Minnesota Statutes § 182.659, subd. 1, requires that a Minnesota OSHA (MNOSHA) investigator be permitted to “enter without delay and at reasonable times any place of employment; and to inspect and investigate during regular working hours and at other reasonable times.”

• Make sure the receptionist or security guard at the front door knows whom to call when an investigator arrives.

• Designate a back-up contact in case the main contact person is unavailable. Because MNOSHA investigators arrive unannounced, it sometimes happens that the plant manager or safety director is on vacation, is sick or, because of a downturn in the economy, has recently been laid off.

• If there is a union in the facility, request the shop stewards or business agents to designate someone who will represent the employees during an inspection.

• Be sure to have a copy of the MNOSHA Safety and Health on the Job poster displayed where employee notices are usually posted. Copies are available upon request from MNOSHA; all workplace posters required by the Minnesota Department of Labor and Industry can be printed or ordered at no cost from its website at www.dli.mn.gov/LS/Posters.asp.

• Keep your 300 logs and completed 301/First Report of Injury forms handy. This includes the current year plus the previous five years. You must be able to provide these records within four hours of the investigator’s request. Note: Remember to post your completed 300A Summary of Work-Related Injuries and Illnesses from Feb. 1 through April 30 of the following year. MNOSHA investigators check for the form when they are on-site.

• Know where your written programs are located, such as for Hazard Communication/Employee Right-to-Know (HAZCOM/ERTK), A Workplace Accident and Injury Reduction (AWAIR) and respiratory protection.

• Similarly, know how to find your employees’ training records and certifications. These include records of HAZCOM/ERTK, forklift,

and hazardous waste and emergency response HAZWOPER) training.

• Make sure employees have ready access, either on paper or electronically, to the [material] safety data sheets for the hazardous chemicals with which they work.

• If there has been any employee exposure monitoring performed, make sure those records are available for review. This includes the carbon monoxide monitoring required under Minnesota Rules 5205.0116 when forklifts with internal combustion engines are used in the workplace, and any initial and periodic monitoring required under 29 CFR 1910 subpart Z – Toxic and Hazardous Substances.

• Where a hearing conservation program is required (for example, when employees are exposed to an eight-hour time-weighted average of 85 dB or greater), have each employee’s baseline and most recent audiometric test records available for review.

• Locate your equipment inspection and maintenance records. This includes such things as crane and hoist inspection certifications, forklift tailpipe gas analysis and mechanical power press inspection and maintenance certifications.

• If the use of respirators is required in the workplace, be sure to have available the medical determination and most recent fit test results for each employee using a respirator.

• If employees are required to enter permit- required confined spaces, retain the canceled entry permits from the past year and calibration records for all direct-reading meters during that time period.

OSHA Broadens Exemption for Digger Derricks in Cranes and Derricks Standard . . . Federal OSHA has issued a final rule that broadens the current exemption for digger derricks used in the electric-utility industry, expanding it to include telecommunications work. This provides a complete exemption from having to follow the requirements of Subpart CC of the Cranes and Derricks in Construction standard.

. . . and Seeks to Extend Compliance Date for Crane Operator Certification Federal OSHA has proposed extending the compliance date for the crane operator certification requirement by three years to November 10, 2017. OSHA issued a final standard on requirements for cranes and derricks in construction work on August 9, 2010. The standard requires crane operators on construction sites to meet one of four qualification/certification options by November 10, 2014. After OSHA issued the standard, a number of parties raised concerns about those requirements. OSHA is considering addressing these concerns through a later separate rulemaking. The agency will propose to extend the compliance date so that the qualification/certification requirements do not take effect during potential rulemaking or cause disruption to the construction industry.

Protecting Temp WorkersFederal OSHA has announced new measures to protect temporary employees from workplace hazards. An OSHA memorandum directs field inspectors to assess whether employers who use temporary workers are complying with their responsibilities under the Occupational Safety and Health Act and to record when temp workers are exposed to safety and health violations. They will also assess whether these workers received required training in a language and vocabulary they could understand.

Hazardous Drugs in HealthcareThe National Institute for Occupational Safety and Health (NIOSH) is seeking public comment on a draft document: “NIOSH List of Antineoplastic and Other Hazardous Drugs in Healthcare Settings

2014: Proposed Additions and Deletions to the NIOSH Hazardous Drug List.” Comments must be received by August 2, 2013.

NIOSH Launches Center for Workers’ Comp StudiesNIOSH has established a coordinating Center for Workers’ Compensation Studies (CWCS) designed to encourage collaboration among NIOSH, insurers and other private and public sector organizations. Goals include identifying work-related injury/illness trends, understanding total economic impact, and developing best practices for injury/illness prevention and disability management. New Resources from NIOSH: Nanoparticles, Nail Gun Safety, Heat • New recommendations from NIOSH are designed to prevent occupational exposure to carbon nanotubes (CNTs) and carbon nanofibers (CNFs). CNTs and CNFs are man- made elongated particles that are about a thousand times smaller than a human hair, and they contain a potential risk of work-related lung effects.

