III. INCIDENT DETAILS On 05-06-2016, at approximately 2230 hours, Kierra Jemison arrived at her residence at 1412 Bow Creek Court after a trip to the store with her three (3) children, , and

. Jemison parked her white Chevrolet Malibu in the garage and shut off the vehicle. As she exited the vehicle, she was approached by a black male adult, approximately 5’7”, skinny build, wearing a black t-shirt, black shorts, and a black baseball cap, and carrying a black backpack. The black male, later identified as Jamal Gwynn, was holding a black semiautomatic handgun. Gwynn pulled the slide back on the firearm and aimed it at Jemison and demanded she exit the vehicle. Jemison told her children to exit the vehicle. They exited the vehicle and went into the house. Jemison exited the vehicle with her hands in the air. Gwynn entered the vehicle and drove away in an unknown direction. Jemison immediately went to a neighbor’s residence and called 911.

Officers from Northwest Area Command were dispatched to Jemison’s residence. Officer LaRosa responded and made contact with Jemison. While he was speaking with Jemison, Officer Sherwood arrived at the residence. He told Officer LaRosa he would attempt to locate the vehicle in the area and left. At approximately 2250 hours, OnStar advised LVMPD Dispatch that GPS showed the stolen vehicle to be at the Copper Palms Apartments, 1150 N. Buffalo Drive. OnStar engaged the ignition block on the vehicle and activated the lights and horn. Officer Sherwood was traveling south on Buffalo Drive when he saw the Chevrolet Malibu inside the main gate of 1150 N. Buffalo Drive. Officer Sherwood performed a U-turn and turned into the Copper Palms Apartments. While Officer Sherwood waited for the gate to open, the Malibu rolled backwards away from the gate into a landscaped area east of the entrance. Officer Sherwood exited his patrol vehicle and saw Gwynn exiting the Malibu. Officer Sherwood issued verbal commands to Gwynn to get down on the ground. Gwynn ignored Officer Sherwood’s commands and turned back towards the vehicle. Officer Sherwood saw a black firearm in Gwynn’s hand. Gwynn reached back into the car before looking over his shoulder at Officer Sherwood. Gwynn put a backpack on and fled from Officer Sherwood on foot. Officer Sherwood pursued Gwynn on foot in the area of the entrance of the complex. Officer Sherwood saw Gwynn drop an object he believed was a firearm. When Gwynn stopped and attempted to retrieve the object, Officer Sherwood told Gwynn to surrender and kicked Gwynn, striking him in the head, in an attempt to get Gwynn to stay on the ground. Gwynn stood up and continued to flee. Gwynn ran back towards the vehicles and entered the driver’s seat of Officer Sherwood’s patrol vehicle, closing the door behind him. Officer Sherwood saw Gwynn grab the shotgun located in the patrol vehicle and attempt to remove it from its mount.

Officer Sherwood saw witnesses Thomas Crisp and Travis Smith standing in the parking lot to the south of his location. Officer Sherwood fired at Gwynn four (4) times, striking him twice in the chest. Gwynn put the patrol vehicle into drive and drove forward. Officer Sherwood retreated to avoid being struck by the vehicle and fired three (3) more times, striking the front of the patrol vehicle. Gwynn drove the patrol vehicle out of the complex, ramming through the gate and driving south on Buffalo Drive. The Air Unit arrived and located Gwynn fleeing the area in the patrol vehicle. The Air Unit followed Gwynn as he drove south on Buffalo Drive and turned west onto the Summerlin Parkway. Gwynn drove to the next exit and turned north onto Durango Drive. Officers LaRosa and Schmitt conducted a vehicle stop on Gwynn on Durango Drive south of Washington Avenue and took him into custody. Paramedics responded to the scene and Gwynn was transported to University Medical Center (UMC) Trauma Center for treatment. Officers secured the scene and witnesses. Investigative units were notified of the incident.

