Minutes of the 118thmeeting of State Environment Impact Assessment Authority held on 12th June,

2019 under the Chairmanship of Sh. Bharat Bhushan IAS (Retd.), Chairman, SEIAA held in the

meeting room of office of SEIAA Haryana, Sector-2 Panchkula, regarding Environmental

Clearance projects under EIA Notification dated 14.9.2006.

All the members are present. The project proposals as recommended by SEAC for Environmental

Clearance or otherwise and listed in the Agenda were discussed and following decisions were taken:-

Agenda Item No.[1] EC for Modification & Expansion of IT & ITES SEZ project located at

Village-Dundahera, Sector-21, Gurugram, Haryana by M/s Gurgaon Inforspace Ltd.

The case was taken up in 117th meeting held on 18.04.2019 and authority decided to defer

the case for the submission of Air Ambient Quality (AAQ) report. The project proponent has submitted

the reply for AAQ report on dated 01.05.2019. The revised value of PM2.5 varies from 71.2-82.4 µg/m3

and PM10 varies from 126.7-143-7 µg/m3.

The reply was considered in the meeting. Project proponent has been advised to take

utmost care to install and operate the necessary air pollution mitigation measures. After detailed

deliberation, the Authority decided to agree with the recommendations of SEAC to accord

Environment Clearance to this project.

Agenda Item No.[2]Environment Clearance for Revision & Expansion of Affordable Group

Housing Project located at Village Mujeri, Sector 70, Faridabad by M/s AGRASAIN

SPACESLLP

The case was taken up in 117th meeting held on 18.04.2019 and discussed at length; Project

Proponent was asked to submit action taken to make up deficiencies, were pointed out by NRO, MoEF&

CC in its visit report. Project Proponent was also asked to incorporate the recommendations for “water

use reduction”. The Project Proponent should submit the water balance diagram showing consumption

@86 lpcd thereby reducing the total water and also the detailed reply to the asked under points as 2.4

and 9.1/9.4/9.5/9.13 of Form-IA. After detailed deliberation, the Authority decided to defer this case in

the 117th meeting. As per the observations, the PP has submitted reply on dated 26.04.2019.

The reply was considered in the meeting. The observations of RO, MoEF&CC regarding

pt. no. 28 & 31 under the conditions of “EC”, were to be discussed during the presentation to SEAC. No

mention of this observation was found in recommendation & appraisal of SEAC.

The case is deferred for the next meeting. To expedite the process, The Authority

constituted a sub-committee comprising of Sh. Vijay Kumar Gupta, Chairman, Sh. R.K. Sapra, Member

and Sh. Anil Mehta, Member SEAC to look into the said subject and submit their opinion at the earliest

possible.

Agenda Item no.[3]EC for Expansion of Affordable Group Housing Colony at Village-

Badshahpur, Sector- 68, Gurugram, Haryana by M/s Sai Aaina Farms Pvt. Ltd.

The case was taken up for the approval of ToR in the 177th meeting of State Expert

Appraisal Committee held on 18.03.2019.Thereafter, the case was taken up for approval of ToR in the

178th meeting of SEAC held on 10.04.2019. SEAC has recommended the project to SEIAA in its 178th

meeting for the approval of ToR.

In today’s meeting the SEIAA approved the “Terms of Reference” and it was decided that

the project proponent will prepare the EIA by using Model Terms of Reference of MoEF& CC.

Item no. 4. EC for Proposed Mixed Land Use colony under TOD Policy on land measuring 13.23

acres in Sector-113, Gurgaon Manesar Urban Complex, Gurgaon, Haryana by M/s

Union Buildmart Pvt. Ltd.

SEAC was recommended the project to SEIAA in its 178th meeting for granting

Environmental Clearance under EIA Notification dated 14.9.2006 issued by the Ministry of

Environment & Climate Change.

The case was taken up. After detailed deliberation, the PP was asked to submit affidavit

regarding installation of Air Cooled DG Sets instead of water cool DG Sets within the premises during

operation phase and also submit revised water balance diagram on the basis of 86 LPCD. The Project

Proponent was also asked regarding the deployment of 4174 number of people as shown in calculation of

Water Consumption. According to which the Project proponent submitted revised water requirement and

designing of sewer water supply as per NBC norm. PP also ensured that the expected population would

work in the premises and engaged by respective buyers of commercial property during operation phase.

The Authority decided to agree with the recommendations of SEAC to accord


Agenda Item no. [5] EC for Affordable Group Housing Colony at Village Kherki-Daula, Sector-76,

Gurugram by M/s Nexus Infracon Pvt. Limited.

The project site for Affordable Group Housing colony Project is to be developed by M/s

Nexus Infracon Pvt. Ltd. The project site is located in the revenue estate of Village KherkiDhaula Sector-

76, Gurugram-Manesar Urban Complex, Haryana on a land measuring 10 acres. The category of the

project is 8(a) as per EIA Notification, 2006 & its amendments. Total Plot area is 40,468.56 m2 (10

acres). Total built up area of project including FAR and Non-FAR will be approximately 120948.204

sqm and net area is 38,849.82 sqm. The ground coverage will be 7612.27 sqm. The achieved residential

FAR is 92069.16 sqm, achieved commercial 3026.19 sqm and Non-FAR is 25474.220 sqm. The project

comprises of Community facilities, commercial Block, residential facilities etc. The total water

requirement for the project will be 1019 KLD out of which domestic water demand is 654 KLD. The

fresh water requirement will be 677 KLD. It is expected that the project will generate 884 KLD from

project of wastewater. The wastewater will be treated in on site STP with MMBR technology of 1060

KLD capacity. The STP treated water will be used for Flushing, Horticulture. Total green is proposed to

be 8229.32 SQM, which is 20.34% of the project site area and number of trees will be 536. The total

electrical load for the project is 3350 kW. There is provision of 1 no. of DG sets of total capacity 500

kVA for power back up in the Group Housing Project. The DG sets will be equipped with acoustic

enclosure to minimize noise generation and adequate stack height for proper dispersion. Parking

requirement for the project as per as per Haryana Bye Laws is 720 ECS while the parking proposed to be

provided in the project is 734 ECS. There will be total solid waste generation of 3966 kg/day. Out of

which, the bio-degradable waste will be composted in the project premises and the manure produced will

be used for horticulture and green development. 10 rainwater harvesting pits have been proposed in the

project for artificial ground water recharge. The total cost of project is Rs.200 crore. The Air quality

data shows exceeding baseline in respect of PM10 and PM2.5 parameters which ranges approximately

from 165.5-272.6 and 103.8-143.4, SO2 is 11.9-15.6, NO2 is 56.6-62.9, CO is 1630-1930 respectively.

