WHEREAS, it has been 27 years since there has been an increase in fees for legal counsel appointed by the court to represent indigent criminal defendants; and

WHEREAS, the Lorain County Board of Commissioners adopted various resolutions to relating to previous fees schedules; Resolution No. 76-62, adopted on January 22, 1976 Resolution No. 88-112, adopted on February 17, 1988 Resolution No. 90-784, adopted on July 31, 1990 Resolution No. 90-883, adopted August 30, 1990 Resolution No. 05-371, adopted May 5, 2005 Resolution No. 09-710, adopted October 15, 2009 Resolution No. 17-349, adopted May 24, 2017 Resolution No. 17-409 , adopted June 21, 2017

And;

WHEREAS, Lorain County recognizes its responsibility under the laws of the State of Ohio and the United States of America to provide legal counsel for indigent individuals appointed by the Lorain County Courts. Lorain County Board of Commissioners hereby adopts the increased fee schedule which is set forth herein which the revised fee schedule shall be reviewed annually, along with all other general fund expenditures during appropriation proceedings.

WHEREAS, pursuant to Section 120.33(A)(3) of the Ohio Revised Code, in order for reimbursements said resolution must be adopted to pay counsel appointed by the Courts of Lorain County, Ohio as follows:

The following plan is adopted for use by the Courts of Lorain County including the Ohio District Court of Appeals and Supreme Court.

1. Payment for representation in trial level cases not involving a death penalty specification will be made based on the maximum rate

Effective July 1, 2017 will be $45.00 per hour for out-of-court services and $55.00 per hour for in-court services.

Effective January 1, 2018 will be $50.00 per hour for out-of-court services and $60.00 per hour for in-court services.

2. The prescribed maximum fees permitted in trial level proceedings are:Offense/Proceeding Fee MaximumAggravated Murder (w/specs) * $25,000.00 per caseper O.R.C. 2929.04(A) and 2941.14(B)

4. Payment are no longer made for social workers (non-attorneys) appointed as guardian ad litem, therefore, where attorneys are appointed as guardian ad litem, they shall be paid at the juvenile rates.

Appellate Level Proceedings

5. The prescribed maximum fees permitted in appellate level proceedings are listed below. The rates apply to each level of appeal.

7. Payment for post-conviction and state habeas corpus proceedings involving a death sentence shall be made based on the maximum rate of $45.00 per hour for both out-of-court and in-court services to a maximum of $55.00 to be divided among services in the trial court, the Court of Appeals, and the Ohio Supreme Court.

Extraordinary Fees/Hourly Rates

8. Cases eligible for Extraordinary fees or Extraordinary hourly rates are ones which, because of extraordinarily complex issues, multiple offenses, lengthy trials, or other reasons, warrant compensation at a rate which exceeds the maximums established by a county or the Ohio Public Defender. Payment for extraordinary fees/hourly rates are subject to the following requirements and are hereby enacted:

Lorain County hereby provides for extraordinary fees/hourly rates in this fee resolution adopted pursuant to R.C. 120.33(A)(3).

Extraordinary fees must be clearly documented in the appropriate sections on the Motion, Entry, and Certification form. Extraordinary hourly rates should be obtained at the beginning of representation by the assigned counsel.

The Judge hearing the case must indicate approval of the extraordinary fees and/or hourly rates by checking the “Extraordinary Fees Granted” box in the Judgment Entry section on the front of the form, and a copy of the journal entry/entries must be attached.

9. All Misdemeanors and felonies at Municipal Courts (statutory charge) are capped to be paid $250.00

Expenses

10. Payment for reasonable expenses requiring Court approval, such as transcripts or experts, associated with providing representation shall be made by motion and approved by the judge in advance of incurring the expense and the amount thereof is determined to be reasonable by the judge.

10.a All of the necessary forms are submitted to the trial judge in the General Division of the Lorain County Common Pleas Court no later than thirty (30) days after the attorney withdraws from the case, whichever date is earlier, or submitted to the Court in the Juvenile Division of the Common Pleas Court or the Appellate Court within thirty (30) days after the conclusion of the proceeding in that Court or within thirty (30) days after the attorney withdraws from the case, whichever date is earlier. Requests for payment of attorney fees and expenses which are submitted after the expiration of the thirty (30) day time limit will be approved for payment for good cause as determined by the trial judge.