Detectives Alsup, Colon, and Jex were assigned to interview available witnesses and conduct weapon countdowns. Detective Jex was assigned responsibilities at the hospital, which included interviewing any possible witnesses.

IV. BODY WORN CAMERAS Several officers uploaded body worn camera footage taken during this event. None of the footage captured the officer-involved shooting. The video footage was uploaded and stored in evidence. The following officers uploaded videos related to this event:

V. HOSPITAL At approximately 0125 hours, Detective Jex responded to UMC Trauma Center and made contact with Officer Torsiello. Officer Torsiello was posted at the bedside of Gwynn in Trauma bed #1. Gwynn was supine with medical intervention apparatus present. UMC medical staff sedated Gwynn due to his injury. Detective Jex made contact with the attending physician, Doctor Deborah Kuhls. Doctor Kuhls informed Detective Jex that Gwynn sustained a gunshot graze wound to his left shoulder and two (2) gunshot entry wounds to his left chest just below the left nipple. There were no exit wounds. The bullets were visible just below the skin on Gwynn’s chest area. Gwynn also sustained two (2) fractured ribs, a fractured sternum, and bruised lungs. Both bullets were removed from Gwynn’s chest. CSA Petersen documented and took digital photographs of Gwynn and his injuries which included the gunshot wounds. The following items were impounded by CSA Petersen: 1) Two (2) bullets 2) A pair of bloodstained Adam Levine blue jeans, size 32x30, with a lime green cloth belt 3) A cut & bloodstained DC black hooded sweater, size XL, with apparent defects 4) Two (2) cut & bloodstained pieces of a St. John’s Bay blue striped short sleeved shirt,

size XL 5) A pair of bloodstained Hanes gray underwear, size LG/G 6) A black nylon bag 7) A pair of white Hanes socks 8) A plastic patient’s belongings bag

VI. SCENE WALK-THROUGHS The purpose of the scene walk-through was to help investigators develop an understanding of the scene, including identifying officer locations at the time deadly force was used, identifying potential physical evidence, and re-creating a time line of the incident. On 05-07-2016, at approximately 0135 hours, Officer Sherwood provided a walk-through of the scene in the presence of the following persons:

Kelly During the walk-through, which was not video or audio recorded, Officer Sherwood relayed the following information: Officer Sherwood arrived at the apartment complex and saw Gwynn exit the Chevrolet Malibu. Officer Sherwood exited his patrol vehicle and told Gwynn to get down on the ground. Officer Sherwood saw Gwynn was holding a black firearm in his left hand. Officer Sherwood continued to issue commands to Gwynn to drop the firearm and surrender. Gwynn did not comply and fled on foot from the vehicle. Officer Sherwood pursued on foot. When Gwynn ran to the northeast portion of the entrance area, Officer Sherwood believed he dropped the firearm. Gwynn fell to his knees. Officer Sherwood believed he was trying to retrieve the firearm, so Officer Sherwood kicked Gwynn in the head one (1) time in an effort to keep him on the ground. Gwynn stood up and continued to flee from Officer Sherwood. As they ran around the entrance area, Gwynn ran back to Officer Sherwood’s patrol vehicle and entered it. Officer Sherwood continued to tell Gwynn to surrender. Officer Sherwood saw Gwynn attempting to retrieve the shotgun that was secured between the driver and passenger seat. Officer Sherwood fired three (3) to four (4) times at Gwynn through the driver side door. Gwynn put the patrol vehicle in reverse and backed away from Officer Sherwood. Officer Sherwood continued to issue verbal commands at Gwynn, who did not comply. Gwynn accelerated the vehicle at Officer Sherwood. Officer Sherwood fired at the front of the patrol vehicle in an attempt to disable it. Officer Sherwood believed Gwynn was trying to run him over and was forced to dodge out of the way to avoid being struck by the vehicle. Gwynn drove around the center landscaped area and rammed the exit gate. Gwynn exited the complex and drove south on Buffalo Drive.

