MAMMOTH TRAILS COMMITTEE

MINUTES OF REGULAR MEETING

JULY 11, 2019

ROLL CALL

President David Page called the meeting to order at 3:05 p.m. Committee Members Finlay Torrance, Dan Holler, John Mueller, Bill Sauser and President David Page were present. Committee Members Ted Dardzinski and Elise Howell were absent.

PUBLIC COMMENTS

There were no comments given at this time.

ADMINISTRATIVE ITEMS

1. Group Photo

Trails Coordinator Joel Rathje took photographs of the Committee Members.

David Page announced that Committee Member Ted Dardzinski had resigned due to outside obligations which no longer allowed him the time to serve on the Committee.

2. Approval of the meeting minutes for April 25, 2019

a. Attachment 1

ACTION: It was moved by Committee Member Bill Sauser, seconded by Committee Member Dan Holler, with Committee Members Ted Dardzinski and Elise Howell absent and carried by a 5-0 voice vote to approve the meeting minutes for the April 25, 2019 Committee Meeting.

3. MLTS Contract for Services

Committee Member Dan Holler gave an update on the contract with the Town of Mammoth Lakes (TOML) and Mammoth Lakes Trails and Public Access Foundation (MLTPA). Mr. Holler said that the Contract would be on the Town Council’s July 17, 2019 agenda for approval. He said that MLTPA was not working on the trails at this time, and that Trails Coordinator Joel Rathje had been designated to oversee all of the trails projects.

Mr. Rathje thanked Mammoth Lakes Recreation (MLR) staff for their assistance at the last Trail Day.

There was discussion among members of the Committee.

SPEAKING FROM THE FLOOR:

Sandy Hogan directed questions to Committee Member Dan Holler regarding the MLTPA contract and the Sierra Nevada Conservancy (SNC) Grant. Ms. Hogan said she felt that MLR should be the agency to administer the SNC Grant Contract, and asked who would administer it.

There was discussion between Mr. Holler and Ms. Hogan.

4. Shady Rest Winter Signs and Trailhead

a. Attachment 2

Trails Coordinator Joel Rathje gave an update regarding the Shady Rest winter signs and trailhead staging areas. Mr. Rathje presented a photo simulation of what the new signs could look like. He said he would like to install the new signs in the fall.

There was discussion between staff and members of the Committee.

CONSENSUS: The Committee directed Mr. Rathje to proceed with installation of the new signage.

5. SHARP Update

a. NEPA Decision Memo/Next Steps

Trails Coordinator Joel Rathje gave an update on the Sherwins Area Recreation Plan (SHARP) Single Track and Trailhead.

There was discussion between Mr. Rathje and members of the Committee.

6. Panorama Dome Reroute

a. Attachment 3

Trails Coordinator Joel Rathje gave a presentation on the Panorama Dome Trail with photographs depicting the trail's the poor condition. Mr. Rathje informed the Committee that he had approached the Mammoth District of Inyo National Forest about the trail to be re-routed up the hill to get it out of the wet area. He said that it was a Forest Service project, not a Mammoth Lakes Trails Systems (MLTS) project; however, MLTS wanted to assist with it.

There was discussion between Mr. Rathje and members of the Committee.

8. MLTS Project Initiation Sheets for FY 19/20 – Action Item

a. Attachment 4

Trails Coordinator Joel Rathje presented the Fiscal Year 2019/20 Project Initiation Sheets. Mr. Rathje explained the purpose of the MLTS Project Initiation Sheets for Fiscal Year 2019/20, and gave updates on various projects.

There was discussion between Mr. Rathje, MLR Executive Director Matt McClain and members of the Committee.

SPEAKING FROM THE FLOOR:

Sandy Hogan said there should be a contractor report in the Project Initiation Sheets stating exactly what work had been done, not just the costs. Ms. Hogan said she felt that there was a lot of data collection work that was being duplicated and questioned how much of the budget should go to duplicative work. She said she thought MLTPA's SHARP environmental review cost of $30,000 was high and asked who was doing the work, and wanted to see MLR take a more active role in the project. She said she would like to know where the funds were going and would like to see it go to actual trails, and tangible items. She noticed that MLTPA was listed as the lead on that project and said that she thought the entire $30,000 for National Environmental Policy Act (NEPA) went to MLTPA. Ms. Hogan said she would like to see the Town of Mammoth Lakes or Mammoth Lakes Recreation as the lead on the projects.

