Status

CSC/9/6 Ministry of Petroleum & Natural Gas is implementing

Ethanol Blended Programme for petrol through its Oil

Marketing Companies, as per the Government decisions

taken from time to time. The

Programe was launched in 2003 for supply of 5% ethanol

blended petrol and was extended to the entire country

except the North- Eastern

States, Jammu & Kashmir, Andaman & Nicobar Islands

and Lakshadweep, with effect from 1st November, 2006.

Recently, this Ministry has issued a Gazette Notification

on 2nd January, 2013,

directing Oil Marketing Companies (OMCs) to sell

ethanol blended Petrol with percentage of ethanol upto

10% as per BIS specification

to achieve 5% ethanol blending across the country as

a whole. Accordingly, OMCs are procuring ethanol for

blending with petrol under the EBP Programme by floating

tenders in the open market.

2. However, OMCs have been

facing constraint in inter-state movement of ethanol for the

EBP Programme due to

restrictions imposed by some State Governments on inter-

state movement of Ethanol and/ or refusal to issue

storage and blending licences/ other clearances, taxation

issues etc.

Governments time to time to

simplify procedures and expedite clearances related to

the roll out of the EBP Programme, in order to help

OMCs achieve their targets under the EBP Programme. A

letter was written in May 2011

to the State Governments in the EBP Programme

implementing States to reduce/ rationalize duties,

taxes and other impediments

in the process of supply for the EBP Programme and to bring

uniformity in procedure/ taxation policy in various

States/ UTs on the usage of ethanol. Thereafter, wherever

the problems have arisen

regarding inter-state movement of ethanol in

various States like, Delhi, Gujarat, UP, Bihar, Karnataka

etc., MoPG has followed up the

matter with respective States time to time. In this regard,

this Ministry has written letters to Chief Secretaries of Gujarat

Government and Delhi on 15.11.2011, to Bihar

Government on 12.4.2012, to

Karnataka Government on 31.10.2013 and 19.05.2014

and to UP Government on 25.7.2011.

4. Recently, a letter was also written by AS, MoPNG to Chief

Secretary, UP on 16.05.2014 requesting for restoration of

the method of giving export permissions from quarterly

basis to annual basis for

ethanol supplies for use by OMCs. However, UP

Government has not accepted the proposal, saying that

issuing one time permission on

annual basis does not seem suitable as verification of the

import permits/ NOC received from importing State, is

necessary for keeping check on the exit of ethanol from

State on fake permits, which

may be used for making illegal liquor which may cause loss of

human life.Under Implementation

Against the import order of Ethanol made

by different States, export order is being issued as per the demand made therein

with export fee of the Rs. 0.50 per Bulk

AS ON NOV 12 2014 5:11PM : The demand

of the sugar mill Association is that they

should be exempted from verification of NOC obtained from exporter state and

they should be allowed to lift or export the

whole quota on annual basis so that the

supply of the ethanol may not be delayed.

According to the comments given by the Excise Commissioner to prevent the

misuse of the NOC obtained by the sugar

mills from the Importer state, the

verification of the NOC is necessary. If the

NOC is not verified the Fraudulent lifting may take place and ethanol can be used in

making of illicit Liquor causing harm to the

people. Petroleum depose are allotted

Annual quota in the state and they lift

their quota from distilleries at the time when they need.

Thus exemption from verification of NOC

and allowing the sugar mills is not

justified. Accordingly Ministry of Petroleum

and Natural Gas, Government of India, has been informed vide U.P. Govt. Letter dated

04 July 2014No further Action Required

15.54 Crs.

Signing of BPSA: Bihar is not signing the Bulk Power

Supply Agreement for the power stations from whom it is

drawing the power.

Presently SBPDCL is under regulation due to non-

payment of outstanding dues & non opening of LC of

requisite value.

Control Societies (SACS) works with vulnerable populations for

prevention and control of HIV. NACO releases funds to State

Treasury for onward release to

SACS.

Co-operation is needed from State Treasury to ensure

timely release of funds to

SACS. However there is delay in release of funds by State

Treasury.

This delay hampers the implementation of key

prevention activities potentially

posing a risk to the control of HIV.

