    5th%Sub.%SB%199%Local%Government%Revisions%(Mayne,%K)%E%Passed%

    Over%the%last%40%years,%the%Utah%State%Legislature%has%been%asked%to%help%resolve%issues%related%to%governance%in%Salt%Lake%County.%The%solutions%have%been%piecemeal%and%insufficient%as%the%population%of%the%valley%continues%to%grow.%Last%year,%Salt%Lake%County%advocated%for%the%passage%of%SB%216%(passed,%3rd%substitute),%which,%in%its%original%form,%would%have%established%a%nonIcontiguous%city,%giving%permanent%boundary%protection%to%the%unincorporated%areas.%This%plan%proved%controversial%though%and%a%substituted%bill%requested%that%Mayor%McAdams%and%residents%of%unincorporated%Salt%Lake%County%spend%the%interim%developing%a%plan%that%could%be%accepted%by%all%sides.%SB199%is%the%proposal%developed%over%the%past%year%and%represents%months%of%meetings%and%discussions%and%hundreds%of%volunteer%hours.%The%bill%went%through%several%revisions%before%the%fifth%substitute%as%amended%was%adopted.%

    % The%bill%will%allow%Townships%and%unincorporated%County%residents%to%decide%their%future%during%the%municipal%election%on%November%2,%2015.%Voters%living%in%current%townships%will%choose%to%incorporate%as%a%city%or%a%Metro%Township.%Either%choice%will%provide%boundary%protection%for%these%communities,%easing%fears%of%annexations%by%neighboring%cities.%The%new%cities%or%metro%townships%would%elect%council%members%in%2016.%Those%council%members%will%take%office%in%January%2017.%For%voters%living%in%unincorporated%islands%in%the%County,%the%ballot%question%will%ask%whether%they%want%to%annex%into%an%existing%city%or%keep%their%current%status.%%A%second%ballot%question%will%ask%residents%of%the%current%townships%if%they%prefer%to%receive%services%through%a%Municipal%Services%District%if%the%Metro%Township%option%prevails.%%

    % Metro%Townships%will%have%the%power%to%enact%all%local%ordinances,%including%land%use,%business%regulations,%animal%control,%buildings,%general%health%and%safety,%traffic,%and%all%other%police%power%ordinances.%Each%Metro%Township%will%control%planning%codes%and%ordinances%adopt%a%master%plan%for%their%community.%If%any%Metro%Township%Council%chooses%not%to%enact%their%own%township%ordinances,%the%existing%county%ordinances%will%apply%to%the%township.%

    % In%conclusion,%this%bill%resolves%an%unsatisfactory%choice%that%has%long%faced%residents%in%the%townships%and%unincorporated%areas%of%the%County.%The%bill%presents%a%workable,%common%sense%solution%offering%stability,%a%broad%tax%base,%and%selfIdetermination%for%the%160,000%residents%in%the%townships%and%unincorporated%areas%of%Salt%Lake%County.%%

  • 3rd%Sub.%HB%351%%Planning%District%Amendments%(Dee,%B)%E%Passed%

    % The%Central%Wasatch%is%one%of%the%most%prized%regional%assets%in%unincorporated%Salt%Lake%County.%Currently,%all%planning%and%zoning%powers%in%unincorporated%county%rest%with%the%County%Council.%Decisions%are%made%at%the%recommendation%of%local%planning%commissions%made%up%of%residents%of%the%unincorporated%county.%SB%199%will%substantially%reduce%the%size%of%the%unincorporated%area%and%consequently%the%pool%of%people%eligible%to%serve%on%any%county%planning%commission,%leaving%important%regional%decisions%to%be%made%by%a%small,%unrepresentative%group.%

    HB%351%is%a%first%attempt%to%address%this%issue.%It%allows%the%county%to%establish%both%a%new%Mountainous%Planning%District%(MPD)%and%a%Mountain%Planning%Commission%(MPC).%The%MPD%will%include%areas%that%serve%a%significant%regional%recreational%purpose.%The%MPC%would%include%members%from%both%unincorporated%and%incorporated%parts%of%the%county%and%create%plans%for%use%and%development%within%the%MPD.%The%County%Council%will%retain%final%decision%making%and%appeal%functions%as%is%currently%the%case.%The%commission%will%have%no%jurisdiction%over%any%current%municipality%in%the%MPD;%however,%in%the%face%of%an%annexation%or%incorporation,%zoning%and%land%use%authority%would%remain%with%the%County.%%

    The%third%substitute%of%the%bill%was%enacted%to%include%a%sunset%date%of%June%1,%2016.%Over%the%next%year,%Salt%Lake%County%will%work%with%stakeholders%to%try%and%create%a%structure%that%works%for%all%interested%parties%and%hopefully%return%to%the%Legislature%next%year.%%%

    6th%Sub.%HB%362%%Transportation%Infrastructure%Funding%(Anderson,%J.)%E%Passed%

    Utah%is%one%of%the%fastest%growing%states%in%the%nation%with%its%population%projected%to%almost%double%by%2050.%Despite%this%growth,%the%State%Gas%Tax,%the%principal%source%of%revenue%for%transportation,%has%not%been%raised%since%1997.%Moreover,%the%lack%of%a%sustainable%funding%structure%for%transportation%needs%places%significant%strains%on%local%government%budgets.%%

