AnActtoprovidefortheregistrationofindustrialdesignsinMalaysiaandformattersconnectedtherewith.

[1September1999,P.U.(B)304/1999]BE IT ENACTED by the Seri Paduka Baginda Yang di‐PertuanAgongwiththeadvice and consent of the Dewan Negara and Dewan Rakyat in Parliamentassembled,andbytheauthorityofthesame,asfollows:

PRELIMINARYShorttitle,commencementandapplication1. (1)ThisActmaybecitedastheIndustrialDesignsAct1996andshall comeinto force on such date as the Minister may, bynotificationintheGazette,appoint.(2)ThisActshallapplythroughoutMalaysia.

Extentofapplication2. This Act shall apply to applications for the registration of industrial designsmadeafterthecommencementofthisActandtoregistrationsofindustrialdesignsmadeonsuchapplications.Interpretation3.(1)InthisAct,unlessthecontextotherwiserequires—“appointed date” has the same meaning as is assigned to thatexpression

in the Intellectual PropertyCorporation ofMalaysiaAct2002[Act617];

“article” means any article of manufacture or handicraft, andincludesany

partofsucharticleorhandicraftifthatpartismadeandsoldseparatelybutdoesnot include an integrated circuit or part of an integrated circuit within themeaning of the Layout‐Designs ofIntegratedCircuitsAct2000[Act601],oramaskusedtomakesuchanintegratedcircuit;“AssistantRegistrar”meansthepersonappointedordeemedtohavebeen

appointedtobeanAssistantRegistrarundersubsection4(2)or(3);“author”meansthepersonwhocreatesadesign;

“conventioncountry”meansacountryinrespectofwhichthereisinforceforthe

timebeinganorderundersection48declaringittobeaconventioncountryforthepurposesofthisAct;“Corporation” means the Intellectual Property Corporation ofMalaysia

established under the Intellectual Property Corporation ofMalaysiaAct2002;“Court”meanstheHighCourtorajudgethereof;

“Deputy Registrar” means the person appointed or deemed to have been

appointedtobeaDeputyRegistrarundersubsection4(2)or(3);“industrialdesign”meansfeaturesofshape,configuration,patternorornament

applied to an article by any industrial process or means,beingfeatureswhichinthefinishedarticleappealtoandarejudgedbytheeye,butdoesnotinclude—

(a)amethodorprincipleofconstruction;or

(b) featuresofshapeorconfigurationofanarticlewhich—

(i) aredictatedsolelybythe functionwhich thearticlehastoperform;or

(ii) aredependentupontheappearanceofanotherarticleofwhichthearticleisintendedbytheauthorofthe design to form an integral part;

“legal personal representative”, in relation to a deceased person,means aperson to whom probate of the will of the deceased person, letters ofadministrationoftheestateofthedeceasedpersonorotherlikegrant,hasbeengrantedwhetherinMalaysiaorelsewhere;“Minister”meanstheMinisterforthetimebeingchargedwiththe

responsibilityforintellectualproperty;“OfficialJournal”meanstheIntellectualPropertyOfficialJournalpublishedbythe

Registrarundersection46A;“owner” means the person who is registered as the owner of theregistered

industrialdesignor,iftherearetwoormoresuchpersons,eachofthosepersons;“originalowner”hasthemeaningassignedtoitbysection10;

“prescribed” means prescribed by or under this Act or anyregulations

made under this Act, andwherenomode ismentioned,meansprescribedfromtimetotimebyorderpublishedintheGazette;“Register”meanstheRegisterofIndustrialDesignskeptunderthisAct;

“registered”meansregisteredunderthisAct;

“registeredindustrialdesign”meansanindustrialdesignregisteredunderthis

Act;“Registrar”meanstheRegistrarofIndustrialDesignsasdesignatedin

subsection4(1);“representation”, in relation to an article to which an industrialdesignis

applied,meansa drawing,tracing or specimenof thearticle to which theindustrialdesignisappliedoraphotographofsuchdrawing,tracingorspecimen;“set of articles” means a number of articles that are of the samegeneral

characterandordinarily onsaletogether,orintendedtobeusedtogether, beingarticlestoeachofwhichthereisappliedanindustrialdesignthatisthesameas,orwhichdiffersonly inimmaterialdetailsorin features commonly used in therelevant trade from, the industrialdesignappliedtotheotherarticlesortoanyofthem;“statement of novelty”, in relation to an industrial design,means astatement

relating to the representation of an article to which theindustrial design isapplied that indicates those features of the representation in respect ofwhichnoveltyisclaimed.

(2)AreferenceinthisActtoanarticleshallbereadasincludingareferenceto—

(a) asetofarticles;

(b) eacharticleinasetofarticles;and

(c) bothasetofarticlesandeacharticleinthatset,asthecaserequires.

ADMINISTRATION Registrar,DeputyRegistrarsandAssistantRegistrars4.(1) TheDirectorGeneraloftheCorporationshallbetheRegistrarofIndustrialDesigns.(2) TheCorporationmay appoint, on such terms and conditions as it may

determine, from amongst persons in the employment of theCorporation,suchnumber of Deputy Registrars of Industrial Designs, Assistant Registrars ofIndustrial Designs and other officers as may be necessary for the properadministrationof thisAct,andmayrevoke the appointment of any person soappointedordeemedtohavebeensoappointedundersubsection(3).(3) The persons holding office as Deputy Registrars, AssistantRegistrars

andother officersunder this Act before the appointeddatewhoweregivenanoptionbytheGovernmentofMalaysiatoserveasemployeesoftheCorporationandhavesooptedshallontheappointeddatebedeemedtohavebeenappointedasDeputyRegistrars,AssistantRegistrarsandsuchotherofficersundersubsection(2).(4) Subject to thegeneraldirectionandcontrolof theRegistrarand tosuch

