Background on Settlement Agreement• Q. Who is covered in the Settlement Agreement’s
housing provisions?
• A. People who are:– 18 years or older– have a developmental disability– meet one of the following:
• transitioning from a skilled nursing facility (SNF) or statetraining center and need the level of care for aDevelopmental Disabilities (DD) Waiver
• receiving services funded by a DD Waiver (e.g., aBuilding Independence, Family and Individual Support orCommunity Living Waiver)
• on the waitlist for a DD Waiver
Background on Settlement Agreement
DBHDS counts people with developmental disabilities as “transitioned to housing” if they:• are in the Settlement
Agreement population• are not living with a parent,
grandparent or guardian • have executed a lease• are leasing a unit that is not a
DBHDS/DSS licensed setting

Answer: There are multiple “eyes on” an individual. Each person may have a different primary contact, depending on the assistance they
receive. The key players are:– Support Coordinators– Provider of Support Services– Family/Guardian– DBHDS’ Regional Housing Specialist
What Happens in an Emergency?“What policies/procedures does my company follow when any other tenant has an emergency?”
• Call 9-1-1 – In cases of a true emergencyinvolving fire, health, and safety
• Contact the individual’s emergency contact listedincluded in the applicant file

As of October 2019, nearly 1,000 adults with a developmental disability in the Settlement Agreement population are living in their own home in the community with natural, Medicaid waiver and other supports? Many have done so using resources made available specifically to this population. You can too! Who is included in the Settlement Agreement Population? The Settlement Agreement* target population for housing includes Virginians with developmental disabilities at least 18 years of age or older who are in one of the following categories: 1) Living in a training center, intermediate care facility, skilled nursing facility and eligible for one of the Medicaid DD Waivers; or 2) Receiving Medicaid DD Waiver services; or 3) On a waitlist for Medicaid DD Waiver services.
* The Commonwealth of Virginia entered into an agreement with the U.S. Department of Justice to create housing options for eligible individuals with DD in the community.

How Can A DBHDS Housing Coordinator help? A Housing Coordinator is available to provide you, your family and your support coordinator with technical assistance to help you access your own home in the community. Areas where we can help are as follows:
1) Providing information about available housing resources; 2) Assisting with developing a Housing Action Plan and Implementing the Plan; 3) Assisting with submitting a DBHDS Housing Resource Referral; 4) Assisting with locating housing and completing rental and housing assistance applications; 5) Assisting with making a reasonable accommodation or modification request; and 6) Assisting with securing resources to cover transition expenses such as security deposits, basic household furniture and supply needs.

Flexible Funds offer Flexible Solutions Flexible Funds were made available by the Department of Behavioral Health and Developmental Services to address housing barriers that impact individuals with a developmental disability included in the Settlement Agreement* population. Flexible Funds provide assistance with securing housing for the first time or maintaining tenancy that could be in jeopardy.
* The Settlement Agreement target population for housing includes Virginians with developmental disabilities at least 18 years of age or older who are in one of the following categories: 1) Living in a training center, intermediate care facility, skilled nursing facility and eligible for Medicaid DD Waivers; OR 2) Receiving Medicaid DD Waiver services; OR 3) On a waitlist for Medicaid DD Waiver services.
Assistance to Remain in Housing:
Up to $5,000 per individual
• Emergency Rent & Late Fees (Limited to 3 months/lease year)
• Last Resort Utility Assistance (Limited to $500.00/lease year)
• Household Management Activities (Limited to $500.00/lease year)
• Unit Repairs (One request per year, not to exceed $500.00)
• Temporary Relocation (One request per year, not to exceed $2500.00)
