Approval of Minutes February 5, 2019Motion: Commissioner Frederick – Motion to approve the minutes from February

Administrators ReportAdministrator Kelly Wuest gave the Administrators report that was prepared on April 22, 2019:

Legislative SessionESD maintains a tracking system of BDR’s and Bills and monitors the impact on all budget accounts. This has been extremely helpful in monitoring changes that will impact CPE.

SB520 is a bill that would provide a computer data system that our applicants, licensees and students could make online payments and submit documents online. This will be heard as a one-shot deal within the next three weeks. We hope that we are going to be successful, we are the only state in the nation that is still using paper.

Both SB466 and AB465 create mechanisms for development in emerging technologies and solar energy. This will impact CPE with potential new school applications and added programs for existing institutions. There are several bills impacting requirements for various licensure and may impact the required training in certain occupational areas. There will be an impact to CPE for the number of program modifications.

AB 146 creates the Nevada Office of the Inspector General with the task of auditing, investigating, inspecting and reviewing the performance of each state agency and grants the tools to perform those duties. AB 236 very similar to AB 146 subject agencies to audits and would require changes based on findings.

BudgetThe Commission’s budget was heard on April 5, 2019 with several other DETR budgets and remains partially closed. The budget replaces the remaining desk top unit not funded in the last budget cycle while other line items area similar to the past budget. We did get a cost of living increase from VA that gave us an additional $3,000.

Art Institute updateThe Art Institute remains in Federal Receivership but the daily operations are being funded by the Save the AI of LV, Ltd. A total of 31 student graduated at the end of last semester with new semester began on April 1, 2019. There are several systems (IT, financial, student records) that are entangled and require the AI Las Vegas campus

information be separated from the other remaining 8 AI institutions under separate ownership and the numerous closed locations.

The school is under a service agreement, which I still have not received from the people who are operating it which is of concern. There are a lot of issues from staff not being paid to students not receiving stipends. There is an order, I have until Friday on what I recommend the court to do because they are planning on cancelling the receivership which will automatically send it to bankruptcy. When an educational entity goes into bankruptcy, Title IV goes away as they will automatically become illegible. If the school stays in this receivership until the very end and does not execute a sales agreement, they will close because the school will lose the majority of their funding. The school had 499 students last semester before students that were backed out. Student were given the option to back out if they just started which the majority did. Several drops have not been refunded their money and we just learned recently the complexity of that. Enrollment is now down to 313 students. I believe 45 students are slated to graduate at the end of this term, which happens the second week in June. Receivership is slated to end at the end of May.

There have been several issues stemming from the insolvency of the parent company, Dream Center Education Holdings including student not receiving their stipends from the past semester, refund issues and payment of faculty at the end of the semester. DCEH had not paid most of the campus bills since November 2018. Beginning April 1, 2019, the Save the AI of LV has been making payments on bills and will bear responsibility for operational costs, staffing and student financial aid.

The Accrediting Council for Independent Colleges and Schools (ACICS) has the Las Vegas campus on Campus-Level Achievement Compliance Warning for Retention and Campus-Level Show-Cause for Placement. While related to the management issues of DCEH, these notices require the campus to develop corrective action plans, achieve performance measures and correction within 24 months.

The bond for AI Las Vegas was cancelled by the surety company on March 5, 2019 and currently there is no surety in the event of closure. A new bond cannot be secured until the sale is complete. The institution remains on Heightened Cash Monitoring for DE Title IV.

Closure UpdatesBrightwood College – The majority of student have been able to transfer to other programs locally except for student registered in the Practical Nursing program (81 students). There is only one other PN program offered through CSN and the program structure and credits do not align making transfer impossible. Most student have elected to attend one of the Registered Nursing programs available. To date, CPE has received four claims in the amount of $9,635.96. The available bond amount is $2,228,878.00 for indemnification. CPE can accept claims until December 6, 2019 per

statute. Brightwood College has transferred the student ledgers and transcripts for all students. This will assist us in verifying claims filed.

Cortiva Institute – Cortiva Institute formerly known as Nevada School of Massage Therapy announced closure to occur at the end of the current term on June 9, 2019. There are 28 students scheduled to graduate at the end of the term and another 28 student who are being provided various options including acceleration of the program to gradate by the June 9 closure, transfer, or full refund. The school backed out all student who started at the beginning of April and provided a full refund. Steiner Education Group, the parent company of Cortiva Institute, is closing 20 locations across the country and will sell the remaining locations. CPE will receive the student transcript files for the Las Vegas campus and the new owner will not be maintaining the files for the Las Vegas campus.

