I. INTRODUCTION

A. Background

1. Government of Madhya Pradesh (GOMP) with a sector project loan funding from Asian Development Bank (ADB) has proposed to implement Madhya Pradesh Urban Services Improvement Project (MPUSIP), herein after referred as ‘the Project’. Madhya Pradesh Urban Development Company Limited (MPUDC) shall be the Implementing Agency and the State Urban Development and Housing Department (UDHD) shall be the executing agency for the Project. A project management unit (PMU) created under MPUDC is implementing MPUSIP. The Project intends to ensure:

a) Continuous, pressurized, safe and sustainable drinking water through private household metered connections in 128 towns;

b) Sewage and storm water collection and treatment systems are proposed in 12 identified towns including national heritage towns Sanchi and Khajuraho & Rajnagar; and

c) Project also includes component of non -physical investment (GIS, MIS, M&E and Social Safeguards) for system strengthening.

2. The Project is planned to be implemented in three periods: (i) preparatory and procurement; (ii) construction and (iii) operations and maintenance. Prior to implementation of the project, Design Consultants were hired by Implementing Agency to develop Detailed Project Report (DPR) of each subproject town along with safeguard reports. 3. The Resettlement Framework for MPUSIP outlines the objectives, policy principles and procedures for land acquisition, if any, compensation and other assistance measures for Displaced Persons1 (DPs) / affected persons, if any. This framework reflects the borrower’s law on the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013, state government policies, ADB’s Safeguard Policy Statement (SPS), 2009 and other social safeguard guidelines. A detailed description of compensation measures and assistance is provided in the entitlement matrix. 4. An entitlement matrix, consistent with the existing norms and guidelines of the country and the state government, and ADB’s Safeguard Policy Statement has been prepared to cover losses identified in this Project. The matrix recognizes that the lack of title/customary rights recognized under law will not be a bar to entitlement and has special provisions for non-titled persons. The eligibility for compensation will be determined through a cut-off date. People moving into the sub-project area after the cut-off date will not be entitled to compensation or other assistance. 5. Design, build and operate (DBO) model is adopted during construction and O&M phase and this includes (i) finalization of design of each subproject components (ii) construction of water supply facilities, using DBO model in all project towns the facilities will include raw water intakes, water treatment plants (WTP), overhead tanks (OHT), transmission line, distribution networks including the metered household connections. After the construction (expected to be completed

in 2 years), the DBO Contractors of the civil works packages will continue to operate and provide continuous water supply service for subprojects for a period of 10 years. The DBO contractor will also ensure proper metering and volumetric billing, adequate water pressure is maintained at the consumer end and supplied water complies with national quality standards for drinking water. B. Project Description

As per revised procurement plan, MPUSIP’s physical components include (a) improvements to water supply scheme (WSS) in 69 subprojects, and (b) sewage collection and treatment services proposed in four (4) identified towns namely Saikheda, Sanawad, Anjad and Badwaha under tranche I while in tranche II – water supply scheme in 59 subprojects and sewage collection and treatment services proposed in eight towns namely Sanchi, Dhamnod, Mandsaur, Nagda, Jabalpur (part-II), Maihar, Khajuraho & Rajnagar. The objective of the proposed improvements in subprojects is to achieve safe and sustainable water services both in terms of services to customers, cost recovery and conservation of precious water resources. The project proposals envisage providing 100% coverage of population with continuous, pressurized and safe drinking water services and achieving progressively increasing cost recovery by expanding the coverage and increasing operating efficiency. The main objectives of the Project are as follows:

• Supplying pure drinking water. • Promote sustainable measures to increase potable water supply to the population. • Water supply through future sustainable source developments. • Water supply through improvements of safe yield of existing water sources. • Water supply through improvements to water treatment works. • Drinking water supply contributes towards a sustainable regional development. • To improve the current state of the water cycle of subproject towns through

improvements in the separate components of the water supply system in investment program