There was discussion between Ms. Hogan, Mr. Rathje and members of the Committee.

ACTION: It was moved by Committee Member Bill Sauser, and seconded by Committee Member John Mueller, with Committee Members Ted Dardzinski and Elise Howell absent, and carried by a 5-0 roll call vote to approve the Mammoth Lakes Trails System Project Initiation Sheets for FY 19/20, amended to remove the line "project lead" and let it be known the Town of Mammoth Lakes would be the project lead on each of the projects and would assign the work as necessary.

SPEAKING FROM THE FLOOR:

Eastern Sierra Sustainable Recreation Coordinator Matt Paruolo announced that he recently had his first day in the Mammoth Mono District Office. Mr. Paruolo said he had computer access now and was set up with a Forest Service account, which would allow him to administer some of the Memorandum of Understandings (MOUs) and special use permits that the Town had with the Forest Service. He said that the Forest Service staff was excellent, however, they were spread thin. He said staff was doing their best to process permits and that he felt he would be a big help to them. He said he would be looking at projects as far north as Walker and also projects in Long Valley. Mr. Paruolo gave an update on the Tangle Free Waters program.

These marked, un-groomed ski and snowshoe routes were established by the US Forest Service in the early 1980s. They have been renewed by the Range of Light Group, Sierra Club, in partner-ship with the US Forest Service.

#1 Knolls Route*Intermediate

Access: 1.5 mi north on Scenic Loop Rd. from Hwy. 203

This route crosses Mammoth Knolls to Shady Rest Park. Highlights of the route are an old growth Red Fir forest and some peak views of surrounding mountains. It crosses groomed snowmobile route “B” a few times before descending to Shady Rest Park. There is a 0.2 mi spur to the south facing “town overlook”.Approximate mileage: 5.0 mi

#2 Connector Route*Intermediate/Advanced

Access: Across from the start of the Knolls Route on Scenic Loop Rd., or start across from north end of snow play parking

This route connects the Knolls with the Inyo Craters route. Steep terrain can be avoided by creating your own switch-backs.Approximate mileage: 1.3 mi

#3 Inyo Craters Route*Beginner/Advanced

Access: Inyo Craters parking off Scenic Loop

This route starts on snowmobile route “B” and after a short distance intersects with the Blue Diamond route. The route goes through gentle terrain to two volcanic craters with lakes. The last part of the route is a steep ascent to the Inyo Craters.Approximate mileage: 1.3 mi

#4 Earthquake Fault Route*Intermediate/Advanced (If icy)

Access: Hwy. 203 (1.8 mi from stop light)

This route is a 1.6 mi gradual climb to spec-tacular views of the San Joaquin Ridge ending at snowmobile route “C”. Follow “C” for 3.1 mi to Inyo Craters Route or continue to Scenic Loop Rd. Approximate mileage: 4.7 miles

#5 Obsidian Dome RouteBeginner/Intermediate

Access: Exit west off Hwy. US 395, 8 mi north of Mammoth Lakes

NORDIC GROOMING EQUIPMENT LEASE

This Nordic Grooming Equipment Lease ("Lease") is made effective as of November 01, 2019, between Mammoth Lakes Trails and Public Access (the "Lessor"), PO Box 100 PMB 432, Mammoth Lakes, California 93546, and the Town of Mammoth Lakes (the "Lessee"), 437 Old Mammoth Road, Suite R, Mammoth Lakes, CA 93546, and states the agreement of the parties as follows:

1. EQUIPMENT SUBJECT TO LEASE. The Lessor shall lease the equipment listedon the attached Exhibit "A".

2. PAYMENT TERMS. The Lessee shall make monthly payments of $400.00 eachmonth, for any month the MLTS Shady Rest Winter Grooming program is inoperation, as deemed by the MLTS Trails Coordinator. Payments shall be due onthe first day of each month, with the first payment due upon execution of thisagreement. The lease payments shall be due whether or not the Lessee hasreceived notice of a payment due.

