COMPLAINT \

Complainant Library Users Association ("Complainant") alleges that the San Francisco Public Library Commission ("the Commission") violated provisions of the Sunshine Ordinance by failing to open a policy body meeting to the public, failing to provide proper notice for a meeting, and failing to allow public comment at a meeting.

COMPLAINANT FILES TIDS COMPLAINT

On October 14, 2013, Complainant filed this complaint with the Task Force alleging that the Commission violated provisions of the Sunshine Ordinance relating to notice and protocol of public meetings.

JURISDICTION

The Commission is a department under the Sunshine Ordinance. The Task Force therefore generally has jurisdiction to hear a complaint of a violation of the Sunshine Ordinance against the Commission. The Commission has not contested jurisdiction.

APPLICABLE STATUTORY SECTION(S)

Section 67 of the San Francisco Administrative Code:

• Section 67.5 provides that policy body meetings shall be open to the public.

• Section 67. 7 governs the notice requirements for public meetings.

• Section 67.15(a) governs the protocol for public comment at public meetings.

Cal. Gov't Code Section 54950 et. seq. (The "Brown Act"):

• Section 54953 governs the protocol for conducting public meetings.

APPLICABLE CASE LAW

• None.

· BACKGROUND

On October 3, 2013, the Commission held a public meeting. During that meeting, there was neither an agendized item nor Commissioners' comments addressing San Francisco City

Librarian Luis Herrera's ("Mr. Herrera") recent stipulation with the Fair Political Practices Commission ("FPPC") regarding his alleged failure to disclose gifts.

Although Mr. Herrera's stipulation with the FPPC was not discussed during the October 3, 2013 meeting by Commission members, the Commission sent a letter to a reporter from the San Francisco Bay Guardian on October 4, 2013 in which it publicly affirmed its support for Mr. Herrera.

Complainant alleges, and the Commission acknowledges, that the sentiments of the letter supporting Mr. Herrera, and its preparation, improperly took place without public notice, without public comment, and during a non-public meeting.

The Commission responded to Complainant's complaint as follows:

After the Library Commission meeting on Thursday, October 3, 2013, Michelle Jeffers, Acting Chief Communications, Programs and Partnership was asked by a member of the Library Commission to draft and send a letter from the Library Commission seeking to publicly affirm its support for San Francisco City Librarian Luis Herrera in regards to the recent stipulation, decision and order pertaining to the filing of statement of economic interest to the Fair Political Practices Commission (FPPC) and recognizing that this was an unintentional reporting error that required the filing of amended statements. The letter was written and circulated to the Commission members by email on Friday, October 4, 2013 for their comments. The letter was then sent to a reporter at the Bay Guardian who was on deadline for a story he was working on.

Once the Library realized that it had violated Sections of the Sunshine Ordinance, Jeffers immediately sent a letter to the reporter rescinding the letter. She stated in the email "Although the letter accurately reflects the sentiments of the Library Commissioners, I am required to ask that you rescind this letter. I note that its contents were not used in your article 'Friends in the Shadows,' dated October 9, 2013 in the San Francisco Bay Guardian. It has come to my attention that the Library Commission did not follow proper procedure in crafting and approving this letter and the letter needs to be officially withdrawn." The letter was not sent to any other recipients.

The Library apologizes for its actions and would like the Sunshine Ordinance Task Force to know that steps are being taken, including additional sunshine ordinance training, to insure that something like this does not happen again. The San Francisco Public Library hopes that this matter can be put behind it and instead focus on its mission to provide exemplary library services to the community.

CHAPTER 67, SAN FRANCISCO ADMINISTRATIVE CODE (SUNSHINE ORDINANCE) .

SEC. 67.5. MEETINGS TO BE OPEN AND PUBLIC; APPLICATION OF BROWN ACT.

All meetings of any policy body shall be open and public, and governed by the provisions of the Ralph M. Brown Act (Government Code Sections 54950 et. seq,) and of this Article. In case of inconsistent requirements under the Brown Act and this Article, the requirement which would result in greater or more expedited public access shall apply.

SEC. 67.7. AGENDA REQUIREMENTS; REGULAR MEETINGS.

