David Payne called t~e Public Hearing to order at the Bloomfield TownshipHall, 4200 Telegraph Road, stating the purpose of the hearing was to reviewand confirm the weed harvest assessment roll for Upper Long Lake.

Residents were notified of the meeting by first class mail. Twelve residentswere present with questions regarding the overall quality of the lake such ashow edible are the fish in the lake and e-coli levels in the water. Ron.Cousineau stated that West Bloomfield has an environmental departmentwho study and test the lake, also Bloomfield Township Water and SewerDepartment is facilite;tting water quality testing through the 9 Lake ForestLake Outlet Watershed (F.L.O.W.) project. Ron Cousineau has kits availableto test for e-coli.

Ron Cousineau reviewed the budget and the amount of the assessments. The2001 budget will be increased $31,294.60 over the $49,000.00 assessmentin 2000 for two years. The scope of the weed-harvesting program will beincreased to include Improvements/Repairs to the harvesting/boat launchsite to improve the current ramp for boat launch capability and add apermanent and separate site for harvesting, also included are a new seawall,retaining wall repairs, boardwalk, light fixtures and landscaping. This willensure that there is a long-term capability to allow simultaneous boatlaunching and harvesting. The full assessment will be $398.50 and partial$99.60. Due date will be June 1, 2001. These rates will be inplace for 2years to pay for the work as outlined. Victor International is contributing$80,000; to the project for their use of the Boat launch

Michael Scheid, 2581 McClintock Roaq, Bloomfield Hills, Michigan, 48302, has applied to thisoffice for a permit under authority of Part 301, Inland Lakes and Streams, of the NaturalResources and Environmental Protection Act, 1994 PA 451, as amended. The applicantproposes to construct a 275 feet long interlocking sheet steel sea wall directly in front of anexisting sea wall and backfill with approximately 30 cubic yards of commercial fill, replace six 2foot by 20 foot eXisting docks with the same, add a 30 foot long dock extension to the end of theexisting main dock with a 12 foot by 12 foot platform, construct two new 1ofoot by 15 footconcrete boat ramps on Upper Long Lake for the purpose of upgrading failing structures. AMarina Operating .Permit has also been requested to operate a facility with 12 boat slips, 12parking spaces, and 2 boat ramps. The project is located in T2N, R10E, Section 7 , BloomfieldTownship, Oakland County, Michigan, in accordance with plans attached to this notice.

When an application is received for a permit to authorize work in or over inland waters of the State of Michigan,pursuant to PART 301, INLAND LAKES AND STREAMS, OF THE NATURAL RESOURCES ANDENVIRONMENTAL PROTECTION ACT, 1994 PA 451, AS AMENDED, provides that the department shall submitcopies for review to the director of public health, the city, village or township, and the county where the project is to belocated, the local soil conservation district, the local watershed council organized under Part 311, if any, the local portcommission, if any. Additionally, notification is provided to certain persons as provided by statute or determined bythe department.

Those persons wishing to make comments on the proposed. project shall fumish this office with their comments inwriting no later than 20 days from the date of submission for review of this notice. Unless a written request is filedwith the department within 20 days after the submission of this notice, the department may grant the applicationwithout a public hearing. The determination as to whether a permit will be issued or a public hearing held will bebased on an evaluation of all relevant factors including the effect of the proposed work on the public trust or interest,including navigation, fish and wildlife, pollution, and the general public interest. Written comments on these factorswill be made part of the file and will be considered in determining if it is in the public interest to grant a permit.Objections must be factual and specific and fully describe the reasons upon which any objection is founded.

LAKE LAKE M.ANAGEJ\1ENT COlVfMITTEE RELATIV"E TO WEED HARVESTING,-(

1. For approximately 20 years, UILE has allowed the Lake Management Committee toconduct weed harvesting through Lot 64 of Upper Long Lake Estate's Subdivision No. 1 ("Lot64").

2. As a result of the past lake harvesting practices, the Lake Management Committee agreedon April 13, 2000 to pay up to $10,000.00 for repairs to the seawall, road and launch site at Lot64. TPis amount was increased on April 5, 2001 to an amount not to exceed $60,000.00 in orderto allow VILE to reconfigure Lot 64 so that a new launch facility would be constructed. Thereconfiguration shall be made in substantial accordance with the diagram and specificationsattached hereto and incorporated herein, which plans have been reviewed by and are satisfactoryto the Lake Management Committee and its current weed harvesting contractor (the "Project").

3. ULLE contemplates spending approximately $140,000.00 for the Project plus receivingapproximately $10,000.00 in landscaping to be supplied by Turtle Lake Development. The LakeManagement Committee shall pay ULLE 6/14 of all reconfiguration costs incurred by ULLE, upto a maximum of $60,000.00, for the reconfiguration Project. The Lake Management Committeeshall remit fund Viithin fourteen working days of written requests by ULLE for payment by

1.:; . presentation of invoices for work performed by ULLE1s contractors. For example, if ULLEincurs an invoice for road work in the amount of$14,000.00, Lake Management Committee shallremit to ULLE the sum of $6,000.00 within fourteen days of the written request .for payment.Requests shall be delivered to Lake Management Committee, c/o Ron Cousineau, 1875 LongPoint, Bloomfield Hills, :Michigan 48302.

