EMPLOYEE SUSPENSION WITHOUT PAY It is recommended that the resolution to suspend Patrick Snee, Mentor High School teacher, without pay for five workdays: January 5, 6, 7, 8, and 11, 2016, be approved.

WHEREAS, the Board employs Patrick Snee (“Mr. Snee”) as a teacher in the Mentor Exempted Village School District;

WHEREAS, Mr. Snee’s employment is subject to the collective bargaining agreement (“CBA”) between the Mentor Teachers’ Association (“MTA” or the “Union”) and the Board;

WHEREAS, on or about December 15, 2015, Mr. Snee engaged in unacceptable workplace communication to other District employees by disseminating inappropriate content using the District’s resources, in violation of multiple District Policies;

WHEREAS, Board Policy 3.04, entitled “Staff Conduct,” provides in relevant part, “District employees are expected to conduct themselves in a professional manner at all times”;

WHEREAS, Board Policy 3.04, entitled “Staff Conduct,” also provides in relevant part, “[District employees] are to follow all of the state and federal laws and regulations required of them and the policies and procedures of the Board of Education and directives and recommendations from their supervisors”;

WHEREAS, Board Policy 3.04, entitled “Staff Conduct,” further provides in relevant part, “District employees are prohibited from using technology . . . to intentionally host or post improper or inappropriate material, including but not limited to documents, photographs, or inappropriate information that could reasonably be accessed by the school community”;

WHEREAS, Board Policy 3.04, entitled “Staff Conduct,” also provides in relevant part, “Essential to the success of ongoing operations and the instructional program are the following specific responsibilities which are required of all personnel: . . . support and enforcement of policies of the Board and regulations of administration”;

WHEREAS, Board Policy 3.11, entitled “Staff E-mail, Internet Access, and Technology Privacy,” provides in relevant part, “It is the responsibility of each employee to ensure that this technology is used for proper educational purposes”;

WHEREAS, Board Policy 3.11, entitled “Staff E-mail, Internet Access, and Technology Privacy,” also provides in relevant part, “The computers, computer network and messaging systems of the School District are intended primarily for educational uses and work-related communications only”;

WHEREAS, Board Policy 3.11, entitled “Staff E-mail, Internet Access, and Technology Privacy,” further provides in relevant parts, “The following are uses that are unacceptable under any circumstances: . . . The transmission of jokes, pictures, or other materials which are obscene, lewd, vulgar, or disparaging of persons based on their race, color, gender, age, religion, national origin, or sexual orientation. The transmission of messages or any other content which would be perceived by a reasonable person to be harassing, demeaning, threatening, disruptive or inconsistent with the Board’s policies concerning equal employment opportunity or sexual harassment . . . Any personal use or uses which are inconsistent with the educational goals and objectives of the School District”;

WHEREAS, Mr. Snee demonstrated a willful noncompliance with District policies as outlined above;

WHEREAS, the Board believes that the herein referenced conduct constitutes serious offenses and grounds for suspending his employment under Article IX of the CBA and the law; and WHEREAS, the Board has considered all related information brought to its attention. NOW, THEREFORE, BE IT RESOLVED by the Board:

1. Mr. Snee is hereby suspended without pay for five (5) days pursuant to the terms set forth in the CBA Section 3.10, as Mr. Snee has demonstrated misconduct amounting to willful violations Board policies

warranting a more serious corrective action than a verbal or written warning.

2. Mr. Snee’s suspension shall be served on days determined by the Superintendent.

3. The Treasurer, after consultation with legal counsel, is directed to prepare and mail to Mr. Snee, by certified mail, notice of this action and a copy of this resolution.

4. The Board hereby authorizes the Board President, Superintendent and Treasurer to take all actions as may be necessary to implement this resolution.

5. It is hereby found and determined that all formal actions of this Board concerning and relating to the adoption of this resolution were adopted in an open meeting of this Board, and that all deliberations of this Board and any of its committees that resulted in such formal action were in meetings open to the public or in executive session as permitted by Ohio law.

6. This Resolution shall take effect and be in force from and after the earliest period allowed by law.

It is recommended that the resolution to suspend Vernon Miles, Ridge Middle School Custodian III, without pay for five workdays: January 13, 14, 15, 19 and 20, 2016, be approved.

WHEREAS, the Board employs Vern Miles (“Mr. Miles”) as a non-teaching employee in the position of Custodian III at Ridge Middle School in the Mentor Exempted Village School District (“the Dstrict”);

WHEREAS, Mr. Miles is a member of the Mentor Classified Employees (the “Union”), an affiliate of the Ohio Education Association and the National Education Association, and his employment is subject to the Collective Bargaining Agreement (“CBA”) between the Union and the Board dated September 1, 2015 through August 31, 2017;

WHEREAS, Article IX of the CBA provides that the Board follow principles of progressive discipline and that no employee may be suspended for more than three (3) days except by use of Section 3319.081 of the Ohio Revised Code;

WHEREAS, R.C. § 3319.081 provides that a board of education of a school district may suspend an employee for a definite period of time for cause as set forth in the statute, which includes the following reasons for discipline: violation of written rules and regulations as set forth by the board of education or for incompetency, inefficiency, dishonesty, drunkenness, immoral conduct, insubordination, discourteous treatment of the public, neglect of duty, or any other acts of misfeasance, malfeasance, or nonfeasance;

