agreed to changes in reserving principles that the industry says if not done, will put Minnesota-based life insurers at a significant competitive disadvantage when selling term life.

The day began with a speech from House Speaker Kurt Daudt. Minnesota Wild CFO Jeff Pellgrom’s provided a break from legis-lative talk at a luncheon. Then it was off to the Capitol complex where industry members followed a complex schedule, designed to ensure that they met with lawmakers from the districts in which they voted.

A number of lawmakers such as State Sen. Karin Housely, Stillwa-ter; Sen. Eric Pratt, Prior Lake; and Rep. Joe McDonald, Delano, came to special sessions arranged by insurance lobbyists. Pratt’s wife Tina is a personal lines underwriter at Western National. Mc-Donald’s father K. J. was an insurance agent. His brother is with Allianz.

While the load of insurance professional stepping off the buses was dramatic, in a way it was just keeping up. A House of Rep-resentative legislative worker asked her impression of the stream remarked: “Oh, is that who is here today?” On the same day the insurance community came, so did the proponents for Alzheim-ers Disease research funds; a group opposing the stocking of state lakes with muskies; and a sports recreation group among others.

One of the best-kept secrets in the working world is that insurance companies are among the best places to work. Outsiders some times view the business as boring, but insiders know otherwise. That is why insurance-related companies were among the most common in the Star-Tribune’s 2016 Best Places to Work list. The list, which is foremost a promotional effort for the newspaper, is not scientific. Rather an independent company specializing in worker retention surveyed about 75,000 employees at 1,500 com-panies. The rankings were composite scores based on those re-sponses. Insurance entities, especially life insurance, were well represented among the 260 companies on the list, which was di-vided into large, medium and small groups.

In the large category, Allianz Life in Golden Valley with 1,804 employees and Securian in St. Paul with 2,527, were on the big company list of best places to work. Northwestern Mutual offices in the Minneapolis area and the Bohannon Northwestern Mutual offices made the medium and small lists respectively. Tim Bo-hannon, general manager of the group headquartered in Mendota Heights, said one reason for inclusion on the list was a common culture. He estimated that 60 percent of the financial advisors in his office, including himself, started out in a college internship

program. ECA Marketing, an independent marketing organization with 53 employees in Eden Prairie headed by Joe Spillman, ranked 60th in the small division. The Minneapolis Financial Group, a successor to the Mass Mutual General Agency, and the North Star Resource Group, Minneapolis, made the list for the first time. “Be-ing recognized as a Top Workplace in Minnesota is a compilation and credit in doing many little things right,” said North Star CEO Ed Deutschlander. Other insurance-connected places on the list were American Income Life, 2021 Hennepin Ave. E., Minneapo-lis; UCare and Delta Dental. From the property-casualty side were

30 Years Ago: Tort reform is one of the major issues facing the Minnesota Legislature. Reform proponents liken conditions for this issue to those about workers’ compensa-tion in the early 1970s when the DFL took control of the legislature and passed many tax and workers’ compensation laws that had drastic impact on businesses. The public began paying attention to the impact of those laws when businesses began leaving the state because of them. By 1983 even a DFL govenor was in favor of tax cuts and other reforms. Tort reform proponents are hoping for a replay.

20 Years Ago: Private investigator Fred Rgnonti turned over audio tapes of possible wrongdoing involving one of his employees and a state official. The move evolved into a tangled case that saw his business devastated, caused legislative audit of a state of-fice funded by insurance companies; helped raise conflict of interest charges within the Carlson administration and resurrected an unsolved murder case.

Northern States Insurance Agency, Edina, is in the process of purchasing independent agencies in Minnesota and surrounding as a way to compete with national brokers and regional agencies. “We want the owner to stay on with us as a producer after the sale,” said NSIA President Brad Hepp.

10 Years Ago: Dan Riley, Executive Vice President of the Big I, advises agents to be careful as the market changes. He noted that during the recent hard market agents became accustomed to higher premiums and rising commissions. “But now, as prices in some lines soften, it is crucial that agents and brokers continue to seek out the best pricing structure for their clients. Ruiley said in some states there is talk of passing laws that would force agents to present to clients every quote they have solicited on the account..

It was named the com-pany’s Agent of the Year in 1995 be-cause of superior production, low loss ratios, efficient processing and overall service.

2006: After more than two decades at the same location in Brooklyn Park, the staff is preparing for a move that will take place some time in 2007. E&L has purchased its own building near I-494 and Bass Lake Rd. in Maple Grove.