To state an example, NACO released funds in June 2014 to

all the SACS but states like

Bihar and Jharkhand have not received funds from the

respective State Treasury till date. Other states like

Arunachal Pradesh, Assam, Chhattisgarh, Haryana,

Manipur, Rajasthan and Tamil

Punjab was released by DAC (Govt. of

India) during June 2014 as first Installment for Punjab SACS. These funds

Punjab and clearance of bills in treasury in

The second instalment of grant of

Rs.275.92 lakh was sanctioned by NACO

on 16-6-2014 but was communicated to

SACS at the time of sanction of another

grant of Rs.300.00 lakh on 4-8-2014. Against these sanctions Rs.490.00 lakh

were received in the SACS bank account

on 22-10-2014 through treasury.

Till date, a total of Rs.3139.41 lakh has been received by SACS against a total

sanction of Rs.3225.33 lakh by NACO from

the total approved Annual Action Plan

budget allocation of Rs.8953.96 lakhs.

Balance fund of Rs.85.92 lakh is under process and likely to be received soon.

Hence, almost full amount sanctioned by

NACO, till now, has been received.

The time involved is due to the procedure involved after sanction by NACO followed

by Administrative and Finance

Department. Cooperation is being given by

State Treasury. Efforts are being made to

reduce the procedural time lag involved in fund sanction by NACO and fund receipt by

instalment of grant of Rs.2649.41 lakh

sanctioned by NACO on 13-5-2014 was

cleared by RBI on 23-5-2014 against which G.O. by Administrative Department

for release through re-appropriation was

issued on 17-6-2014 and funds were

received in SACS bank account through

treasury on 30-6-2014.

The second instalment of grant of

Rs.275.92 lakh was sanctioned by NACO

on 16-6-2014 but was communicated to

SACS at the time of sanction of another

sanction of Rs.3225.33 lakh by NACO from the total approved Annual Action Plan

budget allocation of Rs.8953.96 lakhs.

Balance fund of Rs.85.92 lakh is under

process and likely to be received soon.

Hence, almost full amount sanctioned by NACO, till now, has been received.

The time involved is due to the procedure

involved after sanction by NACO followed

by Administrative and Finance Department. Cooperation is being given by

State Treasury. Efforts are being made to

reduce the procedural time lag involved in

fund sanction by NACO and fund receipt by UPSACS through State treasury.Implemented

In the present scenario, there has been

tremendous increase in the number of objectionable advertisements published by

print & electronic media, relating to

guaranteed cures for the diseases,

improvement of health & beauty. Because

of the lack of law & insufficient punishment and penalty, the violators have become

the habitual offenders.

At the outset it is pertinent to point out the

following suggestions for the amendment

to be carried out, for the effective enforcement & fruitful outcome, in the

aforesaid Act:-

1.Objectionable advertisements of the

purview of the prohibited advertisements

under sections of THE DRUGS & MAGIC REMEDIES (OBJECTIONABLE

ADVERTISEMENTS) ACT, 1954 since the

misleading & exaggerated advertisements

of the COSMETICS relating to

beautification has been increasing day by day. And hence, apart from the DRUGS &

MAGIC REMEDY the word COSMETICS

must be incorporated under the present

section 2 of THE DRUGS & MAGIC

REMEDIES (OBJECTIONABLE ADVERTISEMENTS) ACT, 1954.

2.Prohibition of the advertisements for the

treatment of diseases, disorders or

conditions mentioned under the Schedule and section 3(d) must be increased in

number, such as advertisements relation

to following diseases, disorders or

conditions must be included under the

Schedule & Section-3(d):- AIDS; HIV,

DE-ADDICTION,

HEPATITIS, JAUNDICE, LIVERS

DISORDERS, BRONCHIAL ASTHMA,

PILES &FISTULAE,

CHANGE OF FOETAL SEX BY DRUGS,

IMPROVEMENT IN SIZE &SHAPE OF THE

SEXUAL ORGAN & ITS DURATION OF SEXUAL PERFORMANCE,

INCREASE IN BRAIN CAPACITY &

MEMORY POWER,

IMPROVEMENT IN EYE SIGHT & VISION

POWER, IMPROVEMENT OF HIGHT, WEIGHT,

UNDER WEIGHT, LEANNESS AND

THINNESS APART FROM OBESITY,

BALDNESS; ALOPECIA, GROWTH OF

NEW HAIR AND PREMATURE GREYING OF HAIR,

FAIRNESS AND TEXTURE OF THE SKIN,

POWER TO REJUVINATE, PREMATURE

AGEING,

PYORRHEA, SENSITIVE TEETH AND IMPROVEMENT IN THE STRENGTH OF THE

NATURAL TEETH ETC.