Incremental air pollution in respect of PM2.5 is 0.0298 µg/m3, NOx is 1.016 µg/m3, SOx is 0.1247

µg/m3, CO is 0.3885 µg/m3.The case was lastly taken up in the 178th meeting of the SEAC held on

10.04.2019 in which SEAC recommended the project to SEIAA for granting Environmental Clearance.

The case was taken up. After detailed deliberation, the Authority asked the project

proponent to revise the water balance diagram to reduce total water consumption and submit the

undertaking for the green area. Project Proponent submitted the reply for the reduced total water

consumption from 1019 KLD to 676 KLD, fresh water from 677 KLD to 483 KLD and also submitted

undertaking regarding green area 8229.32 m2 (20.34% of the plot area). The CER of the project is 3 Cr

(1.5% of the total project cost).



Agenda Item no. 6. EC for construction of affordable group housing colony at revenue estate

Village Riwazpur and Tikawali, Sector 89, Faridabad, Haryana by M/s Alesia Buildtech Pvt. Ltd.

It is a proposed Affordable Group Housing Colony located in revenue estate of Village

Riwazpur&Tikawali, Sector-89, Faridabad, Haryana by M/s Alesia Buildtech Pvt. Ltd. The estimated cost of the

project is Rs.206.34 Crores. Total Plot area is 6.331 Acres (25,620.61 Sq. meters) and net Plot area is 5.81 acres

(23,540.61 sqm). Total built up area will be 88,385.58 Sq. Meters. Basement area of 12,570 sqm has been proposed.

The project will comprise of 15 residential towers i.e. Tower T1 & T2 (G+20) and Tower T3 – T15 (G+14),

Commercial area, community & Anganwadi /Creche area. The maximum height of the building is 70 m. The green

area development has been kept as 20% (i.e. 4708.12 sqm). The total water requirement for the project will be 423

KLD (i.e.292 KLD of fresh water & 131 KLD of recycled treated water). The waste water generation will be 339

KLD which will be treated upto tertiary level in STP having total capacity of 420 KLD. The STP treated water will

be used for flushing and horticulture. Environment Management cost is Rs.66.5 lakh, Environment

Monitoring Cost is during construction and operation phase is 15.9 lakh/annum respectively

The Air quality data shows exceeding baseline in respect of PM10 and PM2.5 parameters which

ranges from 191.87 to 249.25 µg/m3 and 119.39 to 158.24 µg/m3, SO2 20.48-26.65 µg/m3, NOX 33.31-37.37

µg/m3, respectively. Incremental air pollution in respect of PM10 is 0.042g/s, SO2 is 0.13 µg/m3, NOX 0.81 µg/m3

and CO 0.147 µg/m3. The power requirement for the project will be 2831 kVA. Total power back up is 2500 kVA.

Parking proposed is of 445 ECS and 890 for two wheelers. There will be total solid waste generation of 2381.66

Kg/day. Out of this the bio-degradable waste 1429 Kg/day will be composted in 1 Organic Waste Convertor

provided within the project premises and the manure produced will be used for horticulture and green development.

The required water for the project will be provided through HUDA. There will be 6 numbers of rain water harvesting

structures as approved by the Central Ground Water Authority (CGWA). SEAC has recommended the project to

SEIAA in its 178th meeting for granting Environmental Clearance.

The case was taken up. After detailed deliberation, the Authority observed that the project

proponent has submitted 500 number of labour would be engaged during construction phase. Hence

Project proponent was advised by the authority to install STP and reuse the treated water in construction

phase. Therefore, the Project Proponent submit affidavit regarding modular STP onsite to treat waste

water for labour settlement. The amount earmarked for CER is 3.09 Cr (1.5% of the project cost).The

Project Proponent also submitted affidavit regarding organic waste convertor for 12 batches per day, area

statement and revised water calculation as per 86 LPCD. The Authority also observed that the necessary

details needed under sections of 2.4, 9.1, 9.4, 9.13 of Form-I/ Form-IA were deficient (not properly

elaborated/explained)

The Authority decided to defer this case for the next meeting. In the meanwhile, PP

should get the Form-I/ Form-IA verification (as mentioned above) from the Sub-Committee consisting of

Sh. Vijay Kumar Gupta, Chairman, Sh. R.K. Sapra, Member and Sh. Anil Mehta, Member SEAC.

Agenda item no. 7 Environment Clearance for Commercial Complex “Spaze Arrow” at Village

Naurangpur, Sector-78, Gurgaon, Haryana by Sh. Ishan Singh in collaboration with M/s Spaze

Towers Pvt. Ltd.

The Project Proponent applied for Environment Clearance in 2013 and construction was

reported to be started in March, 2013 and structure work was started by Project Proponent in October,

2014 without obtaining prior EC.

1. The project was submitted to the Environment Appraisal Committee (EAC), MoEF& CC,

Government of India, vide proposal number IA/HR/NCP/64583/2017 (withdrawn later and

re-applied vide application no.IA/HR/NCP/72996/2018, dated 15.02.2018) along with the

details in Form-1 and Form-1A with reference to the Notification No. S.O.804 (E), dated the

14th March, 2017 for issuance of ToR.