C. Scope of this Report

7. This land acquisition and involuntary resettlement due diligence report (DDR) is prepared for the proposed group water supply scheme for seven towns namely Katangi, Bhedaghat, Majholi, Panagar, Patan, Sihora and Tendukheda along with detailed project report (DPR) during preparatory stage. All the towns are municipal towns locally called Nagar Parishads (NPs) located in Jabalpur and Damoh district. Proposed components of the group water supply subproject include construction of common water intake, water treatment plant (WTP), separate storage reservoirs as per demand of the towns, transmission mains and distribution system. The proposed subproject provides metered water supply for domestic, institutional and commercial users including metered connections to each household in the subproject towns. All municipal wards of the towns are covered under the Project. Thus, the total population of the town, 139,910 as per census 2011 and 221,964 projected population in the design year 2048 will be covered. 8. During preparatory stage of the Project, a due diligence process was conducted to examine the land acquisition and involuntary resettlement issues in line with ADB SPS 2009 and Involuntary Resettlement DDR was prepared and submitted to ADB. Thereafter, detailed design and detailed measurement surveys (DMS) was jointly conducted by DBO Contractor, The Indian Hume Pipe Company Limited, Bhopal, safeguard personnel of PIU Jabalpur and field engineer of Project Management Consultant (PMC) before initiation of civil works and during implementation period, in which involuntary resettlement impacts are reconfirmed and Updated Involuntary

Resettlement DDR (draft) is prepared. The final Involuntary Resettlement report will be reviewed and disclosed on website of urban local body (ULB), Implementing Agency and ADB. No construction work will commence before the updated social safeguard document for the package is reviewed and approved by ADB and compensation to affected persons, if any, paid. The Implementing Agency is responsible to hand over the project lands/sites to the contractor which should be free from all encumbrances. 9. This report describes the findings and provides copies of relevant documents, maps, minutes of meetings and photographs. This land acquisition and involuntary resettlement due diligence report needs to be read along with the Resettlement Framework prepared for MPUSIP.

II. POLICY FRAMEWORK, AND ENTITLEMENTS

10. The Resettlement Framework prepared for MPUSIP sets out the objectives, principles, eligibility criteria and entitlements for APs, based on ADB SPS, 2009 and LARR 2013 as well as national and state laws for protection of street vendors. Until recently, all activities related to rehabilitation and resettlement in the State of MP had been based on the Madhya Pradesh Resettlement and Rehabilitation Policy, 2002 (MPRR) and National Rehabilitation and Resettlement Policy, 2007 (NRRP-2007). GOMP adopted LARR 2013 on 3rd October 2014 with some specifications for operationalizing its implementation in the state.1 Details of policies are in the Resettlement Framework for MPUSIP, visit website - http://www.mpudc.co.in/mpusip-adb-funded.html.

III. SUBPROJECT DESCRIPTION

A. Description of Subproject

11. A group WSS for seven towns namely Katangi, Bhedaghat, Majholi, Panagar, Patan and Sihora under District Jabalpur and Tendukheda under District Damoh is framed with common water source and WTP. Location coordinates of the seven towns under this subproject are described below and Google Earth images are shown in Figures 1, 2 and 3:

(a) Katangi: Geographically, Katangi town is located at 23° 27'49’’ North Latitude and 79° 47'38’’ East Latitude, at an average elevation of 373 meters above Mean Sea Level. The town is situated on State Highway 37 connecting Jabalpur and Damoh. It is located 38 from Jabalpur towards the North-West and 22 km North of Katangi. The town area is divided in 15 wards.

(b) Bhedaghat: Geographically, Bhedaghat lies between 23°08’N 79°48’E, 23°13°N 79°80°E. Bhedaghat is located at 25 kilometers. from Jabalpur and 5 kilometers. eastern side on the State Highway 12A leading towards Bhopal- Jabalpur. Presently Bhedaghat has 15 wards.

(c) Majholi: Geographically Majholi town is located at 23° 30' 0’’ North Latitude and 79° 55' 12’’ East Latitude, at an altitude of 385 meters above mean sea level. The town is situated on Road connecting Sihora Gubra. The distance from Jabalpur is

around 47 kilometers. Majholi Town is located at distance of 30 kilometers. for Sihora. The area of the town is spread over in 629.00 Ha (6.29 Sq Kilometers) as per 2011 data.

(d) Panagar: Geographically, Panagar lies between 23°9'58"N and 79°56'33" E. Panagar is situated on NH – 7 connecting Nagpur – Katni. The distance from Jabalpur is about 16 Kilometers. Panagar is divided into total 15 Wards.