conditionsorrestrictionsasmaybeimposedbytheRegistrar,aDeputyRegistraroran AssistantRegistrarmayexercise any functionoftheRegistrarunderthisAct,andanythingbythisActappointedorauthorizedorrequiredtobedoneorsignedby the Registrar may be done or signed by any Deputy Registrar or AssistantRegistrarandtheactorsignatureofaDeputy RegistraroranAssistantRegistrarshallbeasvalidandeffectualasifdoneorsignedbytheRegistrar.(5) The Registrar shall have a seal of such device as may beapprovedby

theCorporationandthe impressionsofsuchseal shallbe judiciallynoticedandadmittedinevidence.IndustrialDesignsRegistrationOffice5.(1) AnIndustrialDesignsRegistrationOfficeandsuchnumberofbranchofficesoftheIndustrialDesignsRegistrationOfficeasmaybenecessaryforthepurposesofthisActshallbeestablished.(2)(DeletedbyActA1140).

(3)(DeletedbyActA1140).

(4) Anyapplicationorotherdocumentrequiredorpermittedtobefiledatthe

Industrial Designs Registration Office may be filed at anybranch office of the

Industrial Designs Registration Office and suchapplicationorotherdocumentshallbedeemedtohavebeenfiledattheIndustrialDesignsRegistrationOffice.RegisterofIndustrialDesigns6.(1) The Registrar shall keep and maintain a register called theRegisterofIndustrialDesigns.(2)ThereshallbeenteredintheRegister—

(a) thenamesandaddressesofownersofregisteredindustrialdesigns;

(b) notices of assignment and of transmissions of registeredindustrial

designs;and

(c) suchothermatters asmay from time to timebeprescribedorastheRegistrarmaythinkfit.

(3) The Register shall be kept in such form and on suchmaterial asmaybe

prescribed.

Noticeoftrust

7. Noticeofatrustwhetherexpress,impliedorconstructiveshallnotbeenteredintheRegisterorbeacceptedbytheRegistrar.

InspectionofRegister

8.(1) TheRegister shallbeopen to the inspectionof thepublic atsuch timesand in accordance with such conditions as may beprescribed.

(2) A certified true copy or extract of any entry in the Registersealed withthe seal of the Registrar shall be given to any personrequiringthesameonpaymentoftheprescribedfee.

Certifiedcopiestobeevidence9.(1) The Register shall constitute prima facie evidence of allmattersrequiredorauthorizedbythisActtobeenteredtherein.(2) TheRegistrarmaysupplyacopyoforanextractfrom—

(a)anyentryordocumentintheRegister;or

(b)a document or publication in the Industrial DesignsRegistrationOffice,

certifiedby writingunderhishandandsealtobeatruecopyorextract.(3)Acopyorextractsocertifiedandsealedshallbeadmissibleinevidence as

of equal validity with the original in all courts andproceedingswithoutfurtherprooforproductionoftheoriginal.(4)TheRegistrarmaycertify,bywritingunderhishandandseal—

(a) thatanentry,matterorthingrequiredbyorunderthisActtobemade

ordone,ornottobemadeordone,has,orhasnot,asthecasemaybe,beenmadeordone;or

(b)thatabook,documentorpublicationintheIndustrialDesignsRegistrationOfficewasmadeavailableforpublicinspectiononthedatespecifiedinthecertificate,

and such a certificate shall be received as prima facie evidence of themattersspecifiedinthecertificateinanylegalproceedings.

PARTIII

REGISTRATIONOFINDUSTRIALDESIGNOwnershipofregisteredindustrialdesigns10.(1) Subjecttothissection,theauthorofanindustrialdesignshallbe treatedfor the purposes of this Act as the original owner of theindustrialdesign.(2) Where an industrial design is created in pursuance of acommission

for money or money’s worth, the person commissioning the industrial designshall, subject to any contrary agreement between theparties,be treatedas theoriginalowneroftheindustrialdesign.(3) Where, in a casenot fallingwithin subsection (2), an industrialdesignis

created by an employee in the course of his employment, his employer shall,subjecttoanycontraryagreementbetweentheparties,betreatedastheoriginalowneroftheindustrialdesign.(4) Theoriginalownerofanindustrialdesignortheassigneeofanyinterestin

anindustrialdesignmayassigninwritingtoanotherpersonthewholeoranypartofhisinterestintheindustrialdesign.(5) Wherean industrial design, or the right to apply an industrialdesign to

any article, becomes vested, whether by assignment, transmission oroperation of law, in any person other than the original owner,eitheraloneorjointly with the original owner, that other person or, as the casemay be, theoriginalownerandthatotherpersonshallbetreated for the purposes of section11 as the original ownerof theindustrialdesignorastheoriginalowneroftheindustrialdesign inrelationtothatarticle.(6) In the case of an industrial design generated by computer in

circumstances such that there is no human author, the person by whom thearrangementsnecessaryforthecreationoftheindustrialdesignaremadeshallbetakentobetheauthor.Righttoapplyandobtainregistration11.(1) Theoriginalownerofanindustrialdesignisentitledtomakeanapplicationfortheregistrationoftheindustrialdesign.(2) Where two or more persons own interests in an industrialdesign, all

ofthepersonsowningsuchinterests,actingjointly,are,subjecttoanyagreementamong such persons to the contrary, entitled to make an application for theregistrationoftheindustrialdesign.

Registrableindustrialdesign12.(1) SubjecttothisAct,anindustrialdesignshallnotberegisteredunlessitisnew.

(2) Anindustrialdesignforwhichanapplicationforregistrationismadeshallnotbeconsideredtobenewif,beforethepriority dateofthatapplication,itoranindustrialdesigndifferingfromitonlyinimmaterial details or in featurescommonly used in the relevanttrade—

(a)wasdisclosedtothepublicanywhereinMalaysiaorelsewhere;or

(b)was the subject matter of another application forregistrationof an industrial design filed in Malaysia buthavinganearlierprioritydatemadebyadifferentapplicant insofarasthatsubjectmatterwasincludedinaregistrationgrantedonthebasisofthatotherapplication.