(a) At least 72 hours before a regular meeting, a policy body shall post an agenda containing a meaningful description of each item of business to be transacted or discussed at the meeting. Agendas shall specify for each item of business the proposed action or a statement the item is for discussion only. In addition, a policy body shall post a current agenda on its Internet site at least 72 hours before a regular meeting.

(b) A description is meaningful if it is sufficiently clear and specific to alert a person of average intelligence and education whose interests are affected by the item that he or she may have

· reason to attend the meeting or seek more information on the item. The description should be brief, concise and written in plain, easily understood English. It shall refer to any explanatory documents that have been provided to the policy body in connection with an agenda item, such

· as correspondence or reports, and such documents shall be posted adjacent to the agenda or, if such documents are of more than one page in length, made available for public inspection and copying at a location indicated on the agenda during normal office hours.

(c) The agenda shall specify the time and location of the regular meeting and shall be posted in a location that is freely accessible to members of the public.

( d) No action or discussion shall be undertaken on any item not appearing mi the posted agenda, except that members of a policy body may respond to statements made or questions posed by persons exercising their public testimony rights, to the extent of asking a question for clarification, providing a reference to staff or other resources for factual information, or requesting staff to report back to the body at a subsequent meeting concerning the matter raised by such testimony.

( e) Notwithstanding Subdivision ( d), the policy body may take action on items of business not .appearing on the posted agenda under any of the following conditions:

(1) Upon a determination by a majority vote of the body that an accident, natural disaster or work force disruption poses a threat to public health and safety.

(2) Upon a good faith, reasonable determination by a two-thirds vote of the body, or, if less than two-thirds of the members are present, a unanimous vote of those members present, that (A) the need to take immediate action on the item is so imperative as to threaten serious injury to the public interest if action were deferred to a subsequent special or regular meeting, or relates to a purely commendatory action, and (B) that the need for such action came to the attention of the body subsequent to the agenda being posted as specified in subdivision (a).

(3) The item was on an agenda posted pursuant to subdivision (a) for a prior meeting of the body occurring not more than five calendar days prior to the date action is taken on the iterri, and at the prior meeting the item was continued to the meeting at which action is being taken.

(f) Each board and commission enumerated in the Charter shall ensure that agendas for regular and special meetings are made available to speech and hearing impaired persons through telecommunications devices for the deaf, telecommunications relay services or equivalent systems, and, upon request, to sight impaired persons through Braille or enlarged type.

(g) Each policy body shall .ensure that notices and agendas for regular and special meetings shall include the following notice:

Government's duty is to serve the.public, reaching its decisions in full view of the public.

Commissions, boards, councils and other agencies of the City and County exist to conduct the people's business. This ordinance assures that deliberations are conducted before the people and that City operations are open to the people's review.

OF THE ORDINANCE, CONTACT THE

(h) Each agenda of a policy body covered by this Sunshine Ordinance shall include the address, area code and phone number, fax number, e-mail address, and a contact person's name for the Sunshine Ordinance Task Force. Information on how to obtain a free copy of the Sunshine Ordinance shall be included on each agenda. "

SEC. 67.15. PUBLIC TESTIMONY.

(a) Every agenda for regular meetings shall provide an opportunity for members of the public to directly address a policy body on items of interest to the public that are within policy body's subject matter jurisdiction, provided that no action shall be taken on any item not appearing on the agenda unless the action is otherwise authorized by Section 67.7(e) of this article. However, in the case of a meeting of the Board of Supervisors, the agenda need not provide an opportunity for members of the public to address the Board on any item that has already been considered by a. committee, composed exclusively of members of the Board, at a public meeting wherein all interested members of the public were afforded the opportunity to address the committee on the item, before or during the committee's consideration of the item, unless the item has been substantially changed since the committee heard the item, as determined by the Board.

(b) Every agenda for special meetings at which action is proposed to be taken on an item shall provide an opportunity for each member of the public to directly address the body concerning that item prior to action thereupon.

(c) A policy body may adopt reasonable regulations to ensure that the intent of subdivisions (a) and (b) are carried out, including, but not limited to, regulations limiting the total amount of time allocated for public testimony on particular issues and for each individual speaker. Each policy body shall adopt a rule providing that each person wishing to speak on an item before the body at a regular or special meeting shall be permitted to be heard once for up to three minutes. Time limits shall be applied uniformly to members of the public wishing to testify.