(e) Patan: Geographically, this town lies between 220 31’ 48’’ north latitude and 790 25’ 12’’ east Longitude, at an altitude of 379 meters above mean sea level and is nearly 33 Kilometers. from Jabalpur. The municipal council was constituted in the year 1981, with an area of 13.06 sq. kilometers and comprising of 15 municipal wards.

(f) Sihora: Geographically, Sihora town is located at Latitude 23° 28’ 48’’ N Longitude 80° 7' 12’’ E, Town is situated at average elevation of 386 m from Mean Sea Level. The year of Establishment of Sihora ULB is 1967. The area of the town is spread over in 2302.00 Ha (23.02 Sq Kilometers) as per 2011 data. The town area is divided in 18 wards.

(g) Tendukheda: Geographically, Tendukheda town is located at Latitude 23° 23'59’’ N Longitude 79° 32'59’’E.It is 260 kilometers. from the state capital of Bhopal and around 52 kilometers. from district headquarter Damoh. Town is situated at average elevation of 398 m from Mean Sea Level. The area of the town is spread over in 1400.00 Ha (14.00 sq kilometers) as per 2011 data. The year of establishment of Tendukheda ULB is 1984. The town area is divided in 15 wards.

B. Proposed Group Water Supply Scheme

13. The primary objectives of the proposed water supply subproject include:

➢ service improvements to achieve safe and sustainable water services both in terms of services to residents and cost recovery;

➢ conservation of precious water resources. The project envisages providing 100 percent coverage of population with continuous, pressurized and safe drinking

water services and achieving progressively increase cost recovery by expanding the coverage and increasing operating efficiency.

14. Sustainable water supply is a problem for all towns of the proposed subproject as their water source is far and currently not reliable. Water source for Panagar and Bhedaghat is river Narmada near Jabalpur. Water source of Patan is also river Narmada. Distance of each town from the other and to Jabalpur ranges approximately 16 to 56 kilometer. Sihora is approximately 25 kilometers from Panagar and Majholi is approximately 20 km from Sihora; Katangi is 20 kilometers from Majholi and Tedukheda is nearly 20 kilometers away from Patan. A common water scheme for all these towns including Tendukheda is linked to the river Narmada. If combined water scheme is prepared, storage and intake structure costs can be avoided. Feasibility and viability study is worked out through survey and investigation. 15. For this resolve, the water source for the proposed subproject is Narmada River, where intake well will be installed. Previous identified location of the proposed intake well was on left bank of river Narmada at Bhedaghat, however it was changed during visit of ADB mission. The new proposed location is on upstream of the river Narmada on right side of the bank near Lamhetaghat. 16. The proposed subproject components are described below and presented in Table 3. 17. Intake well: The common intake well of 27.93 MLD is proposed for Katangi, Patan, Majholi, Sihora, Panagar, Bhedaghat and Tendukheda Nagar Parishad at Bhedaghat near Lamhetaghat on the bank of Narmada river. There is proposed R.C.C. intake well of 10 m diameter and 35 m height to collect and lift water up to treatment works. 18. Raw Water Rising Main (RWRM): There will be common raw water rising main for Katangi, Patan, Majholi, Sihora, Bhedaghat and Panagar. The proposed raw water rising main is 339 m long 600 mm dia. DI K9 from proposed Intake well to proposed WTP. 19. Water Treatment Plant (WTP): The common WTP for all these towns having capacity of 31.00 MLD considering 22 hours of pumping is located at Lamhetaghat. 20. Clear Water Sump well at WTP: The clear water sump is proposed to 1147 KL of sump well at WTP for storing clear water after treatment from WTP.

2 Pumping stations

Three nos. vertical turbine type pump with 50% as standby is proposed at intake well. The discharge of each pump is (23.32 MLD) 269.91 LPS and head is 47 meters at intermediate stage Yr.2033. The rating of each pump is 58.92 KW (say 59.0 KW). Two nos. working and one pump will be as a standby. This will be replaced by 27.93 MLD or 323.26 LPS discharging capacity at 47 m head pumps of 71.5 KW in year 2048. The pumping is proposed for 22 hours.

3 Raw water Rising Main

There will be common raw water rising main for Katangi, Patan, Majholi, Sihora, Bhedaghat, Tendukheda and Panagar. The proposed raw water rising main is 339 m long 600 mm dia. DI K9 from proposed Intake well to proposed WTP.

