Kevin Sawatsky, 15092 - 70A Avenue, was present to advise he was not approved in principle but didhave some concerns with this application. Mr. Sawatsky stated that he is the home owner that would beaffected the most by the development. His concerns are with respect to construction vehicles not beingallowed to access the site from 70A Avenue. He is concerned regarding a safety risk. Mr. Sawatskystated that 70A Avenue should be upgraded to a proper two lanes with sidewalks. He advised thatanother concern is that a construction trailer has been installed in which a person is living with noservices. He commented that children are afraid to play on the street due to the person living in thetrailer. Mr. Sawatsky concluded by requesting that no trailers in which individuals could live in beallowed on the site.

Councillor Higginbotham left the Public Hearing at 7:05 p.m.

Doris Corrigan, 5957 - 126 Street, was present to speak in opposition to the proposed rezoning. She isconcerned regarding the fact that they are surrounded by busy streets, and believes the traffic problemwill be aggravated. She noted she is also concerned regarding blacktop and the water flow. Sheadvised she would like to see more greenspace and expressed concern regarding the wildlife in thegreenspace.

Marie Cooper 5937 - 124A Street was present to comment on the proposed rezoning. She stated she hasbeen a resident of the area for 30 years. She is concerned regarding traffic congestion and access to thesub-division. Ms. Cooper requested to know where the access to the proposed subdivision is going tobe.

The Engineer advised that future developments will provide access to the subdivision. He noted that 127Street will be dedicated by a future sub-division.

Ms. Cooper requested that the tree by-law be enforced.

Narinder S. Gill expressed an opinion in writing stating that he is in favor of the proposal.

Bob Tinselly, #19, 6950 - 120 Street, Chairman of Cougar Creek Strata Council, was in attendance tospeak in opposition to the proposal. He presented a petition with 56 names expressing opposition to theproposal to Council.

It was Moved by Councillor Higginbotham Seconded by Councillor Watts That the petition with 56 names expressing opposition be received.

RES.R97-2043 Carried

Mr. Tinselly explained the petition. He noted that all 43 owners in Cougar Creek are opposed to therezoning. He stated that owners thought that the third subdivision was going to be a separate strata. Henoted their concerns are visitor parking and traffic. Mr. Tinselly stated the strata owners were told thatboth starts would carry their own budgets. He noted that the owners of strata lots 1 to 56 are listed asthe applicant, which he believes is misleading. He requested the proposal be rejected.

In response to questions from Council, Mr. Tinselly stated the strata is in favor of the 61 units but notthe 70 units. He noted there is no place for RV parking.

Art R. Johnston, #5, 6950 - 120 Street was in attendance to speak in opposition to the proposal. Hestated that when he bought the unit in Cougar Creek he was under the impression there would be 61units in the new development. He is also concerned regarding traffic. He believes there may befatalities from traffic accidents.

Ed Old, 6505 - 3rd Avenue, Tsawwassen, Representative of the Applicant, was in attendance to speakon this proposal. He stated that from the beginning separate uses for the apartments and townhouseswere identified, and separate budgets were planned for the two developments. He stated he wassurprised to find out the strata owners were listed as the applicant. He noted that in terms of the traffiche has put up a bond for completion of a cul-de-sac from 120 Street. He believes there will be separateaccesses for each development. Mr. Old noted that the parking structure is larger to allow for additionalparking. He stated they are contributing to the beautification of 120 Street by adding additionallandscaping.

Terry Neithercut, #6, 6950 - 120 Street, was in attendance to speak in opposition to this By-law. She isconcerned regarding visitor parking. She noted that when she bought into the strata a year ago, shebelieved the new development would be 61 units not 70 units. She noted that she also believed shewould be living in an area where owners would be living in the units. She is concerned that the newdevelopment will have renters in the units.

Marc Drolet, #17, 6950 - 120 Street was in attendance to speak in opposition to this By-law. Hebelieves the application is misrepresented because the owners are not requesting the rezoning. He statedthat he is also concerned regarding the increased population density and believes it will have an impacton their quality of life. He commented that when they bought the unit it was with the understanding thatthere would be 61 units, not 70 units.

Connie Staley, 6304 - 135A Street, was in attendance to speak in opposition to this By-law. She notedthat she is concerned that youth will be attracted to the area and there will be an increase in traffic andvandalism. She stated that a pathway near her home is not recognized as a public pathway but is beingused as a public pathway. She commented there is a safety issue connected to the pathway andrequested it be recognized as a public pathway.

Rick Hammer, 6418 - 134 Street, was present to speak in opposition to this application. He stated hewas concerned regarding the traffic and garbage the development would bring in.