2. ToR was granted to Project Proponent vide F.No.23-38/2018-1A-III, dated April, 2018.

3. Further, EAC accorded approval to the ToRs for undertaking EIA and preparation of EMP

and public hearing is exempted under sub clause 1(d) of stage 3 of paragraph 7(i) of EIA

Notification, 2006 as per MoEF & CC’s OM dated 16.03.2018.

4. The proposal was considered by the SEAC in its 174th, 175th meeting for appraisal under

violation Notification and the late the term of Authority dissolved on 20.08.2018 and the

case was transferred to MoEF & CC.

5. Whereas after the constitution of new SEIAA/SEAC, the case file is received in

SEIAA/SEAC, Haryana and was taken up in 178th meeting of SEAC, Haryana on

10.04.2019.

6. The Haryana State Pollution Control Board also reported vide its letter no.5602, dated

28.02.2019 that prosecution u/s 15 of EP Act has already been filed against PP in Special

Environment Court, Faridabad vide case no.08/2019.

The remediation plan submitted by the Project Proponent was found deficient. The

Committee is of unanimous view that Project Proponent should submit revised remediation plan along

with cost assessment, natural and community resource augmentation plan corresponding to ecological

damage assessed and economic benefits derived due to violation to be prepared from reputed

Government Institution.

Project proponent requested for deferment of their case for the next meeting to be held on

13.07.2018. The Committee unanimously acceded the request of the PP and made clear that no separate

letter shall be issued for attending the meeting. Thereafter, the case was taken up in the 175th meeting

of the SEAC held on 13.08.2018.The case was heard at length. The Committee was of the unanimous

view that the PP has failed to submit the required documents as asked earlier. PP is again requested to

submit the revised remediation plan along with cost assessment, natural and community resource

augmentation plan corresponding to ecological damage assessed and economic benefits derived due to

violation duly vetted from the reputed Government Technical Institution. Thereafter, the Committee’s

tenure was expired on 20.08.2018 and case was transferred to MoEF&CC on 14.09.2018.

The case was taken up in the 178th, 179th meeting and observation were raised after discussion on

remediation plan with cost assessment, natural and community resource augmentation plan, ECBC,

Drainage plan, Green Cover Plan, Soil Test reports, Traffic Management Circulation Plan, solid waste

management, fire safety, water balance statement and PP submitted the reply of these observations vide

letter dated 29.04.2019 and presented the details before committee. Based on the information furnished

by the project proponent, the SEAC recommends the proposal to SEIAA for grant of environmental

clearance subject to the following conditions in addition to all standard conditions applicable for such

projects.

1. The SEAC recommended for an amount of Rs. 1,58,60,667/- Cr. Towards Remediation plan and

Natural and Community Resource Augmentation plan to be spent within a span of three years.

2. Total budgetary provision with respect to Remediation plan and Natural & Community Resource

Augmentation plan is Rupees 1,58,60,667/- Cr.Therefore, project proponent shall be required to

submit a bank guarantee of an amount of Rs.1,58,60,667/- towards Remediation plan and Natural

and Community Resource Augmentation plan with the Haryana State Public Control Board prior

to the grant of EC.

3. Remediation plan shall be completed in 3 years whereas bank guarantee shall be for 5 years. The

bank guarantee shall be released after successful implementation of the EMP, followed by

recommendations of the SEAC and approval of the regulatory authority/SEIAA.

4. The PP shall submit the proof of credible action taken by the state government/Haryana State

Pollution Control Board under the provisions of the section 19 of the Environment Protection Act

1986 to the MoEF& CC prior to the grant of EC which in this case has been taken by HSPCB as

conveyed vide letter no. 5602 on 28/02/2019 by Special Environment Court Faridabad in case no.

08/2019.

5. Approval/permission of the CGWA/SGWA shall be obtained, if applicable before drawing ground

water for the project activities. State Pollution Control Board (SPCB) concerned shall not issue

Consent to Operate (CTO) till the project proponent obtains such permission.

6. The PP should submit the 6 monthly action taken report on the compliance of environmental

conditions to the Regional Officer, MoEF & CC, Haryana State Pollution Control Board and

Chairman, SEIAA.

The case was taken up. The Authority observed the followings:

The budgetary provision with respect to “Remediation and Natural & Community Resource

Augmentation Plan” should be sufficient enough to take care of environment in proportion to the

extent violator has done damage to environment in terms of volume, age and nature of project.

The “Remediation and Natural & Community Resource Augmentation Plan” should be

sustainable, quantifiable and verifiable.

How to handle the rejects of RO plants? PP should elaborate, as the submitted plan is for

remediation not to further increase Pollution Load.

The cost of single RWH pit is distributed equally over 3 years. Why it is taking so long to

develop a single RWH pit.

Project proponent should elaborate what type of awareness programme regarding noise is

proposing to carry out.

5 number of RO plants are supposed to be installed in next 3 years. Cost of single RO is

213,333/-, means per annum cost for installation would be multiple of 213,333/-, shown is equal

distribution of total cost over 3 years. Why not to install all RO in the first year itself?

The Authority decided to refer back the case to SEAC to check/ complete the above

mentioned points raised by the SEIAA during the meeting.

Agenda Item no.[8]. Environment Clearance for Proposed Mixed Land Use Colony under ToD

Policy on land measuring 8.625 acres in revenue Estate of Badshahpur, Sector-75, Gurugram-

Manesar Urban Complex, Haryana by M/s Royal Multiplex Pvt. Ltd.

SEAC was recommended the project to SEIAA in its 179th meeting for granting

Environmental Clearance.