Amendments to the Fee Schedule

11. Lorain County Commissioners may amend this fee schedule at any time. Whenever the schedule is amended or revised, a copy of the resolution amending the fee schedule is directed to be sent to the Ohio Public Defender along with notice to all the courts and assigned counsel.

Effective date

12. July 1, 2017 is the start date for the new reimbursement rate structure for newly assigned cases. All previously assigned cases will be paid at the existing rate in effect when assigned.

Motion by Kokoski, seconded by Kalo to adopt. Clerk called for discussion.County Administrator Cordes said there are lots of things going on with 911. Funds have been spent for the platform of New World

Technology and working on all the GPS components. All law enforcement jurisdictions are on board with the reverse 911. He stated that rather than build a new center a building was already available on Burns Road, Elyria that can accommodate 911 and the old office will be the backup center. The equipment is around $3-4 million and could be decreased. There are 80% of calls placed by cell phone and over 10,000+ calls received a day

Commissioner Kokoski said Cuyahoga County unveiled today text messages. Mr. Cordes said not sure how they did that since they have so many PSAP’s but glad they did. We are working on the GIS and we will have this capability as well.

County Administrator Cordes said he is comfortable with the current levy as long as the state does not withdraw the wireless funds. Commissioner Kokoski said what if this sunset. Mr. Cordes said then we will have to tell the taxpayers.

Commissioner Lundy said he has heard feedback from the taxpayers that a renewal is ok, but nothing else. Mr. Cordes said we owe it to the taxpayers, we are taking a risk but we will work on this levy and no additional funds are needed at this very point, but we never know what the state will do, he would prefer just to stay course at this point.

Discussion continued and the following resolution was adopted.

Motion by Kokoski, seconded by Kalo to adopt. Clerk called for discussion.County Administrator Cordes said there have been discussions taken place with the Sheriff and DTF and was hoping to make a big

announcement today along with this levy request but hopefully all the parties will be together for July 19 meeting. He feels comfortable to keep this levy at the level it is at. Commissioner Kalo said with the building and all, was not really expecting a renewal. Mr. Cordes said the taxpayers are fatigue, not happy with the Commissioners and he understands that and will work to provide that it can be done for now at the renewal. Commissioner Kokoski said taxpayers are not happy with any increase levy and how the homeowners have to burden everything, they are ok with renewal but no increases. Mr. Cordes said there is a drug epidemic in Northeast Ohio actually all over and Lorain County will make it a hostile environment to have narcotics here and the misuse of such. DTF needs to come into the 2017 century, collaborations with other right partners, we will never eliminate the illegal trafficking in drugs in the county, but this will make a difference, come together, get it done and leadership and opportunity will be provided

Commissioner Kalo said there are other counties that have received the mobile freezer for all the bodies.Commissioner Lundy said taxpayers are responsible and a renewal is fair. The state has taken $35 million for local government funds

and Columbus is not here to help us we need help with treatment facility, we cannot arrest ourselves out of this. The state has abandoned us, cuts across the state and nation are increasing and it falls onto the local government. The state has that $2 billion surplus and the politics need to stop. The Lorain county Veterans Court has helped a lot of people but there are people still out there that just let these people die; they could be your family member. These people that have addictions need help and they can be productive people. Commissioner Kokoski said this is a serious problem the Governor has not even declared it an epidemic but something needs to be done.

at a rate not exceeding .080 mills for each one dollar of valuation for 5 a period of five years, as authorized by Ohio Revised Code Section 307.45 (A)(1), which levy is a renewal levy. Said levy shall be submitted to the electors of Lorain County at the General Election to be held November 7, 2017, to be placed on the tax duplicate for the year 2018, to commence collection in 2019.

6Such levy shall be placed on the ballot at the election to be held on November 7, 2017.