Unless otherwise indicated, the following enforcement actions by the Minnesota Commerce Department are consent orders, which means that the companies or agents mentioned agree to abide by the department’s decision, but do not necessarily acknowledge any wrongdoing.

Carmen Garcia, St. Paul, June 27 paid a $500 penalty for alleg-edly issuing a workers’ compensation policy certificate on behalf of the MN Workers’ Compensation Assigned Risk Plan without authorization.

Counsel Wealth Management, Arden Hills, paid a $10,000 penal-ty June 16. It allegedly used a misleading ad to seniors; provided at least 183 rebates to Minnesota consumers; failed to identify itself as an insurance agency in ads; and misled seniors as to the real purpose of complimentary dinner workshops.

Patrick Steven Niska, Cokato, June 8 paid a $1,500 penalty. He allegedly sent a letter to selected insureds that caused them to believe erroneously he was acting on behalf of the insurance com-pany in the handling of their auto glass claim.

Jason John Fleming, Otsego, May 27, paid a $500 penalty. He allegedly issued a workers’ compensation policy certificate on behalf of the MN Workers’ Compensation Assigned Risk Plan without authorization.

Elizabeth Marie Larson, Pequot Lakes, paid a penalty May 26. She allegedly failed to obtain signatures on an insurance application and an electronic funds transfer authorization.

Bradley Hengel, Minneapolis, license was revoked and he paid a $3,500 penalty May. 24. He allegedly submitted applications to an insurance company without the consent of individuals in order to obtain commissions; he also used personal information about Min-nesota residents without their permission.

Jeffrey P. Hoff, Sauk Rapids, May 20 paid a $2,500 penalty. He allegedly failed to remit on time insurance premium to an insurer in one instance.

Ryan Lundervold, Woodbury, May 13 paid a $7,500 penalty. He allegedly used misleading advertising materials in Minnesota that gave the impression his solicitation was connected or approved by a federal government agency. He also allegedly failed to identify the insurance coverage offered.

Gradient Advisors, Arden Hills, May 13 paid a $7,500 penalty. The firm allegedly used misleading advertising materials in Min-nesota that give the impression a solicitation was connected to or approved by a federal government agency and failed to identify the insurance coverage offered. n

Minnesota’s workers compensation market has now moved over the $1 billion mark in annual premium while homeowners’ pre-mium continue to zoom upward. But auto and liability premiums remain relatively low compared to benchmark years of 10 and 15 years ago. The numbers are based on statistics compiled by the Minnesota Commerce Department for the Minnesota Insurance Magazines.

In 2015, the 343 companies selling work comp coverage in Minne-sota reported $998.8 million in combined premium, which—based on past annual increases—means the figure is now over $1 billion. Fifteen years ago the amount was $566 million, which increased to $875 million 10 years ago.

But those rises are small when compared to homeowners’ premi-ums. In 2015, 161 reporting HO companies generated just over $2 billion in total premium in 2015. This compares to $1.1 billion in 2005 and a comparatively paltry $606 million in 2000.

While those lines are steadily moving up, personal auto remains comparatively stable. Total combined premium of 232 carriers in the field was $3.2 billion in 2015, compared to just over $3 billion in 2014 and $2.8 billion a decade earlier.

Combined liability premiums have been up and down. This year 442 companies generated $848 million in liability premium com-

pared to just over $1 billion a decade earlier.

The perennial leaders in those four lines remained so. State Farm headed the list for both personal auto and homeowners as it has since the magazine started reporting the numbers nearly 20 years ago. The carrier reported $539 million in homeowners’ premium for 2015, resulting in a slightly increased market share over the previous year of about four tenths of a percent to 26.8 percent. Fifteen years ago State Farm’s market share was 21.76 percent.

The insurer also ranked as the top personal auto insurer. Its $754 million in premium was up from $712 million. Its 23 percent mar-ket share remained unchanged. American Family remained in sec-ond place with $328 million, a $14 million rise over the previous year. But Progressive’s Preferred and Direct carriers when com-bined had $447 million.

SFM Mutual stayed atop workers’s comp with $102 million for a 10.2 percent market share. A decade ago it also led the line with a similar $100 million. Zurich American moved past Western Na-tional into second by posting $34.5 million premium during 2015, a jump of $15 million over the previous year. Western National went to $30.4 million from $30.1 million. National Union Fire, an AIG company, was again the top liability writer with $69.3 million in annual premium. The line’s combined pure direct loss ratio in 2015 was 53 percent—up from 40.4 percent the previous year.