The case was taken up. After detailed deliberation, the Project Proponent was asked to

submit affidavit regarding revised calculation of installation of 02 numbers of OWC and Air Cool DG

Sets instead of water cool DG Sets within the premises during operation phase and also submit revised

water balance diagram as per the calculations of 86 LPCD. The total water requirement has been reduced

from 736 KLD to 467 KLD and fresh water from 475 KLD to 347 KLD.

SEAC has recommended the project to SEIAA in its 179th meeting for granting

Environmental Clearance.

Project Proponent submitted reply regarding Installation of Air Cool DG Sets instead of water

cool DG Sets within the premises during operation phase and install wet scrubber along with DG sets to

minimize air pollution. The total water calculation has been reduced from 1502 KLD to 955 KLD and

fresh water from 906 KLD to 671 KLD. Project Proponent submitted affidavit regarding revised water

calculation at the rate of 86 LPCD and also submitted revised green area plan 12572.37m2and waste

water generation during construction phase will be treated in onside mobile STP and further reuse in

sprinkling for dust suppression.



Item no. 10. Amendment in Environmental Clearance for expansion of (Phase-II) IT/information

Technology Enable Services(SEZ) at village- Gwalpahari in Sohna Block, District Gurgaon

Haryana by M/s ASF Insignia SEZ Pvt. Ltd.

The case was taken up in 178 th meeting regarding the amendment/inclusion of area of basement in

Environment Clearance issued vide letter no. SEIAA/HR/2014/331 dated 21.02.2014.

It was decided by the SEAC that to carry out the amendment with the built up area of 302819.65

sq.mtrs pertaining to basements constructed/proposed to be constructed by PP as per details submitted by PP in

2013-14 during the appraisal for grant of EC 2014 to the area of 489380 sq.mtrs at ground floor level and above,

which is already approved and mentioned in EC 2014. The Committee decided to recommend an amendment with a

total built up area of 792209.65 sq. mtrs. in EC letter no. SEIAA/HR/2014/331, dated 21.02.2014 (including already

approved area of 489380 sq.mtrs + an area of 302819.65 sq. mtrs pertaining to basements).

The case was taken up. After detailed deliberation, the Authority decided to agree with the

recommendations of SEAC for amendments in the Environment Clearance of this project.

Agenda Item no. 11. Environment Clearance for Proposed Mixed Land Use colony under TOD

Policy on land measuring 16.29 acres in Sector-113, Gurgaon Manesar Urban Complex, Gurgaon,

Haryana by M/s Vibrant Infratech Pvt. Ltd

The case was taken up in the 179th meeting of the SEAC held on 29.04.2019. SEAC in its

179th meeting recommended the case to SEIAA for granting Environment clearance.


submit revised water balance diagram and revised green area. Project Proponent was also asked about

deployment of 3579 number of people shown in water requirement calculation. PP should submit an

affidavit in this regard stating the statutory compliances of the said number of personnel would be

submitted along with the six monthly compliance reports to SEIAA. It was also informed to the PP that

good quantity of waste water being generated during construction phase, plan for treatment and reuse of

treated water.

Project Proponent submitted reply the total water calculation has been reduced from1682

KLD to 1067 KLD and fresh water from 1057 KLD to 774 KLD. Project Proponent submitted affidavit

regarding revised water calculation at the rate of 86 LPCD and also submitted revised green area plan 20

% (i.e. 13490.65 m2) and 3579 number of people would be employed, proposed for water requirement

calculation. PP should submit an affidavit in this regard stating the statutory compliances of the said

number of personnel would be submitted along with the six monthly compliance report and also

submitted affidavit that waste water generated during construction phase will be treated in onside mobile

STP and further treated water will be reused in sprinkling for dust suppression. And further submitted

that Air Cool DG Sets would be installed instead of water cool DG Sets within the premises during

operation phase and wet scrubber to be installed along with DG sets to minimize air pollution.



Agenda Item no. 12 Environment Clearance for construction of Buildings C, D, E & F as

Expansion of "DLF Cyber City” at Sectors 24, 25 & 25A, Gurugram, Haryana by M/s DLF Cyber

City Developers Ltd.

The case was taken up in the 179th meeting of the SEAC held on 29.04.2019 & 30.04.2019

respectively and recommended the project to SEIAA for granting Environmental Clearance.

The main source of power for the DLF Cyber City will be grid supply through on-site ESS

along with existing captive gas-based power plants of total capacity 96.8 MW located at Energy Centres

within the complex. For DG set Stack height of 6 m above roof level shall be provided.

The case was taken up. The Authority observed the followings:

1) 95 KLD of fresh water for “Filter Back-wash”, why does such huge quantity of Fresh

Water is required to wash Filters? As such huge quantity of water that too Fresh water

should not be required for “Filter Washing”. Why cannot treated water be used? Even if, if

it as to carry out then account for waste water being generated in the process. Conserve

water

2) Why does “Run off” (while calculating no. of RWH pits) different in Form-1A & reply

submitted to SEAC, rather it decreased?

3) Submit the schematic plan to treat residual water and account for the residual quantity also.

4) As per site visit report 47 no. of RWH pits required + 16 no. in expansion, total 63 but

mentioned is 53.

5) As per the Site visit report of RO, MoEF&CC dated 05/03/19, following are the

observations:

a) Google Map Timeline reveals that the construction was started somewhere in

September, 2006, Whilst EC was granted 30.04.2007. The scrutiny of the office record

does not reflect that it has been regularized by the Ministry. However, Ministry may take

cognizance as deemed fit under the prevailing laws.

b) All RWH pits have not been installed (47 RWH pits) and in the absence of proper

maintenance, RWH pits were found filled with water.

c) NOC from the Forest Department has not been submitted yet.

d) Piezometers were not installed for monitoring of ground water level and its quality.

e) Facilities for decomposition of biodegradable waste at site were not provided.

f) Ground Water quality data are not being submitted as per the condition.