8 Bulk flow meters

Electromagnetic Bulk flow meter will be installed to monitor the bulk flow in the main components i.e. at the inlet of the raw water mains to know the quantity of water coming to the WTP, outlet of the clear water sump to know the quantity of water going for the distribution, outlet of the service reservoirs to know the quantity of water going in the distribution zone or DMA. This will help in maintaining the UFW in the limit and also equitable distribution of the water.

IV. FIELD WORK AND PUBLIC CONSULTATION

22. This involuntary resettlement document is prepared in consultation with stakeholders including local residents, beneficiaries/consumer, and Urban Local Body (ULB) officials/representatives. Informal consultations and focus group discussions (FGDs) were

conducted to seek feedback from local people and other important stakeholders on the proposed development interventions, perceived impacts and mitigation measures and their participation. A. Outline of Fieldwork

23. During the visit, a field inspection of proposed subproject facility locations and pipeline alignments was undertaken. Identified proposed site facilities and pipeline alignments were inspected and stakeholder consultations were held. The land requirements including identified government lands for the proposed subproject components were also examined. The details of proposed land parcels for subproject components are given in the Appendix-1.

B. Field Report

24. Team of the Consultant met the concerned ULB officials, public representatives; stakeholders and residents of subproject towns to collect data / information for proposed subproject during various discussions/meetings.

• During meeting and discussion, data was collected about the existing water supply in the respective towns and the requirement of the stakeholders. Based on present water supply arrangements and gaps arrived are well documented.

• Along with the ULB officials, visited all the possible water supply sources and identified locations for all components of proposed water supply scheme.

• All the options of possible water supply source, its dependability, quality assurance of source available and the distance from the town, were studied and discussed with the stakeholders.

• Water from the selected source was collected and tested in Bhopal Municipal Corporation Laboratory at Bhopal. Also test report is obtained for designing purpose.

• Water security is ensured during consultation with the concerned department like WRD etc. such that best-chosen water source is made available to ULB for the purpose of water supply scheme.

• Revenue authorities were contacted to ensure that the land required for facilities in the town is secured and under the ownership of government departments such as ULB or Revenue Department, Govt. of Madhya Pradesh etc. for construction of Project facilities.

C. Public Consultation

25. Stakeholder mapping was undertaken as the first step and the major potential stakeholders listed:

(a) The municipality (Nagar Parishads), its elected members and staff who will be

required to oversee the construction of the distribution networks and WTP as well as be directly responsible for the maintenance of the installations

(b) Concerned government departments (Water Resources Department, Revenue Department, PWD, NHAI, Irrigation department etc.)

(c) Local residents who will take initiative to connect their houses with the water distribution line.

(d) Local business persons and traders (e) School and College Students

(f) Opinion makers or prominent citizens/residents, who are intimately acquainted to and well regarded by the community. They need to be enlisted in spreading environmental awareness within the community as well as in conveying the benefits of the project.

26. Consultations were undertaken with key stakeholders in line with ADB’s requirements pertaining to environment and social considerations. Tools used for consultation were formal stakeholder meetings and focus group discussions (FGD). Extensive consultations with stakeholders (municipality, concerned government departments, community members including slum dwellers, and traders’ associations) including individual face to face interviews and public consultations were conducted. Informal meetings were also conducted during visit. No users (boatmen and washer men) were found at the intake site which is vacant and unused, hence no special consultation was conducted with them. 27. Potential impacts and mitigation measures for the proposed subproject sites and pipeline alignments were discussed with stakeholders. These consultations helped identify the felt needs/concerns, apprehensions of the communities and priorities of concerned stakeholders related to the proposed subproject. Discussions were held with people residing at and/or having businesses at/near the proposed subproject site locations. Consultations also revealed that people were aware of the problems of the existing water supply system in their towns as they were getting 35 lpcd, hence they were willing to cooperate in the proposed project. Summary of consultations held with stakeholders during planning and implementation phase is provided in Appendix 2 while photographs and list of participants are provided as Appendix 3 and 4, respectively. Informal consultations were also held during implementation phase, refer to Appendix 5.