( d) A policy bo.dy shall not abridge or prohibit public criticism of the policy, procedures, programs or services of the City, or of any other aspect of its proposals or activities, or of the acts or omissions of the body, on the basis that the performance of one or more public employees is implicated, or on any basis other than reasonable time constraints adopted in regulations pursuant to Subdivision (c) of this Section.

(e) To facilitate public input, any agenda changes or continuances shall be announced by the presiding officer of a policy body at the beginning of a meeting, or as soon thereafter as the change or continuance becomes known to such presiding officer.

THE BROWN ACT

SEC. 54953.

(a) All meetings of the legislative body of a local agency shall be open and public, and all persons shall be permitted to attend any meeting of the legislative body of a local agency, except as otherwise provided in this chapter.

(b )(1) Notwithstanding any other provision of law, the legislative body of a local agency may use teleconferencing for the benefit of the public and the legislative body of a local agency in . connection with any meeting or proceeding authorized by law. The teleconferenced meeting or proceeding shall comply with all requirements of this chapter and all otherwise applicable provisions of law relating to a specific type of meeting or proceeding. ·

(2) Teleconferencing, as authorized by this section, may be used for all purposes. in connection with any meeting within the subject matter jurisdiction of the legislative body. All votes taken during a teleconferenced meeting shall be by rollcall.

(3) If the legislative body of a local agency elects to use teleconferencing, it shall post agendas at all teleconference locations and conduct teleconference meetings in a manner that protects the statutory and constitutional rights of the parties or the public appearing before the legislative body of a local agency. Each teleconference location shall be identified in the notice and agenda of the meeting or proceeding, and each teleconference location shall be accessible to the public. During the teleconference, at least a quorum of the members of the legislative body shall participate from locations within the boundaries of the territory over which the local agency exercises jurisdiction, except as provided in subdivision ( d). The agenda shall provide an opportunity for members of the public to address the legislative body directly pursuant to Section 54954.3 at each teleconference location.

( 4) For the purposes of this section, "teleconference" means a meeting of a legislative body, the members of which are in different locations, connected by electronic means, through either audio or video, or both. Nothing in this section shall prohibit a local agency from providing the public with additional teleconference locations.

Complaint and Request for Hearing: Unlawful Library Commission Meeting Monday, October 14, 2013 9:52:47 PM

Dear Sunshine Ordinance Task Force, and Administrator:

According to information that recently became available to Library Users Association, the Library Commission recently held an unlawful meeting at which the body took an action, in violation of a number of Open Government concepts and Sunshine Ordinance provisions.

In response to our Immediate Disclosure Request of I 0-9-13, we received a response from the Library's Acting Chief, Communications, Programs & Partnerships -- Michelie Jeffers.

In an e-mail to a San Francisco Bay Guardian reporter who was working on a story to be published the following Wednesday, Ms. Jeffers sent an email on Friday, October 4, 2013 at 2:53pm stating the following:

"Joe,

"The San Francisco Library Commission issued a letter in support of City Librarian Luis Herrera regarding the recent FPPC action. It was suggested that I send this to you so here it is as PDF scan."

The attached letter, on San Francisco Public Library Commission stationery, began as follows:

"The San Francisco Library Commission seeks to publicly affirm its support for San Francisco City Librarian Luis Herrera in regards to the recent stipulation, decision and order pertaining to the filing of statements of economic interest to the Fair Political Practices Commission."

The letter went on for an additional two paragraphs.

The Library Commission had held a regularly-scheduled meeting the day before, Thursday,· October 3, 2013. At this meeting there was no agenda item about the FPPC matter, no. comment from the Commissioners or City Librarian about it, and no action taken regarding this matter -- certainly no letter discussed or approved. There was, however, comment from the public -- abouf the City Librarian's violations of law requiring disclosure of gifts received, and Mr. Herrera's formal acknowledgement of wrongdoing that he signed and the fine that he paid. The acknowledgement and fine had been approved by the FPPC at its meeting in Sacramento September 19, 2013.