Very crucial observations were raised by RO MOEF during his visit, the Authority decided

to refer back the case to SEAC. The SEAC must be satisfied with the action taken to make up the

deficiencies pointed by RO MoEF giving due importance to dual plumbing, status of STP and type &

working of APCM DG sets for the compliances the above mentioned points.

Agenda Item no. 13. EC for construction of Group Housing Colony located in the revenue estate of

village Ullawas, Sector-61, District-Gurugram, Haryana by M/s Puri Construction Pvt. Ltd.

The case was taken up in the 179th meeting on 30.04.2019and recommended the project to

SEIAA for granting Environmental Clearance.

The case was taken up. After detailed deliberation, the Authority asked the project proponent

to submit the revise water balance diagram for reducing the total water consumption, also emission

details of 1500 KVA DG sets, Area Statement and submit the complete details of Point no. 8.1, 8.3, 9.1,

9.5, 9.13 of Form-I/ Form-IA.

Project proponent has submitted revised water balance diagram and submitted affidavit

regarding air modeling report, area statement. The total water requirement has been reduced from 305

KLD to 217 KLD and fresh water from 168 KLD to 123 KLD whereas details of Point no. 8.1, 8.3, 9.1,

9.5, 9.13 of Form-I/ Form-IA were deficient (not properly elaborated/explained).

The Authority decided to defer this case for the next meeting. In the meanwhile, PP should

get the Form-I/ Form-IA verification (as mentioned above) from the Sub-Committee consisting of Sh.

Vijay Kumar Gupta, Chairman, Sh. R.K. Sapra, Member and Sh. Anil Mehta, Member SEAC.

(Residential & Commercial) Colony measuring 14.4125 Acres in Revenue Estate of Maidawas and

Badshahpur, Sector-65 of GMUC, Gurugram by M/s Mangalam Multiplex Ltd.

The case was lastly taken up in the 117th meeting of SEIAA held on 18thApril, 2019 and, it

was observed through the language of 177th of Minutes of Meeting of SEAC, dated 18.03.2017that the

case has not been apprised and recommended by SEAC rather had been forwarded by Chairman SEAC

for further consideration due to which the Authority decided to refer back the case for due appraisal and

clear recommendations.

The case was then taken up in the 179th meeting of SEAC and it was decided by the

committee that the case is recommended to the SEIAA subject to the specific and general conditions of

EC letter F. No.21-167/2017-IA-Ill.

The case was taken up. After detailed deliberation, the Authority decided to agree with the

recommendations of SEAC to accord Environment Clearance to this project.

Agenda Item no. 15.Environment Clearance for “Expansion of Industrial Warehousing/ Storage/

Logistics Project” at Village Faizabad, District Jhajjar, Haryana by M/s Indospace Industrial

Park Badli Pvt. Ltd.

The case was lastly taken up for approval of ToR in the 180th meeting of the SEAC held on

15.05.2019.In the 180th meeting of SEAC decided to recommend the case to SEIAA for approval that the

project proponent will prepare the EIA by using Model Terms of Reference of MoEF&CC with

additional Terms of Reference as given in the Minutes of Meeting of 180th of SEIAA.

In the meeting the SEIAA approved the “Terms of Reference” and it was decided that

The case was taken up for appraisal in the 180th meeting of the SEAC held on 15.05.2019.

During which SEAC recommended the project to SEIAA for granting Environmental Clearance.

The case was taken up. The project proponent was asked to submit an undertaking for the

dust suppression and revised water balance diagram. In view of this, the project proponent submitted an

undertaking for the dust suppression measures. The total water requirement has been reduced from 116

KLD to 102 KLD and fresh water from 50 KLD to 19 KLD.

Agenda item no. 17 Environment Clearance for Expansion of Ardee City Township and Area

Development Project of Ardee Infrastructure Pvt Ltd., Sector 52 & 57, Tehsil Gurugram, District

Gurugram, State Haryana by M/s ARDEE Infrastructure Pvt. Ltd

The case was taken up for approval of TOR in the 180th meeting of the SEAC held on

15.05.2019. SEAC in their 180th meeting held on 15.05.2019- 16.05.2019 recommended the case to

SEIAA for approval Terms of Reference along with additional ToRs as decided by SEAC.

In the meeting the SEIAA approved the “Terms of Reference” and it was decided that

The project proponent submitted the case to the SEIAA on dated 11.04.2019 as per check

list approved by the SEIAA/SEAC for Environment Clearance under EIA Notification dated 14.09.2006.

The case was taken up in 180th meeting. The details of the case are as given below:-

The case was taken up. After detail deliberation, the PP was asked to resubmit the area

statement, water calculation as per 86 LPCD, complete details regarding point no. 8.1, 8.3, 9.1, 9.5 and

9.13 of Form-I/ Form-IA. PP was also asked to submit affidavit stating that the statutory compliance of

236 numbers of personnel would be submitted along with the six monthly compliance report to SEIAA.

Project proponent has submitted reply for revised water balance diagram, area statement. The total

water requirement has been reduced from 688 KLD to 349 KLD and fresh water from 334 KLD to 240

KLD. PP has also submitted affidavit regarding the 236 numbers of personnel would be deployed and

their statutory compliances would be submitted along with the six monthly compliance report whereas

the Information needed under point no. 8.1, 8.3, 9.1, 9.5 and 9.13of Form-I/ Form-IA were deficient (not

properly elaborated/explained)




Agenda item no.19 Environment Clearance for Affordable Residential Plotted Colony Project

(Site-II) at Sector 36, Sohna, Haryana by M/s Signature Global Homes Pvt. Ltd

The case was taken up for appraisal in the 180th meeting of the SEAC held on 15.05.2019

In the 180th meeting of SEAC decided to recommend the case to SEIAA for granting

Environmental Clearance under EIA Notification dated 14.9.2006 issued by the Ministry of Environment

and Forest, Government of India.