(3) For the purposes of paragraph (2)(a), an industrial designshallnotbedeemedtohavebeendisclosedtothepublicsolelybyreasonofthefactthat,within the period of six months preceding the filingdateofanapplication forregistration—

(a) itappearedinanofficialorofficially recognizedexhibition;or

(b)ithasbeendisclosedbyapersonotherthantheapplicantorhis predecessor intitle as a result of an unlawful actcommittedbythatotherpersonoranotherperson.

Industrialdesigncontrarytopublicorderormorality13. Industrial designs that are contrary to public order ormoralityshallnotberegistrable.Certainregistrationsnottobeextendedorrestored13A. Notwithstanding any other provision of this Act, where before thecommencement of the Layout‐Designs of Integrated Circuits Act 2000 anindustrialdesignapplicabletoanintegratedcircuitorpartofanintegratedcircuitwithin themeaningof thatActoran industrialdesignapplicabletoa maskusedtomake suchanintegratedcircuitwasregisteredunderthisAct,thatregistrationshall not be extended orrestoredatanytimeonorafterthatcommencement.Applicationforregistration14. (1) Anapplicationfortheregistrationofanindustrialdesign—

(a) shallbemadeintheprescribedformandshallbefiledattheIndustrialDesignsRegistrationOffice;

(b) shall be accompanied by the prescribed number of

representationsofthearticletowhichtheindustrialdesignisapplied;

(c) shall contain a statement of novelty in respect of theindustrialdesigntowhichtheapplicationrelates;and

(d)shallbeaccompaniedbytheprescribedfilingfee.

(2)Where the applicant’s ordinary residence or principal place ofbusiness is

outside Malaysia, he shall appoint an agent in Malaysiauponwhomnoticeorprocessrelating totheapplicationforregistrationofan industrialdesignmaybeserved,and if theapplicant fails toappoint an agent, the Registrar may refuseto proceed with theapplicationuntilsuchagenthasbeenappointed.Multipleapplication15. Twoormoreindustrialdesignsmaybethesubjectofthesameapplication,

provided they relate to the same class of the International Classification forIndustrialDesignsortothesamesetorcompositionofarticles.Filingdate16. The filing date of an application for the registration of anindustrialdesignshallbetheearliestdateonwhichallofthefollowingconditionsaresatisfiedinrelationtotheapplication:

(a)the documents mentioned in section 14 identify theapplicant orapplicants;

(b) theprescribednumberof representationsof the article towhich the

industrial design is applied is filed at the Industrial DesignsRegistrationOffice;and

(c) theprescribedfilingfeeispaid.

Prioritydateandrightofpriorityundertreatyorconvention17. (1) Subject to this section, the priority date of an application for theregistration of an industrial design is the filing date of theapplication.(2) An application may, pursuant to any international treaty orconvention

towhichMalaysiaisparty,containadeclarationclaimingthe priority of one ormoreearliernational,regionalorinternationalapplicationsfiledbytheapplicantorhispredecessorintitleinorforanystatepartytothesaidtreatyorconvention;and inanysuchcase,the priority date shall be the earliest date on whichsuch earliernational,regionalorinternationalapplicationswerefiled:Provided that the application made under this Act has been filedwithinsix

monthsfromsuchearliestdate.(3)Where the application contains a declaration undersubsection

(2),theRegistrarmayrequiretheapplicanttofurnish,within the prescribedtime, a copy of the earlier applicationcertified as correct by the officewithwhichitwasfiled.(4) The effect of the declaration referred to in subsection (2)shall be as

provided in the treatyor convention referred to in thatsubsection.(5) Whereanyoftherequirementsofthissectionoranyregulationspertaining

thereto have not been complied with, the declaration referred to insubsection(2)shallbedeemedtobeinvalid.

Withdrawalofapplication18. The applicant for registration of an industrial design may, bynotice inwriting to the Registrar, withdraw the application at anytime during itspendency, and any such withdrawal shall beirrevocable.Amendmentofapplication19. (1) The Registrar may, on request to him in the prescribedmanner,amend an application for the registration of an industrialdesign.(2) Anamendmentundersubsection(1)shallnotbemadeif,asa result of

the amendment, the scope of the application would be increased by theinclusion of any matter that was not in substancedisclosedintheapplicationinitiallyfiled.

Divisionofapplicationafteramendment20. (1) Where a request for amendment under section 19 has beengranted,and the amendment has the effect of excluding one ormore industrialdesigns from the initial application, the applicantmay at any time duringthe pendency of the initial applicationmakeafurtherapplication,referredtoin this section as a “divisionalapplication”, for registration of the industrialdesign or designs soexcluded.(2) Adivisionalapplicationshallbeentitledtotheprioritydate oftheinitial

application.Examination21. (1) Where an application for the registration of an industrialdesign hasbeen accorded a filing date and the application is notwithdrawn,theRegistrarshallcausetheapplicationtobeexaminedtodeterminewhetheritcomplieswiththeformalrequirements.(2) Where,asaresultoftheexamination,itisdeterminedthattheapplication

doesnotmeettheformalrequirementstheRegistrarshallnotifytheapplicantandgivehimanopportunitytomakeobservationsonsuchfindingandtoamendtheapplicationwithinaspecifiedperiodsoastocomplywiththoserequirements.(3) If, within the specified period, the applicant fails to satisfy theRegistrar

that the formal requirements have been complied with, or to amend theapplication so as to complywith them, theRegistrarmayrefusetoregistertheindustrialdesign.(4) The Registrar shall not refuse to register an industrial designunder

subsection(3)untiltheapplicanthasbeengivenanopportunitytobeheard.(5) Inthissection,“formalrequirements”meanstherequirementsof this Act

and of any regulations made under this Act which aredesignatedby suchregulationsasformalrequirementsforthepurposesofthisAct.Registrationandpublication22. (1) WheretheRegistrarissatisfiedthatanapplicationfortheregistrationofanindustrialdesigncomplieswiththerequirementsofsection21,heshall—

(a)registertheindustrialdesignbyrecordingtheprescribedparticularsintheRegister;and

(b)issue to the applicanta certificate of registration of theindustrial

designintheprescribedform.(2) As soon as possible thereafter, the Registrar shall cause to bepublishedintheOfficialJournal—

(a)anoticethattheindustrialdesignhasbeenregistered;(b)thename

andaddressoftheregisteredowner;and

(c) any other matters constituting or relating to the industrial designwhichinhisopinionitisdesirabletopublish.