Other ClosuresAssociation of Medical Billers – teach out completed 3/31/19. CPE is waiting on receipt of student transcripts.

Commissioner North asked, are the budget items SB466 and AB465, you mentioned that there is going to be a higher volume because of the emerging technology and energy, we will be getting more license requests for schools, did you put in an additional possible staff in the budget? Did you think about that or do you think you can handle that extra volume with the team that you have? Administrator Wuest responded, there were several items where we indicated impacts. On this item, there was not enough detail to tell what the impact would be. The fiscal note stated that it did have an impact on us, but it could not be determined. Every session we have several of these bills where there is an attempt to heighten training and education for a specific area. We did put a note that we could not actually predict how it would impact us on the end. Applications for Full Term License

Century 21 AmericanaTestified: Elizabeth Martinez, owner, gave background information about the

school. Discussion: Commissioner North, it is my understanding you now have had students

go through the training? Martinez replied, yes, that is correct in our April session and students started in the May 6 th session for our second session.

Motion: Commissioner North – The provisional period for Century 21 Americana Real Estate School be extended for six-months.

Nevada Security Guard Training AcademyTestified: Ted Farace, Director, and Chris Palma, Director, gave background and

information about his company, the school and upcoming legislature with security guards.

Discussion: Commissioner Clark asked, just a curiosity question, it appears that all of the students that were reviewed had received a full scholarship. Does the school charge tuition and then reimburse or are there other graduates that work for other companies or is this strictly you are training your own employees? Mr. Farace replied, no, there was no charge to the individuals. We felt that we don’t have a mandated requirement by statute that we would offer our services to train them now and, in the event, that the law does come through that changes the training requirements those individuals have to go back and take the training class again. So, we gave them basically a scholarship and a number of those were Elite Security Specialists employees, which I own that company. I made sure that all my people took the training. Then we had some outside individuals who we didn’t charge who came to us from various avenues of advertisements to participate in the class with the understanding that even though you are taking this eight-hour class, the curriculum we put together has not be mandated by the state yet. If it does occur where the state changes our curriculum, those individuals would be invited back to take the second class at no additional cost. We did this to get our instructors training to handle the class and training for this particular program.

Redemption KitchenTestified: Ralph Salazar, Owner, gave background and information about the

school. Between August 2018 and May 2, 2019, we enrolled 20 students and 15 graduating. Five students moved on for various reasons, but we had to keep the doors open for them to return. We are attempting to expand to a 1900 square foot facility. I plan to submit an application because we need more of a facility instead of a restaurant. I can facilitate up to 29 students at this location. I have become a Proctor for ServSafe and I am in the process of becoming a ITEA for Wonderlic to help assess our students. Out of the 15 students that graduated, six are employed, two of those are still currently employed.

Discussion: Commissioner Clark, the review that took place had several deficiencies noted. What are your plans to come into compliance with those requirements? Mr. Salazar, well unfortunately during that transition period at the end of last year and in to January I lost my head instructor he unexpectedly died at 55 due to a stroke. He was my partner, manager, the person I started this program with and he is gone now. All of those I’s that were not dotted and T’s that were not crossed was due to that situation. I am now able to recover, based on the steps that I have taken to acquire a facility, implement new programs within the programs. I have taken control of the situation.

Commissioner Frederick asked, so are you also an instructor? Mr. Salazar replied, yes ma’am. Commissioner Frederick, how many instructors are there? Mr. Salazar, during that transition period I actually acquired a new instructor. Previously, my partner ran the class and I was the assistant. Now, I am number one and have an assistant.

Commissioner Hersha asked, do you have a plan for someone to manage the details? It seems like collecting the paperwork, collecting the data, and maintaining the data are some of the issues. I know that is not always somebody’s forte. Mr. Salazar responded, yes, I have been instructed very well. I live not too far from CPE and trust me I have been instructed very well.

Commissioner Nielson asked, do you believe during this nine-month extension you will be able to correct all these? Mr. Salazar responded, I believe for sure.

