2015 review: This policy is based on the undated MASC model policy "AB The People and TheirSchool District". During review performed 20 September 2012, the Littleton policy is identical.
This policy states the basic responsibilities of the school committee and commitment to thecommunity.
During the first reading on 20 September, the committee asked about the phrase in Item 3 "Thecommittee recognizes that ultimate responsibility for public education rests with the state"From the Mass Constitution "Chapter v Section II The Encouragement of Literature: ... it shall bethe duty of legislatures and magistrates, in all future periods of this commonwealth, to cherishthe interests of literature and the sciences, ... public schools and grammar schools in the towns..."
Mass General Law Chapter 69 establishes the Department of Elementary and SecondaryEducation with the intent "..a deliberate process for establishing and achieving specificeducational performance goals for every child, and (4) an effective mechanism for monitoringprogress toward those goals and for holding educators accountable for their achievement..."Section 1J in describing chronically underperforming schools empowers the DESE to appoint areceiver "The commissioner may select the external receiver upon the designation of a school aschronically underperforming. The external receiver may serve as the commissioner’s designee forthe purpose of creating a school’s turnaround plan under subsections"
Chapter 69 establishes the guidelines for local districts and in conjunction with Chapter 71 setsthe requirements local school districts must follow.
While districts execute the education of the students, the authority flows from the legislature tothe DESE to the local school committee.

2012 review: This policy is based on the undated MASC model policy "AC Nondiscrimination".During review performed 29 July 2012, the Littleton policy required minor corrections to legalreferences and a change to include "gender identity" as specific criteria of nondiscrimination.This change is required due to changes in Mass general laws, Chapter 199 of the acts of 2011.
Court cases and various regulatory changes continue to modify these acts. The referencesbelow represent basic regulation and may not represent all modifications. The reviewer did notfind specific consolidating legal reference representing the final composition of theseregulations.
2015 review: This policy is based on the undated MASC model policy ""AC Nondiscrimination".During review performed 20 September 2015, the Littleton policy is identical. Gender identifywas inadvertently missing from one sentence in the Littleton policy
Notes: Title VI, Civil rights act of 1964: Prevents discrimination by government agencies that
receive federal funds Title VII Civil rights act of 1964, as amended by EEO of 1972: prohibits discrimination
against an individual based on particular race, color, religion, sex, or national origin andother criteria.
Executive Order 1246, as amended by EO 11375: established requirements for non-discriminatory practices in hiring and employment on the part of U.S. governmentcontractors. EO 11375 prohibits discrimination based on sex.
Equal Pay Act, as amended by Ed. Amends 1972: prohibits wage discrimination byemployers and labor organizations based solely on sex.
Title IX, Ede Amends of 1972: avoid the use of federal money to support sexdiscrimination in education programs and to provide individual citizens effectiveprotection against those practices.
Rehabilitation Acts of 1973: prohibits discrimination on the basis of disability inprograms conducted by Federal agencies, in programs receiving Federal financialassistance.
Education for All Handicapped Children Act of 1975: established that Federal programscould not discriminate on the basis of disabilities
Education for All Handicapped Children Act of 1975: requires all public schoolsaccepting federal funds to provide equal access to education and one free meal a dayfor children with physical and mental disabilities.

During the first reading on 20 September, the committee requested the language specifying theSuperintendent as the Title IX officer be re-worded to "Superintendent or Designee" and usethis language consistently. The intent is the policy will not name specify individuals within theadministration and have the Superintendent appoint the appropriately qualified person.

The MASC policy is specific toward sexual harassment. In reading relevant and cross referencedlaws and regulations, the reviewer has determined this is a complex legal area with referencesto both discrimination and harassment.
2015 review: During review performed 20 September 2015, the Littleton policy is titled"Harassment Prevention and Response", differs significantly from the current MASCrecommendation. The current Littleton policy addresses all forms of harassment per MGL 76:5

Update theLittleton polity to incorporate proper legal references in, update all categories to include"gender identity'" as recently included by MGL updates. Minor text edits to includeconfidentiality for all harassments complaints, not just sexual harassment.

Students and their personal belongings, including student vehicles, are subject tosearch by school personnel. In order for school personnel to search a student orhis/her belongings, there must be a reasonable basis for suspecting that the searchwould reveal evidence that the student has violated the law or school rules. In theevent of a search of a student or his belongings, parents will be notified of the searchand the results thereof as soon as practical.
Except as otherwise necessary due to exigent circumstances, searches will beconducted by a school administrative staff member in the presence of anotheradult. In all cases, the nature of the search must be reasonably related to theobject sought and not excessively intrusive in light of the age and gender of the child.
In the event a student is found to be in possession of an object or substance which maygive rise to a crime, such object or substance will be given to the police. Other objectsor substances, which are prohibited by school rules or are otherwise disruptive to theschool environment, may be held by school officials for later return to the student’sparents.

The interim policy is based on the policy developed by the Fitchburg School district. At the timeof adoption, MASC had not produced a model policy and Dept. Public Health had not publishedfinal regulations on concussions. This policy was adopted as interim pending final publicationand review of the MASC policies.
During the policy sub-committee meeting on 18 January 2012, the MASC model policy wasreviewed and determined to repeat much of the DPH CMR. One area the sub-committeedetermined was of significance and concern is the re-entry of injured student to both athleticand educational activities. The sub-committee voted to add the phrase "Graduated reentryplans for return to full academic and extracurricular activities should be considered." The intentof this addition is that all aspects of reentry to school will be considered. An example usedduring discussion is a student that suffers from a concussion in a sports activity, theirparticipation in other activities (i.e. school play) and classroom activities will be governed by there-entry plan.