    HB%362%is%a%landmark%piece%of%legislation%that%will%reshape%transportation%funding%in%the%State%and%help%address%the%aforementioned%problems.%The%bill%converts%the%24.5%centsIperIgallon%tax%to%a%12%%tax%on%fuel%with%safeguards%in%case%of%dramatic%fluctuations%in%the%price%of%gas.%Effective%January%1,%2016,%the%conversion%includes%the%equivalent%of%$.05%per%gallon%increase%($74%million%annually).%%

    HB%362%also%authorizes%the%county%to%impose%a%quarterIofIaIcent%local%option%sales%tax%to%fund%transportation%projects.%In%Salt%Lake%County,%the%revenue%is%allocated%as%follows:%

    0.10%%to%the%transit%provider%(on%sales%collected%within%county);%

  • 0.10%%to%cities,%towns%and%unincorporated%county%areas%(distributed%on%the%50/50%formula);%and,%%

    0.05%%to%the%county%(on%sales%collected%within%county).%Before%imposing%the%tax,%the%County%Council%must%vote%to%put%an%opinion%question%on%the%ballot.%If%a%majority%of%voters%favor%the%increase,%the%County%shall%impose%the%tax.%%

    % In%addition%to%HB%362,%HB%332,%Local&Transportation&Corridor&Preservation&Fund&Amendments,%and%HB%420%(2nd%Sub.),&Revisions&to&Transportation&Funding,%put%Salt%Lake%County%in%a%better%position%to%meet%its%current%and%future%transportation%needs%as%well%as%encourage%regional%development%in%transportation.%

    1st%Sub.%HB%348%%Criminal%Justice%Programs%and%Amendments%(Hutchings,%E.)%E%Passed%

    With%one%in%200%Americans%behind%bars,%our%country%has%the%highest%incarceration%rate%in%the%world.%%In%2009,%the%nation%spent%$82.7%billion%on%corrections,%a%230%percent%increase%from%1990.%HB%348,%also%known%as%Justice%Reinvestment,%represents%a%first%step%toward%addressing%the%astronomical%growth%in%the%prison%population%with%its%huge%costs%in%dollars%and%lost%human%potential.%

    HB%348,%also%known%as%Justice&Reinvestment,%reforms%the%criminal%justice%system%by:% Focusing%prison%beds%on%serious%and%violent%offenders% Strengthening%probation%and%parole%supervision;% Improving%and%expanding%reentry%and%treatment%services;% Supporting%local%corrections%systems;%and,% Ensuring%oversight%and%accountability.%

    HB%348%reclassifies%nonIviolent%3rd%degree%felony%drug%possession%offenses%to%classIA%misdemeanors%and%downgrades%many%traffic%and%vehicle%related%offenses%from%misdemeanors%to%infractions.%%HB%348%also%creates%evidenceIbased%standards%and%certification%for%treatment%providers.%As%HB%348%is%implemented,%it%will%be%important%to%quantify%the%fiscal%impact%on%the%county.%For%instance,%reclassification%of%3rd%degree%felony%drug%possession%offenses%will%likely%increase%the%number%of%people%in%the%County%Jail%and%referred%to%Criminal%Justice%Services%Probation.%%

  • 1st Sub. SB 164 Access to Health Care Amendments: Healthy Utah

    Over the last two years the Utah State Legislature has debated whether and to what extent to expand Medicaid. In 2014, HB 401 was passed requiring the Health Reform Task Force to study programs, which would provide better access to those eligible for Medicaid. This debate has pitted the Governor and the Senate, who favor Healthy Utah, against the House who would prefer either no expansion or a smaller expansion. Healthy Utah was the main bill this session addressing Medicaid expansion. However, there were also several other proposals from both the House and the Senate. Healthy Utah passed the Senate, but none of the Medicaid bills passed in the House.

    Healthy Utah would expand Medicaid coverage to potentially cover over 100,000 uninsured Utahns. The plans and coverage would be implemented using a private insurance model. Employer-sponsored insurance would be utilized as much as possible. Avenue H, the small business health insurance market place, would also be used to help deliver coverage. Also, Healthy Utah would have provided some of the funding needed for drug treatment and mental health counselling in conjunction with new criminal justice reform initiatives under HB 348. The final version of the bill presented Healthy Utah as a two year pilot program.

    Healthy Utah passed the Senate after the substitute was introduced. The House never brought the bill out of committee because they felt there were not going to be enough votes to pass the bill. They instead presented their own Utah Cares plan, which also did not pass. In the waning moments of the session the House passed HCR 12 setting a July 31st deadline for a committee of the Governor, Lt. Governor, Senators Neiderhauser and Shiozawa, Speaker Hughes, and Representative Dunnigan to come up with a deal on Medicaid expansion. The committee has begun to meet privately to work toward an agreement.

    Healthy Utah and other Medicaid expansion efforts are important to Salt Lake County government and residents. Expansion will afford more citizens the ability to have health insurance and help the County provide necessary services to the criminally justice involved population.