VIII. OFFICER WEAPON COUNTDOWNS On 05-06-2016, Officer Sherwood had his duty weapon counted down at LVMPD headquarters. He was photographed by CSI personnel for appearance purposes, and his weapon was photographed for identification purposes. The following persons were present during the countdown: 1) Officer Sherwood 2) Detective Jex 3) PEAP peer counselor G. Gafford 4) SCSA Thi 5) PPA representative B. Yant Officer Sherwood was dressed in a standard LVMPD long sleeve uniform. He wore LVMPD patches on each shoulder and an LVMPD badge over his left breast. Officer Sherwood wore a black duty belt with attached tools and equipment as part of his position in Traffic. Officer Sherwood’s handgun was carried on the right side of his body and secured in a holster. Prior to countdown Officer Sherwood stated he carried thirteen (13) cartridges in the magazine loaded in his firearm and one (1) cartridge in the chamber (13+1, 14 total).

The officer-involved shooting occurred to the east of the main entrance to the Copper Palms Apartments complex. There were entry and exit driveways heading east from Buffalo Drive with a set of metal gates for both the entry and exit driveway. The exit gate on the north side of the driveway was damaged and open. The entry gate on the south side of the driveway was secured and had no damage. Directly east of the gates was a north/south driveway heading into the complex. East of the driveway was a center landscape area. The landscape area was in the middle of a half circle which had parking along the east portion of the half circle. The manager’s office and business office were east of the half circle. The Chevrolet Malibu was parked facing west on the west side of the center entryway landscaped area. The rear bumper had a small amount of damage to the rear passenger side and was resting against a large landscape rock and the west curb of the landscaped area. The front driver’s side door window was partially rolled down and the door was partially opened. Several items were scattered on the ground outside this door, including a Social Security card bearing the name of Kierra Jemison. A black Walther PPS pellet gun was lying on the front driver’s floorboard between the seat and the door. The vehicle had several bags with miscellaneous personal items, including a black Palms duffel bag and a black & blue Hydrapack backpack. Four (4) .45 caliber cartridge cases were located in the north/south driveway west of the center landscaped area southwest of the Chevrolet Malibu. Broken glass was located in the north/south driveway east of the cartridge cases. Two (2) .45 caliber cartridge cases were located on the ground near the southwest corner of the entryway. One (1) additional .45 caliber cartridge case was located on the ground near the south curb of the center landscape area. There were several tire marks in the grass and landscaped area in the southwest corner of the entryway of the apartment complex. A 2001 Chevrolet Silverado, bearing Nevada license plate 251WMW, was parked to the south of the area inside the entrance to the complex. The vehicle was parked in the middle of the north/south driveway facing south. Digital photographs were recorded of the scene, as well as any items prior to being recovered as evidence. Photographs were taken showing the perspectives of Officer Sherwood and the witnesses. For further details, refer to the Crime Scene Report and digital photographs. Measurements Several locations were marked by traffic cones and measured for the perspectives of Officer Sherwood, witnesses Crisp and Smith, and the patrol vehicle Gwynn was inside. The locations of Officer Sherwood and the patrol vehicle were approximations given by Officer Sherwood during his walk-through. After investigators reviewed the video of the incident, it was determined Officer Sherwood’s and the patrol vehicle’s second locations were incorrect. Their approximate second locations are denoted by the red circle on the crime scene diagram.

LVMPD Vehicle #10369 Durango Drive/Washington Avenue SCSA Vaandering The patrol vehicle was located at the intersection of Durango Drive, south of Washington Avenue, in the northbound lanes. The patrol vehicle was facing north in the right turn lane on the east side of Durango Drive south of its intersection with Washington Avenue. The vehicle was running with the headlights, windshield wipers, and driver’s side spotlight activated. There was damage to the “buddy bumper” located on the front of the vehicle and to the passenger side of the front bumper. There was damage to the front passenger side tire. The front driver’s side door window was broken with some glass still located around the edge of the window frame. Several bullet impacts were noted on the front driver door and the front buddy bumper. A small amount of apparent blood was on the pavement to the west of the front driver’s door. Miscellaneous items, including a right Adidas shoe, were found on the ground next to the front driver side door and were documented in the list of evidence recovered. The key to the vehicle was in the ignition. The tablet and keyboard mounted in the vehicle were facing towards the passenger seat. On the front driver’s floorboard was a left Adidas shoe matching the one found outside the vehicle. A cell phone case in a cell phone wallet case belonging to Officer Sherwood was located on the driver’s floorboard and returned to him. A Chevrolet key fob with a brown keychain for the Chevrolet Malibu was located between the

