Some levies and tax items issued in mining
The payment of dead rent and royalties are classified as levies that are
required to support the success of the national income target. Dead rent is an
annual payment to the government. This annual payment is estimated by number
of hectares included in the contract area or mining area respectively. A mining
area is an area within the contract area containing potentially economic mineral
deposit that the company chose for mining development. A stage activity causes
the rate of the dead rent payment. Further, the payment of royalties is undertaken
by mining company to respect the mineral content of product from mining.
Rates of dead rent and royalties for mineral and coal are different and
described in table 3 below:

A fundamental tax reform in Indonesia has been taken at the early of
1980's encompassing most taxes on income, consumption and property. The
purpose of the introduction of the current tax system is to enhance the revenue,
economic neutrality and simplified tax administration and procedure, increased
revenue comes from the elimination of the multiple exception and exclusions
under the earlier tax system.
Under the current income tax law, an income is defined as any economic
benefit that is received by taxpayer, individual or corporation. Some items of
income in mining operation include but not limited tothe following:
Gross profits from business e Gains from the sale or property transfer, including benefit received by mining
company, from the property distribution to stakeholders, including distribution as a result of liquidation
* Interest Dividends, in whatever mine and form, paid by a corporation
e Royalties * Rent from property
Corporate income tax rates are described as law No. 10 of 1994
concerning amendment on law No.7 Of 1983 concerning income tax as amended
by law No.7 of 1991.

2. Withholding tax Companies, government offices and other agencies are required to pay withholding income taxes on specific types of income. On dividends, interest & royalties, and services, the tax rates:

TENTANG
PENETAPAN TARIF PUNGUTAN EKSPOR ATAS BATUBARA
MENTERI KEUANGAN
Menimbang : bahwa dalam rangka menjaga keseimbarigan persediaan bahan baku di dalam negeri, dipandang perlu untuk menetapkan tarif Pungutan Ekspor atas batubara;
Mengingat : 1. Undang-undang Nomor 10 Tahun 1995 tentang Kepabeanan (Lembaran Negara Republik Indonesia Tah~in 1995 Nomor 75. Tambahan Lembaran Negara Republik Indonesia Nomor 361 2);
2. Undang - undang Nomor 20 Tahun 1997 tentang Penerimaan Negara Bukan Pajak (Lembaran Negara Republik Indonesia Tahun 1997 Nomor 43, Tambahan Lembaran Negara Republik Indonesia Non~or 3687);
3. Undang-undang Nomor 17 Tahun 2003 tenting Keuangan Negara (Lembaran Negara Republik Indonesia Tahun 2003 Nomor 47, Tambahan Lembaran Negara Republik Indonesia Nomor 4256);
4. Peraturan Pemerintah Nomor 22 Tahun 1997 tentang Jenis dan Penyetoran Penerimaan Negara Bukan Pajak (Lembaran Negara Republik Indonesia Tahun 1997 Nomor 57, Tambahan Lembaran Negara Republik Indonesia Nomor 3694);
5 . Peraturan Pemerintah Nomor 44 Tahun 2003 tentang Tarip Atas Jenis Penerimaan Negara Bukan Pajak yang Berlaku Pada Departemen Keuangan (Lembaran Negara Republik Indonesia Tahun 2003 Nomor 95, Tambahan Lembaran Negara Republik Indonesia Nomor 43 13);
6. Peraturan Pemerintah Nomor 35 Tahun 2005 tentang Pungutan Ekspor atas Barang Ekspor Tertentu (Lembaran Negara Republik Indonesia Tahun 2005 Nomor 82, Tamballan Lembaran Negara Republik Indonesia Nomor 453 1);
7. Keputusan Presiden Nomor 2281M Tahun 2001;
8. Keputusan Menteri Keuangan Non~or 557lKM1<.0412002 tentang Tatalaksana Kepabeanan di Bidang Ekspor.
Menetapkan
MEMUTUSKAN :
PERATURAN MENTERI KEUANGAN TENTANG PENETAPAN TARIF PUNGUTAN EKSPOR ATAS BATUBARA.
Pasal 1
Dalan~ Peraturan Menteri Keuangan ini, yang dimaksud deligan :
1. Harga Patokan Ekspor (HPE) adalah harga patokan yang ditetaplta~~ setiap bulan oleh menteri yang bertanggung jawab di bidang perdagangan berdasarkan harga rata - rata internasional.
2. Pemberitahuan Ekspor Barang (PEB) adalah dokumen pabean yang digunakan untuk pemberitahuan pelaksanaan ekspor barang yang dapat berupa tulisan di atas formulir atau media elektronik.
Terhadap ekspor batubara diltenakan Pungutan Ekspor.
Besaran tarif Pungutan Ekspor sebagaimana dimaksud dalatn Pasal 2 adalah sebagaimana ditetapkan dalam lampiran Peraturan Menteri Keuangan ini.
(1) Pungutan Ekspor sebagaimana dimaksud dalam Pasal 2 dihitung berdasarkan rumus : Tarif Pungutan Ekspor x Harga Patokan Ekspor (HPE) x Jumlah Satuan Barang x Nilai Kurs.
(2) Tarif Pungutan Ekspor yang digunakan sebagai dasar perhitungan Pungutan Ekspor adalah Tarif Pungutan Ekspor yang berlaku pada saat PEB didaftarkan pada Kantor Pelayanan Bea dan Cukai.
(3) HPE yang digunakan sebagai dasar perhitungan Pungutan Ekspor adalah HPE yang berlaku pada saat PEB didaftarkan pada Kantor Pelayanan Bea dan Cukai.
(4) Dalam ha1 tidak ada Harga Patokan Ekspor (MPE) penentuan jumlah Pungutan Ekspor dihitung berdasarkan E-larga Free on Board (FOB) yang tercantum dalam PEB dengan rumus sebagai berikut :
Tarif Pungutan Ekspor x Jumlah Satuan Barang x I-Iarga Free On Board (FOB) x Nilai Kurs
(5) Nilai kurs yang digunakan sebagai dasar perhitungan Pungutan Ekspor adalah nilai kurs yang ditetapkan oleh Menteri Keuangan yang beriaku pada saat pembayaran Pungutan Ekspor dilakukan.
Pasal 5
Terhadap batubara yang dikenakan Pungutan Ekspor berlaku tata niaga ekspor.
Pasal6
Peraturan Menteri Keuangan ini rnulai berlaku sejak tanggal ditetapkan
Agar setiap orang rnengetahuinya, mernerintahltan pengumuman Peraturan Menteri Keuangan ini dengan penempatannya dalam Berita Negara Republik Indonesia.