(3)Thecertificateofregistrationshallbeprimafacieevidenceofthefactsstated

thereinandofthevalidityoftheregistration.Registration of the same industrial design in respect of otherarticles23. (1) Whereanindustrialdesignhasbeenregisteredinrespectofanyarticleandtheownerthereofmakesanapplication—

(a) for registration, in respect of one or more other articles, of theregisteredindustrialdesign;or

(b) forregistration,inrespectofthesameoroneormoreotherarticles,of

anindustrialdesignconsistingoftheregisteredindustrial design withmodifications or variations notsufficient toalter thecharacterorsubstantiallytoaffecttheidentifythereof,

theapplicationshallnotberefused,andtheregistrationmadeonthatapplicationshall not be invalidated by reason only of the previousregistration,orofany

disclosure or use after the priority date in respect of the application for thepreviousregistration,oftheindustrialdesignregisteredonthatapplication.(2) The period of registration of an industrial design registered byvirtueof

this section shall not extend beyond the period of registration of the originalregistered industrial design and any extended periodthereof.RectificationofRegister24. (1) SubjecttotheprovisionsofthisAct—

(a) theCourtmay,ontheapplication intheprescribedmanner, of anyperson aggrieved by or interested in thenon‐inclusioninor omissionfromtheRegisterofany entry,orby orinany entry madeinthe Register without sufficient cause, or any entry wrongfullyremaining in theRegister,or any error or defect in any entry in theRegister,make suchorderforincluding,making,expungingorvaryinganysuchentryor for the correcting of any such error or defect as itdeemsfit;

(b)theCourtmayinanyproceedingunderthissectiondecideanyquestion

thatmaybe necessaryor expedient to decideinconnectionwiththerectificationoftheRegister;

(c) in case of fraud in the registration, assignment ortransmission

of a registered industrial designor if inhisopinion it is in thepublicinterest to do so, the RegistrarmayhimselfapplytotheCourtunderthissection;

(d) anorderoftheCourtrectifying theRegistershalldirectthatnotice of

the order be served on the Registrar in theprescribedmannerandthe Registrar shall upon receipt of the notice rectify the Registeraccordingly.

(2)Notwithstandingsubsection (1), theCourt shall notmake anyorderonthe

applicationofapersonotherthantheRegistraruntilnoticeof such applicationhasbeen given to the Registrar who shall beentitledtoappearandbeheardontheapplication.(3) AnyapplicationfortherectificationoftheRegister,whichundersubsection

(1)istobemadetotheCourtandwheretheapplicantisotherthantheRegistrarhimself,may,attheoptionoftheapplicant,bemade in the first instance to theRegistrar except where an actionconcerningtheindustrialdesigninquestionispending.

(4)The Registrarmay atany stageof any applicationfor rectificationoftheRegistermade tohimreferanysuchapplication to theCourt,orhe may, afterhearing the applicant in any such application and theowneraswellwheretheapplicant is a person other than the owner of the registered industrial design,determinethequestionbetweenthem.

PART IV

PERIODOFREGISTRATIONPeriodofregistration25. (1) The registration of an industrial design shall be deemedtohavecomeintoforceonthefilingdateoftheapplicationfortheregistrationoftheindustrialdesignandshallsubsistforfiveyearsthereafter.(2) The period of registration of an industrial designmay beextended

for four further consecutive terms of five years each, if an application forextensionismadeintheprescribedform,and theprescribed extension feeis paid before the expiration of thecurrentterm.(3) A period of grace of six months from the date on which anyunpaid

extensionfeewasdueshallbegrantedforthepaymentofsuchextensionfee,subjectto thepaymentofsuchsurchargeasmaybeprescribed.(4) Whereanapplicationforextensionisnotmadeoranextensionfee isnot

paidinaccordancewiththissection,theregistrationshalllapse,andanoticeoflapseoftheregistrationshallbepublishedintheOfficialJournal.

Restorationoflapsedregistration26. (1) Withinoneyear fromthedateonwhichthenoticeoflapseoftheregistrationofanindustrialdesignwaspublishedin theOfficial Journal, theowner or his successor‐in‐title may apply for the restoration of theregistrationoftheindustrialdesignby—

(a)filingarequestforrestorationintheprescribedform;

(b) payment of anyoutstanding extension fee andaprescribedsurcharge

forrestoration;and

(c) filing a statement setting out the circumstances that led to the

failuretoextendtheregistrationoftheindustrialdesign.

