SUBJECT: Approval and Authority to Amend Independent Living Skills Program (lLSP) Services contract with Robert Jemerson.

RECOMMENDATION:

It is recommended that your Board:

I. Approve and authorize the President of the Board of Supervisors to execute a funding augmentation to the current standard agreement, (Procurement #1548, PO #9160) with Robert Jemerson (Principal: Robert Jemerson, Location: Oakland), increasing the contract amoWlt from $2,912,000 to $3,162,000 (a funding increase of $250,000 ­increasing the contract to $686,000 for FY 2010-20 II and to $736,000 for FY 2011­2012) for the period of July 1, 2007 through June 30, 2012 for enhanced ILSP Emancipation Training and Support Services; and

2. Approve an increase in FY 2010-2011 appropriation in the amount of $100,000 as detailed in the attached Financial Recommendation.

SUMMARY/DISCUSSION:

Tllis letter requests action by your Board for approval and authority to amend the current standard services agreement with Robert Jemerson for a funding increase in the amount of $250,000 for the continued and enhanced services and training for current and former foster youth in preparation for independent living. The Social Services Agency's (SSA), Department of Children & Family Services is federally mandated to provide life skills training services to foster youth prior to their emancipating from the child welfare system. While State and Federal funding for ILSP services has declined over the past years, SSA has the opportunity to reinvest savings generated from participation in the Federal Title IV-E Waiver (available through April 2013) demonstration project and therefore is utilizing these funds to improve and expand services for transition-age foster youth.

SSA is recommending these funding increases with Robert Jemerson to expand services by providing more diversified course offerings, such as pregnancy prevention, youth advocacy, sexuaVethnic/cultural identity, expanded transportation services, and staff training. An evaluation component will be built into the expanded services, as well as an oversight committee.

SELECTION CRITERIAIPROCESS:

Your Board originally approved the results and recommended award from the FY 2006-2007 ILSF Emancipation Training and Support Services Request Jor Proposal (RFP) (July 18. 2006, File #20772) project and related authorization ojthe services agreement with Robert Jemerson. Subsequently, your Board approved renewal oj the services agreement Jor FY 2007-2008 (July 24, 2007, File #20772) and again on June 10, 2008 (File #23535-63). The current term oj the award was approved and authorized Jor extension by your Board on June 29, 2010 (File No. 26298~2) Jor FY 2010-2011 and FY 2011-2012.

FINANCING:

The requested FY 20104 2011 contract increase of $100,000 will be funded with Federal and State Title IV-E Waiver revenue (71%) and with Title IV-E Waiver FMR (29%) generated from waiver savings occurring in Fiscal Years 2007-2008, 2008-2009 and 2009-2010. Similar financing will fund the FY 2011~2012 increase. No net county cost will result from your approval of this contract.

THIRD AMENDMENT TO AGREEMENT

This Third Amendment to Agreement ("Third Amendment") is made by the County of

Alameda ("County") and Robert Jemerson, ("Contractor") with respect to that certain

agreement entered by them on July 1,2007 and that certain Third Amendment to Contract,

(collectively referred to herein as the "Contract") pursuant to which Contractor provides

Independent Living Skills Program (lLSP) services to COWlty.

County and Contractor agree as follows:

1) For valuable consideration, the receipt and sufficiency of which are hereby

acknowledged, County and Contractor agree to amend the Agreement in the following

respects:

• Increase the contract amount by an additional $250,000:

$686,000 (a $100,000 increase for FY 2010-2011)

$736,000 (a $150,000 increase for FY 2011-2012)

• See attached revised Exhibit A - Scope of Work

• See attached revised Exhibit B - Budget.

2) Except as otherwise stated in this Third Amendment, the terms and provisions of this

Amendment will be considered to be effective as of the date this Third Amendment is

executed by the County October 1,2010.

3) The term of the Agreement is cUlTently scheduled to expire on June 30, 2012. In

consideration for Contractor's additional services, the County shall pay Contractor in an

amount not to exceed two million nine hundred twelve dollars ($2,912,000). As a

result of these additional services the not to exceed amount has increased from two

million nine hundred twelve dollars ($2,912,000) to three million one hundred sixty­

two dollars ($3,162,000) over the term of the Agreement.

The amended allocations per fiscal year are;

FY 2010-20 II $686,000 (an increase of $1 00,000)

FY 2011-2012 $736,000 (an increase of $150,000)

Exhibits A and B have modifications that reflect the extended terms of the contract, dates

thereof and revised service agreement. (See amended Exhibits A-I and B-1 attached)

4) DEBARMENT AND SUSPENSION CERTIFICATION:

a. By signing this Second Amendment and Exhibit D, Debannent and Suspension

Certification, Contractor/Grantee agrees to comply with applicable federal

suspension and debarment regulations, including but not limited to 7 Code of

Federal Regulations (CFR) 3016.35, 28 CFR 66.35, 29 CFR 97.35, 34 CFR 80.35,

45 CFR 92.35 and Executive Order 12549.

b. By signing this agreement, Contractor certifies to the best of its knowledge and

belief, that it and its principles:

1. Are not presently debarred, suspended, proposed for debarment, declared

ineligible, or voluntary excluded by any federal department or agency;

2. Shall not knowingly enter into any covered transaction with a person who

is proposed for debarment under federal regulations, debarred, suspended,

declared ineligible, or voluntarily excluded from participation in such

transaction.