TATA CARA PENGEMBALIAN PUGUTAN EKSPOR BATUBARA KEPADA PERUSAHAAN DALAM RANGKA PERJANJIAN KARYA
PENGUSAHAAN PERTAMBANGAN BATUBARA (PKPZB) YANG KONTRAKNYA BERSIFAT "NAILED DOWN"
1. Tahap I : Setiap bulan, Perusahaan PKP2B mengajukan pern~ohonan pengembalian Pungutan Ekpsor yang telah dibayarkan kepada Negara dengan mengirimkan surat permohonan yang d itujukan k epada D irektur Je nderal A nggaran d an P erimbangan Keuangan c.q. Direktur Penerimaan Negara Bukan Pajak dan Badan Layanan Umum. Permohonan tersebut terlebih dahulu disampaikan kepada Direktorat Jenderal Mineral, Batubara dan Panasbumi untuk diperiksa dan diketahui.
Surat permohonan harus dilengkapi dengan dokurnen-dokumen sebagai berikut: 1) Asli Surat Tanda Bukti Setor (STBS); 2) Copy Pemberitahuan Ekspor Barang (PEB); 3) Copy Bill of Lading (B/L); 4) Copy Cotnpletion Advise atau Real Time Gross Settlement (RTGS) atau Bukti
Penyetoran P ungutan E kspor k e R ekening Bendaharawan Umum N egara p ada Bank Indonesia; dan
5 ) Daftar Penyetoran Pungutan Ekspor (DPPE).
2. Tahap I1 : Setelah surat dan dokumen pendukung diterima oleh Direktur Jenderal Anggaran dan Perimbangan Keuangan c.q Direktur Penerimaan Negara Bukan Pajak dan Badan Layanan Umum, selanjutnya dalam waktu selambat-lambatnya 2 (dua) hari kerja dilakukan pemeriksaan kelengkapan dokumen. Apabila dalam tahap ini ditemukan ketidaklengkapan dokumen pendukungnya, nlaka akan dikirimkan surat balasan kepada Perusahaan PKP2B untuk meminta kekurangan dokumen tersebut.
3. Tahap 111 : Apabila dalam verifikasi data dan keabsahan dokumen yang diajukan masih terdapat keragu-I-aguan atau kecurigaan maka selanjutnya dalam waktu selambat-lambatnya 3 (tiga) hari k e j a diminta konfirmasi kepada instansi terkait antara lain : Kantor Pelayanan Bea dan Cukai, Bank Devisa danlatau Agen Pelayaran.
4. Tahap IV : Apabila dokumen yang diajukan telah benar dan lengkap, Direktur Jenderal Anggaran dan Perimbangan Keuangan c.q. Direktur Penerimaan Negara Bukan Pajak dan Badan Layanan Umum menerbitkan Surat Perintah Membayar (SPM) yang disampaikan kepada Direktur Jenderal Perbendaharaan c.q. Direktur Pengelolaan Kas Negara.
5. Tahap V : Berdasarkan SPM tersebut, Direktur Jenderal Perbendaharaan c.q. Direktur Pengelolaan Kas Negara melakukan Pembayaran Pengembalian Pungutan Ekspor.
Proses dari Tahap IV sampai dengan Tahap V diselesaikan paling lambat dalam waktu 5 (lima) hari keja.