This Library Commission meeting, at which the sentiments of this letter were presumably discussed and the letter prepared, failed to meet at least these requirements of the Sunshine Ordinance:

1. 67.5, requiring meetings to be open to the public

2. 67.7 Public Notice requirements, requiring 72 hours notice (67.7(a)) and permitting no action or discussion without proper notice, 67.7( d).

3. 67.15(a) requiring opportunity for public comment on proposed actions.

Library Users Association plans to provide you with copies of the relevant documents and may provide additional information shortly.

We request a prompt public hearing on this matter.

So that's how you think this works? The Library Commission members and Mr. Herrera break the law repeatedly, publicly deny the facts, then just "ask the letter be retracted?"

The letter in question was used in regard to an article the Bay Guardian recently printed entitled: "Friends in the Shadows." The letter, and by extension those who directed you to compose and/or send it, marginalized the fact that City Librarian Luis Herrera repeatedly and continually broke the law for years regarding "gifts" he received from The Friends. This was an ongoing pattern of illegal behavior! He repeatedly swore year after year, under penalty of perjury, that he understood his responsibilities under applicable law. He repeatedly swore year after year, again under penalty of perjury, that he received nothing of value. The idea that you and the Library and the Library Commission seem to be putting forward is that Mr. Herrera is too (insert word here) to understand the requirements of the law regarding "gifts." They also continue to put forward the idea that The Friends get nothing for their "gifts, which is truly laughable in that their very

existence depends on the money they raise in the name of the San Francisco .Pilblic Library: again, more than $53,000,000 between 2000 and 2012. IT IS A MATTER OF FACT AND PUBLIC RECORD THAT LUIS HERRERA IS A SELF-ADl\flTTED PERJURER! The rules for perjury also apply when a person has made a statement under penalty ofperjury, even ifthe person has not been sworn or affirmed as a witness before an appropriate official. Mr. Herrera did so agajn, and again, and again, and again! You and the members of the Library Commission must really believe that Mr. Herrera is a complete idiot, not having any understanding of the things he swore under oath he did understand! That seems to be the argument you and they are putting forward.

Mr. Sutton, in his letter to the FPPC, tried to make this a matter of accepting a "meal!" What pure, unadulterated BULLSHIT! And, before you get all prissy about my use of a word, just think of how insulting you are to members of the Public by violating the law and then asking for, what, a "take-back" or "do-over?" What is this, second grade!

This is a request for copies of all Form 700s filed by Mr. Herrera for the years covered by the FPPC stipulation agreement. These would both original filings and amended filings to cover the years from 2008 through 2010. To simplify everyone's life, please also include any form 700s for 2011 onward, again, both originals and amended filings. I would like those copies in electronic format, by email, by close of business on Thursday, October 17, 2013.

I am deeply disturbed on becoming aware of a letter sent by you the the San Francisco Bay Guardian.

The letter is both dishonest and questionable as to its origin.

It states that Public comments "mischaracterized the nature and severity of the FPPC action." As you are well aware, the same members of the Public have been questioning, literally for years, Mr. Herrera's oversight of the finances of The Friends and the actual benefits accrued by the San Francisco Public Library. We have also been

. questioning the "conflict" between Mr. Herrera accepting gifts which directly and/or indirectly benefited him while failing to make any effort to determine where the $53,000,000 raised by The Friends between 2000 and 2012 has been spent. I have been fighting with Mr. Herrera to produce public records regarding these financial matters for well over two years and have referrals to the San Francisco Board of Supervisors regarding the unlawful withholding. It has also been necessary to petition the Supervisor of Records, Paula J esson, in the City Attorney's Office not once, but twice over a period to years to finally get Mr. Herrera to disgorge public records under his control. Mr. Herrera withheld these records knowing full well he had absolutely no right to do so under the Sunshine Ordiance and/or the California Public Records Act. I have multiple Orders of Determination against both the Library Commission and/or Mr. Herrera finding them to have made repeated and continual efforts to hide their misdeeds.