Commissioner North asked, you had mentioned you were the assistant at that time and were your job functions administrative during that time? Mr. Salazar replied, yes. Commissioner North asked, were you doing the administration during that time or was your partner? Mr. Salazar replied, yes, I was doing it the whole time. Commissioner North, I have some major concerns because of the lack of detail and documentation and now I’m hearing, you mentioned and correct me if I am wrong, you now have an assistant, but you are going to be continuing doing that area, is that correct? Mr. Salazar responded, yes, I will continue that. Commissioner North furthered, I guess my concern is, if you were responsible for it in the beginning and now you are still going to be responsible for it, but the deficiencies are significant. What are you going to do to change this? Getting someone to come in and help you? What are you going to do to change this if you have been the one who has been constantly responsible for this area? The deficiencies are significant and now you are asking for nine months, what are you going to do to change and make this come up to standard? Mr. Salazar replied, I have enlisted people who have expertise in administration. I have also had sit down periods

with Kelly and Maricris on all of my deficiencies that I have and know it very well. I am correcting it right now and not only that it was just a transition period for that loss having to have me take over the restaurant, running the component and just stretching me out to thin. Commissioner North, so you are going to delegate some of this responsibility you are overseeing? Mr. Salazar, yes, that is correct.

Commissioner Frederick asked, Dougie J’s had a restaurant component. The new facility on Pecos, is there also a restaurant there? Mr. Salazar responded, yes. Commissioner Frederick or is it strictly classroom? Mr. Salazar, there is a restaurant there and it will be open. Commissioner Frederick, breakfast, lunch and dinner or? Mr. Salazar, right now we plan to have our school sessions from the two to six and the restaurant component will be right after that from six to midnight. The students will be able to participate in that. So those are our operating hours right now. Commissioner Frederick is that seven days a week? Mr. Salazar, seven days a week. Commissioner Frederick, can you give an update on the catalog that you were revising, how is that project proceeding? Mr. Salazar, ma’am I’m getting it done. I’ve been instructed on all of these. Part of delay was the process to from city to the county. They kinda didn’t understand how these two components come together. Then this last week they understood and I was granted my license to do the food right now. Commissioner Frederick, and your agreement for Hope for Prisoners is still intact? Mr. Salazar, yes it is.

Commissioner Clark asked, please tell us a little bit more about the receipts. Mr. Salazar replied, say it again? Commissioner Clark, how did you get to a point where you were not using receipts and has that been corrected and are you now issuing receipts? Mr. Salazar responded, to the students when they enroll or to the agency? Commissioner Clark, when they make payments. Administrator Wuest, ledger? Mr. Salazar, oh yes. Based on the agreement with Hope for Prisoners the ITA’s are receipts and then we get a check stub back, from Workforce Connections for instance and then each agency we understand this has been paid and collected. I have provided, does that make sense? Commissioner Clark, the tuition is being paid by the agency is that a benefit that the student is earning, has to pay or is that a benefit paid directly to the school to provide for the students. How is that money moving around? Mr. Salazar, the tuition from Workforce Connections is being processed from the agency i.e. Hope for Prisoners of Nevada and then they submit an ITA for a student. That pays for their tuition and also the agency is responsible for paying for the uniform, books, tools and supplies that is strictly through the agency not hand to hand from the student. Does that make sense? Commissioner Clark, the secondary question I guess would be for the Administrator, who is the receipt to be paid for because on the checklist it states there is no evidence of any receipts being

issued. I am wondering if there should be a N/A column or should those receipts be issued to the agency or the student? Administrator Wuest responded, it is issued to the paying entity. I think our big issue in the student file was that there was no indication that payment had been received and how was something that was altered onto the enrollment agreement to be documented that yes that payment was made for that student. When you have an entity paying, they tend to pay for multiple people at a time. Just tracking that each person has been paid for or not is important. The enrollment agreement should show that it had been paid. He didn’t do the final steps. So, he had part of the process, but he didn’t have it fully implemented to show in the student account. Commissioner Clark, so I would assume that the issue is also tied to inspection item, contracts, correct? Administrator Wuest, yes. He did have one case where the enrollment agreement was missing and another where it wasn’t signed properly. I think it was an oversight. However, it is something that needs to be noted because it is not an official contract until it is signed by both parties. We see this in other schools where there is involvement with the Workforce Investment System for an agency contract. We are emphasizing the student contract must be complete. Then if the tuition is paid for by another agency, there is a separate contract, the ITA. Our concern is the agreement between the student and school.

Commissioner Clark asked, the only other area that I would like to discuss is the area of faculty training. Do you actually have instructors or are you the instructor for the school? Mr. Salazar responded yes. Susan Beckett, stated that he has been in compliance, there is no deficiency as to the faculty. Commissioner Clark, there is a mark in the no column for instructor files. This is Maricris Wu for the record, in regard to the audit, the school is to provide CPE staff documentation of approved instructor qualifications. During the time of the audit there was no instructor qualification viewed. Administrator Wuest stated, Commissioner Clark, because of his facility issues he brought us documents. We did not do our normal go to site for the audit, he brought the items to our office. He didn’t bring one of the required items, the instructor information, with him. He did bring it to us the next day. It was not at the time Maricris did the audit. I apologize if that was not marked off.