(2) Where theRegistrar is satisfied that the failure to extend theregistrationwasduetoanaccidentormistake,hemaypublishintheOfficialJournalanoticeofintentiontorestorethelapsedregistration.(3) Any interestedpersonmay,within threemonths fromthedateof such

publication, give notice to the Registrar of opposition to therestorationoftheregistrationandshallserveacopy ofthenoticeontheapplicantforrestoration.(4) Where no notice of opposition is given in accordance withsubsection

(3)withintheperiodofthreemonthsfollowingthedateofthepublicationreferredtoinsubsection(2),theRegistrarshallrestorethe registration of the industrialdesign,whichshallhaveeffectasifthatregistrationhadnot lapsed,andheshallpublishanotice in theOfficialJournalthattheregistrationhasbeensorestored.(5) Where a notice of opposition is given in accordance withsubsection

(3),theRegistrarshall,aftergivingtheopponentandtheapplicantforrestorationanopportunitytobeheard,decidethematter,andwhere he decides to restorethe registration, the registration shallhaveeffectas if ithadnot lapsed,andheshall publish a notice in the Official Journal that the registration has been sorestored.(6) Actions or proceedings shall not be taken in respect ofaninfringement

of the registered industrial design committed between the date on which theregistration of the industrial design ceased to be in force and the dateof thepublicationintheOfficialJournaloftherestorationoftheindustrialdesign.(7) Any personaggrievedbytheRegistrar’sdecisiononthegrantorrefusalof

restorationunderthissectionmayappealtotheCourt.Revocationofregistrationandgrantofcompulsorylicence27. (1) Atanytimeaftertheregistrationofanindustrialdesign,anypersonmayapplytotheCourt—

(a) for therevocationof the registrationof the industrialdesign on theground, subject to section 12, that the industrialdesignhasbeendisclosedtothepublicpriortotheprioritydate of the application forregistration of the industrialdesign;

(b)for the cancellation of the registration of the industrialdesignon

the ground that the registration of the industrial design has beenprocuredbyunlawfulmeans;or

(c)for the grant of a compulsory licence in respect of theindustrial

designonthegroundthattheindustrialdesignisnotappliedinMalaysiabyanyindustrialprocessormeanstothearticleinrespectof

whichitisregisteredtosuchanextentasisreasonableinthecircumstancesofthecase,

andtheCourtmaymakesuchorderontheapplicationasitconsidersjust.(2) Paragraphs(1)(a)and(1)(b)shallbewithoutprejudicetotherightofthe

owner of an industrial design to request the Registrar for therevocationofaregisteredindustrialdesignofwhichheisowner,ortothepoweroftheRegistrarto order the revocation of the registration of an industrial design on anyothergroundashethinksfit.OrderofCourt28. No order which is inconsistent with any treaty, convention,arrangementor engagement with any country outside Malaysia shallbemadebytheCourtundersection27.

REGISTEREDINDUSTRIALDESIGNASPERSONALPROPERTYRegisteredindustrialdesignispersonalproperty29. (1) A registered industrial design is personal property and is capable ofassignment,transmissionorbeingdealtwithbyoperationoflawinthesamewayasotherpersonalormoveableproperty,subjecttotheprovisionsofthissection.(2) Anytransmissionofaregisteredindustrialdesignoranapplicationforthe

registration of an industrial design is subject to any rights vested in any otherpersonofwhichnoticeisenteredintheRegisterorofwhichnoticeisgiventotheRegistrar.(3) An assignment of a registered industrial design or an application for the

registrationofanindustrialdesignshallnotbeeffectiveunlessitisinwritingandsignedbyoronbehalfof theassignorandtheassigneeor,asthecasemaybe,apersonalrepresentativethereof.(4) Subection(3)shallapplytoassignmentbywayofsecurityasinrelationtoanyotherassignment.(5) Aregisteredindustrialdesignmaybethesubjectofasecurityinterestinthesamewayasotherpersonalormoveableproperty.(6) Theownerofaregisteredindustrialdesignmaygrantalicencetoanyperson

tousethatregisteredindustrialdesign.(7) Anyrightsinrespectofaregisteredindustrialdesignmaybeenforcedinlikemannerasinrespectofanyotherpersonalormoveableproperty.Recordingofassignment,etc.30. (1) Whereapersonbecomesentitledto–

(a) aregisteredindustrialdesignbywayofanassignmentortransmissionorbyoperationoflaworbyasecurityinteresttransaction;or

(b) an application for the registration of an industrial design by way ofassignmentortransmission,

heshallapplytotheRegistrarintheprescribedmannertorecordhistitleorinterestintheRegister.(2) TheRegistrarshallrecordtheparticularsofthetitleorinterestreferredto

insubsection(1)intheRegister.(3) No assignment or transmission or operation of law or security interest

transactioninrespectofaregisteredindustrialdesignshallhaveeffectagainstthirdpartiesunlessrecordedintheRegister.Jointownership31. (1) Where an industrial design is registered in favour of two ormorepersons, each of them shall, subject to any agreement between them to thecontrary, be entitled to an equal undivided share in theregisteredindustrialdesign.(2) Where two or more persons are joint owners of a registeredindustrial

design, then, subject to this section and to any agreementbetweenthemtothecontrary—

(a)eachof themshallbeentitled,byhimselfor throughhisagents,todoanyact,forhisownbenefitandwithouttheconsentofor theneed toaccount to the other or others, which would apart from thissubsection amount to an infringement of the registered industrialdesign;and

(b)any such act shall not amount to an infringement of theregistered

industrialdesign.(3) Where two or more persons are joint owners of aregisteredindustrial

design, then, subject to any agreement between them to thecontrary, none ofthemshallwithouttheconsentoftheotherorothersgrant a licencewith respectto the use of the registered industrialdesign,orassignormortgagehisinterestin theregisteredindustrialdesign.(4) The provisions of this section shall have effect in relation to aright to

apply for the registration an industrial design as they haveeffect in relation toa registered industrial design, and references to aregisteredindustrialdesignshall includereferencestoaright toapply for the registrationof an industrialdesign.