As a City department head, Mr. Herrera has taken years of training on the Sunshine Ordinance. He has also certified that he is aware of Ethics requirements regardmg the reporting of gifts. In both instances he has signed multiple statements, under penalty of perjury, that he was aware of his responsibilities in these areas. He also signed the three years of Form 700s, again under penalty of perjury, that he received nothing of value which he needed to report. He falsely reported nothing and would have continued to do so without the efforts of those same members of the Public in filing the complaint with the FPPC. The facts are a matter of public record that Mr. Herrera not only failed to report gifts as required by law, he willfully filed statements that he had not received anything of value. Is it your contention that Mr. Herrera is so oblivious to his duties under the law that all of these acknowledgements of his responsibilites, followed by repeated failures to comply with those same laws, are anything but willful? Thomas Acguinas teaches that "willful ignorance of what one ought to know is a mortal sin."

As to the origin of the letter on San Francisco Public Library Commission letterhead, when did the Commission discuss the matter and determine that this letter should be sent to the San Francisco Bay Guardian? Either the Library Commission held an unlawful meeting, at which they authorized this letter, or your sending of the letter was not authorized by the Library Commission. I would like to know which is the case? Either the Library Commission acted unlawfully or you have misrepresented to the media and, by extension the to public, the positions of the members of the Library Commission!

This letter responds to Complaint #1307 4 in which Peter Warfield, Executive Director, of Library Users Association states that the Library Commission issued a letter and held a meeting "at which the sentiments of this letter were presumably discussed and the letter prepared failed to meet at least these requirements of the Sunshine Ordinance 1. 67.5, requiring meetings to be open to the public; 2. 67.7 Public Notice requirements, requiring 72 hours notice (67.7(a)) and permitting no action or discussion without proper notice, 67. 7(d). 3. 67.15(a) requiring opportunity for public comment on proposed actions."

After the Library Commission meeting on Thursday, October 3, 2013, MicheHe Jeffers, Acting Chief Communications, Programs and Partnership was asked by a member of the Library Commission to draft and send a letter from the Library Commission seeking to publicly affirm its support for San Francisco City Librarian Luis Herrera in .regards to the recent stipulation, decision and order pertaining to the filing of statement of economic interest to the Fair Political Practices Commission (FPPC) and recognizing that this was an unintentional reporting error that required the filing of amended . statements. The letter was written and circulated to the Commission members by email on Friday, October 4, 2013 for their comments. The letter was then sent to a reporter at the Bay Guardian who was on deadline for a story he was working on.

Once the Library realized that it had violated Sections of the Sunshine Ordinance, Jeffers immediately sent a letter to the reporter rescinding the letter. She stated in the email "Although the letter accurately reflects the sentiments of the Library Commissioners, I am required to ask that you rescind this letter. .1 note that its contents were not used in your article 'Friends in the Shadows,' dated October 9, 2013 in the San Francisco Bay Guardian. It has come to my attention that the Library Commission did not follow proper procedure in crafting and approving this letter and the letter needs to be officially withdrawn." The letter was not sent to any other recipients.

She stated in the email "Although the letter accurately reflects the sentiments of the Library Commissioners, I am required to ask that you rescind this letter. I note that its contents were not used in your article 'Friends in the Shadows,' dated October 9, 2013 in the San Francisco Bay Guardian. It has come to my attention that the Library Commission did not follow proper procedure in crafting and approving this letter-and the letter needs to be officially withdrawn." The letter was not sent to any other recipients.

3. File No. 13077: Complaint filed by Victor Bumanglag, against Valerie Wong, San Francisco Public Utilities Commission, for allegedly violating Sunshine Ordinance Sections 67.21, 67.24, 67.25, 67.26, and 67. 7 for failure to respond-to a request for information dated May 23, 2013.

4. File No. 13082: Complaint filed by Gonzalo Javier Ferrer, against City Attorney Dennis Herrera and Deputy City Attorney Paula Jesson, City Attorney's Office, for allegedly violating Sunshine Ordinance Sections 67 .21(d) and 67.34 for failure to respond to a request for determination of the status of certain records being public documents or not in a timely manner made on October 13, 2013, and October 20, 2013.

5. File NO. 13091: Complaint filed by Frank Lee, against Jennifer Johnston, Civil Service Commission, for allegedly violating Sunshine Ordinance Sections 67.5 and 67.9, for conducting a closed session hearing in regards to Mr. Lee's appeal on April 1, 2013.