V. LAND AVAILABILITY AND INVOLUNTARY RESETTLEMENT IMPACTS

28. No land acquisition or resettlement impacts are anticipated for any of the proposed civil works for group water supply subproject. Narmada River is selected as common water source and proposed common components such as Intake well, WTP, Raw water rising main are located at Bhedaghat. Clear water feeder main, OHTs and water distribution networks are proposed for each town. 29. Land identified for the proposed subproject components belongs to government. All the land is vacant, unused and encroachment free, therefore, there is no hurdle to start of civil works. Most of the proposed sites are under possession of concerned ULBs or proposed land parcels belongs to revenue department, proposal has been submitted to District Collector and process of land transfer is in progress. The concerned Chief Municipality Officers (CMOs) of each town has issued land status certificates and has submitted application to the office of the District Collector to allot the proposed site for construction and also transfer the proposed site/land in the name of ULB (refer to Table 4 and Appendix 15,16, 17, 18, 19, 20, 21 and 22). 30. Change of the locations of subproject components during implementation. Location of proposed subproject facilities including the (i) common intake well and WTP in Bhedaghat and (ii) OHTs at Sihora were changed during implementation phase. During visit of ADB Mission in October 2017, it was noted that the location of Intake well and WTP at Bhedaghat had very high aesthetic and scenic value and good tourism potential and construction at this site can adversely impact the tourism activities. Moreover, proposed site is located within 300 meters from Archaeological Survey of India’s (ASI) protected monument namely “Chousat Yogini Temple” notwithstanding, no objection certificate (NoC) has been obtained from ASI before start of

construction. An OHT site (900 KL) at Sihora was changed due to insufficient area (at the previous location) needed for construction. Another OHT site (620 KL) at Sihora was changed due to absence of the approach road to the site. 31. Common Intake well at Lamhetaghat: Location of intake well was changed from Bhedaghat to Lamhetaghat on the banks of Narmada River. The proposed R.C.C. intake well of 10 m diameter and 35 m height will collect and lift water up to treatment works. All group towns applied permission from Water Resource Department (WRD) for extraction and construction and no objection certificate (NOC) from WRD has been obtained (refer to Appendix 7). 32. Water Treatment Plant (WTP) at Lamhetaghat and OHTs at Bhedaghat. Location of WTP was changed from Bhedaghat to Lamhetaghat, with Khasra Numbers 171, 173 and 175 belonging to revenue department. Clear Water Sump well with capacity of 1147 KL is proposed within the premises of WTP for storing clear water after treatment from WTP .This site is located near the proposed new site of Intake well, about 339 m away. Two OHTs (220 KL & 200 KL) located at Bhedaghat are proposed at Khasra No. 153/2 and Khasra No. 72 respectively. These proposed land parcels belong government and under the possession of Nagar Parishad-Bhedaghat. These sites are vacant and without any settlement/ squatter /cultivation or other developments. Therefore, no involuntary resettlement impact is anticipated. The Chief Municipal Officer (CMO) of Bhedaghat issued a land status certificate (refer to Appendix 5) and has written a letter to District Collector, Jabalpur for the transfer of proposed land (refer to Appendix 16 and 17). 33. Raw water rising main (RWRM). The proposed raw water rising main is now 339 m long (from previous 330 m) with 600 mm dia. Ductile Iron K9 pipes are proposed to be installed from intake well to WTP. The land is under possession of revenue department from many years and no involuntary resettlement impact is anticipated. 34. OHTs at Katangi. There is only one proposed OHT having capacity 120 KL with staging height 12M in ward no. 2 at Katangi. Proposed land parcel belongs to Nagar Parishad Katangi and is without any settlement/ squatter /cultivation or other developments. Therefore, no involuntary resettlement impact is anticipated. The CMO Katangi issued a land status certificate (refer to Appendix 15) and has written to District Collector for the transfer of proposed land, refer to Appendix 18. 35. Clear water sump at Majholi: There are four existing OHTs having 2 nos. 15 m staging and 2 nos. 18 m staging height, all are in good condition and considered under WSS. A huge head of pumps will be required to feed these tanks directly from the WTP. An intermediate pumping station at junction point (elevation 393.39m) and a sump well with of capacity 35KL is proposed, considering 30 minutes detention time. The land is in the possession of revenue department. The CMO Majholi issued a land status certificate (refer Appendix 15) and has written a letter to District Collector Jabalpur for the transfer of proposed land (refer Appendix 19). 36. OHTs at Panagar: There are three proposed OHTs having (1) Capacity 700 KL (2) Capacity 600 KL and (3) Capacity 200 KL. All the proposed sites are under possession of Nagar Parishad-Panagar. The CMO Panagar issued a land status certificate (refer to Appendix 15) and has written a letter to District Collector-Jabalpur for the transfer of proposed land (refer Appendix 20). OHTs and Clear Water Sump well at Sihora. There are four proposed OHTs having (1) capacity 920 KL staging height 18 meter, (2) capacity 900 KL staging 15 meter, (3) capacity 630 KL staging