Lorain County Child Support Agency shall expend all of the funds to cover any ceiling excess for the State Match.

providing adequate documentation otherwise. Quote/bid must be within 10% of estimate. Assuring that current prevailing wage rates (Davis-Bacon) are provided to the contractors (to be obtained from the Lorain

County Community Development), when necessary. Acquiring authorization to proceed from Lorain County Community Development prior to authorizing the contractor to start

construction. Permitting the Community’s Labor Compliance Officer on-site during construction to interview the contractor’s employees. Acquiring invoices from all contractors and suppliers along with weekly payroll reports. Providing invoices to the Lorain County Community Development for the project expenditures (those funded both with public

and private funds) and requesting payment for 50 percent of those invoices, up to $10,000 Allowing the Community’s inspector on the site to review the construction and to determine completeness. Agreeing to withhold final reimbursements to the contractor until Community approval is received. Agreeing that the building will not be intentionally demolished for at least five years from the date of project completion. Agreeing that all contracts must comply with the Executive Order 11246 regarding non-discrimination. Agreeing to hold the Community harmless from any potential litigation or disputes involving quality of work and materials used

on this project. The Community is in no way responsible for warranties or quality of work issues regardless of the source of funds used on this project.

Otherwise cooperating with the Community to assure that the CDBG program requirements are being met.Building/Business Owner understands the following:

The Community is bound by CDBG regulations to require the above information and steps. The Community is under no obligation to provide a grant to the Owner if the Owner fails to comply with program regulations. Jeff Baxter, Elyria thanked the Commissioners for allowing him to educate the voters in Lorain County. There are 2 petition initiatives that folks are gathering signatures for. He spoke with 1000+ voters in the past months and has been a lot of work to educate them on how a petition process works, but it is a good thing. The voters appreciate it and a lot of knowledge has been gained by the voters. He continues to talk with voters and voters are unhappy so he will ask again for the commissioners to consider a resolution to repeal the sales tax resolution after 1 year

Jeannie Donaldson, Lorain and CEO of YWCA, Elyria. She comes before the Commissioners, it is that time of year again for fairs, festivals, funnel cakes, fried ice cream, fried cheese, etc., and however there will be several thousands of them that will not go to the Lorain county fair this year. He knows that some of the Commissioners did not attend the fair last year. She is coming here again, to ask the Commissioners to not give up with having the confederate flag at the county fairgrounds. She did attended a fair meeting about 1 month ago and reminded them that the State of Ohio fair does not permit the sale of the confederate merchandise, also reminded them of their own bylaws. Item 1, Section 1, Lorain county fair board under no circumstances that any questionable nature will be sold or permitted on their grounds and there are several thousands of them that feel the confederate flag and memorable is highly controversial. Some folks say why is YWCA involved in this activity. The fair minded collation has several organizations involved and the YWCA and mission around the country are to embrace the power of women, we look at issues of racial justice and what we know working with other organizations, for many folks thinking the confederate flag is just part of clothing, history, nostalgic but they know that the flag is the number one Neo Nazi, White Supremacist groups, which seems not a big deal but to them it is, it is racist. She does it because it is her job but she also has a personal connection, her mother came from Tacoma, GA, 7 years old in 1925 and moved to Sandusky Ohio. Her dad lived in Nashville in 1912. For a lot of African Americans and the south and confederate flag and at that time was traumatized of people. It is similar to Veterans they do not talk about Vietnam War and many do not talk about the experience in the south. She can remember when she was watching TV and it showed the Ku Klux Klan riding into town. Her mother told her that when she was a little girl in Tacoma GA, right next to South Carolina, her dad had already moved to Sandusky to work in the steel factory, so her grandmother, mom and five siblings were still in GA and she was about 5-6 years old. She said the KKK went up to the house and her grandmother went out with a rifle and said you know there is no one here but her and her children, so this is trauma. She said when she was a teenager she use to watch her dad be very respectful with white people, yes sir, no mama, etc and asked why are you like this and did not know until she learned history that you needed to walk on the right side of the street, etc or you were going to get lynched. She said the confederate flag is the number one symbol for this kind of activity up until the civil rights movement so there is no reason in Ohio, especially at our Lorain county fair that this should be sold. She asked the commissioners as ex-officio officers of the fair board, according to their bylaws to remind their colleagues to do what the Ohio state fair board has done and ban the sale of merchandise.

