( 3 ) Forced outages are a l l nonscheduled losses of generation or transmission which require subs t i tu te power f o r a continuous period in excess o f s i x ( 6 ) hours. Where forced outages are n o t as a r e su l t of faul ty equipment, faul ty manufacture, f au l ty design, faul ty in s t a l l a t ions , faulty operation, o r faul ty maintenance, b u t are Acts o f God, r i o t , insurrection o r acts o f the public enemy, then the u t i l i t y m.y , upon proper showing, with the approval o f the commission, include the fuel cost o f subs t i tu te energy in the adjustnient.

Sales ( S ) shall be a l l KIs/t.l's sold, excluding intersystein sales. Where, for any reason, bi l led system sales cannot be coordinated with fuel costs fo r the b i l l ing p e r i o d , s a l e s may be equated t o the sum of ( i ) generatioti, ( i i ) purchases, ( i i i ) interchange i n , less ( i v ) energy associated wi t l i pumped storage operations, less ( v ) intersystem sales referred to i n subsection ( 2 ) ( d ) above, less ( v i ) to ta l system losses, o f s a l c s (S).

The cost o f fossi l fuel shall include no itenis other t h a n the invoice price o f fuel less any cash or o t h e r discounts. I The Company i n s t a l l s f a c i l i t i e s t v supply power t o t h e Customer a t ox near un i ty puwer f a c t o r . The Company expec ts Customer t o use apparatus which s h a l l r e s u l t i n a power f a c t o r near u n i t y . However, t h e Company

w i l l permit t h e use of apparatus which s h a l l r e s u l t , dur ing normal opera t ion , i n a power f a c t o r n o t lower than 90% e i t h e r lagging o r lead ing .

Where t h e Customer's power f a c t o r i s l e s s than 90% t h e Company reserves t h e r i g h t t o r e q u i r e t h e Customer t o fur - n i s h , a t h i s own expense, s u i t a b l e c o r r e c t i v e equipment t o main ta in a power f a c t o r of 90% o r h igher . A t t h e Company's op t ion , i n l i e u of Customer providing t h e above c o r r e c t i v e equipment, t h e Company may a d j u s t t h e maximum measured load f o r b i l l i n g purposes when power f a c t o r is less than 90%, i n accordance wi th t h e fo l lowlng iormula: (BASED ON POWER FACTOR MEASURED AT TIME OF MAXIMIJM LOAD)

Company w i l l n o t b e r e q u i r e d t o measure power f a c t o r more o f t e n than once a year bu t w i l l do s o i f t h e r e i s a m a t e r i a l o r permanent change i n Customer's load. However, t h e Company reserves t h e r i g h t t o i n s t a l l (1) a KVA meter and base t h e b i l l i n g KW on t h e measured KVA times 90%, o r (2) metering equipment of a type whereby power f a c t o r can be determined f o r use i n t h e above formula.

DEPOSIT The Company w i l l have t h e r i g h t t o r e q u i r e t h e Customer t o make and maintain a reasonable d e p o s i t t o s e c u r e t h e

prompt payment of b i l l s . A d e p o s i t w i l l normally b e requi red p r i o r t o s e r v i c e being rendered. The Company reserves t h e r i g h t t o r e q u i r e an i n c r e a s e i n d e p o s i t from an e x i s t i n g Customer. Any p o r t i o n of such d e p o s i t n o t appl ied t o payment of b i l l s w i l l be refunded when t h e Customer d iscont inues service. on t h i s d e p o s i t w i l l be paid a t t h e rate of 6% p e r annum. I n t e r e s t s h a l l be payable annual ly upon demand of t h e Customer, o r upon t h e r e t u r n of t h e depos i t .

BILLING FOR SERVICE (a) A l l b i l l s w i l l be based upon c o n s e c u t i w meter readings made i n accordance wi th t h e Company's meter reading

schedule , n e a r l y as p r a c t i c a b l e every 60 days f o r bi-monthly b i l l i n g o r as otherwise s p e c i f i e d .

Where charges p e r k i l o w a t t hour are s t a t e d f o r a s p e c i f i e d number of k i lowat t hours suppl ied i n t h e month, such number of k i l o w a t t hours s h a l l be doubled when computing bi-monthly h i l l s , and i n computing bi-monthly minimums both t h e k i l o w a t t hours a v a i l a b l e under t h e schedule and t h e monthly minimum charge s h a l l be doubled.