The case was taken up in this meeting and after detailed deliberation, the Authority directed the

Project proponent to submit an undertaking for the green area and CER calculation as per the O.M. dated

01.05.2018. The project proponent has accordingly submitted the undertaking for the green area

calculation as 20.68% (9256.56 m2) of the net plot area and calculation of CER be 351 Lakh as per the

O.M. dated 01.05.2018. Project Proponent submitted revised water balance diagram. Total water

requirement has been reduced from 442 KLD to 297 KLD and fresh water reduced from 266 KLD to 183

KLD.



Agenda item no. 20: Environment Clearance under violation notification dated 14.03.2017

forModification and Expansion of Group Housing Project "Atharva" at Sector 109, Village

PawalaKhusrupur, Gurgaon, Haryana by M/s Raheja Developers Ltd

The project was submitted to the SEIAA, Haryana on 21.05.2018 along with Form-1,

Form-1A and Conceptual Plan with reference to the Notification No. S.O.804 (E), dated the 14th March,

2017 and subsequent Notification No. S.O.1030 (E) dated 08th March, 2018, issued by the Ministry of

Environment, Forest and Climate Change for the appraisal of projects for grant of Terms of Reference

and Environmental Clearance, which have started the work on site, expanded the production beyond the

limit of environmental clearance or changed the product mix without obtaining prior environmental

clearance as mandated under the Environment Impact Assessment Notification, 2006 [S.O.1533 (E),

dated the 14th September, 2006;

The proposal was considered by the State Expert Appraisal Committee, Haryana in its

170th meeting held on 07.06.2018 for approval of Terms of Reference under violation Notification dated

14.03.2017 and 08.03.2018 respectively.

The Committee was informed by PP that the project is a modification and Expansion of

Group Housing Project "Atharva" at Sector-109, Village Pawala Khusrupur, District Gurgaon, Haryana

by M/s Raheja Developers Ltd. The Total Plot area is 63179.40 Sq. Meters and PP has proposed

266094.125 Sq. Meters as built up area. The said project/activity is covered under category B of item

8(b) of the Schedule to the EIA Notification, 2006 and requires prior Environmental Clearance. It is to

note that EC was granted to the project proponent vide letter No.DEH/09/SEIAA/66 dated 01.04.2009

for built-up area of 157918.34 Sq. Meters on 59941.94 Sq. Meters land but PP had constructed

164001.86 Sq. Meters and also stated construction on additional adjacent land of 0.8 Acres in violation

of EIA Notification, 2006.

The Project Proponent submitted the EIA Report on 04.04.2019 and the case was taken up

in 180th meeting in SEAC and PP presented about the project but unable to produce any evidence about

the prosecution launched by any competent authority as recommended by the SEAC in its earlier 170th

meeting. The Committee has sent back the file to SEIAA with the decision that the case will be taken up

only after the receipt of copy of prosecution launched by competent authority as decided in the minutes

of 170th meeting case and has also directed the PP to produce the evidence of prosecution launched by

the competent authority before taking for appraisal.

The project proponent submitted a request letter to SEIAA for exemption from Public

Consultation under EIA Notification 14.09.2006 but the terms of reference were approved as per

amended EIA notification dated 08.03.2018 under violation category.

The case was taken up in. The Authority decided to exempt the project from public

consultation.

Agenda Item no. 21Expansion of Environment Clearance of Affordable Group Housing Colony

Project at Village Hayatpur, Sector-89, District Gurugram, Haryanaby M/s Maxworth

Infrastructure Pvt. Ltd.

The project proponent submitted the case to the SEIAA on dated 01.05.2019 for obtaining

revised Environmental Clearance for earlier EC to the project for 22,333.55 sqmt (5.51875 acres) granted

on dated 13.07.2018.The case was taken up for appraisal in the 180th meeting of the SEAC held on

15.05.2019 but the Project proponent has requested to consider the case as a fresh Environment

Clearance under notification dated 14.09.2006. The PP also submitted affidavit for non start of

construction in the project and thereafter the case was appraised for EC.

In 180th meeting of SEAC decided to recommend the case to SEIAA for granting

Environmental Clearance under EIA Notification dated 14.9.2006 issued by the Ministry of

Environment and Forest, Government of India.

The case was taken up. After detailed deliberation, the Authority directed the Project

proponent to submit an undertaking for the green area and CER calculation as per the O.M. dated


calculation as 20.11% (4265.71 m2) of the net plot area and calculation of CER be 2.1 Cr as per the O.M.

dated 01.05.2018. Project Proponent submitted revised water balance diagram. Total water requirement

has been reduced from 563 KLD to 356 KLD and fresh water reduced from 363 KLD to 251 KLD. The

Authority also observed that the necessary details for the reply of 5.4, 9.1 and 9.30 were deficient (not

elaborated/explained). Environment clearance was granted to same project on 13.07.2018 for 2253.55m2.

Why does PP need fresh Environment Clearance? SEAC has not cited any reason for recommendation of

fresh Environment clearance.

The Authority decided to refer back the case to SEAC.

Agenda Item no. 22 Environment Clearance for Proposed Affordable Group Housing Colony

Sector- 70A, Village-Palra, Gurugram, Haryana by M/s Pyramid Infratech Pvt. Ltd.


Environmental Clearance. The case was taken up for appraisal in the 180th meeting of the SEAC held

on 15.05.2019 and decided to recommend the case to SEIAA for granting Environmental Clearance

under EIA Notification dated 14.9.2006 issued by the Ministry of Environment and Forest,

Government of India.

The case was taken up. The Authority asked the PP to install air cooled DG Sets to reduce

the water requirements also submit revised water balance diagram as per the calculations of 86 LPCD.

affidavit stating that 600 numbers of staff/ employees would be deployed during operation phase, their

statutory compliances would be submitted along with the six monthly compliance report depicting no. of

people deployed. PP has submitted affidavit for the landscape area for the expansion of industrial

logistics park project be 15698.325 m2 which is 15.09% of the total plot area. Proponent submitted

revised water balance diagram. Total water requirement has been reduced from 89 KLD to 66 KLD and

fresh water reduced from 15.3 KLD to 6 KLD.