driver’s seat and center console. Broken glass was visible on the driver’s seat and the floorboard. The passenger seat contained various items belonging to and used by Officer Sherwood in the commission of his duties as a traffic officer, including two (2) file folders containing paperwork, a radar gun, and a green nylon duffle bag. A bullet was located on the front passenger floorboard. The items belonging to Officer Sherwood were released to him prior to him leaving the scene. Areas of apparent blood were observed on the steering wheel, the front dashboard near the steering wheel, the interior of the driver side door, and the interior side of the driver side b-pillar. Digital photographs were taken by SCSA Vaandering showing the location of items and overall condition of the scene. After the initial investigation, the front driver’s window was covered using a biohazard bag and tape. The vehicle was towed to the Criminalistics garage by City Towing for further processing. The vehicle and tow truck was followed by SCSA Vaandering. Evidence Recovered The following items were recovered by SCSAs Vaandering and impounded them as evidence:

One (1) black pouch containing a garage door opener, an Ultra rewards card, an American Express prepaid gift card, and six (6) pieces of lined white paper on the ground west of the front driver’s door of the patrol vehicle.

One (1) small black bag containing one (1) red die, sixteen cents ($0.16) in US currency coins, and nineteen (19) coins of various countries on the ground west of the front driver’s door of the patrol vehicle.

One (1) Newport cigarette pack with two (2) pieces of a cigarette and a tan Marlboro cigarette butt on the ground west of the front driver’s door of the patrol vehicle.

One (1) Oreo package on the ground west of the front driver’s door of the patrol vehicle.

One (1) black Adidas right shoe, size 11, on the ground underneath of the front driver’s door of the patrol vehicle.

One (1) plastic bag containing a green leafy material weighing 2.0 grams between the front driver’s seat and the center console

One (1) Nevada identification card in the name of Karen Hardin under the front passenger seat.

LVMPD Vehicle #10369 LVMPD Criminalistics SCSA Vaandering On 05-07-2016, at approximately 1435, Detective Kowalski, SCSA Vaandering, and SCSA Randy McPhail, P# 3326, continued to document and process the patrol vehicle at the Criminalistics garage. There were three (3) bullet holes located on the exterior side of the front driver side door. One (1) penetrating bullet hole was located just below the window and above the door handle. Two (2) perforating bullet holes were located in the exterior and interior side of the rubber seal on the lower edge of the window. On the interior side of the front driver side door, there was damage to the plastic door panel around the door lock. A protrusion was located in the metal of the door, visible due to the damage to the plastic. A bullet was recovered from the interior of the front driver side door. A bullet ricochet was observed on the plastic molding below the window of the interior side of the front passenger door. A bullet impact, which did not penetrate the glass, was located on the interior side of the front passenger door window. Several bullet impacts were located on the sirens affixed to the front buddy bumper. There was a perforating bullet hole in the interior edge of the driver side siren case with a corresponding ricochet on the top edge of the interior siren cone. There was damage to the front inside edge of the driver’s side siren with a corresponding bullet impact to the bottom of the front grill of the vehicle. A bullet impact was observed to the top edge of the rear coil of the passenger side siren. A corresponding bullet impact was located on the back side of the passenger side siren case. A bullet fragment was recovered from inside the passenger side siren. SCSAs McPhail and Vaandering determined trajectories for the seven (7) rounds fired by Officer Sherwood. Digital photographs were recorded of the trajectories utilizing trajectory rods. Trajectory measurements were taken for trajectories A, B, and C. The recorded measurements were recorded by SCSA Vaandering, but not included due to possible inaccuracies caused by the condition of the vehicle and its movement from the original shooting location. For further details, refer to the corresponding Crime Scene Report and photographs. Trajectory A: The bullet was traveling downward and front to back in relation to the patrol vehicle. It entered the exterior side of the left front door just below the window. It caused damage to the interior side of the front driver side door panel, and a protrusion could be seen in the metal in the interior of the door. A bullet was recovered inside the front driver side door. Trajectory B: The bullet was traveling downward and front to back in relation to the patrol vehicle. It entered the exterior side of the rubber seal on the lower edge of the front driver side