Where a Customer is b i l l e d bi-monthly and d e s i r e s t o make monthly payments, t h e Company w i l l accept budget payments f o r such purpose. Such budget payments w i l l be c r e d i t e d t o t h e Customer's account.

(b) The Company has a budget payment p lan a v a i l a b l e f o r i t s r e s i d e n t i a l Customers whereby a Customer may elect to pay a monthly amount f o r t h e budget year i n l i e u of monthly o r bi-monthly b i l l i n g s f o r a c t u a l usage. The monthly budget payment w i l l be determined by t h e Company based, under normal c i rcumstances, on a minimum of one-twelf th of t h e 12 months prev ious usage, s u b j e c t t o review and adjustment dur ing t h e budget year . Special Rules For Electric Service

R U L E S P E R T A I N I N G TO MULTI-SERVICE INSTALLATIONS

If a customer has need for a three-phase power service and a single phase lighting or x-ray serv- ice at the same TRAHSFORMER B A N K LOCATION these serv ices may be metered through two secondary meters or one primary meter. If the service i s metered through one primary meter, and if the company owns any of the transformers, the service i s to be billed on a secondary voltage rate.*

When two or more T R A N S F O R M E R LOCATIONS are required, either single phase ar three-phase, three methods may be used to provide t h i s service.

METHOD I : Secondary Rate - Secondary Metering If the customer requires service in more than one location and requests the company to

furnish service at each location a separate meter and contract will be required for each serv ice , each of these services to be billed on the rate applicable.

If the curtonier requires service in more than one location, the company will f u r n i s h the transformers (single or three-phase) for one location. 1. Residential rates are based oii service to single family units and ere not applicable to m u l t i - family dwellings served through a single meter. Where two or more families occupy a residential building the Company will rcquire, a s a condition precedent to the application of the residential rate, that the wiring in the building b e so arranged a s to permit each family to be served through a separate meter. I n those c a s e s where s u c h segregation of wiiing wouId involve undue expense to the customer, the Company w i l l allow service to two or more families to he talien through oiic meter, but in this event the energy blocks and minimum b i l l s of the applicable residential rate sha l l be multiplicd by the number of families t h u s served, such number of families to be determined on the bas i s of the number of kitchens in the building. A t the customer’s option, i n lieu of the [oregoing, electric service rendered to a multi-family residential building :hrouy,h a single meter will he classified a s commercial and billed on t h e bas i s of service to one customer under a general service rate applicable.

2. Family u n i t service shall include usage of e lec t t ic energy customarily incidental to home occupations, such ;IS the office of a physician, surgeon, dcntist , musician 01 artist when such occupa- tion is carried on by the customer i n his residence.

Water heaters to be e l ig ib l e f o r service under “of- peak” e l e c t r i c water heating r a t e s , must conform t o the

spec i f ica t ions set for th below. Any water heater i n s t a l l ed which does not conform t o these spec i f ica t ions will be

b i l l ed under the r a t e applicable to other e l e c t r i c service at the premises.

1. Any automatic storage type, thermally insulated e l e c t r i c water heater of not less than 40 gallon capacity,

provided the design, s i z e of elements and method of operation is approved by the Company.

2 . Water heaters s h a l l be equipped with two heating elements; the upper element placed a t approximately one-

quarter of the tank’s capacity from the top; the bottom element t o heat the lower three-quarters of the tank’s

capacity; each controlled by a thermostat. Two-element heaters s h a l l be controlled by a double-throw thermostat switch

s o connected tha t only one element can be i n operation a t any one time.

3 . The water heater s h a l l be served a t 240 v o l t s (nominal) through a separate c i r c u i t d i r ec t ly from the serv ice

entrance t o the water heater. No other equipment is t o be connected t o t h i s c i r cu i t .

The wattage fo r upper and lower elements s h a l l be i n accordance with those s e t fo r th below:

Water 1ic:itcrs sha l l be equipped with two heating elements; the upper element placed a t a p - proximately one-quaitcr of the tank’s capacity from the top, the bottom element to heat the lower three- q u a r t e i s of the tank’s capacity; each controlled by a thermostat. Two-element heaters shall be controlled by a double-throw therniostat switch so connected that only one element can be in operation a t any one t i in e .

3. The water licatei shall be served at 240 volts (norninnl) tliiough a separate circuit directly from the service entrance to the water lieatel. No other equipment i s to be connected to t h i s circuii.

