3 TRADE WASTE ENVIRONMENTAL MANAGEMENT PLAN J Relph: 1/58/13-11: #1847907
RECOMMENDATION: That the Council adopt the General Policy Trade Waste Environmental Management Plan
INTRODUCTION: Council has previously adopted the Trade Waste Policy (Trade Waste Environmental Plan) for dealing with trade waste discharges to the wastewater system. This occurred at the ordinary meeting of 26 July 2007. The purpose of this report is to re-adopt the General Policy – Trade Waste Environmental Management Plan.
COMMENT: The attached Trade Waste Environmental Management Plan has only had minor adjustments to it from the Plan that was adopted in July 2007. These adjustments predominately reflect the new regulatory framework set by the recently enacted Water Supply (Safety and Reliability) Act 2008 (Water Supply Act) and will correctly reference any parts of this Act that have subsequently superseded relevant sections of the Water Act 2000. Other proposed changes to the document include:
Introduction Commentary on a supplementary objective of the Trade Waste Policy, that is:
In the past, residential ratepayers have had to bear the extra costs involved with the treatment of commercial and industrial discharges. The purpose of the Trade Waste Policy is also to remove this burden and provide a true user pays system.
This is considered an important point to identify the Council’s continued commitment to care for the environment in a transparent and equitable manner.

7.1 a) Trade Waste Charges Amended to distinguish the timing differences between the invoicing of Permit Fees as opposed to volumetric charges. The amendment reads:
Permit fees forwarded annually for category 1 and category 2, with volume charges billed four (4) monthly.
7.1.1 General Trade Charges Categories 1 and 2 have been combined to grammatically simplify how the charges will be determined. The amendment reads:
• An annual flat charge (non-refundable) to cover the cost of treatment and recurring administration and overhead costs associated with trade waste control shall apply.
• Where the water consumed for the property exceeds 1.37 kilolitres per day a
quantity charge shall apply.
Category 3, bullet point 2 has been amended to include: TKN (Total Kjedahl Nitrogen), TP (Total Phosphorus) and sulphates.
7.2.4 Penalty Charges for Non-Servicing of Arrestors This represents a specific breach of legislation in discharging “trade waste into the local government’s sewerage infrastructure“, given that the arrester is not maintained according to the conditions of the Trade Waste Permit (Water Supply Act, Part 6). The amendment reads:
Penalty charges based on equivalent arrestor charges (section 7.1.3) may be applied in the instance of non-servicing of arrestors or failing to comply with the servicing requirements in the conditions of the Trade Waste Permit.
12.1 Category 1 and 2 Incorrect reference to section 7.2.2 has been amended to:

section 7.2.1. 13.1 Removing Regulated Waste from Premises The title “Waste Services Co-ordinator” no longer exists. Amendment reads:

Grease Arrestors According to Part 6 of the Water Supply Act, the local government can grant approval that is “conditional” and subject to consideration of the “effect of the proposed discharge”. For this reason the Policy has been amendment to allow Inspectors the opportunity to consider, on a ‘case by case’ basis, the risks associated with approving the installation of an arrestor in excess of a 2,000 litre capacity. The amendment reads:
In certain circumstances Water & Waste may approve the installation of an arrestor in excess of a 2,000 litre capacity. Applications must include all details relating to loadings and accompanied with detailed plans and specifications of the proposed device.
13.2.2 Mineral Oil Arrestors To avoid any ambiguity, the use of “Quick Break” detergents are no longer subject to manufacturers recommendations, but are specifically confined to be used only in mineral oil separators. The amendment reads:
“Quick Break” detergents and degreasers may only be used in mineral oil separators.
13.4 Food Waste Disposal Units To better communicate that food waste disposal units are generally not approved for non-domestic use, additional text has been inserted. This paragraph now reads:
Food waste disposal units (garbage grinders/sink-to-sewer disposal units) are normally not allowable, but may be approved for non-domestic use by specific application to Water Waste…

Cairns Regional Council’s Corporate Plan Goals for Water Supply states:
The community desires better conservation of the natural environment as the region grows and more people live and visit here; we need to ensure the sustainability of our natural resources so that future generations can benefit from them as well.