3. Since the offences under Section 9(A) of

the Drugs & Magic Remedies (Objectionable Advertisement) Act, 1954

are cognizable & hence the existing

punishments six months to one year must

be enhanced for the period from more

than three years and above either in the case of first conviction or in the case of

subsequent convictions respectively, and

must be brought under the purview of

Non-boilable offences. Refer Section 7 & 9

(A) of the DMR(OA) ACT, 1954.

4. The Print & Electronic Media plays the

key role in the publication of the

misleading, vulnerable, exaggerated &

prohibited advertisements & hence the

stringent penalty and tough punishments

must be incorporated in the Amended Act, on conviction against such Publishers and

Advertisement Agencies.

(6) and the Schedule of the Drugs and

magic Remedies (Objectionable

baby food / other food & device should be

separately included.

Clinic, Consultation & treatment should be

brought within the scope of the Act.

No advertisement under this Act shall be made except with the previous sanction of

the State Drugs Control Authority.

All publishers, broadcasters, press &

printers, internet service providers of any offending advertisement and celebrities /

actors or actress endorsing these products

(drugs / article / magic remedies) should

be made culpable.

Schedule under the Drugs & Magic

Remedies Act should be reviewed &

updated in tune of Schedule J of the

Drugs & Cosmetics Rules.

Quantum of punishment should be

enhanced as follows:

i) For the advertiser, 3 to 5 years of

imprisonment and fine of at least Rs. five

lacs for first offence and 5 to 7 years imprisonment and fine of at least Rs. ten

lacs for any subsequent offence.

ii) For the publisher / broadcaster /

Internet Service Provider, 1 to 3 years of imprisonment and fine of at least Rs. three

lacs for first offence and 3 to 5 years

imprisonment and fine of at least Rs. five

lacs for any subsequent offence.

iii) For celebrities / actors endorsing such misleading advertisements, fine of at least

Rs. one lac for first offence and

imprisonment of 1 to 2 years and fine of at

least Rs. one lac for any subsequent

CSC/46/4 1839 Km Eastern Dedicated Freight Corridor (EDFC)

extending from Dankuni in

West Bengal to Ludhiana in Punjab, a mega infrastructure

project is being implemented by Dedicated Freight corridor

Corporation of India Ltd. (DFCCIL), a PSU of Ministry of

Railways. 66 Km section of

EDFC between Durgawati to New Karwandiya in Bihar

which was targeted for commissioning in March, 2014

has got delayed mainly due to

land acquisition difficulties.All the Civil works in Durgawati

to New Karwandiya section have already been completed

in the entire stretch of 66 Km,

except in a few small stretches in Rohtas and Kaimur Districts

where land could not be acquired as the Project

Affected Persons (PAPs) have not accepted the award by the

Arbitrator. In Rohtas District,

300 meter land is not available for formation work in Basa

Village, 700 metre land is not available in Dhanpurwa village

and a temple on the alignment

near Sasaram Railway Station needs to be shifted. The

matter is being pursued regularly by Chief Project

Manager/Mughalsarai and other DFCCIL officials with the

District Magistrates and other

State Government officials of Rohtas and Kaimur Districts.

In addition to above, near Bhabhua Road Railway Station,

the NH-30 is crossing the

existing Railway Track and a new wider Road Over Bridge

(ROB) is required to be constructed to enable two DFC

tracks to pass through the ROB, as existing ROB is too

narrow to pass these DFC

tracks. In this regard, an agreement was reached with

Bihar State Road Development Corporation Ltd (BSRDC) that

the new ROB over IR & DFC

approach earthwork for the new ROB has not been started

so far. Only after completion of

this new ROB, the old ROB can be dismantled, enabling laying

of DFC tracks. Being a key infrastructure

project for the country, its progress is being critically

monitored at the highest level.