3. LEASE TERM. This Lease shall begin on the above effective date and shallterminate on May 31, 2020, unless extended or otherwise terminated in a mannerconsistent with the terms of this Lease.

4. CARE AND OPERATION OF EQUIPMENT. The equipment may only be usedand operated in a careful and proper manner. Its use must comply with all laws,ordinances, and regulations relating to the possession, use, or maintenance of theequipment, including registration and/or licensing requirements, if any.

5. MAINTENANCE AND REPAIR. The Lessee shall maintain, at the Lessee's cost,the equipment in good repair and operating condition, allowing for reasonablewear and tear. Such costs shall include labor, material, parts, and similar items.

6. LESSOR'S RIGHT OF INSPECTION. The Lessor shall have the right to inspectthe equipment during Lessee's normal business hours.

7. RETURN OF EQUIPMENT. At the end of the Lease term, the Lessee shall beobligated to return the equipment to the Lessor at the Lessee's expense.

8. OPTION TO RENEW. If the Lessee is not in default upon the expiration of thislease, the Lessee shall have the option to renew this Lease for a similar term onsuch terms as the parties may agree at the time of such renewal.

9. ACCEPTANCE OF EQUIPMENT. The Lessee shall inspect each item ofequipment delivered pursuant to this Lease. The Lessee shall immediately notify

the Lessor of any discrepancies between such item of equipment and the description of the equipment in the Equipment Schedule. If the Lessee fails to provide such notice before accepting delivery of the equipment, the Lessee will be conclusively presumed to have accepted the equipment as specified in the Equipment Schedule.

10. OWNERSHIP AND STATUS OF EQUIPMENT. The equipment will be deemedto be personal property, regardless of the manner in which it may be attached toany other property. The Lessor shall be deemed to have retained title to theequipment at all times, unless the Lessor transfers the title by sale. The Lesseeshall immediately advise the Lessor regarding any notice of any claim, levy, lien,or legal process issued against the equipment.

11. WARRANTY. The Lessor makes no warranties, express or implied, as to theequipment leased. The Lessee assumes the responsibility for the condition of theequipment.

12. RISK OF LOSS OR DAMAGE. The Lessee assumes all risks of loss or damage tothe equipment from any cause, and agrees to return it to the Lessor in the conditionreceived from the Lessor, with the exception of normal wear and tear.

13. INDEMNITY OF LESSOR FOR LOSS OR DAMAGES. Unless otherwiseprovided in this Lease, if the equipment is damaged or lost, the Lessor shall havethe option of requiring the Lessee to repair the equipment to a state of goodworking order, or replace the equipment with like equipment in good repair, whichequipment shall become the property of the Lessor and subject to this Lease.

14. LIABILITY AND INDEMNITY. Liability for injury, disability, and death ofworkers and other persons caused by operating, handling, or transporting theequipment during the term of this Lease is the obligation of the Lessee, and theLessee shall indemnify and hold the Lessor harmless from and against all suchliability. Lessee shall maintain liability insurance of at least $1,000,000.

15. CASUALTY INSURANCE. The Lessee shall insure the equipment in an amountsufficient to cover the replacement cost of the equipment.

16. GENERAL LIABILITY. Prior to commencing any work under this agreement,Lessee shall provide Lessor with 1) a certificate of documenting evidence ofrequired coverage; 2) an additional insured endorsement applying to MammothLakes Trails and Public Access its agents, officers, and employees; and 3) a noticeof cancellation or change of coverage endorsement indicating that the policy willnot be modified, terminated, or canceled without 30 days written notice to the

Lessor.

17. DEFAULT. The occurrence of any of the following shall constitute a defaultunder this Lease:

A. The failure to make a required payment under this Lease when due.

B. The violation of any other provision or requirement that is not corrected within 30 day(s) after written notice of the violation is given.

C. The insolvency or bankruptcy of the Lessee.

D. The subjection of any of Lessee's property to any levy, seizure, assignment, application or sale for or by any creditor or government agency.