NIOSH’s recommendations are expected to assist industry in establishing good risk management practices for controlling occupational exposures to CNTs and CNFs during their manufacture and industrial use. • “Preventing Heat-related Illness or Death of Outdoor Workers” explains the problem, provides case studies and offers recommended controls.

CSB Posts Video of Destruction in West, TexasThe U.S. Chemical Safety Board (CSB) has posted a video that documents the destruction in West, Texas, along with information about its investigation into the April 17 fertilizer explosion there. The CSB will ultimately report on root causes and provide recommendations that may be applicable to other organizations. The video is linked from http://www.csb.gov/csb-releases-video-documenting-the-blast-damage-in-west-texas/.

New OSHA Publications: Ladder Safety, Hexavalent Chromium, Firefighting and Combustible DustFederal OSHA has published a dual language booklet about using ladders safely. Falling Off Ladders Can Kill: Use Them Safely, presents information in English and Spanish. Three new fact sheets from OSHA address ladder use in construction: • Safe Use of Extension Ladders• Safe Use of Job-made Wooden

Ladders• Safe Use of Stepladders

Four new fact sheets address the dangers of exposure to hexavalent chromium in bridge plating, welding, electroplating and aerospace and air transport painting. You can link to the fact sheets from the OSHA Publications Page; scroll down the alphabetical list to “hexavalent chromium.”

OSHA has also published a new booklet that outlines safe procedures for emergency responders who may face fires and explosions caused by combustible dust. Firefighting Precautions at Facilities with Combustible Dust describes how combustible dust explosions occur and how firefighting operations can prevent

them. The booklet explains the preparations emergency responders can make before a response and how these preparations will affect the operational plan during a response.

Information to Help Keep You Safe on the Road

Throughout July — one of the deadliest times on Minnesota roads — law enforcement agencies statewide will increase speed patrols and ticket speeding motorists in an effort to save lives. The enforcement will include a focus on aggressive driving behavior, such as tailgating, abrupt lane changes and red-light running. Link your traffic safety efforts with this statewide campaign. Here are a few facts you can share with your employees:

• Summertime is the deadliest time on our roads, and speeding is a huge factor in this. Illegal or unsafe speed is the leading contributing factor in fatal crashes.

• Drivers need to be patient, give themselves plenty of travel time and put a priority on safety. The minimal time gained while speeding could have life-long consequences (traveling at 55 mph versus 45 mph for a 10-mile journey will only save about two and one-half minutes).

• No matter how many motorists are speeding, it doesn’t make it legal or safe. Speed limits are posted for a reason— to reflect the safe speed for the road’s design.

• When you speed, you have greater potential to lose control of your vehicle; it takes longer to stop; you have less time available to avoid a crash — and the faster you drive, the harder you crash, meaning more severe injuries. Crashes affect everyone on the roadway, not just the speeder.

• Costs of speeding violations vary by county, but typically ramp up to at least $120 for traveling 10 mph over the limit. Motorists stopped at 20 mph over the speed limit face double the fine, and those ticketed traveling more than 100 mph can lose their license for six months.

• Speeding is linked to aggressive driving — tailgating, running lights, changing lanes abruptly, etc. If confronted with an aggressive driver:

- Get out of their way; disengage. - Stay calm — reaching your destination safely is your goal. - Do not challenge them. - Avoid eye contact. - Ignore gestures and don’t return them. - Report aggressive driving (vehicle description, license number, location).

Statewide Campaign Targets Speed

In 2009–2011 in Minnesota, illegal or unsafe speed was a contributing factor in 228 fatal crashes resulting in 254 deaths.

The Minnesota Safety Council’s HOME/work program is a free, members-only program that provides ideas, materials and tools to promote off-the-job safety in your workplace. It was developed with input from our members about the most frequent off-the-job injuries they see affecting their workers, as well as questions that come up as they promote safety off the job.

You probably know that your employees are safer at work than outside of it. The National Safety Council reports that nine out of ten deaths and two-thirds of disabling injuries suffered by employees occur away from the workplace.

In fact, there are 52,300 worker off-the-job deaths and 13.3 million injuries each year. Approximately 70 percent of all unintentional-injury deaths occur in home and community settings – and that doesn’t include motor vehicle crashes. And more than 20 million people suffer non-fatal disabling injuries annually in these settings.

Whether you’re a small, large, or mid-sized organization, providing an off-the-job safety program doesn’t have to be elaborate or cumbersome. HOME/work allows you to decide what level of activity fits your workplace and provides a framework to begin or expand your off-the-job safety efforts. The HOME/work guide book outlines specific implementation steps and includes resources to encourage management commitment; establish a baseline for your organization’s off-the-job injuries; set improvement objectives; and establish ways to evaluate your off-the-job safety efforts.