PARTVIINFRINGEMENT

Infringementofregisteredindustrialdesign32. (1) Subject to the provisions of this Act, the owner of aregisteredindustrial design shall have the exclusive right to make orimport for sale orhire, or for use for the purposes of any trade orbusiness,ortosell,hireortoofferorexposeforsaleorhire,anyarticletowhichtheregisteredindustrialdesignhasbeenapplied.(2) Subject to section 30, a person infringes the rights conferred by the

registration of an industrial design if he, without the licence orconsentoftheowner of the industrial design, does any of the following things while theregistrationisstillinforce:

(a) applies the industrial design or any fraudulent or obviousimitationof it to any article in respect of which theindustrialdesignisregistered;

(b)importsintoMalaysiaforsale,orforuseforthepurposesofanytradeor

business, any article to which the industrialdesignoranyfraudulentorobviousimitationofithasbeenappliedoutsideMalaysiawithoutthelicenceorconsentoftheowner;or

(c) sells,oroffersorkeepsforsale,orhires,oroffersorkeepsforhire,any

ofthearticlesdescribedinparagraphs(a)and(b).(3) Notwithstanding subsection (1), the right of the owner of aregistered

industrial design shall not extend to acts in respect of anarticle towhichtheregisteredindustrialdesignisappliedby orwiththeconsentof theownerafterthearticle hasbeenlawfully importedintoorsoldinMalaysia.

Infringementproceedings33. (1) The owner of a registered industrial design shall have theright toinstitute legal proceedings against any person who has infringed or isinfringinganyoftherightsconferredbytheregistrationoftheindustrialdesign.(2) Theownerofaregisteredindustrialdesignshallhavethesamerightagainst

anypersonwhohasperformedactswhichmakeitlikelythataninfringementwilloccur.(3) Theproceedingsmentionedinsubsections(1)and(2)maynotbe

institutedafterfiveyearsfromtheactofinfringement.(4) Forthepurposesofthissection,“ownerofaregisteredindustrialdesign”

means the registered owner and includes an assignee, alicensee or thebeneficiary of a compulsory licence granted under section 27; but if anyproceedingsareinstitutedbyapersonotherthanthe registered owner, it mustbeprovedthatthatpersonhadmadeapriorrequesttotheregisteredownertoinstitute proceedings for the infringement complained of by him and that theregistered ownerhadrefusedorfailedtoinstitutetheproceedingswithinthreemonths from the receipt of the request, without prejudice however to theregisteredowner’srighttojoininsuchproceedings.Defenceinactionforinfringement34. Anygroundonwhichtheregistrationofanindustrialdesignmayberevokedis available as adefence in an action for infringementofaregisteredindustrialdesign.Remediesforinfringement35. (1) Iftheownerofaregisteredindustrialdesignprovesthataninfringementhas been committed or is being committed, the Courtmay award damages oran account of profits and may grant an injunction to prevent furtherinfringement and any other legalremedies.(2) Iftheownerofaregisteredindustrialdesignprovesthatacts

are being performed which make it likely that an infringement willoccur,thatCourt may grant an injunction to prevent infringement and any other legalremedies.(3) TheCourtmay refusetoawarddamages,ortomakeanorderforanaccount

ofprofits, inrespectofan infringement, if thedefendantsatisfiestheCourt—

(a)that,atthetimeoftheinfringement,hewasnotawarethattheindustrialdesignwasregistered;and

(b)thathehad,priortothat time,takenallreasonablestepstoascertainwhethertheindustrialdesignhadbeenregistered.

(4)TheCourtshallrefusetoawardcoststotheownerofaregistereddesignwhobecomesentitledtotheregisteredindustrialbywayofassignmentortransmissionor by operation of law or by a security interest transaction in respect of aninfringementunless–

(a) an application to record his title or interest ismade under section 30

beforetheendoftheperiodofsixmonthsbeginningfromthedateoftherelevanttransaction;or

(b) theCourtissatisfiedthatitwasnotpracticableforthesaidapplicationtobemadebeforetheendofthatperiodandthatanapplicationwasmadeassoonaspracticablethereafter.

PARTVIIOFFENCES

FalsificationofRegister,etc.36. Anypersonwho—

(a) makesorcausestobemadeafalseentryintheRegister;

(b) makes or causes to bemade a false entry in any certifiedcopyof a

documentorpublicationintheIndustrialDesignsRegistrationOffice;

(c)makesorcausestobemadeafalsedocumentpurportingtobeacopyofanentryintheRegister;

(d)producesortendersorcausestobeproducedortenderedinevidence

any document mentioned in paragraph (b) or (c) knowing suchdocumentoranyentrythereintobefalse;or

(e) falselymakesaclaimthatheistheowneroftheregisteredindustrial

design or represents that he is acting in thecapacity of, or onbehalfoftheowneroftheregisteredindustrialdesign,

shallbeguiltyofanoffenceandisliableonconvictiontoafinenotexceeding fifteenthousandringgitor to imprisonment fora termnotexceedingtwoyearsortoboth.

Falserepresentationofregistration37. (1) Anypersonwhofalselyrepresentsthatanythingdisposedofby him forvalue is an article protected by an industrial designregistrationcommitsanoffenceandshallbeliableonconvictiontoafinenot exceeding fifteen thousandringgitor to imprisonment foratermnotexceedingtwoyearsortoboth.(2) For thepurposesof subsection (1), apersonwho forvaluedisposes of

any article having stamped, engraved or impressedthereon or otherwiseapplied thereto the words “registered industrialdesign”oranyotherwordorwordsexpressingorimplyingthatthearticle is one to which a registeredindustrial design has beenapplied,shallbetakentorepresentthatthearticleisoneprotectedbyanindustrialdesignregistration.(3) Subsection (1) does not apply where the representation ismade in

respect of an industrial design after the registration in respect of thatindustrial design has expired or been revoked andbeforetheendofaperiodwhichisreasonablysufficienttoenablethatpersontotakestepstoensurethattherepresentationisnotmadeordoesnotcontinuetobemade.(4) Inproceedingsforanoffenceunderthissection,itshallbeadefence for

any person to prove that he used due diligence topreventthecommissionoftheoffence.(5) This section shall have effect in relation to a right to apply for the