18. RIGHTS ON DEFAULT. In addition to any other rights afforded the Lessor bylaw, if the Lessee is in default under this Lease, without notice to or demand onthe Lessee, the Lessor may take possession of the equipment as provided by law,deduct the costs of recovery (including attorney fees and legal costs), repair, andrelated costs, and hold the Lessee responsible for any deficiency. The rights andremedies of the Lessor provided by law and this Agreement shall be cumulative innature. The Lessor shall be obligated to re-lease the equipment, or otherwisemitigate the damages from the default, only as required by law.

19. NOTICE. All notices required or permitted under this Lease shall be deemeddelivered when delivered in person or by mail, postage prepaid, addressed to theappropriate party at the address shown for that party at the beginning of this Lease.

20. ASSIGNMENT. The Lessee shall not assign or sublet any interest in this Lease orthe equipment or permit the equipment to be used by anyone other than the Lesseeor Lessee's employees, without Lessor's prior written consent.

21. ENTIRE AGREEMENT AND MODIFICATION. This Lease constitutes theentire agreement between the parties. No modification or amendment of this Leaseshall be effective unless in writing and signed by both parties. This Lease replacesany and all prior agreements between the parties.

22. GOVERNING LAW. This Lease shall be construed in accordance with the lawsof the State of California.

23. SEVERABILITY. If any portion of this Lease shall be held to be invalid orunenforceable for any reason, the remaining provisions shall continue to be validand enforceable. If a court finds that any provision of this Lease is invalid orunenforceable, but that by limiting such provision, it would become valid andenforceable, then such provision shall be deemed to be written, construed, and

24. WAIVER. The failure of either party to enforce any provision of this Lease shallnot be construed as a waiver or limitation of that party's right to subsequentlyenforce and compel strict compliance with every provision of this Lease.

25. CERTIFICATION. Lessee certifies that the statements submitted to Lessor aretrue and correct and any material misrepresentation will constitute a default underthis Lease.

26. DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arisingout of or relating to this Agreement through friendly negotiations amongst theparties. If the matter is not resolved by negotiation, the parties will resolve thedispute using the below Alternative Dispute Resolution (ADR) procedure, unlessthe dispute or controversy meets the requirements to be brought before California'ssmall claims court.

27. Any controversies or disputes arising out of or relating to this Agreement, otherthan those excepted above, will be submitted to mediation in accordance with anystatutory rules of mediation. If mediation is not successful in resolving the entiredispute or is unavailable, any outstanding issues will be submitted to final andbinding arbitration in accordance with the laws of the State of California. Thearbitrator's award will be final, and any judgment may be entered upon it by anycourt having jurisdiction within the State of California.

28. SIGNATORIES. This Lease shall be signed by a Board Member on behalf ofMammoth Lakes Trails Public Access, and a Town Representative on behalf ofthe Town of Mammoth Lakes, and shall be effective as of the date first abovewritten.

Support staff recommendation to accept the OHV Planning Grant awarded to the Town of Mammoth Lakes from the CA State Off-Highway Motor Vehicle Recreation Division.

BACKGROUND:

The Grants and Cooperative Agreements Program (Grants Program) provides for well managed off-highway vehicle recreation in the State of California by providing financial assistance to cities, counties, districts, federal agencies, state agencies, educational institutions, federally or state recognized Native American Tribes, Certified Community Conservation Corps and nonprofit entities.

The Grants Program supports the planning, acquisition, development, maintenance, administration, operation, enforcement, restoration, and conservation of trails, trailheads, areas, and other facilities associated with the use of off-highway motor vehicles, and programs involving off-highway motor vehicle safety or education.

2018/2019 GRANTS AND COOPERATIVE AGREEMENTS PROGRAM

The California Department of Parks and Recreation, Off-Highway Motor Vehicle Recreation Division (OHMVR Division) announces its Intent to Award for the 2018/2019 Grants and Cooperative Agreements grants cycle.