4. .. On a yearly basis, ULLE shall grant the right of access to and from Lot 64 for thepurpose of allowing weed harvesting removal from Upper Long Lake between April andSeptember of each calendar year and only during such reasonable times as are jointly establishedby ULLE and the Lake Management Committee. Upon completion ·of the Project, there shall betwo launch facilities, and ULLE shall designate the facility from which weed harvesting shalloccur and the other facility shall not be used for weed harvesting. Such access shall include theright to launch and retrieve weed harvesting water craft to and from Upper Long Lake and thetemporary right to park during the day the necessary weed harvester, conveyor, dump (weedremoval) vehicle and equipment vehicle upon Lot 64 in connection with such weed harvesting.Lot 64 shall not be used for overnight storage of any vehicles or equipment, other than oneconveyor and no mor~ than three vehicles (which shall not be automobiles). All otherequipment, trailers and vehicles must be removed from the Subdivision, including the publicroads. There shall be no more than three harvest periods over approximately 18 harvest workingdays. There shall be no harvest working days on weekends or holidays, and no weed harvestingequipment shall be stored on Lot 64 over a holiday without prior approval by ULLE.

5. The parties contemplate that the Lake Management Committee shall hire an independentcontractor to perform such weed harvesting activities, which independent contractor must beapproved by ULLE. The Lake Management Committee and its contractor shall use their best

(including, but are not limited to, Bloomfield Township or the Michigan Depanment ofEnvironmental Quality), renders an opinion, orders, or judicially determines that the useof Lot 64 as defined by this :NIemorandum of Understanding or any future modificationsthereof: or any activity under this Memorandum of Understanding may jeopardize anyexisting right, privilege, or ownership interest of any lot owner in Upper Long LakeSubdivision No. 1 or Upper Long Lake Subdivision;

then ULLE may suspend access to the Lake Management Committee. Notwithstanding theforegoing, in the event that the condition which permitted the suspension of: or the cessation ofentering into, the Memorandum ofUnderstanding is overturned, rescinded or otherwise removed,ULLE shall reinstate access to the Lake Management Committee for the purposes statedhereunder.

11. The Lake Management Committee shall, within thirty days of written request forreimbursement, pay ULLE for (i) thirty-three and one third (33 1/3%) percent of the total cost ofthe improvements and repairs to the driveway from the Long Point Road to the harvestingllaunchpad, and (ii) fifty (50%) percent of the total cost of improvements and repairs to the seawalladjacent to the harvestingllaunch pad, and (iii) seventy-five (75%) percent of the total cost of theimprovements and repairs to the harvesting/launch pad.

12. At least once every 5 years, the Lake Management Committee shall diligently reviewthrough a consultant study (a) alternatives to weed harvesting for the lake and (b} alternativelocations for weed harvesting.

13. Any year in which weed harvesting is conducted from Lot 64, the Lake ManagementComnuttee shall reimburse ULLE for all charges and assessments paid by ULLE to the UpperLong Lake Lake Board for Lot 64 pursuant to Special Assessment District 288.

14. Weed harvesting shall be allowed pursuant to this Memorandum ofUnderstanding uponcompletion of the Project and payment offunds referenced in Paragraph 2 above and ULLEentering into an agreement with Turtle Lake Development LLC relative to a disputed portion ofthe real estate along the boundaries of the respective subdivisions and lake access for Turtle LakeDevelopment condominium owners.

David Payne called the Public Hearing to order at the Bloomfield TownshipHall, 4200 Telegraph Road, stating the purpose of the hearing was to reviewand confirm the weed harvest assessment roll for Upper Long Lake.

Residents were notified of the meeting by first class mail. Seven residentswere present.

David Payne introduced Board members.

Ron Cousineau, Resident Representative, explained that the 2001 assessmentincrease was for improvements to the boat launch and weed harvestingaccess site, Lot 64 in Upper Long Lake Estates. Construction was completedand the Heron Bay residents can use the site through a negotiatedagreement with Victor International. The 2001 rate increase was approvedby the Lake Board for a 2-year period and was due this year to be reducedto the 2000 rate as follows:

After working on the budget Mr. Cousineau recommended an increase fromthe 2000 rate for 2003 as shown above. The increase will allow for

continuation of the three annual weed harvests as well as hiring a limnologistconsultant to provide a study of the lake. A resident questioned whetherthe limnologist would study the "pea soup" (algae) problem. Ron advised thealgae problem is evident has been attributed to the high levels of nutrients,fertilizers, septics, trees,etc.

In addition to the limnologist, Ron recommends contracting with aprofessional company to perform water quality testing. Volunteers haveperformed the water quality testing in the past but it has proven to be aburden.

Mrs. Boehringer, resident at 1816 Long Lake Shores for 41 years, questionedwho controls the weir. Resident and harvester, Robert Wittbold advisedthat he has the key to the weir and works with Roger Cobb, Ron Cousineau,and Dr. Cutler to determine water levels. They do their best to maintain thewater levels on Upper Long, Lower Long and Forest Lakes within t inch. Thewater levels are currently very high but for the past 2 years the area hashad little rain and water levels have been very low.

Traian Cojocaru, resident at 1880 Marie Circle for 25 years, objects to thespecial assessment saying that he doesn't use the lake. He inquired about asenior citizen rate. David Payne explained how the lake access adds to thevalue of his property.

It was also suggested that the Township require homeowners with septics tohave periodic inspections of their septic tanks. Ron Cousineau suggestedthat whenever the ownership changes a septic inspection should be requiredby the Township. David Payne advised the County and Township have beenworking on an Ordinance regarding septic inspections.