height 16 meter, (4) capacity 620 KL staging height 10 meter, at ground levels 397.542m, 386.398 m, 401.502 m and 415.412 m. A huge head of pumps will be required to feed these tanks directly from the intermediate pumping station has been proposed for boosting the water at required head. An Intermediate pumping station at junction point (elevation 378.88m) with a sump well of capacity 245 KL is proposed considering 30 minutes detention time. One semi-pucca (tin shed) structure is reported near sump well (245 KL) but no impact is anticipated on this structure. All the proposed sites are under possession of Nagar Parishad Sihora. The CMO Sihora issued a land status certificate (refer to Appendix 15) and has written a letter to District Collector, Jabalpur for the transfer of proposed land (refer Appendix 21). 37. Overhead tanks, Clear Water Sump well and Break Pressure Tank (BPT) at Tendukheda. There are two proposed OHTs, (1) capacity 325 KL staging height 13 meter and (2) capacity 300 KL staging height 9 meter. Both the OHT sites are government land, and are vacant and unused. Although one semi pucca (tin shed) structure is reported at site, it is owned by Nagar Parishad and is being used for parking of Nagar Parishad vehicles. No impact is anticipated on this structure. For storing clear water by direct pumping from WTP sump to overhead tanks an intermediate pumping station with a sump well of capacity 52 KL is proposed for 30 minutes detention time at junction point near Basan village (elevation 541.50 m) where a break pressure tank (BPT) on hill (capacity 52 KL) is also proposed. Proposed site for BPT is government land. A few trees are noted at the site, but no tree will be cut. Proposed land parcel belongs to Nagar Parishad Tendukheda and is without any settlement/ squatter /cultivation or other developments. Therefore, no involuntary resettlement impact is anticipated. All the proposed sites are under possession of Nagar Parishad Tendukheda. The CMO Tendukheda issued a land status certificate (refer Appendix 15) and has written a letter to Tehsildar Tendukheda for the transfer of proposed land in the name of ULB, refer Appendix 22. 38. Clear water feeder main from WTP to different overhead tanks and sump for Katangi, Patan, Majholi, Sihora, Panagar and Tendukheda Nagar Parishad and its total length is 158494 meters (for details, refer to Table 2). Pipelines will pass through existing road rights of way (RoW) which are government roads. NOC has been applied to Rani Avanti Bai Lodhi Sagar Canal Prakosht, Forest Department, railway, MP Rural Road Development Authority, MPRDC, PWD (for road and bridges), PWD (Division 1), PWD (Division 2) and NHAI to lay the feeder main (refer Appendix 8, 9, 11 and 13). NOC has been obtained from NHAI and Rani Avanti Bai Lodhi Sagar Canal Prakosht, refer to Appendix 10 and 12. 39. The distribution network design of Katangi, Patan, Majholi, Sihora, Panagar, Bhedaghat and Tendukheda Nagar Parishad is done separately and divided into different number of zones. The total length of the proposed network is around 328450 meters of diameter 110 mm to 315 mm HDPE PN 10 pipe (refer to Table 2). Temporary impacts are anticipated in during construction. The Contractor, as per environmental management plan (EMP) will ensure these impacts are mitigated. 40. Temporary impacts to pedestrians, traffic, access to shops, access to residences and possible income loss of businesses due to excavation, laying of transmission mains and distribution network pipelines are possible during construction. The Contractor will provide access to properties through provision of pedestrian planks, provision of adequate signage, and careful traffic management. 41. Mobile hawkers are assisted to move to places nearby, to ensure their earnings are not affected. The weekly market day is avoided for construction. Only mobile vendors are shifted to a nearby location during the period of construction and assistance to shift will be provided by the