door window and exited the interior side of the rubber seal on the front driver side door window. This was one of the bullets that struck Gwynn. Trajectory C: The bullet was traveling downward and front to back in relation to the patrol vehicle. It entered the exterior side of the rubber seal on the lower edge of the front driver side door window and exited the interior side of the rubber seal on the front driver side door window. This was one of the bullets that struck Gwynn. Trajectory D: The bullet was traveling downward and back to front in relation to the patrol vehicle. The bullet entered the inside edge of the driver side siren case and then ricocheted off the top edge of the interior cone of the siren. No bullet was recovered. Trajectory E: The bullet was traveling downward and back to front in relation to the patrol vehicle. It impacted and caused damage to the front inside edge of the driver’s side siren case and then impacted and damaged the bottom of the front grill behind the buddy bumper. The bullet impact on the interior of the door was tested for lead with positive results. No bullet was recovered. Trajectory F: The bullet was traveling downward. It impacted the top edge of the rear coil on the passenger side siren and then impacted the back side of the passenger side siren case. A bullet fragment was recovered from the passenger side siren. Trajectory G: The bullet ricocheted across the top of the interior side of the plastic molding below the window on the front passenger side door then impacted the interior side of the front passenger door window at the bottom of the window. The ricochet location and the window impact were tested for lead with positive results. A bullet was recovered from the front passenger floorboard prior to the vehicle being towed from the original scene. Evidence Recovered The following items were recovered by SCSAs Vaandering and impounded them as evidence:

One (1) bullet from inside the front driver side door (Trajectory A)

One (1) bullet fragment from the passenger side siren on the front buddy bumper (Trajectory F)

One (1) swab of apparent blood from the interior of the front driver side door

X. THIRD PERSON VIDEO AND PHOTOGRAPHIC EVIDENCE On 05-07-2016, at approximately 1500 hours, Forensic Multimedia Analyst Marc Moses, P# 13637, responded to the Copper Palms Apartments complex and obtained video coverage from the complex DVR. Analyst Moses determined the time stamp on the Copper Palms Apartments’ video was approximately twelve (12) hours early. The below information is a summary of the video footage. The times listed for each video summary were taken from the video footage and may not correspond with each other or be accurate. 1150 Buffalo Drive The Copper Palms Apartments utilized a single camera system on property. The camera was affixed to the west side of the main office and pointed to the west, and captured a view of the main entrance / exit gates and the area immediately inside the gate. The right side of the view captured on video was north and the left side was south.

Gwynn ran back into frame from the bottom right followed by Officer Sherwood. Gwynn ran around the patrol car and back towards the Malibu. Officer Sherwood ran around the front of the Malibu. Gwynn turned and ran back towards the patrol vehicle. Gwynn opened the patrol vehicle door, sat down in the driver’s seat, and closed the door. Officer Sherwood ran back and took up a position to the right of the driver’s side door with his firearm pointed at Gwynn.