4 . The wattage loi upper and lower eleinents sha l l be in accordance w i t h those s e t forth below: Off peal{ w:ltei heateis of 40 gallon tank s i ze and above may have a maximum w;-lttage on the

upper elenient of 4,500 walls. ‘The lower (off peak) clenients may have a i n a x i m u m o l 3,000 watts . A11 other combinations of tank s i z e s and wattages not i n agreement with tlie abovc, installed after this filing, w i l l be hilled undoi the rate applicablc to othci electric service a t tlie premises.

5. Service for watci heating at “off-peak” rakes i s available between t he hours of l0:OO p ” m , and 8:00 a.m., arid sha l l be s u b j e L t to cliaiige from time to time a s the conijxiny’s peak load conditions vary. Energy to w a l e i heateis seived hereunder shall Le available for an aggregate of not less than ten hours pel day.

6. This service for the lower u n i t shall be metered by a spec ia l combination inetei and time switch for all off-pcnlc water heating service. The upper element shall be wired s o that the element may heat at any time and register tliiougli the master meter.

7. The Coiiipany w i l l f t i i i i i s h and maintain both the meter and control equipment. The customer s h a l l provide arid install tlie necessarp wiring and circuit equipment to properly connect tlie watct heater.

1. AVAILABILITY O F SERVICE: (a) This plan is applicable f o r domestic, farm light, rural commercial and single phase power service

on and after Ikcwiiher 1, 1940, to custoniers wlio cannot be adequately or econoniically served f rom the secondary lines of the company’s existing distribution s y s t e m .

(b) Primary l ines, singlc or m u l t i p l e phase, at a nominal voltage of 12,470 volts or less between phase wiics or to nc:utial s h a l l be considered a s a point of origin for l i n e extensions. If s u c h lines a re not available, transmission lines havir?g a nominal voltage between phase wires of not more than 34,500 volts shall be considered as a point of origin for line extensions, provided the load to be contracted for shall be not less than 50 kilowatts.

PLANS FOR TAKING O V E R ClJSTOMER OWNED TAP LINES For Electr ic Service

1. The Conipany will take over, maintain and replace tap lines that were built or paid for and have been maintained by the customer 011 the following basis: (a) The customer to guarantee the Company a m i n i m u i n monthly revenue equivalent to $12.00 per mile

of such tap l i n e to b e taken over for an initial t e r m of five (5) years and for yearly periods there- after until cancelled by either party giving thirty (30) days written notice prior to end of any yearly period.

(b) The customei to give the Company a bill of s a l e to the line and e q u i p m c r l t involved. (c) The customer to give the Company, a t no cost to the Company, a standard easement over the

property traversed by the tap line, together with a reasonable outlet should an extension of the tap line be feasible.

2. The Company may, a t its option, limit the length of customei owned tap lines taken over to one-fourth mile per customer.

3. I n determining the rcvcniie to bc guaranteed by the customer the previous twelve m0nth.s’ actual pay- ments lor service, rxclutline taxes, sha l l be used as a guide, except that where additional equipment has been recently installed these changes will be given d u e consideration in determining the future use and m i n i m u m nionthly revenue to be guaranteed.

I . I n some instances the s i z e or value of a home, or t h e probable stabil i ty of a business offers evidence that i t would be good business Ioi the Company to ovin the tap line necessary for electric scivice. These factors are often better evidence of security than a signature guaranteeing a monthly minimum foi five peais.

I n such special ca ses the followinp, plan may be used: The Company w i l l take over customer owned t a p l ine, without requiring a higher minimum than i s specified i n the rate schedule applicable, piovided: (a) The custoiiier’s use i n kilowatt-hours and billing lor a pcriod of the past five years has been

i n excess of thc m i n i m u i n requirements a s set out in the “Take Over” plan, and (b) The line i s not i n excess of % mile in length per customer, and (c) The s i z e or value of the home or business served and the piobable stability of t h e load ica-

5. \\’here the revenue from customer owned t a p line or other conditions d o not coinply with the above requirements, none of such tap line will be taken over by the company but sha l l temain the pioperty of the customer, who will continue to own and maintain the line i n good serviceable condition. It being the policy for the company to take over a l l or none of the tap line involved.

6. Tap lines not talten over at t h i s time w i l l be taken over, in the future, a s increased use indicates compliance wi th the above provisions.