There is trouble in Greenwood, a township between Cook and Tower in northeastern Minnesota. At least that is what the Min-nesota Association of Townships Insurance Trust (MATIT) thinks.The Timberjay newspaper in Tower reported that MATIT general counsel Eric Hedtke told the township board July 12 that for the first time his organization is considering dropping a township. Hedtke cited 16 errors and omissions claims against Greenwood in the past decade. “This is far more than any other township,” he said, noting the most recent three to four claims seemed to stem directly from internal fighting within the township. According to a report by the Timberjay’s Jodi Summit, Hedtke said MATIT’s investigator has identified a number of potential lawsuits the town-ship may face. Hedtke said that while the board has other insur-ance options, it is likely it would pay much higher premiums. “What I am telling you,” Hedtke warned, “is that you are on thin ice. There’s Trouble in Greenwood and That May Mean No Insurance

Farmers Insurance Group office in Wells. When she and her husband returned to her hometown she was not sure what she want-ed to do until she received a call from long-time Farmers agent Karen Brandenberg, who was retiring. Although Warmka had eight years of sales experience with Nor-dstrom’s, she had none in insurance. Bran-denberg told Warmka that were three other agents who wanted to take over the agency, but that she wanted someone from Wells that her clients knew. According to the Tribune’s report, Brandenberg had known Warmka since she was born. After accept-ing the offer, Warmka completed a week training session with Farmers in California, then earned her insurance license and went through more training with Farmers before shadowing Brandenberg on the job. Warm-ka now manages approximately 750 Farm-ers Insurance auto, home and life insurance policies, while Brandenburg works from home on Blue Cross-Blue Shield policies, health supplements and other coverages. Warmka says she will eventually buy these accounts from Brandenburg, but is focus-ing on her current client list first.

Donna Yokiel, an agent at the Wells Insurance Agency since 2001, handles a wide scope of insurance. Her clients need cov-erages for crop, health, auto, home, com-mercial, health and farm—both large and small. Her busiest months are from Oc-tober to January as she helps clients find health insurance. “My favorite part of the business is that I am able to offer such a wide variety of services,” Yokiel told the newspaper.

The departure of Blue Cross from the state’s individual health market will hit the Mankato area harder than most, agent Mary McClure told the Mankato Free Press June 24, because the exit leaves the area with Medica as its only option. “That’s generally not good for the consumer,” Mc-Clure told the paper, because each insurer contracts with a provider network of phy-

sicians, hospitals and other providers. She further explained that customers who are not attracted to Medica face the option of going outside the network, which means they will pay more. “You better make sure you’re always in network, because if you’re out of network, it could absolutely bankrupt you,” McClure was quoted as saying. She cited the example of psychia-trists at the Mankato Clinic who are “out of network” for Medica customers. More-over, she told reporter Dan Linehan, the lack of competition would enable a single carrier to raise prices. McClure added that Medicare patients are not affected by Blue Cross’s departure nor are those who get coverage through an employer. Aaron Hatanpa, a State Farm agent in Mankato, said there is a possibility that another car-rier could jump into the individual market in the Mankato area next year, but that is highly unlikely. Given the losses carriers have seen in the individual market, Hat-anpa told Linehan that he did not envision any rushing into the marketplace.

Fernando Alvarado, a 23-year field claims representative with Auto Owners in Willmar, is seeking a city council seat in that city’s general election in November. A Navy veteran, Alvarado also served on the city’s planning commission.

Andy Gebhard has been promoted to vice president, communications at SFM in Bloomington. Gebhard, who joined the

company in 2007, was previously director of communications.

Gary Bhojwani, the former CEO of Alli-anz Life in Golden Valley, has been hired as the president of Carmel Indiana-based CNO Financial. He was president and CEO of Minneapolis-based Allianz Life Insur-ance Co. of North America from 2007 to 2012.

City attorney Andy Borland told the Nash-wauk city council that in order to have in-surance through the League of Minnesota Cities it needs to annually appoint an insur-ance agent in addition to renewing with a carrier. Nashwauk is near Hibbing.

UNITEDHEALTH’S EARNINGSJUMP 11 PERCENT IN QUARTER

UnitedHealth’s second-quarter earn-ings jumped 11 percent to top analyst expectations even though the nation’s largest health insurer took another hit from coverage it sells largely on the Affordable Care Act’s public insurance exchanges.

The Minnetonka company said that losses from its ACA-compliant indi-vidual business came in $200 million above projections.

That contributed to a drop in operating earnings in its largest business segment, UnitedHealthcare, which sells individu-al and employer-sponsored benefits.

