VI. OLD BUSINESS:
A. Financial Status Update (PDSC and APD Allotment Releases): Chief Fiscal Officer Michael Moreno reported that PDSC received 89%, still pending the first half of January which was due by the 15th. APD is at 59%, an invoice was issued to Superior Court on January 6, 2015, sti II pending 2"d quarter allotment.
B. Domestic Violence Program Update: Chief Fiscal Officer Michael Moreno reported that DVP is still operating under one grant - STOP 2013 . There was enough funding as repmted at the last Board Meeting. However, Mr. Jacob Perez was approved to be placed under the CW A 2014 pay plan, which raised his annual salary, and includes retroactive pay, which resulted in shortening the funds available and the coverage period. A letter was submitted to the Governor' s Office requesting for additional funding to cover through April. The balance is now at $5 ,600 which will cover him another three pay periods. DVP is vying for the STOP 2014 grant to continue the program.
C. Alternate Public Defender Update: Attorney AnaMaria Gayle reported that they are just waiting to fill their legal clerk position. Chief Justice reminded APD that the Fiscal Year 2016 Budget request is due by March to the Judicial Council for approval at their April meeting.
D. Performance Review for APD Managing Attorney: Attorney Donna Cruz reported that she and Presiding Judge Alberto Lamorena, Ill completed the write up, but need one more review with Attorney Gayle. Tabled for next meeting under New Business in Executive Session .
E. Administrative Director Update: Attorney Eric Miller reported that we have 21 applicants and 5 for interviews. However, there is a 15 days appeal process for applicants to file their appeal , if any. The 15th day will end on January 21 , 2015. Interview panel will consist of Attorney Eric Miller, Attorney Richard Dirkx, Attorney Lori Long and Attorney Maria Fitzpatrick.
F. Credit for Outreach Time and Limit Credit for Mock Trial: Acting Administrative Director, Bernadette Lizama spoke to Superior Court HR Administrator, Barbara Jean Perez and the findings are if the Mock Trial is a part of PDSC's outreach program, then PDSC could give credit. However, set a cap and duration of time. Attorney Eric Miller recommended that 40 hours per fiscal year is a reasonable amount of time to be compensated for this outreach program. It's an incentive, an outreach program to benefit the local high school and the Guam Bar Association and PDSC is committed to the community. Chief Justice Robert Torres recommended that Attorney Eric Miller prepare a policy.
G. Executive Director - CW A Pay Grade Assignment: Tabled for next meeting.

RESOLUTION NO. PDSC 06-15
WHEREAS, On November 26, 2014, the Public Defender Service Corporation Executive
Director presented before the Board of Trustees an issue regarding time credit to
Attorneys who assist our local public and private high school students in
preparation of the Guam Mock Trial competitions locally and off-island; and
WHEREAS, It has become increasingly harder to get attorneys to assist our students who are
our future attorneys and who depend on our government and local attorneys to
teach, guide and mentor them; and
WHEREAS, the Public Defender Service Corporation finds it necessary to show our
commitment to the community by allowing Straight Time Work (STW) for our
Staff Attorneys who assist with the Guam Mock Trial competitions; and
WHEREAS, The Public Defender Service Corporation has developed a policy as stated in the
attachment made hereto; and
WHEREAS, Implementation of the attached policy is in compliance with Public Defender
Service Corporation Personnel Rules and Regulations; now therefore be it
RESOLVED, The Board of Trustees of the Public Defender Service Corporation, in its meeting
of January 20, 2015, directed the Executive Director to approve and implement
the attached “Policy Governing Time Credit for Community Outreach High
School Mock Trial”; be it further
RESOLVED, This “Policy Governing Time Credit for Community Outreach High School
Mock Trial” shall be effective immediately.

POLICY GOVERNING TIME CREDIT FOR COMMUNITY OUTREACH HIGH SCHOOL MOCK TRIAL
The local public and private high schools depend on our private and government attorneys to assist our students in preparation of the Guam Mock Trial competitions locally and off-island . It has become increasingly harder to get attorneys to assist our students, our future attorneys. Therefore, in order to promote participation in the Guam Mock Trial activities, a worthwhile outreach project beneficial to the community, the Public Defender Service Corporation will allow Staff Attorneys Straight Time Work (STW) up to 40 hours per fiscal year for time spent on coaching or judging Mock Trial.
In addition, Staff Attorneys who participate and accumulate 40 hours of STW for Mock Trial must utilize the 40 hours within that same fiscal year.