CONDITIONS OF SERVICE

1. DURATION: Service s h a l l be from dusk t o dawn, automatical ly cont ro l led , approximately 4,000 hours per year . 2. STANDARD OVERHEAD SYSTIIEf: Street l i g h t i n g equlpnlent furnished under the Standard Overhead Rate s h a l l cons is t

of wood poles , brackets , appropriate f i x t u r e s f o r the lamps being used, the necessary overhead street l i g h t i n g c i r c u i t , p r o t e c t i v e equipment, cont ro ls and t ransformers . The Company w i l l i n s t a l l , own, opera te and maintain the e n t i r e s t r e e t l i g h t i n g system, including c i r c u i t s , l i g h t i n g f i x t u r e s and lamp replacements. The Customer s h a l l pay t h e Standard Overhead Rate.

3 . ORIiAlBNTAL OVERHEAD SYSTEM: The Company w i l l , upon reques t , f u r n i s h under the Ornamental Overhead Rate, ornamental po le s of t h e Company's choosing, together with overhead wir ing and provis ions mentioned i n 2 above. The Customer w i l l pay the Ornamental Overhead Rate.

4. OTHER 'THAN CONVENTIONAL OVERHEAD SYSTi%SS: Should the Customer requi re , e i t h e r i n i t i a l l y o r upon replacement, a system o r equipment other than t h a t clescribed i n 2 o r 3 above f o r lamp s i z e s a s provided here in , ( t h i s const i - t u t i n g a conventional overhead system) t h e Customer may make a non-refundable cont r ibu t ion t o the Company equal t o t h e d i f f e r e n c e i n the i n s t a l l e d cos t between the system o r equipment so required and the c o s t of a conventional overhead system a s hereinbefore def ined. FUEL ADJUSTMENT CLAIJSE

(1) The charge per KWH delivered under the rate schedules to which this fuel clause is applicable shall be increased or decreased during each month in accordance with the following formula:

where: “F’ is the expense of fossil fuel and “S” is the KWH sales in the base (b) and current (m) periods as defined in 8017 KAR 5:056E , all as set out below.

(2) Fuel costs (F) shall be the most recent actual monthly cost of: (a) Fossil fuel consumed in the utility’s own plants, plus the cost of fuel which would have been used in plants suffering

forced generation or transmission outages, but less the cost of fuel related to substitute generation, plus (b) The actual identifiable fossil and nuclear fuel costs associated with energy purchased for reasons other than

identified in paragraph (c) below, but excluding the cost of fuel related to purchases to substitute the forced outages, plus

(c) The net energy cost of energy purchases, exclusive of capacity or demand charges (Irrespective of the designation assigned to such transaction) when such energy is purchased on an economic dispatch basis. Included therein may be such costs as the charges for economy energy purchases and the charges as a result of schedule outage, all such kinds of energy being purchased by the buyer to substitute for its own higher cost energy; and less

(d) The cost of fossil fuel recovered through intersystem sales including the fuel costs related to economy energy sales and other energy sold on a n economic dispatch basis.

(e) All fuel costs shall be based on weighted average inventory costing.

(3) Forced outages are all nonscheduled losses of generation or transmission which require substitute power for a continuous period in excess of six (6) hours. Where forced outages are not as a result of faulty equipment, faulty manufacture, faulty design, faulty installations, faulty operation, or faulty maintenance, but are Acts of God, riot, insurrection or acts of the publicenemy, then the utility may, upon proper showing, with the approval of the commission. include the fuel cost of substitute energy in the adjustment. IJntil such approval is obtained, in making the calculations of fuel cost (F) in subsection (2) (a) and (b) above, the forced outage costs to besubtracted shall be no less than the fuel cost related to the lost generation.

( 4 ) Sales (S) shall be all KWH’s sold, excluding intersystem sales. Where, for any reason, billed system sales cannot be coordinated with fuel costs for the billing period, sales may be equated to the sum of ( i ) generation, (ii) purcha interchange in, less (iv) energy associated with pumped storage operations, less (v) intersystem sales referred to in subsection (2) (d) above, less (vi) total system losses. Utility used energy shall not be excluded in the determination of sales 6).

(5) The cost of fossil fuel shall include no items other than the invoice price of fuel less any cash or other discounts. The invoice price of fuel includes the cost of the fuel itself and necessary charges for transportation of the fuel from the point of acquisition to the unloading point, as listed in Account 131 of FERC IJniform System of Accounts for Public Utilities and Licensees.