INVESTIGATION Thomas Crisp On 05-06-2016, at approximately 2333 hours, Detective Bundy conducted an audio recorded interview with Thomas Crisp at 1150 North Buffalo Road. The following is a summary of the interview; for complete details refer to the interview transcript. Crisp and Travis Smith were at the entry gate for the Copper Palms Apartments complex when he noticed a newer white Chevrolet vehicle inside the complex. The Chevrolet’s horn was honking and lights were flashing as the driver was trying to exit the complex. Officer Sherwood drove up from behind them, passed them, and entered the complex. The white Chevrolet appeared to reverse from the gate. Crisp and Smith pulled into the complex and parked south of the entrance. Officer Sherwood parked near the Chevrolet and exited his patrol vehicle and yelled at the driver to exit the vehicle. Gwynn exited the vehicle and various items fell out of the vehicle. Gwynn ran from the vehicle toward the north side of main office building. Officer Sherwood

pursued Gwynn on foot for approximately one (1) minute around the patrol vehicle and the Chevrolet. Gwynn ran towards Crisp and Smith’s location before getting into the patrol vehicle. When Gwynn ran towards them, Crisp pulled out his pocket knife for protection. Officer Sherwood told Gwynn, “Don’t do it. Don’t do it.” Crisp saw the brake lights light up on the patrol vehicle. Officer Sherwood fired four (4) times at Gwynn while standing at the front driver side of the patrol vehicle. Crisp estimated Officer Sherwood was approximately three (3) to four (4) feet away from the vehicle when he fired. Gwynn put the patrol vehicle in reverse and drove up onto the landscaped area south of the entrance, west of Crisp and Smith’s location. Gwynn drove forward aiming at Officer Sherwood, who was standing in the middle of the road. Crisp believed Gwynn was trying to hit Officer Sherwood with the vehicle. Officer Sherwood fired a second set of shots at the vehicle before getting out of the way. Gwynn drove the vehicle around the island in front of the main office before crashing through the exit gate. Gwynn turned south onto Buffalo Drive and fled. Christine Curtis On 05-06-2016, at approximately 2340 hours, Detective Leaman conducted and audio recorded interview Christine Curtis at 1150 North Buffalo Drive. The following is a summary of the interview; for complete details refer to the interview transcript. Curtis stated that she heard a car alarm going off inside her apartment complex. The alarm sounded like it was coming from the area where she had parked her vehicle so she went to the window to see if it was her alarm. Looking out, she saw two men pointing guns at each other. She described one man as wearing a light blue shirt and another man in a dark shirt. The two men were in the grassy area to the rear of Curtis’ vehicle. Curtis believed the man in the light blue shirt fired his gun at the other man. When she heard the gunfire, Curtis grabbed her child and retreated to the bedroom where she called 911. Travis Smith On 05-06-2016, at approximately 2351 hours, Detective Bundy conducted an audio recorded interview with Travis Smith at 1150 North Buffalo Drive. The following is a summary of the interview; for complete details refer to the interview transcript. Smith drove up to the entrance for 1150 North Buffalo Drive and was entering the gate code when Officer Sherwood pulled alongside his passenger side. Smith saw a white vehicle with its horn blaring. The vehicle backed up and hit the center island east of the gates. Officer Sherwood pulled into the complex and exited his vehicle. Officer Sherwood told the driver of the white vehicle to get out of the car. Gwynn fell out of the car and it appeared to Smith that Gwynn was under the influence of alcohol and/or drugs. Gwynn dropped various items on the ground. Officer Sherwood continued to tell Gwynn to stop and not to move. Gwynn ran from Officer Sherwood, who

