Case Study 1

Redemption of Downline's Product Coupon without his consent

Recently a Privileged Customer complained with Amway, claiming that his/her contract renewal product coupon was used without his consent!

After investigation, Amway found out that the Upline Distributor of the Privileged Customer redeemed the renewal product coupon and purchased products for him since his coupon would be expired soon. Later, the Privileged Customer would like to redeem the product coupon and purchase products in the Merchandising Centre, and found that the coupon has been redeemed without his consent. So he reported the issue and intended to involve the police for further investigation.

Amway understands that Distributors are responsible and happy to follow up on their Downline Distributors/Privileged Customers, but Amway would like to remind Distributors, that before they use the product coupons of their Downline Distributors/Privileged Customers, they must get their permission. From the standpoint of customer service, Distributors should respect the customer’s willingness, in order to maintain the professional image of Amway Distributors, and the reputation of Amway.

Case Study 2

Purchasing products by Downline's Distributorship/Privileged Customer Membership without his consent

One of the Privileged Customer claimed he has purchased Amway products for two times withinone year only and the amount of product purchase was small. But he found out that the purchase record of his membership was strange since the product

purchase of his Privileged Customer Membership amounts to over a few thousand BV. He thought that he was not respected and was worried that his membership has been abused by others.

After investigation, Amway found out that theother purchase orders were placed by the Upline Distributor of the Privileged Customer. The Upline Distributor would like to ensure that his Downline can get free renewal, so he uses the Distributorship/Privileged Customer Membership which have not accumulated BV5,000 to purchase products for other Distributors/Privileged customers who have reached BV5,000.

Amway does not encourage the above method to get free renewal for Downline. Although the Downlinebenefitsfromafreerenewal,butheisnotrespected as his Distributorship/Privileged Customer Membership is abused by others. This will also bringaboutanegativeeffectontheprestigeofthecompany and Amway Distributors. Moreover, Upline Distributors cannot master the correct purchase record of the customers and hence unable to provide the deserved follow-up services to customers, which greatlyaffecttheservicequality.

Case Study 1 & 2 Tips from Professor Amway

Distributors should not manipulate performance

According to Amway’s Rules of Conduct Section 3.2.3, “Amway expressly prohibits cross-group ordering or cross-group supplying products to other Distributors. Distributors should not order products in the name of their Downlines so as to save tax and manipulate performance for better monthly performance bonus, higher awards and rewards or other specific purposes.” Section 4.11 also states that “No Distributor shall manipulate the Amway Sales and Marketing Plan or manipulate sales volume in any way which results in the payment of bonuses or other awards and recognition that have not been earned in accordance with the terms of the Sales and Marketing Plan and/or the business reference guide.” Distributors and Privileged Customers should use their own Distributorship/Privileged Customer Membership to purchase products and should not allot their business volume. If the situation is serious, the practice will be regarded as “stacking” which violates the Amway Sales Plan.

Case Study 3

Instigating other Distributors to switch Distributorship during the “Rest Period”

A Distributor met friend A, whom she knew a long time ago, at an Amway seminar, and found that A has joined Amway. Since they have known each other for a long time, the Distributor invited friend A to attend her group’s meeting, to join her group and recommended her husband to join. The Distributor asked friend A to resign from Amway, and to add her husband’s Distributorship after 6 months.

Case Study 3 Tips from Professor AmwayAmway has a fair business system, and values all individual efforts and has always protected the interests of Distributors. All Distributors should be aware that your friend and other Distributors in his Line of Sponsorships have provided quality training to new Distributors so that your friend has decided to join.

Moreover, according to Amway’s Rules of Conducts Section 2.8.1, when joining Amway, a husband and wife can hold only one Distributorship, and Section 2.8.2 states that “a husband and wife shall be deemed to be a partnership holding one Distributorship regardless of whether both names are on the Distributorship. Both will share the rights and responsibilities of the Distributorship as well as abide by these Rules of Conduct. Therefore, each is held accountable for the action of the other as far as the Rules are concerned.”

Case Study 4

Selling products of Amway Hong Kong outside Hong Kong or Macau

A Distributor has sent some Amway products that worth tens of thousands of dollars to Mainland China, which include nutritional products and beauty products. While passing through the customs, the Distributor was detained. Although the Distributor claimed that the products were for his personal use at home, the quantity was large, and the customs officer believed that the products were “parallel goods”, and confiscated the products. After learning about the issue, Amway investigated it with the Distributor, and immediately canceled any related awards and bonuses of the Distributor, including his qualification to join Amway Leadership Seminar.

According to Amway’s Rules of Conduct Section 3.4.9, Distributors shall not export Amway Products from Hong Kong or Macau to any country whether with or without Amway established operation; or import Amway Products from other countries in which Amway has established operations for sale in Hong Kong or Macau.

Case Study 4 Tips from Professor AmwayProducts of Amway Hong Kong can only be sold in Hong Kong and Macau based on the listed prices by Amway. Distributor should not export products of Amway Hong Kong or supply products of Amway Hong Kong to other parties to export to other countries or cities, no matter Amway has set up an office in that country/city or not. Similarly, Distributors should not import any products not supplied by Amway Hong Kong, or sell them in Hong Kong or Macau. For details, please refer to Amway’s Rules of Conduct Section 3.4.9.

Distributors who sell products of Amway Hong Kong outside Hong Kong or Macau are violating the Amway Rules of Conduct. Amway insists on implementing the Rules of Conduct to secure the interests of every Distributor. After verification of the violation of Distributors, Amway will impose punishment such as freezing the bonus and cancellation of the rewards on the offended Distributors. If there are no improvements, Amway will even terminate his/her Distributorship.

Using Copyrighted Materialsin Amway Distributor Meetings and ActivitiesIn this digital world, multi-media content are employed in a wide variety of activities. When Distributors develop their Amway businesses, they make use of all kinds of media to share experiences and communicate. We have discovered that some Distributors have misunderstood that resources such as video clips, music and photographs downloaded from the net could be copied and used as free business aids. In reality, if a user has not purchased a license or attained permission from the copyright holder, they could be liable to legal action. To protect and assist distributors, Amway has set up the “Prerequisites for the use of Intellectual Property in Amway Distributor Meetings and Activities” for Distributors to adhere to, hoping that Distributors would understand, respect and correctly use the intellectual property that belongs to a third party.

The main points:•Obtain permission or license from the copyright holder

or its agents before materials are reproduced for Amway business development, and be ready to provide proof of these permission and license to Amway when required.