Town of Mammoth Lakes - Planning: Amount Requested ($155,485): Amount Awarded ($155,485)

PROJECT DESCRIPTION:

The Town of Mammoth Lakes, in partnership with Inyo National Forest (INF), Mammoth Ranger District (land manager) and Mono County, is requesting California OHV Planning Grant funds for planning and environmental review (NEPA/CEQA) in order to optimize existing OHV trail facilities and to consider expanding opportunities for trails in the Shady Rest/Inyo Craters area (north of the town of Mammoth Lakes). This area lies within the Mammoth District of the Inyo National Forest (INF) and has the support of the District Ranger. This planning effort will enhance the existing OHV trail network by building upon existing infrastructure. Funds from the OHV program would be used for proper planning of new OHV trail facilities and to provide a more enjoyable and safer experience for OHV users including motorcycles, quads, e-bikes, side by sides and 4X4s. This effort will also potentially provide better access for camping, fishing,

swimming, birding, hiking, trail running, horseback riding, rock climbing, and mountain biking.

The need for a planning effort in this area has been apparent as the proliferation of user created trails, lack of clear wayfinding information, and public feedback indicate that the existing condition needs improvements. There are opportunities to create loops from existing dead ends, re-route unsustainable segments, create new fun trails, and to optimize existing staging areas. Visitation to the Mammoth Lakes area is increasing and as a result, existing infrastructure is not providing for a sustainable recreation experience. The Town of Mammoth Lakes Trail System Master Plan identifies several areas for future focused planning efforts. The Shady Rest/Inyo Craters sub-region is one of the areas identified for this planning effort. The OHV program funded recreation planning efforts for the Shady Rest area in 2011. The funding supported the design, review, and approval of the development of a new, year-round motorized staging area. This proposed planning effort will build upon the 2011 effort and consider a much larger project scope to include analysis of trails, roads, wayfinding, and staging areas. With increasing trail use, connectivity issues, and the use of non-system routes by trail users to make trail connections, it has been demonstrated that there is a need to plan and build new trail facilities while improving existing infrastructure within the Shady Rest/Inyo Craters sub-region. The Sierra Responsible Riders is an OHV local non-profit that supports this program and application. We will be working with them as partners as we proceed with public outreach and planning.

Project Deliverables: 1. Development of a proposed action through public outreach and professional project development.2. Environmental analysis examining the proposed action and the effects of that action.3. Environmental document to record the analysis.4. Decision document describing what has been authorized by the line officer.5. New routes identified, surveyed, flagged, mapped and approved for construction followingapproval from the Mammoth District Ranger.

Match: An entity that receives an award shall be required to provide a match of twenty percent (20%)

Support staff recommendation to apply for the “Recreational Trails and Greenways” grant funding from the State of California Natural Resources Agency - Proposition 68 State of California Parks & Water Bond, 2018.

BACKGROUND:

California voters passed the California Drought, Water, Parks, Climate, Coastal Protection, and Outdoor Access for All Act of 2018 (Proposition 68) on June 5, 2018. Proposition 68 authorized the Legislature to appropriate $27.7 million to the California Natural Resources Agency (the “State”) for competitive grants that provide non-motorized infrastructure development and enhancements that promote new or alternate access to parks, waterways, outdoor recreational pursuits, and forested or other natural environments to encourage health-related active transportation and opportunities for Californians to reconnect with nature. This resulted in the Recreational Trails and Greenways Grant Program. It is the intent of the people of California that projects funded by Proposition 68, including the Recreational Trails and Greenways Grant Program, result in public benefits addressing the most critical statewide needs and priorities for public funding. Applicants are encouraged to align, develop and improve non-motorized infrastructure and trails that lead to safer interconnectivity among parks, waterways and natural areas.

ELIGIBLE PROJECTS:

All projects must provide non-motorized recreational infrastructure development and enhancements that promote new or alternate access to parks, waterways, outdoor recreational pursuits, and forested or other natural environments to encourage health-related active transportation and opportunities for Californians to reconnect with nature.

General Requirements: 1. At least twenty percent (20%) of program funds shall be allocated for projects serving severely disadvantaged

communities. 2. Unless the project has been identified as serving a disadvantaged community, an entity that receives an award

shall be required to provide a match of twenty percent (20%). 3. Projects must provide workforce education and training, contractor, and job opportunities for disadvantaged

communities, where practicable. 4. Projects shall include the planning, monitoring, and reporting necessary to ensure successful implementation

of the project objectives.

