Architectural Review and Decision form In accordance with the Association’s documents and Architectural Review and Guidelines in the Covenants, Conditions, and Rest rictions, I hereby apply for written approval to make the following exterior alterations or changes to my property. Review Fee: Noted items within the Architectural Review Guidelines for Magnolia at Cane Bay require a $75.00 fee with submittal. Checks may be made out to FirstService Residential Charleston. The following ARB applications DO NOT require the ARB fee (but still need ARB review): Storm doors, paint freshening, skylights, satellite dish placement (if different from placement policy) and minor landscaping additions (softscapes including mulch and rocks). The following ARB applications WILL require the ARB fee: Fences, substantial play units, home additions and landscaping hardscapes. - ARB fees are good for 12 months from date of submission and cover all additional home modifications for the 12 month period - Modifications to the appearance of a lot or home that fail to utilize the ARB approval process as described in the Covenants, Codes and Restrictions may result in the following consequences: Modifications that appear to be compliant with current policies of the Association, but for which an ARB request was not submitted and/or not approved before work was performed: A certified letter will be sent to the owner of record with notification of violation of the ARB process and a $100 violation fine. Homeowner will be required to submit an ARB for the modification within ten (10) business days from receipt of the certified letter. Homeowner must include the $75 ARB fee with the submission if the type of modification requires it per the ARB process (the $100 fine does not cover the $75 fee). Failure to submit within the ten (10) day window will result in the application of an additional $100 fine being assessed against the lot; additional fines of $100 will be applied every ten (10) days thereafter until a completed application is received. Once received by the POA, fines will be suspended until the POA Board has had the opportunity to review and disposition the request. If ARB is not approved the homeowner will have 10 business days to remedy the discrepant modification. Modifications that are not compliant with policies of the Association: Modifications that are not compliant with the policies of the association and for which an ARB request was not submitted and/or not approved will not be approved or granted an exception to policy. A certified letter will be sent to the owner of record with notification of the ARB process and a $100 violation fine. The homeowner will have ten (10) days to remedy the discrepant modification. Homeowners in violation of the ARB process and Article VI of the Covenants, Codes and Restrictions will be referred to the POA Lawyer for legal action. This policy is effective as of June 7 th , 2019 and does not apply retroactively to modifications completed prior to that date. Satellite Dish ARB review and approval is not required for the installation of a satellite dish one meter in diameter or less placed within the homeowners

exclusive use area of their property. Installation of these devices should be on the rear of the structure or other location that minimizes visibility

from the street or front of the residence. It is also recommended that the dish be screened from street view where applicable, though screening

may not be a requirement unless otherwise determined by the Architectural Review Board after final installation.

responsibility of the applicant to determine and comply with all governmental regulations, statutes, codes and zoning requirements. It is the

responsibility of the applicant to secure any and all permits, inspections, authorization, and/or permission from government agencies prior to

work commencement. It is the applicant’s sole responsibility to ensure that any work commencing is within the property limits and meets all

building setback and easement restrictions.

It is the applicant’s responsibility to protect all elements inside the Association easements, and to return any area disturbed by the installation of a

modification to the same standards as previously existed. Upon completion of the improvement, the Association shall review and determine that

the installation is in compliance with the approval provided. If the improvements are deemed incomplete or further work is necessitated, applicant

shall be provided with a deadline for the completion of the work. If the improvements are not completed to the satisfaction of the Association

within the timelines provided, the Association may impose penalties until completion occurs.

All Architectural Review Control Request Forms will be reviewed within 60 days of receipt by the Committee. A copy of the completed request

Please initial after each guideline:

Before beginning any digging, you must contact Palmetto Utility Protection Services at 1-888-721-7877 and give

at least three (3) days’ notice. __________

Fences are not permitted within the public drainage easement(s) without approval from Berkeley County.

On corner lots, side yard fences must be setback from the side property line a minimum of one-half (1/2) of the

side building line setback shown on the plat. __________

Homeowners may install a six (6) foot privacy board / lattice type, six (6) foot privacy, four (4) foot gothic picket

or four (4) foot Charleston picket (refer to photos for approved fence types – ARB review is still needed before

installation).__________

Six (6) Foot fences on pond lots must start the transition to four (4) foot fence by the ten (10) foot mark from the

rear of the house and the transition shall be completed by the twenty (20) foot mark from the rear of the house.

There is a maximum of ten (10) feet allowed to transition from six (6) Foot to a four (4) foot fence.__________

Fencing must be constructed of wood and must remain a natural wood color. __________

Fences will come off back corners of house or up to ¼ the length of the house. __________

Architectural Review approval does not constitute Berkeley County building approval. Securing the necessary

approvals is the responsibility of the homeowner. __________

Fence is subject to all applicable Restrictive Covenants. __________

Fence must be built on the property lines. Vertical supports should be installed just inside the property line so the

finished siding boards sit right on the property line. __________

Fence must be built with the finished side facing street and support beams facing in. __________

Fence must be built as approved by the ARB. __________

Written approval must be received from the ARB before fence installation can occur. __________

Fence may not impede surface drainage to or from adjacent lots. All fencing must have three (3) inches of

clearance at the bottom to allow for drainage. __________

It is the homeowner’s responsibility to ensure contractors comply with all guidelines. __________

Homeowners wishing to constrct a fence on their property must choose from the fence styles pictured below.

Homeonwers can choose to erect a 4ft or 6ft fence , HOWEVER, if your property backs up to a pond you must have

a 4ft fence at the rear of the property. If there is a question as to whether or not your home is beside a pond, please
