JULY 3, 2017 BOARD OF SUPERVISORS MINUTES: 1354 The Straban Township Board of Supervisors met this date, as publicly advertised, at 7:00 p.m. in the meeting room of the Straban Township Municipal Building, 1745 Granite Station Road, Gettysburg, PA 17325 with Board Chair Tony Sanders presiding. Others in attendance were: Vice-Chair Fred Kammerer; Supervisor Sharon Hamm; Office Manager/Treasurer Robin Crushong; Solicitor John S. Phillips; and William Hill, Township Engineer. Others in attendance were: Robert Spangler; Joseph Erb, Jr., Esquire; and Mary Grace Keller, Gettysburg Times. Board Chair Tony Sanders led everyone with the Pledge to the Flag. Mr. Sanders informed the residents present of the next scheduled meetings: Board of Supervisors meeting on August 7, 2017; Planning Commission meeting on July 26, 2017; and Recreation Board meeting on July 17, 2017. There were no workshops held. Public Comment: None. Minutes: Mr. Kammerer moved, seconded by Ms. Hamm, to approve the June 5, 2017 meeting minutes as presented. Motion carried unanimously. Approve Bills: Ms. Hamm moved, seconded by Mr. Kammerer, to approve the June 15, 2017 and June 30, 2017 bills for payment. Motion carried unanimously. Reports: None. The Straban Township Board of Supervisors met this date, as publicly advertised, at 7:00 p.m. in the meeting room of the Straban Township Municipal Building, 1745 Granite Station Road, Gettysburg, PA 17325 with Board Chair Tony Sanders presiding. Others in attendance were: Vice-Chair Fred Kammerer; Supervisor Sharon Hamm; Office Manager/Treasurer Robin Crushong; Solicitor John S. Phillips; and William Hill, Township Engineer. are coordinating an Adams County Electronics Recycling Collection Event at the EMS Building on Saturday, September 9, 2017 from 10am to 2pm. Computers will cost $10; TV’s will cost $25. More information to follow.

Minutes of the White Run Regional Municipal Authority meeting held on May 17, 2017

Appearance: None. Old/New Business:

1. Ordinance No. 2017-02 amending Chapter 112 [Streets and Sidewalks] – Mr. Sanders moved, seconded by Mr. Kammerer to adopt Ordinance No. 2017-02 as presented. Motion carried unanimously.

2. Ordinance No. 2017-03 amending Chapter 117 [Subdivision of Land] – Mr. Sanders moved, seconded by Mr. Kammerer to adopt Ordinance No. 2017-03 as presented. Motion carried unanimously. 3. Ordinance No. 2017-04 amending Section 140-31A(2)(a) of the Zoning Ordinance – Mr. Sanders moved, seconded by Ms. Hamm to adopt Ordinance No. 2017-04 as presented. Motion carried unanimously. 4. Vacation of old Natural Springs Road – Solicitor Phillips informed the Board that around 2002 the township entered into an agreement to vacate the old Natural Springs Road with the Klinefelter and Kiessling properties. GMA and the property owners also entered into an easement agreement. This covered the first 200’ off of Route 30. The remaining portion of the old Natural Springs Road to where it connects to the new Natural Springs Road was never vacated by the Township so that portion is still considered public right-of-way. Members 1st is looking to develop the Kiessling and Klinefelter properties and use this as a driveway. The township will want to complete vacating the old right-of-way, except for the portion necessary to connect from the Natural Springs Road stub across the Giant property to facilitate both the Members 1st driveway and the possible future connection across the Gettysburg Senior Associates property to the Gettysburg Center. An Agreement between Gettysburg Senior Associates; CSC Gettysburg L.P.; Dorothy E. Kiessling and Nadine Klinefelter and the Township needs to be prepared and agreed upon. The action tonight will authorize Solicitor Phillips to review the agreement and move the matter forward. Ms. Hamm moved, seconded by Mr. Kammerer to authorize Solicitor Phillips to review the agreements required to vacate the old Natural Springs Road. Motion carried unanimously. 5. Reduction of Financial Security – Keller Farms – Mr. Hill stated that based upon multiple field inspections performed by his office for the purpose of verifying that the bonded items for the Keller Farms Subdivision/Plank Field Project were built according to the approved

