The Nuclear Regulatory Commission has issued Amendment No. 19 to Facility Operating License NPF-9 for the McGuire Nuclear Station, Unit 1, located in Mecklenburg County, North Carolina.

This amendment is in response to your letter dated February 18, 1983. The amendment replaces the Appendix A Technical Specifications with a revised version which applies to both Units I and 2. Because the MicGuire Unit 1 Technical Specifications were upgraded, some systems and components have new Surveillance Requirements which cannot be performed during operation of McGuire Unit 1. We have evaluated these new requirements and conclude that they need not be implemented immediately, but should be performed no later than after the first refueling. The amendment is effective as of its date of issuance except for these Surveillance Requirements.

A copy of the related safety evaluation report supporting Amendment No. 19 to Facility Operating License NPF-9 is enclosed. Also enclosed is a copy of a related notice which has been forwiarded to the Office of the Federal Register for publication.

AMENDMENT TO FACILITY OPERATING LICENSE

Amendment No. 19 License No. NPF-9

I. The Nuclear Regulatory Cotmission (the Commission) has found that:

A. The application for amendment to the NcGulre Nuclear Station, Unit 1 (the facility) Facility Operating License No. NPF-9 filed by the Duke Power Company (licensee) dated February 18, 1983, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act) and the Commission's regulations as set forth in 10 CFR Chapter I-,

B. The facility will operate in confomnity with the application, as amended, the provisions of the Act, and the regulations of the Commission;

C. There is reasonable assurance: (I) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commission's regulations set forth in 10 CFR Chapter I;

D. The issuance of this license amendment will not be inimical to the common defense and security or to the health and safety of the public;

E. The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied.

2. Accordingly, the license is hereby amended by replacing Appendix A in its entirety with the attached Appendix A (HUREG-0964), dated March 1983. Paragraph 2.C.(2) of Facility Operating License Ho. MPF-9 is hereby amended to read as follows:

shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.

3. This license amendment is effective as of its date of issuance except that systems and components may be considered operable based on surveillance requirements in the superseded McGuire Unit 1 Technic-al Specifications until no later than startup after the first refueling.

SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION

RELATED TO AMENDMENT NO. 19 TO FACILITY OPERATING LICENSE NPF-9

DUKE POWER COMPANY

INTRODUCTION

By letter dated February 18, 1983, the Duke Power Company (the licensee) requested that the McGuire Unit 1, License No. NPF-9, be amended to incorporate the Technical Specifications developed for the McGuire Unit 2, License No. NPF-17, Appendix A, into the McGuire 1 license to supercede the existing Technical Specifications.

BACKGROUND

The McGuire Unit 2 License No. NPF-17 was issued on March 3, 1983. The Technical Specifications appended to the McGuire Unit 2 license were developed to include all required items for both McGuire Units I and 2 using the most recent version of the Westinghouse Standard Technical Specifications, NUREG-0452, Revision 4, as guidance. These combined Technical Specifications apply, as appropriate, to both McGuire Units 1 and 2.

EVALUATION

In the development of the Technical Specifications for the McGuire Unit 2 license, the objective of the staff and licensee was to combine the requirements for McGuire Units 1 and 2 into a single Technical Specification document to be appended to each license. Since the most recent version of the "Standard Technical Specifications for Westinghouse Pressurized Water Reactors", NUREG-0452, Revision 4, was used to develop the combined McGuire Units 1 and 2 Technical Specifications, the McGuire Unit 1 Technical Specifications have been upgraded to the current standards. Because the McGuire Unit 1 Technical Specifications were upgraded, some systems and components have new Surveillance Requirements which cannot be performed during operation of McGuire Unit 1. We have evaluated these new requirements and agree with the licensee that these additional surveillance requirements need not be implemented immediately, but should be performed no later than after the first refueling. Based on our review, we conclude that the requested amendment to the McGuire Unit 1 license to incorporate the combined McGulre Units I and 2 Technical Specifications to supercede the existing McGuire Unit 1 Technical Specifications does not result in a reduction in safety and is acceptable.

ENVIRONMENTAL CONSIDERATION

We have determined that the amendment does not authorize a change in effluent types or total amounts nor an increase in power level and will not result in any significant environmental impact. Having made this determination, we have further concluded that the amendment involves an action which is insignificant from the standpoint of environmental impact and, pursuant to 10 CFR §51.5(d)(4), that an environmental impact statement or negative declaration and environmental impact appraisal need not be prepared in connection with the issuance of this amendment.

CONCLUSION

We have concluded, based on the considerations discussed above, that: (1) because the amendment does not involve a significant increase in the probability or consequences of accidents previously considered, does not create the possibility of an accident of a type different from any evaluated previously, and does not involve a significant decrease in a safety margin, the amendment does not involve a significant hazards consideration, (2) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, and (3) such activities will be conducted in compliance with the Commission'sregulations and the issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public.

The U.S. Nuclear Regulatory Commission (the Commission) has issued Amendment No.

amendment.