Agenda Item no. 24: Environment Clearance for Non-Agro Warehouse Project (18.01 acre) in

Revenue Estate of Village Khalikpur, District Jhajjar, Haryana by M/s All Cargo Multimodel

Pvt. Ltd







proponent to submit an undertaking for the maximum number of persons stating that statutory

compliances of said strength would be submitted along with the six monthly compliance reports, revised

water balance diagram and CER calculation as per the O.M. dated 01.05.2018. The project proponent has

accordingly submitted the undertaking for the 3700maximum number of persons and stated that proof of

deployed number of personnel would be submitted along with the six monthly compliance report. PP has

submitted affidavit for the inadvertently mentioning of project cost as 100.42 cr. which actual is 62.57 cr.

and also provided calculation of CER be 125.14 Lakh as per the O.M. dated 01.05.2018 under the

affidavit. Project Proponent submitted revised water balance diagram. Total water requirement has been

reduced from 170 KLD to 158 KLD and fresh water reduced from 70.50 KLD to 62 KLD.

The project proponent submitted the case to the SEIAA on dated 01.05.2019 for approval

of TOR. The case was taken up for in the 180th meeting of the SEAC held on 15.05.2019 and

recommended to SEIAA for approval of TOR along with public consultation and the project proponent

will prepare the EIA by using Model Terms of Reference of MoEF& CC.

In the meeting, SEIAA approved the “Terms of Reference” and it was decided that the

project proponent will prepare the EIA by using Model Terms of Reference of MoEF& CC.

Agenda Item no. 27: Environment Clearance for Affordable Group Housing Colony Village-

Nawada, Sector- 86, Gurugram, Haryana by M/s Pyramid Infratech Pvt. Ltd.

The case was taken up. The Authority directed the PP to install air cooled DG Sets to

reduce the water requirements and also submit revised water balance diagram as per the calculations of

86 LPCD.As the necessary details for the reply of 9.13of Form-I/ Form-IA were deficient (should be

elaborated /explained).




Agenda Item no. 28 Environment Clearance for construction of commercial colony project

located at Sector 6 & 11 in Revenue Estate of Ratgal, District Kurukshetra, Haryana by M/s

Divine Vision Infraestate Pvt. Ltd.

The Project was submitted to SEIAA on 06.10.2015 and was taken up in the 128th

meeting of SEAC held on 25.02.2016. The committee unanimously referred the case to the SEIAA for

initiative necessary legal action as the Project proponent has already started the construction work

which amounts to violation of EIA Notification 14.09.2006. The project proponent had again applied

and submitted the Form-1, Form-1A and Conceptual Plan to the SEIAA, Haryana on 15.06.2018 with

reference to the Notification No. S.O.804 (E), dated the 14th March, 2017 and subsequent

Notification No. S.O.1030 (E) dated 08th March, 2018, issued by the Ministry of Environment, Forest

and Climate Change.

Thereafter the proposal was considered by the State Expert Appraisal Committee,

Haryana in its 172nd meeting held on 03.07.2018 for approval of Terms of Reference under violation

Notification dated 14.03.2017 and 08.03.2018 respectively. The PP neither attended the 172nd

meeting nor requested for adjournment. The Committee gave 30 days notice to the project proponent.

The term of the SEAC ended on 20.08.2018 as per EIA notification dated 14.09.2006, in the absence

of duly constituted SEIAA/SEAC. The case was forwarded to the MoEF& CC, GoI as per EIA

Notification, 2006. Now after the receipt of file from the Ministry the case is taken up in the 178th

meeting on 11.04.2019 for approval of Terms of Reference under violation Notification dated

14.03.2017 and 08.03.2018 respectively.

The project Proponent submitted that vide the 128th meeting of SEAC the case was

recommended to SEIAA for Prosecution but the prosecution has not yet been initiated.

SEAC in its 180th meeting held on 15.05.2019 recommended the project to SEIAA for

approval of Terms of Reference along with additional Terms of Reference.

In the meeting, SEIAA approved the “Terms of Reference” and it was decided that the

project proponent will prepare the EIA by using Model Terms of Reference of MoEF& CC.. The

Authority also launched the prosecution against the project proponent.

Agenda item no. 29 Environment Clearance for proposed “Commercial Colony” at Village-

Badshahpur, Sector-70, Gurugram, Haryana by M/s Elan Ltd






The case was taken up. The Authority directed the PP to install air cooled DG sets to

reduce the water requirements. The Authority also observed that the necessary details required under the

section 2.4, 9.4, 9.5, 9.6, 9.11 and 9.13 were deficient (not elaborated/ explained).




Agenda item no. 30 Environment Clearance for proposed clinker Grinding Unit with Cement

Production Capacity of 5.0 MTPA (2.5 MTPA-Phase I & 2.5 MTPA Phase II) and D.G.Set (6.5

MW) at Village Jhanswa, Tehsil Matenhail, District Jhajjar (Haryana) M/s Wonder Cement Ltd,

The project proponent submitted the case to the SEIAA on dated 01.03.2019 for approval

of Terms of References. The case was considered in the 180th meeting of the SEAC held on 15.05.2019

and decided to recommend the case to SEIAA approval of terms of references additional Terms of

Reference.

In today’s meeting the SEIAA approved the “Terms of Reference” and it was decided

that the project proponent will prepare the EIA by using Model Terms of Reference of MoEF& CC.

Agenda Item No.31:Environment Clearance for IT Office Complex Project at Village Sarai

Khwaja, Faridabad by M/s SFG Exports (INDIA) Pvt. Ltd.