plans, his office finds that a reduction in the required financial security is warranted. A few items remain to be completed including Basin, Erosion Controls, Wastewater Treatment Plant plus contingency. Mr. Hill’s office recommends that the Township consider a conditional reduction in the financial security in the amount of $219,204.15. The current bond reduction total ($219,204.15) adjusts the originally required financial security for this project from $334,790.51 to $115,586.36. It was noted that the previous financial security reduction requests, which were conditionally approved by the Board of Supervisors at its September 8, 2015 and December 7, 2015 Board of Supervisors meetings, were never finalized due to outstanding conditions and as such this release replaces those prior requests. It was further noted that at this time, as all improvements associated with the Keller Road roadway surface have been completed, a maintenance bond must be provided for those improvements. A Maintenance Surety Estimate, provided by Sharrah Design Group, establishes the amount of the maintenance bond at $23,126.18, which is 15% of the cost of the public improvements associated with Keller Road. The maintenance bond must be posted and shall have a term length of not less than eighteen (18) months. Mr. Kammerer moved, seconded by Ms. Hamm to approve the reduction of Financial Security for Keller Farms in the amount of $219,204.15 which adjusts the current required financial security for this project from $334,790.51 to $115,586.36, conditioned upon a separate maintenance bond in the amount of $23,126.18 with a term of not less than eighteen (18) months to be provided. Once the condition is met, the township will issue a formal reduction letter to reduce the amount of required financial security for the project. Motion carried unanimously. 6. Full Release of Financial Security – Southern States Crop Storage Building – Mr. Hill stated that based on multiple field inspections and site meetings, the improvements have been installed in accordance with the plan drawings. Mr. Hill’s office recommends the township consider a full release in the financial security in the amount of $4,427.50. It was noted that Southern States must continue to maintain the improvements, including the driveway swale/grading and vegetation within the infiltration basin to ensure runoff patterns are maintained in accordance with the Plans. Ms. Hamm moved, seconded by Mr. Kammerer to approve the full release of Financial Security for Southern States Crop Storage Building in the amount of $4,427.50. Motion carried unanimously. Land Use Reviews: Golden Arch LTD. (McDonald’s USA LLC) – Final Land Development Plan (1090 York Road)-Must act by 07/06/17

A request for extension was received by Joseph E. Erb, Jr., Esquire dated June 29, 2017. The Planning Commission recommended approval. Ms. Hamm moved, seconded by Mr.

Kammerer to approve the time extension to October 6, 2017. Motion carried unanimously. TKC CCXXX (Gettysburg Shopping Center) – Preliminary Land Development Plan (1530 York Road)-Must act by 07/25/17

A request for extension was received by Joseph J. Stein of Penn Terra dated June 29, 2017. The Planning Commission recommended approval. Ms. Hamm moved, seconded by Mr. Kammerer to approve the time extension to September 8, 2017. Motion carried unanimously. Public Comment: None. Questions from the Press: None. Adjournment: With no further business to come before the Board, Mr. Kammerer moved, seconded by Ms. Hamm to adjourn the meeting at 7:10 p.m. this date. Respectfully submitted, Robin K. Crushong Office Manager/Treasurer Note: Rita Wagaman came in at 7:25 p.m. after the meeting was concluded to talk to the Board about a Notice of Violation she received from the Zoning Officer for her property at 1550 Granite Station Road. Mr. Sanders addressed her issues, however, she was not satisfied with the answers so Mr. Sanders advised that she contact the Zoning Officer and sit down with him. The next regularly scheduled meeting for the Board of Supervisors of Straban Township will be held on Monday, August 7, 2017 at 7:00 p.m.