UnitedHealth had said earlier this year that it was planning drastic cutbacks in its participation in the ACA’s exchanges in 2017. The insurer sold coverage on ACA exchanges in 34 states this year but only plans so far to offer it in three next year: Nevada, Virginia and New York.

In addition, its new Harken Health sub-sidiary will sell coverage on exchanges in Chicago, Atlanta and South Florida.

Former Burnsville insurance agent Paul Kottke has been sentenced to 45 days of home monitoring and three years of probation as well as being required to repay $22,000 after pleading guilty to felony theft by swindle in a Dakota County Court. In exchange for a guilty plea, the county agreed to drop insurance fraud charges against him. Kottke admitted in court that he never invested any of the $11,000 Agnes Kahler of Prior Lake had given to him since 1995, said Kahler’s daughter Julie Speiker, owner of the Lakeville Bowl, according to a news report. Speiker and her siblings had been suspicious of Kottke and had urged Kahler to invest her mon-ey elsewhere years ago, but Kottke repeatedly told her he could provide a better rate of return. Financial statements provided to Kahler showing a steady increase in her investments were fakes, printed at the agent’s home-based business. When Kahler became ill, the siblings repeatedly tried to withdraw the funds for their mother’s nursing home care, but Kottke invented reasons for de-lays and at one point promised the check was in the mail. It never came. Kottke moved to Nebraska and medical assistance paid Kahler’s nursing home expenses until she died in 2013, Speiker said, according to a report in the Apple Valley Sun

-0-American Modern Insurance Group has been penalized $1 million by the Minnesota Department of Commerce and ordered to refund money to about 7,000 Minnesota policyholders who were over-charged for so-called force-placed insurance, which lenders make homeowners buy when their HO policies lapse. Sometimes, a lapse or cancellation may be the result of financial hardship on the part of the homeowner. But in some instances, insurance may be force-placed in error or due to a dispute about required coverage. Force-placed policies are often significantly more expensive than voluntary homeowners insurance while providing less coverage, Commerce pointed out. For example, it typically does not cover the homeowner’s personal property or third-party liability. The depart-ment’s investigation found that American Modern charged exces-sive rates in a non-competitive market for force-placed insurance and submitted inaccurate information in support of its rates. Under the settlement, Minnesota homeowners who were overcharged or improperly charged for force-placed insurance policies can submit a refund claim. A notice with claim form will be mailed later this year to Minnesotans affected during the 2008-2016 period.

-0-The City of Owatonna and its insurer, the League of Minnesota Cities Insurance Trust, have paid $50,000 to settle an excessive force, illegal arrest and racial profiling federal lawsuit that had initially sought $500,000. The case involved the 2014 arrest of Frank Tubbs, 38, by police who were responding to a report of a woman needing help at an apartment building. According to a news report, the police encountered a woman who had a restrain-ing order against Tubbs as she was leaving the building. An officer contacted a judge for a search warrant. With it, police entered the building. Tubbs resisted and was tasered. A judge subsequently ruled that the officers had misled the judge in requesting the search warrant because the woman’s no-contact order was outdated and the woman had left the building. The lawsuit was filed in Novem-

Tubbs attorney, John Hamer of Faribault, told the Owatonna newspaper that the police department engaged in harassment, ar-rests and charges against Tubbs, who has been acquitted in three separate trials since 2013. In January, Tubbs was arrested for trying to illegally obtain a gun. Tubbs was convicted in that case and is to be sentenced in October. Steele County Attorney Dan McIntosh denied that his office had been selectively prosecuting Tubbs, a newspaper reported. -0-The City of Waseca expects to receive an additional $500,000 in insurance payments to restore its historic Tink Larson base-ball park severely damaged by fire April 6. The city initially got $300,000 but the discovery of a property valuation error pushed the total to $800,000. Arson is the suspected cause. The police department says it has received about 20 tips in the case.

-0-SFM Mutual Insurance Co., has acquired Barrier Free Access, a Byron, Minnesota-based provider of safe-patient-handling products, design consultation and training to medical facili-ties throughout the Upper Midwest. Barrier Free Access started in 1991 as a division of a construction company specializing in home remodeling to allow individuals with disabilities to stay in their homes. The company phased out of construction and be-came a distributor for a wide variety of products designed for acute, post-acute and residential health care facilities.