The case was taken up in the 117th meeting of SEIAA held on 18th April, 2019. SEIAA

pointed out that while proposing the budget for remediation plan, any benchmark or the reference of any

“SEAC” or Hon’ble NGT to establish the validity of “Budget estimation” to be referred. Further, it was

pointed out that the “Proposed Remedial Actions” should be quantifiable & not subjective, keeping in

mind those have to be measured & verified during the course of action and even afterwards also. Project

proponent has to maintain & manage the means through which “Remedial action” would be carried out;

therefore, managing or maintaining cost should be borne by Project Proponent itself.

Thereafter, the case was taken up in 180th meeting of SEAC held on 16.05.2019.The PP

submitted the reply to the observations along with cost remediation plan for natural resources

augmentation plan, community Resource Augmentation plan for the similar IT park Gateway project of

M/s Dove Infrastructure Pvt. Ltd., Faridabad, Haryana. The PP has also submitted the cost of remedial

plan for the said project vide letter dated 16.05.2019 and presented the case before the committee.

Thereafter, the Committee decided that an amount of Rs.1,06,11,500/- towards Remediation plan and

Natural and Community Resource Augmentation plan shall be spend within a span of three years is

justifiable and further the SEAC again recommended the proposal to SEIAA for grant of

Environmental Clearance subject to the following specific conditions in addition to all standard

conditions applicable for such projects:

1. Total budgetary provision with respect to Remediation plan and Natural & Community Resource

Augmentation plan is rupees 1,06,11,500/-. Therefore, project proponent shall be required to

submit a bank guarantee of an amount of Rupees 1,06,11,500/- towards Remediation plan and

Natural and Community Resource Augmentation plan with the Haryana State Public Control

Board prior to the grant of EC.

2. Remediation plan shall be completed in 3 years whereas bank guarantee shall be for 5 years. The

bank guarantee shall be released after successful implementation of the EMP, followed by

recommendations of the SEAC and approval of the regulatory authority/SEIAA.

3. Approval/permission of the CGWA/SGWA shall be obtained, if applicable before drawing ground

water for the project activities. State Pollution Control Board (SPCB) concerned shall not issue

Consent to Operate (CTO) till the project proponent obtains such permission.

4. The PP should submit the 6 monthly action taken report on the compliance of environmental

conditions to the Regional Officer, MoEF&CC, Haryana State Pollution Control Board and

Chairman, SEIAA.

5. The PP shall borne the cost of remedial plan and will be responsible to maintain and manage the

same.

The case was taken up. The authority observed that the PP has proposed to carry out

remediation plan under energy conservation (pt. 3), land use/ land cover (pt. 12) and solid waste

treatment (pt. 13) inside the premises of the project. These plans are as such covered under the EMP of

the project.

The plan of the premises is to remediate and augment the natural and community resources

over and above of what project proponent is supposed to carry out pertaining to its project. And the

“Remediation Plan” should be sustainable, quantifiable and verifiable.

In view of the discussion above, The Authority decided to refer back the case to SEAC.

Agenda Item no. 32: Environment Clearance for minor mineral of Boulder Gravel and Sand

Minor Mineral Mine of Sukhdarshan, Block/Pkl, B-13 at village Shamtoo and Sukhdarshan,

District Panchkula, Haryana by M/s Shiv Enterprises

The project was submitted to the SEIAA on 01.08.2018 as per the checklist approved by SEAC/SEIAA.

The case was lastly taken up in 175th meeting of SEAC held on 13.08.2018 and recommended to SEIAA

for the approval of ToR. The term of SEAC/SEIAA lapsed on 20.08.2019 and the case was transferred to

MoEF& CC for further consideration. The case is returned to the SEIAA Haryana after its reconstitution

on 29.05.2019. The case is listed in the meeting for the approval of ToR.

In the meeting, the SEIAA approved the “Terms of Reference” and it was decided that


Item no. 33: Environment clearance under category B-2 of the proposed project for mining of

Marble(Minor Mineral) having Mine Lease area 3.35 Ha at village-Bayal, Tehsil-Narnaul, District-

Mahendergarh, Haryana by Mr. Satish Kumar Garg S/o Sh. Ajudhya Prasad.

This is a case of mining lease at village village-Bayal, Tehsil-Narnaul, District-

Mahendergarh having mine lease area 3.35 Ha and mineral “Marble”. The material available in the mine

lease is mainly weathered rock, marble lumps, marble Khanda and marble blocks. Marble is a minor

mineral as defined under clause (e) of section 3 of Mines and Minerals development & Regulation Act,

1957 and the same is referred in the Indian Minerals Yearbook 2017(Part-III: Mineral Reviews) 56th

Edition (Minor Mineral 30.15 Marble).

The case was lastly taken up in 181th meeting of SEAC held on held on 30.05.2019-

31.05.2019 and recommended to SEIAA for the grant of Environment Clearance.

The case was put in the category of 8(1) since the area is less than 5 Hectare, hence this

case falls under the category of B(2) meaning thereby that there is no need of the study under the Terms

of Reference. Since the matter was delayed considerably, the applicant made a request in the 118th

meeting accordingly his request was acceded.

After detailed deliberation, the Authority decided to accord Environment Clearance to the

project on the recommendation of SEAC by imposing the condition that Project proponent will submit

the topography plan of the mine area along with an affidavit stating that:

no mining activity is being carried out within the 500 meter of the radius by the PP itself and or

by anybody else.

no intention to expand the mining activity beyond the stated/ approved area.

sprinkler would be deployed to curb fugitive emission by using treated water.

area concerned would be reclaimed as per the norms and reclamation status would be submitted

along with the six monthly compliance report.

trees would be planted as per the submitted plantation plan.

water trough would be provided for incoming/ outgoing water to wash the wheels.

no natural water course/ water body would be obstructed due to any mining activity or due to the

dumping of the material.