Commissioner Lundy said her request is very reasonable request and simply follow the policy and guidelines of the state fair. State fair does not make decisions lightly and ask any focus groups anywhere in the country if this symbol that unites or divides, symbol of love or hate and you would get the clear definition of what it is for. He continues to believe people see but don’t want to get the wrong perception of the county, we are a very diverse county, we are home of the International City and it’s also important for her to know that the Commissioners are very supportive of the 4h students involved with projects out there and decisions are made by adults and we don’t want it to have a negative impact on the children and we have reached out for awards that will be presented and make clear that we support the students and disappointed by some decisions that were made by adults but support the students.

Public comment cont. June 28, 2017

Gerald Phillips, Avon Lake said he has been a resident for 34 years, community activities, a rebel rouser. He got engaged from Columbia Township regards to the annexation and happy to report that the applicant withdrew the application. He said will be forthcoming to the Commissioners but its mute because Olmsted Falls would pass a resolution on or before the 29 th. This process of Columbia Township was an example of democracy, getting residents of both communities educated, involved and clear example of efficient process and was a good citizen’s effort to get involved. The council meeting was packed, exceed the fire code and don’t expect this issue to come back and in his opinion the representative people in Olmsted Falls realize that it is not good for their community or township and was withdrawn, and have votes call the roll and knew it would get defeated so the July 18 hearing will not be needed.

He stated he was at the Lorain International festival and got 500 signatures on the sales tax initiative and will get enough to meet requirements to place on the ballot. He said Mr. Innes has indicted that this was in litigation and hope to avoid because it just creates more bad will and hope the commissioners will get above the low rating of Donald Trump

He also stated the 7th district will get enough signatures for their initiative to place on the ballot and what is helping them gain support is the sales tax issue and hope the Commissioners are listening to Jeff Baxter and him and trying to help the commissioners. He said he is not in favor of this initiative, petition, contents or group behind it. He is open to the concept of a charter form of government for a better way of government but not supportive of this one. He did sign this petition back in March and intend to notify the circulator that he wants his signature removed because he does not want to be associated with this. If this issue gets on the ballot. Commissioner Lundy asked why not. Mr. Phillips said why, because he does not support the petition and the actual language in it. Commissioner Lundy asked what parts. Mr. Phillips said that is for another day of discussions. Mr. Phillips said he is also not supportive of the people involved in this process. If this gets on the ballot, fails and commissioners continue to ignore the taxpayers and don’t listen, example was the sales tax and there may be a new group for a new charter that is a better one in the future. This issue may not go away. He stated that he and Mr. Innes met to try to work something out with the sales tax issue, made progress still pursuing but there is a small time frame. He said some of the ideas are what Mr. Baxter mentioned. His personal thoughts on the issue of a sales tax and understand the Commissioners position and the reason is lowest in the state, and spoke with many people and have some potential ideas to educate the people, inform and that it is needed to get pass, limit to a specific purpose, not to the general fund and if needed get a citizens advisory group to help with the process of determining need to monitor and expend. There are certain issue that he thinks the public will be very respective too; drug enforcement, drug treatment, the opiod problem, sheriff, safety, 911, this would help. He has been an activities and he was successful in get the annexation opposed, privatizing metro hospital, which is public today, representative groups in Lakewood to save their homes from eminent domain and he has previously indicated to the commissioners he would help them and this is sincere and hope that commissioners are listening and restore your confidence with the people.

Commissioner Kokoski moved, seconded by Kalo to go into an executive session at 11:45 a.m. to discuss new hires at WDA, ongoing labor with UAW/JFS and the rejection of the fact finder, update on USW 911 & bridge, purchase of real estate and 1 pending legal matter and court action. Upon roll call the vote taken thereon, resulted as: Ayes: all.