contactor. No income loss is anticipated. 42. In case temporary shifting of vendors with temporary structures is necessary, such shifting will be undertaken on a weekly holiday, to avoid income loss on the day(s) of shifting. The vendors are assisted to shift and will be able to continue plying their trade during the construction period at the alternative location. Potential disruption of water supply to existing consumers is possible during construction, and are being mitigated through supply by water tankers. 43. House Service connections: Household survey is being conducted at each subproject town. Provision of house service connections will involve tapping from a distribution main/ sub-main including one tapping saddles, elbows, service pipe from tapping point to the chamber near property boundary or inside the property boundary. The work involves excavation and road restoration. Each connection will include a domestic water meter. Installation of automatic meter reading compatible water meters for each house service water connection is envisaged.

44. Mitigation: The sites or locations for the subproject components have been selected carefully to avoid and minimize involuntary resettlement impacts. The following mitigation measures are proposed to avoid and/or reduce the impacts during linear pipe works:

(i) Provide prior advanced notice (minimum one week) to community along the construction stretch. Distribute information on project and grievance redress mechanism,

(ii) Maintain access to avoid disturbance to residents and businesses by providing planks and leaving spaces for businesses and residents to maintain access,

(iii) Manage traffic flows as per traffic management plan prepared by the contractor in coordination with local authorities and communities,

(iv) Limit the amount of time of open trenches, and complete works quickly where business activities are located,

(v) Avoid full street closure to extent possible, (vi) Contractors shall provide employment opportunity to the local residents and

particularly woman where possible, and (vii) Contractors shall assist vendors and hawkers in shifting to alternative locations, if

required.

45. This subproject does not have any involuntary resettlement impact as there are no physical or economic displacement. The subproject does not have adverse land acquisition impacts as the subproject components are proposed on public lands belonging to government. Identified sites does not belong to tribal community and no adverse IP impacts are envisaged. Transmission and distribution pipeline carry raw and clear water traverse only through right of way (ROW) of the government roads. Keeping in view, no involuntary resettlement impacts are likely to be envisaged; an involuntary resettlement screening checklist is prepared and attached in Appendix 6. Accordingly, the subproject is classified under ‘Category C’ for involuntary resettlement under ADB’s SPS-2009.

VI. BUDGET

46. A provisional budget for consultation, communication, grievance redress, awareness generation, and mitigation measures such as tanker supply to existing consumers if supply is affected during construction is included in the DDR for Katangi, Patan, Majholi, Tendukheda, Sihora, Bedaghat, Panagar and overall subproject costs.

VII. CONCLUSIONS AND RECOMMENDATIONS

A. Summary and Conclusions

47. No negative involuntary resettlement impacts are assessed at identified sites for sub-project components, as adequate vacant land is available for the proposed facilities, within the compounds of government lands. 48. For the subproject towns, source of water is Narmada River. Office of the CMOs has applied to WRD for NOC and obtained. Common Intake well is being constructed at Lamhetaghat on Narmada River and NOC has been obtained from WRD. The proposed site for common WTP is at Lamhetaghat in Bhedaghat. All identified land/sites for proposed components is owned by revenue department. For linear components (pipe laying) or those proposed along government road ROWs, temporary disruption to road users, pedestrians and community members are avoided in the congested zones of Katangi, Bedaghat, Majholi, Panagar, Patan, Sihora and Tendukheda with proper traffic management with the help of local police and officials. Safety measures and simple mitigation measures are taken during construction by the DBO contractor such as provision of planks for pedestrian access to shops, avoidance of weekly haat days for construction, undertaking construction on weekly market holidays, and proper traffic management and information sharing with the public is being adopted. The subproject is classified as ‘Category C’ for Involuntary Resettlement impact as per ADB’s Safeguard Policy Statement (SPS), 2009. A budgetary provision is made for costs likely to be incurred for impact mitigation. B. Next Steps 49. The DDR needs to be updated with the following information:

➢ Transfer of land in the name of respective Nagar Parishad/ULBs of proposed components under subproject (in progress).

➢ NOC is required to lay the transmission / distribution line (in progress). ➢ In addition to the above, in order to improve the quality of consultations, local

community organizers will be appointed for Project under package; record of consultations held with local communities and other stakeholders to be included in updated/final DDR.

➢ Any unanticipated impacts during construction will be assessed and compensation paid in accordance with the Resettlement Framework.