5. Measurement of greenhouse gas emissions reductions and carbon sequestration associated with the project isrequired, where practicable.

6. Grant funds cannot be used to fulfill any mitigation requirements imposed by law.7. Projects should include, where feasible: a.) Efficient use and conservation of water supplies. b.) Use of

recycled water. c.) Stormwater capture to reduce stormwater runoff, reduce water pollution, or rechargegroundwater supplies, or a combination thereof. d.) Provision of safe and reliable drinking water supplies topark and open-space visitors.

8. Up to 25 percent (25%) of program funds may be made available to communities for innovativetransportation projects that provide new and expanded outdoor experiences to disadvantaged youth.

9. To the extent permissible under the State General Obligation Bond Law, up to five percent (5%) of the grantaward may be used to expand community access to the project. Funds must be used for capital assets with auseful life of at least ten years.

Examples of Eligible Projects: All projects must promote new or alternate access to parks, waterways, outdoor recreational pursuits, and forested or other natural environments to encourage health-related active transportation and opportunities for Californians to reconnect with nature. The list below provides examples of project elements that meet statutory conditions. It is not a comprehensive list.

• New/alternate non-motorized trails where one does not currently exist.

• New non-motorized trail segments to expand and connect to an existing trail or trail system to provide accessto parks, waterways, outdoor recreational pursuits and forested or other natural environments.

• Non-motorized bridges that continue a trail over a waterway or other physical obstacle.

• Access enhancements including trailhead facility, parking lot, restrooms, interpretive signage, kiosks, entrygate, and planting of trees and shrubs to provide shade, carbon sequestration, habitat values and erosion control.

• Acquisition of land for purposes of future development into an eligible project type. Trailside features such asplanting of trees and shrubs, benches, interpretive signage, wayfinding/directional signage, etc., are eligible as minor amenities of a trail project.

Grantee is responsible for ensuring the project complies with all applicable local, state and federal laws and regulations, including, but not limited to: allowable uses of proposed trail including e-bike uses, CEQA/NEPA, legal requirements for construction, building codes, health and safety codes, state contractor’s and other licenses, and disabled access laws. Grantee must certify that all applicable permits have been obtained.

Project Description: Located in the remote and beautiful Eastern Sierra Nevada region of California, the Town of Mammoth Lakes (elevation ˜ 8,000', population ˜ 8,000) is surrounded by public lands and sits at the doorstep of the Ansel Adams and John Muir Wilderness. Providing quality recreation opportunities and public access is the lifeblood of its economy and the cornerstone of its small but passionate community.

This project will provide new and alternate access to existing natural resources and recreation opportunities by developing a formal trailhead complete with end of trail features, ADA accessible restrooms, educational and interpretive kiosks, a free public transit-stop, and 35 miles of non-motorized, multi-use, soft surface trails. These trails will provide equitable access for locals and visitors to safely access the many natural resources of Mammoth Lakes from town managed Mammoth Creek Park integrating seamlessly into the existing Mammoth Lakes Trail System.

Creation of the new Sherwins Trailhead will include the following: * Paved parking including ADA accessible parking stalls* Sustainable vault toilet (double stall)* Bicycle parking rack* Bicycle maintenance rack (bike pump, bike tools, bike stand)* ADA accessible Interpretive & Educational kiosks (TOML Standard Type 7 signs)* Free public transit bus terminal (service provided by Eastern Sierra Transit Authority under contract with

Town of Mammoth Lakes)* Municipal Wayfinding and USFS standard signage* Public access to 35 miles of new trail accessing Mammoth Creek Park, the Mammoth Lakes Basin, andexisting soft-surface trails and multi-use pathways within the MLTS. (see map - Attachment #6)

STAFFING CONSIDERATIONS:

The required time to draft, submit and manage the grant submittal is within the work program of Town staff.

FINANCIAL CONSIDERATIONS:

Once a project alternative is identified, staff will provide a detailed scope of work, cost estimate (including any maintenance obligations), and a recommended source of funds for the match (if required) for Town Council consideration.

ENVIRONMENTAL CONSIDERATIONS:

Environmental Analysis is included as part of the grant application