-0-Optum Palliative and Hospice Care, a division of UnitedHealth, has agreed to pay $18 million to resolve False Claims Act allega-tions that it took Medicare reimbursement for hospice care for patients who were not eligible for such care because they were not terminally ill. The settlement resolves a lawsuit brought by the government alleging that Optum knowingly submitted false claims to Medicare for hospice care from 2000 through 2013 for Medicare patients who were not eligible for the Medicare hos-pice benefit because medical records did not support that they were terminally ill. Optum, which does not operate in Minnesota, said it acted properly and did not engage in wrong doing. The government’s complaint alleged that Optum’s business practices were designed to maximize the number of patients for whom it could bill Medicare without regard to whether the patients were eligible for and needed hospice. These business practices alleg-edly included discouraging doctors from recommending that in-eligible patients be discharged from hospice and failing to ensure that nurses accurately and completely documented patients’ con-

The allegations resolved by the settlement arose from whistle blower lawsuits initially filed by former employees of Optum under the qui tam provisions of the False Claims Act, which allow private parties to bring suit on behalf of the government and to share in any recovery. The Act allows the United States to intervene in the lawsuits, which it did in this case. The share to be awarded in this case has not yet been determined.

-0-A liberal group, the Consumer Federation of America, has re-leased a study saying that lower-income people—especially those in Minneapolis—pay more for basic auto insurance. The CFA says it is unfair for insurers to consider factors such as an appli-cant’s education, occupation, marital status and housing in decid-ing how much to charge for their insurance. The study claimed to have analyzed 280 insurance quotes for minimum liability cover-age in 15 cities and found that low-income drivers with perfect driving records were quoted premiums nearly 60 percent more than drivers with higher incomes, but who likely had better credit scores, another factor in determining rates.

-0-The Diocese of Duluth, which lost a $4.9 million child sexual abuse case in December and is facing Chapter 11 bankruptcy, has filed a federal lawsuit against five insurance companies, seeking to force their participation in settlement discussions. The insur-ers are Liberty Mutual Group, Catholic Mutual Relief Society of America, Fireman’s Fund Insurance Co., Church Mutual In-surance Co. and Continental Insurance Co. A spokesman for the diocese told the Duluth New Tribune that “the action was com-menced as a precautionary measure to ensure that all appropriate

parties would participate in the mediation process. The mediator now has authority to compel participation in the mediation process if necessary.” The diocese alleges that the insurers have not fully paid what the policies obligate them to pay for any judgments or settlement costs. Mike Finnegan, whose St. Paul law firm repre-sents most of the claimants, told the newspaper: “What this tells me is that the diocese has been putting its insurance companies on notice. There has been a push back by insurance companies to honor the insurance and honor the protection that the diocese has bought for years and years.”

-0-The owner of an Alexandria restaurant that burned down three years ago was charged July 7 with insurance fraud, conspiring to commit arson and theft by swindle. A criminal complaint alleges that in 2013, David Galbraith, 26, the co-owner of Blue Smoke BBQ, paid Derrick Bradley, then-manager of the restaurant, to burn down the building so Galbraith could collect insurance pro-ceeds at a time when the business was failing. The complaint al-leges that as a result of the fire, Galbraith collected more than $266,000 in insurance proceeds. Douglas County Attorney Chad Larson said that Bradley voluntarily came forward with informa-tion and cooperated with the investigation. Without that operation, he said, the fire would have been considered accidental. For that reason, Bradley would not be charged, according to a Forum News Service report. n

tiful and not join the trend toward full-scale fi nancial planning. The Minnesota Associa-tion of Life Underwriters had 2,600 mem-bers about that time. The organization has since been renamed the Minnesota chapter of the National Association of Insurance and Financial Advisors with fewer members.

Fern Lighton, who owned the Brandt Agen-cy in Minneapolis, had a response that rings as true today as it did three decades ago . . . and perhaps as long as three centuries before that. “This is the most turbulent time I have seen in my four decades in the business,” she pronounced, adding that her colleagues generally suffered from eternal and unwar-ranted optimism. “If you see an agency for sale today,” she said, “it is probably because the owner and his customers are 105 years old, or it has a terrible loss ratio.”

Skepticism, as Traeger Sr. pointed out, is usually warranted when it comes to fore-

casts and projections. Change usually happens much more slowly than envisioned. For example, in 1991 300 agents and brokers gathered for a meeting sponsored by the Minne-sota Association of Health Underwriters to hear about a report prepared by the Minnesota Health Care Access Committee. The committee, appointed by then Gov. Rudy Perpich, was studying what to do about the seven percent of the state’s population without health insurance. Dale Rehkamp, a broker with the W. A. Lang Agency in Minneapolis, moni-tored the commission’s meetings for the association.