WHEREAS, the Board concludes that the conduct of Mr. Miles, as set forth in Sections a. to d. below, constitutes just cause and sufficient grounds for suspending his employment under the applicable provisions of the CBA and Section 3319.081 of the Ohio Revised Code;

a. Mr. Miles committed unsafe work practices on December 2, 2015, when he intentionally overrode the safety switch on a district lift, to put the legs of the lift down by using 2x4 pieces of wood and putty knives, while using the lift to change light bulbs in the Ridge Middle School cafeteria.

b. Mr. Miles committed unsafe work practices on December 2,

2015, when he instructed another district employee to push him around the school cafeteria while the lift platform was elevated in the air.

c. When a pre-disciplinary hearing was held on December 16,

2015, Mr. Miles confirmed that he intentionally overrode the lift safety switch, shared that he has done this on additional prior occasions when changing filters at the school, and

confirmed that he instructed another employee to push him around while the lift platform was elevated.

d. Mr. Miles violated safety procedures and placed himself and

another district employee in danger resulting in significant potential liability to the district by his intentional unsafe actions on December 2, 2015.

WHEREAS, there is credible evidence supporting the above allegations and

demonstrating that Mr. Miles was neglectful of his job duties; he committed unsafe work practices; and he violated safety procedures and board policies;

WHEREAS, Mr. Miles was previously disciplined with a verbal reprimand on September 13, 2012 for neglect of duty in his failure to clean up an area following broken equipment;

WHEREAS, Mr. Miles was previously disciplined with a written reprimand on August 20, 2013 for unprofessional conduct to others in violation of Board Policy 3.04, Staff Conduct;

WHEREAS, Mr. Miles was also previously disciplined on June 9, 2014 with a one (1) day suspension without pay for giving away district-owned property in violation of Board Policy 9.28, Lending of District-Owned Equipment;

WHEREAS, Mr. Miles was again previously disciplined on July 31, 2015 with a (3) day suspension without pay for smoking on school property in violation of Board Policy 9.35, Smoke Free Schools, and taking a break within the last hour of his contract day in violation of the CBA;

WHEREAS, the above conduct of Mr. Miles violates the Board’s policies, rules and procedures (including, but not limited to, Board Policy 3.04 “Staff Conduct”) and exhibits insubordination, incompetency, inefficiency, dishonesty, a neglect of duty, misfeasance, nonfeasance, and other misconduct as prohibited by Ohio law;

WHEREAS, Mr. Miles continues to demonstrate a willful noncompliance with reasonable directives, written instructions, District policies, and Ohio law; WHEREAS, the Board believes that the above conduct constitutes serious offenses and grounds for suspending his employment under Article IX of the CBA and R.C. § 3319.081;

WHEREAS, a pre-disciplinary meeting was held on December 16, 2015 with Mr. Miles and others, including Union representatives, to discuss the allegations and possibility of discipline; and WHEREAS, the Board has considered all of the allegations and related information brought to its attention. NOW, THEREFORE, BE IT RESOLVED by the Board:

1. Mr. Miles is hereby suspended without pay for five (5) days pursuant to the terms set forth in the CBA and Section 3319.081 of the Ohio Revised Code, as Mr. Miles has demonstrated insubordination, incompetency, inefficiency, dishonesty, a neglect of duty, misfeasance, nonfeasance, and other misconduct amounting to willful violations of District instructions, Board policies, and Ohio law.

2. Mr. Miles’s suspension shall be served on days determined by the Superintendent.

3. The Treasurer is directed to prepare and mail to Mr. Miles, by certified mail, notice of this action and a copy of this resolution.

4. The Board hereby authorizes the Board President, Superintendent and Treasurer to take all actions as may be necessary to implement this resolution.

The motion carried. 2016-1-38 Mrs. Bryner moved, seconded by Mr. Shaw that the Board of Education approve the resolution to recertify tax rates for tax year 2015, collection year 2016.

WHEREAS, This Board of Education in accordance with the provisions of law has previously adopted a Tax Budget for the next succeeding fiscal year commencing July 1, 2015; and, WHEREAS, the Budget Commission of Lake County, Ohio has certified its action thereon to this Board together with an estimate by the County Auditor of the rate of each tax necessary to be levied by this Board, and what part thereof is without, and what part within, the ten mill tax limitation; therefore, be it, RESOLVED, By the Board of Education of the Mentor Exempted Village School District, Lake County, Ohio that the amounts and rates, as determined by the Budget Commission in its certification, be and the same are hereby accepted; and be it further RESOLVED, That there be and is hereby levied on the tax duplicate of said School District the rate of each tax necessary to be levied within and without the ten mill limitation as follows: Outside 10 Mill Limit General Fund 62.90 Emergency Levy 8.46 Permanent Improvement 1.00 Total 72.36 Inside 10 Mill Limit General Fund 4.80 and be it further RESOLVED, That the Clerk of this Board be and he is hereby directed to certify a copy of this Resolution to the County Auditor of said County. Mr. Tuttle moved, seconded by Mrs. Bryner by that the Board of Education recess to executive session in accordance with Ohio Revised Code 121.22 to conduct the performance review of the Superintendent.
