/DEAC under category B2 projects.