A request DO letter in this

regard has been written by Chairman Railway Board to

Bihar, Patna vide letter dated

10-07-2008. The proposal was considered by the Approval

Committee of Ministry of Food Processing Industries which

met on 31-10-2008 and the Committee approved financial

assistance of Rs.1097.21 lakhs

for the project subject to the standard conditions/guidelines

of the scheme. The approval letter in this regard was issued

by the Ministry vide letter

dated 14-11-2008. Thereafter the first installment of the

grant-in- aid amounting to Rs. 109.72 lakhs was released to

the Patna Municipal Corporation vide sanction

letter dated 27-03-2009. The

project was to be established and run by Patna Municipal

Corporation. Thereafter i.e. after 27-03-2009, a number of

D.O. letters were issued at the

level of the Joint Secretary, MoFPI to the Principal

Secretary (UD&HD), Government of Bihar and at

the level of Secretary, MoFPI to the Chief Secretary,

Government of Bihar regarding

delay in execution of the project. In spite of the

repeated reminders, the project continued to suffer

delay and there was no head

way in executing the same. Subsequently, it was intimated

by the State government on 19-10-2012 that

implementation of the project had been transferred to Bihar

Urban Infrastructure

Development Corporation Limited (BUIDCO) as the

project implementation agency. Again the State

Government was requested by

the Ministry to decide whether they were inclined to

implement the project in question in accordance with

the scheme guidelines or else refund the amount of financial

assistance already provided to

the Government of Bihar. Subsequently a D.O. letter

dated 03-03-2014 was sent from Secretary, MoFPI to

Secretary (UD&HD),

Government of Bihar wherein the Government of Bihar was

informed that if they decided that land for the project will

not be given by the Municipal

Corporation and if the project is to be implemented purely as

a private sector project then the amount already released

by the Ministry may be

refunded. There has been no

response to any of these letters from the State

Government nor has any officer from the state

government/Patna Municipal Corporation/BUIDCO

participated in any of the

review meetings convened by the Ministry, the latest

meeting held on 20-08-2014. There was a chronology of

events submitted by BUIDCO

in May, 2014 but this also did not give any clear status of the

progress of the abattoir project. Joint Secretary, MoFPI

visited Patna on 19th and 20th September, 2014 and met the

Principal Secretary (Industry)

and Secretary (UD), Government of Bihar regarding

status of MoFPI assisted abattoir project. Secretary

(UD), Government of Bihar

explained that the state government is committed to

implementing the project on PPP basis through BUIDCO. He

also informed that land has been earmarked for the

abattoir project, approval of

state cabinet has been obtained for the project and

that PPP partner has been selected as per State

Government guidelines on PPP

projects. Secretary (UD) was requested to send a detailed

reply intimating the progress in implementing the project

formally to the Ministry. This letter is awaited.

Units (MRUs) in State Government Medical Colleges:

The objective of the scheme is

to create dedicated infrastructure in the State

Government Medical Colleges to encourage them to

during the 12th Plan period. State has 9 medical colleges.

inclusion of state of Bihar under Foot and

Mouth Disease Control Programme (FMD-

CP), the Director, Animal Husbandry, Govt. of Bihar alongwith two officials of the

department had a meeting with officials of

Department of Animal Husbandry, Dairying

and Fisheries, Govt. of India on 12-09-

2014 at Krishi Bhawan, New Delhi. During the meeting the details about the

preparedness of the state in terms of

infrastructure available with veterinary

institutes at district/block/field level to

implement the FMD-CP in the state was presented by the Director (AH), Bihar.

Since the district-wise final data of 19th

Livestock census has not been made

available by the Govt. of India, the

district-wise requirement of vaccine dose and other items has been calculated on the

basis of provisional data.

During the aforesaid meeting Director

(AH), Bihar was instructed to re-assess the available infrastructure and inform the

department dates for carrying out

vaccination of eligible cattle and buffalo

population in the state alongwith action

plan for seeking funds for carrying out vaccination as per scheme norms.

The Department of Animal and Fisheries

Resources, Govt. of Bihar has been

intimated about the decision of the Govt.

of India to include State of Bihar under FMD-CP in 2014-15 vide letter F.No. 53-

51/2011-LDT (LH) dt. 25-09-2014.

Detailed action plan alongwith fund

requirement (Rs. 1340.00 lakh) for proper

implementation of FMD-CP in Bihar has been submitted to the Govt. of India vide

letter no. 2328 (Ni) dated 17-10-2014, but

we are yet to receive any fund from Govt.

of India for execution of the same.

Apart from FMD-CP, proposals for PPR-CP and Brucellosis-CP has also been sent to

the Govt. of India vide letter no. 2329 (Ni)

dated 17-10-2014 and letter no. 2330 (Ni)

dated 17-10-2014, respectively.Under Implementation