registrationofanindustrialdesignastheyhaveeffectinrelationtoaregisteredindustrial design, and references to a registered industrial design shall includereferencestoarighttoapplyfortheregistrationofanindustrialdesign.Useoftitle“IndustrialDesignsRegistrationOffice”38. Any personwho uses on his place of business or any documentissuedbyhimorotherwisethewords“IndustrialDesignsRegistrationOffice”oranyotherwordssuggestingthathisplaceofbusiness is,or is officially connected with,the Industrial Designs RegistrationOffice commits an offence and is liable onconviction to a fine notexceedingfifteenthousandringgitortoimprisonmentforatermnotexceedingtwoyearsortoboth.Offencesbybodycorporate39. (1) WhereanoffenceunderthisActcommittedbyabodycorporate isproved to have been committedwith the consent orconnivanceof,ortobeattributable to any neglect on the part of adirector, manager, secretary orother similar officer of the body corporate, or any person who was

purportingtoact inanysuchcapacity,he,aswellasthebodycorporate,shallbe guilty of thatoffence and shall be liable to be prosecuted against andpunishedaccordinglyasprovidedbythisAct.(2) Where the affairs of a body corporate are managed by itsmembers,

subsection (1) shall apply in relation to the acts and defaults of a member inconnectionwithhisfunctionsofmanagementasifhewereadirectorofthebodycorporate.

PARTVIII

OTHERPOWERSOFTHEREGISTRARAmendmentofregisteredindustrialdesign40. (1) The owner of a registered industrial design may, inaccordancewith regulations prescribed by the Minister, request theRegistrar to amend aregistered industrial design or any documentassociated therewith for thepurpose of correcting a clerical error,obviousmistakeorforanyotherreasonacceptabletotheRegistrar.(2) The request for amendment shall be accompanied by theprescribed

fee.(3) Except for the purpose of correcting a clerical error or anobvious

mistake,noamendmentshallbepermittedunderthissectionif the amendmentwould have the effect of disclosingmatters whichextendbeyondthatdisclosedbefore the amendment, or extending the protection conferred at the time ofregistrationoftheindustrialdesigninquestion.(4) Noamendmentshallbeallowedtobemadeintheregistrationofanindustrial

designunderthissectionwheretherearependingbeforethe court proceedingsin which the validity of the registration of theindustrialdesignmaybeputinissue.(5) Where the Register has been amended under this section, theRegistrar

mayrequirethecertificateofregistrationtobesubmittedtohim andmay cancelthe certificate of registration and issue a newcertificate of registration withsuchconsequentialamendmentsasarerenderednecessarybytheamendmentoftheRegister.GeneralpowersofRegistrar41. (1) TheRegistrarmaygenerallyforthepurposesofthisAct—

(a) summonwitnesses;

(b) receiveevidenceonoath;

(c) requiretheproductionofanydocumentorarticle;and

(d) award costs as against a party to any proceedingsbeforehim.

(2) Any person who without any lawful excuse fails to comply with any

summons, order or direction made by the Registrar underparagraph(1)(a),(1)(b) or (1)(c) commits anoffence and is liableonconviction to a fine notexceeding two thousand ringgit or toimprisonmentforatermnotexceedingsixmonthsortoboth.(3) Costs awarded by the Registrarmay in default of payment berecovered

in a court of competent jurisdiction by the person to whom the costs wereawarded.Exerciseofdiscretionarypower42. WhereanydiscretionarypowerisgiventotheRegistrarbythisActoranyregulationsmadeunder thisAct,heshallnotexercise thepoweronanypersonwhomay be adversely affected by his decisionwithoutgivingtothepersonanopportunityofbeingheard.Extensionoftime43. Subject to subsection 17(2) and section 50, where by this Act or anyregulationsmadeunderthisAct,atimeisspecifiedwithinwhichan act or thingis to be done, the Registrar may, unless otherwiseexpresslydirectedbytheCourt,extendthetimeeitherbeforeorafteritsexpiration,uponpaymentoftheprescribedfee.

PART IX

MISCELLANEOUSServicebypost44. AnynoticerequiredorauthorizedtobegivenunderthisActorregulationsmade under this Act, and any application or otherdocumentsorequiredorauthorizedtobemadeorfiled,maybegiven,madeorfiledbypost.

Agent45. (1) WherebythisActoranyregulationsmadeunderthisActany act hasto be done by or to any person in connection with anindustrialdesignoranyprocedure relating thereto, theactmay,underand in accordance with this ActandanyregulationsmadeunderthisActorinparticularcasesbyspecialleaveofthe Registrar, be done by or to an agent of that person duly authorize in theprescribedmanner.(2) The Registrar shall not be bound to recognize such agentwhohas been

convicted of crimes involving fraud or dishonesty, or is an undischargedbankrupt or had been struck off or otherwise removedfrom the register ofmembership of any professional body, orsuspended for the timebeing frompractising by any such body orcommitteethereof.Appeal46. (1) AnypersonaggrievedbyanydecisionororderoftheRegistrarmayappealtotheCourt.(2) Thesamerulesofprocedureonappealshallapplytoappealsmadeunder

subsection (1) as to appeals to the High Court from a decision of asubordinatecourtincivilmatters.IntellectualPropertyOfficialJournal46A. (1)TheRegistrarshallpublishanIntellectualPropertyOfficialJournalwhichshallcontain‐

(a) allmattersrelatingtoindustrialdesignswhichisrequiredtobepublishedunderthisActoranyregulationsmadeunderthisAct;and

(b) suchotherinformationormattersrelatingtoindustrialdesignsastheRegistrarconsidersgenerallyusefulorimportant.