Motion: Commissioner North – The provisional license for Redemption Kitchen be extended for nine-months.

Community Ambulance Health Science CenterTestified: Larry Johnson, Director; provided information about Community

Ambulance with founding principles and background of company history. Brian Anderson gave a financial history and introduced staff with credentials. Rebecca Carmody gave information about the curriculum for both the EMT program and the AEMT program and the testing requirements pertaining to Nevada and on the national level.

Discussion: Commissioner Nielson asked if the tuition include textbooks, uniforms and equipment. Mr. Anderson replied, it does not.

Administrator Wuest indicated a change on the licensing worksheet – the curriculum has been approved by the Clark County Health District. The facility review has occurred and is compliant. Commissioner Clark stated the only contingencies would be the surety and personnel information. Administrator Wuest, yes that is correct.

Motion: Commission Hersha – That a twelve-month provisional license be granted

to Community Ambulance Health Science Center to offer the Emergency Medical Technician and Advanced Emergency Medical Technician upon surety bond in the amount of $19,000, approval of personnel.

Second: Commissioner North.Discussion: None. Results: Unanimous, motion carries.

Laurus CollegeTestified: Jason Smith, Leo Craven, and Jeff Redmond, gave background of the

college. The college began in 2006 and accredited in 2008.

Commissioner Frederick stated, I need to disclose I had a professional relationship with Jason Smith when I was at Le Cordon Blu College. He was the campus President when we were both at Le Cordon Blu College and I was a staff member.

Administrator Wuest stated, the facility has been approved. Their curriculum has received final approval. The only contingency remaining is the surety bond.

Commissioner North asked, is there another certification to be an instructor make-up artist. Administrator Wuest, they do not require an additional certification for make-up. You will notice there is a little bit about hair, they are exempt from being a cosmetologist. Commissioner

North furthered, I am asking about being an instructor and is there a requirement to be an instructor? Administrator Wuest, while there is no requirement, we follow our typical requirement for years in occupation. For a non-degree program, it is two years and she has ten years’ experience and own her make-up store.

Discussion: Commissioner Nielson, the graduates of this program work as independent contractors correct? Mr. Aguayo, yes that is correct. Commissioner Nielson, as such, how will your school help them get connected to the community in order to receive jobs/contacts? Mr. Aguayo, specially to be self employed we help them get leads from actual events and from subscribers to help them during seasons. We provide job leads from ten to twenty people every weekend.

Commissioner Clark asked, are there actual sustainable employment opportunities verses free-lance gigs? Mr. Aguayo responded, in my experience a dedicated makeup artist here in Las Vegas can be working all week. Just working one Quinceanera on the weekend can be five or six hundred a week.

Southeastern UniversityTestified: Lisa Murphy, Compliance Director, gave background and information on

the University and the partnership with churches.

Discussion: Commissioner Nielson asked, the cost of the tuition for the whole program for Associates Degree General Education is $17,050 is that correct? Ms. Murphy replied, I going to say that it is. On the tuition form it is stated $7,080.00 which is correct? Administrator Wuest responded, if you are looking at the budget projections that is what is collected in the year. Commissioner Nielson, it just doesn’t add up. Ms. Murphy, we have additional costs such as a technology fee and various site fees. Commissioner Clark asked, is the bond amount correct due to the tuition? Administrator Wuest, I think the difference is because the tuition fees and then you have the embedded costs of technology fees and other fees.

Order to Refund

Gold Star School of GamingDiscussion: Administrator Wuest, the Order to Refund for Gold Star Gaming was

discussed in the last meeting to place it on the agenda. This is a from the order to directly collect from the surety account because the bond company had refused to pay. I did include with the information from our financial department about the monies available in the account, the student indemnification account. Until the account falls below $250,000, removing money from the account to refund a student does not have any other impact than to lower the account balance. Currently, we have a $10,000 reserve in the account per statute and $357,622 that would be available for refunds. With the 19 students included with this closure, the total indemnification is $6,742.00, with your permission. The finding of fact, conclusions of law and order would need to be signed the we would move forward with the Department of Employment, Training and Rehabilitation to do a work program to release the money. The 19 students who submitted a claim from the closure could be paid the refund, usually within about a 30-day time frame.

Motion: Commissioner North – Motion to approve the order required to refund students from the student indemnification account.