pursued him on foot. Gwynn appeared to trip on a curb and Officer Sherwood had him on the ground. Gwynn got up and ran away again. Gwynn ran back towards the vehicles and it appeared he was trying to get back into the white vehicle. Officer Sherwood ran towards Gwynn, who then ran back towards the patrol vehicle, got into the driver’s seat, and shut the door. Officer Sherwood shouted, “Don’t move! Stop! Get out of the car!” Smith believed Gwynn was manipulating a firearm, possibly a rifle, which was secured in the center of the front seat, trying to remove it. Officer Sherwood fired multiple times at Gwynn. Gwynn put the patrol vehicle in reverse and drove over the curb into some bushes. Smith jumped into his vehicle and pulled forward to get out of the way. Gwynn put the patrol vehicle in drive and tried to run over Officer Sherwood. Officer Sherwood fired a second round of shots at Gwynn and avoided being struck. Smith heard Gwynn drive the patrol vehicle through the exit gates and saw as he turned south on Buffalo Drive. Officer Joseph Schmitt On 05-07-2016 at approximately 0156 hours, Detective Alsup conducted an audio recorded interview with Officer Schmitt in his police vehicle which was parked near the intersection of Durango Drive and Washington Avenue. Also present for the interview was Detective Colon. The following is a summary of the interview. For complete details, refer to the transcript. Officer Schmitt was responding to back another officer on a call and heard a call broadcast on the radio of a carjacking. Officer Schmitt continued to respond to his call when he heard a traffic officer broadcast that he was in a foot pursuit with a possible suspect from the carjacking. Officer Schmitt decided that he would respond to the traffic unit. As Officer Schmitt was en route, he heard another radio broadcast that shots had been fired. As Officer Schmitt continued en route, radio traffic was updated that a police vehicle had been taken by the suspect [Gwynn], who left the apartment complex and traveling south on Buffalo Drive. Officer Schmitt saw the Air Unit and was listening to the direction of travel updates they were providing. The Air Unit broadcast Gwynn traveled west on Summerlin Parkway and then north on Durango Drive. Officer Schmitt followed the directions given by the Air Unit. As he exited Summerlin Parkway, he made a right hand turn to northbound Durango Drive and saw the stolen patrol vehicle. Officer Schmitt also observed another marked patrol vehicle behind him. Gwynn pulled over along the right curb near the intersection of Durango Drive and Washington Avenue. As Gwynn stopped the marked patrol vehicle he was driving, he opened the driver’s side door and rolled out of the vehicle, partially landing on the ground. Officer Schmitt and Officer LaRosa approached Gwynn and took him into custody. After Gwynn was in handcuffs, Officer LaRosa checked him for weapons and noticed he had been shot in the chest. Officers called for medical personnel and Officer LaRosa applied pressure to Gwynn’s wounds until they arrived.

Officer James LaRosa On 05-07-2016, at approximately 0212 hours, Detective Alsup conducted an audio recorded interview with Officer LaRosa in his police vehicle which was parked near the intersection of Durango Drive and Washington Avenue. Also present for the interview was Detective Colon and LVPPA Representative Grammas. The following is a summary of the interview: for complete details refer to the interview transcript. Officer LaRosa was dispatched as the primary unit on a carjacking. Officer LaRosa responded to the address and made contact with the person reporting (PR). The PR told him that she arrived home with her children and pulled into her garage when she was approached by a black male adult who was holding a firearm in his hand. The PR described Gwynn as having a medium build, wearing all dark clothing, and a hat. Gwynn told the PR to get out of the vehicle and chambered a round. The PR told her children to run into the house as she exited the vehicle. Gwynn left in the PR’s vehicle, but she did not know which way he went. As Officer LaRosa was speaking with the PR, a traffic unit arrived and then left in an attempt to locate the vehicle. Officer LaRosa was on the phone with patrol detectives when he heard the traffic unit broadcast that he needed assistance due to finding Gwynn. Officer LaRosa left the PR’s residence to assist the traffic unit. According to Officer LaRosa, radio traffic was broadcast of a foot pursuit, shots fired, and Gwynn having taken a marked patrol vehicle. Officer LaRosa followed directions given by the Air Unit and responded to the area of Summerlin Parkway and Durango Drive. As Officer LaRosa exited Summerlin Parkway, he was directly behind Officer Schmitt. Officers LaRosa and Schmitt initiated a felony car stop on the marked police vehicle in the area of Durango Drive and Washington Avenue. After stopping the marked police vehicle, Gwynn exited the vehicle and lay on the ground. Officers approached Gwynn and took him into custody. As Officer LaRosa was conducting a check for weapons, he noticed Gwynn was bleeding and observed a gunshot wound to Gwynn’s chest. Medical personnel were requested and Officer LaRosa applied first aid until they arrived. Kierra Jemison On 05-07-2016, at approximately 0222 hours, Detective Mendoza conducted an audio recorded interview with Kierra Jemison at 1412 Bow Creek Court. The following is a summary of the interview; for complete details refer to the interview transcript. Jemison had just returned from the store with her three (3) children. Jemison parked her white Chevrolet Malibu in the garage and shut the vehicle off. Jemison had not closed the garage door yet and as she opened her driver side door, she was approached by an unknown male adult. She described the subject as being a black male, approximately 5’7” and skinny. The subject was wearing a black t-shirt, black shorts, and a black baseball cap. He also was carrying a black backpack. The subject was holding a black semi-automatic handgun. The subject pulled back the slide of the gun and demanded that Jemison exit the vehicle as he aimed the firearm at her. Jemison told the children to exit the vehicle. Jemison said she feared