(2)TheOfficialJournalshallbemadeavailabletothepubliconpaymentoftheprescribedfee.(3)PublicationintheOfficialJournalshallconstitutesufficientnoticeofanymatterrequiredtobepublishedunderthisActoranyregulationsmadeunderthisAct.(4)AcopyoftheOfficialJournalshallonitsproductionbeadmittedinlegalproceedingsasevidencewithoutfurtherproofbeinggiventhatthecopywassopublished.(5)AcopyoftheOfficialJournalshallbeprimafacieevidenceofthefactsstated

therein.(6)WheretheOfficialJournalispublishedinmorethanoneform,thedateofpublicationoftheOfficialJournalshallbedeemedtobethedatetheOfficialJournalisfirstpublishedinanyform.Regulations47. (1) SubjecttotheprovisionsofthisAct,theMinistermaymakeregulationsforthepurposeofcarryingintoeffecttheprovisionsofthisAct.(2) In particular and without prejudice to the generality of subsection (1),

regulationsmadeunderthissectionmayprovideforalloranyofthefollowing:

(a) to regulate the procedure to be followed in connection with anyproceeding or other matter before the Registrar or the IndustrialDesigns Registration Office under this Actincludingtheserviceofdocuments;

(b)to classify articles for the purpose of registration ofindustrial

designs;

(c) to make or require duplication of documents connectedwiththeregistrationofindustrialdesigns;(ca)toregulatetheprocedurefortherecordingofthematters

requiredundersection30;

(cb)toprescribeanymattersorinformationrequiredtobepublishedintheOfficialJournal;

(d) to prescribe fees to be paid in connection with anyproceedingor other matter or in connection with theprovisionofanyserviceby the Registrar or the IndustrialDesignsRegistrationOffice,andtoprescribetheamountofsuch fees and to allow different feesin certaincircumstancesforcertainprescribedcases;

(e) toprescribeformsandothermatterstobeusedunderthisAct;

(f) toregulatethekeepingoftheRegisterandtoprescribetheformand

contentsthereof;

(g) toregulatethemodeofgivingevidenceinanyproceedingbefore theRegistrarunder thisAct and to empower theRegistrar to compel theattendance of witnesses and the discovery and production of

documents;(h) for doing anything required to be done in connection with any

proceeding or other matter before the Registrar or the IndustrialDesignsRegistrationOffice;

(i) togoverntherecognitionofagents representingapplicantsor other

parties before the Registrar or the IndustrialDesignsRegistrationOffice, and to prescribe qualifications and other conditions to besatisfiedbysuchagentsbeforebeing permitted to appear before theRegistrar or the Industrial Designs Registration Office, and tootherwiseregulatetheirconductassuchagents;

(j) toprescribetimelimits;and

(k) to regulate generally matters pertaining to the business of the

registration of industrial designs carried on in the IndustrialDesigns Registration Office whether or notspeciallyprescribedunderthisAct.

Conventioncountries48. (1) TheMinistermay,byorderpublishedintheGazettewithaview to thefulfilment of a treaty, convention, arrangement orengagement betweenMalaysia and another country, declare that acountryspecifiedintheorderisaconventioncountryforthepurposesofthisAct.(2) Where the Minister, by order declares that an application forprotection

in respect of an industrial design is, in accordance with the terms of a treatysubsistingbetweentwoormoreconventioncountries,equivalenttoanapplicationmadeinoneofthoseconventioncountries,the first‐mentioned application shall,for the purposes of this Act, bedeemedtohavebeenmadeinthatconventioncountry.(3) Where theMinister, byorder, declares that an application forprotection

inrespectof an industrialdesign is, inaccordancewith thelawofaconventioncountry,equivalenttoanapplicationmadeinthatconvention country, the first‐mentioned application shall, for thepurposesofthisAct,bedeemedtohavebeenmadeinthatconventioncountry.Repealandsavingprovisions49. (1) The United Kingdom Designs (Protection) Act 1949[Act 214],theUnitedKingdomDesigns (Protection)Ordinanceof Sabah [Sabah Ord.Cap. 152], and the Designs (UnitedKingdom) Ordinance of Sarawak

[Sarawak Ord. Cap. 59] (hereinafter collectively referred to as the“repealed laws”) arerepealed.(2) Notwithstandingsubsection(1)—

(a)any subsidiary legislationmade under the repealed lawsshall in so

far as such subsidiary legislation is notinconsistent with theprovisions of this Act continue inforceandhaveeffectas if ithadbeenmadeunderthisActand may be repealed, extended, variedor amendedaccordingly;

(b)any appointment made under the repealed laws orsubsidiary

legislationmade under the repealed laws shallcontinue in force andhave effect as if it had beenmadeunderthisActunlesstheMinisterotherwisedirects;

(c) anyregistrationprotectedunder the repealed lawsand inforce

immediatelypriortothecomingintoforceofthisActshall, subject tothe terms, conditions and the period ofvalidityspecifiedintheregistration,continueinforceandhavethelikeeffectasifithadbeeneffectedunderthisAct,butanyextensionthereaftershallbeinaccordancewithsubsection50(2).

Transitional50. (1) Where, prior to the coming into force of this Act, anapplicationforregistrationofanindustrialdesignhasbeenmadeundertheRegisteredDesignAct1949oftheUnitedKingdom[12,13&14GeoVI(U.K.1949)c.88]asamendedbytheCopyright, Designs andPatents Act 1988 of the United Kingdom [(U.K.1988)c.48]andispending registration, the applicant may, within a period oftwelvemonthsfromthecomingintoforceofthisAct,makeanapplicationfortheregistration of the industrial design under this Act, and suchapplicationshallbeaccordedthepriority datewhichhasbeenaccordedtoitintheUnitedKingdom.

(2)AcertificateofregistrationgrantedundertheRegisteredDesignsAct1949oftheUnitedKingdomshallhavethemaximumperiodofvalidityaccordedundertherepealedlawsandforthispurpose,theextensionprocedureshallbeasprescribedintheregulationsmadeundersection47ofthisAct.