5) SMALL LOCAL AND EMERGING BUSINESS PARTICIPATION: Contractor shaJl sube:ontract with (N/A), for services to be provided under this Agreement in an amount of at least twenty percent (20%) of the contract value oftms Agreement in accordance with County's Small and Emerging Local Business provision.

Participation of a small and/or emerging local business must be maintained for the tenn of this contract. Contractor shall not substitute the small and/or emerging local businesses) listed in this agreement without prior written approval from the County. County will be under no obligation to pay contractor for the percent committed to a small and/or local business if the work is not perfonned or not perfonned by the listed small and/or emerging local business. Said requests to substitute a small and/or emerging local business shall be submitted in writing to the County Purchasing Department, ATTN: Purchasing Manager, 1401 Lakeside Drive, 9th Floor, Oakland, CA 94612.

Contractor shall provide SLEB utilization reports when invoicing the County utilizing the Alameda County Compliance System. Contractor and Contractor's small and/or emerging local businesses participating as subcontractors on the awarded contract are required to use the County webwbased compliance system as described in Exhibit E (Contract

THIRD AMENDMENT EXHIBIT A-I - DEFINITION OF SERVICE

PROGRAM DESCRIPTION

Goal: Diversify course offerings and fill content gaps in the curriculum Resource Investment: Staff time for planning, research, and oversight; Contractors hours for expert implementation in certain content areas; Course materials or curriculum licenses as needed. Implementation Recommendations:

• Expand hours of current ILSP staff or hire MSW Intern to manage course expansion

process.

• Develop selection criteria and detennine content areas for enhancement from list

developed by case managers, youth and foster care experts. (See Appendix I)

• Select a pregnancy prevention module from the short list developed by FYA. (See

Appendix 2)

• Further develop concept of "Youth Self-Advocacy" in consultation with YAP and FYA.

Plan experimentation with curriculum elements on self~awareness, cultural, ethnic and

• Engage current ILSP staff in professional development and training on learning styles and

training methods.

• Hire new staff or contract trainers with expertise in different training techniques and

• Identify ways of restructuring staff to increase youth support. For example, utilize

teaching assistants in larger classes, and hire specialists to serve a role similar to high

school guidance counselors.

• Identify methods for decreasing class size, such as splitting classes to alternate in-class

and in-field activities.

• Evaluate compensation to increase retention of staff and contracted trainers.

• Convert courses or add courses/activities that involve experiential learning such as field

trips and practice certain skills introduced in the classroom.

• Add a mentoring component by developing referral pathways or contracting with a community organization providing mentoring services (Strive For, Be a Mentor).

• Create opportunities for youth to showcase progress and work, such as a mid-year open

house.

Develop Training Program Structure:

Goal: Systematize and publicize diversified course offerings and tracks; refresh and develop credit system to include accommodation of different learning styles and needs.

Resource Investment: Staff time for planning, coordination, and implementation

Implementation Recommendations:

• Increase hours of existing staff or hire contracted staff to systematize training program.

Partner with FYA to provide initial support on hiring/retaining intern support.

• Develop a menu of course offerings and activities, including descriptions to use as a

"creative and clever" marketing messages, and schedule.

• Develop a system of credits and "tracks" to allow youth with different needs to pursue the

knowledge and skills they need. For example, organize by skill level: beginner,

intermediate, advanced.

• Develop a course schedule that allows youth with different schedules to take necessary

courses when they are available to do so.

• Provide ILSP orientation in the morning and evening and develop an online orientation to

increase accessibility.

• Develop alternative learning opportunities whereby youth can eam credit through work

opportunities or living skills activities with other organizations.

• Formalize incentive structure that coordinates with credits to promote an equal

distri bution 0 f incentives and benefi ts.

• Compile all course curricula and materials and make publicly available in paper and

online.

CONTRACT PAYMENT TERMS

Contracted Service: Emancipation Training and Support Services:

1. COUNTY will pay CONTRACTOR monthly, upon submission of a completed

statement every month services are performed pursuant to this Agreement. Invoices will

be approved by the ILSP Unit Supervisor and certified by the Program Manger. Payment

under the terms of this Agreement shall not exceed the total amount of $686,000 for the

period of the contract.

2. The term of this Agreement is July 1,2010 through June 30, 2011.

Appendix 2 - Selected List of Evidence Based Pregnancy Prevention and Self­

Advocacy Programs

In fiscal year (FY) 2010 appropriations, Congress funded the President's proposed new

Teen Pregnancy Prevention fnitiative. Under contract with the Department of Health and

Human Services (HHS), Mathematical Policy Research conducted an independent

systematic review of the evidence base for programs to prevent teen pregnancy. In total,

28 programs met the funding criteria, reflecting a range of programs models and target

populations. FYA used this list as a starting point to select programs that could be

appropriate for implementation at Alameda County ILSP.

The criteria used to select these 6 programs from the 28 chosen as evidence-based were:

1. Age appropriateness - The selected programs have been proven effective for high

school aged youth.

2. Location fit - Each program can be taught in a CBO setting.

3, Set curriculum available for purchase.

4. Training of Trainers/Staff Support available.

5. Population fit - while some programs are targeted towards males, females,

African Americans, or parenting youth, all programs are relevant for a subsection

of ILSP youth.

It should be noted however, that none of the programs fulfills all the recommendations of the Alameda County Youth Adult Partnership (YAP), nor the member agencies of the Foster Youth Alliance.