John W. Caines, 6442 - 134 Street, was present to speak in opposition to this application. He statedthere are three McDonald's within 3 miles. He is concerned regarding traffic and accidents.

Bill Hennessey, 6077 - 140 Street, was present to speak in opposition to this application. He noted thatthere is already litter in the area; the majority of which is fast-food containers. He suggestedMcDonalds join Surreys Adopt-a-Street program.

Brad Johannessen, 6328 - 135A Street, was present to speak in opposition to this application. He notedthat McDonalds will be "in his back yard." He is concerned regarding the pollution, noise at night, andtrash. He advised there are already three McDonald's in a short distance. Mr. Johannessen stated thathis house has been up for sale for three months, and his agent has advised that potential buyers havereported they do not want a McDonalds in their back yard." He questioned whether the RCMP CrimePrevention was contacted regarding CEPTED issues. Mr. Johannessen stated he believes the main issueis the drive-through.

Marion Scott, 13535 - 64 Avenue, was present to speak in opposition to this application. Shequestioned whether Council has any input into what goes into the two future commercial buildings onthe site.

Eric Hall, 13535 - 64 Avenue was present to comment on the proposed rezoning. He is concernedregarding night-time commercial development next to residential. Mr. Hall advised that he is notagainst McDonald's and complimented the proposed design. He suggested that a restrictive covenant beimplemented regarding the hours of operation, adding he was pleased to see the gas station had beendeleted from the proposal.

Rob Blackwell, Development Representative of McDonald's, was in attendance to speak on this By-law. He outlined the proposed commercial development in the area. He stated this is a smallerMcDonalds than Cloverdale or Guildford. Mr. Blackwell noted there will be no speakers on the drive-through to discourage noise. He also noted the garbage container will be attached to the building andlocked. He stated they have done a study and feel there is a demand for a family restaurant in the area. He advised that 64% of respondents to an open house were in favor of the development. Mr. Blackwellconcluded by stating they are committed to the neighborhood.

Councillor Hunt left the Public Hearing at 8:37 p.m.

In response to questions from Council, Mr. Blackwell stated that security personnel patrol the parkinglot regularly.

Councillor Hunt returned to the Public Hearing at 8:43 p.m.

Dave Lyons, 13458 - 62A Avenue, was in attendance to speak in opposition to this proposal. He statedthat there are a number of McDonalds in the area and another one is not needed. He is concernedregarding litter. He noted that there is a park nearby and the litter would end up in the park. He statedhe is concerned regarding the odor. Mr. Lyons stated he is also concerned regarding the traffic in thearea. He noted the poll from Angus Reid was undertaken in conjunction with Chevron and he indicatedhe would like to see a new poll taken. Mr. Lyons advised that the people he had spoken with were notin favour of this proposal.

Mayor McCallum noted that Arnold Neufeld expressed an opinion in writing and indicated that he was against the proposal.

Rick Cunningham, 1395 - 194 Street, was present and advised he is in favour of the existing operation,adding he can tolerate the existing noise as this is an agricultural area. By extending the operation,

Neil Cain, 1417 - 194 Street, was present to speak on this application. He stated that in the late 1960she applied to add additional buildings to his property and was denied. He noted he subsequentlyrelocated his farming operations to another municipality. Mr. Cain stated he was concerned regardingthe density of the area and the lot lines. He commented that his front door is located near the clean-outbins and is very dusty at times. He also stated the other end of the buildings should be used for clean-outs. He noted there are odors of rotting, decaying flesh.

Councillor Lewin and Councillor Watts returned to the Public Hearing at 9:18 p.m.

Mr. Cain stated his concerns are a result of past operational problems. He is also concerned regarding adecrease in property values.

Barbara Sherritt, 1399 - 194 Street, was in attendance to speak on this By-law. She stated she supportsthe City allowing legalization of the poultry farm but is in opposition to the proposed development. Shealso stated the concentration exceeds the stipulations of the By-law. She noted she represents 100% ofthe owners around the site. She is concerned regarding the noise, odor, traffic, and pollution. Ms.Sherritt noted these concerns are currently a problem at night. She requested a Restrictive Covenant, tolimit shipping trucks to the west and east boundaries of the property. She requested that the buffer on194 Street be maintained.

Arnold Neufeld, 19353 - 16 Avenue and 19475 - 16 Avenue, was present to speak in opposition to thisapplication. He stated he has a family operation across from the chicken operation. He advised he wasborn and raised on a farm and has compassion with farmers. Mr. Neufeld questioned the wisdom ofexpanding the operations when residential homes have been developed in the area over the past fewyears. He stated he is concerned regarding the flies, noise, and odor. He noted he has lived in the areafor 25 years. He advised it would be helpful to have the Health Department in attendance for theiropinion.