for her life and thought she or her children would be injured. Jemison put her hands in air and exited her vehicle. As her children entered into the house, the subject entered Jemison’s vehicle and fled the area. Jamison stated she did not see which direction the suspect drove away in. Jamison immediately went to her neighbor’s residence located at 1400 Bow Creek Court. Her neighbors stated they saw her car leave the area but thought Jemison was driving. Jemison called 911 and reported the incident. Search Warrant On 05-23-2016, a search warrant was obtained by Detective Kowalski from Judge Sciscento to obtain epithelial cells from the mouth of Gwynn to be collected via buccal swab. The warrant was served on 05-24-2016 at the Clark County Detention Center. The buccal swab was collected and impounded by Detective Kowalski. XIII. TIME LINE The below time line is a reconstruction of events which transpired on Friday, 05-06-2016, in relation to the non-fatal officer-involved shooting that occurred at 1150 N. Buffalo Drive.

XIV. FORENSICS REQUESTS / RESULTS On 05-23-2016, an LVMPD Forensic Laboratory Request was submitted for the following examination:

Firearm function test of Officer Sherwood’s firearm

Bullet/Cartridge Case comparison of recovered bullets and cartridge cases with Officer Sherwood’s firearm

DNA comparison of samples taken from the shotgun inside Officer Sherwood’s patrol vehicle and a sample taken from Gwynn

DNA Examination On 07-14-2016, Forensic Scientist A. Rubino, P# 14784, submitted the Biology/DNA Forensic Casework Report with the following results: The DNA profile obtained from the swabs from the Remington shotgun inside Officer Sherwood’s vehicle was consistent with a mixture of at least four contributors with at least one profile being a male. Due to the complexity of the data available, no additional conclusions could be made regarding the mixture DNA profile. Officer Firearm Examination On 06-28-2016, Forensic Scientist D. Angel Moses, P# 8002, submitted the Firearms & Tool Marks Report with the following results: The Glock pistol was examined, test fired, and found to be in normal operating condition with no noted malfunctions. It was determined to have a barrel length of approximately 4 5/8 inches, an overall length of approximately 8 5/8 inches with the flashlight, 8 5/16 inches without, and a trigger pull between 6 ¾ and 7 pounds. Along with the magazine, the maximum capacity for this pistol is fourteen (14) cartridges.

Bullet Comparison The evidence and test bullets and cartridge cases were microscopically examined in conjunction with one another. Based on these comparative examinations, Forensic Scientist Moses made the following determinations:

The four (4) bullets bear the same general rifling characteristics and some similar individual detail as the test bullets from the Glock pistol. However, there were insufficient microscopic details for a conclusive identification. These bullets could not be identified or eliminated as having been fired by the Glock pistol.

The seven (7) cartridge cases had all been fired by the Glock pistol.
