The proposed resolution adopts guidelines and salary schedules for salary adjustments for management/confidential employees in SUNY’s professional service.

Resolution

I recommend that the Board of Trustees adopt the following resolution:

Whereas, pursuant to Education Law sections 355 and 355-a, the State University has authority to set salary schedules for unclassified employees in the professional service of the University;

Whereas, in concert with the recent ratification and legislative implementation of the agreement between the State of New York and the United University Professions for fiscal years 2011-2017, it is appropriate for the State University to update its salary schedules for employees who have been designated, stipulated or excluded from negotiating units as management/confidential; now therefore be it

Resolved that the “Guidelines for Salary Adjustments for Certain Management/Confidential Employees in the Professional Service of State University” (copy on file in the Office of the Secretary of the University), are approved, and, be it further

Resolved that the salary schedules adopted on May 12, 2009 by Resolution 2009-052 are hereby repealed; and, be it further

Resolved that the “Salary Schedule for Management/Confidential Employees in the Professional Service of State University of New York” (copy on file in the Office of the Secretary of the University) be, and hereby is, approved, subject to and in accordance with any applicable legislation; and, be it further

Resolved that, at the discretion of the Chancellor for System Administration management/confidential employees, and each campus president with respect to management/confidential employees under each president’s jurisdiction, such employees are authorized to receive a 2% salary increase effective April 1, 2014 and April 1, 2015, respectively paid as an across-the-board or discretionary increase; and be it further

Resolved that the Chancellor, or designee, be, and hereby is, authorized to take all steps necessary and appropriate to implement the above-referenced Salary Schedules and Guidelines.

Background

In concert with the recent ratification and legislative implementation of the agreement between the State of New York and the United University Professions and the authority of the Board of Trustees to establish salary schedules and compensation for employees generally, it is appropriate for the State University to update its salary schedules in fiscal years 2011-2017 for State University employees who have been designated, stipulated or excluded from negotiating units as management/confidential.

This resolution establishes a compensation increase for State University management/confidential employees of two percent (2%) effective April 1, 2014, and two percent (2%) effective April 1, 2015. In addition, it authorizes an amount equal to one-half percent (.5%) of the total basic annual salaries as of June 30, 2013, June 30, 2014, June 30, 2015 and one percent (1%) as of June 30, 2016 as discretionary pools. These pools are expected to be distributed to incumbents in the form of a lump sum payment not added to basic annual salary in recognition of meritorious service.

A further component of discretionary increases for State University management/confidential employees consists of The Chancellor’s Power of SUNY Performance Incentive payments in the amount of $500 in 2013, $250 in 2014, and $500 in 2015. Such payments will be added to basic annual salary, and will be distributed at the discretion of the Chancellor. These payments are effective July 1, 2013, July 1, 2014 and July 1, 2015.

The Guidelines delegate to the Chancellor, with respect to System employees, and to campus presidents for employees under their discretion the authority to make all or a portion of the salary pool discretionary in recognition of merit. Portions not distributed on a discretionary basis are to be distributed as across-the-board payments.

Guidelines for Salary Adjustment for CertainManagement/Confidential Employees in the Professional Service of

The State University of New YorkJuly 16, 2013

1. Management/Confidential (M/C) Salary Pool

Effective April 1, 2014, and April 1, 2015 the basic annual salary of incumbents of positions designated management/confidential in the State University Professional Service may be increased as follows. Such increases in basic annual salary rate, exclusive of amounts for meritorious service, shall not exceed in the aggregate two percent (2%) based on the total basic annual salary rates in effect on March 31, 2014 and two percent (2%) based on the total basic annual salary rates in effect on March 31, 2015. The Chancellor, with respect to System Administration employees, and each campus president with respect to employees under the president’s jurisdiction may elect to distribute the money as an across-the-board percentage to M/C employees, or use a portion of the funds as a merit pool to reward performance. The Chancellor, with respect to System Administration employees, and each campus president may withhold any part of the increase from an M/C employee based upon a review of performance.

In order to receive an across-the-board or merit increase for April 2014 or April 2015, the employee must be on the payroll on March 31, 2014, and March 31, 2015, respectively and must be on the payroll at the time of actual payment. Each campus president must submit a written summary to the Chancellor detailing the proportion of the pool which will be distributed for merit or across-the-board.

2. Discretionary Adjustment Pools

Effective July 1, 2013, July 1, 2014, and July 1, 2015, one-half percent (.5%) and July 1, 2016 one percent (1%) discretionary pools are established for distribution to incumbents to recognize meritorious service. These pools are to be paid in accordance with the effective date indicated and are intended to reward exemplary performance for the specified performance period. The first discretionary payment, to recognize performance from 7/1/12 to 6/30/13, shall be

effective 7/1/13. The second discretionary payment, to recognize performance from 7/1/13 to 6/30/14, shall be effective 7/1/14. The third discretionary payment, to recognize performance from 7/1/14 to 6/30/15, shall be effective 7/1/15. The final discretionary payment shall be effective 7/1/16 in recognition of performance from 7/1/15 through 6/30/16. The pools are to be distributed to incumbents in the form of a lump sum payment, however, the Chancellor, with respect to System Administration employees, and each campus president with respect to employees under the president’s jurisdiction, has the discretion to add the amounts to basic annual salary for specific employees on a limited basis.

The Chancellor’s Power of SUNY Performance Incentive payments in the amounts of $500 in 2013, $250 in 2014, and $500 in 2015 added to basic annual salary, are distributed at the discretion of the Chancellor. These payments are effective July 1, 2013, July 1, 2014 and July 1, 2015.

To be eligible to receive a payment from one or more of these pools, the employee must have been employed as a management/confidential employee prior to the effective date of the payment and must be employed as a management/confidential employee at the time of the actual payment.

3. Salary Schedules

The attached salary schedules for Management/Confidential employees have been amended to reflect the two percent (2%) increase effective April 1, 2014, and the two percent (2%) increase effective April 1, 2015. As noted on the salary schedules, campuses located in New York City, Nassau, Westchester, and Suffolk Counties may exceed the maximum of the salary range by ten percent (10%). All Employees must be paid at least the minimum of the grade.

4. Funding

When verifying the campus pool totals, funding sources should be identified as State Purpose, Income Fund Reimbursable, Dormitory Income Fund Reimbursable, or Hospital Fund Reimbursable. Although campuses are authorized to spend pool dollars at campus discretion, reimbursement, if any, will only be for the State Purpose portion of the salaries.

5. Rosters

The Office of the State Comptroller will require the submission of rosters to verify eligibility for these payments. The format of the rosters and process for submission will be provided once payment dates have been established.
